(4) तथा धारा 64 के खंड (एनसी) द्वारा प्रित्त िजियों का प्रयोग करते हुए कुछ जनयमों के जनम् नजलजखत प्रारूप को प्रस्ट्ताजवत करती ह,ै इन्द्हें उक् त अजधजनयम की धारा 212 की उप-धारा (1) द्वारा यथापेजित उनके द्वारा प्रभाजवत होन ेकी संभावना वाले सभी व्यजियों की िानकारी के जलए प्रकाजित दकया िाता ह ैऔर एतिद्वारा नोरटस दिया िाता ह ै दक प्रारूप जनयमों को उस तारीख से तीस दिन की अवजध समाप्त होने के बाि जवचाराथग स्ट्वीकार कर जलया िाएगा जिसको सरकारी रािपत्र में यथा प्रकाजित इस अजधसूचना की प्रजतयां िनता के जलए उपलब्ध करायी िाती हैं। इन प्रारूप जनयमों से संबंजधत आपज तयां एवं सुझाव, यदि कोई हो, को संयुि सजचव (एमवीएल, पररवहन और टोल), सड़क पररवहन और रािमागग मंत्रालय, पररवहन भवन, संसि मागग, नई दिल्ली-110001 को अथवा ईमेल से: comments-morth@gov.in पर भेिा िा सकता ह।ै
1. संजिप् त नाम एवं प्रारंभ - (1) इन जनयमों को केन्द्रीय मोटर यान (........ संिोधन) जनयम, 2022 कहा िाएगा।

2. कें रीय मोटर यान जनयम, 1989 में (इसके बाि उि जनयमों के रूप में संिर्भगत) जनयम 58 के पश्चात जनम्नजलजखत जनयम अंतःस्ट्थाजपत दकया िाएगा, नामत: - "58ए वाहन स्ट्रैपपगं के जलए अियेता –
(1) मोटर वाहन के माजलक द्वारा पंिीकृत वाहन स्ट्रैपपगं सुजवधा (सुजवधा कें र) के माध्यम से वाहन स्ट्रैपपंग के जलए "अिेयता" प्रिान करन ेके जलए, मोटर वाहन (वाहन स्ट्रैपपंग सुजवधा का पंिीकरण और कायग) के जनयम, 2021, के तहत जनधागररत वाहन पोटगल पर फॉमग 28ए में एक इलेक्रॉजनक आवेिन उस राज्य के दकसी भी पंिीकरण प्राजधकरण को दकया िाएगा िहां वाहन वतगमान में पंिीकृत ह।ै
(2) उप-जनयम (1) के तहत आवेिन प्राप्त होने पर, पंिीकरण प्राजधकारी बिते कोई कर, चालान, आपराजधक मामला, वाहन से संबंजधत िरु्गटना का मामला लंजबत न हो और वाहन भाड़ा-रय/भाड़ारांजत/पट्टा करार के अधीन नहीं रखा गया हो, के अध्यधीन पोटगल के माध्यम से आवेिन िमा करन ेके छह दिनों के भीतर फॉमग 28बी में इलेक्रॉजनक रूप से वाहन स्ट्रैपपंग के जलए "अिेयता" प्रिान करेगा, इसमें जवफल होने पर आवेिन को स्ट्वीकृत माना िाएगा और पोटगल द्वारा वाहन स्ट्रैपपंग के जलए "अिेयता" प्रिान दकया गया माना िाएगा ।
(3) वाहन स्ट्रैपपगं की "अिेयता" इसके िारी होने की तारीख से 30 दिनों तक वैध होगी।
(4) िमा प्रमाणपत्र िारी होन ेकी जतजथ तक ऐसे वाहन के संबंध में हुई दकसी भी र्टना के जलए वाहन माजलक जिम्मेिार होगा।
(5) यदि पंिीकरण प्राजधकारी उि आवेिन को अस्ट्वीकार कर िेता है, तो वह वाहन माजलक को इसका जवजिष्ट कारण और आग ेकी कारगवाई की िानकारी प्रिान करेगा।
3. उि जनयमों में, जनयम 52क के बाि, जनम्नजलजखत खंड अतंःस्ट्थाजपत दकया िाएगा, नामत: - "52बी पिंीकरण के प्रमाण पत्र को स्ट्वजैछछक आधार पर रद्द करना –
(1) पंिीकरण के प्रमाण पत्र को रद्द करन े के जलए पंिीकृत वाहन स्ट्रैपपंग सुजवधा द्वारा एक इलेक्रॉजनक आवेिन, फॉमग 25ए में पोटगल पर उस राज्य के दकसी भी पंिीकरण प्राजधकारी को भेिा िाए िहां वाहन वतगमान में पंिीकृत ह,ै साथ ही वाहन स्ट्रैपपंग के जलए "अिेयता" तथा मोटर यान (वाहन स्ट्रैपपंग सुजवधा का पंिीकरण और कायग) जनयम, 2021 के तहत फॉमग 2 में िारी िमा प्रमाणपत्र संलग्न दकया िाए।
(2) उपजनयम (1) के तहत आवेिन प्राप्त होन ेपर, पंिीकरण प्राजधकारी पोटगल पर िमा प्रमाण पत्र और वाहन स्ट्रैपपंग के जलए "अिेयता" को सयाजपत करने के बाि, पोटगल पर आवेिन िमा करने के सात दिनों के भीतर पंिीकरण प्रमाण पत्र को रद्द कर िगेा। ऐसा न करन ेपर आवेिन को स्ट्वीकृत माना िाएगा।
(3) पंिीकरण के रद्द दकए िाने को वास्ट्तजवक समय में पोटगल पर ििागया िाएगा और यह मोटर वाहनों के राष्ट्रीय रजिस्ट्टर में स्ट्वतः अद्यतन हो िाएगा।
(4) वाहन स्ट्रैपपंग का प्रमाण पत्र सृजित होने के 30 दिनों के भीतर पंिीकृत वाहन स्ट्रैपपंग सुजवधा केन्द्र, मोटर यान (वाहन स्ट्रैपपंग सुजवधा के पंिीकरण और कायग) जनयम, 2021 के तहत फॉमग 4 में िारी वाहन स्ट्रैपपंग के प्रमाण पत्र के साथ पंिीकरण प्रमाण पत्र की वास्ट्तजवक प्रजत राज्य के दकसी भी पंिीकरण प्राजधकरण को भेिेगी जिसमें वाहन पंिीकृत हो।
4. उि जनयमों में, फामग 25 के बाि, जनम्नजलजखत फामग अंतःस्ट्थाजपत दकया िाएगा, यथा: - [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 "फामग 25ए" [िखेें जनयम 52बी] मोटर यान के पंिीकरण प्रमाण पत्र को रद्द करने का आवेिन सेवा में, पंिीकरण प्राजधकरण, ...........................................

Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (MVL, Transport & Toll), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001 or on the email: comments-morth@gov.in;
1. Short title and commencement. – (1) These rules may be called as the Central Motor Vehicles (…… Amendment) Rules, 2022.
(2) These rules shall come into force on the date of their final publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), after rule 58, the following rule shall be inserted, namely: - “58A No dues for vehicle scrapping – mailto:comments-morth@gov.in 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(1) An electronic application by the owner of a motor vehicle through the registered vehicle scrapping facility (facilitation centre), for the grant of "no dues" for vehicle scrapping, shall be made on Vahan portal as prescribed under the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021, in Form 28A to any registering authority of the state in which the vehicle is currently registered.
(2) On receipt of an application under sub-rule (1), the registering authority subject to no pendency of any tax, challan, criminal case, accidental case on vehicle and if vehicle is not held under hire-purchase/ hypothecation/ lease agreement, shall grant "no dues" for vehicle scrapping electronically in Form 28B, within six days of submission of application on the portal, failing which the application shall be deemed to be approved and "no dues" for vehicle scrapping shall be deemed to be granted through the portal.
(3) "No dues" for vehicle scrapping shall be valid up to 30 days from the date of its issuance.
(4) Vehicle owner shall be held responsible for any incident regarding such vehicle till the date of issue of Certificate of deposit.
(5) In case the registering authority rejects the said application, it shall provide the vehicle owner with specific reasons for the same and further course of action.”
3. In the said rules, after rule 52A, the following clause shall be inserted, namely: - “52B Voluntary cancellation of certificate of registration –
(1) An electronic application by the registered vehicle scrapping facility, for the cancellation of certificate of registration, shall be made on the portal to any registering authority of the state in which the vehicle is currently registered, in Form 25A, accompanied by "no dues" for vehicle scrapping and the Certificate of Deposit issued in Form 2 under the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021.
(2) On receipt of an application under sub-rule (1), the registering authority after verifying the certificate of deposit and "no dues" for vehicle scrapping on the portal, shall cancel the certificate of registration within seven days of submission of application on the portal, failing which the application shall be deemed to be approved.
(3) Cancellation of registration shall be reflected on the portal in real time and shall be auto updated in the national register of motor vehicles.
(4) Registered vehicle scrapping facility will send the physical copy of registration certificate along with Certificate of Vehicle Scrapping issued in Form 4 under the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021 to any registering authority of the state in which vehicle is registered, within 30 days of generation of Certificate of Vehicle Scrapping.”
4. In the said rules, after Form 25, the following form shall be inserted, namely: - “FORM 25A [See rule 52B] APPLICATION FOR CANCELLATION OF CERTIFICATE OF REGISTRATION OF A MOTOR VEHICLE To The Registering Authority, ...........................................
