(162)3 MINISTRY OF HOME AFFAIRS New Delhi, the 30th October, 1984 NOTIFICATION G.S.R. 749(E).—In exercise of the powers confer red by section 10 of the Dadra and Nagar Haveli Act, 1961 (35 of 1961), the Central Government hereby extends to the Union territory of Dadra and Nagar Haveli, the Goa, Daman and Diu Town and Country Planning Act, 1974 (Goa, Daman and Din Act 21 of 1975), as in force in the Union territory of Goa, Daman and Din at the date of this notification, subject to the following modifications, namely :— MODIFICATIONS
1. Throughout the Act,—
(a) unless otherwise directed in this notification, for the word "Government" except where it occurs in the expression "Department of Government", "State Government", "Cent ral Government", "Officer*: of Government".
"Government Officer", "Government ac counts", "Government Provident Fund" or "Government Department", the word "Ad ministrator" shall be substituted and there shall also be made in any sentence, in which such substitution is made, such consequen tial changes as the rules of grammar may require;
(b) for the words "Goa, Daman and Eliu", ex cept where they occur in the long title, en acting formula and short title, the words "Dadra and Nagar Haveli" shall be substitu ted.
2. In section 2,—
(a) clause (1) shall be renumbered as clause (la) and before the clause as so renumbered, the following clause shall be inserted, namely :— '(1) "Administrator" means the administrator of the Union territory of Dadra and Na#ar Haveli appointed by the President under article 239 of the Constitution;';
(b) Clause (13) shall be omitted;
(c) for clause (IS), the following clause shall be substituted, namely ;— '(18) "local authority" means a village panchavat constituted under the Dadra and Nagar Haveli Village Panchavats Regulation, 1965 (3 of 1965);';
(d) after clause (26),—the following clause shall be inserted as clause (26A) namely :— '(26A) "prescribed authority" means the autho rity notified by the Administrator as the prescribed authority for purposes of sec tion 71 of the Act;*
(e) in clause (32),— 0) for the words and figures "Goa, Daman and Diu Municipalities Act, 1968", the words and figures "Dadra and Nagar Haveli Village Panchayats Regulation, 1965" shall be substituted;
3. In section 4, for sub-section (2), the following sub-section shall be substituted, namely:— "(2) The Board shall consist of the following members, namely :—
(a) a Chairman to be appointed by the Administ rator;
(b) the person, who for the time being represents the Union territory in Parliament,
(c) the Sarpanch of the Varishta Panchayat elect ed under section 20 of the Dadra and Nagar Haveli Village Panchayat Regulation, 1965 (3 of 1965);
(d) three persons having special knowledge of, and practical experience in, matters relating to town and country planning, architecture, engineering, transport, industries, commerce, agriculture or geology to be nominated by the Administrator;
(e) the Chief Town Planner Member Secretary."
4. In section 5,—
(a) for the words, brackets and letters "clauses G) and 0)"/ the word, brackets and letter "clause (d)" shall be substituted;
(b) for the proviso the fallowiug proviso shall be substituted, namely :— "Provided that the member referred to in clause (b) or clause (c) of the said sub section shall cease to hold office on ceas ing to be a member of Parliament or, as the case may be, the Sarpanch of the Varishta Panchayat.".
5. In section 6, for the words, brackets and letters "clauses /j) and (1)", the word, brackets and letter "clause (d)" shall be substituted.
6. In section 19, in clause (ii) of sub-section (2), the word "Government", where it ocenrs for the second and third times, shall stand unmodified..
7. In section 43, in clause (ii) of the proviso, the words "or the Government" shall be omitted.
8. In section 44, in clause (a) of sub-section (2), for the words "Central or Union territory Govern ment", the words "Central Government or Union terri tory Administration" shall be substituted.

9. In section 47, the- word "Government" shall stand unmodified whete it occurs for the second time in clause (b) of sub-section (1) and in sub-section (6).
10. In section 64, for the words "Act of the Legislative Assembly of the Union territory or any of the Acts which the Legislativt Assembly of the Union territory is competent to amend", the wo/as "law for the time being in force in the Union ter ritory" shaU b* substituted.
11. In section 71, fof {he words "Chief Town Planner", wherever it occurs, the words "prescribed authority" shall fee substituted.
12. In section 98, in "sub-section (1), the word "Government" shall stand unmodified.
13. In section 99, in. sub-section (2), the word Government" shall stand unmodified.
14. In section 100, in sub-section (3), the word Government" shall be omitted.
15. In section 105, the word "Government" shall stand unmodified in clause (a) of sub-Section (1) and In sub-section, (4).
16. In section 107, for sub-section (2), the follow ing sab-section shall fee substituted, namely :— "(2) The accounts of every Planning and Deve lopment Authority shall be audited annually by stick person, or persons as may be deci ded by the Administrator.".
