PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पयाावरण, वन और जलवाय ुपररवतान मतं्रालय ऄजधसचूना नइ ददल्ली, 25 माचा, 2022 का.अ. 1331(ऄ).—प्रारुप ऄजधसूचना भारत के राजपत्र, ऄसाधारण, भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 4048 (ऄ), तारीख 11 नवम्बर, 2020 द्वारा प्रकाजित की गइ थी जजसमें ऐसे सभी व्यजियों से, जजनकी ईससे प्रभाजवत होने की संभावना थी, ईस तारीख से, जजसको ईि ऄजधसूचना को ऄन्तर्ववष्ट करने वाली राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थीं, साठ ददन की ऄवजध के भीतर अक्षेप और सुझाव अमंजत्रत दकए गए थ;े और, ईि प्रारूप ऄजधसूचना को ऄन्तर्ववष्ट करने वाली राजपत्र की प्रजतयां जनता को तारीख 11 नवम्बर, 2020 को ईपलब्ध करा दी गइ थी;
और, ईि प्रारुप ऄजधसूचना के प्रत्युत्तर में व्यजियों और पणधाररयों से प्राप्त अक्षेपों और सुझावों पर मंत्रालय द्वारा जवचार दकया गया था;
नरग ूवन्यजीव ऄभयारण्य जहमाचल प्रदेि के मंडी और कुल्ल ूजजले में मंडी से लगभग 55 दकलोमीटर, जोगगदर नगर से 30 दकलोमीटर की दरूी पर जस्ट्थत ह ैजो जवजभन्न स्ट्थाजनक वनस्ट्पजत और जीवजंतु को अश्रय प्रदान करता ह।ै ऄभयारण्य पाररजस्ट्थजतकी, जीवजंतु, वनस्ट्पजत, भू-अकृजतवैज्ञाजनक और मनोरंजनात्मक और ऄनुसंधान एवं िैजक्षक पररप्रेक्ष्य से काफी महत्त्वपूणा ह।ै ऄभयारण्य का कुल क्षेत्रफल 132.37 वगा दकलोमीटर ह;ै स.ं 1289] नइ ददल्ली, िुक्रवार, माचा 25, 2022/चतै्र 4, 1944 No. 1289] NEW DELHI, FRIDAY, MARCH 25, 2022/CHAITRA 4, 1944 सी.जी.-डी.एल.-अ.-25032022-234480 CG-DL-E-25032022-234480 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, नरग ू वन्यजीव ऄभयारण्य के ऄंतगात अर्द्ा देवदार वन, 12 सी1 (सी), अर्द्ा िीतोष्ण पणापाती वन 12/सी1(इ), खरसू ओक वन 12/सी2(ए), ईप-ईष्णकरटबंधीय चीड पाआन वन, पजिमी जमजश्रत िंकुधारी वन, पजिमी जहमालय ईप-ऄल्पाआन देवदारू वन अत ेहैं । ऄभयारण्य में महत्त्वपूणा वृक्ष प्रजाजतयों में देवदार (केदरूस देवदार), फर (ऄजबआस गपदरोप), खरसू (के्वरसुस सेजमकारपीफोलीऄ), प्रूनस (प्ररूनस ऄजवयम), मापल े(ऄकेर स्ट्पा), जुगलान (जुगलान रेलजगया एल), रोडोडेंड्रोन (रोडोडेंड्रोन ऄरबोरेतुम), केलटीस (केजल्टस ऑस्ट्रजलस एल), दफग (दफकस पालमेट),बान (के्वरसुस लकुरैकोफोरा), अदद पाए जाती हैं;
और, नरग ूवन्यजीव ऄभयारण्य वन्यजीव की जविेष जवजवधता के वास के जलए जाना जाता ह।ै ऄभयारण्य में मुख्य प्रजाजतयों में संकटापन्न प्रजाजतयों जैसे सामान्य तेंदअु (पेन्थेरा प्रड्यूस), मुंजक (मुनटीक्स मुनतजक), काला भाल ू (सेलेनारक्टस जथबेटेनस), घोराल (नेमोराएडस गोरल), जसयार (कैजनस ऑररयस), जहमालयन येलो थ्रोटेड माटेन (माटेस फ्लाजवगलुा), जहमालयन जसवेट (पगोमा लारवाटा), फ्लाआंग जगलहरी (पेटोररस्ट्टा पेटोररस्ट्टा) पाए जाते हैं। यह जहमाचल प्रदेि में पाए जाने वाले फेजेंट की सात प्रजाजतयों में से चार प्रजाजतयों का वास ह ैऔर आसे भारत में जहमालयन के्षत्र में प्रजतबंजधत स्ट्थाजनक ऄसुरजक्षत प्रजाजतयों जहमालयी मोनल, के जलए महत्त्वपूणा पक्षी के्षत्र के रूप में मान्यता दी गइ ह।ै आसके ऄलावा ऄन्य पक्षी, सफेद के्रस्ट्टेड कलीज, चूकोर, काला और ग्र ेतीतर ह।ै आसके ऄलावा सरीसृप, सांप, मॉनीटर जछपकली सामान्य रूप से पाए जाते ह;ै और, नरग ूवन्यजीव ऄभयारण्य के चारों ओर के क्षेत्र को, जजसका जवस्ट्तार और सीमाएं आस ऄजधसूचना के पैरा 1 में जवजनर्ददष्ट हैं, पाररजस्ट्थजतकी, पयाावरणीय और जैव-जवजवधता की दजृष्ट से पाररजस्ट्थजतकी संवेदी जोन के रूप में सुरजक्षत और संरजक्षत करना तथा ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों की श्रेजणयों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजषद्ध करना अवश्यक ह;ै ऄतः ऄब, केन्र्द्ीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ परठत पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आस ऄजधसूचना में आसके पिात ्पयाावरण ऄजधजनयम कहा गया ह)ै धारा 3 की ईपधारा (1) तथा ईपधारा (2) के खंड (v) और खंड (xiv) एवं ईपधारा (3) के द्वारा प्रदत्त िजियों का प्रयोग करत ेहुए, जहमाचल प्रदेि राज्य के मंडी और कुल्ल ूजजला के नरग ूवन्यजीव ऄभयारण्य की सीमा के चारों ओर 0 (िून्य) से
1.00 दकलोमीटर तक जवस्ट्ताररत क्षेत्र को पाररजस्ट्थजतकी संवेदी जोन (जजसे आस ऄजधसूचना में आसके पश् चात ्पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप में ऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार ह,ै ऄथाात्:-
1. पाररजस्ट्थजतकी संवदेी जोन का जवस्ट्तार और सीमाए-(1) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार 0 (िून्य) से 1.00 दकलोमीटर तक जभन्न रूप में फैला हुअ ह ैऔर पाररजस्ट्थजतकी संवेदी जोन का क्षेत्रफल 50.0425 वगा दकलोमीटर ह।ै रटप्पण: पाररजस्ट्थजतकी संवेदी जोन की िून्य सीमा ईत्तर की ओर धौलाधार वन्यजीव ऄभयारण्य और पूवा की ओर खोखण वन्यजीव ऄभयारण्य के साथ नरगू वन्यजीव ऄभयारण्य के जारी रहन ेके कारण ह।ै
(2) नरग ूवन्यजीव ऄभयारण्य और आसके पाररजस्ट्थजतकी संवेदी जोन की सीमा का जववरण ईपाबधं-I के रूप में संलग्न ह।ै
(3) सीमा जववरण और ऄक्षांि और देिांतर के साथ पाररजस्ट्थजतकी संवेदी जोन को सीमांदकत करत ेहुए नरग ूवन्यजीव ऄभयारण्य के मानजचत्र ईपाबधं–IIक और ईपाबधं-IIख के रूप में संलग्न ह।ै
(4) नरग ूवन्यजीव ऄभयारण्य के पाररजस्ट्थजतकी संवेदी जोन की सीमा के भू-जनदेिांकों की सूची ईपाबधं-III में दी गइ ह।ै
(5) प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अन ेवाल ेराजस्ट्व ग्रामों की सूची, मुख्य गबदओुं पर ईनके भू-जनदेिांकों के साथ ईपाबधं -IV के रूप में संलग्न ह।ै
2. पाररजस्ट्थजतकी संवदेी जोन के जलए अचंजलक महायोजना– (1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोजनों के जलए राजपत्र में आस ऄजधसूचना के प्रकािन की तारीख से दो वषा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और राज्य के सक्षम प्राजधकारी के ऄनुमोदन के जलए आस ऄजधसूचना में ददए गए ऄनुबंधों का पालन करत े हुए अंचजलक महायोजना तैयार करेगी और राज्य में सक्षम प्राजधकारी द्वारा सम्यक रुप से ऄनुमोददत दकया जाएगा। [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3
(2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना में जवजनर्ददष् ट दकए गए हैं, के ऄनुसार तथा सुसंगत कें र्द्ीय और राज् य जवजधयों के ऄनुरुप और कें र्द्ीय सरकार द्वारा जारी मागाजनदेिों, यदद कोइ हों, द्वारा तैयार होगी ।
(3) अंचजलक महायोजना, ईि योजना में पाररजस्ट्थजतकी और पयाावरणीय जवचारों को समाकजलत करन े के जलए राज् य सरकार के जनम्नजलजखत जवभागों के परामिा से तैयार होगी, ऄथाात:्-
(i) पयाावरण;
(ii) वन और वन्यजीव;
(iii) िहरी जवकास;
(iv) पयाटन;
(v) नगरपाजलका जवभाग;
(vi) राजस्ट् व जवभाग;
(vii) कृजष;
(viii) ग्रामीण जवकास;
(ix) गसचाइ और बाढ़ जनयंत्रण;
(x) जहमाचल प्रदेि राज्य प्रदषूण जनयंत्रण बोडा;
(xi) पंचायती राज; और
(xii) लोक जन मााण जव भाग।
(4) अंचजलक महायोजना ऄनमुोददत जवद्यमान भू-ईपयोग, ऄवसंरचना और दक्रयाकलापों पर कोइ जनबंधन ऄजधरोजपत नहीं करेगी जब तक दक आस ऄजधसूचना में आस प्रकार जवजनर्ददष् ट न हो और अचंजलक महायोजना सभी ऄवसंरचना और दक्रयाकलापों में, जो ऄजधक दक्षता और पाररजस्ट्थजतकी ऄनुकूल हों, का संवधान करेगी ।
(5) अंचजलक महायोजना में ऄनाच्छाददत क्षेत्रों के जीणोद्धार, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदा और नमी संरक्षण, स्ट्थानीय समुदायों की अवश्यकताओं तथा पाररजस्ट्थजतकी और पयाावरण से संबंजधत ऐसे ऄन्य पहलओुं, जजन पर ध्यान देना अवश्यक ह,ै के जलए ईपबंध होंगे ।
(6) अंचजलक महायोजना जवद्यमान और प्रस्ट्ताजवत भूजम ईपयोग जविेषताओं के ब्यौरों से ऄनुसमर्वथत मानजचत्र के साथ सभी जवद्यमान पूजा स्ट् थलों, ग्रामों और नगरीय बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजष क्षेत्रों, उपजाउ भूजम, हररत क्षेत्र जैसे ईद्यान और ईसी प्रकार के स्ट् थान, ईद्यान कृजष क्षेत्र, फलोईद्यान, झीलों और ऄन्य जल जनकायों का ऄभयांकन करेगी।
(7) अंचजलक महायोजना पाररजस्ट्थजतकी संवेदी जोन में जवकास को जवजनयजमत करने और पैरा-4 में सारणी में सूचीबद्ध प्रजतजषद्ध और जवजनयजमत दक्रयाकलापों का ऄनुपालन करने के जलए होगी और स्ट् थानीय समुदायों की जीजवका को सुरजक्षत करन ेके जलए पाररजस्ट्थजतकी ऄनुकूल जवकास को सुजनजित और ईसकी ऄजभवृजद्ध भी करेगी।
(8) अंचजलक महायोजना प्रादेजिक जवकास योजना की सह जवस्ट्तारी होगी ।
(9) राज्य सरकार द्वारा ऄनुमोददत अंचजलक महायोजना, मानीटरी सजमजत के जलए एक संदभा दस्ट्तावेज होगी तादक वह आस ऄजधसूचना के ईपबंधों के ऄनुसार जनगरानी के ऄपन ेकताव्यों का जनवाहन कर सके।
3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करने के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:-
(1) भू-ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन में वनों, ईद्यान कृजष क्षेत्रों, कृजष क्षेत्रों, मनोरंजन के प्रयोजनों के जलए जचजन्हत दकए गए पाकों और खुल ेस्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक संबद्ध जवकास दक्रयाकलापों के जलए ईपयोग या संपररवतान नहीं होगा:
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंत ुपाररजस्ट्थजतकी संवेदी जोन के भीतर आसमें जवजनर्ददष्ट प्रयोजनों से जभन्न प्रयोजनों के जलए कृजष और ऄन्य भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और यथा लागू और क्षेत्रीय नगर योजना ऄजधजनयम और केन्र्द्ीय सरकार या राज्य सरकार के ऄन्य जनयमों तथा जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन से, और आस ऄजधसूचना के ईपबंधों द्वारा स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को पूरा करन ेके जलए ऄनुज्ञात दकया जाएगा, जैसे-
(i) जवद्यमान सड़कों को चौड़ा करना और ईन्हें सुदढृ़ करना तथा नइ सड़कों का संजनमााण;
(ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रदषूण ईत्पन्न न करने वाल ेलघ ुईद्योग;
(iv) कुटीर ईद्योगों जजनके ऄंतगात ग्रामीण ईद्योग भी हैं; सुजवधाजनक भण्डार और स्ट्थानीय सुजवधाएं सहायक पाररजस्ट्थजतकी पयाटन जजसके ऄधीन गहृ वास सजम्मजलत ह;ै और
(v) पैरा 4 में ददए गए संवर्वधत दक्रयाकलाप:
परंत ुयह और दक प्रादेजिक नगर योजना ऄजधजनयम और राज्य सरकार के ऄन्य जनयमों और जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन और संजवधान के ऄनचु्छेद 244 के ईपबंधों या तत्समय प्रवृत्त जवजध के ईपबंधों के ऄनुपालन के जबना, जजसके ऄंतगात ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता) ऄजधजनयम, 2006 (2007 का 2) भी ह,ै वाजणजज्यक या औद्योजगक जवकास दक्रयाकलापों के जलए जनजातीय भूजम का ईपयोग ऄनुज्ञात नहीं होगा:
परंत ुयह और भी दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भू-ऄजभलेखों में ईपसंजात कोइ गलती, मानीटरी सजमजत के जवचार प्राप्त करन ेके पिात ्राज्य सरकार द्वारा प्रत्येक मामले में एक बार ठीक होगी और ईि गलती के सुधार की सूचना कें र्द्ीय सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय को दी जाएगी:
परंत ुयह और भी दक गलती के सुधार में आस ईप पैरा के ऄधीन यथा ईपबंजधत के जसवाय दकसी भी दिा में भू-ईपयोग का पररवतान सजम्मजलत नहीं होगा;
(ख) वनीकरण तथा वास जीणोद्धार दक्रयाकलापों सजहत ऄनप्रयुक् त या ऄनुत् पादक कृजष क्षते्रों में पुन: वनीकरण करने के प्रयास दकए जाएंगे।
(2) प्राकृजतक जल स्रोत.- अचंजलक महायोजना में सभी प्राकृजतक झरनों के अवाह क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण और नवीकरण के जलए योजना सजम् मजलत होगी और राज् य सरकार द्वारा ऐसे क्षेत्रों पर या ईनके जनकट जवकास दक्रयाकलाप प्रजतजषद्ध करने के बारे में जो ऐसे क्षेत्रों के जलए ऄजहतकर हो ऐसी रीजत से मागादिाक जसद्धांत तैयार दकए जाएंगे।
(3) पयाटन या पाररजस्ट्थजतकी पयाटन.- (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन दक्रयाकलाप या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन के जलए होगा। (ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य पयाटन जवभाग द्वारा राज्य पयाावरण और वन जवभाग के परामिा से तैयार होगी। (ग) पयाटन महायोजना अंचजलक महायोजना के एक घटक के रूप में होगी। (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जाएगी। (ङ) पाररजस्ट्थजतकी पयाटन संबंधी दक्रयाकलाप जनम्नानुसार जवजनयजमत होंगे, ऄथाात:्-
(i) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै नय ेवाजणजज्यक होटल और ररजॉटा के सजन्नमााण ऄनजु्ञात नहीं होंग:े [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 परंत,ु यह दक संरजक्षत के्षत्र की सीमा से एक दकलोमीटर की दरूी से परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक होटलों और ररजॉटा का स्ट्थापना केवल पूवा पररभाजषत और नामजनर्ददष्ट क्षेत्रों में पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए ही ऄनजु्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पयाटन दक्रयाकलापों या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार कें र्द्ीय सरकार के पयाावरण, वन और जलवायु पररवतान मतं्रालय के मागादिाक जसद्धांतों के द्वारा तथा राष् रीय ा याघ्र संरक्षण प्राजधकरण, द्वारा जारी पाररजस्ट्थजतकी–पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देत ेहुए (समय-समय पर यथा संिोजधत) जारी मागादिाक जसद्धांतों के ऄनुसार होगा;
(iii) अंचजलक महायोजना का ऄनुमोदन दकए जाने तक, पयाटन के जलए जवकास और जवद्यमान पयाटन दक्रयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्ददष्ट संवीक्षा और जनगरानी सजमजत की जसफाररि पर अधाररत संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नए होटल या ररसोटा या वाजणजज्यक स्ट्थापना का संजनमााण ऄनुज्ञात नहीं दकया जायेगा ।
(4) नसैर्वगक जवरासत.- पाररजस्ट्थजतकी संवेदी जोन में महत्वपूणा नैसर्वगक जवरासत के सभी स्ट्थलों जैसे जीन कोि अरजक्षत के्षत्र, िैल जवरचनाएं, जल प्रपातों, झरनों, घाटी मागों, ईपवनों, गुफाए,ं स्ट्थलों, भ्रमण, ऄश्वरोहण, प्रपातों अदद की पहचान की जाएगी और जवरासत संरक्षण योजना अंचजलक महायोजना के भाग के रुप में परररक्षण और संरक्षण के जलए तैयार की जाएगी ।
(5) मानव जनर्वमत जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, जिल्प-तथ्य, ऐजतहाजसक, स्ट्थापत्य, सौंदयापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और ईपक्षेत्रों पहचान और ईनके संरक्षण के जलए जवरासत योजना अंचजलक महायोजना के भाग के रुप में तयैार की जाएगी।
(6) ध् वजन प्रदषूण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदषूण (जवजनयमन और जनयंत्रण) जनयम, 2000 में ईपबंधों के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदषूण के जनयंत्रण और जनवारण का ऄनुपालन दकया जाएगा।
(7) वाय ुप्रदषूण.- पाररजस्ट्थजतकी संवेदी जोन में, वायु प्रदषूण के जनवारण और जनयंत्रण का वायु (प्रदषूण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया जाएगा।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन में ईपचाररत बजहस्राव का जनस्ट्सारण, साधारण मानकों के ईपबंधों के ऄनुसार पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अन ेवाले पयाावरणीय प्रदषूण के जनस्ट्सारण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक कठोर हो, के ईपबंधों के ऄनुसार होगा।
(9) ठोस ऄपजिष्ट.- ठोस ऄपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन में ठोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357(ऄ), तारीख 8 ऄप्रैल, 2016 के द्वारा प्रकाजित ठोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा;
(ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप ठोस ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन (आएसएम) ऄनुज्ञात दकया जा सकेगा।
(10) जैव जचदकत्सा ऄपजिष् ट.- जैव जचदकत्सा ऄपजिष् ट का प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन 343 (ऄ), तारीख 28 माचा, 2016, के द्वारा प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा;
(ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप जैव-जचदकत्सा ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(11) प्लाजस्ट्टक ऄपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सा.का.जन 340(ऄ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(12) जनमााण और जवध्वसं ऄपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सां.का.जन 317(ऄ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा ।
(13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत द्वारा प्रकाजित इ–ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(14) यानीय यातायात.- यातायात की यानीय गजतजवजधयां अवास के ऄनुकूल जवजनयजमत होंगी और आस संबंध में अंचजलक महायोजना में जविेष ईपबंध सजम्मजलत दकए जाएंगे और अंचजलक महायोजना के तैयार होने और राज्य सरकार के सक्षम प्राजधकारी द्वारा ऄनुमोददत होने तक, मानीटरी सजमजत सुसंगत ऄजधजनयमों और ईसके ऄधीन बनाए गए जनयमों और जवजनयमों के ऄनुसार यानीय दक्रयाकलापों के ऄनुपालन को मानीटर करेगी।
(15) यानीय प्रदषूण.- लाग ूजवजधयों के ऄनपुालन में वाहन प्रदषूण का जनवारण और जनयंत्रण दकया जाएगा और स्ट्वच्छक ईंधन अदद के ईपयोग के जलए प्रयास दकए जाएंगे।
(16) औद्योजगक इकाआया.ं- (i) राजपत्र में आस ऄजधसूचना के प्रकािन पर या ईसके पिात ्पाररजस्ट्थजतकी संवेदी जोन के भीतर कोइ नए प्रदजूषत ईद्योगों की स्ट्थापना की ऄनजु्ञा नहीं दी जाएगी;
(ii) केन्र्द्ीय प्रदषूण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक ऄजधसूचना में आस प्रकार जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन के भीतर केवल गैर-प्रदषूणकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि, गैर प्रदषूणकारी ईद्योगों को बढ़ावा ददया जाएगा।
(17) पहाड़ी ढलानों को सरंक्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) अंचजलक महायोजना पहाड़ी ढलानों पर क्षेत्रों का संकेत होगा जहां दकसी भी संजनमााण की ऄनजु्ञा नहीं दी जाएगी;
(ख) कटाव के एक ईच्च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनजु्ञा नहीं दी जाएगी।
4. पाररजस्ट्थजतकी संवदेी जोन में प्रजतजषद्ध या जवजनयजमत दकए जान ेवाल ेदक्रयाकलापों की सचूी.- पाररजस्ट्थजतकी संवेदी जोन में सभी दक्रयाकलाप पयाावरण ऄजधजनयम के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों जजसके ऄन्तगात तटीय जवजनयमन जोन, 2011 और पयाावरणीय समाघात जनधाारण ऄजधसूचना, 2006 और ऄन्य लागू जवजधयों के जजसमें वन (संरक्षण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53) सजम्मजलत हैं और दकय ेगये संिोधनों द्वारा िाजसत होंग ेऔर नीचे दी गइ सारणी में जवजनर्ददष्ट रीजत में जवजनयजमत होंगे, ऄथाात ्:- सारणी क्रम स.ं

1. वाजणजज्यक खनन, पत्थर ईत्खनन और ऄपघषाण आकाआयां । (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सदभावी स्ट्थानीय जनवाजसयों की घरेल ूअवश्यकताओं जजसमें मकानों के संजनमााण या मरम्मत के जलए धरती को खोदना सजम्मजलत ह,ै के जसवाय सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनज), पत्थर [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 क्रम स.ं
(1) दक्रयाकलाप
(2) वणान
(3) ईत्खनन और ऄपघषाण आकाआयां तत्काल प्रभाव से प्रजतजषद्ध होंगी;
(ख) खनन प्रचालन, 1995 की ररट याजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाद बनाम भारत संघ के मामल े में माननीय ईच्चतम न्यायालय के अदेि 4 ऄगस्ट्त, 2006 और 2012 की ररट याजचका (जसजवल) सं. 435 में गोवा फाईंडेिन बनाम भारत संघ के मामले में तारीख 21 ऄप्रलै, 2014 के अदेि के ऄनुसरण में होगा ।
2. प्रदषूण (जल, वाय,ु मृदा, ध्वजन, अदद) ईत्पन करने वाले ईद्योगों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन में कोइ नया ईद्योग लगाने और वतामान प्रदषूणकारी ईद्योगों का जवस्ट्तार करने की ऄनुज्ञा नहीं होगी:
परन्तु, केन्र्द्ीय प्रदषूण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनसुार, जब तक ऄजधसूचना में ऐसा जवजनर्ददष्ट न हों, पाररजस्ट्थजतकी संवेदी जोन के भीतर गरै- प्रदषूणकारी ईद्योगों को ऄनजु्ञात दकया जाएगा और आसके ऄजतररि गैर-प्रदषूणकारी कुटीर ईद्यागों को बढ़ावा ददया जाएगा।
3. बृहत जल जवदु्यत पररयोजना की स्ट्थापना । प्रजतजषद्ध।
4. दकसी पररसंकटमय पदाथा का ईपयोग या ईत्पादन या प्रसंस्ट्करण। प्रजतजषद्ध।
5. प्राकृजतक जल जनकायों या क्षेत्र भूजम में ऄनुपचाररत बजहस्रााव का जनस्ट्सारण । प्रजतजषद्ध।
6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन के भीतर नइ अरा जमलों की स्ट्थापना और जवद्यमान अरा जमलों का जवस्ट् तार ऄनुज्ञात नहीं होगा।
7. ईंट भट्टों की स्ट्थापना करना। प्रजतजषद्ध।
8. जलावन लकड़ी का वाजणजज्यक ईपयोग। प्रजतजषद्ध।
9. पोजलथीन बैगों का ईपयोग। प्रजतजषद्ध।
10. मछली पकड़ना और जिकार करना। प्रजतजषद्ध। अ. जवजनयजमत दक्रयाकलाप
11. वाजणजज्यक होटलों और ररसोटों की स्ट्थापना। पाररजस्ट्थजतकी पयाटन दक्रयाकलापों लघ ु ऄस्ट्थायी संरचनाओं के जसवाय संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै नए वाजणजज्यक होटल और ररसोटों को ऄनुज्ञात नहीं दकया जाएगा:
परंत,ु संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के परे या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक आनमें से, जो भी जनकट हो सभी नए पयाटन दक्रयाकलाप या जवद्यमान दक्रयाकलाप का जवस्ट्तार पयाटन महायोजना और यथा लागू मागादिी जसद्धांतों के ऄनुरुप होगा।
12. संजनमााण दक्रयाकलाप। (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट हो, दकसी भी प्रकार के नय ेवाजणजज्यक संजनमााण की ऄनुज्ञा नहीं होगी:
परंतु स्ट्थानीय लोगों को ऄपनी अवास सम्बन्धी जनम्नजलजखत अवश्यकताओं को पूरा करन े के जलए, पैरा 3 के ईप पैरा (1) में सूचीबद्ध दक्रयाकलापों सजहत ऄपने ईपयोग के जलए, ऄपनी भूजम में 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] क्रम स.ं

परंत ु यह और दक गैर–प्रदषूणकारी लघ ु ईद्योगों से संबंजधत संजनमााण दक्रयाकलाप लाग ूजनयमों और जवजनयमों, यदद कोइ हों, के ऄनुसार सक्षम प्राजधकारी की पूवा ऄनुमजत से जवजनयजमत दकए जाएंगे और वे न्यूनतम होंगे। (ख) एक दकलोमीटर क्षेत्र से परे ये अंचजलक महायोजना के ऄनुसार जवजनयजमत होंगे।
13. प्रदषूण ईत्पन्न न करन े वाले लघ ु ईद्योग। फरवरी, 2016 में केन्र्द्ीय प्रदषूण जनयंत्रण बोडा द्वारा जारी ईद्योगों में वगीकरण के ऄनुसार समय-समय पर यथा संिोजधत गरै- प्रदषूणकारी ईद्योग और ऄपररसंकटमय में, लघ ुऔर सेवा ईद्योग, कृजष, पुष्प कृजष, ईद्यान कृजष या पाररजस्ट्थजतकी संवेदी जोन से देिी सामग्री से ईत्पादों को ईत्पन्न करन े वाले कृजष अधाररत ईद्योग सक्षम प्राजधकारी द्वारा ऄनुज्ञात होंगे।
14. वृक्षों की कटाइ। (क) राज्य सरकार में सक्षम प्राजधकारी की पूवा ऄनुज्ञा के जबना वन, सरकारी या राजस्ट्व या जनजी भूजम पर या वनों में वृक्षों की कटाइ नहीं होगी । (ख) वृक्षों की कटाइ संबंजधत कें र्द्ीय या राज्य ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंध के ऄनुसार जवजनयजमत होग े।
15. वन ईत्पादों या गैर काष् ठ वन ईत्पादों का संग्रहण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
16. जवदु्यत और संचार टावरों का पररजनमााण और केबलों के जबछाए जाने और ऄन्य बुजनयादी ढांचे। लागू जवजधयों के ऄधीन जवजनयजमत (भूजमगत केबल जबछाने को बढ़ावा ददया जाएगा) होंग े।
17. नागररक सुख सुजवधाओं सजहत ऄवसंरचनाएं । न्यूनीकरण ईपायों को लागू जवजधयों, जनयमों और जवजनयमनों और ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाना ।
18. जवद्यमान सड़कों को चौड़ा करना और ईन्हें सुदढृ़ करना तथा नवीन सड़कों का संजनमााण । न्यूनीकरण ईपायों को लाग ूजवजधयों, जनयमों और जवजनयमनों तथा ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाएगा ।
19. पयाटन से संबंजधत ऄन्य दक्रयाकलाप जैसे गमा वायु गबु्बारें, हलेीकॉप्टर, ड्रोन, माआक्रोलाआटस, अदद द्वारा पाररजस्ट्थजतकी संवेदी जोन क्षते्र के उपर से ईड़ना जैसे दक्रयाकलाप करना। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
20. पहाड़ी ढालों और नदी तटों का संरक्षण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
21. राजत्र में याजनक यातायात का संचलन । लाग ू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए जवजनयजमत होंगे ।
22. स्ट्थानीय समुदायों द्वारा चल रही कृजष और बागवानी प्रथाओं के साथ दगु्धिाला, दगु्घ ईद्योग, कृजष और मछली पालन । स्ट्थानीय लोगों के ईपयोग के जलए लागू जवजधयों के ऄधीन ऄनुज्ञात होंगे ।
23. फमों, जनगम और कंपजनयों द्वारा बडे़ पैमान े पर वाजणजज्यक पिुओं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीय अवश्यकताओं को परूा करन े लागू जवजधयों के ऄनुसार (ऄन्यथा ईपबंजधत के जसवाय) जवजनयजमत होगा। [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 9 क्रम स.ं

24. प्राकृजतक जल जनकायों या सतही के्षत्र में पुनःचक्रण प्रवाह में ईपचाररत बजहस्रााव का जनस्ट्तारण । जल जनकायों में ईपचाररत ऄपजिष्ट जल या बजहस्रााव के जनस्ट्सारण से बचा जाएगा और ईपचाररत ऄपजिष्ट जल के पुन:चक्रण और पुन:ईपयोग के जलए प्रयास दकए जाएंगे। ऄन्यथा लागू जवजधयों के ऄनुसार ईपचाररत बजहस्रााव के पुनचाक्रण या प्रवाह के जनवाहन को जवजनयजमत दकया जाएगा।
25. सतही और भूजल का वाजणजज्यक जनष्कषाण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
26. ठोस ऄपजिष्ट का प्रबन्धन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
27. जवदेिी प्रजाजतयों का पररचय। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
28. पाररजस्ट्थजतकी पयाटन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
29. वाजणजज् यक सूचनापट्ट और होर्डडग। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
30. रैककग और जिजवर। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
31. फोटोग्राफी वाजणजज्यक। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे । आ. सवंर्वधत दक्रयाकलाप

35. कुटीर ईद्योगों जजसके ऄंतगात ग्रामीण कारीगर भी हैं। सदक्र य रूप से बढ़ावा ददया जाएगा।
36. नवीकरणीय उजाा और ईंधन का ईपयोग । बायोगैस, सौर प्रकाि, आत् यादद को बढ़ावा ददया जाएगा।
37. कृजष वाजनकी । सदक्र य रूप से बढ़ावा ददया जाएगा।
38. बागान लगाना और जड़ी बूरटयों का रोपण । सदक्र य रूप से बढ़ावा ददया जाएगा।
39. पाररजस्ट्थजतकी ऄनुकूल पररवहन का ईपयोग । सदक्र य रूप से बढ़ावा ददया जाएगा।
40. कौिल जवकास । सदक्र य रूप से बढ़ावा ददया जाएगा।
41. जनम्नीकृत भूजम या वन या वास की बहाली । सदक्र य रूप से बढ़ावा ददया जाएगा।
42. पयाावरणीय जागरुकता । सदक्र य रूप से बढ़ावा ददया जाएगा।
43. होटल और लॉज के पररसर की बाड़ लगाना। बढ़ावा ददया जाएगा ।
44. धार्वमक रैककग। बढ़ावा ददया जाएगा ।
5. पाररजस्ट्थजतकी संवदेी जोन ऄजधसचूना को मानीटर करन ेके जलए मानीटरी सजमजत- कें र्द्ीय सरकार, पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 3 की ईपधारा (3) के ऄधीन आस ऄजधसूचना के ईपबंधों को प्रभावी रुप से मानीटर करन ेके जलए मानीटरी सजमजत का गठन करती ह,ै जो जनम्नजलजखत से जमलकर बनेगी, ऄथाात:्- क्र.स.ं मानीटरी सजमजत का गठन पद
(i) मुख्य वन संरक्षक या वन संरक्षक, मंडी (जजसके पास भी प्रभार ह)ै ऄध् यक्ष;
(ii) मुख्य वन संरक्षक या वन संरक्षक, कुल्ल ू सह-ऄध् यक्ष;

(iii) वन्य जीव संरक्षण के के्षत्र में कायारत गरै सरकारी संगठन का एक प्रजतजनजध राज्य सरकार द्वारा मनोनीत दकया जायेगा। सदस्ट्य;
(iv) राज्य प्रदषूण जनयंत्रण बोडा के क्षेत्रीय कायाकारी ऄजभयंता सदस्ट्य;
(v) के्षत्र के वररष्ठ नगर जनयोजक सदस्ट्य;
(vi) पाररजस्ट्थजतकी और पयाावरण में एक जविेषज्ञ राज्य द्वारा नाजमत दकया जाएगा सदस्ट्य;
(vii) राज्य सरकार द्वारा नाजमत दकए जाने वाल ेजैव जवजवधता में एक जविेषज्ञ सदस्ट्य;
(viii) संभागीय वनाजधकारी, कुल्ल ू सदस्ट्य;
(ix) संभागीय वनाजधकारी (वन्यजीव) कुल्ल ू सदस्ट्य;
(x) संभागीय वनाजधकारी, जोजगन्दरनगर सदस्ट्य;
(xi) संभागीय वनाजधकारी, मंडी सदस्ट्य–सजचव।
6. जनदेि जनबधंन.- (1) मानीटरी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन को मानीटर करेगी।
(2) मानीटरी सजमजत का कायाकाल ऄगल ेअदेि होने तक दकया जाएगा, परंत ुयह दक सजमजत के गैर-सरकारी सदस्ट्यों को समय-समय पर राज्य सरकार द्वारा नामजनर्ददष्ट दकया जाएगा।
(3) ईन दक्रयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ.
1533 (ऄ), तारीख 14 जसतम्बर, 2006 की ऄनुसूची में सजम्मजलत हैं, और जो पाररजस्ट्थजतकी संवेदी जोन में अते हैं, आसके जो पैरा 4 के ऄधीन सारणी में यथा जवजनर्ददष्ट प्रजतजषद्ध दक्रयाकलापों के जसवाय मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईि ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरण ऄनापजत्त के जलए कें र्द्ीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को जनर्ददष्ट दकया जाएगा।
(4) ईन दक्रयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ. 1533 (ऄ) तारीख 14 जसतंबर, 2006 की ऄनुसूची में सजम्मजलत नहीं ह,ै और जो पाररजस्ट्थजतकी संवेदी जोन में अत ेहैं, आसके पैरा 4 के ऄधीन सारणी में यथाजवर्वनष्ट प्रजतजषद्ध दक्रलाकलापों के जसवाय मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईसे संबद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया जाएगा।
(5) मानीटरी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायुि ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का ईल्लघंन करता ह,ै पयाावरण ऄजधजनयम की धारा 19 के ऄधीन पररवाद फाआल करन ेके जलए सक्षम होगा।
(6) मानीटरी सजमजत मुद्दा दर मदु्दा के अधार पर ऄपेक्षाओं पर जनभार रहत े हुए संबद्ध जवभागों के प्रजतजनजधयों या जविेषज्ञों, औद्योजगक संगमों या संबद्ध पणधाररयों के प्रजतजनजधयों को ऄपन ेजवचार-जवमिा में सहायता के जलए अमंजत्रत कर सकेगी ।
(7) मानीटरी सजमजत प्रत्येक वषा की 31 माचा तक के ऄपने दक्रयाकलापों की वार्वषक कारावाइ ररपोटा राज् य के मुख् य वन् यजीव वाडान को ईपाबंध-V में संलग्न प्रोफामाा में ईक् त वषा के 30 जून तक प्रस्ट्ततु करेगी ।
(8) केन्र्द्ीय सरकार का पयाावरण, वन और जलवाय ुपररवतान मंत्रालय मानीटरी सजमजत को ऄपन ेकृत्यों के प्रभावी जनवाहन के जलए ऐसे जनदेि दे सकेगा, जो वह ठीक समझे ।

8. कोइ ऄन् य महत् वपूणा जवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 25th March, 2022 S.O. 1331(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 4048 (E), dated the 11th November, 2020, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 11th November, 2020;
AND WHEREAS, objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification were duly considered in the Ministry;
AND WHEREAS, the Nargu Wildlife Sanctuary is situated at a distance around 55 kilometres from Mandi, 30 kilometres from Joginder nagar in Mandi and Kullu district of Himachal Pradesh which provides home to a variety of endemic flora and fauna and the Sanctuary has several important values from ecological, faunal, floral, geomorphologic and recreational and research or educational perspective. The total area of the Sanctuary is 132.37 square kilometers;
[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 17 AND WHEREAS, Nargu Wildlife Sanctuary consists of Moist Deodar Forests,12 C1 (c), Moist Temperate Deciduous Forests 12/C1(e), Kharsu Oak Forests 12/C2(a), Sub-tropical Chir Pine Forest, Western Mixed Coniferous Forests, Western Himalaya Sub-alpine Fir Forest.
Important tree species available in the Sanctuary are deodar (Cedrus deodara), fir (Abies pindrop), kharsu (Quercus semicarpifolia), prunus (Prunus avium), maple (Acer spp), juglan (Juglan regia L), rhododendron (Rhododendron arboretum), celtis (Celtis australis L), fig (Ficus palmate), ban (Quercus leucutrichophora), etc;
AND WHEREAS, Nargu Wildlife Sanctuary is known to harbor an exceptional varieties of wildlife. The main species found in the Sanctuary are threatened species like, common leopard (Panthera pardus), barking deer (Muntiacus muntjak), black bear (Selenarctus thibetanus), ghoral (Nemorhaeadus goral), jackal (Canis aureus), Himalayan yellow throated marten (Martes flavigula), Himalayan civet (Pagoma larvata), flying squirrel (Petaurista petaurista). It is habitat of four species of pheasants out of seven species found in Himachal Pradesh and has been recognized as important bird area for Himalayan monal, endemic vulnerable species restricted to Himalayan region in India. Among other birds, white crested kalij, chukor, black and grey partridge. Among reptiles snakes, monitor lizard are of common occurrence;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Nargu Wildlife Sanctuary which are specified in paragraph 1 as the Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zones;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses
(v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 (zero) to 1.00 kilometres around the boundary of Nargu Wildlife Sanctuary, in Mandi and Kullu district in the State of Himachal Pradesh as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: -
1. Extent and Boundaries of Eco-sensitive Zone. – (1) The extent of Eco-sensitive Zone varies from 0 (zero) to 1.00 kilometres and the area of the Eco-sensitive Zone is 50.0425 square kilometres.
Note: Zero extent of Eco-sensitive Zone is due to continuation of the Nargu Wildlife Sanctuary with Dhauladhar Wildlife Sanctuary in North side and Khokhan Wildlife sanctuary towards the East Side.
(2) The boundary description and geo-coordinates of Nargu Wildlife Sanctuary and its Ecosensitive Zone is appended in Annexure-I.
(3) The maps of the Nargu Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB.
(4) The list of geo-coordinates of the boundary of Eco-Sensitive Zone of Nargu Wildlife Sanctuary are given in Annexure-III.
(5) The list of revenue villages inside the proposed Eco-sensitive Zone along with their geo coordinates at prominent points are given in Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with the local people and adhering to the stipulations given in this notification for approval of the competent authority of State.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan,namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal Department;
(vi) Revenue Department;
(vii) Agriculture;
(viii) Rural Development;
(ix) Irrigation and Flood Control;
(x) Himachal State Pollution Control Board;
(xi) Panchayati Raj; and
(xii) Public Works Department.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.
(9) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(10) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.–(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the Regional Town Planning Act and other rules and regulations of the Central Government or State Government as applicable and vide [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 19 provisions of this Notification, to meet the residential needs of the local residents and for activities such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(a) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.
(b) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(c) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Ecosensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.
(10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:-
(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016.
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 21 the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within the Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. (a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within the Eco Sensitive Zone;
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N.
Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted.
3. Establishment of major hydro-electric project.
Prohibited.
4. Use or production or processing of any hazardous substances.
Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited.
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited.
8. Commercial use of firewood. Prohibited.
9. Use of polythene bags. Prohibited.
10. Fishing and Hunting. Prohibited.
B. Regulated Activities
11. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for ecotourism activities:
Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of the Ecosensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
12. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph
(1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents.
Provided further that the construction activity related to small scale industries not causing pollution shall [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 23 be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
13. Small scale non polluting industries.
Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
14. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
15. Collection of Forest produce or Non-Timber Forest produce.
Regulated as per the applicable laws.
16. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws (underground cabling may be promoted).
17. Infrastructure including civic amenities.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 25 Sr. No. Constituent of the Monitoring Committee Designation

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be till further orders, provided that the nonofficial members of the Committee shall be nominated by the State Government from time to time.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures.- The Central Government and the State Government may specify additional measures, if any, for giving effect to the provisions of this notification.

8. Orders of Supreme Court, etc.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
