शि.य/ का योग करते Aए, उ;र दशे राhय म( बखीरा प7ी अभयार=य क% सीमा के चार/ ओर 1 �कलोमीटर तक के 7े$ को बखीरा प7ी अभयार=य पा"रि>थितक% संवेदी जोन (िजस े इसम( इसके पkात् पा"रि>थितक% संवेदी जोन कहा गया ह)ै के �प म( अिधसूिचत करती ह,ै िजसका िववरण िनnानुसार हM, अथा�त्:- 1. पा�रि�थितक� पा�रि�थितक� पा�रि�थितक� पा�रि�थितक� सवेंदीसवेंदीसवेंदीसवेंदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर उसक�उसक�उसक�उसक� सीमाएंसीमाएंसीमाएंसीमाएं--(1) पा"रि>थितक% संवेदी जोन 35.46 वग� �कलोमीटर के 7े$ म( िव>तृत होगा िजसका िव>तार बखीरा प7ी अभयार=य, जो उ;र दशे के संत कबीर नगर िजले म( ि>थत ह,ै उसक% सीमा के चारो ओर 1 �कलोमीटर तक ह ै(26° 54' 26. 91'' उ;र अ7ांश से 83° 8' 55. 75'' पूवr दशेांतर) ह।ै (2) बखीरा वgयजीव अभयार=य और इसके पा"रि>थितक% संवेदी जोन क% सीमा का िववरण उपाबंध उपाबंध उपाबंध उपाबंध IIII के �प म( उपाबd ह।ै (3) भ-ूिनदtशांक/ के साथ और पा"रि>थितक% संवेदी जोन सीमा का सीमाकंन करने वाला और बखीरा प7ी अभयार=य का मानिच$ और भिूम उपयोग पैटन� उपाबंध उपाबंध उपाबंध उपाबंध IIIIIIII कककक और गगगग के �प म( उपाबd ह ै। (4) बखीरा प7ी अभयार=य क% सीमा और पा"रि>थितक% संवेदी जोन के भ-ूिनदtशांक/ क% सूची उपाबंध उपाबंध उपाबंध उपाबंध IIIIIIIIIIII क% सारणी क और ख के म( दी गई ह ै। (5) मुCय Uबंदuु के भू-िनदtशाकं/ के साथ पा"रि>थितक% संवेदी जोन के अंतग�त आने वाले Nाम/ क% सूची उपाबंध उपाबंध उपाबंध उपाबंध IVIVIVIV के �प म( उपाबd ह।ै 2222.... पा�रि�थितक� संवेदीपा�रि�थितक� संवेदीपा�रि�थितक� संवेदीपा�रि�थितक� संवेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आंचिलकआंचिलकआंचिलकआंचिलक महायोजनामहायोजनामहायोजनामहायोजना –––– राhय सरकार, पा"रि>थितक% संवेदी जोन के योजन के िलए राजप$ म( इस अिधसूचना के अंितम काशन क% तारीख से दो वष� क% अविध के भीतर, >थानीय -ि.य/ के परामश� से और राhय के स7म ािधकारी के अनुमोदन के िलए इस अिधसूचना म( संलv अनुबंध/ के सामंज>य से आंचिलक महायोजना तैयार करेगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 (2) पा"रि>थितक% संवेदी जोन के िलए आंचिलक महायोजना, राhय सरकार 'ारा इस अिधसूचना म( िविन_द�̀ �प म( ऐसी रीित म( तथा सुसंगत क( Iीय और राhय िविधय/ के तथा क( Iीय सरकार 'ारा जारी माग�दश�क िसdांत/, य�द कोई ह/, के सामंज>य स ेतैयार क% जाएगी। (3) आंचिलक महायोजना, उ. योजना म( पया�वरणीय और पा"रि>थितक% बात/ को समाकिलत करने के िलए राhय के िनnिलिखत िवभाग/ के परामश� से तैयार होगी, अथा�त्:- (i) पया�वरण; (ii) वन; (iii) शहरी िवकास; (iv) पय�टन; (v) नगरपािलका; (vi) राज> व; (vii) कृिष; (viii) उ;र दशे राh य दषूण िनयं$ण बोड�; (ix) Uसंचाई; और (x) लोक िनमा�ण िवभाग । (4) आंचिलक महायोजना अनुमो�दत िवaमान भ-ूउपयोग, अवसंरचना और �Oयाकलाप/ पर कोई िनबyधन अिधरोिपत नह4 करेगी जब तक �क इस अिधसूचना म( िविन_द�̀ न �कया जाए और उ. आंचिलक महायोजना म( सभी अवसंरचना और काय� कलाप/ म( द7ता और पा"रि>थितक%य अनुकूलता का सुधार करेगी । (5) आंचिलक महायोजना म( अनाzछा�दत 7े$/ के जीणbdार, िवaमान जल िनकाय/ के संर7ण, आवाह 7े$/ के बंधन, जल-संभर/ के बंधन, भू जल के बंधन, मदृा और नमी संर7ण, >थानीय समुदाय/ क% आवeयकताu तथा पा"रि>थितक% और पया�वरण से संबंिधत ऐस ेअgय पहलuू, िजन पर |यान दनेा आवeयक ह,ै के िलए उपबंध ह/गे । (6) आंचिलक महायोजना सभी िवaमान पूजा > थल/, Nाम/ और नगरीय बंदोब>त/, वन/ के कार और �क>म/, कृिष 7े$/, ऊपजाऊ भूिम, ह"रत 7े$ जैसे उaान और उसी कार के > थान, उaान कृिष 7े$, फलोउaान, झील/ और अgय जल िनकाय/ का तथा समथ�क मानिच$ के साथ अ}यकंन करेगी और इस योजना के मानिच$ के साथ िवaमान और >तािवत भूिम उपयोग िवशेषताu का िववरण संलv होगा । (7) आंचिलक महायोजना >थानीय समुदाय/ क% जीवकोपाज�न को सुिनिkत करने के िलए, पा"रि>थितक% संवेदी जोन म( िवकास को पा"रि>थितक% अनुकूल िवकास के िलए पैरा 4 क% सारणी म( सूची बd िविनयिमत करेगी और अिधसूचना म( िविन_द�̀ ितिषd, िविनयम और संव~ध�त �Oयाकलाप/ का अनुसरण करेगी। (8) आंचिलक महायोजना 7े$ीय िवकास योजना के साथ सह-अंतक होगी । (9) आंचिलक महायोजना पा"रि>थितक% संवेदी जोन म( िवकास को िविनयिमत करेगी िजससे पा"रि>थितक% अनुकूल िवकास >थानीय समुदाय/ क% जीवकोपाज�न सुर7ा के िलए सुिनिkत �कया जा सके । (10) आंचिलक महायोजना इस अिधसूचना म( �दए गए उपबंध/ के अनुसार म( अपने कृ:य/ का पालन करने के िलए िनगरानी सिमित के िलए एक संदभ� द>तावेज इस कार अनुमो�दत करेगी। 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार !ारा!ारा!ारा!ारा कए कए कए कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय-------- राhय सरकार इस अिधसूचना के उपबंध/ को भावी करने के िलए िनnिलिखत उपाय करेगी, अथा�त्:-- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (1) भूभभूूभू----उपयोग. उपयोग. उपयोग. उपयोग. –––– (क) पा"रि>थितक% संवेदी जोन म( वन/, उaान-कृिष 7े$/, कृिष 7े$/, आमोद- मोद के योजन/ के िलए िचिgहत �कए गए पाक� और खुले >थान/ का वािणिhयक या मुCय िनवािसय प"रसर या औaोिगक संबd िवकास �Oयाकलाप/ के िलए उपयोग या संप"रवत�न नह4 होगा: परंतु पा"रि>थितक% संवेदी जोन के भीतर भाग (क) म( िविन_द�̀ योजन से िभ� योजन के िलए कृिष और अgय भिूम का संप"रवत�न, मानीटरी सिमित क% िसफा"रश पर और यथा लागू और 7े$ीय नगर योजना अिधिनयम तथा केgIीय/राhय सरकार के अgय िनयम/ तथा िविनयम/ के अधीन स7म ािधकारी के पूव� अनुमोदन से, तथा इस अिधसूचना के उपबंध/ 'ारा >थानीय िनवािसय/ क% िनnिलिखत आवासीय ज�रत/ को पूरा करने के िलए अनु�ात �कया जाएगा, जैस े�क:- (i) पा"रि>थितक% अनुकूल पय�टन �Oयाकलाप/ से संबंिधत पय�टक/ के अ>थायी अिधभोग के िलए पा"रि>थितक% अनुकूल कुटीर जैसे टMट, का� गृह; (ii) िवaमान सड़क/ को चौड़ा करना, उgह( सुदढृ करना और नई सड़क/ का सिंनमा�ण; (iii) कुटीर, उaोग िजसके अंतग�त Nामीण उaोग हM; सिुवधाजनक भ=डार और >थानीय सिुवधाu; (iv) वषा� जल संचय; और (v) दषूण उ:प� न करने वाले लघ ुउaोग, (vi) संव~ध�त �Oयाकलाप और पैरा 4 के अधीन �दया गया ह:ै परंतु यह और भी �क 7े$ीय नगर योजना अिधिनयम और राhय सरकार के अgय िनयम/ और िविनयम/ के अधीन स7म ािधकारी के पूव� अनुमोदन तथा संिवधान के अनुzछेद 244 और त:समय वृ; िविध के उपबंध/ के अनुपालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अgय परंपरागत वन िनवासी (वन अिधकार/ क% माgयता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिhयक या उaोग िवकास �Oयाकलाप/ के िलए जनजातीय भूिम का उपयोग अनु�ात नह4 होगा: परंतु यह और भी �क पा"रि>थितक% संवेदी जोन के भीतर भ-ूअिभलेख/ म( उपसंजात कोई $ु"ट, िनगरानी सिमित के िवचार ा< करने के पkात् राhय सरकार 'ारा :येक मामल ेम( एक बार संशोिधत होगी और उ. $ुटी के संशोधन क% सचूना क( Iीय सरकार के पया�वरण, वन और जलवायु प"रवत�न मं$ालय को दनेी होगी। परंतु यह और भी �क उपयु�. $ु"ट का संशोधन म( इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म( भू-उपयोग का प"रवत�न सिXमिलत नह4 होगा; (ख) वनरोपन तथा ाकृितक आवास पुनः[धार �Oयाकलाप/ के साथ अनु यु. या अनु:पादक कृिष 7े$/ म( पुन: वनीकरण के यास �कए जाएंगे। ((((2222)))) #ाकृितक जल &ोत#ाकृितक जल &ोत#ाकृितक जल &ोत#ाकृितक जल &ोत - आचंिलक महायोजना म( सभी ाकृितक जल �ोत/ क% पहचान क% जाएगी और उनके संर7ण और पुनन�वीकरण के िलए योजना सिXमिलत होगी राhय सरकार 'ारा ऐसे 7े$/ या उनके िनकट िवकास �Oयाकलाप/ जो ऐसे 7े$/ के िलए हािनकारक ह,ै को ितिषd करने के िलए ऐसी रीित से माग�दश�क िसdांत तैयार करेगा। (3) पय टनपय टनपय टनपय टन....–––– (क) पा"रि>थितक% संवेदी जोन के भीतर सभी नए पा"रि>थितक% पय�टन �Oयाकलाप या िवaमान पय�टन �Oयाकलाप/ का िव>तार पय�टन महायोजना के अनुसार पा"रि>थितक% संवेदी जोन के िलए होगा । (ख) पय�टन महायोजना पय�टन िवभाग, 'ारा राhय पया�वरण िवभाग और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के �प म( होगी । (घ) पा"रि>थितक% पय�टन संबंधी �Oयाकलाप िनnानुसार िविनयिमत ह/गे, अथा�त् :- (i) वgयजीव अभयार=य क% सीमा से एक �कलोमीटर के भीतर या पा"रि>थितक% संवेदी जोन के िव>तार तक, इनम( जो भी िनकट ह,ै नये वािणिhयक होटल और "रसोट� अनु�ात नह4 ह/गे। तथािप, वgयजीव अभयार=य क% सीमा से ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 एक �कलोमीटर क% दरूी से परे पा"रि>थितक% संवेदी जोन के िव>तार तक नये होटल/ और सैरगाह/ का >थापन केवल पूव� प"रिनिkत और पदािभिहत 7े$/ म( पय�टन महायोजना के अनुसार पा"रि>थितक% पय�टन सुिवधाu के िलए ही अनु�ात होगा; (ii) पा"रि>थितक% संवेदी जोन के भीतर नए पय�टन �Oयाकलाप/ या िवaमान पय�टन �Oयाकलाप/ का िव>तार क( Iीय सरकार के पया�वरण, वन और जलवायु प"रवत�न मं$ालय के 'ारा जारी माग�दश�क िसdांत/ तथा रा�ीय -ा� सरं7ण ािधकरण, 'ारा माग�दश�क िसdांत/ (समय-समय पर यथा सशंोिधत) के अनुसार, पा"रि>थितक% पय�टन, पर जोर देते Aए के अनुसार होगा; (ख) खनन सं34याएं, माननीय उ5तम 6यायालय क� 7रट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबम$न िथ:मूलपाद बनाम भारत सरकार के मामले म� आदेश तारीख 4.8.2006 और 7रट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामले म� तारीख 21.04.2014 के अंत7रम आदेश के अनुसरण म� सव$दा =चालन होगा । 2. आरा मील� क� �थापना । पा7रि�थितक� संवेदी जोन के भीतर नई और िव�मान आरा मील� का िव� तार अनुAात नह2 होगा । 3. 3कसी प7रसंकटमय पदाथC का उपयोग या उ पादन या =3कया। लागू िविधय� के अनुसार =ितिषE (अ6 यथा उपबंिधत के िसवाय) ह�गे। 4. =दषूण (जल या वायु या मृदा या H विन) का7रत करने वाले उ�ोग� क� � थापना । पा7रि�थितक� संवेदी जोन म� नए उ�ोग और उ�ोग� म� िव�मान =दषूण का िव�तार अनुAा नह2 होगी। फरवरी, 2016 म� जब तक 3क इस =कार अिधसूचना म� िविनNद$O न हो, क� Pीय =दषूण िनयंQण बोड$ Rारा जारी 3दशािनदSश� म� उ�ोग� के वगTकरण के अनुसार पा7रि�थितक� संवेदी जोन के भीतर केवल गैर- =दषूण उ�ोग� को अनुAात 3कया जाएगा इसके अित7रU कुटीर उ�ोग� को बढ़ावा 3दया जाएगा। 5. बृहत जल िव�ुत प7रयोजना� का �थापन । लागू िविधय� के अनुसार =ितिषE (अ6 यथा उपबंिधत के िसवाय) । 6. जलावन लकड़ी का वािणि�यक उपयोग। लागू िविधय� के अनुसार =ितिषE (अ6 यथा उपबंिधत के िसवाय) । 7. =ाकृितक जल िनकाय� या भूिम XेQ म� अनुपचा7रत बिहYाव� का िन�सारण । लागू िविधय� के अनुसार =ितिषE (अ6 यथा उपबंिधत के िसवाय) ह�गे। 8. Zलाि�टक बैग� का उपयोग । लागू िविधय� के अनुसार =ितिषE (अ6 यथा उपबंिधत के िसवाय) ह�गे। 9. -ट भ[� क� �थापना करना। लागू िविधय� के अनुसार =ितिषE (अ6 यथा उपबंिधत के िसवाय) ह�गे। ख. िविनयिमत ��याकलापख. िविनयिमत ��याकलापख. िविनयिमत ��याकलापख. िविनयिमत ��याकलाप 10. होटल� और 7रसोटC क� वािणि�यक �थापना । पा7रि�थितक� पय$टन 34याकलाप� संबंधी लघु अ�थायी संरचना� के िलए संरिXत XेQ क� सीमा से एक 3कलोमीटर भीतर या पा7रि�थितक� संवेदी जोन के िव�तार तक, इनम� जो भी िनकट है, नए वािणि�यक होटल और 7रसोट$ अनुAात नह2 ह�गे। परंतु, संरिXत XेQ क� सीमा से 1 3कलोमीटर के बहार या पा7रि�थितक� संवेदी जोन के िव�तार तक, जो भी िनकट हो, सभी 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] नए पय$टन 34याकलाप या िव�मान 34याकलाप� का िव�तार पय$टन महायोजना और यथा लागू माग$दश$क िसEांत� के अनु:प होगा । 11. संिनमा$ण 34याकलाप । (क) संरिXत XेQ क� सीमा से एक 3कलोमीटर के भीतर या पा7रि�थितक� संवेदी जोन के िव�तार तक जो भी िनकट हो, 3कसी भी =कार का वािणि�यक संिनमा$ण अनुAात नह2 3कया जाएगा: परंतु � थानीय ^िUय� को पैरा 3 के उप पैरा (1) म� सूचीबE 34याकलाप� सिहत उनके उपयोग के िलए उनक� भूिम म� �थानीय िनवािसय� क� आवासीय आव�यकता� को पूरा करने िलए संिनमा$ण करने क� अनुमित भवन उपिविधय� के अनुसार दी जाएगी । (i) िव�मान सड़क� को चौड़ा करना और उ6ह� सुदढृ करना तथा नई सड़क� का संिनमा$ण; (ii) बुिनयादी ढांच� और नाग7रक सुख-सुिवधा� का संिनमा$ण और नवीकरण; (iii) फरवरी, 2016 म� क� Pीय =दषूण िनयंQण बोड$ Rारा 3कए गए वगTकरण के अनुसार प7रभािषत गैर- =दषूणकारी लघु उ�ोग; (iv) कुटीर उ�ोग� िजनके अंतग$त aामीण उ�ोग हb; सुिवधा भcडार और �थानीय सुख सुिवधा� जो पा7रि�थितक� पय$टन म� िजस म� aह वास भी ह ैसहायक हो; और (v) इस अिधसूचना म� सूचीबE संव$िधत 34याकलाप क� सूची : पर6तु ऐसे लघु उ�ोग� जो =दषूण उ प6 न नह2 करते हb, से संबंिधत संिनमा$ण 34याकलाप िविनयिमत 3कए जाएंगे और लागू िनयम� और िविनयम�, य3द कोई ह�, के अनुसार सXम =ािधकारी क� पूव$ अनुमित से ही 6 यूनतम पर रखे जाएंगे । (ख) एक 3कलोमीटर से आगे आंचिलक महायोजना के अनुसार िविनयिमत ह�गे । 12. =दषूण उ पf न करने वाले लघु उ�ोग । फरवरी, 2016 म� के6Pीय =दषूण बोड$ Rारा जारी उ�ोग� के वगTकरण के अनुसार गैर-=दषूणकारी उ�ोग और अप7रसंकटमय लघु और सेवा उ�ोग, कृिष, पुgप कृिष, कृिष उ�ान, कृिष आधा7रत उ�ोग जो पा7रि�थितक� संवेदी जोन से देशी सामिaय� से बने उ पाद� का उ पादन करते हb, सXम =ािधकारी Rारा अनुAात ह�गे। 13. वृX� क� कटाई । (क) रा�य सरकार म� सXम =ािधकारी क� पूव$ अनुAा के िबना सरकारी या राज�व या िनजी भूिम पर या वन� म� hकंही वृX� क� कटाई नह2 होगी । (ख) वृX� क� कटाई संबंिधत क� Pीय या रा�य अिधिनयम या उसके अधीन बनाए गए िनयम� के उपबंध के अनुसार िविनयिमत होगी । 14. वन उ पाद� और गैर काg ठ वन उ पाद� (एन एफ पी) का संaहण । लागू िविधय� के अधीन िविनयिमत ह�गे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 15. िव�ुत केबल� और दरूसंचार टावर� का प7रिनमा$ण और केबल� के िबछाए जाने और अ6य बुिनयादी ढांचे । लागू िविधय� के अधीन िविनयिमत ह�गे । भूिमगत केबल के िबछाए जाने को बढ़ावा 3दया जाएगा। 16. नाग7रक सुख-सुिवधा� सिहत बुिनयादी ढांचे। लागू िविधय� िनयम� और िविनयम� और उपलkध माग$दश$क िसEांत� के अनुसार 6यूनीकरण उपाय� के साथ िविनयिमत 3कए जाएंगे। 17. िव�मान सड़क� को चौड़ा करना और उ6ह� सुदढृ करना और नई सड़क� का संिनमा$ण। लागू िविधय� िनयम� और िविनयम� और उपलkध माग$दश$क िसEांत� के अनुसार 6यूनीकरण क� उपाय� के साथ िविनयिमत 3कए जाएंगे। 18. पय$टन से संबंिधत 34याकलाप जैसे गम$ वायु गुkबार�, हेलीकाZटर, lोन, माइ4ोलाइटस और अ6य पय$टन 34याकलाप आ3द Rारा पा7रि�थितक� संवेदी जोन XेQ के ऊपर से उड़ना जैसे 34याकलाप करना। लागू िविधय� के अधीन िविनयिमत ह�गे ।

Apart from birds, the Sanctuary has a variety of trees, shrubs, hydrophytes. About 40,000 birds belonging to about 30 species have been recorded during winters. The important birds visiting in this sanctuary are great crested grebe (Podiceps cristatus), little grebe (Podiceps ruficolis), large cormorant (Phalacrocorax carbo), Indian shag (Phalacrocorax fuscicollis), darter (Anhinga rufa), grey heron (Ardea cinerea), purple heron (Ardea purpurea), little green heron (Ardecia striatus), pond heron (Ardecia grayii), little egret (Egretta garzetta), night heron (Nyctcorex nycticorax), little bittern (Ixobrychus minutus), black bittern (Ixobrychus flavicolis), painted stork (Mycteria leucocephala), openbilled stork (Anastomus oscitans), black stork (Ciconia nigra), blacknecked stork (Ephippor hynchus asiaticus), white Ibis (Threskiornis aethiopica), bar headed goose (Aser indicus), lesser whistling teal (Dendrocygna javanica), brahminy duck (Tadorma ferruginea), pintail (Tadorna ferruginea), shoveller (Anas clypeata), red crested pochard (Netta rufina), tuffed duck (Aythya fuligula), cotton teal (Nettapus coromandelianus), comb duck (Sarkidiornis melanotos), black winged kite (Elanus caeruleus), black crested baza (Avicedia leuphotes), black kite (Milvus migrans migrans), goshawk (Accipiter gentilis), sparrow hawk (Accipiter nisus melaschistas), white eyed buzzard (Butastur teesa), tawny eagle (Aquila rapax vindhiana), great spotted eagle (Auila clanga), Indian griffon (Gyps fulvus), hen harrier (Circus cyaneus), etc. have been recorded in the sanctuary; AND WHEREAS, the flora of this area is represented by semi-arid vegetation and a typical aquatic vegetation of the lake in plains of North India. The Bakhira Lake supports a variety of aquatic plants typical to the upper Gangetic system. It includes patera cultail (Typha latifolia), patera (Typha angustifolia), ban reed (Sparganium fluctans), pond weed (Potamageton filiformis varborealis), pond weed (Potamageton caplillaceas), horned pond weed (Zalihichellia palustris), bushy pond weed (Najas minor), limnophyton (Limnophyton obtusifolium), arrow head duck potato (Sagittiaria gigayanensis), water plantain (Alisma plantagoaquatica), wild celery (Vallisneria americana), tape grass (Vallisneria spiralis), frogbit (Limnobium spongia), bahma grass (Cynodon dactylon), wild rice (Zizania aquatic), kans (Saccharum spontaneum), love grass (Eragrastic hypnoides), fox tail (Alopecurus aequalis), etc; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Bakhira Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone. NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent upto one kilometers around the boundary of the Bakhira Bird Sanctuary in the State of Uttar Pradesh as the Bakhira Bird Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall spread over an area of 35.46 square kilometres, the extent of which shall be one kilometre uniform around the boundary of the Bakhira Bird Sanctuary situated in the Sant Kabir Nagar district (260 54' 26.91" N Latitude 830 8' 55.75" E Longitude) of Uttar Pradesh.
(2) The boundary description of Bakhira Bird Sanctuary and its Eco-sensitive Zone is given in Annexure-I.
(3) The map of the Bakhira Bird Sanctuary demarcating the Eco-sensitive Zone boundary and landuse pattern along with geo co-ordinates is appended in Annexure – IIA, Annexure – IIB and Annexure – IIC.
(4) The list of geo-coordinates of the boundary of Bakhira Bird Sanctuary and its Eco-sensitive Zone are given in table A and B of Annexure-III.
(5) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority of State.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan, namely:-
(i) Environment;
(ii) Forest,
(iii) Urban Development,
(iv) Tourism,
(v) Municipal,
(vi) Revenue,
(vii) Agriculture,
(viii) Uttar Pradesh State Pollution Control Board,
(ix) Irrigation, and
(x) Public Works Department,
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The said Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities.
(10) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for ecofriendly tourism activities;
(ii) widening and strengthening of existing roads and construction of new roads; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21
(iii) cottage industries including village industries, convenience stores and local amenities:
(iv) rainwater harvesting;
(v) small scale industries not causing pollution and
(vi) promoted activities given under para 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within one kilometre from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer. However, beyond the distance of one kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste. – Bio medical waste management shall be as under:-
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28 th March, 2016.
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.
(11) Plastic Waste Management. - The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.
(13) E-waste. - The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution. - Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units. – (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, nonpolluting cottage industries shall be promoted.
(17) Protection of Hill Slopes. - The protection of hill slopes shall be as under:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S No Activity Description
(1) (2) (3) A. Prohibited Activities
1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
4. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted. Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
5. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
8. Use of polythene bags. Prohibited (except as otherwise provided) as per applicable laws.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities
10. Commercial establishment of hotels No new commercial hotels and resorts shall be permitted within one 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] and resorts. kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including homestays; and
(v) Promoted activities listed in this Notification:
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
12. Small scale nonpolluting industries. Nonpolluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
13. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.
14. Collection of Forest produce or Non-Timber Forest Produce (NTFP). Regulated as per applicable laws.
15. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated as per applicable law. Underground cabling may be promoted. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25
16. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
17. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18. Undertaking other activities related to tourism like over flying the ESZ area by hot air balloon, helicopter, drones, Microlites, etc. Regulated as per applicable laws.
19. Protection of Hill Slopes and river banks. Regulated as per applicable laws.
20. Movement of vehicular traffic at night. Regulated for commercial purpose as per applicable laws.
21. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals.
22. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies. Regulated as per applicable laws.
23. Discharge of treated waste water/effluents in natural water bodies or land area. The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
24. Commercial extraction of surface and ground water. Regulated as per applicable laws.
25. Open Well, Bore Well etc. for agriculture or other usage Regulated and the activity should be strictly monitored by the appropriate authority.
26. Solid Waste Management. Regulated as per applicable laws.
27. Introduction of Exotic species. Regulated as per applicable laws.

4. Monitoring Committee.- The Central Government constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:-
(a) District Magistrate, Sant Kabir Nagar Chairman
(b) Superintendent of Police/ Senior Superintendent of Police, Sant Kabir Nagar Uttar Pradesh Member;
(c) Executive Engineer of Public Works Department, Sant Kabir Nagar Uttar Pradesh Member;
(d) Executive Engineer of Irrigation Department, Sant Kabir Nagar Member;
(e) One representative of a Non Governmental Organization (NGO) working in the field of environment (including heritage conservation) to be nominated by the Government of Uttar Pradesh for a period of one year Member;
(f) One expert in the area of ecology from reputed Institution or University of the State of Uttar Pradesh to be nominated by the Government of Uttar Pradesh for a period of one year Member;
(g) District Agriculture Officer, Sant Kabir Nagar Member;
(h) Wildlife Warden, Endangered Species, UP, Lucknow Member;
(i) Regional Officer, Uttar Pradesh Pollution Control Board, Sant Kabir Nagar Member;
(j) Divisional Director, Social Forestry Division, Sant Kabir Nagar Member-Secretary
5. Terms of Reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment, Forest and Climate Change number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
37. Use of eco-friendly transport. Shall be actively promoted.
38. Skill Development. Shall be actively promoted.
39. Restoration of Degraded Land/ Forests/ Habitat. Shall be actively promoted.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma given in Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
