PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 29 नवम् बर, 2024 का.आ. 5132(अ).—भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना संखर्ांक का. आ. 4952 (अ), तारीख 16 नवम्बर, 2023, द्वारा प्रारुप अजधसूचना भारत के रािपत्र, असाधारण में प्रकाजित की गई थी, जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होन ेकी संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उि प्रारूप अजधसूचना की रािपत्र की प्रजतर्ां िनता को तारीख तारीख 16 नवम्बर, 2023 को उपलब्ध करा िी गई थी;

और, पूवोि प्रारुप अजधसूचना की बाबत व्यजिर्ों और पणधाररर्ों से प्राप्त आक्षेपों और सुझावों पर कें द्रीर् सरकार द्वारा जवचार दकर्ा गर्ा था;

और, गोरुमारा राष्ट्रीर् उद्यान, पजिमी बंगाल के िलपाईगुडी जिल ेमें 79.45 वगा दकलोमीटर क्षेत्रफल में फैला ह,ै िो दक पजिमी बंगाल राज्र् सरकार द्वारा तारीख 01 िनवरी, 1998 की अजधसूचना के द्वारा अजधसूजचत दकर्ा गर्ा था और र्ह लगभग 55 जविाल भारतीर् एक सींग वाले गैंडों का वास ह,ै िो वैजिक अंजतम प्रिाजतर्ों की िनसंखर्ा में से एक ह;ै स.ं 4742] नई दिल्ली, िुक्रवार, नवम् बर 29, 2024/अग्रहार्ण 8, 1946 No. 4742] NEW DELHI, FRIDAY, NOVEMBER 29, 2024/AGRAHAYANA 8, 1946 सी.जी.-डी.एल.-अ.-05122024-259175 CG-DL-E-05122024-259175 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, र्ह राष्ट्रीर् उद्यान भारतीर् हाजथर्ों के आवागमन के जलए एक महत्वपूणा गजलर्ारे के रूप में कार्ा करता ह,ै र्ह लगभग 1000 गौर, कई अन्र् िाकाहारी िानवरों, कई लसे्ट्सर जबजल्लर्ों के साथ तेंिआु और पजक्षर्ों की लगभग 300 प्रिाजतर्ों और जततजलर्ों की लगभग उतनी ही संखर्ा का भी वास ह,ै और र्ह वन, निी पाररजस्ट्थजतकी-तंत्र और समीपवती चार् बगान और ग्रामों सजहत उनके जवजवध िाजतर्ों के साथ िलपाईगडुी जिला के वन भू-िशृ्र् में बहुत महत्त्वपणूा स्ट्थान रखता ह;ै और, गोरूमारा राष्ट्रीर् उद्यान, वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) की अनुसूची-1 के अधीन जवजनर्िाष्ट असंखर् प्रिाजतर्ों का पोषण करता ह ै जिसमें उसके साथ-साथ जविाल भारतीर् एक सींग वाला गैंडा (रजहनोसेरोस र्नूीकोर्नास), भारतीर् हाथी (एजलफस मैक्सीमूस), गौर (बोस गौरस), तेंिआु जबल्ली (पेन्थेरा प्रड्यूस), इंजडर्न राक पार्थन (पार्थन मलूर्रूस), मालार्न जविाल जगलहरी (रतुफा जबकोलोर), तेिआु (पररओनाइलरुूस बैंगालेंजसस), दफशिंग कैट (पररओनाइलुरूस जववेरीनुस), हील मैना (ग्राकुला रेलीजगओसा), भारतीर् मोर (पावो दक्रस्ट्टेटस), भारतीर् ग्र ेहानाजबल्ल (ओकर्केरोस जबरोस्ट्रीस), आदि भी आत ेहैं;

और, गोरूमारा राष्ट्रीर् उद्यान की समृद्ध िीव और िंत ुजवजवधता के प्रभावी संरक्षण और सुरक्षा के जलए, उद्यान की पररजध में नृिातीर् िबावों के जवस्ट्तार को जवजनर्जमत दकर्ा िाना होगा क्र्ोंदक इस नािुक पाररजस्ट्थजतकी तंत्र के एकिम आस-पास के के्षत्र पाररजस्ट्थजतकी की िजृष्ट से बहुत संवेिनिील ह ैिो इस संरजक्षत के्षत्र को बहुत प्रभाजवत करत ेह;ै और, इस उद्यान में वन्र्िीव पर मूर्ता और िलढाका की मुखर् निी प्रणाजलर्ों के साथ-साथ उनकी सहार्क नदिर्ों और नालों की गजतिील प्रकृजत का सीधा प्रभाव पडता ह;ै और इसजलए, गोरुमारा राष्ट्रीर् उद्यान के आसपास के क्षेत्रों का संरक्षण और सुरक्षा करना आवश्र्क है तादक वहां और पररिशृ्र् में वन्र्िीव वास स्ट्थान में सुधार और जवकास दकर्ा िा सके;

और, गोरूमारा राष्ट्रीर् उद्यान की सीमा के चारों ओर के क्षेत्र को, िो दक पैराग्राफ 1 में जवजनर्िाष्ट हैं, पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव-जवजवधता की िजृष्ट से पाररजस्ट्थजतकी संवेिी िोन के रूप में सुरजक्षत और संरजक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों की श्रेजणर्ों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजषद्ध करना आवश्र्क ह;ै अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इसमें इसके पिात ्पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) और उप-धारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, पजिमी बंगाल राज्र् के िलपाईगुडी जिले के गोरूमारा राष्ट्रीर् उद्यान की सीमा के चारों ओर 1.0 दकलोमीटर से 17.0 दकलोमीटर तक जवस्ट्ताररत क्षेत्र को पाररजस्ट्थजतकी संवेिी िोन (जिसे इस अजधसूचना के पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात:्-

1. पाररजस्ट्थजतकी सवंिेी िोन का जवस्ट्तार और सीमाएं.-(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार गोरूमारा राष्ट्रीर् उद्यान की सीमा से 1.0 दकलोमीटर से 17.0 दकलोमीटर तक जवस्ट्ताररत होगा और इस पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल लगभग 278 वगा दकलोमीटर ह।ै

(2) गोरूमारा राष्ट्रीर् उद्यान और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबधं–I के सारणी क और सारणी ख में संलग्न ह।ै

(3) पर्ाावरण-संवेिनिील के्षत्र का सीमांकन करन ेवाल ेगोरुमारा राष्ट्रीर् उद्यान के मानजचत्र में उपाबधं-IIक, उपाबधं-Illख, उपाबधं-IVग, उपाबधं-Vघ, उपाबधं-VIड., में संलग्न हैं,

(4) राष्ट्रीर् उद्यान और इसके पाररजस्ट्थजतकी संवेिी िोन के महत्वपूणा भू-जनििेांकों की सूची उपाबधं-III के सारणी क, सारणी ख, और सारणी ग, में संलग्न ह।ै [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3

(5) प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेिी िोन में आन ेवाल ेक्षेत्रों की सूची उपाबधं-IVक के रूप में संलग्न ह ैऔर पाररजस्ट्थजतकी संवेिी िोन के अतंगात आन ेवाले ग्रामों की सूची अक्षांि और िेिांतर के साथ-साथ उपाबधं-IVख में संलग्न ह।ै

2. पाररजस्ट्थजतकी सवंिेी िोन की आचंजलक महार्ोिना. – (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वषा की अवजध के भीतर, राज्र् सरकार में सक्षम प्राजधकारी के अनुमोिन के जलए स्ट्थानीर् व्यजिर्ों के परामिा से और इस अजधसूचना में दिए गए अनुबंधों का पालन करत ेहुए आंचजलक महार्ोिना तैर्ार और अजधसूजचत करेगी।

(2) पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना राज्र् सरकार द्वारा इस अजधसूचना में जवजनर्िाष्ट रीजत में और तत्समर् प्रवृत सुसंगत जवजधर्ों और कें द्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों के अनरुूप तैर्ार दकर्ा की िाएगी, र्दि कोई हो;

(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरण संबंधी सरोकारों को िाजमल करने के जलए राज्र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार की िाएगी, अथाात्: -

(i) पर्ाावरण;

(ii) वन और वन्र्िीव;

(iii) कृजष;

(iv) रािस्ट्व;

(v) िहरी जवकास;

(vi) पर्ाटन;

(vii) ग्रामीण जवकास;

(viii) जसचांई और बाढ़ जनर्ंत्रण;

(ix) नगरपाजलका;

(x) पंचार्ती राि; और

(xi) लोक जनमााण जवभाग।

(4) आंचजलक महार्ोिना, अनमुोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध तब तक नहीं अजधरोजपत दकर्ा िाएगा तथा िब तक की इस अजधसूचना में आचंजलक महार्ोिना में इस प्रकार जवजनर्िाष्ट न हो, सभी अवसंरचनाओं और दक्रर्ाकलापों में सुधार करके उन्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनाने की व्यवस्ट्था की िाएगी।

(5) आंचजलक महार्ोिना, अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल- संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं का उपबंध करेगी तथा पाररजस्ट्थजतकी एवं पर्ाावरण के ऐसे अन्र् पहलओुं का उपबंध करेगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै

(6) आंचजलक महार्ोिना, सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, कृजष क्षेत्रों, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्र् िल जनकार्ों की सीमा का जवद्यमान तथा प्रस्ट्ताजवत भू-उपर्ोग की जविेषताओं का ब्र्ौरा िेते हुए समर्थर्ाकारी मानजचत्र के साथ जनधाारण दकर्ा िाएगा।

(7) आंचजलक महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन में होन ेवाले जवकास का जवजनर्मन करेगी और पैरा 4 की सारणी में सूचीबद्ध प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा। इसमें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनिर् और संवधान दकर्ा िाएगा।

(8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(9) इस प्रकार तैर्ार और अजधसूजचत आंचजलक महार्ोिना, मनीटरी सजमजत के जलए एक जनिेि िस्ट्तावेि का काम करेगी तादक वह इस अजधसूचना के उपबंधों के अनुसार मनीटरी के अपने कताव्यों को काररत कर सके।

(10) आंचजलक महार्ोिना की तैर्ारी और इसके अनुमोिन के लंजबत रहन े के िौरान दकसी भी नए जवकासात्मक दक्रर्ाकलापों को उप-पैरा (1) और (2) के पैरा 6 में जवजनर्िाष्ट उपबंधों के अनुसार ही िाजसत दकर्ा िाएगा।

3. राज्र् सरकार द्वारा दकए िान ेवाल ेउपार्. - राज्र् सरकार, इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्: -

(1) भ-ूउपर्ोग. – (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए अजभज्ञात उद्यानों और खुल ेस्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक दक्रर्ाकलापों के जलए उपर्ोग नहीं दकर्ा िाएगा र्ा न ही उसका संपररवतान दकर्ा िाएगा:

परंतु दक पाररजस्ट्थजतकी संवेिी िोन के भीतर उपर्ुाि भाग (क) में जवजनर्िाष्ट प्रर्ोिन से जभन्न दकसी प्रर्ोिन के जलए कृजष और अन्र् भूजम का संपररवतान को मानीटरी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा केन्द्रीर् सरकार र्ा राज्र् सरकार के र्था लाग ूअन्र् जनर्मों और जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के द्वारा सक्षम प्राजधकारी के पूवा अनुमोिन से स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को परूा करने के जलए तथा जनम्नजलजखत दक्रर्ाकलापों िैसे दक, के जलए अनुमजत िी िा सकेगी:- i. जवद्यमान सडकों को चौडा करना तथा उन्हें सुिढृ़ करना और नई सडकों का सजन्नमााण करना;

ii. बुजनर्ािी ढांचों और नागररक सुजवधाओं का सजन्नमााण और नवीकरण;

iii. प्रिषूण उत्पन्न न करने वाल ेलघु उद्योग;

iv. कुटीर उद्योग सजहत ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन में सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं सजहत गृह वास; और v. पैरा-4 में दिए गए संवधान दक्रर्ाकलापः परंत ुर्ह और दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म तथा राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना और संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनपुालन दकए जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के उपर्ोग की अनमुजत नहीं होगी। परंत ु र्ह और दक पाररजस्ट् थजतकी संवेिी िोन के अतंगात आने वाली भूजम के अजभलेखों में हुई दकसी तु्ररट को, मानीटरी सजमजत के जवचार अजभप्राप्त करने के पिात्, राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार सुधारा िा सकेगा और उि तु्ररट को सुधारे िान ेकी सूचना कें द्रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी:

परंतु र्ह भी दक तु्ररट को सुधारने में, इस उप-पैरा के अधीन र्था उपबंजधत के जसवार्, दकसी भी ििा में भू- उपर्ोग का पररवतान िाजमल नहीं होगा। (ख) अनुप्रर्िु र्ा अनुत् पािक कृजष क्षेत्रों में वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों से पनु: वनीकरण दकए िाने के प्रर्ास दकए िाएगंे।

(2) प्राकृजतक िल जनकार्. - आंचजलक महार्ोिना में सभी प्राकृजतक िलमागों के आवाह क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना में उनके संरक्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और राज् र् सरकार द्वारा मागाििाक जसद्धांत इस रीजत से बनाए िाएंग ेदक इन क्षेत्रों में र्ा के आसपास जवकास दक्रर्ाकलापों को प्रजतजषद्ध दकर्ा िा सके और िो दक ऐसे क्षेत्रों के जलए हाजनकारक ह।ै [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन. – (क) पाररजस्ट्थजतकी संवेिी िोन में सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार होगा। (ख) पर्ाटन महार्ोिना, राज्र् के पर्ाावरण और वन जवभागों के परामिा से राज्र् के पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम् नानुसार जवजनर्जमत दकए िाएंग,े अथाात:्-

(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें से िो भी अजधक जनकट हो, दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण अनुज्ञात नहीं दकर्ा िाएगाः परंतु र्ह दक पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की िरूी से परे, पाररजस्ट्थजतकी संवेिी िोन की सीमा तक पूवा पररभाजषत और अभीजहत क्षेत्रों में पर्ाटन महार्ोिना के अनुसार, नए होटलों और ररिॉटा की स्ट्थापना अनुज्ञात होगी;

(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार द्वारा िारी मागाििाक जसद्धांत तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाल ेराष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी मागाििाक जसद्धांतों (समर्-समर् पर र्था सिंोजधत) के अनुसार होगा;

(iii) आंचजलक महार्ोिना का अनुमोिन होन े तक, पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनजु्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन में दकसी नए होटल, ररिॉटा र्ा वाजणजज्र्क स्ट्थापना का संजन्नमााण अनुज्ञात नहीं होगा।

(4) प्राकृजतक जवरासत. – पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पलू ररज़वा के्षत्र, िैल संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा और संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(6) ध् वजन प्रिषूण.- ध्वजन प्रिषूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिषूण का जनवारण और जनर्ंत्रण दकर्ा िाएंगा ।

(7) वार् ुप्रिषूण. - पाररजस्ट्थजतकी संवेिी िोन में, वार् ुप्रिषूण का जनवारण और जनर्ंत्रण, वार् ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा।

(8) बजहस्राव का जनस्ट्सरण. - पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, िल (प्रिषूण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और पर्ाावरण अजधजनर्म, और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार होगा।

(9) ठोस अपजिष्ट. - ठोस अपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट जनपटान और प्रबंधन, ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा, अकाबाजनक सामग्री का जनपटान पाररजस्ट्थजतकी संवेिी िोन के बाहर पहचाने गए स्ट्थल पर पर्ाावरणीर् स्ट्वीकृत रीजत से दकर्ा िा सकता ह।ै 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) स्ट्थानीर् प्राजधकारी ठोस कचरे को िैव-अवकषाणीर् और गरै-िैव-अवकषाणीर् घटकों में अलग करने की र्ोिना तैर्ार करेंग;े (ग) िैव-अवकषाणीर् सामग्री को अजधमानतः खाि र्ा वमीकल्चर के माध्र्म से पनुचादक्रत दकर्ा िाएगा । (घ) अकाबाजनक सामग्री को पाररजस्ट्थजतकी संवेिी िोन के बाहर अजभज्ञात दकए गए स्ट्थलों पर पर्ाावरण की िजृष्ट से स्ट्वीकार्ा रीजत में जनपटार्ा िा सकता ह ैऔर पाररजस्ट्थजतकी संवेिी िोन में ठोस कचरे को िलाने र्ा भष्म दकर्े िाने की अनुमजत नहीं िी िाएगी।

(10) िवै जचदकत्सा अपजिष्ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा;- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में अनुज्ञात पहचान की गई प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुज्ञात दकर्ा िार्ेगा।

(11) प्लाजस्ट्टक अपजिष्ट का प्रबधंन. - पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा।

(12) सजन्नमााण और जवध्वसं अपजिष्ट का प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में सजन्नमााण और जवध्वंस अपजिष्ट का प्रबंधन संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन, ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(14) सडक-र्ातार्ात.- सडक-र्ातार्ात को पर्ाावास-अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जवजनर्िाष्ट उपबंध िाजमल दकए िाएगं ेऔर आंचजलक महार्ोिना के तैर्ार होन ेऔर राज्र् सरकार के सक्षम प्राजधकारी से अनुमोदित होन ेतक, मानीटरी सजमजत सुसंगत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार सडक-र्ातार्ात के अनुपालन की मानीटरी करेगा।

(15) वाहन िजनत प्रिषूण. - वाहन िजनत प्रिषूण का जनवारण और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे ।

(16) औद्योजगक ईकाइर्ा.ं - (क) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रिषूणकारी उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्द्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, समर् समर् पर संिोधन के अनुसार िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रिषूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गरै प्रिषूणकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा।

(17) पहाडी ढलानों का सरंक्षण. - पहाडी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना में पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी संजनमााण की अनजु्ञा नहीं होगी;

(ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों में अत्र्जधक भू-क्षरण होता ह ै उनमें दकसी भी संजनमााण की अनुज्ञा नहीं होगी । [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7

4. पाररजस्ट्थजतकी सवंिेी िोन में प्रजतजषद्ध र्ा जवजनर्जमत दकए िान ेवाल े दक्रर्ाकलापों की सचूी- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीन बन ेजनर्मों, जिसके अंतगात पर्ाावरणीर् समाघात जनधाारण अजधसूचना (ईआईए), 2006 भी ह,ै और अन्र् लागू जवजधर्ााँ जिसके अंतगात सजहत वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) भी हैं, के द्वारा िाजसत होंगें और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में जवजनर्जमत होंगे, अथाात ्:- सारणी क्रम स.ं दक्रर्ाकलाप रटप्पणी

1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघषाण इकाइर्ां । (क) पाररजस्ट्थजतकी संवेिी िोन के अंतगात वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं जिसमें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत है, इसके जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघषाण इकाइर्ां तत्काल प्रभाव से प्रजतजषद्ध होंगी;

(ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन . गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्र्ार्ालर् के तारीख 4 अगस्ट्त, 2006 के आििे और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रलै ,2014 के आिेि के अनुपालन में होगा ।

2. प्रिषूण (िल, वार्,ु मिृा, ध्वजन, आदि) उत्पन्न करने वाले उद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रिषूणकारी उद्योगों का जवस्ट्तार करन े की अनुमजत नहीं होगी और जवद्यमान उद्योगों द्वारा प्रिषूण जनवारण प्रौद्योजगदकर्ां और ध्वजन अवरोधक स्ट्थाजपत दकए िाने चाजहए।

3. बडी िल जवदु्यत पररर्ोिनाओं की स्ट्थापना । प्रजतजषद्ध।

4. दकसी पररसंकटमर् पिाथा का प्रर्ोग र्ा उत्पािन र्ा प्रस्ट्संकरण । प्रजतजषद्ध।

5. प्राकृजतक िल जनकार्ों र्ा भूजम के्षत्र में अनुपचाररत बजहस्रावों का जनस्ट्सारण । प्रजतजषद्ध।

6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट्तार अनुमत नहीं होगा ।

7. ईंट भट्टों की स्ट्थापना करना। प्रजतजषद्ध।

8. पॉलीजथन बैग का प्रर्ोग। प्रजतजषद्ध।

10. होटलों और ररसोटों की वाजणजज्र्क स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हतेु लघु अस्ट्थार्ी संरचनाओं के जनमााण के जसवार्, संरजक्षत क्षते्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना की अनुमजत नहीं होगी:

परंतु, दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लागू मागाििाक जसद्धांतों के अनसुार सभी नए पर्ाटन दक्रर्ाकलाप करन े र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करने की अनुज्ञा होगी ।

11. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का वाजणजज्र्क सर्न्नामाण अनुमत नहीं दकर्ा िाएगा:

परंतु दक स्ट् थानीर् लोगों को पैरा 3 के उप पैरा (1) में सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को परूा करने जलए सर्न्नामाण करने की अनुमजत भवन उपजवजधर्ों के अनुसार िी िाएगी:

परन्तु दक ऐसे लघ ु उद्योगों िो प्रिषूण उत् पन् न नहीं करते हैं, से संबंजधत सर्न्नामाण दक्रर्ाकलाप जवजनर्जमत दकए िाएंगे और लाग ू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से ही न् र्ूनतम पर रखे िाएंग े। (ख) एक दकलोमीटर से आग े र्ह आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे ।

12. गैर प्रिषूणकारी लघ ुउद्योग। फरवरी, 2016 में केन्द्रीर् प्रिषूण जनर्ंत्रण बोडा द्वारा िारी समर्-समर् पर र्था संिोजधत उद्योगों के वगीकरण के अनुसार गैर-प्रिषूणकारी उद्योग और अपररसंकटमर्, लघु और सेवा उद्योग, कृजष, पषु्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करन ेवाल ेकृजष आधाररत उद्योग अनुज्ञात होंगे।

13. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत, कें द्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी ।

14. वन उत्पािों और गरै काष्ठ वन उत्पािों का संग्रहण । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

15. जवदु्यत और संचार टॉवर लगाने, तार-जबछान ेतथा अन्र् बुजनर्ािी ढांचे की व्यवस्ट्था । लागू जवजधर्ों के अधीन जवजनर्जमत होगा और भूजमगत केबल जबछान े को बढ़ावा दिर्ा िाएगा । [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9

16. नागररक सुजवधाओं सजहत बुजनर्ािी ढांचा। लाग ू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के साथ न्र्ूनीकरण उपार् करना।

17. जवद्यमान सडकों को चौडा करना और उन्हें सुिढृ बनाना और नई सडकों का जनमााण। लाग ूजवजधर्ों, जनर्मों और जवजनर्मों और उपलब्ध मागाििाक जसद्धांतों के अनुसार उजचत पर्ाावरण समाघात जनधाारण के साथ न्र्ूनीकरण उपार् करना।

18. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे दक पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के उपर गमा वार् ु के गुब्बारे, हलेीकाप्टर, ड्रोन, माइक्रोलाइट्स आदि उडाना। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

19. पहाडी ढालों और निी तटों का संरक्षण । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

20. राजत्र में वाहन र्ातार्ात का संचलन । लाग ूजवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होगा ।

21. स्ट्थानीर् समुिार्ों द्वारा अपनाई िा रही वतामान कृजष और बागवानी पद्धजतर्ों के साथ डेर्ररर्ां, िगु्ध उत्पािन, िल कृजष और मत्स्ट्र् पालन। स्ट्थानीर् िनता के उपर्ोग के जलए लाग ू जवजधर्ों के अनुसार अनुमत होंगे।

22. प्राकृजतक िल जनकार्ों र्ा भू के्षत्र में उपचाररत अपजिष्ट िल र्ा बजहस्रााव का जनस्ट्सारण । िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुनचाक्रण और पनु:उपर्ोग के प्रर्ास दकए िाएंगे। उपचाररत अपजिष्ट िल र्ा बजहस्रााव का जनस्ट्सारण लाग ूजवजधर्ों के अनसुार जवजनर्जमत दकर्ा िाएगा।

23. सतही और भूिल का वाजणजज्र्क जनष्कषाण । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

24. फमों, कॉपोरेट और कंपजनर्ों द्वारा बडे पैमान े पर वाजणजज्र्क पिुधन और पोल्री फामा की स्ट्थापना। स्ट्थानीर् िनता की आवश्र्कताओं के जलए लागू जवजधर्ों के अधीन जवजनर्जमत होंगे ।

25. खुले कंुआ, बोर कंुआ, आदि कृजष और अन्र् उपर्ोग के जलए । जवजनर्जमत और समुजचत प्राजधकारी द्वारा दक्रर्ाकलापों की सखती से मानीटरी की िाएगी।

26. ठोस अपजिष्ट प्रबंधन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

27. जविेिी प्रिाजतर्ों को लाना। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

28. पाररजस्ट्थजतकी पर्ाटन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।

29. वाजणजज्र्क संकेत बोडा और होर्डिंग का प्रर्ोग । लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । ग.सवंर्धात दक्रर्ाकलाप

37. पाररजस्ट्थजतकी अनुकूल पररवहन का उपर्ोग । सदक्रर् रूप से संवधान दकर्ा िाएगा ।

38. कौिल जवकास । सदक्रर् रूप से संवधान दकर्ा िाएगा ।

39. अवक्रजमत भूजम र्ा वनों र्ा पर्ाावासों की बहाली । सदक्रर् रूप से संवधान दकर्ा िाएगा ।

40. पर्ाावरण के प्रजत िागरुकता। सदक्रर् रूप से संवधान दकर्ा िाएगा ।

5. मॉनीटरी सजमजत.- पर्ाावरण अजधजनर्म की धारा 3 की उपधारा (3) के अधीन इस अजधसूचना के उपबंधों की प्रभावी मॉनीटरी के जलए कें द्रीर् सरकार, एक मॉनीटरी सजमजत का गठन करती ह,ै िो जनम्नजलजखत से जमलकर बनेगी, अथाात:्-

(i) संबंजधत जिला कलेक्टर अध् र्क्ष, पिने;

(ii) पर्ाावरण और वन्र्िीव संरक्षण (जवरासत संरक्षण सजहत) के क्षेत्र में काम करने वाले गैर-सरकारी संगठन का एक प्रजतजनजध, जिसे प्रत्र्ेक कार्ाकाल के जलए तीन वषा से अजधक की अवजध के जलए राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा। सिस्ट्र्;

(iii) राज्र् सरकार द्वारा प्रत्र्ेक तीन वषा में समर्-समर् पर पाररजस्ट्थजतकी और पर्ाावरण के क्षेत्र में एक जविेषज्ञ को नामजनर्िाष्ट दकर्ा िाएगा। सिस्ट्र्;

(iv) राज्र् िैवजवजवधता बोडा का सिस्ट्र् सिस्ट्र्, पिेन;

(v) राज्र् लोक जनमााण जवभाग का एक प्रजतजनजध सिस्ट्र्, पिेन;

(vi) राज्र् प्रिषूण जनर्ंत्रण बोडा का एक प्रजतजनजध सिस्ट्र्, पिेन;

(vii) प्रभागीर् वन अजधकारी, गोरुमारा राष्ट्रीर् उद्यान के प्रभारी सिस्ट्र्-सजचव, पिने।

6. मॉनीटरी सजमजत के कार्ा:- (1) मॉनीटरी सजमजत, वास्ट्तजवक स्ट्थल-जवजनर्िाष्ट जस्ट्थजतर्ों के आधार पर उन दक्रर्ाकलापों की संवीक्षा करेगी िो दक भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर्, की अजधसूचना संखर्ांक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006, की अनुसूची के अतंगात आत ेहों और िो उसके परैा 4 के अधीन सारणी में जवजनर्िाष्ट प्रजतजषद्ध दक्रर्ाकलापों के जसवार् पाररजस्ट्थजतकी संवेिी िोन में आत े हों, और उि अजधसूचना के उपबंधों के अधीन पर्ाावरण की िजृष्ट से पूवा-अनुमजत के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् र्ा राज्र् पर्ाावरण समाघात जनधाारण प्राजधकरण को जनर्िाष्ट करेगी। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11

(2) दक्रर्ाकलाप उप-पैरा (1) में जनर्िाष्ट अजधसूचना की अनुसूची में िाजमल नहीं हैं और िो पाररजस्ट्थजतकी संवेिी ज़ोन में आती हैं, उनके पैरा 4 के अधीन सारणी में जवजनर्िाष्ट प्रजतजषद्ध दक्रर्ाकलापों के जसवार्, मॉनीटरी सजमजत द्वारा संवीक्षा की िाएगी। वास्ट्तजवक स्ट्थल-जवजनर्िाष्ट जस्ट्थजतर्ों के आधार पर और संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट की िाएगी।

(3) मॉनीटरी सजमजत के सिस्ट्र्-सजचव र्ा सम्बद्ध कलेक्टर र्ा संबद्ध उप वन संरक्षक, पर्ाावरण अजधजनर्म की धारा 19 के अधीन इस अजधसूचना के उपबंधों का उल्लघंन करन ेवाले दकसी भी व्यजि के जवरुद्ध जिकार्त ििा करने के जलए सक्षम होंगे।

(5) मॉनीटरी सजमजत उपाबधं-V में जवजनर्िाष्ट प्रोफामाा के अनुसार प्रत्र्ेक वषा 31 माचा तक दक अवजध के अपन े दक्रर्ाकलापों की वार्षाक कारावाई ररपोटा उस वषा के 30 िून तक राज्र् के मखुर् वन्र्िीव संरक्षक को प्रस्ट्तुत करेगी।

8. कोई अन् र् महत् वपूणा मामला । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 29th November, 2024 S.O. 5132(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 4952(E), dated the 16th November, 2023, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 16th November, 2023;

AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the aforesaid draft notification were considered by the Central Government;

26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, Gorumara National Park in Jalpaiguri District of West Bengal with an area of 79.45 square kilometers, was notified by the State Government of West Bengal vide notification dated the 1st January, 1998 and is home to about 55 Great Indian One Horned Rhinoceros, one of the last populations of the species globally;

AND WHEREAS, the National Park acts as a crucial corridor for the movement of the Indian Elephant and harbours about 1000 Gaurs, Leopards along with other lesser cats, numerous herbivores and about 300 species of birds and about same number of butterflies, and has great significance in the forested landscape of Jalpaiguri district along with its forest, riverine ecosystem and adjoining tea gardens and villages including their diverse ethnicities;

AND WHEREAS, Gorumara National Park supports a number of species specified under Schedule-I of the Wildlife (Protection) Act, 1972 (53 of 1972) that inter alia,includes the Great Indian One Horned Rhinoceros (Rhinoceros unicornis), Indian Elephant (Elephas maximus), Gaur (Bos gaurus), Leopard (Panthera pardus), Indian Rock Python (Python molurus), Malayan Giant Squirrel (Ratufa bicolor), Leopard Cat (Prionailurus bengalensis), Fishing Cat (Prionailurus viverrinus), Hill Myna (Gracula religiosa), Indian Peafowl (Pavo cristatus), Indian Grey Hornbill (Ocyceros birostris), etc.;

AND WHEREAS, for effective conservation and protection of this rich floral and faunal biodiversity of Gorumara National Park, the extent of anthropogenic pressure in the periphery of the park has to be regulated as the immediate area adjoining this fragile ecosystem is ecologically sensitive and exert great impact on this Protected Area;

AND WHEREAS, the dynamic nature of main river systems of Murti and Jaldhaka along with their tributaries and rivulets has a direct impact on the wildlife in the park, and therefore, it is necessary to conserve and protect the areas around Gorumara National Park for improvement and development the wildlife habitat therein and in the landscape;

AND WHEREAS, it is necessary to conserve and protect the area, surrounding the boundaries of Gorumara National Park which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1.0 kilometer to 17.0 kilometers from the boundary of Gorumara National Park, in Jalpaiguri district in the State of West Bengal as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-Sensitive Zone) details of which are as under, namely: -

1. Extent and boundaries of Eco-Sensitive Zone.-(1) The Eco-Sensitive Zone shall be to an extent varying from 1.0 kilometer to 17.0 kilometers from the boundary of Gorumara National Park and the area of the Eco-sensitive Zone is approximately 278 Square kilometers.

(2) The boundary description of Gorumara National Park and its Eco-Sensitive Zone is appended as Table A and Table B in Annexure-I.

(3) The maps of the Gorumara National Park demarcating Eco-sensitive Zone is appended as Annexure-II A, Annexure-II B, Annexure-II C, Annexure-II D and Annexure-II E.

(4) List of important geo-coordinates of the National Park and its Eco-sensitive Zone are appended as Table A, Table B and Table C in Annexure- III.

(5) The list of areas falling in the proposed Eco-Sensitive Zone is appended as Annexure-IV A and villages falling under Eco-Sensitive Zone along with latitudes and longitudes is appended as Annexure-IV B.

2. Zonal Master Plan for Eco-Sensitive Zone .-(1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare and notify a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant laws for the time being in force and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan, namely.-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipality;

(x) Panchayati Raj; and

(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so prepared and notified shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

(10) Pending preparation and approval of the Zonal Master Plan, any new developmental activities shall be governed by provisions specified in sub-para (1) and (2) of paragraph 6.

3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or the State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph;

(b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests.

(c) Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.

(e) Activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:

Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the regulatory authorities concerned based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and Environment Act, and the rules made thereunder.

(8) Discharge of effluents.- The discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and Environment Act and the rules made thereunder.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-

(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 29 biodegradable components;

(c) the biodegradable material shall be recycled preferably through composting or vermiculture;

(d) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall he permitted in the Eco-sensitive Zone.

(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:-

(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016;

(b) safe and environmentally sound management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016.

(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016.

(13) E-waste.- The E - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016.

(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone;

(b) only non-polluting industries shall be allowed within the Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the nonpolluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Ecosensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and regulated in the manner specified in the Table below, namely:- TABLE Sl. (a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within the Eco- sensitive Zone;

(b) The mining operations shall be carried out in accordance with the orders of the Hon’ble Supreme Court, dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs.

UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of

2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).

No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted and pollution prevention technologies and noise barriers should be installed by existing industries.

3. Establishment of major hydroelectric project.

Prohibited.

4. Use or production or processing of any hazardous substance.

Prohibited.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited.

6. Setting up of saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited.

8. Use of polythene bags. Prohibited.

9. Commercial use of firewood. Prohibited.

B. Regulated Activities

10. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of the Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

11. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents:

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

12. Small scale non-polluting industries.

Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted.

13. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

14. Collection of Forest Produce or Non-Timber Forest Produce.

Regulated under applicable laws.

15. Erection of electrical and communication towers and laying of cables and other Regulated under applicable laws and underground cabling may be promoted.

16. Infrastructure including civic amenities.

Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.

18. Undertaking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

Regulated as per the applicable laws.

19. Protection of Hill Slopes and river banks.

Regulated as per the applicable laws.

20. Movement of vehicular traffic at night.

Regulated for commercial purpose under applicable laws.

21. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

Permitted as per the applicable laws for use of locals.

22. Discharge of treated waste water or effluents in natural water bodies or land area.

The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water, and the discharge of treated waste water or effluent shall be regulated as per the applicable laws.

23. Commercial extraction of surface and ground water.

Regulated under applicable laws.

24. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies.

Regulated as per applicable laws except for meeting local needs.

25. Open Well, Bore Well, etc. for agriculture or other usage.

Regulated and the activity should be strictly monitored by the appropriate authority.

26. Solid Waste Management. Regulated as per the applicable laws.

27. Introduction of Exotic species. Regulated as per the applicable laws.

28. Eco-tourism. Regulated as per the applicable laws.

29. Commercial Sign boards and hoardings.

Regulated as per the applicable laws.

C. Promoted Activities

30. Rain water harvesting. Shall be actively promoted.

31. Organic farming. Shall be actively promoted.

32. Adoption of green technology for all activities.

Shall be actively promoted.

33. Cottage industries including village artisans, etc.

Shall be actively promoted.

34. Use of renewable energy and fuels.

Bio-gas, solar light etc. shall be actively promoted.

35. Agro-Forestry. Shall be actively promoted.

36. Plantation of Horticulture and Herbals.

Shall be actively promoted.

5. Monitoring Committee.-For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment Act, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:-

(i) Concerned District Collector Chairman; ex-officio

(ii) A representative of Non-governmental Organisation working in the field of environment and wildlife conservation (including heritage conservation) to be nominated by the State Government for a period not exceeding three years for each term Member;

(iii) An expert in the area of ecology or environment to be nominated by the State Government from time to time every three years Member;

(iv) Member of State Biodiversity Board Member; ex-officio

(v) A representative from State Public Works Department Member; ex-officio

(vi) A representative from State Pollution Control Board Member; ex-officio

(vii) The Divisional Forest Officer, in charge of Gorumara National Park Member-Secretary; ex-officio

6. Functions of Monitoring Committee –(1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification.

(2) The activities not covered in the Schedule to the notification referred to in sub-paragraph (1) and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the regulatory authorities concerned.

(3) The Member-Secretary of the Monitoring Committee or the Collector concerned or the Deputy Conservator of Forests concerned shall be competent to file complaint under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.

(4) The Monitoring Committee may invite representative or expert from the Department concerned, representative from industry associations or stakeholders to assist in its deliberations depending on the requirements on case to case basis.

(5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in .

(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional Measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. Supreme Court, etc. orders. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
