20. wta ftwt wr 1 [ft. i-noifs/j/aa-qj^w (i7e)] MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 20th September, 1989 G.S.R. 846(E).—In exercise of the powers con­ ferred by section 10 of the Dadra and Nagar Haveli Act, 1961 (No. 35 of 1961), the Central Government hereby extends to the Union territory of Dadra and Nagar Haveli, the Madhya Pradesh Kolahal Niyantran Adhiniyam., 1985 (Madhya Pradesh Act No. 1 of 1986), a* at present in force m the State of Madhya Pradesh, subject to the following modifications, namely :— MODIFICATIONS

1. Throughout the Act, for the words "State Government', the word "Administrator" shall be substituted.

2. In Section 1, —

(a) In sub-section (2), for the words "Madhya Pradeeh" the words "Union territory of Dadra and Nagar Haveli" shall be substi­ tuted.

(b) for sub-section (5), the following shall be substituted, namely ; "(3) It shall come into force in such areas and on such date as the Administrator may, by notification, appoint and different dates may be appointed for different areas in the Union territory". 5- In section 2, —

(i) clause (a) shall be re-numbered as clause

(aa) thereof and before the clause so re­ numbered, the following clause shall be inserted, namely ; " (a) "Administrator" means the Administrator of Union territory of Dadra and Nagar Haveli appointed by the President under article 2S9 of the Constitution";

(ii) in clause (d), the words "not below the rank of a Naib Tehsildar"' shall be omrrnttcd.

4. In section 12, for the words "Commissioner of a Division", the words "District Magistrate" shah be substituted.

5. In section 19, sub-section (3) shall be omitted.

6. Section 20 shall be omitted. ANNEXURE THE MADHYA PRADESH KOLAHAL NIYAN- TRAN ADHINIYAM, W85 (Act No. 1 of 13B6) An Act to provide- for control of noises in the State of Madhya Pradesh and for matters connected therewith and incidental thereto. Be it enacted by tire Madhya Pradesh Legislatuie in the Thirty-sixth Year of the Republic of India as follows :—

1. Short title, extent and commencement.— (1) This Act may be called the Madhya Pradesh Kolahal Niyantran Adhiniyam, 1985.

(2) It extends to the whole of Union territory of Dadra and Nagar Haveli. (S) It shall come into force in aueh areas and on such date as the Administrator may, by notification, appoint and different dates may be appointed for different areas in the Union territory. 2. Definitioni.-In thi* Aot, unlaw the eoQtexi othorwiio require*, —

(a) "Administrator" means the Administrafor of Union territory of Dadra and Nagar Haveli appointed by the President under article 239 of the Constitution;

(aa) "loud music" means sound produced on M from band, bag pipe, clarionet, shahnai, drum, bugle, dhole, daf, dafda, naga'a, tasha or jhanj and includes any loud sound produced by any other instrument or meai^;

(b) "loud speaker" means an amplifier or any other device used for the purpose of ampli­ fying sound;

(c) "noise" means sound from any source what­ soever of such character as causes or is likely to cause mental or physical discomfort to a man of ordinary sensibility or suscepti­ bility or causes or is likely to cause distur­ bance in the study;

(d) "prescribed authority" means the District Magistrate or such other authority or officer as may be empowered by the District Magis­ trate in writing in this behalf;

(e) "public place" means a place to which public have eccess or have a right to resort or over which public have a right to pass and includes,—

(i) street or way, whether a through-fare or not;

(ii) shops, hotels, restaurants as are adjacent to tile aforesaid;

(iii) such other place as the Administrator may, by notification, specify in this bthalf;

(f) "soft music" means sound produced on or from any of the following instruments. namely :—

(i) sitar, sarangi, ektara, violin, bansi, dilruba, bin, veena, sarod, jaltarang ;

(ii) piano, harmoniyam, gramophone, tabli, khanjari, dholak and mridang ;

(iii) transistor, record-player, stereo or radio in so far as musical programmes only are con­ cerned.

3. Prohibition of soft music in certain cases.— (f) Soft music on or from instruments mentioned in sub­ clauses (ii) and (iii) of clause (f) of section 2 s>ball not be produced in any public place between the hours 10 P.M. and 6 A.M.

(2) Nothing contained in sub-section (1) shall apply to soft music produced within enclosed areas or indoor so long as such soft music does not result in noise.

4. Prohibition of loud music—Loud music shall not be produced or be caused to be produced in any place between the hours of 10 P.M. and 6 A.M.

5. General restrictions, against the use of loudspea­ ker.-(1) Loud music shall not be operated or be caused to be operated between the hour* of 10 P.M. and 6 A.M.,

(2) Loud speaker shall not also be operated or caused to be operated at any time other,than that mentioned in sub-section (1) ,—

(a) for the purposes of advertising any enter­ tainment, trade or business or for any other commercial announcement : Proyided that the local authority or where there is no local authority, the prescribed authority, may permit the use of loud speaker for any reasonable.cause between the hours as may be specified by him lor the aforesaid purposes on such terms and conditions as may be prescribed; •(b) for playing records or taped music in any open place or public, place ;

(c) within a distance of two hundred metres from a hospital, a nursing home, a telephone exchange, a court, an educational institu­ tion or its hostel, Government offices, office of the local authority and bank :

Provided that where a loud speaker is operated or caused to be operated beyond the above distance its volume shall be so re­ gulated as not to cause any disturbance or nuisance to the above institutions. 6, Restrictions on the use of horntyped loud speaker—The use of horn-type loud speaker is pro­ hibited, unless so permitted by the prescribed autho­ rity.

7. Operation of loudspeaker.—(1) Subject to the provisions of section 5, the prescribed authority may permit operation of a loud-speaker in the following circumstances with restrictions attached thereto . •••

(a) the operation of loud-speaker may be per­ mitted within closed doors and enclosed premises which are open to the public to the extent that noise is not carried outside such closed doors or enclosed premises;

(b) operation of only a cone type loud-speaker enclosed within wooden cabinet shall be permitted in such premises which are either open or not closed on all sides and the loud­ speaker shall be so fixed as not to project sound away from the nearest building.

(2) In all such cases where a loud-speaker is permitted to be operated, the prescribed authority may regulate the duration which shall not exceed six hours in any one day and shall be operated in such manner and during such time and under surb conditions as may be prescribed to eliminate noise.

(3) The prescrihed authority may grant the per­ mission under this section either generally or for a specified period or for specified purpose.

8. Use of loudspeakers for public purposes or making announcements.—Not withstanding any thing contained In section 5, 6 and 7 loud-speakers may be [trrrll—«f¥3{i)J TPOT *T WCTX : WTWp.trr operated for purposes of making announcements on behalf of the Government or local authorities ot public meeting or for the maintenance of law and order. 9 Permission for operation of cone-type loudspeaker.-Notwnhstanding anything contained in sec­ tions 5, 6 and 7 the operation of a cone-type loundspeaker enclosed in a wooden cabinet within enclosed premises of a private building is permitted provided that such operation does not result in noise.

11. Special provision relating to noise emanatlni from motor-veWcs.-(1) No motor vehicle B f f be dnven or used on a public road or in a public place unless the exhausc cistern is proporev muffled so that the vehicle does not give o u f n X

(2) No one shall blow an electric or mechanical horn from a vehicle as to nerve of cause alarm or annoyance to the pedestrians or driver of, and passengers m, the vehicle nearby.

12. Relaxation of provisi0ns,-The District Maristrate may for any reasonable cause relax provisions of section 4, 3, 6 and 7 to such extent as he may con­ sider necessary, ' '

13. Exemption.-(I) Nothing in this Act shall apply to,—

(i) the occasions of National and Social func­ tions a nd religious Festivals mentioned below :—

1. Republic Day (26th January) ;

2. Basant Panchami;

3. Maha Shivratrj;

4. Holi and RangpanchamJ;

5. Gurupadhva;

6. Chaitti Chand ;

7. Ramnawami;

8. Baishakhi;

9. Mahavir Jayanti;

10. Dr. Ambedkar Jayanti;

11. Buddha Poornima;

12. Nagpanchami;

13. Idu-ul-Fiter;

14. Rakshabandhan ; 15- Independence Day (15th August) ;

16. Sri Krisna Jamashtami;

17. Ganesh Chaturthi to Anant Choudas;

18. Sarva Pitrimoksha Amavasya ;

19. Gandhi Jayanti (2nd October);

20. Durgft Padhvt to D*#afctf& j SI. Deepavali;

22. Bhaf Dooj;

23. Guru Nanak Jayanti;

24. Milad-un-nabi;

(2) The prescribed authority may, on application in writing made to him, grant exemption from the Fus ions of sections 4, 5, 6 and 7 for such period on such occasjons and in such areas as may be speci­ a l in the permission.
