PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पयाावरण, वन और जलवाय ुपररवतान मतं्रालय ऄजधसचूना नइ ददल्ली, 13 जनवरी, 2022 का.अ. 172(ऄ).—प्रारुप ऄजधसूचना भारत के राजपत्र, ऄसाधारण में भारत सरकार के पयाावरण, वन और जलवायु पररवतान, मंत्रालय की ऄजधसूचना सं. का.अ. 4697(ऄ), तारीख 24 ददसम्बर, 2020, द्वारा प्रकाजित की गइ थी जजसमें ऐसे सभी व्यजियों से, जजनकी ईससे प्रभाजवत होने की संभावना थी, ईस तारीख से, जजसको ईि ऄजधसूचना को ऄन्तर्ववष्ट करन ेवाली राजपत्र की प्रजतयां जनता को ईपल्ध करा दी गइ थ,, सा ददन की ऄवजध के भीतर अ्ेप और सुझाव अमंजत्रत दकए गए थ;े और, ईि प्रारूप ऄजधसूचना को ऄन्तर्ववष्ट करन ेवाली राजपत्र की प्रजतयां जनता को तारीख 24 ददसम्बर, 2020, को ईपल्ध करा दी गइ थी; और, पूवोि प्रारुप ऄजधसूचना के प्रजतईत्तर में व्यजियों और पणधाररयों से कोइ अ्पे और सुझाव प्राप्त नह, हुए; और, कनाल िेरजंग राष्ट्रीय ईद्यान (जो पहल ेसंबलबारा राष्ट्रीय ईद्यान के नाम से जाना जाता था) 27.88 वगा दकलोमीटर ्ेत्रफल में फैला हुअ ह ैऔर जहमाचल प्रदेि राज्य में जसरमौर जजला में जस्ट्थत हैं; और, कनाल िेरजंग राष्ट्रीय ईद्यान को ऄजधसूचना सं. एफ.एफ.इ-बी-एफ(6)-11/2005-II/संबलबारा द्वारा तारीख 7 जून, 2013 से राष्ट्रीय ईद्यान का स्ट्तर प्रदान दकया गया था जो दक राष्ट्रीय ईद्यान स्ट्थाजनक वनस्ट्पजत और जीवजंतु की जवजवधता को वास प्रदान करता ह ैऔर पाररजस्ट्थजतकी, जीवजंतु, वनस्ट्पजत, भू-अकृजतवैज्ञाजनक और मनोरंजात्मक और ऄनुसंधान/िैज्क पररप्रेक्ष्य से काफी महत्त्वपूणा ह;ै स.ं 168] नइ ददल्ली, बहृस्ट् पजतवार, जनवरी 13, 2022/पौष 23, 1943 No. 168] NEW DELHI, THURSDAY, JANUARY 13, 2022/PAUSHA 23, 1943 सी.जी.-डी.एल.-अ.-13012022-232632 CG-DL-E-13012022-232632 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, राष्ट्रीय ईद्यान हररयाणा राज्य में कालेसर राष्ट्रीय ईद्यान और कालेसर वन्यजीव ऄभयारण्य के सरंज्त ्ेत्रों के साथ सीमाएं साझा करता ह ैऔर राजाजी राष्ट्रीय ईद्यान पूवा की ओर लगभग 8 दकलोमीटर में जस्ट्थत ह ैऔर यह ्ेत्र जहमालयन (जोन 2), िुष्क जोन (जोन 4) और गंगेरटक मैदानों (जोन 7) का प्रजतच्छेदन ह ैऔर वनस्ट्पजत और जीवजंत ु पजिमी जहमालय, पंजाब मैदान और उपरी गंगेरटक मैदान के अकषाण को दिााते ह;ै और, कनाल िेरजंग राष्ट्रीय ईद्यान में ईत्तरी ईष्णकरटबंधी अर्द्ा पणापाती वन, अर्द्ा जिवाजलक साल वन, ईत्तरी ईष्णकरटबंधी िुष्क पणापाती वन, िुष्क जिवाजलक साल वन अत ेहैं। कनाल िेरजंग राष्ट्रीय ईद्यान में और असपास मुख्य वनस्ट्पजत परकारे साल (िोरेया रोबुस्ट्टा), सेन (टेरजमनाजलया टोमेंटोसा), संदन (ओगेजनजनया डेलबर्वगयोआड्स), रोहीनी (माल्लोटुस दफजलजपपनेजसस), महुअ (मधुका लोंजगफोजलया), टेंद ु (जडओसपयरोस मलेनोजससलों), ओनला (आम्बजलका ऑदफदकनाजलस), ऄमलतास (कैजिया दफस्ट्तुला), जामुन (जसजजयम कुजमजन), अदद पाइ जाती ह;ै और, ्ेत्र में मुख्य जीवजंतु में तेंदअु (पेन्थेरा प्रड्यूस), बनजबलार (फेजलस चाईस), जसयार (कैजनस ऑररयस), जहमालयन पाल्म जसवेट (पागमुा लारवाटा), येलो थ्रोटेड मार्टटन (मारटेस फलाजवगुला), सांभर (एजससस यूनीसलोर), जचत्तीदार जहरण (एजससस एजससस), मुंजक (मुनटीसस मुनतजक), ्ल ूबुल (बोसेलाफुस रागोकामेलुस), गोरल (नेमोररहडुेस गोरल), बनैला सुऄर (सस स्ट्रोफा), सामान्य लगंूर (प्रेस्ऄयटेस आंटेल्लुस), ररसस मकाक (मकाका मुलाट्टा), साही (जहस्ट्रीसस आंजडका) पाए जात ेह;ै और, कनाल िेरजंग राष्ट्रीय ईद्यान में जिवाजलक और जहमालय की जवजिष्ट प्ी प्रजाजतयां जैसे मैरून ओररओल े (ओररओलुस रेजलजल), ऑरेंज हडे थ्रि (जोथेरा जसररना), व्हाआट कैपपड वाटर रेडस्ट्टाटा (चैमोरोर्वनस ल्यूकोसेफालस), पलमबेअईस वाटर रेडस्ट्टाटा (रहयाकोर्वनस फुलीजगनोसस), कजलज तीतर (लोफुरा लेकोमेलानसॅ), वालरीपर (जतचोडरोमा मुरारीया), का वास ह।ै ्ेत्र जततजलयों की 70 प्रजाजतयों और टाआगर बीटलस ्की कइ ऄन्य प्रजाजतयों को भी अश्रय प्रदान करता ह;ै और, ऐजतहाजसक ऄजभलेखों में कनाल िेरजंग राष्ट्रीय ईद्यान में हाजथयों की ईपजस्ट्थजत जनर्ददष्ट ह ैजो दक यमुना बैराज में हाआडल-चैनल, जो दक प्रवासी मागा को काटता ह ैके कारण ऄजनयजमत ह;ै और, कनाल िेरजंग राष्ट्रीय ईद्यान के चारों ओर के ्ेत्र को, जजसका जवस्ट्तार और सीमाएं आस ऄजधसूचना के पैराग्राफ 1 में जवजनर्ददष्ट हैं, पाररजस्ट्थजतकी, पयाावरणीय और जैव-जवजवधता की दजृष्ट से पाररजस्ट्थजतकी संवेदी जोन के रूप में सुरज्त और संरज्त करना तथा ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों की श्रेजणयों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजषद्ध करना अवश्यक ह;ै ऄतः, ऄब, केन्र्द्ीय सरकार, पयाावरण (संर्ण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ पर त पयाावरण (संर्ण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आस ऄजधसूचना में आसके पिात् पयाावरण ऄजधजनयम कहा गया ह)ै की ईपधारा (1)तथा धारा 3 की ईपधारा (2) के खंड (v) और खंड (xiv) और ईपधारा (3) के द्वारा प्रदत्त िजियों का प्रयोग करत ेहुए, जहमाचल प्रदेि राज्य के जसरमौर जजला के कनाल िेरजंग राष्ट्रीय ईद्यान की सीमा के चारों ओर िून्य से
8.064 दकलोमीटर तक जवस्ट्ताररत ्ेत्र को कनाल िेरजंग राष्ट्रीय ईद्यान के पाररजस्ट्थजतकी संवेदी जोन (जजसे आसमें आसके पश् चात् पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप में ऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार ह,ै ऄथाात ्:-
1. पाररजस्ट्थजतकी सवंदेी जोन का जवस्ट्तार और सीमा-(1) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार कनाल िेरजंग राष्ट्रीय ईद्यान की सीमा के चारों ओर िून्य से 8.064 दकलोमीटर के साथ 31.24 वगा दकलोमीटर तक जवस्ट्तृत ह।ै पाररजस्ट्थजतकी संवेदी जोन का िून्य जवस्ट्तार ईत्तर-पजिमी, दज्णी और दज्ण-पूवी भागों पर हररयाणा के कालेसर वन्यजीव ऄभयारण्य और कालेसर राष्ट्रीय ईद्यान के साथ जनकटवती सीमा के कारण ह।ै
(2) कनाल िेरजंग राष्ट्रीय ईद्यान और आसके पाररजस्ट्थजतकी संवेदी जोन की सीमा का जववरण ईपाबधं -I के रूप में संलग्न ह।ै
(3) सीमा जववरण और ऄ्ािंों और दिेांतरों के साथ पाररजस्ट्थजतकी संवेदी जोन को सीमांदकत करत ेहुए कनाल िेरजंग राष्ट्रीय ईद्यान के मानजचत्र ईपाबधं-IIक और ईपाबधं-IIख के रूप में संलग्न ह।ै
(4) कनाल िेरजंग राष्ट्रीय ईद्यान और पाररजस्ट्थजतकी संवेदी जोन की सीमा के भू- जनदेिांकों की सूची ईपाबधं-III की सारणी क और सारणी ख में दी गइ ह।ै
(5) मुख्य बबदओुं के भू-जनदेिांकों के साथ पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अन ेवाले ग्रामों की सूची ईपाबधं- IV के रूप में संलग्न ह।ै [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3
2. पाररजस्ट्थजतकी सवंदेी जोन के जलए अचंजलक महायोजना– (1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोजनों के जलए राजपत्र में आस ऄजधसूचना के प्रकािन की तारीख से दो वषा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और राज्य के स्म प्राजधकारी के ऄनुमोदन के जलए आस ऄजधसूचना में ददए गए ऄनुबंधों का पालन करत े हुए अंचजलक महायोजना तैयार करेगी और राज्य में स्म प्राजधकारी द्वारा जवजधवत ऄनुमोददत दकया जाएगा।
(2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना में जवजनर्ददष् ट दकए गए हैं, के ऄनुसार तथा सुसंगत कें र्द्ीय और राज् य जवजधयों के ऄनरुुप और कें र्द्ीय सरकार द्वारा जारी मागाजनदेिों, यदद कोइ हों, द्वारा तैयार होगी।
(3) अंचजलक महायोजना, ईि योजना में पाररजस्ट्थजतकी और पयाावरणीय बातों को समाकजलत करन े के जलए राज् य सरकार के जनम्नजलजखत जवभागों के परामिा से तैयार होगी, ऄथाात्:-
(i) पयाावरण;
(ii) वन और वन्यजीव;
(iii) कृजष;
(iv) राजस्ट् व;
(v) िहरी जवकास;
(vi) पयाटन;
(vii) ग्रामीण जवकास;
(viii) बसचाइ और बाढ़ जनयंत्रण;
(ix) नगरपाजलका;
(x) पंचायती राज;
(xi) जहमाचल प्रदेि राज्य प्रदषूण जनयंत्रण बोडा; और
(xii) लोक जन मााण जव भाग।
(4) अंचजलक महायोजना ऄनुमोददत जवद्यमान भू-ईपयोग, ऄवसंरचना और दरयाकलापों पर कोइ जनबंधन ऄजधरोजपत नह, करेगी जब तक दक आस ऄजधसूचना में आस प्रकार जवजनर्ददष् ट न हो और अचंजलक महायोजना सभी ऄवसंरचना और दरयाकलापों में, जो ऄजधक द्ता और पाररजस्ट्थजतकी ऄनुकूल हों, का संवधान करेगी ।
(5) अंचजलक महायोजना में ऄनाच्छाददत ्ेत्रों के जीणोद्धार, जवद्यमान जल जनकायों के संर्ण, अवाह ्ेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदा और नमी संर्ण, स्ट्थानीय समुदायों की अवश्यकताओं तथा पाररजस्ट्थजतकी और पयाावरण से संबंजधत ऐसे ऄन्य पहलुओं, जजन पर ध्यान देना अवश्यक ह,ै के जलए ईपबंध होंगे ।
(6) अंचजलक महायोजना जवद्यमान और प्रस्ट्ताजवत भूजम ईपयोग जविेषताओं के ्यौरों से ऄनुसमर्वथत मानजचत्र के साथ सभी जवद्यमान पूजा स्ट् थलों, ग्रामों और नगरीय बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजष ्ेत्रों, उपजाउ भूजम, हररत ्ेत्र जैसे ईद्यान और ईसी प्रकार के स्ट् थान, ईद्यान कृजष ्ेत्र, फलोईद्यान, झीलों और ऄन्य जल जनकायों का ऄभयांकन करेगी।
(7) अंचजलक महायोजना पाररजस्ट्थजतकी संवेदी जोन में जवकास को जवजनयजमत करन े के जलए प्रदकया प्रदान की जाएगी और सारणी में सूचीबद्ध पैरा-4 में प्रजतजषद्ध और जवजनयजमत दरयाकलापों का ऄनपुालन करेगी और स्ट् थानीय समुदायों की जीजवका को सुरज्त करने के जलए पाररजस्ट्थजतकी ऄनुकूल जवकास को सुजनजित और ईसकी ऄजभवृजद्ध भी करेगी।
(8) अंचजलक महायोजना प्रादेजिक जवकास योजना की सह जवस्ट्तारी होगी ।
(9) राज्य सरकार द्वारा ऄनुमोददत अंचजलक महायोजना आस ऄजधसूचना के ईपबंधों के ऄनुसार मानीटरी के ऄपन े कृत्यों को करने के जलए राज्य सरकार द्वारा मानीटरी सजमजत के जलए एक संदभा दस्ट्तावेज तैयार करेगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करन े के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:-
(1) भ-ूईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन में वनों, ईद्यान कृजष ्ेत्रों, कृजष ्ेत्रों, मनोरंजन के प्रयोजनों के जलए जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक संबद्ध जवकास दरयाकलापों के जलए ईपयोग या संपररवतान नह, होगा: परंत ुपाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क) में जवजनर्ददष्ट प्रयोजनों से जभन्न प्रयोजनों के जलए कृजष और ऄन्य भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और यथा लागू और ्ेत्रीय नगर योजना ऄजधजनयम और केन्र्द्ीय सरकार या राज्य सरकार के ऄन्य जनयमों तथा जवजनयमों के ऄधीन स्म प्राजधकारी के पूवा ऄनुमोदन से, और आस ऄजधसूचना के ईपबंधों द्वारा स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को पूरा करन ेके जलए ऄनुज्ञात दकया जाएगा, जैसे-
(i) जवद्यमान सड़कों को चौड़ा करना और ईन्हें सुदढृ़ करना तथा नइ सड़कों का संजनमााण;
(ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रदषूण ईत्पन्न न करन ेवाले लघु ईद्योग;
(iv) कुटीर ईद्योगों जजनके ऄंतगात ग्रामीण ईद्योग भी हैं; सुजवधाजनक भण्डार और स्ट्थानीय सुजवधाएं सहायक पाररजस्ट्थजतकी पयाटन जजसके ऄन्तगात गहृ वास सजम्मजलत ह;ै और
(v) पैरा 4 में ददए गए संवर्वधत दरयाकलाप: परंत ुयह और दक प्रादेजिक नगर योजना ऄजधजनयम और राज्य सरकार के ऄन्य जनयमों और जवजनयमों के ऄधीन स्म प्राजधकारी के पूवा ऄनुमोदन और संजवधान के ऄनचु्छेद 244 के ईपबंधों या तत्समय प्रवृत्त जवजध के ईपबंधों के ऄनुपालन के जबना, जजसके ऄंतगात ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता) ऄजधजनयम, 2006 (2007 का 2) भी ह,ै वाजणजज्यक या औद्योजगक जवकास दरयाकलापों के जलए जनजातीय भूजम का ईपयोग ऄनुज्ञात नह, होगा: परंत ुयह और भी दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भू-ऄजभलेखों में ईपसंजात कोइ गलती, मानीटरी सजमजत के जवचार प्राप्त करन ेके पिात ्राज्य सरकार द्वारा प्रत्येक मामले में एक बार ीक होगी और ईि गलती के सुधार की सूचना कें र्द्ीय सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय को दी जाएगी: परंत ुयह और भी दक गलती के सुधार में आस ईप पैरा के ऄधीन यथा ईपबंजधत के जसवाय दकसी भी दिा में भू-ईपयोग का पररवतान सजम्मजलत नह, होगा। (ख) वनीकरण तथा वास जीणोद्धार दरयाकलापों सजहत ऄनप्रयसु त या ऄनुत् पादक कृजष ्ेत्रों में पुन: वनीकरण करने के प्रयास दकए जाएंगे।
(2) प्राकृजतक जल स्रोत.- अचंजलक महायोजना में सभी प्राकृजतक झरनों के अवाह ्ेत्रों की पहचान की जाएगी और ईनके संर्ण और नवीकरण के जलए योजना सजम् मजलत होगी और राज् य सरकार द्वारा ऐसे ्ते्रों पर या ईनके जनकट जवकास दरयाकलाप प्रजतजषद्ध करन ेके बारे में जो ऐसे ्ेत्रों के जलए ऄजहतकर हो ऐसी रीजत से मागादिाक जसद्धांत तैयार दकए जाएगंे।
(3) पयाटन या पाररजस्ट्थजतकी पयाटन.- (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन दरयाकलाप या जवद्यमान पयाटन दरयाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन के जलए होगा; (ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य पयाटन जवभाग द्वारा राज्य पयाावरण और वन जवभाग के परामिा से तैयार होगी; (ग) पयाटन महायोजना अंचजलक महायोजना के एक घटक के रूप में होगी; (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन ्मता के अधार पर तैयार की जाएगी; (ङ) पाररजस्ट्थजतकी पयाटन संबंधी दरयाकलाप जनम्नानुसार जवजनयजमत होंग,े ऄथाात:्- [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5
(i) संरज्त ्ेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै नय ेवाजणजज्यक होटल और ररजॉटा के सजन्नमााण ऄनजु्ञात नह, होंग:े परंत,ु यह दक संरज्त ्ेत्र की सीमा से एक दकलोमीटर की दरूी से परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक होटलों और ररजॉटा का स्ट्थापना केवल पूवा पररभाजषत और नामजनर्ददष्ट ्ेत्रों में पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए ही ऄनुज्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पयाटन दरयाकलापों या जवद्यमान पयाटन दरयाकलापों का जवस्ट्तार कें र्द्ीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय के मागादिाक जसद्धांतों के द्वारा तथा राष् रीय व् याघ्र स संर्ण प्राजधकरण, द्वारा जारी पाररजस्ट्थजतकी– पयाटन, पाररजस्ट्थजतकी-जि्ा और पाररजस्ट्थजतकी-जवकास पर बल देत े हुए (समय-समय पर यथा संिोजधत) जारी मागादिाक जसद्धांतों के ऄनुसार होगा;
(iii) अंचजलक महायोजना का ऄनुमोदन दकए जाने तक, पयाटन के जलए जवकास और जवद्यमान पयाटन दरयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्ददष्ट संवी्ा और मानीटरी सजमजत की जसफाररि पर अधाररत संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नए होटल या ररसोटा या वाजणजज्यक स्ट्थापना का संजनमााण ऄनुज्ञात नह, दकया जायेगा।
(4) नसैर्वगक जवरासत.- पाररजस्ट्थजतकी संवेदी जोन में महत्वपूणा नैसर्वगक जवरासत के सभी स्ट्थलों जैसे जीन कोि अरज्त ्ेत्र, िैल जवरचनाएं, जल प्रपातों, झरनों, घाटी मागों, ईपवनों, गुफाए,ं स्ट्थलों, भ्रमण, ऄश्वरोहण, प्रपातों अदद की पहचान की जाएगी और जवरासत संर्ण योजना अंचजलक महायोजना के भाग के रुप में पररर्ण और संर्ण के जलए तैयार की जाएगी।
(5) मानव जनर्वमत जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, जिल्प-तथ्य, ऐजतहाजसक, स्ट्थापत्य, सौंदयापूरक और सांस्ट्कृजतक महत्व के ्ेत्रों की और ईप्ेत्रों की पहचान और ईनके संर्ण के जलए जवरासत योजना अंचजलक महायोजना के भाग के रुप में तैयार की जाएगी।
(6) ध् वजन प्रदषूण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदषूण (जवजनयमन और जनयंत्रण) जनयम, 2000 में जनयत ईपबंधों के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदषूण के जनयंत्रण और जनवारण का ऄनुपालन दकया जाएगा।
(7) वाय ुप्रदषूण.- पाररजस्ट्थजतकी संवेदी जोन में, वायु प्रदषूण के जनवारण और जनयंत्रण का वाय ु(प्रदषूण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया जाएगा।
(8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेदी जोन में ईपचाररत बजहस्राव का जनस्ट्सरण, साधारण मानकों के ईपबंधों के ऄनुसार पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अन ेवाल ेपयाावरणीय प्रदषूण के जनस्ट्सरण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक क ोर हो, के ईपबंधों के ऄनुसार होगा।
(9) ोस ऄपजिष्ट.- ोस ऄपजिष्ट का जनपटान और प्रबंधन जनम्नानसुार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन में ोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357(ऄ), तारीख 8 ऄप्रैल, 2016 के द्वारा प्रकाजित ोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप ोस ऄपजिष्ट का सुरज्त और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा।
(10) जवै जचदकत्सा ऄपजिष् ट.- जैव जचदकत्सा ऄपजिष् ट का प्रबंधन जनम्नानुसार दकया जाएगा:- 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन 343 (ऄ), तारीख 28 माचा, 2016, के द्वारा प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप जैव-जचदकत्सा ऄपजिष्ट का सुरज्त और पयाावरण-ऄनकूुल प्रबंधन ऄनुज्ञात दकया जा सकेगा।
(11) पलाजस्ट्टक ऄपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में पलाजस्ट्टक ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं. सा.का.जन 340(ऄ), तारीख 18 माचा, 2016 द्वारा प्रकाजित पलाजस्ट्टक ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(12) जनमााण और जवध्वसं ऄपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सां.का.जन 317(ऄ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा ।
(13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत द्वारा प्रकाजित इ–ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(14) यानीय यातायात.- यातायात की यानीय गजतजवजधयां अवास के ऄनुकूल जवजनयजमत होंगी और आस संबंध में अंचजलक महायोजना में जविेष ईपबंध सजम्मजलत दकए जाएंगे और अंचजलक महायोजना के तैयार होने और राज्य सरकार के स्म प्राजधकारी द्वारा ऄनुमोददत होने तक, मानीटरी सजमजत सुसंगत ऄजधजनयमों और ईसके ऄधीन बनाए गए जनयमों और जवजनयमों के ऄनुसार यानीय दरयाकलापों के ऄनुपालन की मानीटरी करेगी।
(15) यानीय प्रदषूण.- लाग ूजवजधयों के ऄनुपालन में वाहन प्रदषूण का जनवारण और जनयंत्रण दकया जाएगा और स्ट्वच्छक ईंधन के ईपयोग के जलए प्रयास दकए जाएंगे।
(16) औद्योजगक इकाआया.ं- (क) राजपत्र में आस ऄजधसूचना के प्रकािन पर या ईसके पिात ्पाररजस्ट्थजतकी संवेदी जोन के भीतर कोइ नए प्रदजूषत ईद्योगों की स्ट्थापना की ऄनजु्ञा नह, दी जाएगी। (ख) केन्र्द्ीय प्रदषूण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में आस प्रकार जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन के भीतर केवल गैर-प्रदषूणकारी ईद्योगों को ऄनजु्ञात दकया जाएगा और आसके ऄजतररि, गैर प्रदषूणकारी ईद्योगों को बढ़ावा ददया जाएगा।
(17) पहाड़ी ढलानों को सरं्ण.- पहाड़ी ढलानों का संर्ण जनम्नानसुार होगा:- (क) अंचजलक महायोजना पहाड़ी ढलानों पर ्ेत्रों का संकेत होगा जहां दकसी भी संजनमााण की ऄनजु्ञा नह, दी जाएगी; (ख) कटाव के एक ईच्च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनजु्ञा नह, दी जाएगी।
4. पाररजस्ट्थजतकी सवंदेी जोन में प्रजतजषद्ध और जवजनयजमत दकए जान ेवाल ेदरयाकलापों की सचूी.- पाररजस्ट्थजतकी संवेदी जोन में सभी दरयाकलाप पयाावरण ऄजधजनयम के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों जजसके ऄन्तगात तटीय जवजनयमन जोन, 2011 और पयाावरणीय समाघात जनधाारण ऄजधसूचना, 2006 और ऄन्य लाग ूजवजधयों के जजसमें वन (संर्ण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्यजीव (संर्ण) ऄजधजनयम, 1972 (1972 का 53) सजम्मजलत हैं और दकये गये संिोधनों द्वारा िाजसत होंग ेऔर नीचे दी गइ सारणी में जवजनर्ददष्ट रीजत में जवजनयजमत होंगे, ऄथाात ्:- [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 सारणी रम स.ं दरयाकलाप वणान क. प्रजतजषद्ध दरयाकलाप
1. वाजणजज्यक खनन, पत्थर ईत्खनन और ऄपघषाण आकाआयां । (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर वास्ट्तजवक स्ट्थानीय जनवाजसयों की घरेल ूअवश्यकताओं जजसमें मकानों के संजनमााण या मरम्मत के जलए धरती को खोदना सजम्मजलत ह,ै के जसवाय सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनज), पत्थर ईत्खनन और ऄपघषाण आकाआयां तत्काल प्रभाव से प्रजतजषद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट याजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाद बनाम भारत संघ के मामल े में माननीय ईच्चतम न्यायालय के अदेि 4 ऄगस्ट्त, 2006 और 2012 की ररट याजचका (जसजवल) सं. 435 में गोवा फाईंडेिन बनाम भारत संघ के मामले में तारीख 21 ऄप्रलै, 2014 के अदेि के ऄनुसरण में होगा ।
2. प्रदषूण (जल, वाय,ु मृदा, ध्वजन, अदद) ईत्पन करने वाले ईद्योगों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन में कोइ नया ईद्योग लगाने और वतामान प्रदषूणकारी ईद्योगों का जवस्ट्तार करने की ऄनुज्ञा नह, होगी: परन्तु, केन्र्द्ीय प्रदषूण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में ऐसा जवजनर्ददष्ट न हों, पाररजस्ट्थजतकी संवेदी जोन के भीतर गरै- प्रदषूणकारी ईद्योगों को ऄनजु्ञात दकया जाएगा और आसके ऄजतररि गैर-प्रदषूणकारी कुटीर ईद्यागों को बढ़ावा ददया जाएगा।
3. बृहत जल जवद्यतु पररयोजना की स्ट्थापना । प्रजतजषद्ध।
4. दकसी पररसंकटमय पदाथा का ईपयोग या ईत्पादन या प्रसंस्ट्करण। प्रजतजषद्ध।
5. प्राकृजतक जल जनकायों या ्ेत्र भूजम में ऄनुपचाररत बजहस्रााव का जनस्ट्सरण । प्रजतजषद्ध।
6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन के भीतर नइ अरा जमलों की स्ट्थापना और जवद्यमान अरा जमलों का जवस्ट् तार ऄनुज्ञात नह, होगा।
7. ईंट भट्टों की स्ट्थापना करना। प्रजतजषद्ध। अ. जवजनयजमत दरयाकलाप
8. वाजणजज्यक होटलों और ररसोटों की स्ट्थापना। पाररजस्ट्थजतकी पयाटन दरयाकलापों लघ ु ऄस्ट्थायी संरचनाओं के जसवाय संरज्त ्ेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] नए वाजणजज्यक होटल और ररसोटों को ऄनुज्ञात नह, दकया जाएगा: परंत,ु यह दक संरज्त ्ेत्र की सीमा से एक दकलोमीटर के परे या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक आनमें से, जो भी जनकट हो सभी नए पयाटन दरयाकलाप या जवद्यमान दरयाकलाप का जवस्ट्तार पयाटन महायोजना और यथा लाग ूमागादिी जसद्धांतों के ऄनुरुप होगा।
9. संजनमााण दरयाकलाप। (क) संरज्त ्ेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट हो, दकसी भी प्रकार के नय ेवाजणजज्यक संजनमााण की ऄनुज्ञा नह, होगी: परंत ु यह दक स्ट्थानीय लोगों को ऄपनी अवास सम्बन्धी जनम्नजलजखत अवश्यकताओं को पूरा करने के जलए, पैरा 3 के ईप पैरा (1) में सूचीबद्ध दरयाकलापों सजहत ऄपन े ईपयोग के जलए, ऄपनी भूजम में भवन ईप-जवजधयों के ऄनुसार, संजनमााण करने की ऄनुज्ञा होगी: परंत ुयह दक, गैर–प्रदषूणकारी लघु ईद्योगों से संबंजधत संजनमााण दरयाकलाप लागू जनयमों और जवजनयमों, यदद कोइ हों, के ऄनुसार स्म प्राजधकारी की पूवा ऄनुमजत से जवजनयजमत दकए जाएंग ेऔर वे न्यूनतम होंगे। (ख) एक दकलोमीटर ्ेत्र से परे ये अंचजलक महायोजना के ऄनुसार जवजनयजमत होंगे।
10. प्रदषूण ईत्पन्न न करन े वाले लघ ु ईद्योग। फरवरी, 2016 में केन्र्द्ीय प्रदषूण जनयंत्रण बोडा द्वारा जारी ईद्योगों में वगीकरण के ऄनुसार समय-समय पर यथा संिोजधत गरै- प्रदषूणकारी ईद्योग और ऄपररसंकटमय में, लघ ुऔर सेवा ईद्योग, कृजष, पुष्प कृजष, ईद्यान कृजष या पाररजस्ट्थजतकी संवेदी जोन से देिी सामग्री से ईत्पादों को ईत्पन्न करन े वाले कृजष अधाररत ईद्योग स्म प्राजधकारी द्वारा ऄनुज्ञात होंगे।
11. वृ्ों की कटाइ। (क) राज्य सरकार में स्म प्राजधकारी की पूवा ऄनुज्ञा के जबना वन, सरकारी या राजस्ट्व या जनजी भूजम पर या वनों में वृ्ों की कटाइ नह, होगी । (ख) वृ्ों की कटाइ संबंजधत कें र्द्ीय या राज्य ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंध के ऄनुसार जवजनयजमत होग े।
12. वन ईत्पादों या गैर काष् वन ईत्पादों का संग्रहण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
13. जवद्युत और संचार टावरों का पररजनमााण और केबलों के जबछाए जाने और ऄन्य बुजनयादी ढांचे। लाग ूजवजधयों के ऄधीन जवजनयजमत होंग े(भूजमगत केबल के जबछाए जाने को बढ़ावा ददया जा सकेगा)।
14. नागररक सुख सुजवधाओं सजहत ऄवसंरचनाएं । न्यूनीकरण ईपायों को लागू जवजधयों, जनयमों और जवजनयमनों और ईपल्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाना ।
15. जवद्यमान सड़कों को चौड़ा करना और ईन्हें सुदढृ़ करना तथा नवीन सड़कों का संजनमााण । न्यूनीकरण ईपायों को लाग ूजवजधयों, जनयमों और जवजनयमनों तथा ईपल्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाएगा । [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 9
16. पयाटन से संबंजधत ऄन्य दरयाकलाप जैसे गमा वायु गु् बारें, हलेीकॉपटर, ड्रोन, माआरोलाआटस, अदद द्वारा पाररजस्ट्थजतकी संवेदी जोन ्ते्र के उपर से ईड़ना जैसे दरयाकलाप करना। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
17. पहाड़ी ढालों और नदी तटों का संर्ण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
18. राजत्र में याजनक यातायात का संचलन । लाग ू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए जवजनयजमत होंगे ।
19. स्ट्थानीय समुदायों द्वारा चल रही कृजष और बागवानी प्रथाओं के साथ दगु्धिाला, दगु्घ ईद्योग, कृजष और मछली पालन । स्ट्थानीय लोगों के ईपयोग के जलए लागू जवजधयों के ऄधीन ऄनुज्ञात होंगे ।
20. प्राकृजतक जल जनकायों या सतही ्ेत्र में ईपचाररत बजहस्रााव का जनस्ट्तारण । जल जनकायों में ईपचाररत ऄपजिष्ट जल या बजहस्रााव के जनस्ट्सारण से बचा जाएगा और ईपचाररत ऄपजिष्ट जल के पनु:चरण और पुन:ईपयोग के जलए प्रयास दकए जाएंग;े ऄन्यथा लाग ू जवजधयों के ऄनुसार ईपचाररत बजहस्रााव के पुनचारण या प्रवाह के जनवाहन को जवजनयजमत दकया जाएगा।
21. सतही और भूजल का वाजणजज्यक जनष्कषाण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
22. फमों, जनगम और कंपजनयों द्वारा बडे़ पैमान े पर वाजणजज्यक पिुओं और कुसकुट फामों की स्ट्थापना । स्ट्थानीय अवश्यकताओं को परूा करन े के जलए लागू जवजधयों के ऄधीन जवजनयजमत होंगे ।
23. खुल े कंुअ, बोर कंुअ, अदद कृजष और ऄन्य ईपयोग के जलए । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
24. ोस ऄपजिष्ट का प्रबन्धन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
25. जवदेिी प्रजाजतयों को लाना। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
26. पाररजस्ट्थजतकी पयाटन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
27. पोजलथीन बैगों का ईपयोग। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
28. वाजणजज् यक सूचनापट्ट और होर्डडग। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे । आ. सवंर्वधत दरयाकलाप
29. वषाा जल संचयन। सदर य रूप से बढ़ावा ददया जाएगा।
30. जैजवक खेती। सदर य रूप से बढ़ावा ददया जाएगा।

5. पाररजस्ट्थजतकी सवंदेी जोन ऄजधसचूना की मानीटरी के जलए मानीटरी सजमजत.- आस ऄजधसूचना के ईपबंधों की प्रभावी मानीटरी के जलए, कें र्द्ीय सरकार, पयाावरण (संर्ण) ऄजधजनयम, 1986 (1986 का 29) की धारा 3 की ईपधारा
(3) के ऄधीन मानीटरी सजमजत का ग न करती ह,ै जो जनम्नजलजखत से जमलकर बनगेी, ऄथाात:्- र.स.ं मानीटरी सजमजत का ग न पद
(i) ऄंचल प्रभारी, नाहन वन ऄंचल, नाहन ऄध् य्;
(ii) राज्य सरकार द्वारा पयाावरण के ्ेत्र में काम करन ेवाल ेगरै-सरकारी संग न के प्रजतजनजध को नाजमत दकया जाएगा सदस्ट्य;
(iii) राज्य प्रदषूण जनयंत्रण बोडा के ्ेत्रीय कायाकारी ऄजभयंता सदस्ट्य;
(iv) ्ेत्र के वररष्ठ नगर जनयोजक सदस्ट्य;
(v) पाररजस्ट्थजतकी और पयाावरण के ्ेत्र में एक जविेषज्ञ राज्य सरकार द्वारा नाजमत दकया जाएगा सदस्ट्य;
(vi) राज्य सरकार द्वारा नाजमत दकया जाने वाला राज्य जैव जवजवधता बोडा का सदस्ट्य सदस्ट्य;
(vii) संभागीय वन ऄजधकारी (वन्यजीव), जिमला सदस्ट्य- सजचव
6. जनदिे-जनबधंन.- (1) मानीटरी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन को मानीटरी करेगी।
(2) मानीटरी सजमजत का कायाकाल ऄगल ेअदेि होने तक दकया जाएगा, परंत ुयह दक सजमजत के गरै-सरकारी सदस्ट्यों को समय-समय पर राज्य सरकार द्वारा नामजनर्ददष्ट दकया जाएगा।
(3) ईन दरयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ. 1533 (ऄ), तारीख 14 जसतम्बर, 2006 की ऄनुसूची में सजम्मजलत हैं, और जो पाररजस्ट्थजतकी संवेदी जोन में अत े हैं, जसवाय आसके जो पैरा 4 के ऄधीन सारणी में यथा जवजनर्ददष्ट प्रजतजषद्ध दरयाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवी्ा की जाएगी और ईि ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरण ऄनापजत्त के जलए कें र्द्ीय सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय को जनर्ददष्ट दकया जाएगा।
32. कुटीर ईद्योगों जजसके ऄंतगात ग्रामीण कारीगर भी हैं। सदर य रूप से बढ़ावा ददया जाएगा।
33. नवीकरणीय उजाा और ईंधन का ईपयोग । बायोगैस, सौर प्रकाि, आत् यादद को बढ़ावा ददया जाएगा।
34. कृजष वाजनकी । सदर य रूप से बढ़ावा ददया जाएगा।
35. बागान लगाना और जड़ी बूरटयों का रोपण । सदर य रूप से बढ़ावा ददया जाएगा।

(5) मानीटरी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायुि ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का ईल्लंघन करता ह,ै पयाावरण ऄजधजनयम की धारा 19 के ऄधीन पररवाद फाआल करन ेके जलए स्म होगा।
(6) मानीटरी सजमजत मुद्दा दर मुद्दा के अधार पर ऄपे्ाओं पर जनभार रहत ेहुए संबद्ध जवभागों के प्रजतजनजधयों या जविेषज्ञों, औद्योजगक संगमों या संबद्ध पणधाररयों के प्रजतजनजधयों को ऄपन ेजवचार-जवमिा में सहायता के जलए अमंजत्रत कर सकेगी ।
(7) मानीटरी सजमजत प्रत्येक वषा की 31 माचा तक के ऄपने दरयाकलापों की वार्वषक कारावाइ ररपोटा राज् य के मुख् य वन् यजीव वाडान को ईपाबंध-V में संलग्न प्रोफामाा में ईस त वषा के 30 जून तक प्रस्ट्ततु करेगी ।
(8) केन्र्द्ीय सरकार का पयाावरण, वन और जलवाय ुपररवतान मंत्रालय मानीटरी सजमजत को ऄपने कृत्यों के प्रभावी जनवाहन के जलए ऐसे जनदेि दे सकेगा, जो वह ीक समझे ।
7. ऄजतररस त ईपाय.- आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए कें र्द्ीय सरकार और राज् य सरकार, ऄजतररस त ईपाय, यदद कोइ हों, जवजनर्ददष् ट कर सकेंगी।

8. कोइ ऄन् य महत् वपूणा जवषय । [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 17 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 13th January, 2022 S.O. 172(E) —WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O 4697 (E), dated the 24 th December, 2020, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 24 th December, 2020; AND WHEREAS, no objection and suggestion were received from persons and stakeholders in response to the aforesaid draft notification; AND WHEREAS, the Col. Sher Jung National Park (also known as Simbalbara National Park) is spread over an area of 27.88 square kilometres and is located in District Sirmour in the State of Himachal Pradesh; AND WHEREAS, the Col. Sher Jung National Park was given the status of National Park with effect from the 7 th June, 2013 vide notification no. FFE-B-F(6)-11/2005-II/Simbalbara which provides home to a variety of endemic flora and fauna and also has several important values from ecological, faunal, floral, geomorphologic and recreational and research/educational perspective; AND WHEREAS, the Col. Sher Jung National Park shares boundaries with the protected areas of Kalesar National Park and Kalesar Wildlife Sanctuary in the state of Haryana and Rajaji National Park is located at about 8 kilometres towards east and the area occurs at the intersection of Himalayan (Zone 2), Arid Zone (Zone 4) and Gangetic plains (Zone 7) and the flora and fauna shows affinity to Western Himalaya, Punjab plains and Upper Gangetic plains; AND WHEREAS, the Col. Sher Jung National Park consists of Northern Tropical Moist deciduous forest, Moist Shiwalik Sal forests, Northern Tropical Dry Deciduous forests, Dry Shiwalik Sal forests. The major vegetation found in and around of Col. Sher Jung National Park are sal (Shorea robusta), sain (Terminalia tomentosa), sandan (Ougeninia dalbergioides), rohini (Mallotus philippinensis), mahua (Madhuca longifolia), tendu (Diospyros melanoxylon), Aonla (Emblica officinalis), Amaltas(Cassia fistula), Jamun (Syzgium cumini) etc; AND WHEREAS, the major fauna found in the area are leopard (Panthera pardus), jungle cat (Felis chaus), jackal (Canis aureus), Himalaya palm civet (Paguma larvata), yellow throated marten (Martes flavigula), sambar (Axis unicolor), spotted deer (Axis axis), barking deer (Muntiacus muntjac), blue bull (Boselaphus tragocamelus), goral (Nemorrhaedus goral), wild pig (Sus scrofa), common langur (Presbytes entellus), Rhesus macaque (Macaca mulatta), porcupine (Hystrix indica); AND WHEREAS, the Col. Sher Jung National Park harbours avi-faunal species typical to Shiwaliks and Himalayas such as maroon oriole (Oriolus traillii), orange headed thrush (Zoothera citrinae), white capped water redstart (Chaimarrornis leucocephalus), plumbeous water redstart (Rhyacornis fuliginosus), Kalij pheasant (Lophura leucomelanos), wallcreeper (Tichodroma muraria). The area also supports seventy species of butterflies and several other species of tiger beetles; AND WHEREAS, the historical records indicated the presence of elephants in the Col. Sher Jung National Park which are now believed to be occasional due the hydel channel at Yamuna barrage which cut off the migratory routes; AND WHEREAS, it is necessary to conserve and protect the area of Col. Sher Jung National Park, the extent and boundaries of which are specified in paragraph 1, as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from zero to 8.064 kilometres around the boundary of Col. Sher Jung National Park, in Sirmour District in the State of Himachal Pradesh as the Col. Sher Jung National Park Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be of 31.24 square kilometres with an extent of zero to 8.064 kilometres around the boundary of Col. Sher Jung National Park. Zero extent of Eco-sensitive Zone is due to contiguous border with Kalesar Wildlife Sanctuary and Kalesar National Park of Haryana on north-western, southern and south-eastern sides.
(2) The boundary description of Col. Sher Jung National Park and its Eco-sensitive Zone is appended in Annexure-I.
(3) The maps of the Col. Sher Jung National Park demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB.
(4) The lists of geo co-ordinates of the boundary of Col. Sher Jung National Park and Eco-sensitive Zone are given in Table A and Table B of Annexure-III.
(5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purposes of the Ecosensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with the local people and adhering to the stipulations given in this notification and get it duly approved by the competent authority in the State.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Himachal Pradesh State Pollution Control Board; and

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved by the State Government shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into the areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per the Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, ecoeducation and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.-Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 21
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by the State Government, whichever is more stringent.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.
(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:-
(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28 th March,
2016.
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industry shall be permitted to be set up within the Eco-sensitive Zone.
(b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:- 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco- Sensitive Zone;
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (water, air, soil, noise, etc.). New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that, non-polluting industries shall be allowed within the Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project. Prohibited.
4. Use or production or processing of any hazardous substance. Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited.
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited. B. Regulated Activities
8. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 23 shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per the building bye-laws to meet the residential needs of the local residents:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
10. Small scale non-polluting industries. Non-polluting industries as per the classification of industries issued by the Central Pollution Control Board in February, 2016 as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
11. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.
12. Collection of Forest Produce or Non-Timber Forest Produce. Regulated under applicable laws.
13. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under the applicable laws (underground cabling may be promoted).
14. Infrastructure including civic amenities. Taking measures of mitigation, as per the applicable laws, rules and regulation and available guidelines.
15. Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation, as per the applicable laws, rules and regulation and available guidelines.
16. Undertaking other activities related to tourism like over flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, microlites, etc. Regulated as per the applicable laws.
17. Protection of Hill Slopes and river banks. Regulated as per the applicable laws.
18. Movement of vehicular traffic at night. Regulated for commercial purpose under the applicable laws. 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
19. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.
20. Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water; otherwise the discharge of treated waste water/effluent shall be regulated as per the applicable laws.
21. Commercial extraction of surface and ground water. Regulated under the applicable laws.
22. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies. Regulated as per the applicable laws except for meeting local needs.
23. Open well, bore well, etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority.
24. Solid Waste Management. Regulated as per the applicable laws.
25. Introduction of Exotic species. Regulated as per the applicable laws.
26. Eco-tourism. Regulated as per the applicable laws.
27. Use of polythene bags. Regulated as per the applicable laws.
28. Commercial sign boards and hoardings. Regulated as per the applicable laws. C. Promoted Activities
29. Rain water harvesting. Shall be actively promoted.
30. Organic farming. Shall be actively promoted.
31. Adoption of green technology for all activities. Shall be actively promoted.
32. Cottage industries including village artisans, etc. Shall be actively promoted.
33. Use of renewable energy and fuels. Bio-gas, solar light etc. shall be actively promoted.
34. Agro-forestry. Shall be actively promoted.
35. Plantation of horticulture and herbals. Shall be actively promoted.
36. Use of eco-friendly transport. Shall be actively promoted.
37. Skill Development. Shall be actively promoted.
38. Restoration of degraded land/ forests/ habitat. Shall be actively promoted.
39. Environmental Awareness. Shall be actively promoted.
5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 25 Sl.No. Constituent of the Monitoring Committee Designation

(iv) Senior Town Planner of the area Member;
(v) An expert in the area of Ecology and Environment to be nominated by the State Government Member;
(vi) One member of State Biodiversity Board to be nominated by the State Government Member;
(vii) Divisional Forest Officer(Wildlife), Shimla Member Secretary.
6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per the proforma appended as Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures. - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Orders of Supreme Court, etc. - The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
