MlNJS1RY OF DEFENCE NOTIFICATION New Delhi, the 4th November, 20 II S.RO. 10(E).- Whereas, draft Election of Vice-President of the Cantonments Board (Procedure) Rules, 201 0 were published, as required by section 31 read with sub section (3) of the section 19 of the Cantonments Act, 2006 (4 1 of2006) in Part-li, section 4 of the Gazette of India, vide notification of the Government of India, Ministry of Defence, S.R.O 12 (E) dated the 23n1 August, 2010 inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of sixty days from the date on which the copies of the said Gazette notification arc made avai lable to U1e public; And, whereas, the copies of the said Gazette were made available to the pub I ic by 3151 Oct, 2010 by the Cantonment Boards; And, whereas, all the objections and ·suggestions received before the date so specified have been duly considered by the Central Government; Now, therefore, in exercise of powers conferred by section 31 read with sub section (3) oC section 19 of the said Act, the Central Government hereby makes the following ru les, namely:- ELECTION OF VICE-PRESIDENT OF THE CANTONMENTS BOARD (PROCEDURE) RULES, 201 1
PART-I PRELIMINARY
1. . Short title and commcncerncnt. - (1) These rules may be called the Election of Vice-President of the Cantonments Board (Procedure) Rules, 2011.
(2) They shall come in to force on the date of their final publ ication in the Official Gazette.
2. Definitions. - (1) In these rules, unless the context otherwise requires.-
(a) "Act" means the Cantonments Act, 2006 (41 of 2006);
(c) "Form" means a form appended to these rules; ·
(d) "Member" means the member eiected to Ihc Board;
(e) "·Pres ident" means the President of the Board; and ['~-' 11-~ 4]
(f) "Vice-President" means the Vice-President o[ the Board;
(2) . 'J'he words and expressions used in these rules and not defined but deiincd in the Act shall have respective meanings as assigned to them in the Act. J. Power of J>rcsidcnt. - Subject to the general superintendence, direction and control of the Central Government, the President shall be responsible i"or the conduct of election of the Vice-President.
PART-II ELECTION OF VICE-PRESIDENT OF THE BOARD :.\. Convening Special Meeting for election of Vicc- P•·csidcnt. - (l) A speci~l meeting of the Board shall be convened in the ofJice of the Bomd for the election or Vice-President.
(2) The ChiefExecutivc Officer shall give notice of the date and time of such special meeting in Form-l at least four cicar working days in advance from the date of the meeting Gxed by the President for the election or the Vice President.
5. Mmmer of election.- (1) A candidate for the office of Vice-President shall be pruposed by one member and seconded by another member by way of nomination paper 111 Form-ll.
(2) The names of all cand idates validly proposed and seconded by the mt:mbcr shnll be read out by the President in special meeting of the Boru·d.
(3) If only one candidate is duly proposed and seconded, there shall be no election and such carul idate shall be declared elected as Vice-President.
(4) If there arc two or more candidates, the elected members of the Board shall then proceed to vote by ballot. The ballot shall be held in such manner as the President may direct.
(5) The Pn.:sidcnt shall,-
(a) record the total number of votes polled by ballot.
(b) announce the number of votes secured by. each candidate: and
(c) declare the candidate who secures the highest number of votes and eiected.
(6) In the event of equality of votes between two or more cancliclatcs. the 1)resident shall draw lots in the presence of the members and the candidates and whose name is lirst drawn shall be declared to have been duly elected.

6. Record of proceedings. - ( 1) lmmediately after the declaration of the result of the election, the President shall-
(a) prepare a record of the proceeding of the meeting and sign it with his initials in every cotTection, if any, made therein; ·
(b) publish the result of the ~lection of Vice-President on the notice board of the Board in Forrn-lii stating the name of the person elected as Vice-President of the Board in Form-Ill and send a copy of the result to the General Officer Commanding-in-Chief, the Command and Director General Defence Estates;
(c) give the copy of the result to the candidate who declared elected as Vice- President; and
(d) issue a certificate of election in Form-lV.
(2) the record of proceeding of the meeting prepared by the President w1der clause
(a) of sub-rule (1 ), shall be attested by a majority of the members who participated in the meeting and the Chief Executive Officer shall countersign on such reeord of proceedings.
