2. औषिध और �साधन साम ी िनयम, 1945 (िजसे इसम� इसके पOात् उ+ िनयम कहा गया ह)ै के िनयम 96 के उप-िनयम (1) क� धारा (xi) म�,— (क) "के अलावा" श5द� से आरHभ होने वाले और "उपयु3/ त सूची म�” श5द� के साथ समाR होने वाल ेभाग के �थान पर िनSिलिखत को रखा जाएगा, अथा3त्:— "अ?य िविशि4य� के अलावा, िज? ह� इन िनयम� के अधीन मु'@त 'कए जाने या िलखे जाने क� अपे�ा ह,ै िनSिलिखत Vेिणय� क� औषिध के सबसे आंत!रक आधान के लबेल पर और हर दसूरे आवरण म� पैक आधान पर, जैसा लागू हो, सावधानी या चेतावनी होगी 'क / या औषिध को अनुसूची जी अथवा अनुसूची एच अथवा अनसुूची एच1 अथवा अनुसचूी ए/ स के अंतग3त रखा गया ह,ै जैसा'क िनयम 97 म� िविनWद3X ट ह,ै जो इन िनयम� के अधीन अ? य दशाZ म� बाधा पCचंाए ं िबना परूी तरह से लाल आयताकार बॉ/स म� मु'@त पठनीय काले रंग हो, अथा3त्:— �वापक एनालजेिसक, िह> नो!टक् स, सेडे!ट* स, ]ां'^लाईजर, को_ट3को�टेरोइड, हाम`न, हाईपोिaलसेिमक, ए!ंटमाइbोबाय" स, एं!टइिपलेि>ट/ स, एटंीिड�ेस�cस, एंटीकोआगुलdcस, एटंी कd सर औषिध और जी, एच, एच 1 अनुसूिचय� और अनुसूची ए/ स म� आने वाली अ?य सभी औषिधयां चाह ेवे उपरो/ त सूची के अंतग3त हो अथवा नहe: परंतु य'द उपयु3/ त �वग3 म� संद2भ3त कोई भी औषिध 'कसी भी अनसुूची अथा3त अनुसूची जी अथवा अनुसूची एच अथवा अनुसूची एच1 अथवा अनुसूची ए/ स के अंतग3त नहe ह,ै तो, यथाि�थित, औषिध के सबस ेआंत!रक आधान के लबेल पर और हर दसूरे आवरण म� पैक आधान पर िनयम 97 म� िविनWद3X ट अनुसचूी एच के अंतग3त उस औषिध के िलए सावधानी या चेतावनी होगी । ” ; (ख) परंतुक म�, "परंतु यह क�" श5द� के �थान पर "परंतु यह और 'क" श5द रखे जाएगंे।
3. उ/ त िनयम� के िनयम 97 के उप-िनयम (1) म�, (i) धारा (क) से (ङ) के �थान पर, िनSिलिखत खंड रखे जाएगं,े अथा3त:्— “(क) य'द इसम� अनुसूची जी म� िविनWद34 औषिध पदाथ3 अंत2व34 ह ैतो, इस पर पूरी तरह से लाल रंग के आयताकार बॉ/स म� �प4 'दखाई दनेे वाले काले रंग म� िनSिलिखत श5द� के साथ लेबल 'कया जाएगाः अनुसूची एच �ैस'b> शन औषिध- चेतावनी िच'कB सा िनगरानी के िसवाय इस िन2म3त का उपयोग करना खतरनाक ह।ै (ख) य'द इसम� अनुसूची एच म� िविनWद34 औषिध पदाथ3 अंत2व34 ह ैतो इस पर आरए/ स का लेबल 'कया जाएगा िजसे �प4 �प से ऊपर बा= ओर कोने पर �द2श3त 'कया जाएगा और लाल रंग के आयताकार बॉ/स म� �प4 'दखाई दनेे वाले काले रंग म� िनSिलिखत श5द� के साथ लेबल 'कया जाएगा : (ग) य'द इसम� अनुसूची एच म� िविनWद34 औषिध पदाथ3 अंत2व34 ह ैऔर इस पर �वापक औषिध और मनः �भावी पदाथ3 अिधिनयम, 1985 (1985 का 61) क� प!रिध म� आता ह ैतो इस पर एनआरए/ स का िच?ह का लेबल लगाया जाएगा जो लाल रंग का होगा और िजसे � पX ट �प से ऊपर बा= ओरे कोने पर �द2श3त 'कया जाएगा और लाल रंग के आयताकार बॉ/ स म� � पX ट 'दखाई दनेे वाले काल ेरंग म� िनH निलिखत श5 द� के साथ लबेल भी 'कया जाएगा:

(घ) य'द इसम� अनसुूची ए/ स म� िविनWद34 औषिध पदाथ3 अंत2व34 ह ैतो इस पर ए/ सआरए/ स िच?ह का लेबल लगाया जाएगा जो लाल रंग का होगा और िजसे � पX ट �प से ऊपर बा= ओर कोने पर �द2श3त 'कया जाएगा और लाल रंग के आयताकार बॉ/ स म� � पX ट 'दखाई दनेे वाले काल ेरंग म� िनH निलिखत श5 द� के साथ लेबल भी 'कया जाएगा: (ङ) य'द इसम� अनूसूची एच1 म� िविनWद34 औषिध पदाथ3 अंत2व34 ह ैतो इस पर आरए/ स िच?ह का लबेल लगाया जाएगा जो लाल रंग का होगा और िजसे � पX ट �प से ऊपर बा= ओर कोन ेपर �द2श3त 'कया जाएगा और लाल रंग के आयताकार बॉ/ स म� � पX ट 'दखाई दनेे वाले काले रंग म� िनH निलिखत श5 द� के साथ लेबल भी 'कया जाएगा: (च) य'द इसम� अनुसूची एच1 म� िविनWद34 औषिध पदाथ3 अंत2व34 ह ै और यह �वापक औषिध और मनः �भावी पदाथ3 अिधिनयम, 1985 (1985 का 61) क� प!रिध म� आता ह ैतो इस पर एनआरए/ स िच?ह का लेबल लगाया जाएगा िजस ेऔर � पX ट �प स ेऊपर बा= ओर कोन ेपर �द2श3त 'कया जाएगा और लाल रंग के आयताकार बॉ/ स म� � पX ट 'दखाई दनेे वाले काल ेरंग म� िनH निलिखत श5 द� के साथ लबेल भी 'कया जाएगा: अनुसूची एच1 �ैस'b> सन औषिध-चेतावनी - िसवाय िच'कB सा सलाह के अनुसार इस िन2म3त का उपयोग खतरनाक ह।ै - इसे रिज�]ीकृत िच'कBसा jवसायी के न�ु खे के िबना खुदरा नहe बचेा जाएगा। ”. 4. उ/ त िनयम� क� अनुसूची एच म�, उसस ेसंग म� संलa न !ट>पण के पैरा 3 के पOात ् िनH निलिखत पैरा अ?तः �थािपत 'कया जाएगा, अथा3त्:— ‘’4. सामियक या बाहरी उपयोग के िलए � टेरॉयलड यु/ त लवण, इ� टर, jुBपंनी और िविन2म3त को भी इस अनुसूची के अंतग3त रखा जाएगा ।” 5. उ/ त िनयम� क� अनुसूची ट म�, b.सं. 27 के सम�, ‘औषिध क� Vेणी’ �वयं के िनच े�िवि4य� के �थान पर िनH निलिखत रखा जाएगा, अथा3त्:— अनुसूची एच �ैस'b> सन औषिध-चेतावनी इसे रिज�]ीकृत िच'कBसा jवसायी के न�ु ख ेपर ही खुदरा बेचा जाएगा। अनुसूची ए/ स �ैस'b> सन औषिध-चेतावनी इसे रिज�]ीकृत िच'कBसा jवसायी के न�ु ख ेपर ही खुदरा बेचा जाएगा। अनुसूची एच1 �ैस'b> सन औषिध-चेतावनी - िसवाय िच'कB सा सलाह के अनुसार इस िन2म3त का उपयोग खतरनाक ह।ै - इसे रिज�]ीकृत िच'कBसा jवसायी के न�ु खे के िबना खुदरा नहe बचेा जाएगा। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ‘’ओरल पुनज3लीकरण लवण (िनH न सू� के अनुसार िविन2म3त):- ाम क� मा�ा के संदभ3 म� तयैार संघटक, 1000 िमलीलीटर को बनान ेहतेु िजसे पया3> त पानी म� घोला जाना ह ै। • सोिडयम / लोराइड 2.6 • डे/ स]ोज़ (िनज3ल) या 13.5 • डे/ स]ोज़ मोनो-हाइpेट 14.85 • पोटेिशयम / लोराइड 1.5 • सोिडयम साइ]ेट 2.9. ’’ । [फा.सं. ए/ स.11014/06/2016-डीएफ/ यसूी] सुधीर कुमार, संयु/ त सिचव ट� प ट� प ट� प ट� पण:ण:ण:ण: मूल िनयम अिधसचूना संr या एफ.28-10/45-एच (1), तारीख 21 'दसबंर, 1945 &ारा भारत के राजप� म� �कािशत 'कए गए थ ेऔर अिधसूचना संr या सा.का.िन. 385(अ), तारीख 19 अ�ैल, 2018 &ारा अंितम बार संशोधन 'कया गया था। MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Health and Family Welfare) NOTIFICATION New Delhi, the 26th April, 2018 G.S.R. 408(E).—Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules, 1945, was published, as required under sub-section (1) of section 12 and sub-section (1) of section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940), vide notification of the Government of India in the Ministry of Health and Family Welfare (Department of Health and Family Welfare), number G.S.R. 1369(E), dated the 3 rd November, 2017, for inviting objections and suggestions from persons likely to be affected thereby before the expiry of a period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;
And whereas copies of the said Official Gazette were made available to the public on the 3 rd November, 2017;
And whereas, objections and suggestions received from the public on the said rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 12 and section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940), the Central Government, after consultation with the Drugs Technical Advisory Board, hereby makes the following rules further to amend the Drugs and Cosmetics Rules, 1945, namely:-
1. (1) These rules may be called the Drugs and Cosmetics (Fifth Amendment) Rules, 2018.
(2) They shall come into force on the 1 st day of November, 2018.

2. In the Drugs and Cosmetics Rules, 1945 (hereinafter to be referred as the said rules), in rule 96, in sub-rule (1), in clause (xi),—
(a) for the portion beginning with the words “In addition to the’’ and ending with the words “in the above list:”, the following shall be substituted, namely:— “In addition to the other particulars which are required to be printed or written under these rules, the label of inner most container of the following categories of drugs and every other covering in which the container is packed shall bear a caution or warning, as applicable, depending on whether the drug is covered under Schedule G or Schedule H or Schedule H1 or Schedule X, as specified in rule 97, in legible black coloured font size in a completely red rectangular box without disturbing other conditions printed on the label under these rules, namely:— Narcotic analgesics, hypnotics, sedatives, tranquillisers, corticosteroids, hormones, hypoglycemic, antimicrobials, antiepileptics, antidepressants, anticoagulants, anti-cancer drugs and all other drugs falling under Schedules G, H, H1 and Schedule X whether covered or not in the above list:
Provided that if any of the drug referred above category is not covered under any of the Schedule, namely, Schedule G, Schedule H, Schedule H1 and Schedule X, the label of inner most container of drugs and every other covering in which the container is packed shall bear caution or warning, as the case may be, applicable for that drugs covered under Schedule H as specified in rule 97.”;
(b) In the Proviso, for the words “Provided that”, the words “Provided further that” shall be substituted.
3. In the said rules, in rule 97, in sub-rule (1),—
(i) for clauses (a) to (e), the following clauses shall be substituted, namely:— “(a) if it contains a drug substance specified in Schedule G, be labeled with following words in legible black coloured font size in completely red rectangular box:

(b) if it contains a drug substance specified in Schedule H, be labeled with symbol Rx and conspicuously displayed on the left top corner of the label and shall also be labeled with the following words in legible black coloured font size in completely red rectangular box:
SCHEDULE G PRESCRIPTION DRUG – CAUTION It is dangerous to take this preparation except under medical supervision.

(c) if it contains a drug substance specified in Schedule H and comes within the purview of the Narcotic Drugs and Psychotropic Substances Act, 1985 (61 of 1985) be labeled with symbol NRx, which shall be in red and conspicuously displayed on the left top corner of the label and shall also be labeled with the following words in legible black coloured font size in completely red rectangular box:

(d) if it contains a drug substance specified in Schedule X, be labeled with symbol XRx, which shall be in red and conspicuously displayed on the left top corner of the label and shall also be labeled with the following words in legible black coloured font size in completely red rectangular box:
;
(e) if it contains a drug substance specified in Schedule H1, be labeled with symbol Rx, which shall be in red and conspicuously displayed on the left top corner of the label and shall also be labeled with the following words in legible black coloured font size in completely red rectangular box:
” ;
(f) if it contains a drug substance specified in Schedule H1 and comes within the purview of the Narcotic Drugs and Psychotropic Substances Act, 1985 (61 of 1985) be labeled with symbol NRx, which shall be in red and conspicuously displayed on the left top corner of
SCHEDULE H PRESCRIPTION DRUG – CAUTION Not to be sold by retail without the prescription of a Registered Medical Practitioner.
SCHEDULE H PRESCRIPTION DRUG – WARNING To be sold by retail on the prescription of a Registered Medical Practitioner only.
SCHEDULE X PRESCRIPTION DRUG – WARNING To be sold by retail on the prescription of a Registered Medical Practitioner only.
SCHEDULE H1 PRESCRIPTION DRUG – CAUTION − It is dangerous to take this preparation except in accordance with the medical advice.
− Not to be sold by retail without the prescription of a Registered Medical Practitioner.

4. In the said rules, in Schedule H, in the Note appended thereto, after paragraph 3, the following paragraph shall be inserted, namely:— “4. The salts, esters, derivatives and preparations containing steroids for topical or external use shall also be covered under this Schedule.”.
5. In the said rules, in Schedule K, against serial number 27, for the entries under the column “Class of Drugs”, the following shall be substituted, namely:— “Oral Rehydration Salts (Manufactured as per the following formula):-Composition of the formulation in terms of the amount in g, to be dissolved in sufficient water to produce 1000 ml.
• Sodium Chloride 2.6 • Dextrose (anhydrous) or 13.5 • Dextrose mono-hydrate 14.85 • Potassium chloride 1.5 • Sodium Citrate 2.9. ”.
