और, उि प्रारुप अजधसूचना के प्रत्र्ुत्तर में व्यजिर्ों और पणधाररर्ों से प्राप्त आक्षेपों और सुझावों पर मंत्रालर् द्वारा सम्र्क जवचार दकर्ा गर्ा था; और, काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र् और लचीपोरा वन्र्िीव अभर्ारण्र्, कश्मीर प्रांत, िम्मू-कश्मीर में 128.77 वगा दकलोमीटर क्षेत्रफल में फैला हुआ ह;ै स.ं 1288] नई दिल्ली, िुक्रवार, माचा 25, 2022/चतै्र 4, 1944 No. 1288] NEW DELHI, FRIDAY, MARCH 25, 2022/CHAITRA 4, 1944 सी.जी.-डी.एल.-अ.-26032022-234503 CG-DL-E-26032022-234503 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, काज़िनाग राष्ट्रीर् उद्यान, जिसमें 89.00 वगा दकलोमीटर का क्षेत्र िाजमल ह,ै िैसा दक अजधसूजचत दकर्ा गर्ा ह,ै को 18 दिसंबर, 2007 की अजधसूचना संख्र्ा का.जन.आ: 425 द्वारा राष्ट्रीर् उद्यान के रूप में अजधसूजचत दकर्ा गर्ा ह।ै लीम्बर वन्र्िीव अभर्ारण्र् में 12 वगा दकलोमीटर के क्षेत्र को अजधसूजचत दकर्ा गर्ा ह,ै वन्र्िीव अभर्ारण्र् के रूप में का.जन.आ संख्र्ा: 157 तारीख 19 माचा 1987 और लचीपोरा वन्र्िीव अभर्ारण्र् के रूप में अजधसूजचत दकर्ा गर्ा ह,ै जिसमें 80.00 वगा दकलोमीटर का क्षेत्र िाजमल है दकन्तु 52.23 वगा दकलोमीटर को िाजमल करने के पश्चात ्बचे हुए 27.77 वगा दकलोमीटर क्षेत्र को काज़िनाग राष्ट्रीर् उद्यान घोजित करने के जलए वन्र्िीव अभर्ारण्र् के रूप में अजधसूजचत दकर्ा गर्ा ह,ै जिसे का.जन.आ. संख्र्ा: 150 तारीख 19 माचा 1987 द्वारा अजधसूजचत दकर्ा गर्ा ह;ै और, काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र् और लचीपोरा वन्र्िीव अभर्ारण्र् वनस्ट्पजत और िीविंतु की अच्छी िैव-जवजवधता ििााते हुए सबसे महत्त्वपूणा प्राकृजतक जवरासत बनाता ह ै और र्ह के्षत्र पीर पंिल मरखोर (कपरा फलकोनेरी) और स्ट्थाजनक कश्मीर मस्ट्क जडर्र (मोस्ट्र्ूस कूपरेर्ूस) की अंजतम िीवनक्षम िनसंख्र्ा के वास के जलए िाना िाता ह।ै र्ह के्षत्र प्रकृजत प्रेजमर्ों, पक्षी ििाकों, पवातारोजहर्ों, पाररजस्ट्थजत जवज्ञानी, िोधकतााओं और पर्ाटकों के जलए प्राचीन अवस्ट्थान प्रिान करता ह;ै और, के्षत्र का भू-आकृजत जवज्ञान और स्ट्थलाकृजतक के्षत्र ऊंचाई अनुक्रम में िीतोष्ण कोजनफर की मेसोफाइरटक वनस्ट्पजत का आश्रर् प्रिान करता ह ैऔर जवजवध वन के प्रकार, अल्पाइन वासों के हरे-भरे घास के मैिान इस तरह के िैजवक और पाररजस्ट्थजतकी जवरासत के जलए अजधक अद्भुत बनाते ह ैऔर इसजलए, आगामी पीद़िर्ों के जलए इसे संरजक्षत करन ेके जलए वन्र्िीव प्रिाजतर्ों के प्रभावी संरक्षण, सुरक्षा और बेहतर प्रवधान का आह्वान दकर्ा गर्ा; और, काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र् और लचीपोरा वन्र्िीव अभर्ारण्र् िेविार वुड कवर, ब्ल ूपाइन वन, जसल्वर फॅर कनौपी, बृहत-्पत्ती वुडलैंड, बचा वन, आइसोडेन झाडी, सावाना झाडी और अल्पाइन चरागाह के साथ िंकुधारी वनों में िाजमल हैं। के्षत्र में वनस्ट्पजत प्रिाजतर्ों की जवजवधता िैसे िेविार (सेडरस िेविारा), परोरटर्ा (परोरटओजससस िेक्रू्इमोंरटअना), कैल (पाइनस वाल्लीजचना), फर (एजबइस पपंड्रो), स्ट्प्रूस (पीजसर्ा जस्ट्मथीआना), हॉसा चेस्ट्टनट (ऐस्ट्कुलुस इंजडका), वाल्नट (िगलांस रेजगर्ा), अकेर कसपाडोदककम, बेटुला उटीजलस, इंजडगोफेरा हटेेरंथा, वेबरनम ग्ांडीफलोरम, रोसा वेजब्बआना, लोजनकेरा क्रू्इंक्इलोकुलाररस, चीनार (सलैटैनस ओररएंटजलस), िुजनपेरस रेकुवाा, रेहोडोडेंड्रोन एंन्थोगोन, इसोडोन रगोसस, पाइनस जग्जफफथी आदि भी ह;ै और, रो़िसा और पवार (1988) द्वारा िम्मू - कश्मीर संघ राज्र्क्षेत्र के िैव-भौगोजलक सीमांकन के अनुसार काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र्, लचीपोरा वन्र्िीव अभर्ारण्र् और नागानारी संरक्षण रऱिवा जहमालर्न िोन के उत्तर-पजश्चम जहमालर्न प्रांत के अंतगात आत ेह।ै भारत-चीनी रूपों की कई प्रिाजतर्ों की उपजस्ट्थजत से िीविंतु िीवन जवजिष्ट ह।ै िीविंतु तत्व उत्तरी पैजलर्ार्टाक िीविंतु के साथ-साथ पूवी और ओररएंटल िीविंतु के साथ संबंध दिखाते ह,ै िो महान संरक्षण मूल्र् का अद्भुत संर्ोिन बनाते हैं; और, के्षत्र में िलुाभ, संकटापन्न और लुप्तप्रार् िीविंतु प्रिाजतर्ों की बृहत ्जवजवध िैसे एजिर्ाई काला भाल ू(उसास जथबेटानस), जहमालर्न ब्राउन भाल ू (उरसूस आका टोस इसाबेजल्लनस), तेंिआु (पेन्थेरा प्रड्यूस), तेंिआु जबल्ली (जप्ररओनाइलरुूस बेंगालेंजसस), िंगली जबल्ली (फेजलस चाउस), रेड लोमडी (वुल्पेस वुल्पेस), जसर्ार (कैजनस ऑररर्स), र्ेलो- थ्रोटेड मार्टान (मारटेस फलाजवगुला), माउंटेन वेअसेल (मुस्ट्टेला अलटाइका), भारतीर् साही (जहस्ट्रीक्स इंजडका), जहमालर्न ग् े लगंूर (सेम्नाजपथेकस अिाक्स), रीसस मकाक (मकाका मुलाट्टा), जहमालर्न ग् े गोरल (नेमोरहाइडस बेडफोरिी), जहमालर्न पाल्म जसवेट(पागुमा लारवाटा), बनैला सूअर (सस स्ट्क्रोफा), रोर्ल े जपका (ओचोटोना रोर्लेइ), हाउस श्रेव (संुकस मुरीनस), कश्मीर फलाईंग जगलहरी (इओगलाउकोम्र्स दफम्बरीअटस) आदि ह;ै [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 और, काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र्, लचीपोरा वन्र्िीव अभर्ारण्र् में पजक्षर्ों की 120 प्रिाजतर्ों का वास ह ैिो लगभग 36 कुलों का प्रजतजनजधत्व करता ह।ै के्षत्र में पाई िाने वाली पजक्षर्ों की कुछ प्रिाजतर्ां जहमालर्न जग्फॉन (जिससी जहमालर्नजसस), बेअरडेड जगद्ध (गर्पैटस बारबेटस), पजश्चम रागोपन (रागोपन मेलानोकेफलुस) चीर तीतर (कटरेउस वाजल्लची), जहमालर्न मोनल (लोफोफोरूस इम्पेिानस), कोकलास्ट्स तीतर (पुकराजसर्ा माकरोलोफा), लािा-स्ट्पोटे्टड नटकै्रकर (नदकफेरगा मुलटीपुंकटाटा), रेड-जबल्ड चौगह (सर्ररहोकरस सर्ररहोकरस), ग्-ेहडेेड केनरी फलाईकैचर (कुजलदककापा केर्लोनेंजसस), कश्मीर नूठातच (जसट्टा कजश्मरेंजसस), रॉक बंुटीग (इम्बेरीिा दकर्ा) आदि ह;ै और, काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र्, लचीपोरा वन्र्िीव अभर्ारण्र् के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाएं इस अजधसूचना के परैाग्ाफ 1 में जवजनर्िाष्ट हैं, को पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव- जवजवधता की िजृष्ट से पाररजस्ट्थजतकी संवेिी िोन के रूप में सुरजक्षत और संरजक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों की श्रेजणर्ों के प्रचालन तथा प्रदक्रर्ाओं को प्रजतजिद्ध करना आवश्र्क ह;ै अतः अब, केन्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना में इसके पश्चात ्पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) तथा उपधारा (2) के खंड (v) और खंड (xiv) एवं उपधारा (3) के द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, िम्मू - कश्मीर संघ राज्र्क्षेत्र के काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र् और लचीपोरा वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0 (िून्र्) से 5 दकलोमीटर क्षेत्र को काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र्, लचीपोरा वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात ्:-

1. पाररजस्ट्थजतकी संविेी िोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र्, लचीपोरा वन्र्िीव अभर्ारण्र् की सीमा के चारो ओर 0 (िनू्र्) से 5 दकलोमीटर के साथ

69.97 वगा दकलोमीटर तक जवस्ट्तृत ह।ै वास्ट्तजवक जनर्ंत्रण रेखा की उपजस्ट्थजत के कारण और मानव बजस्ट्तर्ों के कारण भी पजश्चम और उत्तर-पजश्चम दििा की ओर पाररजस्ट्थजतकी संवेिी िोन का िून्र् जवस्ट्तार ह।ै जवजभन्न दििाओं (दकलोमीटर) में पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार नीचे दिर्ा गर्ा ह:ै दििा जवस्ट्तार (दकलोमीटर) उत्तर 1.5 उत्तर-पूवा 1.5 पूवा 0.05 िजक्षण-पूवा 5.0 िजक्षण 0.05 िजक्षण-पजश्चम 0.05 पजश्चम 0.00 उत्तर-पजश्चम 0.00

(2) काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र्, लचीपोरा वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबधं -I के रूप में संलग्न ह।ै

(3) सीमा जववरण और अक्षािंों और िेिांतरों के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र्, लचीपोरा वन्र्िीव अभर्ारण्र् के मानजचत्र उपाबधं–IIक, उपाबधं–IIख, 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उपाबधं –IIग, उपाबधं–IIघ और उपाबधं–IIङ के रूप में संलग्न हैं।

(4) काज़िनाग राष्ट्रीर् उद्यान, लीम्बर वन्र्िीव अभर्ारण्र् और लचीपोरा वन्र्िीव अभर्ारण्र् और पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू- जनिेिांकों की सूची उपाबधं-III की सारणी क और सारणी ख में िी गई ह।ै

(5) मुख्र् पबंिओुं के भू-जनिेिांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन ेवाल ेग्ामों की सूची उपाबधं-IV के रूप में संलग्न ह।ै

2. पाररजस्ट्थजतकी संविेी िोन के जलए आचंजलक महार्ोिना– (1) संघ राज्र्क्षेत्र सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से इस अजधसूचना में दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी और उसे संघ राज्र्क्षेत्र में सक्षम प्राजधकारी द्वारा जवजधवत अनुमोदित दकर्ा िाएगा।

(2) संघ राज्र्क्षेत्र सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत, िो इस अजधसूचना में जवजनर्िाष् ट की गई ह,ै के अनुसार तथा सुसंगत कें रीर् और संघ राज्र्क्षेत्र जवजधर्ों के अनरुुप और कें रीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी ।

(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करन ेके जलए संघ राज्र् क्षेत्र सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी.-

(i) पर्ाावरण;

(ii) वन;

(iii) कृजि;

(iv) रािस्ट्व;

(v) िहरी जवकास;

(vi) पर्ाटन;

(vii) ग्ामीण जवकास;

(viii) पसंचाई और बा़ि जनर्ंत्रण;

(ix) प्रििूण जनर्ंत्रण बोडा;

(x) नगरपाजलका;

(xi) पंचार्ती राि; और

(xii) लोक जनमााण जवभाग।

(4) आंचजलक महार्ोिना अनमुोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दक्रर्ाकलापों, िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।

(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलओुं, जिन पर ध्र्ान िेना आवश्र्क ह,ै के जलए उपबंध होंगे ।

(6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेिताओं के ब्र्ौरों से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्ामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजि क्षते्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजि क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभर्ांकन करेगी। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

(7) आंचजलक महार्ोिना में पाररजस्ट्थजतकी संवेिी िोन में जवकासात्मक दक्रर्ाकलापों को जवजनर्जमत करने के जलए प्रदक्रर्ा प्रिान की िाएगी और सारणी में र्थासूचीबद्ध पैरा 4 में प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा और इसमें स्ट् थानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनश्चर् और संवधान दकर्ा िाएगा।

(8) आंचजलक महार्ोिना प्रािेजिक जवकास र्ोिना की सह जवस्ट्तारी होगी।

(9) अनुमोदित आंचजलक महार्ोिना मानीटरी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपने कताव्यों का जनवाहन कर सके।

3. सघं राज्र्क्षते्र सरकार द्वारा दकए िान ेवाल ेउपार्.- संघ राज्र्क्षेत्र सरकार इस अजधसूचना के उपबंधों को प्रभावी करन े के जलए जनम्नजलजखत उपार् करेगी, अथाात:्-

(1) भ-ूउपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुल ेस्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा: परंत ुपाररजस्ट्थजतकी संवेिी िोन के भीतर ऊपर भाग (क) में जवजनर्िाष्ट प्रर्ोिनों से जभन्न प्रर्ोिनों के जलए, कृजि और अन्र् भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और र्था लागू क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्रीर् सरकार र्ा संघ राज्र्क्षते्र सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करने के जलए अनुज्ञात दकर्ा िाएगा, िैसे-

(i) जवद्यमान सडकों को चौडा करना और उन्हें सुि़ृि करना तथा नई सडकों का संजनमााण;

(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;

(iii) प्रििूण उत्पन्न न करने वाल ेलघ ुउद्योग;

(iv) कुटीर उद्योगों जिनके अंतगात ग्ामीण उद्योग भी हैं; सुजवधािनक भण्डार और पाररजस्ट्थजतकी पर्ाटन में स्ट्थानीर् सुजवधाएं सहार्क जिसके अन्तगात गृह वास सजम्मजलत ह;ै और

(v) पैरा 4 के अधीन दिए गए संवर्धात दक्रर्ाकलाप: परंत ुर्ह और दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म तथा संघ राज्र्क्षेत्र सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना और संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुमत नहीं होगा: परंत ुर्ह भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई गलती, मानीटरी सजमजत के जवचार प्राप्त करन ेके पश्चात ्संघ राज्र्क्षेत्र सरकार द्वारा प्रत्र्ेक मामले में एक बार ठीक होगी और उि गलती के सुधार की सूचना कें रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी: परंत ुर्ह भी दक गलती के सुधार में इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा। (ख) वनीकरण तथा वास िीणोद्धार दक्रर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजि क्षते्रों में पुन: वनीकरण करने के प्रर्ास दकए िाएंगे।

(2) प्राकृजतक िल स्रोत.- आचंजलक महार्ोिना में सभी प्राकृजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत की िाएगी और संघ राज्र् क्षेत्र सरकार द्वारा ऐसी रीजत में मागाििी 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जसद्धांत तैर्ार दकए िाएंग ेिो ऐसे क्षेत्रों में र्ा उनके जनकट जवकास दक्रर्ाकलापों को प्रजतजिद्ध करे िो ऐसे क्षेत्रों के जलए अजहतकर हों।

(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन के जलए पर्ाटन महार्ोिना के अनुसार होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना संघ राज्र्क्षेत्र पर्ाटन जवभाग द्वारा संघ राज्र्क्षेत्र पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप में होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे, अथाात:्-

(i) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो, होटलों और ररिॉटों के नर् ेसजन्नमााण अनजु्ञात नहीं होंग:े परंत,ु संरजक्षत के्षत्र की सीमा से एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक नए होटलों और ररिॉटों की स्ट्थापना केवल पूवा पररभाजित और अजभजहत क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनजु्ञात होगी;

(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार कें रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष् रीर् ा र्ाघ्र स संरक्षण प्राजधकरण, द्वारा िारी पाररजस्ट्थजतकी–पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेत ेहुए (समर्- समर् पर र्था संिोजधत) िारी मागाििाक जसद्धांतों के अनुसार होगा;

(iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िाष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर् े होटल र्ा ररसोटा र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनुज्ञात नहीं दकर्ा िार्ेगा ।

(4) नसैर्गाक जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत के्षत्र, िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाएं, स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और एक जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप में परररक्षण और संरक्षण के जलए तैर्ार की िाएगी ।

(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तरै्ार की िाएगी।

(6) ध् वजन प्रििूण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििूण का जनवारण और जनर्ंत्रण दकर्ा िाएगा।

(7) वार् ु प्रििूण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रििूण का जनवारण और जनर्ंत्रण वार्ु (प्रििूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा।

(8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सरण, साधारण मानकों के उपबंधों के अनुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन ेवाले पर्ाावरणीर् प्रििूण के जनस्ट्सरण के जलए साधारण मानकों र्ा संघ राज्र् क्षेत्र सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7

(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रलै, 2016 द्वारा प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करत ेहुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।

(10) िैव जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा.- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 द्वारा प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करत ेहुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।

(11) सलाजस्ट्टक अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में सलाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित सलाजस्ट्टक अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(12) जनमााण और जवध्वसं अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित समर्-समर् पर र्थासंिोजधत ई–अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(14) र्ानीर् र्ातार्ात.- र्ातार्ात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सजम्मजलत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होने और संघ राज्र्क्षेत्र सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् दक्रर्ाकलापों के अनपुालन की मानीटरी करेगी।

(15) र्ानीर् प्रििूण.- लागू जवजधर्ों के अनुपालन में र्ान प्रििूण का जनवारण और जनर्तं्रण दकर्ा िाएगा और स्ट्वच्छ ईंधनों के उपर्ोग के जलए प्रर्ास दकए िाएंगे।

(16) औद्योजगक इकाइर्ा.ं- (क) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात पाररजस्ट्थजतकी संवेिी िोन के भीतर दकन्ही नए प्रिजूित उद्योगों की स्ट्थापना की अनजु्ञा नहीं िी िाएगी। (ख) केन्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रििूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रििूणकारी उद्योगों को ब़िावा दिर्ा िाएगा।

(17) पहाडी ढलानों को सरंक्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:- 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) आंचजलक महार्ोिना पहाडी ढलानों पर उन क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी; (ख) जवद्यमान खडी पहाडी ढलानों र्ा कटाव की उच्च मात्रा वाली ढलानों पर दकसी भी संजनमााण की अनजु्ञा नहीं िी िाएगी ।

4. पाररजस्ट्थजतकी संविेी िोन में प्रजतजिद्ध और जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सूची.- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीन बनाए गए जनर्मों, जिसके अन्तगात तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 और अन्र् लाग ूजवजधर्ों के, जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) सजम्मजलत हैं और उनमें दकर्े गर्े संिोधनों द्वारा िाजसत होंगे और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में जवजनर्जमत होंगे, अथाात ्:- सारणी क्रम स.ं दक्रर्ाकलाप वणान क. प्रजतजिद्ध दक्रर्ाकलाप

1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघिाण इकाइर्ां। (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं जिसमें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत ह,ै के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघ ुऔर वृहत खजनि), पत्थर उत्खनन और अपघिाण इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्र्ार्ालर् के आिेि 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामल े में तारीख 21 अप्रैल, 2014 के आिेि के अनुसरण में होगा ।

2. प्रििूण (िल, वार्,ु मृिा, ध्वजन, आदि) उत्पन करने वाल े उद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगान े और वतामान प्रििूणकारी उद्योगों का जवस्ट्तार करन ेकी अनुज्ञा नहीं होगी: परंत,ु केन्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रििूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गरै- प्रििूणकारी कुटीर उद्योगों को ब़िावा दिर्ा िाएगा।

3. बडी िल जवदु्यत पररर्ोिना की स्ट्थापना । प्रजतजिद्ध।

4. दकसी पररसंकटमर् पिाथा का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। प्रजतजिद्ध। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9

5. प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में अनुपचाररत बजहस्रााव का जनस्ट्सारण । प्रजतजिद्ध।

6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई आरा जमलों की स्ट्थापना और जवद्यमान आरा जमलों का जवस्ट् तार अनुज्ञात नहीं होगा।

7. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध।

8. िलावन लकडी का वाजणजज्र्क उपर्ोग । प्रजतजिद्ध।

9. पोजलथीन बैगों का प्रर्ोग । प्रजतजिद्ध।

10. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे वार्ुर्ान गमा वार्ु गुब्बारों, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उडने िैसे दक्रर्ाकलाप करना। प्रजतजिद्ध। आ. जवजनर्जमत दक्रर्ाकलाप

11. वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों लघ ु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा: परंत ु संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के परे र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक इनमें से, िो भी जनकट हो सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लाग ूमागाििी जसद्धांतों के अनुरुप होगा।

12. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नरे् वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी: परंत ु स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवश्र्कताओं को पूरा करन ेके जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध दक्रर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप-जवजधर्ों के अनुसार, संजनमााण करन ेकी अनुज्ञा होगी: परंत ु र्ह दक, गैर–प्रििूणकारी लघु उद्योगों से संबंजधत संजनमााण दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंगे । (ख) एक दकलोमीटर क्षेत्र से परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे ।

13. प्रििूण उत्पन्न न करन े वाल े लघ ु उद्योग। फरवरी, 2016 में केन्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों के वगीकरण के अनुसार समर्-समर् पर र्था संिोजधत गैर-प्रििूणकारी उद्योग और अपररसंकटमर्, लघ ु और सेवा 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्ी से उत्पािों को उत्पन्न करने वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे।

14. वृक्षों की कटाई। (क) संघ राज्र् क्षेत्र सरकार के सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत कें रीर् र्ा संघ राज्र्क्षेत्र अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनसुार जवजनर्जमत होगी।

15. वन उत्पािों र्ा गैर काष् ठ वन उत्पािों का संग्हण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

16. जवदु्यत और संचार टावरों का पररजनमााण और केबलों और अन्र् बुजनर्ािी ढांचे का जबछार्ा िाना । लाग ू जवजधर्ों के अधीन जवजनर्जमत भूजमगत केबल जबछान ेको ब़िावा दिर्ा िाएगा।

17. नागररक सुख सुजवधाओं सजहत अवसंरचनाएं । न्र्नूीकरण उपार्ों को, लाग ूजवजधर्ों, जनर्मों और जवजनर्मों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाएगा।

18. जवद्यमान सडकों को चौडा करना और उन्हें सुि़ृि करना तथा नवीन सडकों का संजनमााण । न्र्ूनीकरण उपार्ों को, लाग ू जवजधर्ों, जनर्मों और जवजनर्मनों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाएगा।

19. पहाडी ढालों और निी तटों का संरक्षण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

20. राजत्र में र्ाजनक र्ातार्ात का संचलन । लागू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंगे ।

21. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजि और बागवानी प्रथाओं के साथ िगु्धिाला, िगु्घ उद्योग, कृजि और मछली पालन । स्ट्थानीर् लोगों के उपर्ोग के जलए लागू जवजधर्ों के अधीन अनुज्ञात होंगे।

22. प्राकृजतक िल जनकार्ों र्ा सतही के्षत्र में उपचाररत अपजिष्ट िल/ बजहस्रााव का जनस्ट्तारण । िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुन:चक्रण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएगंे। अन्र्था लागू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचाक्रण र्ा प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा।

23. सतही और भूिल का वाजणजज्र्क जनष्किाण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

24. फमों, जनगम और कंपजनर्ों द्वारा बडे पैमाने पर वाजणजज्र्क पिओुं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आवश्र्कताओं को पूरा करने के अलावा लागू जवजधर्ों के अधीन (अन्र्था उपबंजधत के जसवार्) जवजनर्जमत होंगे ।

25. खुले कंुआ, बोर कंुआ, आदि कृजि और अन्र् उपर्ोग के जलए । जवजनर्जमत और समुजचत प्राजधकारी द्वारा दक्रर्ाकलापों की सख्ती से मानीटरी की िार्ेगी।

26. ठोस अपजिष्ट का प्रबन्धन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

27. जविेिी प्रिाजतर्ों को लाना । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

28. पाररजस्ट्थजतकी पर्ाटन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11

36. बागान लगाना और िडी बूरटर्ों का रोपण । सदक्र र् रूप से ब़िावा दिर्ा िाएगा।

37. पाररजस्ट्थजतकी अनुकूल पररवहन का उपर्ोग । सदक्र र् रूप से ब़िावा दिर्ा िाएगा।

38. कौिल जवकास । सदक्र र् रूप से ब़िावा दिर्ा िाएगा।

39. जनम्नीकृत भूजम/वन/वास की बहाली । सदक्र र् रूप से ब़िावा दिर्ा िाएगा।

40. पर्ाावरणीर् िागरुकता । सदक्र र् रूप से ब़िावा दिर्ा िाएगा।

5. पाररजस्ट्थजतकी संविेी िोन अजधसचूना की मानीटरी के जलए मानीटरी सजमजत.- कें रीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अधीन इस अजधसूचना के उपबंधों की प्रभावी मानीटरी के जलए मानीटरी सजमजत का गठन करती ह,ै िो जनम्नजलजखत से जमलकर बनगेी, अथाात:्- क्र.स.ं जनगरानी सजमजत का गठन पि

2. िम्मू और कश्मीर सरकार द्वारा नाजमत दकए िाने वाले पाररजस्ट्थजतकी और पर्ाावरण के के्षत्र के एक जविेिज्ञ सिस्ट्र्;

3. िम्मू-कश्मीर सरकार द्वारा नाजमत पर्ाावरण संरक्षण के के्षत्र में काम करने वाले गैर-सरकारी संगठन का एक प्रजतजनजध सिस्ट्र्;

4. िम्मू और कश्मीर िैव जवजवजधता पररिि ्का प्रजतजनजध सिस्ट्र्;

5. जिला अजधकारी, िम्मू और कश्मीर राज्र् प्रििूण जनर्ंत्रण बोडा, बारामूला सिस्ट्र्;

6. प्रभागीर् वनाजधकारी, झेलम घाटी वन प्रभाग सिस्ट्र्;

7. प्रभागीर् वनाजधकारी, लगंेट वन प्रभाग सिस्ट्र्;

8. वन्र्िीव वाडान, उत्तर प्रभाग सिस्ट्र्- सजचव

6. जनिेि-जनबधंन.- (1) मानीटरी सजमजत इस अजधसूचना के उपबंधों के अनुपालन की मानीटरी करेगी।

(2) मानीटरी सजमजत का कार्ाकाल अगल ेआिेि होने तक दकर्ा िाएगा, परंत ुसजमजत के गरै-सरकारी सिस्ट्र्ों को समर्- समर् पर संघ राज्र्क्षेत्र सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा।

(3) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में सजम्मजलत हैं, और िो पाररजस्ट्थजतकी संवेिी िोन में आत ेहैं, उसके पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के जसवार्, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए कें रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को जनर्िाष्ट दकर्ा िाएगा।

(4) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ) तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं ह,ै और िो पाररजस्ट्थजतकी संवेिी िोन में आत ेहैं, उसके पैरा 4 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] के अधीन सारणी में र्थाजवर्नाष्ट प्रजतजिद्ध दक्रलाकलापों के जसवार्, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबंद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा।

(5) मानीटरी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लघंन करता ह,ै पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि फाइल करन ेके जलए सक्षम होगा।

(6) मानीटरी सजमजत मुद्दा िर मुद्दा के आधार पर अपेक्षाओं पर जनभार रहत े हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपन ेजवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।

(7) मानीटरी सजमजत प्रत्र्ेक विा की 31 माचा तक के अपन े दक्रर्ाकलापों की वार्िाक कारावाई ररपोटा संघ राज्र् क्षेत्र के मुख् र् वन् र्िीव वाडान को उपाबधं-V में उपाबद्ध प्रारुप में उक् त विा के 30 िून तक प्रस्ट्तुत करेगी ।

(8) केन्रीर् सरकार का पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् मानीटरी सजमजत को उसके कृत्र्ों के प्रभावी जनवाहन के जलए ऐसे जनिेि िे सकेगा, िो वह ठीक समझे ।

7. अजतररक् त उपार्.- इस अजधसूचना के उपबंधों को प्रभावी बनान ेके जलए कें रीर् सरकार और संघ राज्र् क्षेत्र सरकार, अजतररक् त उपार्, र्दि कोई हों, जवजनर्िाष् ट कर सकें गी।

8. कोई अन् र् महत् वपूणा जविर् । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 25th March, 2022 S.O. 1330(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 2180 (E), dated the 7 th June, 2021, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 8 th June, 2021; AND WHEREAS, objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification were duly considered in the Ministry; AND WHEREAS, the Kazinag National Park, Limber Wildlife Sanctuary and Lachipora Wildlife Sanctuary are spread over an area of 128.77 square kilometers is located, in Kashmir province, Jammu and Kashmir; AND WHEREAS, the Kazinag National Park comprising an area of 89.00 square kilometres has been notified as National Park vide notification number S.R.O:425 dated 18 th December, 2007. Limber Wildlife Sanctuary comprising an area of 12 square kilometres has been notified as Wildlife Sanctuary vide S.R.O No: 157 dated 19 th March 1987 and Lachipora Wildlife Sanctuary comprising an area of 80.00 square kilometres as notified but 27.77 square kilometres area carved out after inclusion of 52.23 Sq. Km area for declaring Kazinag National Park has been notified as Wildlife Sanctuary notified vide S.R.O No: 150 dated 19 th March1987; AND WHEREAS, the Kazinag National Park, Limber Wildlife Sanctuary, and Lachipora Wildlife Sanctuary form the most important natural heritage representing a great biodiversity of flora and fauna and the area is known to harbour the last viable population of Pir Panjal Markhor (Capra falconeri) and endemic Kashmir musk deer (Moschus cupreus). The area provides pristine locations for nature lovers, bird watchers, mountaineers, ecologists, researchers and tourists; AND WHEREAS, the physiographical and topographical terrain of the area supports a mesophytic vegetation of temperate conifers arranged in an altitudinal sequence and a variety of forest types, lush green meadows of alpine habitats makes it more unique for such a biological and ecological heritage and therefore, calls upon its effective conservation, preservation and better propagation of wildlife species in order to protect it for future generations; AND WHEREAS, the Kazinag National Park, Limber Wildlife Sanctuary and Lachipora Wildlife Sanctuary consists of coniferous forests with deodar wood cover, blue pine forests, silver fir canopy, broad-leaved woodland, birch forest, isoden scrub, savana scrub and alpine pastures. The area also has a diversity of floral species such as Deodar (Cedrus deodara), Parrotia (Parrotiopsis jacquemontiana), kail (Pinus walllichina), fir (Abies Pindrow), spruce (Picea smithiana), horse chestnut (Aesculus indica), walnut (Juglans regia), Acer cappadocicum, Betula utilis, Indigofera heterantha, Viburnum grandiflorum,Rosa webbiana, Lonicera quinquelocularis, chinar (Platanus orientalis), Juniperus recurva, Rhododendron anthopogon, Isodon rugosus, Pinus griffithii etc; AND WHEREAS, the Kazinag National Park, Limber Wildlife Sanctuary, Lachipora Wildlife Sanctuary and Naganari Conservation Reserve fall in the North-West Himalayan province of Himalayan zone as per the biogeographic demarcation of Jammu and Kashmir State by Rodgers and Pawar (1988). The faunal life is distinguished by the presence of many species of Indo-Chinese forms. The faunal elements show affinities with Northern Paleartic fauna as well as Eastern and Oriental fauna, forming a unique assemblage of great conservation value; [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 AND WHEREAS, the area has a wide variety of rare, threatened and endangered faunal species such as Asiatic black bear (Ursus thibetanus), Himalayan brown bear (Ursus arctos), common leopard (Panthera pardus), leopard cat (Prionailurus bengalensis), jungle cat (Felis chaus), red fox (Vulpes vulpes), jackal (Canis aureus), yellow-throated marten (Martes flavigula), mountain weasel (Mustela altaica), Indian porcupine (Hystrix indica), Himalayan grey langur (Semnopithecus ajax), Rhesus macaque (Macaca mulatta), Himalayan grey goral (Nemorhaedus bedfordi), Himalayan palm civet (Paguma larvata), Indian wild pig (Sus scorfa), Royle’s pika (Ochotona roylei), house shrew (Suncus murinus), Kashmir flying squirrel (Eoglaucomys fimbriatus)etc; AND WHEREAS, the Kazinag National Park, Limber Wildlife Sanctuary, Lachipora Wildlife Sanctuary are home to 120 species of birds representing about 36 families. Some of the birds species present in the area are Himalayan griffon (Gypsy himalayensis), bearded vulture (Gypaetus barbatus), western tragopan (Tragopan melanocephalus), cheer pheasant (Catreus wallichii), Himalayan monal (Lophophorus impejanus), koklass pheasant (Pucrasia macrolopha), large-spotted nutcracker (Nucifraga multipunctata), red-billed chough (Pyrrhocorax pyrrhocorax), grey-headed canary flycatcher (Culicicapa ceylonensis), Kashmir nuthatch (Sitta cashmirensis), rock bunting (Emberiza cia) etc; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Kazinag National Park, Limber Wildlife Sanctuary and Lachipora Wildlife Sanctuary which are specified in paragraph 1 as Eco-Sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 (zero) to 5kilometers around the boundary of Kazinag National Park, Limber Wildlife Sanctuary and Lachipora Wildlife Sanctuary, in the Union territory of Jammu and Kashmir as Kazinag National Park, Limber Wildlife Sanctuary and Lachipora Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:

1. Extent and boundaries of Eco-Sensitive Zone. – (1) The Eco-Sensitive Zone shall be of 69.97 square kilometers with an extent 0 (zero) to 5 kilometers around the boundary of Kazinag National Park, Limber Wildlife Sanctuary and Lachipora Wildlife Sanctuary. The zero extent of the Eco-sensitive zone towards West and North-West direction is due to presence of actual Line of Control and also due to human settlements. (2) The boundary description of Kazinag National Park, Limber Wildlife Sanctuary and Lachipora Wildlife Sanctuary and its Eco-sensitive Zone is appended as Annexure-I.

(3) The maps of the Kazinag National Park, Limber Wildlife Sanctuary and Lachipora Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC, Annexure-IID and Annexure-IIE.

(4) The lists of geo co-ordinates of the boundary of Kazinag National Park, Limber Wildlife Sanctuary and Lachipora Wildlife Sanctuary and Eco-Sensitive Zone are given in Table A and Table B of Annexure-III.

(5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.

2. Zonal Master Plan for Eco-sensitive Zone. -(1) The Union territory Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the Union territory. 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union territory Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union territory laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union territory Government, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment;

(ii) Forests;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Pollution Control Board;

(x) Municipal;

(xi) Panchayati Raj; and

(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by the Union Territory Government. -The Union territory Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or Union territory Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given in paragraph 4: [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Union territory Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the Union territory Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Tourism Master Plan shall be prepared by the Union tferritory Department of Tourism in consultation with the Union territory Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.

(e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, ecoeducation and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made there under or standards stipulated by the Union territory Government, whichever is more stringent.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-

(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.

(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:-

(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28 th March,

2016.

(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.

(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.

(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the Union territory Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.

(b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:- [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco- sensitive Zone;

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). New industries and expansion of existing polluting industries in the Ecosensitive Zone shall not be permitted:

Provided that, non-polluting industries shall be allowed within Eco- Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.

3. Establishment of major hydroelectric project. Prohibited.

4. Use or production or processing of any hazardous substance. Prohibited.

5. Discharge of untreated effluents in natural water bodies or land area. Prohibited.

6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited.

8. Commercial use of firewood Prohibited.

9. Use of polythene bags. Prohibited.

10. Undertaking activities related to tourism like over-flying the national park area by aircraft, hot-air balloons. Prohibited. B. Regulated Activities

11. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco- 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

12. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in subparagraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

13. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.

14. Felling of trees. (a)There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the Union territory Government.

(b)The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.

15. Collection of Forest Produce or Non-Timber Forest Produce. Regulated under applicable laws.

16. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws of underground cabling may be promoted.

17. Infrastructure including civic amenities. Taking measures of mitigation, as per applicable laws, rules, regulation and available guidelines.

18. Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation, as per applicable laws, rules, regulation and available guidelines.

19. Protection of Hill Slopes and river banks. Regulated as per the applicable laws.

20. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.

21. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.

22. 23. Commercial extraction of surface and ground water. Regulated under applicable laws.

24. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies. Regulated (except as otherwise provided) as per applicable laws except for meeting local needs.

25. Open Well, Bore Well, etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority.

26. Solid Waste Management. Regulated as per the applicable laws.

27. Introduction of Exotic species. Regulated as per the applicable laws.

28. Eco-tourism. Regulated as per the applicable laws.

29. Commercial Sign boards and hoardings. Regulated as per the applicable laws. C. Promoted Activities

30. Rain water harvesting. Shall be actively promoted.

31. Organic farming. Shall be actively promoted.

32. Adoption of green technology for all activities. Shall be actively promoted.

33. Cottage industries including village artisans, etc. Shall be actively promoted.

34. Use of renewable energy and fuels. Bio-gas, solar light etc. shall be actively promoted.

35. Agro-Forestry. Shall be actively promoted.

36. Plantation of Horticulture and Herbals. Shall be actively promoted.

37. Use of eco-friendly transport. Shall be actively promoted.

38. Skill Development. Shall be actively promoted.

39. Restoration of Degraded Land/ Forests/ Habitat. Shall be actively promoted.

40. Environmental Awareness. Shall be actively promoted.

5. Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification. -For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely: - S.N. Constituent of the Monitoring Committee Designation

1. Deputy Commissioner, Baramulla Chairman;

2. An expert in the area of ecology and environment to be nominated by the Government of Jammu and Kashmir Member;

3. One representative of a Non-Governmental Organization working in the field of environment conservation to be nominated by the Government of Jammu and Kashmir Member;

4. Representative of Jammu and Kashmir Biodiversity Council Member;

6. Divisional Forest Officer, Jhelum Valley Forest Division Member;

7. Divisional Forest Officer, Langate Forest Division Member;

8. Wildlife Warden, North Division Member Secretary.

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the Union territory Government from time to time.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the Union territory as per performa appended at Annexure-V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional measures.-The Central Government and Union territory Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
