3TR. ^ . h w f , ^^^^^"^ t^ I , MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 13th July, 19S2 G.S.R. 493(E)—In exercise of the powers conferred by section 87 of the Punjab Reorganisation Act, 1966 (31 of 1966), the Central Government hereby extends to the Union territory of Chandigarh, the Punjab Electricity (Duty) Amendment Act, 1981 (Punjab Act No. 25 of 1981), aa in force in the State, of Punjab at the date of this notification, subject to the following modifications, namely :— MODIFICATIONS
1. In section 1, for sub-section (2), the followine sub section shall bo substituted, namely :— "(2) It shall come into force on such date as the Ad ministrator may, ty notification in the Chondiearh Gazette, appoint.
Explanation.—In this sub-section 'Administrator' means the Administrator of the Union territory of Chandi garh appointed by the President under article. 239 of the Constitution.".
2. In section 2.—
(a) in the opening portion for the words, bracked and figures ''the Punjab Electricity (Duty) Act 10«" the word,, brackets and figure, 'the Punjab E J c c t S y THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—Sec. 3tj)] (Duly) Act, 1958, us in force in the Union territory of Chandigarh" (hall be substituted;
(b) in clause (1), in sub-section (1) directed by that clause to be substituted in section 3 of «W> principal Act,—
(i) in the opening portion, for the words "State Government" occurring therein for the first time, the words "Central Government" shall be substi tuted and for the same words occurring therein for the second time, the word "Administrator" shall be- substituted;
(ii) in the first proviso, for the woids "State Govern ment", the word -'Administrator" shall he sub stituted;
(Hi) in the opening portion of the third proviso, for the words, brackets and figures ' the com mencement of the Punjab Electricity (Duty) Amendment Act, 1981", the words, brackets and figures "commencement of the Punjab Electncity (Duty) Amendment Act, 1981 (Punjab Act No, 25 of 1981) in the Union territory of Chandi garh", for the -witt-ds "State Government occurring therein for the first time, tlie words "Administartor", and for the words "State Govern ment" occurring therein for the second time, the words "Central Government" shall be substituted;
(c) in clause (2), for the provisos directed by that clause to be added to sub-section (4) of section 3 of the principal Act, the following provisos and
Explanation shall be substituted: namely :— 'Provided that for the purpose of computing the elec tricity duty at the rates specified in this section as amended by the Punjab Electricity (Duty) Amendment Act, 1981 (Punjab Act No. 25 of J981), as extended to the Union territory of Chandigarh, the consumption shown by the meters commencing with the first meter reading date falling after the date appointed by the Adminis trator under sub-section (2) of section 1 of the said Act shall be taken into account :
Provided further that, for the period commencing with the date appointed by the Administrator under sub-section (2) of section 1 of the Punjab Elec tricity (Duty) Amendment Act, 1981 (Punjab Act No. 25 of 1981), as extended to the Union territory of Chandigarh, and endin? with the first meter reading date falling after that oate, the elec tricity duty shall be computed as if the Puniab Electricity (Duty) Amendment Act, 1981 (Punjab Act No. 25 of 1981) had not been extended to the Union territory of Chandigarh.
Explanation.—Tn this section "Administrator" means the Administrator of the Union ten itory of Chandi- Rarh appointed by the President under article 239 of the Constitution.

ANNEXURE THE PUNJAB ELECTRICITY (DUTY) AMENDMENT ACT, 1981 (PUNJAB ACT No. 25 OF 1981) AS EXTEND ED TO THE UNION TERRITORY OF CHANDIGARH.
An Act to amend the Punjab Flec-tricily (Duty) Act,
1958.
Be it enacted by the Legislature of the State of Punjab in the thirty-second Year of the Republic of India as follows t— I. Short title and commencement—(1) This Act may be cnlled the Punjab Electricity (Duty) Amendment Act, 1981.
(2) It shall come into force on such date as the Adminis trator may, by notification in the Chandigarh Gazette, appoint,

2. Amendment ot section 3 of Punjab Act 10 of 1958.— In the Punjab Electricity (Duty) Act, 1958, as in force in the Union territory of Chandigarh (hereinafter referred to a« the principal Act), in section 3,—
(1) for sub-section (1), the following sub-section aball be substituted, namely :•— "(1) There shall be levied and paid to tho Central Government on the energy supplied by the Board to u consumer or a licensee a duty to bo called the electricity duty, at such rate not exceeding twelve pulse per unit its the Administrator may, from time to time, by notification specify :
Provided that the Administrator may specify different rates for different categories of consumers :
Provided further that the rate of electricity duty to b* specified by the Government may exceed twelve pai»e per unit but shall not exceed ten rupees per unit of energy consumed through u temporary connection or temporary extension of an existing connection for the purpose of illumination on the occasion of a marriage or other religious or social function ;
Provided l'uither that as fiom the commencement of the Punjab Electricity (Duty) Amendment Act, 1981 (Punjab Act No. 25 of 1981) in the Union territory of Chandigarh, till the rales of electricity duty arc for the firit time specified by the Adminis trator under this section, the electricity duty shall be levied and paid to the Central Government on the energy supplied by (he Board to a consumer or a licensee and it shall be computed at the following rates :—
(i) where the energy is supplied to a domestic con sumer, the rate of electncity duty shall be eight paiso per unit of energy so supplied;
(ii) where the energy is supplied to a commercial consumer, the rate of electricity duty shall b» ton paisc per unit of energy so supplied ;
(iii) where the eneigy is supplied to any other cate gory of consumers, th© rate of electricity duty shall be five paiso per unit of energy so supplied :
Piovided that if such a consumer uses any part o£ tho energy so supplied to him for a domestic or com mercial purpose,—
(a) where a sepaute meter is in-tailed for measuring energy so used foT a domestic or commercial purpose, the rate of el-ciricitv fluty on the part of the energy so used shall be as specified in clsuw
(i) or clause (ii), as the case may be, and
(b) to where a separate matter is not installed for measur ing energy so used for a domestic or commercial purpose, the rate of electricity duty on the whole of the energy so supplied, including the energy so used, shall be as specified in clause (ii);
(iv) where the energy is supplied to any consumer, not being a licensee thiough a temporary connection or a temporary extension of an existing connection for the purpose of illumination on the occasion of a marriage oi other religious or social function.
the rate of clecti icity duty shall be ten rupees per unit of the energy so supplied notwithstanding anything to the contrary contained in the preceding clause; and
(v) where the energy is supplied to a licensee, the rate of electricity duty shill be five paise per unit of the energy so supplied .
Provided that on the supply of energy v.hich is sold by a licensee not being a licensee as specified in such clause (ii) of clause (d) of section 2.—
(u) to a domestic consumer ot a commeiciul consumer, the rate of electricity duty on the energy »o sold * f [irjt H--<sr? a (ii)] i r a VJ TITW : narErrrr shall be as specified in clause (i) o r clause (ii), as the cas* may be;
(b) to any other category of consumers, the rate of electricity duty on the energy so sold «hall be as specified in clause (iii); and
(c) to any consumer, through a temporary connection or a temporary extension of an existing connection for the purpose of illumination on the occasion of a marriage or other religious or social function, the rate of electricity duty on the energy HO sold shall be as specified in clause (iv),*1;
(2) to sub-section (4), the following provisos shall be added, namely :—
Provided that for the purpose of computing the electricity duty at Ihe rates specified iD this section as amend ed by the Punjab Electricity (Duty) Amendment Act, 1981 (Punjab Act No. 25 of 1981), as extend ed to the Union territory of Chandigarh, the con sumption shown by the meters commencing with the first meter reading date falling after the date appointed by the Administrator under lub-sectlon
(2) of section 1 of the said Act shall bo taken into account :
