PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 22 नवम् बर, 2021 का.आ. 4793(अ).—प्रारुप अजधसूचना भारत के रािपत्र, असाधारण, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान, मंत्रालर् की अजधसूचना सं. का.आ. 566 (अ), तारीख 5 फरवरी, 2021, द्वारा प्रकाजित की गई थी जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करन ेवाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उि प्रारूप अजधसूचना को अन्तर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को तारीख तारीख 5 फरवरी, 2021 को उपलब्ध करा िी गई थी;
और, पूवोि प्रारुप अजधसूचना के प्रत्र्ुत्तर में व्यजिर्ों और पणधाररर्ों से कोई आक्षेप और सुझाव प्राप्त नहीं हुए;

और, कैस वन्र्िीव अभर्ारण्र् जहमालर् के्षत्र में प्रजतबंजधत स्ट्थाजनक और अजतसंवेिनिील जहमालर्न मोनल फीिेन्ट (लोकोफोरस इम्पेिनक) के जलए महत्त्वपूणा पक्षी के्षत्र के रूप में पहचाना गर्ा ह।ै के्षत्र में महत्त्वपूणा पक्षी प्रिाजतर्ों में जहमालर्न कठफोड़वा (डेंड्रोकोपोस जहमालार्ेंजसस), कोकलास फेिेण्ट (पुकराजसर्ा माक्रोलोफा), कजलि फेिेण्ट (लोफुरा लेर्कोमेलानोस), ग्र े फेिेण्ट (परेजडक्स परेजडक्स), स्ट्रीक्ड लाफफंग थ्रि (रोचलोपटरों जलनतमु), जचतकबरा लाफफंग थ्रि (रोचलोपटरों वाररइगातुम), ग्र ेबुिचाट (सजक्सकोला फेरेउस), ब्ल ू जहहस्ट्टललगं थ्रि (मार्ोफोनुस कैइरूलेउस), आदि पाई िाती ह;ै और, कैस वन्र्िीव अभर्ारण्र् और इसका पाररजस्ट्थजतकी संवेिी िोन ओषधीर् पौधों की संख्र्ा को आिर् प्रिान करता ह ै जिसमें पजति (अकोंरटनम स्ट्पा), लिंगली लमंगली (डीओस्ट्कोरेर्ा डेलटोआइजडर्ा), सलाम-पंिा (ओरजचस लैरटफोजलर्ा), पडोफर्ल्लुम प्रिाजतर्ां, गुजि (मोरचेल्ला इस्ट्कुलांटा), धूप (िुररनेर्ा माकरोपोडा), बानाकिा (जवओला स्ट्पा) िाजमल हैं;
और, कैस वन्र्िीव अभर्ारण्र् और इसका पाररजस्ट्थजतकी संवेिी िोन कई िलुाभ और लपु्तप्रार् प्रिाजतर्ों के जलए बफर िोन का कार्ा करता ह।ै र्ह के्षत्र ब्र्ास निी के ऊपरी िलग्रहण के्षत्र का कार्ा करता ह ैऔर खड़ी ढलान को मिृा कटाव का खतरा ह;ै और, कैस वन्र्िीव अभर्ारण्र् के चारों ओर के के्षत्र को, जिसका जवस्ट्तार और सीमाए ंपाररजस्ट्थजतकी पर्ाावरणीर् से पाररजस्ट्थजतकी संवेिी िोन के रूप में पैरा 1 में जवजनर्िाष्ट हैं, िैव जवजवजधता की िजृष्ट सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करन े को प्रजतजषद्ध करना आवश्र्क ह;ै अतः, अब, केन्र्द्ीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना में इसके पिात ्पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, जहमाचल प्रिेि राज्र् के कुल्लू जिला में कैस वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 50 मीटर से [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3
2.21 दकलोमीटर जवस्ट्ताररत के्षत्र को कैस वन्र्िीव अभर्ारण्र् पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका ब्र्ौरा जनम्नानुसार ह,ै अथाात्:-
1. पाररजस्ट्थजतकी सवंिेी िोन का जवस्ट्तार और सीमाए.ं- (1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार कैस वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 50 मीटर से 2.21 दकलोमीटर तक 24.651 वगा दकलोमीटर क्षेत्रफल के साथ जवस्ट्ततृ होगा। पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार रािस्ट्व ग्रामों की जनकटता के कारण पजिमी भाग पर 50 मीटर ह।ै
(2) कैस वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबंध-I के रूप में संलग्न ह।ै
(3) सीमा जववरण और अक्षािं और ििेांतर के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए कैस वन्र्िीव अभर्ारण्र् के मानजचत्र उपाबंध-IIक और उपाबंध-IIख के रूप में संलग्न ह।ै
(4) कैस वन्र्िीव अभर्ारण्र् और पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनिेिांकों की सूची उपाबंध-III की सारणी क और सारणी ख में िी गई ह।ै
(5) मुख्र् लबंिओुं के भू-जनिेिाकंों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन ेवाल ेग्रामों की सूची उपाबंध- IV के रूप में संलग्न ह।ै
2. पाररजस्ट्थजतकी सवंिेी िोन के जलए आचंजलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी और राज्र् में सक्षम प्राजधकारी द्वारा सम्र्क रुप से अनुमोदित दकर्ा िाएगा।
(2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए हैं, के अनुसार तथा सुसंगत कें र्द्ीर् और राज् र् जवजधर्ों के अनरुुप और कें र्द्ीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी ।
(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी:-
(i) पर्ाावरण;
(ii) वन और वन्र्िीव;
(iii) कृजष;
(iv) रािस्ट् व;
(v) िहरी जवकास;
(vi) पर्ाटन;
(vii) ग्रामीण जवकास;
(viii) लसंचाई और बाढ़ जनर्ंत्रण;
(ix) नगरपाजलका;
(x) पंचार्ती राि;
(xi) जहमाचल प्रिेि राज्र् प्रिषूण जनर्ंत्रण बोडा; और

(4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दक्रर्ाकलापों में, िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलओुं, जिन पर ध्र्ान िनेा आवश्र्क ह,ै के जलए उपबंध होंग े।
(6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेषताओं के ब्र्ौरों से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजष क्षेत्रों, ऊपिाऊ भूजम, हररत के्षत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजष के्षत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभर्ांकन करेगी।
(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करने के जलए प्रदकर्ा प्रिान की िाएगी और सारणी में सूचीबद्ध पैरा-4 में प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों की िीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित और उसकी अजभवृजद्ध भी करेगी।
(8) आंचजलक महार्ोिना प्रािेजिक जवकास र्ोिना की सह जवस्ट्तारी होगी ।
(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कृत्र्ों को करने के जलए राज्र् सरकार द्वारा जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी ।
3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करन े के जलए जनम्नजलजखत उपार् करेगी, अथाात्:-
(1) भ-ूउपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजष क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुले स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा:
परंत ुपाररजस्ट्थजतकी संवेिी िोन के भीतर भाग (क) में जवजनर्िाष्ट प्रर्ोिनों से जभन्न प्रर्ोिनों के जलए कृजष और अन्र् भूजम का संपररवतान जनगरानी सजमजत की जसफाररि पर और र्था लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्र्द्ीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करन ेके जलए अनुज्ञात दकर्ा िाएगा, िैसे-
(i) जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिढृ़ करना तथा नई सड़कों का संजनमााण;
(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रिषूण उत्पन्न न करन ेवाले लघ ुउद्योग;
(iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी हैं; सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन जिसके अन्तगात गृह वास सजम्मजलत ह;ै और
(v) पैरा 4 में दिए गए संवर्धात दक्रर्ाकलाप:
परंत ुर्ह और दक प्रािेजिक नगर र्ोिना अजधजनर्म और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन और संजवधान के अनचु्छेि 244 के उपबंधों र्ा तत्समर् प्रवृत्त जवजध के उपबंधों के [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 अनुपालन के जबना, जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा:
परंत ुर्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई गलती, जनगरानी सजमजत के जवचार प्राप्त करन ेके पिात ्राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार ठीक होगी और उि गलती के सुधार की सूचना कें र्द्ीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी:
परंतु र्ह और भी दक गलती के सुधार में इस उप परैा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू- उपर्ोग का पररवतान सजम्मजलत नहीं होगा;
(ख) वनीकरण तथा वास िीणोद्धार दक्रर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजष क्षते्रों में पनु: वनीकरण करने के प्रर्ास दकए िाएंगे।
(2) प्राकृजतक िल स्रोत.- आचंजलक महार्ोिना में सभी प्राकृजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दक्रर्ाकलाप प्रजतजषद्ध करने के बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएंगे।
(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा;
(ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी;
(ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप में होगी;
(घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी;
(ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम्नानुसार जवजनर्जमत होंग,े अथाात:्-
(i) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नर् ेवाजणजज्र्क होटल और ररिॉटा के सजन्नमााण अनुज्ञात नहीं होंगे:
परंत,ु र्ह दक संरजक्षत के्षत्र की सीमा से एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररिॉटा का स्ट्थापना केवल पूवा पररभाजषत और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनजु्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार कें र्द्ीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष् रीर् ह र्ाघ्र संरक्षण प्राजधकरण, द्वारा िारी पाररजस्ट्थजतकी–पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िते े हुए (समर्-समर् पर र्था संिोजधत) िारी मागाििाक जसद्धांतों के अनुसार होगा;
(iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िाष्ट संवीक्षा और जनगरानी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए होटल र्ा ररसोटा र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनुज्ञात नहीं दकर्ा िार्गेा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(4) नसैर्गाक जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत के्षत्र, िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाए,ं स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप में परररक्षण और संरक्षण के जलए तैर्ार की िाएगी ।
(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तैर्ार की िाएगी।
(6) ध् वजन प्रिषूण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रिषूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिषूण के जनर्ंत्रण और जनवारण का अनुपालन दकर्ा िाएगा।
(7) वार् ुप्रिषूण.- पाररजस्ट्थजतकी संवेिी िोन में, वार् ुप्रिषूण के जनवारण और जनर्ंत्रण का वार्ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा।
(8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सरण, साधारण मानकों के उपबंधों के अनुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर् प्रिषूण के जनस्ट्सरण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा।
(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रलै, 2016 के द्वारा प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा;
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(10) िवै जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016, के द्वारा प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा;
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनकूुल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(11) प्लाजस्ट्टक अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(12) जनमााण और जवध्वसं अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा ।
(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(14) र्ानीर् र्ातार्ात.- र्ातार्ात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध में आंचजलक महार्ोिना में जविेष उपबंध सजम्मजलत दकए िाएंग ेऔर आंचजलक महार्ोिना के तैर्ार होन ेऔर राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, जनगरानी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् दक्रर्ाकलापों के अनुपालन को जनगरानी करेगी।
(15) र्ानीर् प्रिषूण.- लाग ूजवजधर्ों के अनुपालन में वाहन प्रिषूण का जनवारण और जनर्ंत्रण दकर्ा िाएगा और स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे।
(16) औद्योजगक ईकाइर्ा.ं- (क) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पिात ्पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिजूषत उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी;
(ख) केन्र्द्ीर् प्रिषूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गरै-प्रिषूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रिषूणकारी उद्योगों को बढ़ावा दिर्ा िाएगा।
(17) पहाड़ी ढलानों को संरक्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) आंचजलक महार्ोिना पहाड़ी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनजु्ञा नहीं िी िाएगी;
(ख) कटाव के एक उि जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी।
4. पाररजस्ट्थजतकी सवंिेी िोन में प्रजतजषद्ध और जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सचूी.- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीन बनाए गए जनर्मों जिसके अन्तगात तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 और अन्र् लागू जवजधर्ों के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) सजम्मजलत हैं और दकर् ेगर् ेसंिोधनों द्वारा िाजसत होंगे और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में जवजनर्जमत होंगे, अथाात ्:- सारणी क्रम स.ं दक्रर्ाकलाप वणान

1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघषाण इकाइर्ां । (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं जिसमें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत है, के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघ ु और वृहत खजनि), पत्थर उत्खनन और अपघषाण इकाइर्ां तत्काल प्रभाव से प्रजतजषद्ध होंगी;

गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उितम न्र्ार्ालर् के आििे 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रैल, 2014 के आििे के अनुसरण में होगा ।
2. प्रिषूण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन करने वाले उद्योगों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रिषूणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी:
परन्तु, केन्र्द्ीर् प्रिषूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रिषूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रिषूणकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा।
3. बृहत िल जवद्युत पररर्ोिना की स्ट्थापना । प्रजतजषद्ध।
4. दकसी पररसंकटमर् पिाथा का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। प्रजतजषद्ध।
5. प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में अनुपचाररत बजहस्रााव का जनस्ट्सरण । प्रजतजषद्ध।
6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई आरा जमलों की स्ट्थापना और जवद्यमान आरा जमलों का जवस्ट् तार अनुज्ञात नहीं होगा।
7. ईंट भट्टों की स्ट्थापना करना। प्रजतजषद्ध।
8. पोजलथीन बैगों का उपर्ोग। प्रजतजषद्ध।
9. िलावन लकड़ी का वाजणजज्र्क उपर्ोग। प्रजतजषद्ध।
10. मछली पकड़ना और जिकार करना। प्रजतजषद्ध। आ .जवजनर्जमत दक्रर्ाकलाप
11. वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना। पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों लघ ु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट है, नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा:
परंतु, र्ह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के परे र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक इनमें स,े िो भी जनकट हो सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लाग ूमागाििी जसद्धांतों के अनुरुप होगा।
12. संजनमााण दक्रर्ाकलाप। (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर्े वाजणजज्र्क संजनमााण की अनजु्ञा नहीं होगी:
परंतु र्ह दक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवश्र्कताओं को पूरा करने के जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध दक्रर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप- जवजधर्ों के अनुसार, संजनमााण करने की अनुज्ञा होगी:
परंतु र्ह दक गैर–प्रिषूणकारी लघु उद्योगों से संबंजधत संजनमााण दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 क्रम स.ं दक्रर्ाकलाप वणान
(1) (2) (3) प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंगे। (ख) एक दकलोमीटर क्षेत्र से परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे।
13. प्रिषूण उत्पन्न न करने वाले लघु उद्योग। फरवरी, 2016 में केन्र्द्ीर् प्रिषूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों में वगीकरण के अनुसार समर्-समर् पर र्था संिोजधत गैर-प्रिषूणकारी उद्योग और अपररसंकटमर् में, लघु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन से ििेी सामग्री से उत्पािों को उत्पन्न करने वाले कृजष आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे।
14. वृक्षों की कटाई। (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत कें र्द्ीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होगे ।
15. वन उत्पािों र्ा गैर काष् ठ वन उत्पािों का संग्रहण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंग े।
16. जवद्युत और संचार टावरों का पररजनमााण और केबलों के जबछाए िाने और अन्र् बुजनर्ािी ढांचे। लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग ेभूजमगत केबल के जबछाए िान े को बढ़ावा दिर्ा िा सकेगा।
17. नागररक सुख सुजवधाओं सजहत अवसंरचनाएं । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाना ।
18. जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिढृ़ करना तथा नवीन सड़कों का संजनमााण । न्र्ूनीकरण उपार्ों को लाग ू जवजधर्ों, जनर्मों और जवजनर्मनों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाएगा ।
19. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे गमा वार्ु गुब्बारें, हलेीकॉप्टर, ड्रोन, माइक्रोलाइटस, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उड़ना िैसे दक्रर्ाकलाप करना। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंग े।
20. सतही और भूिल का वाजणजज्र्क जनष्कषाण । लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे ।
21. पहाड़ी ढालों और निी तटों का संरक्षण। लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे ।
22. राजत्र में र्ाजनक र्ातार्ात का संचलन । लाग ूजवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंग े।
23. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजष और बागवानी प्रथाओं के साथ िगु्धिाला, िगु्घ उद्योग, कृजष और मछली पालन । स्ट्थानीर् लोगों के उपर्ोग के जलए लाग ूजवजधर्ों के अधीन अनुज्ञात होंग े।
24. प्राकृजतक िल जनकार्ों र्ा सतही क्षेत्र में उपचाररत बजहस्रााव का जनस्ट्तारण । िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुन:चक्रण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्र्था लागू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचाक्रण र्ा प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा। 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] क्रम स.ं दक्रर्ाकलाप वणान

25. जवििेी प्रिाजतर्ों को लाना। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंग े।
26. फमों, जनगम और कंपजनर्ों द्वारा बडे़ पैमाने पर वाजणजज्र्क पिुओं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आवश्र्कताओं को पूरा करने के जलए लागू जवजधर्ों के अधीन जवजनर्जमत होंग े।
27. खुल े कंुआ, बोर कंुआ, आदि कृजष और अन्र् उपर्ोग के जलए । जवजनर्जमत और सम्बद्ध प्राजधकारी द्वारा दक्रर्ाकलापों की सख्ती से जनगरानी की िाएगी।
28. ठोस अपजिष्ट का प्रबन्धन। लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे ।
29. पाररजस्ट्थजतकी पर्ाटन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंग े।
30. वाजणजज् र्क सूचनापट्ट और होडडंग। लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे । इ .सवंर्धात दक्रर्ाकलाप
31. वषाा िल संचर्न। सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
32. िैजवक खेती। सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
33. सभी गजतजवजधर्ों के जलए हररत प्रौद्योजगकी को अंगीकृत करना । सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
34. कुटीर उद्योगों जिसके अंतगात ग्रामीण कारीगर भी हैं। सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
35. नवीकरणीर् ऊिाा और ईंधन का उपर्ोग । बार्ोगैस, सौर प्रकाि, इत् र्ादि को बढ़ावा दिर्ा िाएगा।
36. कृजष वाजनकी । सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
37. बागान लगाना और िड़ी बूरटर्ों का रोपण । सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
38. पाररजस्ट्थजतकी अनुकूल पररवहन का उपर्ोग । सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
39. कौिल जवकास । सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
40. जनम्नीकृत भूजम/वन/वास की बहाली। सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
41. पर्ाावरणीर् िागरुकता । सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
5. पाररजस्ट्थजतकी सवंिेी िोन अजधसचूना की जनगरानी के जलए जनगरानी सजमजत- इस अजधसूचना के उपबंधों की प्रभावी जनगरानी के जलए, कें र्द्ीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अधीन जनगरानी सजमजत का गठन करती ह,ै िो जनम्नजलजखत से जमलकर बनगेी, अथाात:्- क्र.स.ं जनगरानी सजमजत का गठन पिनाम
(i) वन संरक्षक, कुल्ल ू अध् र्क्ष;
(ii) राज्र् सरकार द्वारा नाजमत दकए िान ेवाल ेपर्ाावरण के के्षत्र में काम करन ेवाल ेगैर- सरकारी संगठन का प्रजतजनजध सिस्ट्र्;
(iii) राज्र् प्रिषूण जनर्ंत्रण बोडा के क्षेत्रीर् कार्ाकारी इंिीजनर्र सिस्ट्र्;
(iv) के्षत्र के वररष्ठ नगर जनर्ोिक सिस्ट्र्;
(v) राज्र् िैव जवजवधता बोडा का प्रजतजनजध सिस्ट्र्;
(vi) पाररजस्ट्थजतकी और पर्ाावरण के के्षत्र में एक जविेषज्ञ राज्र् सरकार द्वारा नाजमत दकर्ा िाएगा सिस्ट्र्;
(vii) संभागीर् वन अजधकारी (वन्र्िीव), कुल्ल ू सिस्ट्र्;
(viii) प्रभागीर् वन अजधकारी, कुल्ल ू सिस्ट्र्–सजचव। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11
6. जनिेि जनबधंन.- (1) जनगरानी सजमजत इस अजधसूचना के उपबंधों के अनुपालन को जनगरानी करेगी।
(2) जनगरानी सजमजत का कार्ाकाल अगले आिेि होन ेतक दकर्ा िाएगा, परंत ुर्ह दक सजमजत के गैर-सरकारी सिस्ट्र्ों को समर्-समर् पर राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा।
(3) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में सजम्मजलत हैं, और िो पाररजस्ट्थजतकी संवेिी िोन में आत े हैं, जसवार् इसके िो पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजषद्ध दक्रर्ाकलापों के, जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केर्द्ींर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िाष्ट दकर्ा िाएगा।
(4) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ) तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं ह,ै और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवर्नाष्ट प्रजतजषद्ध दक्रलाकलापों के जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा।
(5) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता ह,ै पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि फाइल करने के जलए सक्षम होगा।
(6) जनगरानी सजमजत मदु्दा िर मुद्दा के आधार पर अपेक्षाओं पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेषज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपने जवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।
(7) जनगरानी सजमजत प्रत्र्ेक वषा की 31 माचा तक के अपन े दक्रर्ाकलापों की वार्षाक कारावाई ररपोटा राज् र् के मुख् र् वन् र्िीव वाडान को उपाबंध-V में संलग्न प्रोफामाा में उक् त वषा के 30 िून तक प्रस्ट्तुत करेगी ।
(8) केन्र्द्ीर् सरकार का पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् जनगरानी सजमजत को अपने कृत्र्ों के प्रभावी जनवाहन के जलए ऐसे जनिेि िे सकेगा, िो वह ठीक समझे ।
7. अजतररक् त उपार्.- इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए कें र्द्ीर् सरकार और राज् र् सरकार, अजतररक् त उपार्, र्दि कोई हों, जवजनर्िाष् ट कर सकेंगी।

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 5 th February, 2021;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification;
AND WHEREAS, the Kais Wildlife Sanctuary is spread over an area of 12.61 square kilometers and is situated at a distance of 270 kilometers from Shimla and 20 kilometers from Kullu in District Kullu in the State of Himachal Pradesh;
AND WHEREAS, the Kais Wildlife Sanctuary was given the status of Wildlife Sanctuary with effect from the 7 th June, 2013 vide notification no. FFE-B-F(6)- 11/2005-II/Kais. The Wildlife Sanctuary provides home to a variety of endemic flora and fauna and also has several important values from ecological, faunal, floral, geomorphologic and recreational and research/educational perspective;
AND WHEREAS, the Kais Wildlife Sanctuary consists of sub-tropical chir pine forest, moist deodar forests, western mixed coniferous forests, moist temperate deciduous forest, kharshu oak forest, western Himalayan sub-alpine fir forest. The major floral species found in and around Kais Wildlife Sanctuary are deodar (Cedrus deodara), blue pine (Pinus wallichiana), chir pine (Pinus roxburghii), mohr (Quercus dialata), kharsu (Quercus semecarpifolia), prunus (Prunus cornata), khanor (Aesculus indica), boxwood (Buxus wallichiana), walnut (Juglans regia), buransh (Rhododendron arboretum), mohran (Ulmus wallichiana), rhus (Rhus wallichiana) khairak (Celtis australis), bhojpatra (Betula utilis), Kosh (Alnus nitida), maple (Acer pictum);
AND WHEREAS, the major faunal species found in the sanctuary are threatened species like leopard (Panthera pardus), leopard cat (Felis bengalensis), jungle cat (Felis chaus), Himalayan civet (Pagoma larvata), Himalayan yellow throated marten (Martes flavigula), black bear (Selenarctus thibetanus), porcupine (Hystrix indica), flying squirrel (Petaurista petaurista), monkey (Macaca mullata), langoor (Presbytis entellus), goral (Nemorhaeadus goral), barking deer (Muntjacus muntjack), jackal (Canis aureus), etc;
AND WHEREAS, the Kais Wildlife Sanctuary has been recognised as an Important Bird Area for Himalayan monal pheasent (Lophophorus impejanus), endemic and vulnerable species restricted to Himalayan region. The important avi- fauna species present in the area are Himalayan woodpecker (Dendrocopos himalayensis), Koklash pheasant (Pucrasia macrolopha), Kalij pheasant (Lophura leucomelanos), grey partridge (Perdix perdix), streaked laughing thrush (Trochalopteron lineatum), variegated laughing thrush (Trochalopteron variegatum), grey bushchat (Saxicola ferreus), blue whistling thrush (Myophonus caeruleus), etc;
AND WHEREAS, the Kais Wildlife Sanctuary and its Eco-Sensitive Zone supports a number of medicinal plants including patish (Acontinum spp.), shingli mingli (Dioscorea deltoidea), salam-panja (Orchis latifolia), Padophyllum species, guchhi (Morchella esculanta), dhoop (Jurinea macropoda), banaksha (Viola spp.);
AND WHEREAS, the Kais Wildlife Sanctuary and its Eco-Sensitive Zone act as a buffer zone for many rare and endangered species. The area also acts as an upper catchment to Beas River and the steep slopes are prone to soil erosion;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Kais Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 50 meters to 2.21 kilometers around the boundary of Kais Wildlife Sanctuary, in Kullu District in the State of Himachal Pradesh as the Kais Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:

1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be of 24.651 square kilometers with an extent 50 meters to 2.21 kilometers around the boundary of Kais Wildlife Sanctuary. The extent of the Eco-sensitive zone is 50 meters on Western side due to proximity of revenue villages alongside.
(2) The boundary description of Kais Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I.
(3) The maps of the Kais Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB.
(4) Lists of geo co-ordinates of the boundary of Kais Wildlife Sanctuary and Eco- sensitive Zone are given in Table A and Table B of Annexure-III.
(5) The list of villages falling in the Eco-sensitive Zone along with their geo co- ordinates at prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Ecosensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification and get it duly approved by the competent authority in the State.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Himachal Pradesh State Pollution Control Board; and
(xii) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved by the State Government shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco- sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph;
(b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone;
(b) the Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests;
(c) the Tourism Master Plan shall form a component of the Zonal Master Plan;
(d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone;
(e) the activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, ecoeducation and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc.
shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco- sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made there under or standards stipulated by the State Government, whichever is more stringent.
(9) Solid wastes.- Disposal and Management of solid wastes shall be asunder:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco- sensitive Zone;
(b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.
(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be asunder:-
(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28 th March,2016;
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco- sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone;
(b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be asunder:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Ecosensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Description

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco- sensitive Zone;
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435of 2012.
2. Setting of industries causing pollution (water, air, soil, noise, etc.).
New industries and expansion of existing polluting industries in the Eco-Sensitive Zone shall not be permitted:
Provided that, non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited.
4. Use or production or processing of any hazardous substance.
Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited.

6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited.
8. Use of polythene bags. Prohibited.
9. Commercial use of firewood. Prohibited.
10. Fishing and Hunting. Prohibited.
B. Regulated Activities

11. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco- sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
12. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents:
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
13. Small scale non- polluting industries.
Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority.
14. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.
15. Collection of Forest Produce or Non-Timber Forest Produce.
Regulated under applicable laws.

16. Erection of electrical and communication towers and laying of cables and other Infrastructures.

23. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted as per the applicable laws for use of locals.
24. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per the applicable laws.
25. Introduction of exotic species. Regulated under applicable laws.
26. Establishment of large- scale commercial livestock and poultry farms by firms, corporate and companies.
Regulated as per applicable laws except for meeting local needs.
27. Open Well, Bore Well, etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following,namely:- S. (ii) A representative of Non-governmental Organisation working in the field of environment to be nominated by the State Government Member;
(iii) Regional Executive Engineer of State Pollution Control Board Member;

(v) A representative of State Biodiversity Board Member;
(vi) An expert in the area of Ecology and Environment to be nominated by the State Government Member;
(vii) Divisional Forest Officer(Wildlife), Kullu Member;
(viii) Divisional Forest Officer, Kullu Member Secretary.
6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended as Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
Additional Measures.-The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
