PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और रािमागग मतं्रालय अजधसचूना नई दिल्ली, 5 मई, 2022 सा.का.जन. 340(अ).—कें द्रीय मोटर यान जनयम, 1989 जनज्ललजखत प्रारूप जनयम, जिसे कें द्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 39 द्वारा प्रित्त िजियों का प्रयोग करते हुए कुछ जनयमों में और संिोधन करने का प्रस्ट्ताव करती ह,ै को उि अजधजनयम की धारा 212 की उप-धारा (1) द्वारा यथापेजित उनके द्वारा संभाव्य प्रभाजवत सभी व्यजियों की िानकारी के जलए प्रकाजित दकया िाता ह ैऔर एतिद्वारा नोरटस दिया िाता ह ैदक उि प्रारूप जनयमों पर उस तारीख से िब इस अजधसूचना की प्रजतयां, भारत के रािपत्र में यथाप्रकाजित, आम िनता को उपलब्ध कराई िाती हैं, से तीस दिन की अवजध की समाजि के पश्चात् जवचार दकया िाएगा। आिेप या सुझाव, यदि कोई हों, संयुि सजचव (एमवीएल, पररवहन, टोल), सड़क पररवहन और रािमागग मंत्रालय, पररवहन भवन, संसि मागग, नई दिल्ली- 110001 को भेिे िा सकेंगे अथवा comments-morth@gov.in; पर ई-मेल दकए िा सकें गे। आिेप या सुझाव, िो दकसी व्यजि से उि प्रारूप जनयमों के संबंध में इस प्रकार जवजनर्िगष्ट अवजध की समाजि के भीतर प्राि दकए िाते हैं, पर कें द्रीय सरकार द्वारा जवचार दकया िाएगा;
प्रारूप जनयम
1. (1) इन जनयमों को कें द्रीय मोटर यान (....... संिोधन) जनयम, 2021 कहा िा सकता ह।ै

2. केलद्रीय मोटर वाहन जनयम, 1989 (जिसे इसमें इसके पश्चात् उि जनयम कहा गया ह)ै में, जनयम 33 के स्ट्थान पर, जनम्नजलजखत जनयम को प्रजतस्ट्थाजपत दकया िाएगा, अथागत्:- "33. व्यवसाय प्रमाण पत्र की आवश्यकता - व्यवसाय प्रमाण पत्र उन मोटर वाहनों के जनमागताओं या मोटर वाहनों के डीलरों या जनयम 126 में जनर्िगष्ट परीिण एिेंजसयों या मोटर वाहनों के आयातकों या कें द्र सरकार द्वारा जनर्िगष्ट दकसी भी संस्ट्था (ओं) के जलए आवश्यक ह,ै जिनके पास ऐसे वाहन हैं िो न तो पंिीकृत हैं न ही अस्ट्थायी रूप से पंिीकृत हैं। ”
3. उि जनयमों में, जनयम 33 के पश्चात,् जनम्नजलजखत जनयम अंत:स्ट्थाजपत दकए िाएंगे, अथागत् – "33ए. पिंीकरण स ेछूट की ितग - धारा 39 के परंतुक के प्रयोिन के जलए, जनयम 33 में जनर्िगष्ट दकसी संस्ट्था (ओं) के कब्िे में का मोटरयान रजिस्ट्रीकरण की आवश्यकता से इस ितग के अधीन छूट प्राि होगी दक वह उस रजिस्ट्रीकताग प्राजधकारी से व्यवसाय प्रमाणपत्र प्राि करता ह ै जिसकी उस िेत्र में अजधकाररता ह ैजिसमें संस्ट्थाओं को इस अध्याय के अनुसार कारोबार का स्ट्थान ह।ै
4.उि जनयमों में, जनयम 34 में,-
(i) उप जनयम (1) में, - (क) िब्िों "व्यापार प्रमाण पत्र बनाया िाएगा" के बाि िब्ि "इलेक्ट्रॉजनक रूप से वाहन पोटगल पर" अतं:स्ट्थाजपत दकए िाएंगे। (ख) िब्िों "जनयम 81 में जवजनर्िगष्ट फीस" के बाि िब्ि "वाहन पोटगल पर इलेक्ट्रॉजनक रूप से प्रस्ट्ततु" अंत:स्ट्थाजपत दकए िाएंगे।
(ii) उप जनयम (2) में, "पृथक्" िब्ि का जवलोपन दकया िाएगा।
(iii) उप जनयम (2) के बाि, जनम्नजलजखत उप जनयम अंतःस्ट्थाजपत दकया िाएगा, अथागत:्- "(3) आवश्यक व्यवसाय प्रमाण पत्र जचलहों की संख्या आवेिन में जनर्िगष्ट की िाएगी।"
5. उि जनयमों में, जनयम 35 के स्ट्थान पर, जनम्नजलजखत जनयम अंत:स्ट्थाजपत दकए िाएगं,े अथागत्:- "35. व्यवसाय प्रमाणपत्र का अनिुान या नवीनीकरण। -
(1) दकसी यान के संबंध में दकसी व्यवसाय प्रमाणपत्र के दिए िाने या नवीनीकरण के जलए दकसी आवेिन की प्राजि पर रजिस्ट्रीकताग प्राजधकारी, यदि संतुष्ट हो िाता ह,ै ऐसे आवेिन की प्राजि की तारीख से पंद्रह दिनों के भीतर फॉमग 17 में आवेिक को व्यवसाय प्रमाण पत्र, पोटगल पर इलेक्ट्रॉजनक रूप से, डाउनलोड करन ेयोग्य और प्प्रंट करन ेयोग्य रूप, में िारी कर सकता ह।ै व्यवसाय प्रमाणपत्र संख्या इस प्रकार होगी - एबी 12 ए 1234 टीसी एबी- राज्य कोड ििागता ह,ै 12- आरटीओ कोड ििागता ह,ै ए. - जनयम 34(2) में जनधागररत वाहन की श्रणेी की क्रम सखं्या ििागता ह ैअथागत ए स ेिे तक, 1234- चार अंकों की जवजिष्ट पहचान संख्या ििागता ह ैजिसे संबंजधत प्राजधकारी द्वारा व्यवसाय प्रमाण पत्र धारक को सौंपा िाना ह,ै टीसी- व्यवसाय प्रमाणपत्र ििागता ह,ै एक व्यवसाय रजिस्ट्रीकरण जचलह और संख्यांक होगा जिसके बाि चार अंकों के अंक 0001 से 9999 तक जनम्नानुसार होंगे- एबी 12 ए 1234 टीसी 0001 [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3
(2) व्यवसाय प्रमाणपत्र के जलए दकसी भी आवेिन को पंिीकरण प्राजधकारी द्वारा तब तक अस्ट्वीकार नहीं दकया िाएगा िब तक दक आवेिक को सुनवाई का अवसर नहीं दिया िाता ह ैऔर जलजखत रूप में इस तरह के इनकार के कारण नहीं दिए िाते हैं।"
6. उि जनयमों में, जनयम 35 के बाि, जनम्नजलजखत जनयम अतं:स्ट्थाजपत दकए िाएगं,े अथागत्:-
(i) “35क. अजतररि व्यवसाय रजिस्ट्रीकरण जचह्न के जलए आवेिन। -
1. अजतररि व्यवसाय रजिस्ट्रीकरण जचह्न प्रिान करन े के जलए आवेिन प्रपत्र 17ए में पोटगल पर इलेक्ट्रॉजनक रूप से पंिीकरण प्राजधकारी को दकया िाएगा जिसन ेव्यवसाय प्रमाणपत्र प्रिान दकया था और जनयम 81 में जनर्िगष्ट उजचत िुल्क के साथ होगा। िलु्क पोटगल पर इलेक्ट्रॉजनक रूप से िमा दकया िाएगा।
2. एक व्यवसाय प्रमाण पत्र के संबंध में अजतररि व्यवसाय पंिीकरण जचह्न प्रिान करन ेके जलए एक आवेिन प्राि होन े पर, अगर पंिीकरण प्राजधकारी इस बात से संतुष्ट ह ैदक आवेिक के पास एक वैध व्यवसाय प्रमाण पत्र ह ैऔर अजतररि व्यवसाय पंिीकरण जचह्न की आवश्यकता ह,ै आवेिक को इस तरह के आवेिन की प्राजि की तारीख से सात दिनों के भीतर फॉमग 17बी में अजतररि व्यवसाय पंिीकरण जचह्न िारी कर सकता ह।ै"
(ii) “35ख. व्यवसाय प्रमाण पत्र में व्यवसाय के स्ट्थान के पत ेमें पररवतगन की सचूना —
1. यदि व्यवसाय प्रमाण पत्र में जवजनर्िगष्ट व्यवसाय का स्ट्थान बिल िाता ह,ै तो व्यवसाय प्रमाण पत्र धारक जनयम 81 में जवजनर्िगष्ट उजचत िुल्क के साथ पोटगल पर इलके्ट्रॉजनक रूप से फॉमग 17सी में तुरंत इस तरह के पररवतगन के बारे में उस प्राजधकारी को सूजचत करेगा जिसने व्यवसाय प्रमाण पत्र प्रिान दकया ह।ै
2. व्यवसाय के स्ट्थान में पररवतगन की सूचना प्राि होन ेपर, पंिीकरण प्राजधकारी, यदि संतुष्ट हो दक आवेिक के पास एक वैध व्यवसाय प्रमाण पत्र ह,ै व्यवसाय प्रमाण पत्र में नया पता ििग कर सकता है।
7. उि जनयमों के, जनयम 37 में, “बारह महीने” िब्िों के जलए “पांच वर्ग” िब्िों को अंत :स्ट् थाजपत दकया िाएगा ।
8. उि जनयमों के, जनयम 38 को जवलोजपत दकया िाएगा।
9. उि जनयमों के, जनयम 39 में, -
(i) उप -जनयम ) 1 (में, "ऑटोमोबाइल या ऑटोमोबाइल सहायक के डीलर या जनमागता या जनयम 126 में जवजनर्िगष्ट एक परीिण एिेंसी" िब्िों को “व्यवसाय प्रमाण पत्र धारक” िब्िों द्वारा प्रजतस्ट्थाजपत दकया िाएगा।
(ii) उप-जनयम (2) को जनम्नजलजखत उप-जनयम द्वारा प्रजतस्ट्थाजपत दकया िाएगा, अथागत:्- "(2) व्यवसाय रजिस्ट्रीकरण जचह्न जनयम 51 में जवजनर्िगष्ट आयामों के अनुसार लाल पृष्ठभूजम पर सफेि रंग में होगा और मोटर यान के आग ेऔर पीछे प्रिर्िगत दकया िाएगा।"
10. उि जनयमों के, जनयम 40 के िीर्गक में “व्यवसाय प्रमाण पत्र या व्यवसाय रजिजस्ट्रकरण जचलह और संख्यांक के उपयोग पर जनबंधन” िब्िों को “व्यवसाय रजिजस्ट्रकरण जचलह के उपयोग पर जनबंधन” िब्िों द्वारा प्रजतस्ट्थाजपत दकया िाएगा।
11. उि जनयमों के, जनयम 40 में, (क) “प्रमाण पत्र” िब्िों को “रजिस्ट्रीकरण जचलह” िब्िों द्वारा प्रजतस्ट्थाजपत दकया िाएगा। (ख) “प्रमाण पत्र या संख्यांक” िब्िों को “व्यवसाय रजिस्ट्रीकरण जचलह” िब्िों द्वारा प्रजतस्ट्थाजपत दकया िाएगा।
12. उि जनयमों के, जनयम 41 में, "उदे्दश्य जिसके जलए व्यवसाय प्रमाण पत्र के साथ मोटर वाहन का उपयोग दकया िा सकता ह"ै िब्िों को "उदे्दश्य जिसके जलए व्यवसाय रजिस्ट्रीकरण जचह्न वाले मोटर वाहन का उपयोग दकया िा सकता ह"ै िब्िों द्वारा प्रजतस्ट्थाजपत दकया िाएगा। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
13. उि जनयमों के, जनयम 41 में, (क) “व्यवसाय प्रमाण पत्र” िब्िों को “व्यवसाय रजिजस्ट्रकरण जचलह” िब्िों द्वारा प्रजतस्ट्थाजपत दकया िाएगा। (ख) उपवाक्ट्य (ि) को जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत दकया िाएगा, अथागत:् - “(ि) मोटरयान या दकसी ऐसे अलय स्ट्थान की प्रििगनी को िहां यान जवक्रय के जलए प्रस्ट्थाजपत दकये िात ेहैं या दकये िा रह ेहैं, अग्रसर होने या उससे वापसी के जलए; या।”
14. उि जनयमों के, जनयम 43 के िीर्गक में, "व्यवसाय प्रमाणपत्र का रजिस्ट्टर" िब्िों को "व्यवसाय रजिस्ट्रीकरण जचह्नों का रजिस्ट्टर" िब्िों द्वारा प्रजतस्ट्थाजपत दकया िाएगा।
15. उि जनयमों के, जनयम 43 के पश्चात,् जनम्नजलजखत जनयम अंत:स्ट्थाजपत दकए िाएंगे, अथागत्:- "43क. इलवेंरी का रजिस्ट्टर- व्यवसाय प्रमाण पत्र रखन ेवाले मोटर वाहन के प्रत्येक डीलर को पोटगल पर फॉमग 19क में इलेक्ट्रॉजनक रूप से मोटर वाहनों की इलवेंरी का एक रजिस्ट्टर रखना होगा।
16. उि जनयमों के, जनयम 44, को जनम्नजलजखत जनयमों द्वारा प्रजतस्ट्थाजपत दकया िाएगा, अथागत्:- “44. व्यवसाय प्रमाण पत्र का जनल्बन या रद्द दकया िाना – यदि रजिस्ट्रीकताग प्राजधकारी के पास यह जवश्वास करने का कारण ह ैदक दकसी व्यवसाय प्रमाणपत्र के धारक ने जनयम 39 से 43क तक के उपबलधों का अनुपालन नहीं दकया ह,ैयथोजचत प्रमाणों के साथ धारा 213 के अधीन स्ट्थाजपत मोटरयान जवभाग के जवभागाध्यि को उि प्रावधानों के गरै-अनुपालन के तथ्य को ररपोटग कर सकेगा। जवभागाध्यि व्यवसाय प्रमाण पत्र धारक को सुनवाई का अवसर िनेे के पश्चात,् उसके द्वारा धाररत व्यवसाय प्रमाणपत्र को जनलंजबत या रद्द कर सकेगा।.”
17. उि जनयमों के, जनयम 45 में, "धारा 213 के अधीन स्ट्थाजपत मोटरयान जवभाग के प्रमखु" िब्िों को "राज्य पररवहन अपीलीय लयायाजधकरण या संबंजधत राज्यों / संघ राज्य िेत्रों द्वारा इस संबंध में तय दकए गए दकसी भी प्राजधकरण" िब्िों द्वारा प्रजतस्ट्थाजपत दकया िाएगा।
18. उि जनयमों के, जनयम 81 में, क. ताजलका में, क्रमांक 1 के स्ट्थान पर, जनम्नजलजखत प्रजवजष्टयां प्रजतस्ट्थाजपत की िाएंगी, अथागत्:
1 प्रत्येक व्यवसाय रजिस्ट्रीकरण जचह्न या प्रत्येक व्यवसाय रजिस्ट्रीकरण जचह्न के अजतररि अनुिान के संबंध में व्यवसाय प्रमाण पत्र का अनिुान या नवीनीकरण:
34(1), 35क(1) (क) मोटरसाइदकल िो हिार पांच सौ रुपए (ख) अनुकूजलत वाहन पांच सौ रुपए (ग) अलय पांच हिार रुपए ख. ताजलका में, क्रमांक 2 के स्ट्थान पर जनम्नजलजखत क्रमांक रखा िाएगा, अथागत:् “2 व्यवसाय प्रमाण पत्र में व्यवसाय के स्ट्थान के पत े में पररवतगन की सूचना एक हिार रुपए 35ख (1)”
19. उि जनयमों में, प्रपत्र 16 में, - (क) िीर्गक में , "व्यवसाय प्रमाण पत्र के अनुिान या नवीनीकरण के जलए आवेिन पत्र" िब्िों के पश्चात "और व्यवसाय पंिीकरण जचह्न" िब्ि अंतःस्ट्थाजपत दकये िायेगें। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (ख) पैरा 1 में , "प्रमाणपत्रों" िब्िों के स्ट्थान पर "प्रमाणपत्र" िब्ि प्रजतस्ट्थाजपत दकए िाएंगे। (ग) क्रम संख्या के बाि 3, जनम्नजलजखत क्रमांक सं. अंतःस्ट्थाजपत दकए िाएगंे अथागत:्- "3क .व्यवसाय के स्ट्थान का पता" (घ) क्रम संख्या 4 में, "ऑटोमोबाइल के जनमागता या डीलर" िब्िों के जलए "मोटर वाहनों के जनमागता या मोटर वाहनों के डीलर" िब्िों को प्रजतस्ट्थाजपत दकया िाएगा। (ड.) क्रम संख्या 4 में , "उि जनयमों के जनयम 126 के तहत जनर्िगष्ट एक परीिण एिेंसी" िब्िों से पहले "या ऑटोमोबाइल सहायक" िब्ि जवलोप दकये िायेगें। (च) क्रम संख्या 4 में, "उि जनयमों के जनयम 126 के तहत जनर्िगष्ट एक परीिण एिेंसी" िब्िों के बाि और कोष्ठक में "या मोटर वाहनों के आयातक या कें द्र सरकार द्वारा जनर्िगष्ट दकसी भी इकाई, (यदि आवेिक के पास वाहन जनमागता द्वारा िारी प्राजधकरण पत्र मोटर वाहन के डीलर के पास ह ै तो इसे को आवेिन के साथ प्रस्ट्ततु दकया िाएगा)” अंतःस्ट्थाजपत दकया िायेगा। (छ) क्रम संख्या 4 में, िब्ि और अंक "मोटर वाहनों में, वाहनों के स्ट्वीकृत मर्मतकताग, वाहनों के जलए ढााँचा जनमागण में लग ेहुए, भाडे़ की खरीि / पटे्ट / वाहनों को जगरवी रखना के व्यवसाय में लगे हुए हैं।" िब्िों का जवलोप दकया िायेगा। (ि) क्रम संख्या 5, 6, 7 और 8 जवलोप कर दिए िायेगे। (झ) "घोर्णा" िब्िों के पहल ेजनम्नजलजखत ताजलका अंतःस्ट्थाजपत की िाएगी, अथागत:्- कं्र.सं. वाहन की श्रेणी आवश्यक व्यवसाय पंिीकरण जचलहों की संख्या भुगतान की गई िुल्क राजि पत्र संख्या (त्र) "आवेिक के हस्ट्तािर" िब्िों के बाि "या आवेिक के जडजिटल/ई हस्ट्तािर" िब्ि और जचलह िोडे़ िाएंगे।
20. उि जनयमों में, प्रपत्र 17 में, - (क) िीर्गक में , "व्यवसाय पंिीकरण का प्रपत्र" िब्िों के बाि "और व्यवसाय रजिस्ट्रेिन जचलह" िब्ि अतंःस्ट्थाजपत दकया िायेगा। (ख) िीर्गक में , िब्ि, जचलह और कोष्ठक "(70 जमलीमीटर के व्यास के आकार में मुदद्रत दकए िाने के जलए)" का जवलोप दकया िाएगा। (ग) क्रम संख्या 1 में, "प्रमाणपत्र की क्रम संख्या" िब्िों के स्ट्थान पर "व्यवसाय प्रमाणपत्र संख्या" िब्ि अंतःस्ट्थाजपत दकया िायेगा। (घ) क्रम संख्या 2 पश्चात, जनम्नजलजखत क्रमांक सं. अंतःस्ट्थाजपत दकए िायेगे, अथागत:्- "2ए .व्यवसाय के स्ट्थान का पता" (ड.) क्रम संख्या 3, 4, 6 और 7 जवलोप दकए िाएगंे। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (च) क्रम संख्या 5 के बाि जनम्नजलजखत ताजलका अंतःस्ट्थाजपत की िाएगी, अथागत:् - क्र.स. वाहन की श्रेणी आवंरटत व्यवसाय पंिीकरण जचलहों की संख्या भुगतान की गई िलु्क राजि रसीि संख्या 0001 से **** (छ) िब्ि, जचलह "िेत्र/" का जवलोप दकया िाएगा । (ि) "राज्य के रजिस्ट्रेंिन प्राजधकरण" िब्िों के पश्चात , िब्ि और कोष्ठक "(जडजिटल रूप से हस्ट्तािररत)" अतंःस्ट्थाजपत दकया िाएगा। ( i ) क्ट्यूआर कोड प्रपत्र 17 में अंतःस्ट्थाजपत दकया िाएगा
21. उि जनयमों में, प्रपत्र 17 में, अनुसूची, और इसके तहत सििृ प्रजवजष्टयों का जवलोप दकया िाएगा।
22. उि जनयमों में, प्रपत्र 17 के बाि, जनम्नजलजखत प्रपत्रों को अंत:स्ट्थाजपत दकया िाएगा, अथागत्: - फॉमग 17क [जनयम 35क (1) िेखें] अजतररि व्यवसाय पिंीकरण जचलह प्रिान करन ेके जलए आविेन का प्रारूप सेवा पंिीकरण प्राजधकरण, …………………………….

द्वारा संिोजधत की गई थी। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 5th May, 2022 G.S.R. 340(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 39 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public. Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (MVL, Transport & Toll), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001 or on the email: comments-morth@gov.in;
The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government.
Draft Rules
1. (1) These rules may be called as Central Motor Vehicles (…. Amendment) Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), for Rule 33, following rule shall be substituted, namely: - “33. Necessity of Trade certificate- Trade certificate is necessary for those manufacturers of motor vehicles or dealers of motor vehicles or test agencies specified in rule 126 or importers of motor vehicles or any entity(s) specified by central government, who possess vehicles which are neither registered nor temporarily registered.”
3. In the said rules, after Rule 33, following Rules shall be inserted, namely – [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 “33A. Condition for exemption from registration. — For the purpose of the proviso to section 39, a motor vehicle in the possession of any of the entity(s) referred in rule 33, shall be exempted from the necessity of registration subject to the condition that such entity(s) obtain a trade certificate from the registering authority having jurisdiction in the area in which entity(s) have places of business, in accordance with the provisions of this Chapter.
4. In the said rules, in Rule 34, -
(i) in sub rule (1), -
(a) after the words “trade certificate shall be made” the words “electronically on the VAHAN portal” shall be inserted.
(b) after the words “fee as specified in rule 81” the words “submitted electronically on the VAHAN Portal” shall be inserted.
(ii) in sub rule (2), the words “separate” shall be omitted.
(iii) after sub rule (2), following sub rule shall be inserted, namely: - “(3) Numbers of Trade registration marks required shall be specified in the application.”
5. In the said rules, for Rule 35, following rule shall be substituted, namely: - “35. Grant or renewal of trade certificate. —
(1) On receipt of an application for the grant or renewal of a trade certificate in respect of a vehicle, the registering authority may, if satisfied, issue to the applicant Trade certificate, electronically on portal, in downloadable and printable form, in Form 17 within fifteen days from the date of receipt of such an application.
Trade certificate number shall be as follows - AB 12 A 1234 TC AB—Represents State Code, 12—Represents RTO Code, A. - Represents serial number of class of vehicle as prescribed in Rule 34(2) i.e. from A to J, 1234- Represents four digit unique identification number to be assigned by the concerned authority to the holder of a trade certificate, TC—Represent trade certificate, A trade registration mark will be trade certificate number followed by four digit numerals starting from 0001 to 9999 as follows- AB 12 A 1234 TC 0001
(2) No application for trade certificate shall be refused by the registering authority unless the applicant is given an opportunity of being heard and reasons for such refusal are given in writing.”
6. In the said rules, after rule 35, the following rules shall be inserted, namely: -
(i) “35A. Application for additional Trade registration mark. —
1. An application for the grant of additional Trade registration mark shall be made electronically on portal in Form 17A to the registering authority which granted the trade certificate and shall be accompanied by the appropriate fee as specified in rule 81. The fees shall be submitted electronically on portal.
2. On receipt of an application for the grant of additional Trade registration mark in respect of a Trade certificate, the registering authority may, if satisfied that the applicant holds a valid Trade certificate and requires additional Trade registration mark, issue to the applicant additional Trade registration mark, in Form 17B within seven days from the date of receipt of such an application” 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(ii) “35B. Intimation of change of address of place of business in trade certificate—
1. If the place of business specified in the trade certificate is changed, then the holder of trade certificate shall immediately intimate to the authority which granted the trade certificate, about such change, electronically on portal in Form 17C accompanied by the appropriate fee as specified in rule 81.
2. On receipt of intimation of change of place of business, the registering authority may, if satisfied that the applicant holds a valid Trade certificate, record new address in the trade certificate.”
7. In the said rules, in Rule 37, for the words “twelve months” the words “five years” shall be inserted.
8. In the said rules, rule 38 shall be omitted.
9. In the said rules, in Rule 39, -
(i) in sub rule (1), for the words “the dealer or manufacturer of automobiles or automobiles ancillaries or a test agency specified in rule 126” the words “the holder of trade certificate” shall be substituted.
(ii) for sub rule (2), the following sub rule shall be substituted, namely: - “(2) The trade registration mark shall be in white colour on red background as per dimensions specified in rule 51 and shall be exhibited on front and rear of motor vehicle.”
10. In the said rules, in the heading of Rule 40, for the words “Restrictions on use of trade certificate or trade registration mark and number” the words “Restrictions on use of trade registration mark” shall be substituted.
11. In the said rules, in Rule 40,
(a) for the word “certificate” the words “registration mark” shall be substituted.
(b) for the words “certificate or the number” the words “trade registration mark” shall be substituted.
12. In the said rules, in the heading of Rule 41, for the words “Purposes for which motor vehicle with trade certificate may be used” the words “Purposes for which motor vehicle with trade registration mark may be used” shall be substituted.
13. In the said rules, in Rule 41,
(a) for the words “trade certificate”, the words “trade registration mark” shall be substituted.
(b) for clause (h) following clause shall be substituted, namely: - “(h) for proceeding to or returning from the place of demonstration of vehicle for sale purpose or for keeping vehicle for display at such place of demonstration.”
14. In the said rules, in the heading of Rule 43, for the words “Register of trade certificate” the words “Register of trade registration marks” shall be substituted.
15. In the said rules, after rule 43, the following rules shall be inserted, namely: - “43A. Register of inventory—Every dealer of motor vehicle holding a trade certificate shall maintain a register of inventory of motor vehicles electronically in Form 19A on the portal.”
16. In the said rules, for rule 44, the following rules shall be substituted, namely: - “44. Suspension or cancellation of trade certificate. - If the registering authority has reason to believe that the holder of any trade certificate has not complied with the provisions of rules 39 to 43A, it shall report the fact of non-compliance of the said provisions along with reasonable proof, to the head of the Motor Vehicles Department established under section 213. The head of the department may, after giving the holder of trade certificate an opportunity of being heard, suspend or cancel the trade certificate held by him.”
17. In the said rules, in Rule 45, for the words “head of the Motor Vehicles Department established under section 213” the words “state transport appellate tribunal or any authority decided by the respective states/UTs in this respect” shall be substituted.

18. In the said rules, in rule 81, a. in the table, for serial no.1, the following entries shall be substituted, namely:
1 Grant or renewal of trade certificate in respect of each trade registration mark or additional grant of each trade registration mark :

(a) Motorcycle Two thousand five hundred rupees
(b) Adapted vehicle Five hundred rupees
(c) Others Five thousand rupees b. in the table, for serial no.2, the following serial number shall be substituted, namely:

19. In the said rules, in Form 16, -
(a) in the heading, after the words “FORM OF APPLICATION FOR GRANT OR RENEWAL OF TRADE CERTIFICATE” the words “AND TRADE REGISTRATION MARKS” shall be inserted.
(b) in para 1, for the words “certificate(s)” the words “certificate” shall be substituted.
(c) after serial no. 3, the following serial no. shall be inserted, namely: - “3A. Address of place of business”
(d) In serial no. 4, for the words “manufacturer or dealer of automobiles” the words “manufacturer of motor vehicles or dealer of motor vehicles” shall be substituted
(e) in serial no. 4, before the words “a test agency specified under rule 126 of the said rules” the words “or automobile ancillary” shall be omitted.
(f) in serial no. 4, after the words “a test agency specified under rule 126 of the said rules” the words and bracket “or importer of motor vehicles or any entity specified by central government, (In case applicant is dealer of motor vehicles letter of authority issued by vehicle manufacturer shall be submitted with application)” shall be inserted.
(g) in serial no. 4, the words and figure “in motor vehicles, approved repairer of vehicles, engaged in building bodies to vehicles, engaged in the business of hire purchase / lease / hypothecation of vehicles.” shall be omitted.
(h) serial no. 5, 6, 7 and 8 shall be omitted.

20. In the said rules, in Form 17, -

(b) in the heading, the words, figures and brackets “(To be printed in diameter shape of 70 millimetres)” shall be omitted.

(c) in serial no. 1, for the words “Serial number of certificate” the words “Trade certificate number” shall be substituted.
