5TK. n n , «tf, # f ? c f f ^ L^&% 'J'V •1 MINISTRY OF HOME AFFAIRS NOTIFICATION jsfew Delhi, the 23rd April. 1994 GSK 398(E).—In exercise of the powers com -red by ssciion 87 of the Punjab Re-organisation Central Govern or "Rir *?fl966 (31 of 1966),.th . L(t hereby extends to the Union territory of ijaadigarh, the Punjab Panchayati Raj Act, 1994 7i Punjab Act No. 9 of 1994) as in force in the tgte of Punjab on the date of this notification, subject to the following modifications, namely:— In the Act so extended to the Union territory of Chandigarh;—
(1) in section 1, for sub-sectiou (3) the follow ing sub-section shall be substituted, namely:— "(3) It shall come into force on 23rd dm of April, 1994";
(2) (a) for the words '"State of Punjab", "Pun jab State ", "Punjab" and "State", wherever they ocfctir, except the iong title, the words "Union ter ritory of Chandigarh" shall be substituted;
(b) for the words "Punjab Government", "Gov ernment of Punjab", "Government of the State of Punjab", "State Government", and "State Govern ment of Punjab", wherever they occur, the words Administrator" shall be substituted.
(3) in section 2,—
(i) clause (a) shall be re-nuir/bered as clause "(aa)", and before the clause so re-num bered the following shall be inserted, namely:—-
(a) 'Administrator' means the Administ rator of the Union territory of Chan digarh appointed by the President un der article 239 of "the Constitution;'":
(ii) for clause (o), the following shall be sub stituted, -namely:— 'Co) 'Deputy Commissioner'"means, the De puty Commissioner of the Union ter ritory of Chandigarh;"; (&) in clause (w), the words, "as in force in the Union territory of Chandigarh" shall be inserted at the end;
(w) for clause (ze), the following shall be substituted, namely:— "(ze) 'local authority' includes a Municipal Corporation, Municipal Committee, Zila Parishad, Panchayat Samiti, Gram Panchayat, Notified Area Com mittee, or any other authority consti tuted under this Ac or under any other law' for the time being in force;";
(v) for clause (zv), the following sba;: be substituted, namely:— "(zv) ^Scheduled Castes' means any of the Scheduled Castes specified in Part IT of the Schedule to the Constitution (scheduled Castes) Union Territo ries) Order, 1951;";
(vi) in clause (zzc) the words "for the time being m force1', the words "for the time being in force in the Union territory of Chandigarh" shall be substituted;
(vii) in clause (zzg), the words "as in force m the Union territory of Chandigarh" shall be inserted at the end:
(4) in section 3:
(i) in sub-section ( I ) , in the second proviso. m clause (a), for the words "for the time being m force", the words "for the time being inforce in the Union territory of Cnandjgarh" shall be substituted;
(ii) in sub-section (4) for the words "for the time being inforce", the words "for the time being inforce in the Union territory or Chandigarh" shall be substituted.
(5) section 26 shall be omitted.
(6) in section 32, for the words "for the time being mrorce", wherever they occur the words as inforce in fee Union territory of Chandigarhshall be substituted.
(7) in section 40, for the words "for the feae b-ng inforce", wherever thev .-coir -ths words as mrorce in the Union territory of Chandigarh" shall be substituted.
(8) in section 47, in sub-section (3). the words as inforce m the Union territory of Chandigarh" Snail be inserted at the end.
(9) in section 56, in sub-section ( I ) , in clause
(d), for the words "for the time beine inforce" the words "as inforce in the Union territory of Chandigarh'' shall be substituted.
(10) in section 60,—
(i) in clause (c), for the words "for the time being inforce", the words "for the time being inforce in the Union territory of Chandigarh" shall be substituted; '
(ii) in clause (f\ after the words and figures "the Punjab Tenancy Act, 1887", the words "as inforce in the Union territory of Chandigarh", shall be inserted. ( U ) in section 98, in sub-section (2) in the second proviso, after the words and figures "the THE GAZETTE OF INDIA b> "RAOEDINAR ^ <y [PART IE-SEC.^ Punjab Panchayat Samities and Zila Parishads ',cl 196"", the words "as in force in the Union territory of Chandigarh" shall be inserted. 0 2 ) in section 99, in sub-section (1) ,— •i) for clause (c), the following shall be substituted, namely:— "(c) Member of Parliament (Loh Sabhs) representing the union Territory n hanclisarh."':
(a) Clause (d) shall be omitted.
(13) to section 161, to sub-section (1) , ind ie second proviso, after the words and figures the Punjab 'Panchayat Samiti Zila Parishads Act, 1961" the words "as in force m the Union terri tory of Chandigarh" shall be inserted.
(14) in section 162, to sub-section ' ( . ! ) ,—
(i) for clause (c) , the following shall be substituted, namely:— "(c) the Member of Parliament (Lot. Sabha) representing the Union terri tory of "Chandigarh.";
(if) clause (d) shall be omitted.
