the Central Government hereby extends to the Union territory of Delhi, the Punjab Cinemas (Regulation) Act, 1952 (Punjab Act No, XI of 1952), as at present in force in the State of Haryana on the date of this notification, subject to the following modifications, namely:— MODIFICATIONS
1. In section 1,-
(a) in sub-section (2), for tie words "State of Haryana", the words "Union territory of Delhi" shall be substi tuted ;
(b) for sub-section (3), the following sub-section shall be substituted, namely:— "(3) It shall come into force on such date as the Adminis trator may, by notification in the Delhi Gazette, appoint.
2. In section 2,—
(a) existing clause (a) shall be re-lettered as clause (b) thereof, and before the clause as so re-lettcred tie following clause shall be insorted, namely:— "(a) "Administrator'' means the Administrator of the Union territory of Delhi appointed by President under article 239 of the Constitution ;'
(b) for existing clauses (b) and (c), the following clauses shall be substituted, namely :— '(c) "licensing authority" means the authority having power to grant licences in Delhi under section l l Of the Cinematograph Act, 1952 (Central Act 37 of 1952), read with section 146 of the Delhi Police Act, 197S (Central Act 34 of 1978);
(d) "licensee" means the person to whom a licence hai been granted under sub-ssction (2) of section 12 of the Cinematograph Act, 1952 (Central Act 37 of 1952);'
(c) existing clause (d) shall be re-lettered as clause (e) thereof.
3. Sections 3 to 7 (both inclusive) shall be omitted.
4. In section 7A, in sub-section (4), for tho word "Govern ment" at both the places it occurs, tho word "Administrator";
and for the words "as it thinks fit", the words "as he thinks fit" shall be substituted.
5. In section 7B, for the word "Government", the word "Administrator"; and for the wordg "it may", the words "he may" shall be substituted.
6. In section 7C, for the words and figures "Code ot Criminal Procedure, 1898, the words, figures and brackets "Code of Criminal Procedure, 1973 (2 of 1974)" shall be substituted.
7. Sections 8 and 8A shall be omitted.
8. For section 9, the following section shall be substituted, namely:— "9. Power to make rules—The Administrator may, by notifi cation in the Delhi Gazette, make rules prescribing the time within which and the conditions subject to which an appeal under sub-section (4) of section 7A may be preferred."
9. Sections 10 and 11 shall be omitted.
ANNEXURE TOE PUNJAB CINEMAS (REGULATION) ACT, 1952 (PUNJAB ACT NO. XI OF 1952) AS IN FORCE IN THE STATE OF HARYANA AS EXTENDED TO THE UNION TERRITORY OF DELHI An Act to make provision for regulating exhibitions by means of cinematographs in the Punjab.
It is hereby enacted as follows :—
1. Short title extent and commencement.—(1) This Act may be called (he Punjab Cinemas (Regulation) ACT, 1952,
(2) It extends to the whole of the Union territory of Delhi.
(3) It shall come into force on such date as the Adminisrator may, by notification in the Delhi Guzette, appoint.
2, Definitions.—In this Act, unless the context otherwise requires,—
(a) "Administrator" means the Administrator of the Union territory of Delhi appointed by President under article 239 of tie Constitution;
(b) "Cinematograph" includes any apparalus for the representation of moving pictures or series of pictures;
(c) "licensing authority" means the authority having power to grant licences in Delhi under section 11 of the Cinematograph Act, 1952 (Central Act 37 of 1952) read with section 146 of the Delhi Police Act, 1978 (Central Act 34 of 197S);
(d) "licensee" means the person to whom a licence has been granted under sub-section (2) of section 12 of the Cinematograph Act, 1952; (Central Act 37 of 1952).
(e) "prescribed" means prescribed by rules made under this Art.

7A. Amendment or alteration in classification of seat$ and rates for admission by the licensee..—(1) The licensee shall adhere to the classification of seats and the rates for admission to tho cinematograph exhibition as approved by the licensing authority and shall not amend Or alter the same without tie written approval of the licensing authority.
(2) If the licencsee intends to increase tic rates for admis sion to the cinematograph exhibition, he shall make an appli cation in writing to the licensing authority stating the reasons therefor, at least seven days before the date on which It is proposed to give effect to the increaso in such rates.
(3) If the licensing authority is satisfied that the increase in the rates for admission to the cinematograph exhibition will not unreasonably affect the purchaser of the cinematograph exhibition tickets, it may, for reasons to be recorded in writing, grant the approval for such increase :
Provided that such approval shall not bo granted by tie licensing authority more than twice a year.
(4) Any person aggrieved by the decision of the licensing authority tinder sub-section (3) may, within such time as may be prescribed appeal to the Administrator and the Administra tor may make such order in the case as he thinks fit.
7B. Power of Administrator to amend or alter rates for admission to cinematograph exhibition.—If the Administrator is of opinion that it is necessary or expedient so to do in tie 1358 THE GAZET1E OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] public interest, he may, by order, for reasons, to be recorded in writing, amend or alter the rates for admission to the cinematograph exhibition and the licensee shall comply with such order accordingly.
7C. Penalty for resale of tickets and cognizance of offen ces.—-(1) Notwithstanding anything contained in section 56 of the Indian Easements Act, 1882, a ticket for admission to a cinematograph exhibition shall not be resold for profit by the purchaser thereof.
(2) Whoever re-sales any ticket for admission to a cine matograph exhibition for profit shall be punishable with fine which may extend to two hundred rupees.
(3) Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (Central Act 2 of 1974), an offence under this section shall be deemed to be cognizable within the meaning of that Code.
