1. संजिप् त िीर्गक एवं प्रारंभ - (1) इन जनयमों को मोटर वाहन (वाहन स्ट् रैपपंग सुजवधा पिंीकरण और कायग संिोधन) जनयम, 2022 कहा िाएगा।
(2) ये जनयम आजधकाररक रािपत्र में अंजतम रूप से प्रकाजित होने की तारीख से प्रवृ त होंगे।
2. मोटर यान (वाहन स्ट्रैपपंग सुजवधा पंिीकरण और कायग) जनयम, 2021 (इसके बाि उि जनयमों के रूप में उजल्लजखत) के, जनयम 3 के उप-जनयम (1) में खंड (ग) के स्ट् थान पर जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा, अथागत्:
"िमा प्रमाणपत्र' का ता पयग पंिीकृत माजलक द्वारा आग े की कारगवाई के जलए आरवीएसएफ को वाहन िमा करन े को पचंजहत करने के जलए पंिीकृत वाहन स्ट्रैपपंग सुजवधा (आरवीएसएफ) द्वारा िारी दकया गया प्रमाण पत्र ह।ै"
3. जनयम 4 में उप जनयम (2) के स्ट्थान पर जनम्नजलजखत को प्रजतस्ट् थाजपत दकया िाएगा, अथागत्:
"वाहन डेटाबेस तक सुरजित पहुचं के जलए संचालन िरुू करने से पहल ेपंिीकृत वाहन स्ट्रैपपंग सुजवधा के पास आईटी जसस्ट्टम के जलए आवश्यक साइबर सुरिा प्रमाणपत्र होना चाजहए।"
4. जनयम 4 के उप- जनयम (3) में, जनम्नजलजखत िब्ि, "साथ ही स्ट्थानीय पुजलस के साथ" का लोप दकया िाएगा।
5. जनयम 5 में उप जनयम (ि) के खंड (झ) के स्ट्थान पर जनम्नजलजखत को प्रजतस्ट् थाजपत दकया िाएगा, अथागत्:
"संचालन िरुू होने से पहले संस्ट् था के पास जनयम 4 के उप-जनयम (2) के तहत जन्िगष्ट आवश्यक साइबर सुरिा प्रमाणपत्र होंगे"
6. जनयम 6, उप जनयम (1) के खंड (ii) में जनम्नजलजखत िब्ि, "प्लस नब्बे दिन" का लोप दकया िाएगा
7. जनयम 7 में, उप-जनयम (5) के स्ट्थान पर जनम्नजलजखत को प्रजतस्ट् थाजपत दकया िाएगा, अथागत्:
"इस जनयम और जनयम 6 के तहत िारी पंिीकरण हस्ट्तांतरणीय नहीं होगा"
8. जनयम 10 और उससे संबंजधत प्रजवजष्टयों के स्ट्थान पर जनम्नजलजखत को प्रजतस्ट् थाजपत दकया िाएगा, अथागत्:- "स्ट्रैपपगं प्रदरया: - (1) आरवीएसएफ द्वारा सभी एंड-ऑफ-लाइफ वाहनों के संबंध में वाहनों की स्ट्रैपपगं जनम्नजलजखत प्रदरया द्वारा की िाएगी, अथागत्: - i. पंिीकृत माजलक वाहन के िमा और आग ेकी कारगवाई के जलए आरवीएसएफ या नाजमत संग्रहण कें द्र में प्रपत्र -2 के अनुसार वाहन पर जडजिटल रूप से आवेिन करेगा। आरवीएसएफ और नाजमत संग्रहण कें द्र भी नागररकों की सहायता करने के जलए प्रपत्र-2 के जडजिटल आवेिन के साथ सुजवधा कें द्र के रूप में कायग करेंगे। ii. दकसी प्रवतगन एिेंसी द्वारा िब्त दकए गए वाहनों, यदि वे जनयम (8) के अनुसार वाहन स्ट्रैपपंग के मानिडंों को पूरा करते हैं, को आरवीएसएफ को सौंप दिया िाएगा । iii. आरवीएसएफ, वाहन पोटगल के माध्यम से राष्ट्रीय अपराध ररकॉडग ब्यरूो द्वारा रखे गए चोरी के वाहनों के डेटाबेस के साथ स्ट्रैपपंग के जलए उपादित वाहनों के ररकॉडग का सयापन करेगा। iv. पंिीकृत वाहन स्ट्रैपपगं सुजवधा वाहन पोटगल के माध्यम से जडजिटल रूप से यह भी सयाजपत करेगी - क. दक संबंजधत वाहन के जलए इस अजधजनयम की धारा 51 की उप-धारा (1) के तहत आवश्यक मोटर वाहन के पंिीकरण के प्रमाण पत्र में भाड़ा-रय, पट्टा या भाड़ा रांती करार का जवजधवत जनवगहन दकया गया ह,ै ख. दक वाहन पर कोई राजि बकाया नहीं ह,ै और ग. दक वाहन को काली सूची में नहीं ड़ाला गया ह ै यदि वाहन इनमें से दकसी भी िांच में जवफल रहता ह,ै तो माजलक को प्रपत्र-2 के अनुसार जडजिटल आवेिन िमा करन े की अनुमजत नहीं िी िाएगी। v. आरवीएसएफ द्वारा सयापन के जलए पंिीकृत माजलक द्वारा प्रपत्र -2 के साथ जनम्नजलजखत िस्ट्तावेि अपलोड दकए िाएंगे - क. स्ट्वामी के स्ट्थायी खाता संख्या काडग की प्रजत;
ख. माजलक के बैंक खाते का रद्द दकया गया चेक;
[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 ग. यदि वाहन को माजलक द्वारा िमा नहीं दकया िाना ह,ै तो अजधकृत प्रजतजनजध के जलए प्रपत्र-2 के पैरा 5 के अनुसार स्ट्टांप पेपर पर प्राजधकरण पत्र लाग ू घ. अजधकृत प्रजतजनजध (यदि लागू हो) का पहचान प्रमाण िैसे पासपोटग, वोटर काडग, आधार काडग, ड्राइपवंग लाइसेंस या राज्य सरकार अथवा कें द्र सरकार द्वारा िारी फोटो पहचान पत्र;
ड. माजलक का पता प्रमाण िैसे जबिली जबल, पानी का जबल, लैंड लाइन टेलीफोन जबल या पाइप्ड कुककंग गैस जबल आदि; तथा च. एंड-ऑफ-लाइफ व्हीकल के साथ माजलक या अजधकृत प्रजतजनजध का जडजिटल फोटोग्राफ छ. माजलक की ओर से प्रपत्र -2 के पैरा 4 के अनुसार एक वचन, यह स्ट्वीकार करत े हुए दक जडजिटल प्रपत्र -2 आवेिन में िी गई सभी सूचना उसकी िानकारी के अनुसार सही ह।ै vi. िब वाहन पर प्रपत्र-2 के अनुसार जडजिटल आवेिन िमा दकया िाता है, तो इसे सीएमवीआर के जनयम 58क के अनुसार वाहन स्ट्रैपपंग के जलए अिेयता के जलए जडजिटल रूप से िेत्रीय पररवहन कायागलय को भेिा िाएगा। vii. िेत्रीय पररवहन कायागलय से वाहन स्ट्रैपपंग के जलए अिेयता प्राप्त होने पर, आरवीएसएफ प्रपत्र-2 के अनुसार जडजिटल आवेिन स्ट्वीकार करेगा और माजलक को स्ट्रैपपंग के जलए वाहन िमा करन े के जलए सूजचत करेगा। यदि िेत्रीय पररवहन कायागलय द्वारा वाहन स्ट्रैपपंग के जलए अिेयता प्रिान नहीं दकया िाता ह,ै तो आरवीएसएफ स्ट्रैपपगं के जलए आवेिन स्ट्वीकार नहीं कर सकता ह।ै viii. माजलक या उसके अजधकृत प्रजतजनजध को पंिीकरण के मूल प्रमाण पत्र के साथ वाहन को आरवीएसएफ को सौंपना होगा और प्रपत्र-2क के अनुसार एक जडजिटल वचन पर हस्ट्तािर करना होगा। आरवीएसएफ भी प्रपत्र-2ख के अनुसार एक जडजिटल वचन पर हस्ट्तािर करेगा। आरवीएसएफ द्वारा प्रपत्र-2 के अनुसार जडजिटल आवेिन की स्ट्वीकृजत के बाि वाहन माजलक द्वारा कोई कारगवाई नहीं करन ेकी जस्ट्थजत में, सीएमवीआर के जनयम 58क के अनुसार वाहन स्ट्रैपपंग के जलए अिेयता के साथ आवेिन की समय सीमा समाप्त हो िाएगी। ix. आरवीएसएफ, वाहन के जलए सहमत राजि का, आिाता खाता चेक द्वारा जडजिटल रूप से प्रेर्ण या भुगतान करेगा और ररकॉडग के जलए माजलक या उसके अजधकृत प्रजतजनजध से इसकी रसीि प्राप्त करेगा। x. आरवीएसएफ, माजलक या उसके अजधकृत प्रजतजनजध की उपजस्ट्थजत में पंिीकरण प्रमाण पत्र को जवकृत या उस पर छेि करेगा और स्ट्रैपपंग के जलए वाहन की स्ट्वीकृजत के प्रमाण के रूप में, प्रपत्र 2ग के अनुसार वाहन में, जडजिटल रूप से हस्ट्तािररत िमा प्रमाणपत्र िारी करेगा। xi. एक राज्य में स्ट्थाजपत आरवीएसएफ, दकसी भी पंिीकरण प्राजधकरण के अजधकार िेत्र के तहत दकसी भी राज्य या संघ राज् य िेत्र में पंिीकृत वाहनों को स्ट्वीकार और स्ट्रैप कर सकता ह।ै xii. पूरी प्रदरया को, दकसी भी वाहन पंिीकरण प्राजधकरण के स्ट्थान पर ध् यान दिए बगैर अजखल भारतीय आधार पर वाहन से िोड़ा िाएगा। xiii. माजलक के जलए नए वाहन की खरीि के जलए समय-समय पर घोजर्त प्रोसाहन और लाभ प्राप्त करन ेके जलए िमा प्रमाणपत्र एक आवश्यक और पयागप्त िस्ट्तावेि होगा। इस प्रमाणपत्र की वैधता िारी होने की तारीख से 2 वर्ग की होगी। xiv. िमा प्रमाणपत्र इलेक्रॉजनक रूप से व्यापार करन े योग्य होगा। प्रयेक नए माजलक के जलए िमा का हस्ट्तांतरण प्रमाणपत्र प्रपत्र 2घ के अनुसार रेपडंग प्लेटफॉमग पर तैयार दकया िाएगा। एक बार उपयोग दकए गए िमा प्रमाणपत्र को िेत्रीय पररवहन कायागलय या डीलर द्वारा उि प्रमाणपत्र के धारक को लाभ प्रिान करन ेवाल ेवाहन डेटाबेस में "जनरस्ट् त" के रूप में अंदकत दकया िाएगा। xv. िमा प्रमाणपत्र के एवि में खरीिे गए नए वाहन को पंिीकृत करन े वाल े िेत्रीय पररवहन कायागलय/डीलर, िमा प्रमाणपत्र को जडजिटल रूप से सयाजपत और प्रमाजणत करेंगे। xvi. आरवीएसएफ, वाहन के पंिीकरण के राज् य में सड़क पररवहन या िेत्रीय पररवहन कायागलय को वाहन स्ट्रैपपंग के प्रमाण पत्र के साथ मूल पंिीकरण प्रमाण पत्र (जवकृत या जछदद्रत) के हस्ट्तांतरण की प्रदरया को सुजवधािनक बनाएगा, तादक वाहन पंिीकरण को सीएमवीआर के जनयम 52ख के अनुसार जनरस्ट् त दकया िा सके। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] xvii. जनयम 11 के तहत िारी वाहन स्ट्रैपपंग प्रमाणपत्र िारी होने की तारीख से छह महीने की अवजध के जलए चेजसस नंबर का कटा हुआ टुकड़ा आरवीएसएफ के पास सुरजित अजभरिा में होगा। xviii. जनरीिण के िौरान ररकॉडग और िांच के जलए आरवीएसएफ अपने पास िस साल की अवजध तक सभी िस्ट्तावेिों की जडजिटल स्ट्कैन कॉपी को रखेगा। xix. आरवीएसएफ यह सुजनजित करेगा दक एडं-ऑफ-लाइव वाहनों और एआईएस-129 के पयागवरणीय रूप से ध् वजन प्रबंधन के जलए सीपीसीबी दििाजनिेिों के अनुसार स्ट्रैप दकए गए वाहन के खतरनाक कलपुिों का जनपटान या पुन:चरण या जनपटान दकया गया ह।ै xx. िब तक ईंधन, तेल, एंटीदिि और अन्य गैसों, तरल पिाथों आदि को जनकाल कर प्रमाजणत मानक कंटेनरों में एकत्र नहीं दकया िाता ह,ै तब तक वाहनों को स्ट्रैप नहीं दकया िाएगा। xxi. स्ट् रैप दकए गए वाहनों का जडजिटल रजिस्ट्टर प्रपत्र-3 में रखा िाएगा।
9. जनयम 11 के उप जनयम 1 में जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा, अथागत्:- "आरवीएसएफ, आवश्यक कारगवाई पूणग करने के पश् चात,् स्ट् रैपपंग यान का एक जडजिटल प्रमाण पत्र िारी करेगा जिसके अंतगगत प्ररुप-4 में चेजसस के कट आउट का एक जडजिटल फोटो, रा् रीय रजिस्ट् टर, वाहन डेटाबेस को उद्यतन करन ेऔर राज्य सरकार या संघ राज् य सरकार के सिम प्राजधकारी द्वारा सीएमवीआर के जनयम 52ख के अनुसार अजभलेखों को उद्यतन करन ेहते ुसंसूजचत करन ेके जलए भी ह।ै
10. जनयम 13 के उप जनयम 12 में जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा, अथागत:् “दकसी आरवीएसएफ द्वारा स्ट्रैपपंग याडग के अलावा दकसी अन्य स्ट्थान पर भी संग्रहण कें द्र स्ट्थाजपत दकया िा सकता ह।ै यदि संग्रहण कें द्र प्रिरू्ण जनयंत्रण और जडसमेंटपलंग िैसे कायगकलाप करता है, तो आरवीएसएफ के जलए लाग ू आवश्यकताएं ऐसे संग्रहण कें द्र पर भी लाग ूहोंगी।
11. प्रपत्र-1 के स्ट् थान पर जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा, अथागत्:

04.03.2022.
Objections or suggestions, if any, may be sent to the Joint Secretary (Transport), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi - 110 001 or by email at <comments-morth@gov.in> within the period specified above;
Objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period aforesaid will be considered by the Central Government.
1. Short title and commencement- (1) These rules may be called the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility Amendment) Rules, 2022.
(2) These rules shall come into force on the date of final publication in the official Gazette.
2. In the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021, (hereinafter referred as said rules), in rule 3 sub rule (1) for clause (c), the following shall be substituted, namely:
“‘Certificate of Deposit’ means the certificate issued by the Registered Vehicle Scrapping Facility (RVSF) to recognise the submission of the vehicle from the registered owner to the RVSF for further treatment.”
3. In rule 4 for subrule (2), the following shall be substituted, namely:
“The Registered Vehicle Scrapping Facility must have necessary cyber security certifications for the IT Systems before start of operation for safe access to the VAHAN database.”
4. In rule 4 subrule (3), the following words, “as well as with the local Police” shall be omitted 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
5. In rule 5 for sub rule (h) clause (i), the following shall be substituted, namely:
“The entity shall have necessary cyber security certifications specified under sub-rule (2) of rule 4 before start of operation”
6. In rule 6, sub rule (1) clause (ii), the following words, “plus ninety days” shall be omitted
7. In rule 7, for subrule (5), the following shall be substituted, namely:
“The registration issued under this rule and rule 6 shall not be transferable”
8. For rule 10 and the entries relating thereto, the following shall be substituted, namely: - “Scrapping Procedure: - (1) The scrapping of vehicles shall be carried out by an RVSF in respect of all End-of- Life Vehicles, by the following procedure, namely: - i. The registered owner shall apply digitally on Vahan as per Form-2 to the RVSF or the designated Collection Centre for deposit and further treatment of the vehicle. The RVSF and the designated Collection Centre shall also act as facilitation centres to support citizens with digital application of Form-2.
ii. Vehicles impounded by an enforcement agency shall be handed over to the RVSF, if they meet the criteria for vehicle scrapping as per rule (8).
iii. The RVSF shall verify the records of the vehicles produced for scrapping with the database of the stolen vehicles held by National Crime Records Bureau through the Vahan portal.
iv. The Registered Vehicle Scrapping Facility shall also digitally verify through the Vahan portal - a. that the hire-purchase, lease or hypothecation agreement in the certificate of registration of a motor vehicle required under sub-section (1) of section 51 of the Act has been duly discharged for the concerned vehicle, b. that there are no pending dues on the vehicle, and c. that the vehicle has not been blacklisted If the vehicle fails any of these checks, the owner shall not be allowed to submit the digital application as per Form-2.
v. The following documents shall be uploaded along with Form-2 by the registered owner for verification by the RVSF - a. copy of the Permanent Account Number card of the owner;
b. cancelled cheque of the bank account of the owner;
c. letter of authorization on stamp paper for the authorized representative as per para 5 of Form-2, applicable if the vehicle is not to be submitted by the owner d. identity proof of the authorized representative (if applicable) such as passport, voter card, Aadhar card, driving license or photo identity card issued by the State Government or the Central Government;
e. address proof of the owner such as electricity bill, water bill, land line telephone bill or piped cooking gas bill etc; and f. digital photograph of the owner or authorized representative with the End-of-Life Vehicle g. an undertaking, as per para 4 of Form-2 from the owner acknowledging that all information furnished in digital Form-2 application is true as per his knowledge vi. Once the digital application as per Form-2 is submitted on Vahan, it shall be sent digitally to the regional transport office for no dues for vehicle scrapping as per rule 58A of CMVR.
vii. On receiving the no dues for vehicle scrapping from the regional transport office, the RVSF shall accept the digital application as per Form-2 and inform the owner to submit the vehicle for scrapping. If the no dues for vehicle scrapping is not provided by the regional transport office, the RVSF cannot accept the application for scrapping.

The owner or his authorized representative shall submit the vehicle along with the original certificate of registration to the RVSF and sign a digital undertaking as per Form-2A. The RVSF shall also sign a digital undertaking as per Form-2B. In case of no action by the vehicle owner after acceptance of digital application as per Form-2 by the RVSF, the application shall expire along with the no dues for vehicle scrapping as per Rule 58A of CMVR. The RVSF shall digitally remit or pay by an account payee cheque, the agreed consideration for the vehicle and obtain a receipt for the same from the owner or his authorized representative for record.
ix. The RVSF shall deface or punch the certificate of registration in the presence of the owner or his authorized representative and issue a digitally signed Certificate of Deposit in Vahan, as per Form 2C, as evidence of acceptance of vehicle for scrapping.
x. The RVSF established in a State may accept and scrap the vehicles registered in any of the State or Union Territory under the jurisdiction of any Registration Authority.
xi. The whole process shall be seamlessly linked with VAHAN on pan India basis irrespective of the location of any vehicle registering authority.
xii. The Certificate of Deposit shall be a necessary and sufficient document for the owner to avail incentives and benefits for purchase of a new vehicle as may be declared from time to time. The validity of this certificate shall be 2 years from the date of issuance.
xiii. The Certificate of Deposit shall be electronically tradeable. The transfer Certificate of Deposit shall be generated on the trading platform for each new owner as per Form 2D. The Certificate of Deposit once utilised shall be marked “Cancelled” in the Vahan database by the regional transport office or dealer providing the benefits to the bearer of the said certificate.
xiv. The regional transport office/dealer registering the new vehicle purchased against the Certificate of Deposit shall verify and authenticate the Certificate of Deposit digitally.
xv. The RVSF shall facilitate the process of transmission of original certificate of registration (defaced or punched) along with Certificate of Vehicle Scrapping to road transport or regional transport office, in the state of registration of the vehicle, to get the vehicle registration cancelled as per rule 52B of CMVR.
xvi. The RVSF shall have the cut piece of the chassis number in safe custody for a period of six months from the date of issue of Certificate of Vehicle Scrapping issued under rule 11.
xvii. The RVSF shall maintain digital scanned copy of all documents for a period of ten years for record and examination during inspection.
xviii. The RVSF shall ensure that removal or re-cycling or disposal of hazardous parts of the scrapped vehicle is done as per CPCB guidelines for Environmentally Sound Management of End-of-Live Vehicles and AIS-
129.
xix. Vehicles shall not be scrapped until the fuel, oil, antifreeze, and other gases, fluids etc. are drained and collected in certified standard containers.
xx. A digital register of vehicles scrapped shall be maintained in Form-3.”
9. In rule 11 subrule 1, the following shall be substituted, namely: - “The RVSF, after completing the necessary treatment, shall issue a digital Certificate of Vehicle Scrapping including a digital photograph of the cut out of the chassis, in Form-4 to update the VAHAN Database and inform the competent authority of the State Government or Union territory Government for updating of records as per rule 52B of CMVR.”
10. In rule 13 subrule 12, the following shall be substituted, namely:
“Collection centre may be established by an RVSF at any other place as well, other than the Scrapping Yard. If collection centre undertakes activities such as depollution and dismantling, then the requirements applicable for RVSF shall also be applicable to such collection centre”
