The, at aa NOTIFICATION New Delhi, the 8th December, 2006 GSR, 309.—In exercise of the powers conferred by clause (m) of Section 14 and sub-section (2) of Section 56 of the Energy Conservation Act, 2001 (52 of 2001), the Central Government, in consultation with the Bureau of Bnergy Fificiency, hereby makes the following rules o prescribe minimum qualification for energy managers designated or appointed under clause (1) of Section L4 of the Act, namely + |. Short titleand Commencement.— (i) These nukes may be called the for Energy Managers) Rules, 2006.

(ii) They shall come into force on the date of their publication in the Official Gazette,

2. Detinitions.—(1) In these rule

(2) “Act means the Energy Conservation Act, 2001 (52 of 2001);

(b) “agency” means an agency appointed by the Bureau for the purpose of holding National Examination for certification of energy managers;

(©) “ventificate” means the certificate issued, on being declared successful in the National Examination, by the Bureau or the agency notified by the Bureau in support of certification of energy manager.

(W) “diploma Engineer” means a person who has obtained a diploma in Engineering from a University or Board or Institution incorporated by an Act of the Central or State Legistature in India or other educational institutions established by an Act of Parliament or any diploma recognized by All India Council for Technical Education ‘as equivalent orhas obtained a diploma in Engineering from such foreign University or College or Institution ‘recognized by the Central Government, andl under such conditions as may be laid dowa for the purpose, from time to time:

(c) “equivalent” in relation to any: qualification means educational qualifications acquired by passing an ‘examination conducted by an examining body constituted by Iaw in India or an examination recognized by the ‘Central Government or State Governments or All India Council for Technical Education as equivalent thereto;

rey Conservation (Minimum Qualification unless the context otherwise requited, 3 () “geaduate Fngineer” means a person who has obtained a graduation degree in Enginecring from an University incorporated by an Actof the Central or State Legislature in India or other educational institutions established by an Act of Parliament or declared to be deemed as Universities under Section 3 of the University Grants ‘Commission Act, 1956 or any degree recognized by All India Council for Technical Education as equivalent or has obtained a graduation degree in Engineering from such foreign University or College or Institution ecognized hy the Central Government, and under such conditions as may be laid down for the purpose, from time totime;

(@) “National Examination means the examination conducted by the Buceau or the agency appointed by the Bureau for certification of energy managers;

{h) “post-graduate in Engineering” cans a person who has obrained 2 post-graduate degree in Engineer from an University incorporated by an Act of the Central or State Legislature in India or other educational institutions established by an Act of Parliament or declared to be deemed as Universities under Section 3 of the University Grants Commission Act, 1956 or any degree recognized by All India Council for Technical ‘Tdueation as equivalent or has obtained a post-graduate degree in Engineering from such foreign University oor College or Institution recognized by the Central Government, and under such conditions as may be laid down for the purpose, from time to time;

() “post-graduate” means a post-graduate of an University incomporated by an Act of the Central or State Legislature in India or other educational institutions established by an Act of Parliament or declared to be cemed as Universities under Section 3 of the University Grants Commission Act, 1956 oF any degree recognized by All India Council for Technical Edueation as equivalent or has obtained a post-graduate degree in Enginesrins from such foreign University or College or Institution recognized by the Central Government, ancl under such conditions as may be laid down for the purpose, from Gime to time.

(2) Words and expressions used'in these rules and not defined, but defined in the Act, shall have the meaning respectively assigned to them in the Act.

3. Qualification of Certified Energy Managers.—(1) A person shall be qualified to beconne a certified encrzy manager. ithe — fi) has passed the National Examination for energy manager or energy auditor held under the aegis of the Bureau; and effect, Gi) has been issued a certificate by the Burcau to th

(2) No candidate shall be eligible for appearing in the National Examination uniess he is:

(a) a graduate Engineer dr equivalent with three years of work experience invotying use of energy 1n operation.

(3) A.candidate appeating in the National Examination shall be eligible for award of certificate on being declared icessful in the said examination,

(4) Any National Examination for certification of energy managers or energy auditors held by the Bureau prior 10 tho notification of these rules shall be deemed to'have been conducted under these rules.
