The Excise Duty of the Indian made foreign liquor issued to the Defence Services personnel shall be charged for (Rum) at the rate of 20 percent and for other Indian made foreign liquor [Whisky, Brandy, Gin, Vodka, Wine, Malt (Beer) ect.] at the rate of 30 percent of duty, payable by the Civilians.
Explanation-(1) Foreign liquor (Spirit) includes Whisky, Brandy, Rum, Gin, Vodka, Liquor, Cordial, Bitter and their mixtures and other preparations, containing spirit as main ingredient. Heguer users, feiss 31 ard 2018 418 (5)

Bhopal, the 31st March 2018 No. F-B-1-01-2018-V-(15).—WHEREAS, the State Government considers it necessary that the following amendments in the Rule of General Application should be made at once without previous publication in the official Gazette; Heyes Usga, feats 31 ard 2018 418 (13) Now, THEREFORE, in exercise of the powers conferred by. sub-section (1) and clauses (e), (f) and (h) of sub-section (2), and proviso of sub-section (3) of Section 62, read with Section 63 of the Madhya Pradesh Excise Act, 1915 (No. II of 1915) and in supersession of this department’s Notification No. F-B-1-01-2017- 02-V-(12), dated 27th March, 2017 and Notification No. F-B-1-1-2017-2-V(31), dated 13th October, 2017, the State Government, hereby, makes the following amendment in the Rules of General Application published under Notification No. (14) V-SR, dated 7th January, 1960, namely:— AMENDMENTS In the said rules, for rule 1, the following rule shall be substituted, namely:—
1. Location of shops,—
(1) (a) In the areas with a population of more than 20,000 no shop for the sale of liquor shall be situated within a distance of 500 metres of the outer edge of the national or state highway or of a service lane along the highway.
(b) In the areas with a population of 20,000 or less no shop for the sale of liquor shall be situated within a distance of 220 metres of the outer edge of the national or state highway or of a service lane along the highway.
(c) No shop for the sale of liquor shall be visible from a national or state highway.
(d) All signages and advertisements of the availability of the liquor shall be prohibited on national and state highway.
(e) No shop for the sale of liquor shall be directly accessible from a national or state highway:
Provided that, the provisions of sub-rule (1) shall not be applicable to a liquior shop situated/located in section/part of any national highway or any state highway within the limits of any Urban body (Municipal Corporation, Municipality and Nagar Panchayat).
(2) Any shop for the sale of liquor shall not be situated upto a distance of 50 metres from lawful religious institution, girls school, girls college and lawful girls hostel.
(3) While granting licence to a retail shop for the consumption of liquor on the premises, the following conditions shall be considered, if the shop is:-—
(a) Situated near the mill, factory or other place where a large number of labourers are employed, the mill owner or employer of such labourers an opportunity of stating their objections to the proposal for opening of such shop has been given.
(b) Situated near a religious or any educational institution, lawful girls hostel, hospital, colony of members of Scheduled Castes, labour colony, bus stand, or railway station, when such shop is situated at a distance more than 50 meters from such places. (4 Any liquor shop licensed for consumption in the premises shall not be deemed to be situated within prohibited distance referred to in clause (b) of sub-rule (3), if at any time after such licence is granted, any institution (educational or religious), Lawful girls hostel, hospital, or bus stand etc. referred to in clause (b) of sub-rule (3) comes into existence within a distance of fifty meters or less from that shop:
Provided that the provisions of clause (a) and clause (b) of sub-rule (3) shall not applicable to shops for the sale of liquor which are existing at the present site since 31st March, 2007, except those shops for the sale of liquor which are situated at a distance of 50 meters or less from the religious institutions, girls school, girls college and Lawful girls hostel.
Explanation.—For the purposes of this rule—
(a) “Fiducational institution” means any pre-primary, primary or secondary school managed or recognized by any local authority or the State Government or the Central Government and any college affiliated to any University established by law, but does not include any coaching institution. 418 (14) meagee tsa, feat 31 ard 2018

(ii) “Religious institution” means an institution for the promotion of any religion and includes temple, math, mosque, church or other place of public religious worship which is managed or owned by a public trust registered under the Madhya Pradesh Public Trusts Act, 1951 or any other enactment for the time being in force and shall include such other religious institutions as the State Government may by order specify in this behalf. The distance referred to in sub-rule (2) and sub-rule (3) (b) shall be measured from the mid point of the entrance of the shop along the nearest path by which a pedestrian ordinarily reaches at the, Mid-point of the nearest gate of the institution if there is a compund wall and if there is no compound wall then the mid-point of the nearest entrance of the institution, or The mid-point of the nearest gate of the Bus stand, Station or depot or Madhya Pradesh State Road Transport Corporation if there is a compound wall and if there is no compound wall then the nearest point of the boundary of such Bus stand, station or depot. “Bus Stand” means bus stand of MPSRTC or of Municipal Corporation or any other local body as the case may be. “Hospital” means any hospital or nursing home run by State or Central Government or by any “Charitable Institution” where atleast facilities of 10 Beds are available for admission and treatment of 10 patients.

Bhopal, the 31st March 2018 No, F-B-1-01-2018-2-V-(18).—In exercise of the powers conferred by sub-section (1) of Section 28 of the Madhya Pradesh Excise Act, 1915 (No. II of 1915) and Rule 14 of the Madhya Pradesh Beer and Wine Rules and in supersession of this department’s Notification No. F-B-1-44-2015-2-V(3), dated 2nd January, 2016, the State Government, hereby, prescribes the Bottling fee at the rate of Rs. 15/- per bulk litre on Foreign Liquor (beer) manufactured for consumption in the State of Madhya Pradesh by manufacturers of National status under franchisee or any other system.

(ii) In serial number 2 (ii) for the letter and figure “Rs. 50.00 per permit” the letter and figure “Rs.
