PART II—Section 3—Sub-section (ii) �ािधकार से �कािशत PUBLISHED BY AUTHORITY पया�वरण , वन और जलवायु प�रवत�न मं�ालय अिधसूचना नई �द�ली, 1 जनवरी, 2020 का.आ. 7(अ).— भारत के राजप�, असाधारण म� भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� अिधसूचना सं. का.आ. 1943(अ), तारीख 11 जून, 2019, %ारा एक &ा'प अिधसूचना &कािशत क� गई थी िजसम� ऐसे सभी -ि.य/ से, िजनके उससे &भािवत होने क� संभावना थी, उस तारीख से, िजसको उ. अिधसूचना म� अ4त5व6 राजप� क� &ितयां जनता को उपल7ध करा दी गई थ8, साठ �दन क� अविध के भीतर आ:ेप और सुझाव आमंि�त �कए गए थे;

और, उ. &ा=प अिधसूचना म� अ4त5व6 राजप� क� &ितयां जनता को तारीख 11 जून, 2019, को उपल7ध करा दी गई थी;

और, उ. &ा'प अिधसूचना के बारे म� -ि.य/ और पणधा�रय/ से &ा? आ:ेप/ और सुझाव/ पर मं�ालय म� िवचार �कए गए थे;

और, अभयारAय उ@र अ:ांश 12.2557º उ से 12.6846º उ और पूव� देशांतर 77.5812º पू से 77.9739º पू के िCथत ह ैऔर यह कृGणिग�र िजला के उ@र पिHमी भाग म� अविCथत ह।ै अभयारAय का कुल भौगोिलक :े� 504.33 वग� �कलोमीटर ह ैऔर होसुर और धम�पुरी वन संभाग/ के चौबीस �रज़व� वन/ म� फैला Qआ ह।ै कुल :े�फल म� से,

493.33 वग� �कलोमीटर कृGणिग�र िजला के देनकनीकोRई तालुक म� िCथत ह ैऔर धम�पुरी िजला के पालाकोड तालुक म� 11 वग� �कलोमीटर म� िCथत ह;ै और, अभयारAय समृS वनCपित और जीवज4तु िविवधता के िलए जाना जाता ह।ै चंू�क, यह कना�टक के बTेरघRा राVीय उWान और कावेरी व4यजीव अभयारAय के िनकटCथ ह,ै अतः संरि:त :े� कई जंगली पशुY के िलए एक आदश� पया�वास के =प म� जाना जाता ह।ै कावेरी उ@र व4यजीव अभयारAय Z[िग�र-नीलिग�र-पूव\ घाट हाथी भू- द]ृय का भाग ह ैऔर यह नीलिग�र-पूव\ घाट हाथी �रज़व� भी ह।ै तिमलनाडु और कना�टक म� फैल ेवन/ िनकटCथ भू-द]ृय व4यजीव/ के िविभT =प/ के िलए एक आदश� वास &दान करता ह;ै और, अभयारAय तिमलनाडु के नीलिग�र पहािड़य/, कना�टक के बांदीपुर-नागरहोल संरि:त :े�, केरल के वायनाड, कना�टक के िबिलिग�ररंगनाथCवामी मं�दर अभयारAय के समीप स_यामंगलम बाघ �रज़व� और धम�पुरी वन संभाग िमि`त भू-भाग से जुड़ा ह;ै और, अभयारAय म� समृS वनCपित और जीवज4तुY क� िविवधता म� समृS ह।ै इसम� पौध/ क� 468 &जाितय/, Cतनधा�रय/ क� 36 &जाितय/, पि:य/ क� 272 &जाितय/ और िततिलय/ क� 172 &जाितयाँ हc िजसम� दलु�भ, Cथािनक और लु?&ाय &जाितयां जैसे िdज़लड ज�ट िगलहरी, फोर-होन�ड एि4टलोप, त�दआु, हाथी, ढोल,े रीछ आ�द शािमल हc। यह िनकटCथ और िमि`त भू-द]ृय व4यजीव/ के &वास म� मदद करता ह ैऔर इसिलए एिशयाई हािथय/, बंगाल बाघ, त�दएु, आ�द जैसे बड़े Cतनधा�रय/ के िलए एक संभािवत गिलयारे के =प म� काय� करता ह।ै व4यजीव/ िवशेषकर हािथय/ क� आवाजाही िविभT सुर:ा और संर:ण उपाय/ के माgयम से ही संभव ह;ै और, अभयारAय म� वनCपित और जीवज4तुY क� बृहत् िविवधता ह।ै वनCपित के उदाहरण/ म� अiलगी मरम (अलंिगयम सालिवफोिलयम), थु�रनजी मरम (अि�बिजया अमारा), क'वागई मरम (अि�बिजया ओडोरा�टिसमा), वेल नगामाराम/वjाली (अनोगीसस लै�टफोिलया), क@ू एलिुमचाई (अटलां�टया मोनोफाइला), कडkपाई मरम (ब�रगटोिनया एकुटा�गुला), अथी मरम (बौिहिनया रेसेमोसा) हc। जीवज4तु के उदाहरण/ म� एिशयन हाथी (एिलफस मैि�समस), मंुजक (मंु�टयाकस मंुतजैक), 7लैक नैkड खरगोश (लेपस नाइ�ीकोिलस), लघु पुmछ वानर (मैकाका रेिडएट), सामा4य लंगरू (से!ोिपथेकस एसपीपी), सामा�य पॉम िसवेट (पैगुमा लावा%टा), चौस8गा मृग (टेटरासेरेस 'ाड�रकोरिनस) शािमल हc;

और, अभयारAय म� प:ी-जीव िविवधता बृहत् और िविवध ह ै अभयारAय म� पि:य/ के कुछ उदाहरण d े nc कोिलन ((ांसोिलनस पॉि�डसा�रयनस), जंगली बुश बटेर (पे*डकुला एिशया�टक), प�टड बुश बटी (पे*डकुला ए�र,ो�र�चा), लाल Cपुरोoल (गलैोपेरिड�स .पैिडिसया), d े जंगली मुरगा (गलैस सोनेराटी), भारतीय मोर (पावो ¹भाग IIµख� ड 3(ii)º भारत का राजप� : असाधारण 3 /0.टेटस), लेसर िpहiCलग कबूतर (ड12ोसी3ा जावािनका), भारतीय Cपॉट-िबलड कबूतर (एनास पॉलीिसलो�र�चा), उ@री शोवेलेर (अनस �लाइपेटा) पाए जाते हc;

और, अभयारAय म� 30 dाम//बिCतय/ के साथ 19 बाड़े शािमल हc और uवालािग�र �रज़व� वन (अभयारAय के पिHमी भाग म� िCथत) म� संपूण� चेTामालम राजCव dाम दि:ण भारत के &मुख हाथी गिलयार/ म� से एक ह;ै और, कावेरी उ@र व4यजीव अभयारAय के चार/ ओर के :े� को, िजसका िवCतार और सीमाएं पा�रिCथितक� पया�वरणीय से पा�रिCथितक� संवेदी जोन के =प म� पैरा 1 म� िविनxद6 हc, जैव िविविधता क� दिृ6 सुरि:त और संरि:त करना और उ. पा�रिCथितक� संवेदी जोन म� उWोग/ या उWोग/ के वगy के &चालन और &संCकरण करने को &ितिषS करना आव]यक ह;ै अतः, अब, के4{ीय सरकार, पया�वरण (संर:ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प�ठत पया�वरण (संर:ण) अिधिनयम, 1986 (1986 का 29) (िजसे इस अिधसूचना म� इसके पHात् पया�वरण अिधिनयम कहा गया ह)ै क� धारा 3 क� उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) %ारा &द@ शि.य/ का &योग करते Qए, कना�टक राuय के िनकटवत\ :े� के अलावा 1 �कलोमीटर (सम'प) के साथ िवCतृत ह ै जहां तिमलनाडु राuय म� कावेरी उ@र व4यजीव अभयारAय क� सीमा के चार/ ओर चेTामलम राजCव dाम म� शू4य और 1.75 �कलोमीटर तक िवCता�रत :े� को कावेरी उ@र व4यजीव अभयारAय पा�रिCथितक�-संवेदी जोन (िजसे इस अिधसूचना म� इसके प] चात् पा�रिCथितक� संवेदी जोन कहा गया ह)ै, के =प म� अिधसूिचत करती ह,ै िजसके िववरण िन|ानुसार ह,ै अथा�त्:-

पा�रि�थितक� संवेदी जोन का िव�तार और सीमा.

-(1) कना�टक राuय के िनकटवत\ :े� के अलावा 1 �कलोमीटर (सम'प) के साथ िवCतृत ह ैजहां कावेरी उ@र व4यजीव अभयारAय क� सीमा के चार/ ओर चेTामलम राजCव dाम म� शू4य और 1.75 �कलोमीटर तक िवCतृत ह।ै पा�रिCथितक� संवेदी जोन का :े�फल 301.934 वग� �कलोमीटर ह।ै

(2) पा�रिCथितक� संवेदी जोन क� सीमा का वण�न उपाबंध-I के =प म� उपाबS ह।ै

(3) पा�रिCथितक� संवेदी जोन का सीमांकन करने वाले संरि:त :े� के मानिच� उपाबंध–IIक से उपाबंध–II ङ म� �दए गए ह।ै

(4) पा�रिCथितक� संवेदी जोन और संरि:त :े� क� सीमा के भू िनद~शांक/ क� सूची उपाबंध III क� सारणी क और ख म� दी गई ह।ै

(5) मु�य iबदYु के भू-िनद~शांक/ के साथ पा�रिCथितक� संवेदी जोन के अंतग�त आने वाल ेdाम/ क� सूची उपाबंध IV के =प म� उपाबS ह।ै

2. पा�रि�थितक� संवेदी जोन के िलए आंचिलक महायोजना–

(1) राuय सरकार, पा�रिCथितक� संवेदी जोन के &योजन/ के िलए राजप� म� इस अिधसूचना के &काशन क� तारीख से दो वष� क� अविध के भीतर, Cथानीय -ि.य/ के परामश� से और राuय के स:म &ािधकारी के अनुमोदन के िलए इस अिधसूचना म� �दए गए अनुबंध/ का पालन करते Qए आंचिलक महायोजना तैयार करेगी।

(2) राuय सरकार %ारा पा�रिCथितक� संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित से जो इस अिधसूचना म� िविनxदG ट �कए गए हc के अनुसार तथा सुसंगत क� {ीय और राu य िविधय/ के अनु'प और क� {ीय सरकार %ारा जारी माग�दश�क िसSांत/, य�द कोई ह/, %ारा तैयार होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(3) आंचिलक महायोजना, उ. योजना म� पा�रिCथितक� और पया�वरणीय बात/ को समाकिलत करने के िलए राu य सरकार के िन|िलिखत िवभाग/ के परामश� से तैयार होगी.-

(i) पया�वरण;

(ii) वन और व4यजीव;

(iii) कृिष;

(iv) राजC व;

(v) नगर िवकास;

(vi) पय�टन;

(vii) dामीण िवकास;

(viii) iसचाई और बाढ़ िनयं�ण;

(ix) नगरपािलका;

(x) पंचायती राज; और

(xi) लोक िन मा�ण िव भाग;

(4) आंचिलक महायोजना अनुमो�दत िवWमान भू-उपयोग, अवसंरचना और ��याकलाप/ पर कोई िनब�धन अिधरोिपत नह8 करेगी जब तक �क इस अिधसूचना म� इस &कार िविनxदG ट न हो और आचंिलक महायोजना सभी अवसंरचना और ��याकलाप/ म�, जो अिधक द:ता और पा�रिCथितक� अनुकूल ह/, का संवध�न करेगी ।

(5) आंचिलक महायोजना म� अनाmछा�दत :े�/ के जीण�Sार, िवWमान जल िनकाय/ के संर:ण, आवाह :े�/ के &बंधन, जल-संभर/ के &बंधन, भूतल जल के &बंधन, मृदा और नमी संर:ण, Cथानीय समुदाय/ क� आव]यकताY तथा पा�रिCथितक� और पया�वरण से संबंिधत ऐसे अ4य पहलYु, िजन पर gयान देना आव]यक ह,ै के िलए उपबंध ह/ग े।

(6) आंचिलक महायोजना िवWमान और &Cतािवत भूिम उपयोग िवशेषताY के 7यौर/ से अनुसम5थत मानिच� के साथ सभी िवWमान पूजा C थल/, dाम/ और नगरीय बिCतय/, वन/ के &कार और �कC म/, कृिष :े�/, ऊपजाऊ भूिम, ह�रत :े� जैसे उWान और उसी &कार के C थान, उWान कृिष :े�, फलोउWान, झील/ और अ4य जल िनकाय/ का अ�यकंन करेगी।

(7) आंचिलक महायोजना पा�रिCथितक� संवेदी जोन म� िवकास को िविनयिमत करेगी और सारणी म� सूचीबS पैरा-4 म� &ितिषS और िविनयिमत ��याकलाप/ का अनुपालन करेगी और C थानीय समुदाय/ क� जीिवका को सुरि:त करने के िलए पा�रिCथितक� अनुकूल िवकास को सुिनिHत और उसक� अिभवृिS भी करेगी।

(8) आंचिलक महायोजना &ादेिशक िवकास योजना क� सह िवCतारी होगी ।

(9) इस &कार अनुमो�दत आंचिलक महायोजना इस अिधसूचना के उपबंध/ के अनुसार मानीटरी के अपने कायy को करने के िलए मानीटर सिमित के िलए एक संदभ� दCतावेज तैयार करेगी ।

रा�य सरकार �ारा �कए जाने वाल ेउपाय.- राuय सरकार इस अिधसूचना के उपबंध/ को &भावी करने के िलए िन|िलिखत उपाय करेगी, अथा�त्:- ¹भाग IIµख� ड 3(ii)º भारत का राजप� : असाधारण 5

(1) भू-उपयोग.– (क) पा�रिCथितक� संवेदी जोन म� वन/, उWान कृिष :े�/, कृिष :े�/, मनोरंजन के &योजन/ के िलए िचि4हत �कए गए पाकy और खुल ेCथान/ का वािणिuयक या आवासीय या औWोिगक संबS िवकास ��याकलाप/ के िलए उपयोग या संप�रवत�न नह8 होगा:

परंतु यह �क पा�रिCथितक� संवेदी जोन के भीतर भाग (क) म� िविनxद6 &योजन/ से िभT &योजन के िलए कृिष और अ4य भूिम का संप�रवत�न मानीटरी सिमित क� िसफा�रश पर और यथा लाग ूऔर :े�ीय नगर योजना अिधिनयम और के4{ीय सरकार या राuय सरकार के अ4य िनयम/ तथा िविनयम/ के अधीन स:म &ािधकारी के पूव� अनुमोदन से, और इस अिधसूचना के उपबंध/ %ारा Cथानीय िनवािसय/ क� िन|िलिखत आवासीय आव]यकताY को पूरा करने के िलए अनु�ात �कया जाएगा, जैसे:-

(i) िवWमान सड़क/ को चौड़ा करना और उ4ह� सुदढ़ृ करना तथा नई सड़क/ का संिनमा�ण;

(ii) बुिनयादी ढांच/ और नाग�रक सुिवधाY का संिनमा�ण और नवीकरण;

(iii) &दषूण उ�पT न करने वाल ेलघु उWोग;

(iv) कुटीर उWोग/ िजनके अंतग�त dामीण उWोग भी हc; सुिवधाजनक भAडार और Cथानीय सुिवधाएं सहायक पा�रिCथितक� पय�टन िजसके अ4तग�त dह वास सि�मिलत ह;ै और

(v) पैरा 4 के अधीन �दए गए संव5धत ��याकलाप:

परंतु यह और �क &ादेिशक नगर योजना अिधिनयम और राuय सरकार के अ4य िनयम/ और िविनयम/ के अधीन स:म &ािधकारी के पूव� अनुमोदन और संिवधान के अनुmछेद 244 के उपबंध/ या त�समय &वृ@ िविध के उपबंध/ के अनुपालन के िबना, िजसके अ4तग�त अनुसूिचत जनजाित और अ4य परंपरागत वन िनवासी (वन अिधकार/ क� मा4यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिuयक या औWोिगक िवकास ��याकलाप/ के िलए जनजातीय भूिम का उपयोग अनु�ात नह8 होगा:

परंतु यह और भी �क पा�रिCथितक� संवेदी जोन के भीतर भू-अिभलेख/ म� उपसंजात कोई गलती, मानीटरी सिमित के िवचार &ा? करने के पHात् राuय सरकार %ारा &�येक मामल ेम� एक बार ठीक होगी और उ. गलती के सुधार क� सूचना क� {ीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय को दी जाएगी:

परंतु यह और भी �क गलती के संशोधन म� इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म� भू- उपयोग का प�रवत�न सि�मिलत नह8 होगा;

(ख) वनीकरण तथा वास जीण�Sार ��याकलाप/ सिहत अन&यु� त या अनु� पादक कृिष :े�/ म� पुन: वनीकरण करने के &यास �कए जाएंग।े

(2) �ाकृितक जल ोत".

- आचंिलक महायोजना म� सभी &ाकृितक जल �ोत//न�दय// जलमागy के आवाह :े�/ क� पहचान क� जाएगी और उनके संर:ण और नवीकरण के िलए योजना सि� मिलत होगी और राu य सरकार %ारा ऐसे :े�/ पर या उनके िनकट िवकास ��याकलाप &ितिषS करने के बारे म� जो ऐसे :े�/ के िलए अिहतकर हो ऐसी रीित से माग�दश�क िसSांत तैयार �कए जाएंगे ।

(3) पय�टन या पा�रि�थितक� पय�टन.- (क) पा�रिCथितक� संवेदी जोन के भीतर सभी नए पा�रिCथितक� पय�टन ��याकलाप या िवWमान पय�टन ��याकलाप/ का िवCतार पय�टन महायोजना के अनुसार पा�रिCथितक� संवेदी जोन के िलए होगा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) पा�रिCथितक� पय�टन महायोजना राuय पय�टन िवभाग %ारा राuय पया�वरण और वन िवभाग के परामश� से तैयार होगी। (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के =प म� होगी। (घ) पय�टन महायोजना पा�रिCथितक� संवेदी जोन क� वहन :मता के आधार पर तैयार क� जाएगी। (ङ) पा�रिCथितक� पय�टन संबंधी ��याकलाप िन|ानुसार िविनयिमत ह/ग:े-

(i) व�यजीव अभयार5य क� सीमा से एक �कलोमीटर के भीतर या पा�रिCथितक� संवेदी जोन के िवCतार तक, इनम� जो भी िनकट ह,ै नये वािणिuयक होटल और �रजॉट� के सिTमा�ण अनु�ात नह8 ह/ग:े परंतु, यह �क व�यजीव अभयार5य क� सीमा से एक �कलोमीटर क� दरूी से परे पा�रिCथितक� संवेदी जोन के िवCतार तक होटल/ और �रजॉट� का Cथापना केवल पूव� प�रभािषत और नामिनxद6 :े�/ म� पय�टन महायोजना के अनुसार पा�रिCथितक� पय�टन सुिवधाY के िलए ही अनु�ात होगा;

(ii) पा�रिCथितक� संवेदी जोन के भीतर नए पय�टन ��याकलाप/ या िवWमान पय�टन ��याकलाप/ का िवCतार क� {ीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय के माग�दश�क िसSांत/ के %ारा तथा राG �ीय p या� संर:ण &ािधकरण, %ारा जारी पा�रिCथितक�–पय�टन, पा�रिCथितक�-िश:ा और पा�रिCथितक�-िवकास पर बल देते Qए (समय- समय पर यथा संशोिधत) जारी माग�दश�क िसSांत/ के अनुसार होगा;

(iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय�टन के िलए िवकास और िवWमान पय�टन ��याकलाप/ के िवCतार को वाCतिवक Cथल िविनxद6 संवी:ा और मानीटरी सिमित क� िसफा�रश पर आधा�रत संबंिधत िविनयामक &ािधकरण/ %ारा अनु�ात �कया जाएगा और पा�रिCथितक� संवेदी जोन के भीतर �कसी नये होटल या �रसोट� या वािणिuयक Cथापना का संिनमा�ण अनु�ात नह8 �कया जायेगा ।

(4) नैस&गक िवरासत.- पा�रिCथितक� संवेदी जोन म� मह�वपूण� नैस5गक िवरासत के सभी Cथल/ जैसे जीन कोश आरि:त :े�, शैल िवरचनाएं, जल &पात/, झरन/, घाटी मागy, उपवन/, गुफाएं, Cथल/, �मण, अ�रोहण, &पात/ आ�द क� पहचान क� जाएगी और िवरासत संर:ण योजना आंचिलक महायोजना के भाग के 'प म� प�रर:ण और संर:ण के िलए तैयार क� जाएगी ।

(5) मानव िन&मत िवरासत � थल.- पा�रिCथितक� संवेदी जोन म� भवन/, संरचनाY, िश�प-त_य, ऐितहािसक, Cथाप�य, स�दय�पूरक और सांCकृितक मह�व के :े�/ क� और उप:े�/ पहचान और उनके संर:ण के िलए िवरासत योजना आंचिलक महायोजना के भाग के 'प म� तैयार क� जाएगी।

(6) ( विन �दषूण .- पया�वरण अिधिनयम के अधीन gविन &दषूण (िविनयमन और िनयं�ण) िनयम, 2000 म� िनयत उपबंध/ के अनुसार म� पा�रिCथितक� संवेदी जोन म� gविन &दषूण के िनयं�ण और िनवारण का अनुपालन �कया जाएगा।

(7) वायु �दषूण.

- पा�रिCथितक� संवेदी जोन म�, वायु &दषूण के िनवारण और िनयं�ण का वायु (&दषूण िनवारण और िनयं�ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम/ के उपबंध/ के अनुसार अनुपालन �कया जाएगा।

(8) बिह ाव का िन�सारण.

- पा�रिCथितक� संवेदी जोन म� उपचा�रत बिह�ाव का िनCसारण, साधारण/ मानक/ के उपबंध/ के अनुसार पया�वरणीय अिधिनयम और उसके अधीन बनाए गए िनयम/ के अधीन आने वाल ेपया�वरणीय &दषूण के िनCसारण के िलए साधारण मानक/ या राuय सरकार %ारा िनयत मानक/, जो भी अिधक कठोर हो, के उपबंध/ के अनुसार होगा। ¹भाग IIµख� ड 3(ii)º भारत का राजप� : असाधारण 7

(9) ठोस अपिश/.- ठोस अपिश6 का िनपटान एवं &बंधन िन|ानुसार �कया जाएगा:- (क) पा�रिCथितक� संवेदी जोन म� ठोस अपिश6 का िनपटान और &बंधन भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अ&ैल, 2016 के तहत &कािशत ठोस अपिश6 &बंधन िनयम, 2016 के उपबंध/ के अनुसार �कया जाएगा। अकाब�िनक पदाथ� का िनपटान पा�रिCथितक� संवेदी जोन से बाहर िचि4हत �कए गए Cथान/ पर पया�वरण-अनुकूल रीित से �कया जाएगा। (ख) पा�रिCथितक� संवेदी जोन म� मा4य &ौWोिग�कय/ )ईएसएम ( का &योग करते Qए िवWमान िनयम/ और िविनयम/ के अनु=प ठोस अपिश6 का सुरि:त और पया�वरण-अनुकूल &बंधन अनु�ात �कया जा सकेगा।

(10) जैव िच�क1सा अपिश2 ट.

- जैव िच�क�सा अपिशG ट का &बंधन िन|ानुसार �कया जाएगा- (क) पा�रिCथितक� संवेदी जोन म� जैव िच�क�सा अपिश6 का िनपटान भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� अिधसूचना सं.सा.का.िन 343 (अ), तारीख 28 माच�, 2016 के अधीन &कािशत जैव िच�क�सा अपिश6 &बंधन िनयम, 2016 के उपबंध/ के अनुसार �कया जाएगा । (ख) पा�रिCथितक� संवदी जोन म� मा4य &ौWोिग�कय/ का &योग करते Qए िवWमान िनयम/ और िविनयम/ के अनु=प जैव-िच�क�सा अपिश6 का सुरि:त और पया�वरण-अनुकूल &बंधन अनु�ात �कया जा सकेगा।

(11) 3लाि�टक अपिश/ �बंधन.- पा�रिCथितक� संवेदी जोन म� kलािCटक अपिश6 &बंध का िनपटान भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� समय-समय पर यथासंशोिधत अिधसूचना सं.सा.का.िन 340(अ), तारीख 18 माच�, 2016 %ारा &कािशत kलािCटक अपिश6 &बंध िनयम, 2016 के उपबंध/ के अनुसार �कया जाएगा।

(12) िनमा�ण और िव(वंस अपिश/ �बंधन.- पा�रिCथितक� संवेदी जोन म� संिनमा�ण और िवgवंस अपिश6 &बंध का िनपटान भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� समय-समय पर यथासंशोिधत अिधसूचना सं.सां.का.िन 317(अ), तारीख 29 माच�, 2016 %ारा &कािशत संिनमा�ण और िवgवंस &बंध िनयम, 2016 के उपबंध/ के अनुसार �कया जाएगा ।

(13) ई–अपिश/.- पा�रिCथितक� संवेदी जोन म� ई–अपिश6 &बंध का िनपटान भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय क� समय-समय पर यथासंशोिधत %ारा &कािशत ई–अपिश6 &बंध िनयम, 2016 के उपबंध/ के अनुसार �कया जाएगा।

(14) यानीय यातायात.- यातायात क� यानीय गितिविधयां आवास के अनुकूल िविनयिमत ह/गी और इस संबंध म� आंचिलक महायोजना म� िवशेष उपबंध सि�मिलत �कए जाएंग े और आंचिलक महायोजना के तैयार होने और राuय सरकार के स:म &ािधकारी %ारा अनुमो�दत होने तक, मानीटरी सिमित सुसंगत अिधिनयम/ और उसके अधीन बनाए गए िनयम/ और िविनयम/ के अनुसार यानीय ��याकलाप/ के अनुपालन को मानीटर करेगी ।

(15) यानीय �दषूण.- लाग ू िविधय/ के अनुपालन म� वाहन &दषूण का िनवारण और िनयं�ण �कया जाएगा। Cवmछक �धन के उपयोग के िलए &यास �कए जाएंगे।

(16) औ5ोिगक इकाईयां.-

(i) राजप� म� इस अिधसूचना के &काशन पर या उसके पHात पा�रिCथितक� संवेदी जोन के भीतर कोई नए &दिूषत उWोग/ क� Cथापना क� अनुमित नह8 दी जाएगी। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(ii) के4{ीय &दषूण िनयं�ण बोड� %ारा फरवरी, 2016 म� जारी माग�दश�क िसSा4त/ म� उWोग/ के वग\करण के अनुसार, जब तक �क अिधसूचना म� इस &कार िविनxद6 न हो; पा�रिCथितक� संवेदी जोन के भीतर केवल गैर- &दषूणकारी उWोग/ को अनु�ात �कया जाएगा और इसके अित�र., गैर &दषूणकारी उWोग/ को बढ़ावा �दया जाएगा।

(17) पहाड़ी ढलान" को संर9ण.- पहाड़ी ढलान/ का संर:ण िन|ानुसार होगा:- (क) आंचिलक महायोजना पहाड़ी ढलान/ पर :े�/ का संकेत होगा जहां �कसी भी संिनमा�ण क� अनुमित नह8 दी जाएगी;

(ख) कटाव के एक उ� िडdी के साथ िवWमान खड़ी पहाड़ी ढलान/ या ढलान/ पर �कसी भी संिनमा�ण क� अनुमित नह8 दी जाएगी ।

4. पा�रि�थितक� संवेदी जोन म: �ितिष; और िविनयिमत �कए जाने वाल े�=याकलाप" क� सूची.- पा�रिCथितक� संवेदी जोन म� सभी ��याकलाप पया�वरण अिधिनयम के उपबंध/ और उसके अधीन बनाए गए िनयम/ िजसके अ4तग�त तटीय िविनयमन जोन अिधसूचना, 2011 और पया�वरणीय &भाव आकलन अिधसूचना, 2006 और अ4य लाग ू िविधयां के िजसम� वन (संर:ण) अिधिनयम, 1980 (1980 का 69), भारतीय वन अिधिनयम, 1927 (1927 का 16), व4यजीव (संर:ण) अिधिनयम, 1972 (1972 का 53) सि�मिलत हc और �कये गये संशोधन/ %ारा शािसत ह/ग ेऔर नीचे दी गई तािलका म� िविनxद6 रीित म� िविनयिमत ह/ग,े अथा�त् :- सारणी =म सं. �=याकलाप वण�न अ. �ितिष; �=याकलाप

2. &दषूण (जल, वायु, मृदा, gविन, आ�द) उ�पन करने वाले उWोग/ क� Cथापना । पा�रिCथितक� संवेदी जोन म� कोई नया उWोग लगाने और वत�मान &दषूणकारी उWोग/ का िवCतार करने क� अनु�ा नह8 होगी:

बृहत जल िवWुत प�रयोजना क� Cथापना । लाग ू िविधय/ के अनुसार &ितिषS (अ4 यथा उपबंिधत के िसवाय) ह/गे ।

�कसी प�रसंकटमय पदाथ� का उपयोग या उ�पादन या &संCकरण। लाग ू िविधय/ के अनुसार &ितिषS (अ4 यथा उपबंिधत के िसवाय) ह/गे ।

&ाकृितक जल िनकाय/ या :े� भूिम म� अनुपचा�रत बिह�ा�व का िनCसारण । लाग ू िविधय/ के अनुसार &ितिषS (अ4 यथा उपबंिधत के िसवाय) ह/गे ।

नई आरा िमल/ क� Cथापना। पा�रिCथितक� संवेदी जोन के भीतर नई और िवWमान आरा िमल/ का िवC तार अनु�ात नह8 होगा ।

�ट भR/ क� Cथापना करना। लाग ू िविधय/ के अनुसार &ितिषS (अ4 यथा उपबंिधत के िसवाय) ह/गे । आ. िविनयिमत �=याकलाप

वािणिuयक होटल/ और �रसोटy क� Cथापना । पा�रिCथितक� पय�टन ��याकलाप/ लघु अCथायी संरचनाY के िसवाय संरि:त :े� क� सीमा से एक �कलोमीटर के भीतर या पा�रिCथितक� संवेदी जोन के िवCतार तक, इनम� जो भी िनकट ह,ै नए वािणिuयक होटल और �रसोटy को अनु�ात नह8 �कया जाएगा:

परंतु यह �क संरि:त :े� क� सीमा से एक �कलोमीटर के परे या पा�रिCथितक� संवेदी जोन के िवCतार तक इनम� से जो भी िनकट हो सभी नए पय�टन ��याकलाप या िवWमान ��याकलाप का िवCतार पय�टन महायोजना और यथा लाग ू माग�दश\ िसSांत/ के अनु'प होगा।

संिनमा�ण ��याकलाप । (क) संरि:त :े� क� सीमा से एक �कलोमीटर के भीतर या पा�रिCथितक� संवेदी जोन के िवCतार तक, इनम� जो भी िनकट हो, �कसी भी &कार के नये वािणिuयक संिनमा�ण क� अनु�ा नह8 होगी:

परंतु यह �क Cथानीय लोग/ को अपनी आवास स�ब4धी िन|िलिखत आव]यकताY को पूरा करने के िलए, पैरा 3 के उप पैरा (1) म� सूचीबS ��याकलाप/ सिहत अपने उपयोग के िलए, अपनी भूिम म� भवन उप-िविधय/ के अनुसार, संिनमा�ण करने क� अनु�ा होगी, जैसे:- परंतु यह �क गरै–&दषूणकारी लघु उWोग/ से संबंिधत 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] संिनमा�ण ��याकलाप लाग ू िनयम/ और िविनयम/, य�द कोई ह/, के अनुसार स:म &ािधकारी क� पूव� अनुमित से िविनयिमत �कए जाएंगे और वे 4यूनतम ह/ग े। (ख) एक �कलोमीटर :े� से परे ये आंचिलक महायोजना के अनुसार िविनयिमत ह/गे ।

&दषूण उ�पT न करने वाल े लघु उWोग । फरवरी, 2016 म� के4{ीय &दषूण िनयं�ण बोड� %ारा जारी उWोग/ म� वग\करण के अनुसार गरै-&दषूणकारी उWोग और अप�रसंकटमय म�, लघु और सेवा उWोग, कृिष, पुGप कृिष, उWान कृिष या पा�रिCथितक� संवेदी जोन से देशी सामdी से उ�पाद/ को उ�पT करने वाले कृिष आधा�रत उWोग स:म &ािधकारी %ारा अनु�ात ह/गे।

11.

वृ:/ क� कटाई । (क) राuय सरकार म� स:म &ािधकारी क� पूव� अनुमित के िबना वन, सरकारी या राजCव या िनजी भूिम पर या वन/ म� वृ:/ क� कटाई नह8 होगी । (ख) वृ:/ क� कटाई संबंिधत क� {ीय या राuय अिधिनयम या उसके अधीन बनाए गए िनयम/ के उपबंध के अनुसार िविनयिमत होगे ।

12.

वन उ�पाद/ या गैर काG ठ वन उ�पाद/ का संdहण । लाग ूिविधय/ के अनुसार िविनयिमत ह/गे ।

13. फमy, कंपिनय/ %ारा बड़े पैमाने पर वािणिuयक पशुY और पो��ी फामy क� Cथापना । लाग ूिविधय/ के अनुसार िविनयिमत ह/गे ।

14.

िवWुत और संचार टावर/ का प�रिनमा�ण और केबल/ के िबछाए जाने और अ4य बुिनयादी ढांचे । लाग ू िविधय/ के अधीन िविनयिमत ह/गे। भूिमगत केबल के िबछाए जाने को बढ़ावा �दया जा सकेगा।

15.

नाग�रक सुख सुिवधाY सिहत अवसंरचनाएं । 4यूनीकरण उपाय/ को लाग ू िविधय/, िनयम/ और िविनयमन/ और उपल7ध माग�दश�क िसSांत/ के अनुसार �कया जाएगा ।

16.

िवWमान सड़क/ को चौड़ा करना और उ4ह� सुदढ़ृ करना तथा नवीन सड़क/ का संिनमा�ण । 4यूनीकरण उपाय/ को लाग ूिविधय/, िनयम/ और िविनयमन/ तथा उपल7ध माग�दश�क िसSांत/ के अनुसार �कया जाएगा ।

17.

पय�टन से संबंिधत अ4य ��याकलाप जैसे गम� वायु ग7ुबार�, हलेीकाkटर, �ोन, माइ�ोलाइटस आ�द %ारा पा�रिCथितक� संवेदी जोन :े� के ऊपर से उड़ना जैसे ��याकलाप करना। लाग ूिविधय/ के अनुसार िविनयिमत ह/गे ।

18.

पहाड़ी ढाल/ और नदी तट/ का संर:ण लाग ूिविधय/ के अनुसार िविनयिमत ह/गे । ¹भाग IIµख� ड 3(ii)º भारत का राजप� : असाधारण 11 ।

19.

राि� म� यािनक यातायात का संचलन । लाग ू िविधय/ के अधीन वािणिuयक &योजन के िलए िविनयिमत ।

20.

Cथानीय समुदाय/ %ारा चल रही कृिष और बागवानी &थाY के साथ द�ुधशाला, द�ुघ उWोग, कृिष और मछली पालन । Cथानीय लोग/ के उपयोग के िलए लागू िविधय/ के अधीन अनु�ात ।

21.

&ाकृितक जल िनकाय/ या सतही :े� म� उपचा�रत बिह�ा�व का िनCतारण । जल िनकाय/ म� उपचा�रत अपिश6 जल या बिह�ा�व के िनCसारण से बचा जाएगा और उपचा�रत अपिश6 जल के पुन:च�ण और पुन:उपयोग के िलए &यास �कए जाएंग।े अ4यथा लागू िविधय/ के अनुसार उपचा�रत बिह�ा�व के पुनच��ण/&वाह के िनव�हन को िविनयिमत �कया जाएगा।

6. िनद?श–िनबंधन.-

(1) मानीटरी सिमित इस अिधसूचना के उपबंध/ के अनुपालन को मानीटर करेगी।

(2) मानीटरी सिमित का काय�काल तीन वष� तक या राuय सरकार %ारा नई सिमित के पुन: गठन तक के िलए होगा और त�पHात िनगरानी सिमित राuय सरकार %ारा ग�ठत क� जाएगी।

(3) उन ��याकलाप/ क�, जो भारत सरकार के त�कालीन पया�वरण और वन मं�ालय क� अिधसूचना सं�यांक का.आ.

1533 (अ), तारीख 14 िसत�बर, 2006 क� अनुसूची म� सि�मिलत हc, और जो पा�रिCथितक� संवेदी जोन म� आते हc, िसवाय इसके जो पैरा 4 के अधीन सारणी म� यथा िविनxद6 &ितिषS ��याकलाप/ के, मानीटरी सिमित %ारा वाCतिवक िविनxद6 Cथलीय दशाY के आधार पर संवी:ा क� जाएगी और उ. अिधसूचना के उपबंध/ के अधीन पूव� पया�वरण अनापि@ के िलए के{8य सरकार के पया�वरण, वन और जलवायु प�रवत�न मं�ालय को िनxद6 �कया जाएगा।

(4) इस अिधसूचना के पैरा 4 के अधीन सारणी म� यथा िविनxद6 &ितिषS ��याकलाप/ के िसवाय, भारत सरकार के त� कालीन पया�वरण और वन मं�ालय क� अिधसूचना सं�यांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 क� अिधसूचना के अनुसूची के अधीन ऐसे अनुसूची म� ��याकलाप/, िज4ह� सि�मिलत नह8 �कया गया ह,ै परंतु पा�रिCथितक� संवेदी जोन म� आते हc, ऐसे ��याकलाप/ क� वाCतिवक िविनxद6 Cथलीय दशाY पर आधा�रत िनगरानी सिमित %ारा संवी:ा क� जाएगी और उसे संबS िविनयामक &ािधकरण/ को िनxद6 �कया जाएगा ।

(5) मानीटरी सिमित का सदCय-सिचव या संबS उपायु. ऐसे -ि. के िव=S, जो इस अिधसूचना के �कसी उपबंध का उ�लघंन करता ह,ै पया�वरण (संर:ण) अिधिनयम, 1986 क� धारा 19 के अधीन प�रवाद फाइल करने के िलए स:म होगा।

8. कोई अ4 य मह� वपूण� िवषय । ¹भाग IIµख� ड 3(ii)º भारत का राजप� : असाधारण 39 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 1st January, 2020 S.O. 07(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 1943(E), dated the 11 th June, 2019, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 11 th June, 2019;

AND WHEREAS, objections or suggestions received from persons and stakeholders in response to the aforesaid draft notification were considered in the Ministry;

AND WHEREAS, Cauvery North Wildlife Sanctuary (CNWLS) was established vide G.O (MS) No. 30 Environment and Forest Department dated the 24 th February, 2014 and published in the Tamil Nadu Government Gazette notification bulletin No.10 dated the 12 th March, 2014;

AND WHEREAS, the Sanctuary is situated within the North Latitudes of 12.2557º N to 12.6846º N and East Longitudes 77.5812º E to 77.9739º E and is located in the North Western part of Krishnagiri District. The total geographical area of the Sanctuary is 504.33 square kilometers and spreads across twenty four Reserved Forests of Hosur and Dharmapuri Forest Divisions. Out of the total area, 493.33 square kilometres area is located in Denkanikottai taluk of Krishnagiri district and 11 square kilometres is located in Palacode Taluk of Dharmapuri Districts;

AND WHEREAS, the Sanctuary is known for its rich floristic and faunal diversity. Since, it is contiguous with the Bhanerghatta National Park and Cauvery Wildlife Sanctuary of Karnataka, the protected area acts as one of the ideal habitats for many wild animals. The Cauvery North Wildlife Sanctuary is part of the Brahmagiri-Nilgiri- Eastern Ghats Elephant Landscape and it is Nilgiri-Eastern Ghats Elephant Reserve. The contiguous landscape of forests that spread across Tamil Nadu and Karnataka provides an ideal habitat for various forms of wildlife;

AND WHEREAS, the Sanctuary has connectivity to the complex landscapes comprising the Nilgiri hills of Tamil Nadu, Bandipur – Nagarahole Protected Area of Karnataka, Wyanad of Kerala, Biligiriranganathaswamy Temple Sanctuary of Karnataka adjoining the Sathyamangalam Tiger Reserve and Dharmapuri Forest Divisions;

AND WHEREAS, the Sanctuary is rich in floral and faunal diversity. It accounts for 468 species of plants, 36 species of mammals, 272 species of birds and 172 species of butterflies which includes rare, endemic and endangered species such as grizzled giant squirrel, four-horned antelope, leopard, elephants, dhole, sloth bear etc.

This contiguous and complex landscape helps in migration of wildlife and hence serves as a potential corridor for large mammals such as Asian elephants, Bengal tiger, leopard, etc. The movement of wildlife especially elephants can be feasible only through various protection and conservation measures;

AND WHEAREAS, the Sanctuary has wide variety of flora and fauna. Examples of flora are alingi maram (Alangium salvifolium), thurinji maram (Albizzia amara), karuvaagai maram (Albizzia odoratissima), vel nagamaram/ vakkali (Anogeissus latifolia), kattu elumichai (Atlantia monophylla), kaddappai maram (Barringtonia acutangula), athi maram (Bauhinia racemosa). Examples of fauna include Asian elephant (Elephas maximus), barking deer (Muntiacus muntjak), black naped hare (Lepus nigricollis), bonnet Macaque (Macaca radiate), common langur (Semnopithecus spp), common palm civet (Paguma larvata), four horned antelope (Tetraceres quadricornis), etc;

AND WHEAREAS, the avian diversity is wide and varied in the Sanctuary some examples of birds found in the Sanctuary are grey francolin (Francolinus pondicerianus), jungle bush quail (Perdicula asiatica), painted bush quail (Perdicula erythrorhyncha), red spurfowl (Galloperdix spadicea), grey jungle fowl (Gallus sonneratii), Indian peafowl (Pavo cristatus), lesser whistling duck (Dendrocygna javanica), Indian spot-billed duck (Anas poecilorhyncha), northern shoveler (Anas clypeata), etc.;

40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEAREAS, the Sanctuary includes 19 enclosures with 30 villages /hamlets and the entire Chennamalam Revenue village in Jawalagiri Reserved Forest (located in western part of the Sanctuary) is one of the prime elephant corridors of South India;

AND WHEAREAS, it is necessary to conserve and protect the area, the extent and boundaries of Cauvery North Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies that an extent 1 kilometer (uniform) except area adjoining the Karnataka State where it is 0 (zero) and 1.75 kilometer at Chennamalam revenue village around the boundary of Cauvery North Wildlife Sanctuary in the State of Tamil Nadu as the Cauvery North Wildlife Sanctuary as Ecosensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone. -(1) The extent of Eco-sensitive Zone is 1 kilometer (uniform) except area adjoining the Karnataka State where it is 0 (zero) and 1.75 kilometers at Chennamalam revenue village around the Cauvery North Wildlife Sanctuary. The area of the Eco-sensitive Zone is 301.934 square kilometers.

(2) The boundary description of the Eco-sensitive Zone is appended at Annexure-I.

(3) The map of the protected area demarcating the Eco-sensitive Zone boundary is at Annexure – IIA to Annexure - IIE.

(4) List of geo co-ordinates of the boundary of the protected area and the Eco-sensitive Zone is at Table A and B of Annexure - III.

(5) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure - IV.

2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purposes of the Ecosensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority of State.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan.-

(i) Environment,

(ii) Forest and Wildlife,

(iii) Agriculture,

(iv) Revenue,

(v) Urban Development,

(vi) Tourism,

(vii) Rural Development,

(ix) Municipal,

(x) Panchayati Raj, and

(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by the State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given under paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone;

(e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, ecoeducation and eco-development and based on the study of carrying capacity of the Eco-sensitive Zone;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.

(4) Natural heritage.-All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc.

shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.-Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-

(i) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.

(ii) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.

(10) Bio-Medical Waste.–Bio Medical Waste Management shall be as under:-

(i) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28 th March, 2016.

(ii) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic Waste Management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.

(12) Construction and Demolition Waste Management.-The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.

(13) E-waste.-The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic.–The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. 1. Commercial mining, stone quarrying and crushing units.

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for personal consumption;

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs.

UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).

New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:

Provided that, non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.

3. Establishment of major hydroelectric project.

Prohibited (except as otherwise provided) as per the applicable laws.

4. Use or production or processing of any hazardous substance.

Prohibited (except as otherwise provided) as per the applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited (except as otherwise provided) as per the applicable laws.

6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per the applicable laws.

B. Regulated Activities

8. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

9. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

10. Small scale non polluting industries.

Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.

11. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior 46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.

12. Collection of Forest Produce or Non-Timber Forest Produce.

Regulated under applicable laws.

13. Establishment of large scale commercial live stock and poultry farms by firms, corporate, companies.

Regulated under applicable laws.

14. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated under applicable laws. Underground cabling may be promoted.

15. Infrastructure including civic amenities.

Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.

16. Widening and strengthening of existing roads and construction of new roads.

Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.

17. Undertaking other activities related to tourism like over flying the Eco-Sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

Regulated as per the applicable laws.

18. Protection of hill slopes and river banks.

Regulated as per the applicable laws.

19. Movement of vehicular traffic at night.

Regulated for commercial purpose under applicable laws.

20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

Permitted as per the applicable laws for use of locals.

21. Discharge of treated waste water/effluents in natural water bodies or land area.

The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per the applicable laws.

22. Commercial extraction of surface and ground water.

Regulated under applicable law.

23. Open Well, Bore Well etc. for agriculture or other usage.

Regulated under applicable laws and the activity shall be strictly monitored by the concerned authority.

26. Use of polythene bags. Regulated as per the applicable laws.

27. Commercial sign boards and hoardings.

Regulated as per the applicable laws.

28. Religious tourism (i) In temple area occurring as enclosures, all activities which cause noise, air and water pollution may be regulated.

(ii) In other areas also, all activities which cause noise, air and water pollution may be regulated.

(iii) Number, time of visit of pilgrims shall be regulated based on the carrying capacity of the visiting site. The regulations may be relaxed during festival days.

29. Use of Fire Crackers Regulated as per the applicable laws.

30. Charcoal Burning Shall be regulated during the breeding and migratory seasons under the applicable laws.

31. Eco-tourism. Regulated as per the applicable laws.

C. Promoted Activities

32. Rain water harvesting. Shall be actively promoted.

33. Organic farming. Shall be actively promoted.

34. Adoption of green technology for all activities Shall be actively promoted.

35. Cottage industries including village artisans, etc .

Shall be actively promoted.

36. Use of renewable energy and fuels.

Bio-gas, solar light etc. to be actively promoted.

37. Agro-Forestry. Shall be actively promoted.

38. Use of eco-friendly transport. Shall be actively promoted.

39. Skill Development. Shall be actively promoted.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- SI. 8. An expert in Ecology and Environment to be nominated by the State Government Member;

9. A representative from State Public Works Department Member;

10. A representative from State Pollution Control Board Member;

11. Divisional Forest officer, IFF Division, Krishnagiri Member;

12. Tamil Nadu Water Supply and Drainage Board, Krishnagiri District. Member;

13. District Forest Officer, Hosur Forest Division, Hosur Member-Secretary.

6. Terms of reference.–(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to ¹भाग IIµख� ड 3(ii)º भारत का राजप� : असाधारण 49 the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.

C GARKOTI, Scientist ‘G’ ANNEXURE- I BOUNDARY DESCRIPTION OF ECO-SENSITIVE ZONE OF THE PROTECTED AREA North West The Boundary of the proposed Eco-sensitive Zone starts at the North eastern corner of boundary point of Thally Extension Reserve Forest of Jawalgiri Range of Denkanaikottai Taluk, Krishnagiri district. The boundary travels westwards along the northern margin of Thally Extension Reserve Forest reaching the western most boundary point of Thally Reserve Forest along the Karnataka - Tamilnadu Inter-State boundary. Further, travels southwards along the Karnataka - Tamilnadu Inter-State boundary reaching the southernmost boundary point of Thally Reserve Forest. Then it turns eastern direction and meets at the Thally corridor villages of Bilalam and then the line continues in Northern direction near the boundary of Chikka Averahalli village, then it extends along the boundary of Achubalu Revenue village and the line turns towards easterly direction meets the village boundary of Gijanakuppe village, then it turn and extents towards northern direction and meets at Oddarpalayam village, then the line similarly successively meets and continues along the boundaries of Osur, Ganganahalli Villages and finally it meets at the starting point of Thally Extension Reserve Forest.

North The boundary starts at Nellumar Agraharam and extents towards southwards direction of Jawalagiri Reserve Forests. Then it passes through the villages of Anaikarai, Panchumandoddi, Jawalagiri and meets at Maragattadoddi. It further continues through 50 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Kulsandoddi, Thervidi, Nachipalli, Kallubalam, Geragura, Bolarai and it slightly turns towards easterly direction and extents towards the village boundary Pailmandoddi. It further turns towards south direction meets at Kundukottai village and further continue through Arulallam and meets at Gonamakanapalli (Panai Reserve Forest). Further it turns towards northern direction and passes through Sivanapalli, Muchandiram and turns towards easterly direction and meets at Belalam village and then it meets at Melur village (Gullatty Reserve Forest).

The boundary extends towards northern direction and Aiyur, Arasajjur, Kamasandiram, Dibbanur and meets at Thippasandiram village (Aiyur Extension). It further travels northwards and passes through Basavanahalli, Baleguli, Narappanahatti, Gullatti and finally it meets at Lakshmipuram village (Udedurgam Reserve Forest).

North East The boundary starts at Lakshmipuram village, further it extents towards Northeastern direction and passes through Kudur, Gavipuram, U.Puram, Gurubarapalli and meets Pavadarapatti village, then it turns towards southern direction and finally meets at the boundary of Nerupuguttai village (Udedurgam Reserve Forest).

East The boundary starts from Nerupuguttai and extends downwards southern direction and traverse through the village boundaries of Jalathimmahalli, Panchapalli, Eri Panchapalli, Periyanur, Kurumbarkottai, Athimutlu, Agaram, Bemmahalli, Singampatti and ends at Pudur village (Galigattam Reserve Forest).

South East The boundary starts from Pudur village and turns towards westerly direction and meets near Uchikal malai of Morappur Reserved Forest, then it turns towards southern direction and passes through Uchikal malai, Alegettu enclosure, finally it meets near Gutirayan malai in Gutirayan Reserved Forest.

South The boundary starts from Guttirayan Reserved Forests and turns towards western direction and the line passes through Biligundulu Reserve Forest and meets at Sivalingapuram of enclosure village, then it passes through Geratty village boundary and ends at Shesarajapuram village (Anchetty Reserve Forest).

South West The boundary starts from Shesarajapuram villages and extends towards northern direction traverse through Ubrani Reserve Forest and ends at northern boundary of Ubrani Reserve Forest (Anchetty enclosure boundary).

West The boundary passes through Nasi Guddai, villages of Anchetty, Sakalapatti and Mariyalam villages and meets at Hosadoddi village and passes through the boundary line of Ulibanda Reserve Forest. Further the line turns towards the western direction and passes through the villages of Karadikal, Gollapalli, Hosadoddi, Madakkal, Sulakunda, Manjikere and reaches Nandimangalam Revenue village. The boundary further extends towards western direction and meets at Kebbaradoddi village. From there, the boundry further passes along the western boundary of Jawalagiri Reserve Forests.

The boundary further continues along the Western boundary of Chennamalam Village and again passes along the boundary of Jawalagiri Reserve Forests. Further extends northwards and passes through the Thally corridor villages of Kempathpalli, Gurusathappandoddi and finally ends at southernmost boundary of Thally Reserve Forest.
