PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और रािमागग मतं्रालय अजधसचूना नई दिल्ली, 21 अक् तूबर, 2021 सा.का.जन.758(अ).— कें द्रीय मोटर यान जनयम, 1989 जनज्ललजखत प्रारूप जनयम, जिसे कें द्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 137 के खंड (कक) द्वारा प्रित्त िजियों का प्रयोग करते हुए कुछ जनयमों में और संिोधन करन ेका प्रस्ट्ताव करती ह,ै को उि अजधजनयम की धारा 212 की उप-धारा (1) द्वारा यथापेजित उनके द्वारा संभाव्य प्रभाजवत सभी व्याजियों की िानकारी के जलए प्रकाजित दकया िाता ह ैऔर एतिद्वारा नोरटस दिया िाता ह ै दक उि प्रारूप जनयमों पर उस तारीख से िब इस अजधसूचना की प्रजतयां, भारत के रािपत्र में यथाप्रकाजित, आम िनता को उपलब्ध कराई िाती हैं, से तीस दिन की अवजध की समाजि के पश्चापत जवचार दकया िाएगा। इन प्रारूप जनयमों के बारे में आिेप या सुझाव, यदि कोई हों, संयुि सजचव (एमवीएल, पररवहन, टोल), सड़क पररवहन और रािमागग मंत्रालय, पररवहन भवन, संसि मागग, नई दिल्ली-110001 को भेिे िा सकें ग े अथवा comments-morth@gov.in; पर ई-मेल दकए िा सकेंगे। इन प्रारूप जनयमों के बारे में आिेप या सुझाव, िो दकसी व्यजि से उि प्रारूप जनयमों के संबंध में इस प्रकार जवजनर्िगष्ट अवजध की समाजि के भीतर प्राि ंदकए िाते हैं, पर कें द्रीय सरकार द्वारा जवचार दकया िाएगा;
प्रारूप जनयम
1. (1) इन जनयमों को कें द्रीय मोटर यान (....... संिोधन) जनयम, 2021 कहा िा सकता ह,ै

2. केलद्रीय मोटर यान जनयम, 1989 के जनयम 138 में उपजनयम (6) के पश्चात् जनम्नजलजखत उपजनयम अंत:स्ट्थाजपत दकया िाएगा, अथागत्:-
(7) इन जनयमों के प्रकािन की तारीख से एक वर्ग पर और उसके बाि, मोटरसाइदकल चालक को 0 से 4 वर्ग की आय ुके बचे्च को पीछे की सीट पर ले िात ेसमय जनम्नजलजखत सुरिा उपायों का पालन सुजनजश्चत करना होगा, अथागत् : -
(i) चार साल से कम उम्र के बच्चों के जलए, बचे्च को मोटरसाइदकल के चालक से िोड़न ेके जलए सेफ्टी हानेस का उपयोग दकया िाएगा। स्ट्पष्टीकरण: सेफ्टी हानेस बचे्च द्वारा पहना िाने वाला एक वेस्ट्ट ह,ै िो समायोजित करने योग्य होगा, जिसमें वेस्ट्ट से िुड़ी परियों की एक िोड़ी और चालक द्वारा पहन ेिान ेवाल ेिोल्डर लूप्स होंगे। इस तरह, बचे्च का ऊपरी धड़, चालक से सुरजित रूप से िुड़ा होगा। इसकी एक जविेर्ता ह ैजिसके द्वारा ध्यान रखा िाता ह ैवह यह ह ैदक परियों को बजनयान के पीछे से िोड़कर और परियों को वेस्ट्ट के ऊपर से पार करना तादक िो बड़े क्रॉससंग-ओवर लपू बन िाए ंिो यात्री के परैों के बीच से गुिरत ेहैं। भारतीय मानक ब्यरूो अजधजनयम 2016 के तहत भारतीय मानक ब्यूरो द्वारा जवजनिेि जनधागररत दकए िाने तक सेफ्टी हानेस सजहत सुरिात्मक जगयर जनम्नजलजखत आवश्यकताओं को पूरा करेगा:
सेफ्टी हानेस के जवजनिेि (क) हल्का विन, समायोज्य, िलरोधक और रटकाऊ;
(ख) भारी नायलॉन/उच्च घनत्व फोम के साथ मल्टीदफलामेंट नायलॉन सामग्री;
(ग) 30 दकलो तक भार वहन करने की िमता के जलए जडजाइन दकया िाए। उिाहरण के जलए जचत्र प्रस्ट्ततु हैं-
(ii) कै्रि हलेमेट: चालक को यह सुजनजश्चत करना होगा दक 09 महीने से 4 वर्ग की आय ुके पीछे बैठन ेवाले बाल सवारी को अपना कै्रि हलेमटे अवश्य पहनना चाजहए िो [एएसटीएम 1447]/ [यूरोजपयन (सीईएन)बीएस ईएन 1080/बीएस ईएन 1078] का अनुपालन करता हो और उसके जसर पर दफट बैठता हो िब तक दक भारतीय मानक ब्यूरो अजधजनयम 2016 के तहत भारतीय मानक ब्यरूो द्वारा जवजनििे जनधागररत नहीं दकए िाते हैं। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3

(aa) of section 137 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by subsection (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public;
Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (MVL, Transport & Toll), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001 or on the email: comments-morth@gov.in;
The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government.
Draft Rules
1. (1) These rules may be called as Central Motor Vehicles (….Amendment) Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989, in Rule 138, after sub-rule (6), the following sub-rule shall be inserted, namely: -
(7) On and after one year from the date of publication of these rules, the driver of a motorcycle shall ensure the following safety measures while carrying a child between the age of 0 and 4 years, on the vehicle as a pillion , namely: -
(i) For children below four years, Safety harness shall be used for attaching the child to the driver of the motorcycle.
Explanation: Safety harness is a vest to be worn by the child, which shall be adjustable, with a pair of straps attached to the vest and forming shoulder loops to be worn by the driver. This way, the upper torso of the child is securely attached to the driver. A feature by which this is achieved is by attaching the straps to the back of the vest and crossing the straps over the vest so that two large crossing-over loops are formed that pass between the legs of the passenger. The protective gear including safety harness shall meet the following requirements till such time the specifications are prescribed by the Bureau of Indian Standards under the Bureau of Indian Standards Act 2016:
Specifications of Safety harness
(a) Light weight, adjustable, waterproof and durable;
(b) Heavy nylon/ multifilament nylon material with high density foam;
(c) Shall be designed to hold weight upto 30 kg.

(ii) Crash helmet: The driver shall ensure that the child pillion passenger aged between 09 months and 4 years must wear his/her own crash helmet which fits his/her head or wear bicycle helmet complying with [ASTM 1447]/ [European (CEN)BS EN 1080/BS EN 1078] till such time that the specifications are prescribed by the Bureau of Indian Standards under the Bureau of Indian Standards Act 2016.
(iii) The speed of the motorcycle with the child upto age 4 years being carried as a pillion, shall not be more than 40 kmph.
