PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् अजधसूचना नई दिल्ली, 4 दिसम् बर, 2024 का.आ. 5226(अ).—प्रारुप अजधसूचना भारत के रािपत्र, असाधारण में संखर्ांक का.आ. 3565 (अ), तारीख 9 अगस्ट्त, 2023, द्वारा प्रकाजित की गई थी, जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उि रािपत्र अजधसूचना की प्रजतर्ां िनता को तारीख 10 अगस्ट्त , 2023 को उपलब्ध करा िी गई थी;

और, उि प्रारुप अजधसूचना की बाबत व्यजिर्ों और पणधाररर्ों से प्राप्त आक्षेपों और सुझावों पर कें द्रीर् सरकार द्वारा जवचार दकर्ा गर्ा था;

और, भीमगढ़ वन्र्िीव अभर्ारण्र् कनााटक में बेलगावी जिल ेके खानापुर तालुक में महािर्ी निी के िल ग्रहण क्षेत्र में फैला हुआ ह ैऔर र्ह कनााटक के उत्तर कन्नड़ जिले में िांिेली वन्र्िीव अभर्ारण्र् और गोवा में महािर्ी वन्र्िीव अभर्ारण्र् के साथ सीमा साझा करता ह ैऔर अभर्ारण्र् का कुल क्षेत्रफल 19042.58 हके्टेर्र ह ैऔर अभर्ारण्र् को उच्च पुष्प और िीव जवजवधता वाल ेआरजक्षत वन क्षेत्रों से बनार्ा गर्ा है;

और, पजिमी घाट अपन ेअजद्वतीर् स्ट्थान के कारण भारतीर् प्रार्द्वीप में िैव जवजवधता के संरक्षण और उनके द्वारा समर्थात पाररजस्ट्थजतक प्रचुरता के जलए महत्वपूणा भूजमका जनभाते हैं, उनकी समृद्ध िैव जवजवधता और संवेिनिील स.ं 4833] नई दिल्ली, बुधवार, दिसम् बर 4, 2024/अग्रहार्ण 13, 1946 No. 4833] NEW DELHI, WEDNESDAY, DECEMBER 4, 2024/AGRAHAYANA 13, 1946 सी.जी.-डी.एल.-अ.-09122024-259269 CG-DL-E-09122024-259269 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] भू-आकृजत जवज्ञान और जवजिष्टता िोड़त ेहैं और भीमगढ़ के्षत्र में व्यापक िैव जवजवधता ह ैऔर बाघ और अन्र् िंगली िानवरों के जलए गजलर्ारा प्रिान करता ह।ै जनकटवती संरजक्षत क्षेत्रों वाल ेिानवर और भीमगढ़ की बारापडे गुफा भारत में रॉटन के फ्री टेल्ड चमगािड़ों के जलए एकमात्र ज्ञात आश्रर् स्ट्थल ह ै और भीमगढ़ के्षत्र कृष्णापुर गुफाओं में जथर्ोबाल््स के मकबरे के जलए िेि में िलुाभ आवासों में से एक ह;ै र्ह क्षेत्र पजिमी घाट के मखुर् क्षेत्र में ह,ै जिसमें खड़ी ढलानों वाल े अधा-सिाबहार और सिाबहार घन े िंगल िाजमल हैं और इस क्षेत्र में समृद्ध पुष्प और िीव जवजवधता ह ैऔर र्ह रॉटन के मुि पूछं वाले चमगािड़ (ओटोमॉप्स रॉटोनी) िैसी गंभीर रूप से लपु्तप्रार् और स्ट्थाजनक प्रिाजतर्ों का जनवास स्ट्थान ह ैऔर जथर्ोबाल्ड के मकबरे चमगािड़ों (टैफोज़स जथर्ोबाल्डी) और बारापेड गुफाओं को भारत में रॉटन के मुि पूछं वाल ेचमगािड़ों के जलए एकमात्र आश्रर् और प्रिनन स्ट्थान के रूप में िाना िाता ह ैऔर समृद्ध िैव जवजवधता वाला र्ह क्षेत्र गोवा में महािर्ी वन्र्िीव अभर्ारण्र् के पूवा में और उत्तर में जस्ट्थत ह।ै िांिेली वन्र्िीव अभर्ारण्र् कनााटक में ह ैऔर र्ह पूरा क्षेत्र िांिेली वन्र्िीव अभर्ारण्र्, काली टाइगर ररिवा, भगवान महावीर और महािार्ी वन्र्िीव अभर्ारण्र्ों के बीच बाघों और अन्र् वन्र्िीवों के जलए प्राकृजतक गजलर्ारे के रूप में कार्ा करता ह ै और र्ह क्षेत्र महािार्ी िैसी कई महत्वपूणा नदिर्ों का उद्गम स्ट्थल और िलग्रहण बेजसन ह,ै बैलनाडी, आदि धाराओं की संखर्ा के अलावा और क्षेत्र में कई गुफाओं के साथ कई भू-आकृजत जवज्ञान चूना पत्थर की संरचनाएं िाजमल हैं, िो इस स्ट्थान के जलए स्ट्थाजनक िीवों और वनस्ट्पजतर्ों की जवस्ट्तृत जवजवधता का समथान करती हैं और उपरोि के अलावा, अभर्ारण्र् ऐजतहाजसक भीमगढ़ दकले के खंडहरों को कवर करता है, जिसे संरजक्षत करने की आवश्र्कता ह;ै और, भीमगढ़ वन्र्िीव अभर्ारण्र् के सिाबहार िंगलों में प्रमुख वृक्ष प्रिाजतर्ां अंिन (मेमेसीलोन एडुल)े, हबे्बालासु (आटोकापास जहसुाटस), वाटे (आटोकापास लकूचा), रामपात्री (जमररजस्ट्टका मालाबाररकम), िालजचनी (जसनामोमम एसपीएस), नंिी (लगेरस्ट्रोजमर्ा लांसोलाटा), धपु (वेटेररर्ा इंजडका), अिोक (साराकैजन्डका), दफिटेल पाम (कैररर्ोटॉरेन्स), गोवाडा (मैजपर्ा फोरटडा) हरड़ (टर्मानजलर्ा चेबुला), कवल (केरेर्ा आबोररर्ा), आंवला (एजम्ब्लका ऑदफजसनैजलस), तारे (टर्मानजलर्ा बेजलररका), होन (परेोकापास मासुाजपर्म), ककंडल (टर्मानजलर्ा पैजनकुलता), िीिम (डालबर्गार्ा लैरटफोजलर्ा), िैक (आटोकापास एसपीपी), मुकी (बुचाजनर्ा लानज़ान), धपु (जडप्टरोकापास इंजडकस), आदि का बाहुल्र् होता ह।ै और, भीमगढ़ वन्र्िीव अभर्ारण्र् औषधीर् पौधों का एक समृद्ध भंडार ह ैऔर अमागांव के अधा सिाबहार िंगलों में एक ऐसा क्षेत्र 2010-11 के िौरान औषधीर् पौधों के संरक्षण क्षेत्र के जलए पहचाना गर्ा ह ैऔर अजभजलजखत प्रिाजतर्ों में से लगभग 82 प्रजतित पौध ेपाए िात ेहैं। औषधीर् महत्व के होन ेके जलए और अजभजलजखत की गई पौधों की प्रिाजतर्ों में से लगभग 47 प्रजतित पडे़ हैं, इसके बाि झाजड़र्ााँ, 28 प्रजतित और िड़ी-बूरटर्ााँ, 18 प्रजतित हैं और र्ह क्षेत्र कई स्ट्थाजनक पौधों की प्रिाजतर्ों का भी घर ह,ै िैसे दक एंजसस्ट्रोक्लाडस हनेनेस, डार्ोस्ट्पार्रोस पैजनकुलाटा, र्ओूजनमस इंजडकस, माजस्ट्टजक्सर्ा आबोररर्ा, आदि और ििा दकए गए औषधीर् पौधों में से कई िैसे अररस्ट्टोलोजचर्ा टैगाला, डार्ोस्ट्पार्रोस मोंटाना, एजम्ब्लका ऑदफजसनैजलस, गार्साजनर्ा इंजडका, नॉथापोजडट्स जनमोजनर्ाना आदि उच्च औषधीर् और आर्थाक मूल्र् वाल ेहैं;

और, भीमगढ़ वन्र्िीव अभर्ारण्र् जवजभन्न प्रकार के स्ट्तनधाररर्ों, सरीसृपों, पजक्षर्ों, जततजलर्ों और अन्र् कीड़ों का पर्ाावास ह ैऔर इस तथ्र् के अलावा दक भीमगढ़ रॉटन फ्री टेल्ड चमगािड़ों के पर्ाावास और प्रिनन के जलए एकमात्र ज्ञात स्ट्थान ह,ै इस के्षत्र में अन्र् महत्वपूणा जिकारी और जिकार करने वाल ेिानवर भी हैं और अभर्ारण्र् में रह रह ेबाघों की उपजस्ट्थजत और उनके जलए अच्छे जिकार की उपलब्धता से पता चलता ह ैदक र्ह बाघों के जलए एक अच्छा पर्ाावास स्ट्थल ह ैऔर अभर्ारण्र् जवजभन्न प्रकार के िीवों िैसे सांभर (सवास र्ूजनकलर), भारतीर् गौर (बोस गौरस), चौसींगा मगृ (टेरासेरस क्वाजिकोर्नास), काकड़ जहरण (मुंरटर्ाकस मुंटिैक), बनलैा सूअर (सस स्ट्रोफा), भारतीर् रेस्ट्टेड साही (जहजस्ट्टक्सइंजडका), भारतीर् खरगोि (लपेस नाइग्रीकोजलस), भारतीर् जचत्तीिार िेवरोटेन (रैगुलस मेजमन्ना), ग्रे लगंूर (प्रेजस्ट्बरटस एंटेलस), रेड स्ट्लेंडर लोररस (लोररस टार्डाग्राडस), चीतल (एजक्सस एजक्सस), तेंिआु (पेंथरेा पाडास), ढोल र्ा [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 भारतीर् िंगली कुत्ता (कुओन अल्पाइनस), तेंिआु जबल्ली (फेजलस बेंगालेंजसस) रीछ (मलेसास उर्सानस), स्ट् वणा जसर्ार (कैजनस ऑररर्स), पार्थन (पार्थन मोलुरस), ककंग कोबरा (ओदफर्ोफैगस हन्ना), रसेल वाइपर (िबोइर्ा रसेली), सामान्र् करैत (बंगारस कैर्ूालस), रैट स्नेक (पटार्स म्र्ूकोसा), वाइन स्नेक (अहतैलु्लानासुता), सामान्र् भारतीर् मॉजनटर जछपकली (वरनस बेंगालेंजससभारतीर् उड़ाकू जछपकली (िेको डुसुजमएरी), मालाबार गैंट जगलहरी (रतुफा इंजडका) आदि का पर्ाावास ह।ै भीमगढ़ के्षत्र को बाघों के जलए सबसे आििा पर्ाावासों में से एक माना िाता ह ैऔर ऐसा माना िाता ह ैदक छह से आठ बाघ अभर्ारण्र् में रहते हैं और कनााटक और गोवा राज्र् के आसपास के िंगलों में भी घूम रह ेहैं। और, भीमगढ़ वन् र्िीव अभर्ारण् र् में पजक्षर्ों की बहुलता ह ै जिसमें जविाल भारतीर् धनिे सजम्मजलत ह ैऔर अंगारक, खंिन, कठफोड़वा, कौजडल्ला, चील, बगलुा, िकरखोरा, उल्ल ूऔर पंडुक की जवजवधता ह।ै ग्र ेिंगली मुरगा, िंगल मर्ना, महोख, परलोक मक्खीमार, मालाबार अगंारक आदि भी इस के्षत्र में सामान्र्तः दिखाई िेते हैं। और, भीमगढ़ वन् र्िीव अभर्ारण् र् के चारों ओर के के्षत्र को, जिसका जवस्ट्तार और सीमाएं इस अजधसूचना के परैा 1 में जवजनर्िाष्ट हैं, पर्ाावरण क िजृष्ट से पाररजस्ट्थजतक संवेिी िोन के रूप में सुरजक्षत और संरजक्षत करना तथा उि पाररजस्ट्थजतक संवेिी िोन में उद्योगों र्ा उद्योगों के वगो के प्रचालन तथा प्रसंस्ट्करण करने को प्रजतजषद्ध करना आवश्र्क ह;ै अतः, अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 19)। (जिसे इसके पिात् इस अजधसूचना में पर्ाावरण अजधजनर्म कहा गर्ा ह।ै) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, कनााटक राज्र् में भीमगढ़ वन्र्िीव अभर्ारण्र् की सीमा के आस-पास के क्षेत्र को पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पिात् इस अजधसूचना में पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसके ब्र्ौरे जनम्नानुसार ह,ै अथाात ्: -

1. पाररजस्ट्थजतकी सवंिेी िोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेिी ज़ोन 117.75 वगा दकलोमीटर के क्षेत्र में फैला हुआ ह,ै जिसका जवस्ट्तार 0 दकलोमीटर (अंतर राज्र् सीमा और काली टाइगर ररिवा) से 3.23 दकलोमीटर तक ह,ै जिसमें आसपास के 13 गांव िाजमल हैं।

(2) पाररजस्ट्थजतकी संवेिी ज़ोन का सीमा जववरण उपाबधं-क के रूप में संलग्न ह ैऔर इसकी सीमा पर प्रमुख स्ट्थानों के साथ पाररजस्ट्थजतकी संवेिी िोन के मानजचत्र उपाबधं-ख के रूप में संलग्न हैं।

(3) संरजक्षत क्षेत्र और पाररजस्ट्थजतकी संवेिी िोन सीमा के प्रमुख स्ट्थानों के ग्लोबल पोजििननगं जसस्ट्टम जनिेिांक उपाबधं-ग के रूप में सलंग्न हैं।

(4) पाररजस्ट्थजतकी संवेिी ज़ोन के भीतर आन ेवाले गांवों के ब्र्ौरे उपाबधं-घ के रूप में संलग्न ह ैऔर पाररजस्ट्थजतकी संवेिी ज़ोन सीमा के भीतर आने वाल ेआरजक्षत वन क्षेत्र के ब्र्ौरे उपाबधं-ड. के रूप में संलग्न ह।ै और पाररजस्ट्थजतकी संवेिी ज़ोन की सीमा के भीतर रािस्ट्व क्षते्र के ब्र्ौरे उपाबधं-च में दिर् ेगए हैं और सवेक्षण संखर्ा के साथ आरजक्षत वन भूजम िो पाररजस्ट्थजतकी संवेिी ज़ोन के भीतर आती ह ैउसे उपाबधं-छ के रूप में संलग्न दकर्ा गर्ा ह।ै

(5) वन ब्लॉक क्षेत्रों में सभी दरर्ाकलाप भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69) के उपबंधों द्वारा िाजसत होंग ेऔर संरजक्षत क्षेत्र अभर्ारण्र् में सभी दरर्ाकलाप और वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), राज्र् अजधजनर्मों, जनर्मों और मागाििाक जसद्धांतों के उपबंधों द्वारा िाजसत होगें ।

(6)कुल क्षेत्रफल 11413.25 हके्टेर्र और आरजक्षत वन तथा 525.04 हके्टेर्र रािस्ट्व क्षेत्र पाररजस्ट्थजतकी संवेिी िोन की सीमा के भीतर आता ह।ै

2. पाररजस्ट्थजतकी सवंिेी ज़ोन के जलए आचंजलक महार्ोिना. –(1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए, रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और इस अजधसूचना में दिए गए उपबंधों का पालन करत ेहुए, आंचजलक महार्ोिना तैर्ार और अजधसूजचत करेगा। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(2) पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना राज्र् सरकार द्वारा इस अजधसूचना के उपबंधों के अनुसार और सुसंगत कें द्रीर् और राज्र् जवजधर्ों और कें द्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हो, के अनरुूप तैर्ार होगी ।

(3) आंचजलक महार्ोिना उि र्ोिना में पाररजस्ट्थजतक और पर्ाावरणीर् जवचारों को एकीकृत करन ेके जलए राज्र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी, अथाात:् -

(i) पर्ाावरण ;

(ii) वन और वन्र्िीव;

(iii) कृजष;

(iv) रािस्ट्व;

(v) िहरी जवकास;

(vi) पर्ाटन;

(vii) ग्रामीण जवकास;

(viii) नसंचाई और बाढ़ जनर्ंत्रण;

(ix) नगरपाजलका;

(x) पंचार्ती राि;

(xi) लोक जनमााण जवभाग, कनााटक सड़क जवकास जनगम जलजमटेड, भारतीर् राष्ट्रीर् रािमागा प्राजधकरण;

(xii) हुबली इलेजक्रजसटी सप्लाई कंपनी जलजमटेड;

(xiii) पुजलस जवभाग (गृह);

(xiv) कनााटक राज्र् प्रिषूण जनर्ंत्रण बोडा।

(4) आंचजलक महार्ोिना अनमुोदित जवद्यामान भू-उपर्ोग, अवसंरचना और दरर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो और आंचजलक महार्ोिना सभी अवसंरचना और दरर्ाकलापों में िो अजधक और पाररजस्ट्थजतकी अनुकूल हो का संवधान करेगी।

(5) आंचजलक महार्ोिना में अनाछादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, िलग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं और पाररजस्ट्थजतकी तथा पर्ाावरण के ऐसे अन्र् पहलुओं, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह,ै के जलए उपबंध होंगे।

(6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेषताओं के ब्र्ोरों से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट्थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट्मों, कृजष क्षेत्रों, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट्थल, उद्यान कृजष क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्ंकन करेगी।

(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और सारणी में सूचीबद्ध परैाग्राफ 4 में प्रजतजसद्ध और जवजनर्जमत दरर्ाकलापों का पालन करेगा और स्ट्थानीर् समुिार् की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास को सुजनजित और उसकी अजभबृजद्ध भी करेगा।

(8) आंचजलक महार्ोिना प्रािेजिक जवकास र्ोिना की सह-जवस्ट्तारी होगी। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपन ेकार्ों को पूरा करने के जलए मानीटरी सजमजत के जलए संिभा िस्ट्तावेि तैर्ार करेगी।

(10) पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना तैर्ार होन ेतक, सभी नए संजनमााण और अन्र् जवकासात्मक दरर्ाकलापों को मानीटरी सजमजत को भेिा िाएगा।

3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्. - राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्: -

(1) भ-ूउपर्ोग. – (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजष क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत उद्यानों और खुले स्ट्थानों का वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दरर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा:

परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर ऊपर भाग (क), में जवजनर्िाष्ट प्रर्ोिन से जभन्न प्रर्ोिन के जलए कृजष और अन्र् भूजम का संपररवतान, मानीटरी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा अनुमोिन से प्रािेजिक नगर र्ोिना अजधजनर्म तथा र्था लागू केन्द्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों एवं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करन ेके जलए अनजु्ञात दकर्ा िाएगा िैसे:-

(i) जवद्यमान सड़कों को चौड़ा करना, उन्हें सुिढृ़ करना और नई सड़कों का संजनमााण करना;

(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;

(iii) प्रिषूण उत्पन्न न करन ेवाले लघ ुउद्योग;

(iv) कुटीर उद्योग एवं जिनके अंतगात ्ग्रामीण उद्योग भी है; सुजवधा भण्डार और स्ट्थानीर् सुजवधाएं; सहार्क पाररजस्ट्थजतकी पर्ाटन जिनके अंतगात ग्रहवास सजम्मजलत ह ैऔर;

(v) पैराग्राफ-4 में दिए गए संवर्धात दरर्ाकलापः परंतु र्ह और दक प्रािेजिक नगर र्ोिना अजधजनर्म तथा राज्र् सरकार के अन्र् जनर्मों एवं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन और संजवधान के अनुच्छेि 244 के अनपुालन तथा तत्समर् प्रवृत्त जवजध के उपबंधों के जबना, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै वाजणजज्र्क र्ा औद्योजगक जवकास दरर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनजु्ञात नहीं होगा:

परंत ु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के भीतर आने वाली भूजम के अजभलेखों में हुई दकसी तु्ररट को, मानीटरी सजमजत के जवचार प्राप्त करने के पिात्, राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार सुधारा िाएगा और उि तु्ररट को सुधारने की सूचना कें द्रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी:

परंत ुर्ह भी दक तु्ररट को सुधारने में, इस उप-पैरा के अधीन र्था उपबंजधत के जसवार्, दकसी भी ििा में भू-उपर्ोग का पररवतान िाजमल नहीं होगा। (ख) वनीकरण तथा वास िीणोंद्धार दरर्ाकलापों सजहत अनुप्रर्ुि र्ा अनुत् पािक कृजष क्षेत्रों में पुन: नवीनीकरण के प्रर्ास दकए िाएंगे।

(2) प्राकृजतक िल जनकार्. - आंचजलक महार्ोिना में सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीनीकरण के जलए र्ोिना सजम् मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों में र्ा उसके पास जवकास दरर्ाकलापों को प्रजतजषद्ध करन े के बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हों ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएगंे। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन. – (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दरर्ाकलाप र्ा जवद्यमान पर्ाटन दरर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन के जलए पर्ाटन महार्ोिना के अनुसार होगा। (ख) पर्ाटन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा से पर्ाटन जवभाग द्वारा तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के घटक के रूप में होगी। )घ (पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िार्ेगी। )ङ (नुसार जवजनर्जमत दकए िाएंगेपाररजस्ट्थजतकी पर्ाटन संबंधी दरर्ाकलाप जनम् ना ,अथाात्:-

(i) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नई पर्ाटन दरर्ाकलापों र्ा जवद्यमान पर्ाटन दरर्ाकलापों का जवस्ट्तार कें द्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों और पाररजस्ट्थजतकी पर्ाटन राष्ट्रीर् बाघ संरक्षण प्राजधकरण द्वारा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी जिक्षा और पाररजस्ट्थजतकी जवकास पर बल ितेे हुए िारी मागाििाक जसद्धांतों के अनुसार होगा।

(ii) िब तक आंचजलक महार्ोिना तैर्ार और अनुमोदित नहीं हो िाती, तब तक पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दरर्ाकपाओं का जवस्ट्तार वास्ट्तजवक स्ट्थल जवजनर्िाष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा।

(4) नसैर्गाक जवरासत. – पाररजस्ट्थजतकी संवेिी िोन में बहुमूल्र् नैसर्गाक जवरासत के सभी स्ट्थलों िैसे दक िीन कोि आरजक्षत के्षत्र, िलै संरचना, िल प्रपात, झरन,े िरे, उपवन, गफुाए,ं स्ट्थल, वनपथ, रोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा तथा संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(6) ध् वजन प्रिषूण.- पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिषूण की जनवारण और जनर्ंत्रण का अनुपालन ध्वजन प्रिषूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा।

(7) वार् ुप्रिषूण. - पाररजस्ट्थजतकी संवेिी िोन में, वार् ुप्रिषूण का जनवारण और जनर्ंत्रण, वार् ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा।

(8) अपजिष्टों का जनवाहन. - पाररजस्ट्थजतकी संवेिी िोन में उपचाररत अपजिष्ट का जनवाहन िल (प्रिषूण की रोकथाम और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) के उपबंधों के अनसुार अनुपालन दकर्ा िाएगा।

(9) ठोस अपजिष्ट. - ठोस अपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट जनपटान और प्रबंधन ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा और अकाबाजनक सामग्री का जनपटान पाररजस्ट्थजतकी संवेिी िोन के बाहर जचजन्हत स्ट्थल पर पर्ाावरणीर् स्ट्वीकार्ा रीजत से दकर्ा िा सकेगा । (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर मान्र् प्रौद्योजगदकर्ों का उपर्ोग करके जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।

(10) िवै जचदकत्सा अपजिष्ट. - िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनजु्ञात दकर्ा िा सकेगा। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7

(11) प्लाजस्ट्टक अपजिष्ट का प्रबधंन. - पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(12) सजंनमााण और जवध्वसं अपजिष्ट का प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(14) र्ानीर् गजतजवजधर्ा-ंर्ातार्ात.- र्ातार्ात र्ानीर् गजतजवजधर्ों को पर्ाावास-अनुकूल रीजत से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेष उपबंध िाजमल दकए िाएगंे। आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होन ेतक, मानीटरी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर्-र्ातार्ात के अनुपालन को मानीटरी करेगी।

(15) र्ानीर् िजनत प्रिषूण. – र्ानीर् प्रिषूण के जनवारण और जनर्ंत्रण लाग ूजवजधर्ों के अनसुार दकर्ा िाएगा और स्ट्वच्छ ईंधन िैसे संपीजड़त प्राकृजतक गसै आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे।

(16) औद्योजगक ईकाइर्ा.ं - (क) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पिात् पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिषूणकारी उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्द्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 द्वारा िारी मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गरै-प्रिषूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गरै प्रिषूणकारी उद्योगों को बढ़ावा दिर्ा िाएगा।

(17) पहाड़ी ढलानों का सरंक्षण. - पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना में पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी संजनमााण की अनुज्ञा नहीं होगी;

(ख) कटाव के एक उच् च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों में र्ा ढलानों पर दकसी भी संजनमााण की अनजु्ञा नहीं होगी ।

4. पाररजस्ट्थजतकी सवंिेी िोन के भीतर प्रजतजसद्ध र्ा जवजनर्जमत दकए िान ेवाल ेदरर्ाकलाप.- पाररजस्ट्थजतकी संवेिी ज़ोन में सभी दरर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों, उसके अधीन बनाए गए जनर्मों और कें द्रीर् सरकार की अन्र् अजधसूचनाओं, जवजधर्ों और अजधजनर्मों, तत्कालीन पर्ाावरण और वन मंत्रालर् में पर्ाावरण, वन और वन्र्िीव से संबंजधत अजधसूचना, संखर्ांक 1533(अ), तारीख 14 जसतंबर, 2006 और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में तत्समर् प्रवृत्त जवजधर्ों द्वारा िाजसत होंग,े अथाात:् - सारणी रम स.ं

1. वाजणजज्र्क खनन, वाजणजज्र्क उत्खनन, पत्थर उत्खनन, रेत खनन और अपघषाण इकाइर्ां । (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर घरों के संजनमााण र्ा मरम्मत के जलए जमट्टी की खुिाई सजहत वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं को पूरा करने के जसवार् सभी नए और जवद्यमान (लघु और प्रमुख खजनि), पत्थर उत्खनन और उनके तोड़ने की इकाइर्ों को तत्काल प्रभाव से प्रजतजसद्ध दकर्ा िाता ह।ै 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) खनन प्रचालन माननीर् उच्चतम न्र्ार्ालर् की ररट र्ाजचका (जस.) सं.

1995 का 202 में टी. एन. गौडावमान जथरुमूलपाि बनाम भारत संघ और ररट र्ाजचका (जस.) सं. 2012 का 435 में गोवा फाउंडेिन बनाम भर संघ और आई.ए. सं. 2003 का 1000 में तारीख 03.06.2022 के जनमााण और तत्पश्र्ात् आई.ए. सं. 2022 का 131377 में तारीख 26.04.2023 और

28.04.2023 के जनणार् के मामले में आिेिों के अनुसार दकर्ा िाएगा।

2. प्रिषूण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन्न करने वाले उद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रिषूणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगीः परन्तु र्ह दक केन्द्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रिषूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रिषूणकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा।

3. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई र्ा जवद्यमान आरा जमलों का जवस्ट्तार अनजु्ञात नहीं होगा।

4. उद्योगों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नए र्ा जवद्यमान उद्योगों का जवस्ट्तार अनजु्ञात नहीं होगा।

5. िलावन लकड़ी का वाजणजज्र्क उपर्ोग। प्रजतजषद्ध।

6. नई प्रमुख िल जवद्युत पररर्ोिनाओं, ताप जवद्युत संर्ंत्रों, परमाण ु ऊिाा संर्ंत्रों और नसंचाई पररर्ोिनाओं की स्ट्थापना । प्रजतजषद्ध।

7. प्राकृजतक िल जनकार्ों र्ा भूजम क्षेत्र में जचदकत्सा अपजिष्ट सजहत अपजिष्टों और ठोस अपजिष्टों का जनवाहन। प्रजतजषद्ध।

8. कृजष और बागवानी से भूजम उपर्ोग जवन्र्ास में पररवतान । पाररजस्ट्थजतकी संवेिी िोन में वाजणजज्र्क प्रर्ोिनों िैसे ररसॉट्सा, उद्योगों की स्ट्थापना, आवासीर् जवन्र्ास के जलए प्रजतजषद्ध ह।ै

9. वाजणजज्र्क खजनि िल संर्ंत्रों, वाजतत पेर् बॉटनलंग संर्ंत्रों आदि के जलए भूिल संचर्न सजहत प्राकृजतक िल संसाधनों का वाजणजज्र्क उपर्ोग। प्रजतजषद्ध।

10. पर्ाटकों, वाजणजज्र्क होटलों और ररसॉट्सा द्वारा पोजलथीन बैगों का उपर्ोग। प्रजतजषद्ध।

11. पर्ाटन से संबंजधत अन्र् दरर्ाकलापों िैसे वार्ुर्ान, गमा वार्ु गुब्बारे, हजेलकॉप्टर, िोन, माइरोलाइट्स आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उड़ने के दरर्ाकलाप करना। प्रजतजषद्ध, तथाजप, वन जवभाग गैर- वाजणजज्र्क प्रर्ोिन के जलए वृत्तजचत्र बनाने के जलए वन, पर्ाावरण और वन्र्िीव संरक्षण पर िागरूकता पैिा करने के जलए िोन का उपर्ोग कर सकेगा।

12. संकेत बोडा और होर्डंग प्रजतजषद्ध, तथाजप, पाररजस्ट्थजतकी संवेिी िोन के ग्राम की सीमा के भीतर अनजु्ञा ह ै और वन जवभाग और उपर्ोिा अजभकरणों िैसे लोक जनमााण [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 जवभाग, कनााटक सड़क जवकास जनगम जलजमटेड, कनााटक राज्र् रािमागा सुधार पररर्ोिना, भारतीर् राष्ट्रीर् रािमागा प्राजधकरण, आदि को अभर्ारण्र् और पाररजस्ट्थजतकी संवेिी िोन से गुिरने वाली सावािजनक सड़कों पर गजत सीमा का पालन करने के जलए साइन बोडा िैसे, वन्र्िीवों के बारे में और वन्र्िीवों के जहत में िागरूकता पैिा करने के जलए अनुज्ञ्र्ा िी गई है।

13. कृजष-पर्ाटन, होम स्ट्टे, वाजणजज्र्क होटल और ररसॉट्सा के जलए फामा स्ट्टे की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नए र्ा जवद्यमान स्ट्थापना के जवस्ट्तार अनजु्ञा नहीं होगी

14. दकसी पररसंकटमर् पिाथा का प्रर्ोग र्ा उत्पािन र्ा प्रस्ट्संकरण । प्रजतजषद्ध।

15. फमों, कंपजनर्ों, कॉरपोरेट्स द्वारा बडे़ पैमाने पर वाजणजज्र्क पिुधन और पोल्री फामों इत्र्ादि की स्ट्थापना। प्रजतजषद्ध, तथाजप, स्ट्थानीर् दकसानों द्वारा छोटे पैमाने पर पहल की अनुज्ञा ह।ै

16. ईंट भट्टों की स्ट्थापना। सभी नई और जवद्यमान ईंट भट्टा इकाइर्ां प्रजतजषद्ध हैं।

17. ठोस अपजिष्ट जनपटान स्ट्थल और ठोस तथा िैव जचदकत्सा अपजिष्ट के जलए सामान्र् भस्ट्मीकरण सुजवधा की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी नए ठोस अपजिष्ट जनपटान स्ट्थल और अपजिष्ट उपचार र्ा ठोस अपजिष्ट प्रसंस्ट्करण सुजवधा की अनुज्ञा नहीं िी िाएगी, और औद्योजगक प्रदरर्ा और स्ट्वास्ट्थ्र् स्ट्थापनाओं, अस्ट्पतालों आदि से उत्पन्न दकसी भी प्रकार के ठोस अपजिष्ट के उपचार के जलए सामान्र् र्ा व्यजिगत भस्ट्मीकरण सुजवधा की स्ट्थापना की अनुज्ञा नहीं िी िाएगी।

18. रेलवे, रोपवे, केबल कार प्रजतजषद्ध।

19. 11दकलोवॉट से अजधक जवद्युत केबलों, पारेषण लाइनों का जनमााण। प्रजतजषद्ध। ख.जवजनर्जमत दरर्ाकलाप

20. वाजणजज्र्क होटलों और ररसॉट्सा की स्ट्थापना। पाररजस्ट्थजतकी पर्ाटन दरर्ाकलापों के जलए लघु अस्ट्थार्ी संरचनाओं के जनमााण के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटो को स्ट्थापना अनुज्ञात नहीं दकर्ा िाएगा:

परंतु, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी अजधक जनकट हो, सभी नए पर्ाटन दरर्ाकलाप र्ा जवद्यमान दरर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागाििाक जसद्धांतों के अनुरूप होगा ।

21. संजनमााण दरर्ाकलाप। (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, िो भी जनकट हो, दकसी भी प्रकार के नए वाजणजज्र्क संजनमााण की अनुज्ञा नहीं िी िाएगी:

परंतु, स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने के जलए भवन उपजवजधर्ों के अनुसार पैराग्राफ 3 के उप-पैराग्राफ (1) में सूचीबद्ध दरर्ाकलापों सजहत स्ट्थानीर् लोगों को उनके उपर्ोग के जलए अपनी भूजम पर संजनमााण करने की अनुज्ञा िी िाएगी:

परंतु, गैर प्रिषूणकारी लघु उद्योगों से संबंजधत संजनमााण दरर्ाकलाप लागू जनर्मों और जवजनर्मों र्दि कोई हो, के अनुसार सक्षम प्राजधकारी की पूवा अनजु्ञा से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंगे। 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(ii) एक दकलो मीटर के परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंग।े

22. वृक्षों की कटाई । (क) सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िाएगी। (ख) वृक्षों की कटाई संबंजधत कें द्रीर् र्ा राज्र् के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगें।

23. भूिल संचर्न सजहत िल संसाधनों का वाजणजज्र्क उपर्ोग। (क) सतही िल और भूिल के जनकासी की अनुज्ञा केवल स्ट्थानीर् लोगों को उनके वास्ट्तजवक कृजष उपर्ोग और भूजम के अजधभोगी को घरेलू उपभोग के जलए िी िाएगी;

(ख) औद्योजगक र्ा वाजणजज्र्क उपर्ोग के जलए सतही िल और भूिल जनकासी की अनुज्ञा नहीं िी िाएगी। (ग) सतही िल र्ा भूिल के जबरर् की अनुज्ञा नहीं िी िाएगी;

(घ) कृजष सजहत दकसी भी स्रोत से िल के संिषूण र्ा प्रिषूण को रोकने के जलए किम उठाए िाएंगे।

24. जवद्युत केबलों, पारेषण लाइनों का जनमााण। लागू जवजधर्ों के अनुसार जवजनर्जमत होगें। परंतु भजवष्र् में 11 दकलोवाट तक घरेलू प्रर्ोिनों के जलए जवद्युत केबल र्ा पारेषण लाइनें जबछाई िाएं, केबनलंग अजनवार्ा रूप से भूजमगत की िानी चाजहए और उपर्ोिा अजभकरणों द्वारा इंजडकेिन टाइल्स/केबल सुरक्षा कवर अजनवार्ा रूप से लगाए िाने चाजहए और िंगली िानवरों को करंट लगने से बचाने के जलए जवद्यमान जवद्युत लाइनों के िो टावरों के बीच का "झुकाव" नबंि ुिमीन से सुरजक्षत िरूी पर होना चाजहए।

25. संचार टावर और ऑजप्टकल फाइबर केबल लाइनें। लागू जवजधर्ों के अधीन अनुसार जवजनर्जमत होगें।

26. जवद्युत बाड़ लगाना, वाजणजज्र्क होटलों र्ा ररसॉट्सा र्ा जनिी होमस्ट्टे, जनिी फामों और फमों, कॉपोरेट घरानों, कंपजनर्ों द्वारा बडे़ पैमाने पर वाजणजज्र्क कृजष और बागवानी उद्यमों के जलए पररसर। लागू जवजधर्ों के अधीन अनुसार जवजनर्जमत होगें।

27. जवद्यमान सड़कों को चौड़ा करना, उन्हें सुिढृ बनाना। जवद्यमान सड़कों को चौड़ा करने की अनुज्ञा नहीं िी िाएगी, और मरम्मत की गई सड़कों की सतह की पररष्करण की जस्ट्थजत मूल सड़कों के समान ही रहगेी;

अथाात्, जवद्यमान सड़कों का कोई चौड़ीकरण नहीं दकर्ा िाना चाजहए, िबदक जबना तारकोल वाली सड़कें मरम्मत के पिात् भी जबना तारकोल वाली रहेंगी और केवल मूल रूप से तारकोल वाली सड़कों की मरम्मत और तारकोल दकर्ा िाएगा और सड़कों को उनके वतामान स्ट्वरूप और वतामान चौड़ाई में सवोत्तम रीजत से बनाए जिससे उसकी मरम्मत की िा सके, और र्दि र्ह एक जवद्यमान तारकोल वाली सड़क है, तो इसे उसी रूप में बनाए रखा िाएगा, और तारकोल वाली सतह को चौड़ा नहीं दकर्ा िाएगा र्ा सड़क को चौड़ा नहीं दकर्ा िाएगा, जवद्यमान सड़कों का सुिढृ़ीकरण उजचत पर्ाावरणीर् समाघात जनधाारण के साथ अजनवार्ा रूप से िाजमल दकर्ा िाएगा। राज्र् वन जवभाग और पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित मागाििान िस्ट्तावेज़ "वन्र्िीवों पर रैजखक [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 अवसंरचना के प्रभावों को कम करने के जलए पर्ाावरण -अनुकूल उपार् "के अनुसार िमन उपार्।

28. पहाड़ी ढलानों और निी तटों का संरक्षण। लागू जवजधर्ों के अनुसार जवजनर्जमत होगें।

29. राजत्र में र्ानीर् र्ातार्ात का सचंलन । वाजणजज्र्क प्रर्ोिन के जलए लागू जवजधर्ों के अधीन जवजनर्जमत और भीमगढ़ वन्र्िीव अभर्ारण्र् और पाररजस्ट्थजतकी संवेिी िोन से गुिरने वाले राज्र् रािमागा 30 पर िाम 6 बिे से सुबह 6 बिे के बीच जनबंधन िारी रहगेा।

30. कृजष प्रणाजलर्ों में आमूल पररवतान । लागू जवजधर्ों के अनुसार जवजनर्जमत होगें।

31. मछली पकड़ना। लागू जवजधर्ों के अनुसार जवजनर्जमत होगें। ग.सवंर्धात दरर्ाकलाप

32. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजष और बागवानी प्रथाओं के साथ िगु्धिाला, पिुपालन, िल कृजष और मत् स्ट्र् पालन । स्ट्थानीर् लोगों के उपर्ोग के जलए लागू जवजधर्ों के अधीन अनुज्ञात ह।ै तथाजप, इनमें से कुछ दरर्ाकलापों के अत्र्जधक जवस्ट्तार को आंचजलक महार्ोिना के अनुसार जवजनर्जमत दकर्ा िाना चाजहए।

33. आवास, कृजष और अन्र् स्ट्व-जनवााह प्रर्ोिनों के जलए जवद्युत केबलों का जनमााण। भूजमगत केबनलंग को बढ़ावा दिर्ा िाएगा।

34. वषाा िल संचर् । सदरर् रूप से बढ़ावा दिर्ा िाएगा ।

35. िैजवक खेती। सदरर् रूप से बढ़ावा दिर्ा िाएगा ।

36. सभी गजतजवजधर्ों के जलए हररत प्रौद्योजगकी का अंगीकरण । सदरर् रूप से बढ़ावा दिर्ा िाएगा ।

37. नवीकरणीर् ऊिाा ईंधन का प्रर्ोग । िैजवक गैस, सौर प्रकाि इत्र्ादि को बढ़ावा दिर्ा िाएगा।

38. कृजष वाजनकी । सदरर् रूप से बढ़ावा दिर्ा िाएगा ।

39. कौिल जवकास । सदरर् रूप से बढ़ावा दिर्ा िाएगा ।

40. पर्ाावरण के प्रजत िागरुकता। सदरर् रूप से बढ़ावा दिर्ा िाएगा ।

5. कें द्रीर् सरकार एक मानीटरी सजमजत का गठन करती ह ैिो जनम्नजलजखत से जमलकर बनगेी अथाात:्-

(i) प्रािेजिक आर्ुक् त, बेलागाव अध्र्क्ष, पिेन;

(ii) उपार्ुक् त र्ा उसका प्रजतजनजध, बेलागावी जिला सिस्ट्र्, पिेन;

(iii) पुजलस अधीक्षक र्ा उनके प्रजतजनजध - बेलगावी जिला सिस्ट्र्, पिेन;

(iv) पर्ाावरण जवभाग, कनााटक सरकार का प्रजतजनजध सिस्ट्र्, पिेन;

(v) प्रिषूण जनर्ंत्रण बोडा, कनााटक का प्रजतजनजध सिस्ट्र्, पिेन;

(vi) ऊिाा जवभाग, कनााटक का प्रजतजनजध सिस्ट्र्, पिेन;

(vii) पर्ाटन जवभाग, कनााटक का प्रजतजनजध सिस्ट्र्, पिेन;

(xiv) कनााटक राज्र् के खर्ाजतप्राप्त संस्ट्था र्ा जवश्वजवद्यालर् से पाररजस्ट्थजतकी में एक जविेषज्ञ को कनााटक राज्र् सरकार द्वारा प्रत्र्ेक 3 वषा के जलए समर्-समर् पर नामजनर्िाष्ट दकर्ा िाएगा। सिस्ट्र्;

(xv) प्राकृजतक संरक्षण (जवरासत संरक्षण सजहत) के क्षेत्र में कार्ा करने वाल ेगैर-सरकारी संगठनों के प्रजतजनजध, जिन्हें कनााटक राज्र् सरकार द्वारा प्रत्र्ेक 3 वषा के जलए समर्-समर् पर नामजनर्िाष्ट दकर्ा िाएगा। सिस्ट्र्;

(xvi) उप वन संरक्षक, प्रािेजिक प्रभाग, बेलगावी सिस्ट्र्–सजचव, पिेन;

6. मानीटरी सजमजत के कार्ा:- (1) उन दरर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ांक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत ह,ै और िो पररजस्ट्थतकी संवेिी िोन में आए हैं, जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजनर्िाष्ट प्रजतजषद्ध दरर्ाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् र्ा र्थाजस्ट्थजत, राज्र् पर्ाावरण समाघात जनधाारण प्राजधकारी को जनर्िाष्ट दकर्ा िाएगा।

(2) उन दरर्ाकलापों की, िो उप परैा (1) में जनर्िाष्ट अजधसूचना की अनुसूची में सजम्मजलत नहीं ह ै और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवजनर्िाष्ट प्रजतजषद्ध दरर्ाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे सम्बद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा।

(3) मानीटरी सजमजत के सिस्ट्र् सजचव र्ा कलेक्टर र्ा उप वन संरक्षक इस अजधसूचना के उपबंधों का उल्लघंन करन े वाले दकसी भी व्यजि के जवरुद्ध पर्ाावरण अजधजनर्म की धारा 19 के अधीन जिकार्त फाइल करने में सक्षम होंगे।

(4) मानीटरी सजमजत मामला- िर -मामला के आधार पर अपेक्षाओं के आधार पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेषज्ञों, औद्योजगक संगमों र्ा पणधाररर्ों के प्रजतजनजधर्ों को अपन े जवचार जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी।

(5) मानीटरी सजमजत प्रत्र्ेक वषा 31 माचा तक के अपने दरर्ाकलापों की वार्षाक कारावाई ररपोटा उस वषा 30 िून तक राज्र् में मखुर् वन्र्िीव वाडान को उपाबधं-ि में जवजनर्िाष्ट जनििान पत्र के अनुसार प्रस्ट्ततु करेगी।

(6) केन्द्रीर् सरकार का पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् मानीटरी सजमजत को उसके कार्ों के प्रभावी जनवाहन के जलए ऐसे जनििे िे सकेगा िो वह उजचत समझे।

8. कोई अन् र् महत् वपूणा मामला । 32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, 4th December, 2024 S.O. 5226(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide number S.O. 3565(E), dated the 9th August, 2023, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 10th August, 2023;

AND WHEREAS, objections and suggestions received from persons and stakeholders in respect of the said draft notification have been considered by the Central Government;

AND WHEREAS, Bhimgad Wildlife Sanctuary is spread in the catchment area of Mahadayi River in Khanapur taluk of Belagavi district in Karnataka and it shares boundary with Dandeli Wildlife Sanctuary in Uttar Kannada district of Karnataka and Mahadayi Wildlife Sanctuary in Goa and the total area of the Sanctuary is

19042.58 Hectare and the Sanctuary has been carved out of reserve forest areas with high floral and faunal diversity;

AND WHEREAS, Western Ghats due to their unique location play a vital role for conservation of biodiversity in the Indian peninsula and the ecological abundance supported by them, their rich biodiversity and sensitive geomorphology add further uniqueness and Bhimgad region has extensive biodiversity and provides corridor for tiger and other wild animals with adjacent protected areas and Barapede cave of Bhimgad is the only known roosting site for Wroughton’s Free Tailed bats in India and Bhimgad region is also one of rare habitats in the country for Theobalds’s tomb bat at Krishnapur caves;

AND WHEREAS, the area is in the core zone of Western Ghats comprising of semi evergreen and evergreen dense forests with steep slopes and the region is having rich floral and faunal diversity and it is habitat for Critically endangered and endemic Species Like Wroughton’s free tailed bats (Otomops wroughtoni) and Theobald’s tomb bats (Taphozous theobaldi) and Barapede caves are known to be the only roosting and breeding place for Wroughton’s free tailed bats in India and this region with rich biodiversity is located in the east of Mahadayi Wildlife Sanctuary in Goa and in the north of Dandeli Wildlife Sanctuary in Karnataka and this entire stretch acts as natural corridor for tigers and other wildlife between Dandeli Wildlife Sanctuary, Kali Tiger Reserve, Bhagwan Mahaveer and Mahadayi Wildlife Sanctuaries and this area is the place of origin and Catchment basin for many important rivers like Mahadayi, Bailnadi, etc. apart from number of streams and the area encompasses several geo-morphological lime stone formations with lots of caves, which support wide variety of fauna and flora endemic to this location and apart from above, the Sanctuary covers historical Bhimgad fort ruins, which needs to be protected;

AND WHEREAS, Dominant tree species in Evergreen forests of Bhimgad Wildlife Sanctuary are Anjan (Memecylon edule), Hebbalasu (Artocarpus hirsutus), Wate (Artocarpus lakoocha), Rampatri (Myristica malabaricum), Dalchini (Cinnamomum sps), Nandi (Lagerstroemia lanceolata), Dhup (Vateria indica), Ashok (Saracaindica), Fishtail palm (Caryotaurens), Gowada (Mappia foetida), Harada (Terminalia chebula), Kaval (Careya arborea), Amla (Emblica officinalis), Tare (Terminalia bellirica), Honne (Pterocarpus marsupium), Kindal (Terminalia paniculata), Shisham (Dalbergia latifolia), Jack (Artocarpus spp), Murki (Buchanania lanzan), Dhup (Dipterocarpus indicus), etc. ;

AND WHEREAS, Bhimgad Wildlife Sanctuary is a rich reservoir of medicinal plants and one such area in semi evergreen forests of Amagoan has been identified for Medicinal Plants Conservation Area during 2010-11 and out of the recorded species, about 82 percent of the plants are found to be of medicinal value and around 47 percent of the recorded plant species are trees, followed by shrubs, 28 percent and herbs, 18 percent and the area is also home to several endemic plant species such as Ancistrocladus heyneanus, Diospyros paniculata, Euonymus indicus, Mastixia arborea, etc. and several among the recorded medicinal plants such as Aristolochia tagala, Diospyros montana, Emblica officinalis, Garcinia indica, Nothapodytes nimmonianaetc are with high medicinal and economic value;

AND WHEREAS, Bhimgad wildlife Sanctuary is a habitat for variety of mammals, reptiles, birds, butterflies and other insects. apart from the fact that Bhimgad is the only known place for roosting and breeding of Wroughton free tailed bats, the region has other important predator and prey animals presence of resident tigers and their good prey base in the sanctuary indicates it is a good habitat for the Tigers and the Sanctuary is home to variety of Fauna such as Sambar (Cervus unicolor), Indian Gaur (Bos gauras), Four Horned Antelope (Tetracerus quadricornis), Barking deer (Muntiacus muntjak), Wild boar (Sus scrofa), Indian crested porcupine (Hystix indica), Indian spotted chevrotain (Tragulus meminna), Red Slender Loris (Loris tardigradus), Chital (Axis axis), Leopard (Panthera pardus), Dhole or Indian Wild Dog (Cuon alpinus), Leopard Cat (Felis bengalensis) Sloth Bear (Melursus ursinus), Golden Jackal (Canis aureus), Python (Python molurus), King Cobra (Ophiophagus hannah), Russell’s viper (Daboia russelii), Common Krait (Bungarus caeruleus), Rat snake (Ptyas mucosa), Vine Snake (Ahaetulla nasuta), Common Indian Monitor Lizard (Varanus bengalensis), Indian Flying Lizard (Draco dussumieri), Malabar [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 33 Gaint squirrel (Ratufa indica), etc., Bhimgad region is also considered as one of the most ideal habitats for tigers and six to eight tigers are known to be resident and also moving from the Sanctuary to the surrounding forests of Karnataka and Goa State;

AND WHEREAS, the Bhimgad Wildlife Sanctuary has a very good population of avifauna includes Great Indian hornbills and variety of Drongos, Wagtails, Wood peckers, Kingfishers, Eagles, Egrets, Sunbirds, Owls, Doves, etc. Grey Jungle fowl, Jungle myna, Crow, Pheasants, Paradise flycatcher, etc. are also commonly seen in the region;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Bhimgad Bird Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW THEREFORE, in exercise of the powers conferred by sub-section(1) clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an Eco-senstive Zone around the boundary of Bhimgad Wildlife Sanctuary in the State of Karnataka (hereafter in this notification referred to as the Eco-sensitive Zone details of which are as under, namely: -

1. Extent and boundaries of the Eco-Sensitive Zone- (1) The Eco-sensitive Zone is spread over an area of 117.75 square kilometer with an extent varying from 0 kilometer (Inter State Boundary and Kali Tiger Reserve) to 3.23 kilometer encompassing 13 villages around the boundary of the Bhimgad Wildlife Sanctuary.

(2) The boundary description of the Eco-sensitive Zone is appended as Annexure-A and the maps of the Ecosensitive Zone with key locations on its boundary is appended as Annexure-B.

(3) The Global Positioning System co-ordinates of key locations of protected area and Eco-sensitive Zone boundary are appended as Annexure-C.

(4) Details of villages that falls within the Eco-sensitive Zone are appended as Annexure–D and the details of reserved forest area falling within the Eco-sensitive Zone boundary is appended as Annexure-E. and revenue area details within the Eco-sensitive Zone boundary are given at Annexure-F and reserved forest land with survey number that falls within the ambit of Eco-sensitive Zone is appended as Annexure-G.

(5) All activities in the forest block areas shall be governed by the provisions of the Indian Forest Act, 1927 (16 of 1927), the Forest (Conservation) Act, 1980 (69 of 1980) and all the activities in the protected area (Sanctuary) shall be governed by the provisions of the Wildlife (Protection) Act, 1972 (53 of 1972), State Acts, Rules and Guidelines.

(6) A total area of 11413.25 hectare. of reserve forest and 525.04 hectare. of revenue area comes within the limits of Eco-sensitive Zone.

2. Zonal Master Plan for Eco-sensitive Zone. - (1) The State Government shall, for the purposes of the Ecosensitive Zone, prepare and notify a Zonal Master Plan within two years from the date of publication of this notification in the Official Gazette, in consultation with local people and in conformity to the provisions of this notification.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in accordance with the provisions of this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan namely: -

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipality;

(x) Panchayati Raj;

(xi) Public Works Department, Karnataka Road Development Corporation Limited, National Highway Authority of India;

(xii) Hubballi Electricity Supply Company Limited;

(xiii) Police Department (Home);

(xiv) Karnataka State Pollution Control Board.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendlier.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks and it’s like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local community’s livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

(10) Until the preparation of the Zonal Master Plan for the Eco-sensitive Zone, all new construction and other developmental activities shall be referred to the Monitoring Committee.

3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely: -

(1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as,-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies. - The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or eco-tourism. - (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone;

(b) the Tourism Master Plan shall be prepared by the Department of Tourism in consultation with the Departments of Environment and Forests of the State Government;

(c) the Tourism Master Plan shall form a component of the Zonal Master Plan;

(d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone;

(e) the activities of eco-tourism shall be regulated as under, namely: -

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the ecotourism guidelines issued by the National Tiger Conservation Authority with emphasis on ecotourism, eco-education and eco-development;

(ii) until the Zonal Master Plan is prepared and approved, development for tourism and expansion of existing tourism activities shall be permitted by the regulatory authorities concerned based on the actual site-specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural heritage. - All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites. - Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000.

(7) Air pollution. - Prevention and control of air pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981).

(8) Discharge of effluents. - The discharge of treated effluent in the Eco-Sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974).

(9) Solid wastes. - Disposal and Management of solid wastes shall be as under-

(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.

(b) Safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive Zone.

(10) Bio-medical waste. – Bio-medical waste management shall be as under-

(a) Bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016,

(b) Safe and Environmentally Sound Management of bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic waste management. - The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016.

(12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016.

(13) E-waste. - The E- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Central Government in the Ministry of Environment, Forest and Climate Change.

(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be complied with in accordance with applicable laws and efforts shall be made for use of cleaner fuel such as Compressed Natural Gas, etc.

(16) Industrial units. – (a) No new polluting industries shall be allowed to be set up within the Eco-sensitive Zone on or after the publication of this notification in the Official Gazette.

(b) Only non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of industries in the guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes. - The protection of hill slopes shall be as under-

(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.

(b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act, the rules made under there and other notifications, laws and acts of the Central Government, notification pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14 th September, 2006 and laws for the time being in force in the manner specified in the Table below, namely:- TABLE Sl. 26.04.2023 and 28.04.2023.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).

New industries and expansion of existing polluting industries in the Eco-Sensitive Zone shall not be permitted:

Provided that, non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the nonpolluting cottage industries shall be promoted.

3. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

4. Establishment of Industries No new or expansion of existing industries shall be permitted within the Eco-sensitive Zone.

5. Commercial use of firewood. Prohibited.

6. Establishment of new major Hydroelectric projects, Thermal Power Plants, Nuclear Power Plants and irrigation projects.

Prohibited.

7. Discharge of effluents and solid waste including medical waste in natural water bodies or terrestrial area.

Prohibited.

8. Change in Land use pattern from Agriculture and Horticulture.

Prohibited in the Eco-sensitive Zone for commercial purposes such as resorts, establishment of industries, residential layouts.

9. Commercial use of natural water resources including ground water harvesting for commercial mineral water plants, aerated drinks bottling plants, etc.

Prohibited.

10. Use of Polythene bags by tourists, commercial hotels and resorts.

Prohibited.

11. Undertaking activities related to tourism like over-flying the Eco-sensitive Zone area by any Aircraft, Hot Air Balloons, Helicopter, Gliders, Parasailing, Drones, Microlites, etc.

Prohibited. however, Forest Department may use Drones for creating awareness on forest, environment and wildlife conservation for making documentaries for noncommercial purpose.

12. Sign Boards and hoardings. Prohibited, however, permitted within village limits of Eco-sensitive Zone and also permitted for Forest Department and user agencies such as Public Works Department, Karnataka Road Development Corporation Limited, Karnataka State Highways Improvement Project, National Highways Authority of India etc, to put in order to create awareness on wildlife such as sign boards to follow speed limit, etc. on public roads passing through Sanctuary and Eco-sensitive Zone in the interest of wildlife.

13. Establishment of Farm Stays for Agro-Tourism, Home stays, Commercial Hotels and Resorts.

No new or expansion of existing establishment shall be permitted within the Eco-sensitive Zone.

14. Use or production or processing of any hazardous substances.

Prohibited.

15. Establishment of large-scale commercial livestock and poultry farms by firms, companies, corporates, etc.

Prohibited, however, initiatives on a small-scale by the local farmers are permitted.

16. Setting up of brick kilns. All new and existing brick kiln units are prohibited.

17. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.

No new solid waste disposal site and waste treatment or processing facility of solid waste shall be permitted within the Eco-sensitive Zone and installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishments, hospitals, etc. shall be prohibited.

18. Railways, Ropeways, Cable Cars. Prohibited.

19. Erection of electrical cables, transmission lines beyond 11 kilowatts.

Prohibited.

Regulated Activities

20. Commercial establishment of hotels and resorts.

New commercial hotels and resorts along with their expansion shall not be permitted within one kilometer of the boundary of the protected area or upto the extent of 38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Eco-sensitive Zone, whichever is nearer, except for small temporary structures only for eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Ecosensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

21. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Ecosensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

22. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.

23. Commercial use of water resources including ground water harvesting.

(a) The extraction of surface water and ground water shall be permitted only for local people for their bona fide agricultural use and domestic consumption of the occupier of the land.

(b) Extraction of surface water and ground water for industrial or commercial use shall not be permitted.

(c) no sale of surface water or ground water shall be permitted.

(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.

24. Erection of electrical cables, transmission lines. Regulated as per applicable laws:

Provided that any future laying of electric cables or transmission lines for domestic purposes up to 11Kilowatts, cabling has to be mandatorily done underground and indication tiles or cable protection covers shall be mandatorily put by the user agencies and the “sag” point between the two towers of existing electric lines should be at safe distance from the ground in order to avoid electrocution of wild animals.

25. Telecommunication towers and Optical fiber cable lines.

Regulated as per applicable laws.

26. Electric fencing, compound for commercial hotels or resorts or private homestays, private farms and large-scale commercial Agricultural Regulated as per applicable laws.

27. Widening and strengthening of existing roads. No widening of existing roads shall be permitted, and the status of finishing of the surface of the repaired road(s) shall remain the same as that of the original road(s); i.e., no widening of the existing road should be done while untarred roads shall remain untarred after repairs and only originally tarred roads shall be repaired and tarred and the roads could be maintained and repaired in the best manner possible in their current form and present width and if it is an existing tarred road, it shall be maintained as such, and no widening of the tarred surface or the widening of the road itself shall be done, strengthening of the existing roads shall be done with proper Environmental Impact Assessment with mandatorily involving the State Forest Department and the Ministry of Environment, Forest, and Climate Change and mitigation measures as per the guidance document “Eco-Friendly Measures to Mitigate Impacts of Linear Infrastructure on Wildlife", Published by Ministry of Environment, Forest and Climate Change.

28. Protection of hill slopes and river banks. Regulated as per the applicable laws.

29. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws and, restrictions on State Highway 30 passing through Bhimgad Wildlife Sanctuary and the Eco-sensitive Zone between 6pm to 6am shall continue.

30. Drastic Change of Agriculture systems. Regulated as per the applicable laws.

31. Fishing. Regulated as per the applicable laws.

Promoted Activities

32. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

Permitted under applicable laws for use of locals, however, excessive expansion of some of these activities should be regulated as per the Zonal Master Plan.

33. Erection of electrical cables for housing, agricultural and other self-subsistence purposes.

Promote underground cabling.

34. Rain water harvesting. Shall be actively promoted.

35. Organic farming. Shall be actively promoted.

36. Adoption of green technology for all activities. Shall be actively promoted.

37. Use of renewable energy sources. Bio gas, solar light etc. to be promoted.

38. Agro-Forestry. Shall be actively promoted.

39. Skill Development. Shall be actively promoted.

40. Environment Awareness. Shall be actively promoted.

5. Monitoring Committee- The Central Government hereby constitute a Monitoring Committee consisting of the following namely: -

(i) Regional Commissioner, Belagavi Chairman, ex officio;

(ii) Deputy Commissioner or his representative, Belagavi District Member, ex officio;

(iii) Superintendent of Police or his representative - Belagavi District Member, ex officio;

(iv) Representative of the Department of Environment, Government of Karnataka Member, ex officio;

(v) Representative of Pollution Control Board, Karnataka Member, ex officio;

(vi) Representative of Energy Department, Karnataka Member, ex-officio;

(viii) Representative of Rural Development and Panchayat Raj Department, Karnataka Member, ex officio;

(ix) Representative of Public Work, Ports and Inland Water Transport Department, Karnataka Member, ex officio;

(x) Representative of Health Department, Karnataka Member, ex officio;

(xi) Representative of Urban Development Department, Karnataka Member, ex officio;

(xii) Representative of Animal Husbandry Department, Karnataka Member, ex officio;

(xiii) Representative of Minor Irrigation Department, Karnataka Member, ex officio;

(xiv) One expert in Ecology from reputed institution or university of the State of Karnataka to be nominated by the State Government from time to time every three years Member;

(xv) Representative of Non-governmental Organizations working in the field of natural conservation (including heritage conservation) to be nominated by the State Government from time to time every three years Member;

(xvi) Deputy Conservator of Forests, Territorial Division, Belagavi Member- Secretary, ex officio.

6. Functions of the Monitoring Committee.- (1) The Monitoring Committee shall, based on the actual site-specific conditions, scrutinize the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification.

(2) The activities that are not covered in the Schedule to the notification referred to in sub-paragraph (1) and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(3) The Member-Secretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.

(4) The Monitoring Committee may invite representatives or experts from the Departments concerned, representatives from industry associations or stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(5) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per proforma appended at Annexure H.

(6) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional measures. - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

KERKETTA, Scientist ‘G’ [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 41 ANNEXURE-A BOUNDARY DESCRIPTION OF THE ECO-SENSITIVE ZONE AROUND BHIMGAD WILDLIFE SANCTUARY North: The boundary of eco-sensitive zone starts at 15° 39' 55.972" N, 74° 14' 46.070" E near Parwad village and runs towards Gavase Village with GPS point 15° 39' 16.500" N, 74° 17' 22.207" E. It shares common boundary with Amagav Village with GPS points 15° 38' 44.070" N, 74° 18' 27.404" E. At Sy.

No. 8 it takes right turn and moves further towards Chapoli Village with GPS point 15° 38' 15.655" N, 74° 20' 37.043" E. Then the boundary of ESZ follows Kotni Nadi and takes turn at GPS point 15° 36'

30.832" N, 74° 18' 12.327" E and further continues at the boundary of Sy. No. 70 of Gavali Village.

The ESZ Boundary shares common boundary with Kapoli K. Chapoli and Kiravali villages with GPS point 15° 37' 55.620" N, 74° 22' 31.882" E. A smallportion of land belonging to Pastole Village falls within the ESZ Boundary with GPS point 15° 36' 52.459" N, 74° 22' 19.008" E.The ESZ Boundary runs along the boundary of Sy. No. 36 till Sy. 52 of Kabanali Village with the GPS point 15° 37' 8.297" N, 74° 23' 48.479" E.

East: The ESZ boundary continues from Kabanali and enters Kongale Village with GPS point 15° 35'

39.440" N, 74° 23' 21.121" E and continues with the boundary of Sy. No. 43, Sy. No. 44 and Sy. No. 25 and enters Nerse Village at Sy. No. 125 and runs towards Shiroli Village at Sy. No. 97, 96 with GPS point 15° 34' 15.666" N, 74° 25' 11.594" E. South: From the above point the boundary enters Dongragaon Village through the GPS point 15° 34' 11.637" N, 74° 25' 49.089" E and crosses Haltara Nala and further moves towards Varakarpati Village with GPS point 15° 29' 59.861" N, 74° 26' 14.173" E. Then the boundary runs along Hemmadagai Varakarpati Village and enters Devuli Village of UTTARA Kannada District at GPS point 15° 28'

36.783" N, 74° 23' 27.491" E and crosses Tarva Nadi and finally joins Dandeli Anshi Tiger Reserve at GPS point 15° 28' 26.319" N, 74° 22' 18.503" E.

West : From the above point the boundary runs through the common boundary of the Bhimgad Wildlife Sanctuary and the Dandeli Wildlife Sanctuary till it reaches the Interstate state boundary of the Goa and Karnataka states. Then runs all along the Interstate boundary till it reaches the starting point.
