ANNEXURE THE TAMIL NADU RELIEF UNDERTAKINGS (SPECIAL PROVISIONS) ACT 1969 fACT NO.
XXI OF 1969) AS EXTENDED TO THE UNION TERRITORY OF PONDICHERRY.
An Act to enable the Government to make special provisions for a limited period in respect of industrial relations, financial obligations and other like matters >n relation to industrial undertakings the running of which is considered essential as a measure of pre venting, or of providing relief against, unemployment.
BE it enacted by the Legislature of the State of Tamil Nadu in the Twentieth Year of the Republic of India as follows :—•
1. Short title, extent and commencement.—
(1) This Act may b c called the Tamil Nadu Relief Undertakings (Special Provisions) Act, 1969.
(2) It extends to the whole of the Union territory of Pondicherry,
(3) Tt shall come into force on such date as the Administrator may, by notification, in the Pordicherry Gazette, appoint.
2. Definitions.—In this Act, unless the context otherwise requires,-
(1) "Administrator" means Pis Administrator of the Union territory of Pondicherry, appoint ed by the PreVdent under article 239 of the Constitution ;
(1A) "Government" means the Cenehal Govern ment :
(2J "Government company ' m^ans any company in which net less than fifty-ore per cent of the paid up share capital'is held by the Central Onv-.'rnnien'. r.'ul includes i r«n-- pany which is a subsidiary of any such Government company.
Explanation.—Tn this clause, "company" means a company as defined in the Companies Act. 1956" fCcn'r;;! Au 1 of l^Shj;
(3) "industry" means arty ton-'ess, trade, under taking, manufacture or calling of employers and includes any calling, service, employ ment of which is under any law or avocation of workmen and the word "industrial" shall be construed accordingly ;
(4) "idief undertaking" means a State industrial undertaking in respect of which a: declara tion under section 3 is in force;
(5) "State industrial undertaking" means an industrial undertaking—
(a) which is started or which or the manage ment of which is under any law or agreement acquired or otherwise taken over by the Centra:! Government or by a Government company and is run or proposed to be run by, or under the authority of, the Central Government or a Government company; or
(b) to which any loan, advance, or grant has been given, or in respect uf any loan whereeof, a guarantee has been given, by the Central Government or a Government company or Corporation.
3, Declaration of relief undertaking.—The Adminis trator may, if satisfied thru it is necessary or expe dient so to do in the public interest and after petting approval of the Central Government, with a view to enabling the continued running' or restarting of a State industrial undertaking as a measure of prevent ing. or of providing relief against, unemployment, declare, by notification, that the State industrial under taking shall, with e^ecl on and from such date and for such pencd as may be specified in the notification, bc a relief undertaking :
Provided that the period so specified shall not, in the first instance, exceed one year but may, by a like notification, b ; extended from time to time," by any period not exceeding one year at anv ore time so however-that no notification issuer! "under this section shall in any case remain in force for more than ten years in the aggregate,
4. Application of certain enactments and contracts, agreements, etc,, to relief undertaking.—The Adminis trator may. if satisfied that it is necessary or expedient so to do for the purposes specified in section 3, direct by notificcrUcn,—
(a) ihat in relation to any rekicf undertaking all or any of the enactments specified in the Schedule shall n«t 3>jnly or shall applv with_ sucb adaptations. whether by way of modification, addition or omission, as may bc specified fo such notification ; or
(b) th?t aM or any of the contracts, assurances of property, nqreements, settlements, awards, standing orders or rilm instruments in force, to which any relief undertaking is a par'" or which mav be applicable to any relief nn'IrrtnVin". immediately before the datp with effect on and from which the rol'-'f imdertPkin" w>s declared a relief undertaking, shall bc suspended in operation or that all or any of the rights privileges, [inn II—TO S[i)j wrm «r TTTT̂ . tmrar"T obligations and liabilities accruing or arising thereunder before the said daic, shall fee impended or be enforceable with such modifications and in such manner as may be specified in such notification.
5 Overriding effect of notification under section 4—A nolificalion under section 4 shall have efiect notwithstanding anything to the contrary contained in any other law, agreement or instrument or any decree or order of a court, tribunal, officer or other authority.
6 Suspension or modification of certain remedies, riP'hts etc., stay of proceedings, their revival and coSntinuance,-A remedy for the enforcement of any right, privilege, obligation or hab.Hy referred to k clause (b) of section 4 and suspended or modified bv a notification under that section shall, in accord ance with the terms of the notification be suspended or modified, and all proceedings relating UKreto pending before any court, tribunal, oiheer or other S S P t y shall accordingly be stayed or be continued subject to such modification, so however, .hat on the notification ceasing to have effectfa) any right, privilege, obligation « fiibility K> suspended or modiiied shall revive and oe enforceable as if the notification had never been Usued; and
(b) any proceeding so stayed shall be proceeded with subjecet to the provisions of any law which may than be in force from *he stage which had been reached when the proceeding was stayed.
7. Pereiod of limitation.—in computing the period of limitation for the enforcement of any right, privilege obligation or liability referred to in clause (b) of section 4 the period during which it or the remedy for the enforcement thereof was suspended, snail be excluded.
