1. In section 2, for the words and figures "Punjab Agricultural Produce Markets Act, 1961", the words and figures "Punjab Agricultural Produce Markets Act, 1961, as in force in the Union territory of Chandigarh" ehall be substituted,

2. Section 2A shall be omitted.

3. In section 3, the words "or brought for processing" shall be omitted.

4. Section 4 shall be omitted.

Be it enacted by the Legislature of the State of Haryana in the Twenty-seventh Year of the Republic of India as follows;—

1. Short title.—This Act may be called the Punjab Agricultural Produce Markets (Haryana Amendment and Validation) Act, 1976.

2. Amendment of section 2 of Punjab Act 23 of 1961.—After clause (h) of section 2 of the Punjab Agricultural Produce Markets Act, 1961, as in force in the Union territory of Chandigarh (hereinafter referred to as the principal Act), the following clause shall be inserted and shall always be deemed to have been inserted, namely:— '(hh) "licensee" means a dealer to whom a. licence is granted under section 10 and the rules made under (his Act and includes any person who purchases or sells agricultural produce and to whom a licence is granted as Kacha Arhtia or commission agent or otherwise but does not include a person licensed under section 13;'.

3. Validation.—Notwithstanding anything contained in any law, judgment, decree or order of any court, ariy fee levied, imposed, assessed or collected from a licensee under section 23 of the principal Act and the rules made thereunder on the agricultural produce bought or sold by him in any notified market area shall be deemed to have been validly levied, imposed, assowed or collected and such levy, imposition, assessment or collection shall not be called in question In any court and accordingly—>

(a) no suit or other legal proceedings shall be maintained or continued in any court for the refund of the whole or any part of the fee so levied, imposed, assess­ ed or collected; and

(b) no court shall enforce any decree or order directing the refund of the whole or any part of the fee so levied, imposed, assessed or collected.
