(e) the general level of wages for unskil led labour prevalent in the un i t , and <f) such other f ac to r s as may be p resc r ibed .
n s t i t u t i o n 5 . The Administrator may, in respect of any minor fores t un i t s . ' produce, by no t i f i c a t i on in the Off ic ia l Gazet te , divide the whole Union t e r r i t o r y into such number of u n i t s , and each of them comprising such a reas , as the Administrator may deem f i t , otnts- 6 . (1) The Administrator may, for the purpose of s e l l i n g , n t ' of purchasing or t ranspor t ing any minor fo res t produce on Sm i t s behalf, appoint any person a s an agent in charge of any . u n i t and i t shall be lawful to appoint the same person as an agent for more than one u n i t .
. ', (2) The terms and condit ions of appointment of any agent shal l be such as may be specified by the Administrator in the order of appointment*
Provided that nothing contained in t h i s sect ion shall p revent the Administrator from appointing the Corporation as the sole agent for the purpose of . se l l ing , purchasing or t ranspor t ing any minor fores t produce and such appoint ment shal l be on such terms and condi t ions a s may be determined by the Administrator.
(2A) notwithstanding anything contained in sub-section ( l ) the Administrator may a f t e r consul ta t ion with the f o r e s t Development Corporation'of any Sta te , appoint such S ta te Forest Development Corporation as the sole agent for the purpose of s e l l i ng , purchasing or t ranspor t ing any _ minor fores t produce and such appointment shall be a t such terms and condit ions a s may be determined by the Adminis t r a t o r .
(3) If the Corporation i s appointed by the Adminis t r a t o r a s i t s solo agent under t h i s section, i t shal l be lawful for the Corporation"'to au thor i se any person including i t s o f f i c e r s for the purpose of s e l l i ng , purchasing or t ranspor t ing any minor fores t produce on i t s behalf under the provis ions of t h i s Act .
(4) The Administrator may prescr ibe the procedure for the appointment of an agent under sub-section (l) • contd. « .6/— - t 6 i - Const i tu t ion 7 e (l) The Administrator shal l / by n o t i f i c a t i o n in the of Advisory Off ic ia l Gaset te , cons t i t u t e an Advisory Committee consist- Committee* ing of such members net exceeding f ive as may be specified in such no t i f i ca t ion for the purpose specified in sub sect ion (2)i
Provided tha t -
(i) a t l e a s t one member shall be from amongst the persons who, in the opinion of the Administrator/ a re t r a d e r s o rd ina r i ly carrying on the t rade of buying or s e l l i ng of some minor forest produce/ ( i i ) a t l e a s t one member sha l l be from amongst the persons who, in the opinion of the Administrator/ are growers, and ( i i i ) a t l e a s t one member shal l be from amongst persons belonging to the Scheduled Tribes, who are members of the Fores t Labourers Co-operative S o c i e t i e s .
Explanation - For the purpose of t h i s p rov i so , -
(i) a t r ader or a grower shal l mean, in a case where the t r a d e r or the grower i s a loca l au thor i ty , a society, a company or any other assoc ia t ion of ind iv idua ls , a person author ised in writ ing by such loca l au thor i ty , society, company or assoc ia t ion , a s the case may be, to represent i t on such committee;
Cii) "Scheduled Tribes" sha l l mean t r i b e s or t r i b a l communities or p a r t s of, or groups within such t r i b e s or / a s a r G t r i b a l communities/declared and no t i f ied a s such under the Const i tu t ion (Dadra and Nagar Haveli) Scheduled Tribes Order, 1962,
(2) The Committee shall advice the Administrator in the matter of f ixa t ion under sect ion 4 of the f a i r and reasonable p r i ce a t which any minor fores t produce may be purchased by the Administrator, an authorised of f ice r or an agent, and in respect of such other matters re la t ing to the adminis t ra t ion of t h i s Act a s may be referred to i t by the Administrator .
(3) The Committee shall tender i t s advice to the Administrator within such period as the Administrator may specify in that behalf,
(4) The Committee shall perform i t s functions in such manner as may be prescr ibed.
(5) The members of the Committee shall be e n t i t l e d to such remuneration and t r a v e l l i n g and other allowances as ' - may be proscr ibed .
(6) The term of the Committee shall be one year from the date on which i t i s const i tuted* !

(5) Nothing in this section shall be construed to debar the Administrator or the authorised officer or the agent from appropriating to the Central Government any minor forest produce offered for sale, if the Administrator or the authorised officer or the agent has reason to believe that such produce appertains to forest or land belonging to -Hhe Central Government and paying to the person so offering such oroduce for sale only such charges, if any as may have bean incurred by such person in collecting such produce, t .subject to such" rules, as the Administrator may from time to time make.
(6) Where anv person is aggrieved by the appropriation of the minor forest produce to the Central Government under sub-section (5) by an authorised officer or an agent, he may make a compelint to the competent officer.
(7) On receipt of a complaint under sub-sect ion (6) the competent officer rov, after holding, such inquiry as he thinks fi t and after hearing the parties concerned, either allow or reject the complaint.
(8) Where the competent officer allows the complaint, he may direct the authorised officer or the agent to make payment to the aggrieved person of an amount, not. 1 ess than th^ price of such minor forest produce as would have been eayable to hivrr under this section at the time when such produce vas appropriated to the Central Government.
Appeal. 10. Any persons including an authorised officer or an % agent, aggrieved by the decision of the competent officer under sub-section (3), (4), (7) or (8). of section 9 may, within a period of thirty days, from the date of communi cation to him of such decision, make an appeal to the Administrator and the decision of the Administrator on such appeal shall bo final and shall not be called in question in any court, •Registration. 11-. Every grower, not being the Central Government, who ha r , during the year immediately preceding the appointed day or the year preceding any subsequent day, grown'any minor forest produce exceeding such quantity as may be prescribed •• shall, within thirty days after such day, on payment of sue?
fees and in such manner as may be prescribed get his name and address registered in a register to be kept by the proscribed officer, together with the particulars regarding the/ quant it-/ of the minor forest produce grown by him and the land in" which such produce is grown during such year.

The Administrator may, by an order published, in the of Powers, Official Gazette, delegate any of i t s powers (other than the power to fix the price of minor forest produce under ac t ion 4 and the oower to make rules under section 20} o? functions under" this Act or tKe rules made thereunder -to any officer or authority not below rhe rank or a »ftnge Forest Officer or an Assistant Project Manager of tne Corporation, who shall exercise or perform the_same, subject to such conditions and restrictions as the Administrator may specify in the order.

'"J~" (ii) enter and search and place;
( i l l ) seize minor forest produce in respect of which he suspects that any provision of this Act or the rules • made thereunder has been, is being or is about .to be, '- - • contravened, alongwith the receptacle containing such produce or.the vehicle or boat used in carrying such produce.
(2> Every person seising any minor forest produce or other property under clause ( i i i) of sub-section (1) shall place'on such produce or other property a mark indicating •' . that the same has been so seized.
(3) Any forest officer not below the rank of a Range - Forest OfFicer who has seised any property other than a minor forest produce, under clause (i i i) of sub-section
(1) may release the same on the execution by the owner •thereof of a bond for the production of the property so released, whenever required.
(4) The minor forest produce and other property seized under clause (iii) of sub-section (l) shall be kept in the custody of the forest officer not below the rank of a forest e,uard or village headman until an order of his disposal i s received.
