(i) पया�वरण;
(ii) वन और व:यजीव;

(v) शहरी िवकास;

(x) पंचायती राज;
(xi) लोक िन मा�ण िव भाग;
(xii) मCNय पालन;
(xiii) अंडमान ल@-ीप बंदरगाह िनमा�ण और अ:य अनुसंधान संNथान;
(xiv) आ�दवासी िवभाग। (4) आंचिलक महायोजना अनुमो�दत िवHमान भ-ूउपयोग, अवसंरचना और �jयाकलाप5 पर कोई िनब�धन अिधरोिपत नह> करेगी जब तक �क इस अिधसूचना म� िविनwद�X ट न हो और आचंिलक महायोजना सभी अवसंरचना और �jयाकलाप5 म� और अिधक द@ता और पा"रिNथितक$ अनुकूलता का संवध�न करेगी । (5) आंचिलक महायोजना म� अनाgछा�दत @े�5 के जीण�pार, िवHमान जल िनकाय5 के संर@ण, आवाह @े�5 के �बंधन, जल-संभर5 के �बंधन, भतूल जल के �बंधन, मदृा और नमी संर@ण, Nथानीय समुदाय5 क$ आवzयकताP तथा पा"रिNथितक$ और पया�वरण से संबंिधत ऐस ेअ:य पहलूP, िजन पर Lयान दनेा आवzयक ह,ै के िलए उपबंध ह5गे । (6) आंचिलक महायोजना सभी िवHमान पूजा N थल5, Uाम5 और नगरीय बंदोबNत5, वन5 के �कार और �कN म5, कृिष @े�5, ऊपजाऊ भिूम, ह"रत @े� जसेै पाक� और उसी �कार के N थान, उHान कृिष @े�, फलोHान5, झील5 और अ:य जलाशय5 का अ�यकंन करेगी। आंचिलक महायोजना के मानिच� -ारा िवHमान और �Nतािवत भिूम के उपयोग का िववरण �कया जाएगा। (7) आंचिलक महायोजना N थानीय समदुाय5 क$ जीवकोपाज�न को सिुनिz चत करने के िलए, पा"रिNथितक$ संवेदी जोन म� िवकास को पा"रिNथितक$ अनुकूल िवकास के िलए पैरा 4 क$ सारणी म� सूची बp िविनयिमत करेगी और अिधसूचना म� िविनwद�< �ितिषp, िविनयम और संव;ध�त �jयाकलाप5 का अनुसरण करेगी। (8) आंचिलक महायोजना @े�ीय िवकास योजना के साथ सह-कािलक होगा। (9) आंचिलक महायोजना N थानीय समुदाय5 क$ जीवकोपाज�न को सुिनिz चत करने के िलए, पा"रिNथितक$ संवेदी जोन म� िवकास को पा"रिNथितक$ अनुकूल िवकास के िलए िविनयिमत करेगी । (10) आंचिलक महायोजना इस अिधसूचना म� �दए गए उपबंध5 के संबंध म� अपने कृCय5 के �jया:वयन के िलए िनगरानी सिमित के िलए एक संदभ� दNतावेज इस �कार अनुमो�दत करेगी। 3.3.3.3. संघ संघ संघ संघ रा�यरा�यरा�यरा�य �े �े �े �े सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय-------- संघ राJय @े� सरकार इस अिधसूचना के उपबंध5 को �भावी करने के िलए िन�िलिखत उपाय करेगी, अथा�त् :- (1) भिूमभिूमभिूमभिूम----उपयोग उपयोग उपयोग उपयोग ---- (क) पा"रिNथितक$ संवेदी जोन म� वन5, उHान-कृिष @े�5, कृिष @े�5, आमोद-�मोद के �योजन5 के िलए िचि:हत �कए गए पाकx और खुल ेNथान5 का वृहद वािणिJयक या वृहद आवासीय काaपलै'स औHोिगक �jयाकलाप5 के िलए उपयोग या संप"रवत�न नह> होगा:
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 परंतु पा"रिNथितक$ संवेदी जोन के भीतर भाग (क) म� िविनwद�< �योजन स ेिभ] �योजन के िलए कृिष और अ:य भिूम का संप"रवत�न, िनगरानी सिमित क$ िसफा"रश पर और यथा लागू और @े�ीय नगर योजना अिधिनयम तथा के:Sीय/ राJय सरकार के अ:य िनयम5 तथा िविनयम5 के अधीन स@म �ािधकारी के पूव� अनुमोदन से, तथा इस अिधसूचना के उपबंध5 -ारा Nथानीय िनवािसय5 क$ िन�िलिखत आवासीय ज रत5 को पूरा करने के िलए अनु�ात �कया जाएगा, जैसे �क:- (i) िवHमान सड़क5 को चौड़ा करना और उ:ह� सुदढृ करना और नई सड़क5 का संिनमा�ण करना; (ii) बुिनयादी ढांच5 और नाग"रक सुिवधाP का संिनमा�ण और नवीकरण; (iii) �दषूण उCप] न करने वाले लघ ुउHोग, (iv) कुटीर उHोग5 िजसके अंतग�त Uामीण उHोग हT; सिुवधाजनक भqडार और Nथानीय सुख-सुिवधाP जो पा"रिNथितक$ पय�टन म� सहायक हT िजसम� गृह वास सिaमिलत ह;ैऔर (v) संव;ध�त �jयाकलाप5 पैरा 4 के अधीन �दया गया ह:ै परंतु यह भी �क @े�ीय शहरी िनयोजन अिधिनयम के अधीन स@म �ािधकारी के पूव� अनुमोदन के िबना तथा संघ राJय @े� सरकार के अ:य िनयम5 एवं िविनयम5 का अनुपालन �कए िबना तथा संिवधान के अनुgछेद 244 के उपबंध5 तथा तCसमय �वृD िविध, िजसके अंतग�त अनुसूिचत जनजाित और अ:य परंपरागत वन िनवासी (वन अिधकार5 क$ मा:यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै के अनुपालन के िबना वािणिJयक या औHोिगक िवकास �jयाकलाप5 के िलए जनजातीय भूिम का �योग अनु�ात नह> होगा: परंतु यह भी �क पा"रिN थितक$ संवेदी जोन के भीतर क$ भिूम के अिभलेख5 म� उCप] �कसी �ु"ट क$, िनगरानी सिमित के िवचार �ाE करने के प~ात्, राJय सरकार -ारा �Cयेक मामले म� एक बार शुिp क$ जाएगी और उ4 �ु"ट के शुिpकरण क$ सूचना क� Sीय सरकार के पया�वरण, वन और जलवायु प"रवत�न मं�ालय को दी जाएगी । परंतु यह भी �क उपयु�4 �ु"ट के शुिpकरण म�, इस उप-पैरा म� यथा उपबंिधत के िसवाय, �कसी भी दशा म� भ-ूउपयोग का प"रवत�न सिaमिलत नह> होगा । ऐसे ह"रत @े� और कृिष @े� म� प"रणािमक कमी नह> होगी। (ख) अनु�यु' त या अनुC पादक कृिष @े�5 म� पुन: वनीकरण के तथा पया�वास और जैव- िविवधता क$ बहाली के �यास �कए जाएंगे । (2) �ाकृितक जल ोते�ाकृितक जल ोते�ाकृितक जल ोते�ाकृितक जल ोते - आचंिलक महायोजना म� सभी �ाकृितक जल �ोत5 क$ पहचान क$ जाएगी और उनके संर@ण और पुनf�भूतकरण के िलए योजना सिa मिलत होगी और संघ राJय @े� सरकार -ारा ऐसे @े�5 पर या उनके िनकट िवकास �jयाकलाप �ितिषp करने के िलए ऐसी रीित से माग�िनद�श तैयार �कए जाएंगे । (3) पय�टन पय�टन पय�टन पय�टन –––– (क) पा"रिNथितक$ संवेदी जोन के भीतर सभी नए पा"रिNथितक$ पय�टन �jयाकलाप या िवHमान पय�टन �jयाकलाप5 का िवNतार पा"रिNथितक$ संवेदी जोन सaबंधी पय�टन महायोजना के अनुसार होगा । (ख) पय�टन महायोजना पय�टन िवभाग5 -ारा सघं राJय @े� के पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना का एक घटक होगी । (घ) पय�टन संबंधी �jयाकलाप िनa नानुसार िविनयिमत �कए जाएंगे, अथा�त् :- (i) सैडल पीक राGीय उHान क$ सीमा एक �कलोमीटर के भीतर या पा"रिNथितक$ संवेदी जोन के िवNतार तक, इसम� जो भी नजदीक हो होटल और "रसोट� के नए सिंनमा�ण अनु�ात नह> होगे: परंतु सैडल पीक राGीय उHान क$ सीमा से एक �कलोमीटर क$ दरूी से परे पा"रिNथितक$ संवेदी जोन के िवNतार तक नए होटल और "रसोट� क$ Nथापना को पूव� प"रभािषत और िविनwद�< @े�5 म� पा"रिNथितक$ पय�टन काय�कलापो के िलए पय�टन महायोजना के अनुसार अनु�ात �कया जाएगा;
6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) पा"रिNथितक$ संवेदी जोन के भीतर सभी नए पय�टन �jयाकलाप5 या िवHमान पय�टन �jयाकलाप5 का िवNतार राX nीय r या� संर@ण �ािधकरण, पया�वरण, वन और जलवायु प"रवत�न मं�ालय -ारा जारी (समय-समय पर यथा संशोिधत) माग�िनदशे5 के अनुसार होगा िजसम� पा"रिNथितक$ पय�टन, पा"रिNथितक$ िश@ा और पा"रिNथितक$ िवकास को महCव �दया जाएगा और पा"रिNथितक$ संवेदी जोन क$ वहन @मता के अLययन पर आधा"रत होगा; (iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय�टन के िलए िवकास और िवHमान पय�टन �jयाकलाप5 के िवNतार को वाNतिवक Nथल िविनwद�< संवी@ा तथा िनगरानी सिमित क$ िसफा"रश पर आधा"रत संबंिधत िविनयामक �ािधकरण5 -ारा अनु�ात �कया होगा । (4) नैस$ग�कनैस$ग�कनैस$ग�कनैस$ग�क िवरासतिवरासतिवरासतिवरासत -------- पा"रिNथितक$ संवेदी जोन म� महCवपूण� नैस;ग�क िवरासत के सभी Nथल5 जैसे सभी जीन कोश आरि@त @े�, शैल िवरचनाएं, जल �पात5, झरन5, घाटी मागx, उपवन5, गुफाएं, Nथल5, �मण, अ�रोहण, �पात5 आ�द क$ पहचान क$ जाएगी और राजप� म� इस अिधसूचना के �काशन क$ तारीख से छह माह5 के भीतर संप"रवत�न होगा और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िन$म�त िवरासत � थमानव िन$म�त िवरासत � थमानव िन$म�त िवरासत � थमानव िन$म�त िवरासत � थल ल ल ल ---- पा"रिNथितक$ संवेदी जोन म� भवन5, संरचनाP, िश�प-त�य, ऐितहािसक, कलाCमक और सांNकृितक महCव के @े�5 क$ पहचान क$ जाएगी इस अिधसूचना के �काशन क$ तारीख से छह माह के भीतर उनके सरं@ण क$ योजनाएं तैयार क$ जाएगी तथा ऐसी योजना आंचिलक महायोजना का भाग होगी । (6) & व& व& व& विनिनिनिन �दषूण�दषूण�दषूण�दषूण -- पा"रिNथितक$ संवेदी जोन म� L विन �दषूण का िनवारण और िनयं�ण, पया�वरण (संर@ण) अिधिनयम, 1986 के अधीन बनाए गए Lविन �दषूण (िविनयमन और िनयं�ण) िनयम, 2000 के अनुसार �कया जाएगा । (7) वायुवायुवायुवायु �दषूण�दषूण�दषूण�दषूण - पा"रिNथितक$ संवेदी जोन म�, वायु �दषूण का िनवारण एवं िनयं�ण, वायु (�दषूण िनवारण और िनयं�ण) अिधिनयम, 1981 (1981 का 14) के उपबंधो और उसके अधीन बनाए गए िनयम5 के अनुसार �कया जाएगा । (8) बिह ावबिह ावबिह ावबिह ाव काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण -- पा"रिNथितक$ संवेदी जोन म� उपचा"रत बिह�ाव5 का िनNसारण, पया�वरण (सरं@ण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयम5 के अ:तग�त शािमल �कए गए पया�वरणीय �दषूण के िनNसारण संबंधी साधारण मानक5 या राJय सरकार -ारा िनयत मानक5 के अनुसार �कया जाएगा जब कभी और कठोर हो। (9) ठोसठोसठोसठोस अपिश. अपिश. अपिश. अपिश. -------- ठोस अपिश<5 का िनपटान और �बंधन िन�िलिखत प म� होगा- क. पा"रिNथितक$ संवेदी जोन म� ठोस अपिश< िनपटान और �बंधन समय-समय पर संशोिधत ठोस अपिशX ट �बंधन िनयम, 2016, जो भारत सरकार के पया�वरण, वन और जलवायु प"रवत�न मं�ालय क$ अिधसूचना सं. का.आ. 1357(अ) तारीख 8 अ�ैल, 2016 -ारा �कािशत �कए गए थ,े के उपबंध5 के अनुसार �कया जाएगा ; May, 2018 S.O.1874(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3328 (E), dated the 13 th October, 2017, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the draft notification were made available to the public on the 13 th October 2017;
AND WHEREAS, No objections or suggestions were received from the persons and stakeholders in response to the draft notification;
WHEREAS, the Saddle Peak National Park is a Protected Area having an area of 35.54 square kilometers falling in North and Middle Andaman District in the Union territory of Andaman and Nicobar Islands and represents a unique combination of richest and varied forests, marine, coastal and mangrove ecosystems harboring many endemic plants and animals and the said National Park is located in the Eastern part of North Andaman Island at a distance of about 30 kilometers (by road) from Diglipur town and about 325 kilometers from Port Blair; Saddle Peak having an altitude of 732 metres above sea level is the highest peak in the Andaman and Nicobar Islands; forest types include (i) Andaman Tropical Evergreen Forests represented by species like Dipterocarpus grandiflorus, Artocarpus chaplasha, Siderxylion longeopatalum, etc.;(ii)Southern Hill top Tropical Evergreen Forests represented by species like Dipterocarpus costatus, Mesua ferrea, Canarium manii, Hopea andamanica, etc; (iii)Andaman Semi Evergreen Forests represented by species like Dipterocapus spp, Artocarpus chaplasha, Pterocarpus dalbergioides, etc.; (iv) Andaman Moist Deciduous forests represented by species like Pterocarpus dalbergioides,Terminalia bilata, T.manii, Bombax insignis, Lagerstoemia hypoleuca, etc.; (v) Littoral Forests represented by species like Manilkara littoralis, Pongamia pinnata, Calophyllum inophyllum, etc.; (vi) Mangrove Forests or tidal Swamp forests represented by species like Rhizopora spp, Bruguiera spp., Avicenia spp, Xylocarpus spp, etc.; (vii) Cane Brakes represented by species like Calamus and (viii) Wet Bamboo Brakes represented by species like Oxytentherea nigrociliata ,etc;
AND WHEREAS, the Saddle Peak National Park is home of endemic plant species namely Alstonia kurzii, Polyalthia parkinsonii, Pterocarpus dalbergioides, Dinochloa andamanica, Derris andamanica and Amoora manii,etc., and rare threatened plants namely Bombax insignis, Amoora manii, Plecospermum andamanicum, Gnetum spp, Podocarpus spp and Mangifera andamanica, etc;
AND WHEREAS, nineteen species of mammals were reported from the said National Park which includes Andaman Lesser Short-nosed Fruit Bat (Cynopterus brachyotis brachysoma), Bent winged Bat (Miniopterus australlis pusillus), Blackbeard Tomb Bat (Taphozous melanopogon melanopogon), Blyth’s Clubfooted Bat(Thlonycteris pochupus fulvida), Blyth’s pouch bearing Bat (Taphozous saccolaimus crassus), Dobson’s horseshoe Bat (Rhinolophus affinis andamensis), Donson’s long-tongued fruit Bat (Eonycteris spelaea), Fulvus leaf-nosed Bat (Hipposideros fulvus fulvus), Insular mouse-eared Bat (Myotis dryas), Lesser yellow Bat (Scotophilus kuhli), Rat (Rattusburrescns) Andaman island spiny shrew (Crocidura hispida), etc.; though the large mammalian fauna is not well represented due to geographic isolation of the truly oceanic islands, reptiles, birds, amphibians, fishes and other lower forms insects and butterflies along with plant and marine biodiversity are well represented in the National Park; about 16 species of reptilian fauna recorded from the Saddle Peak National Park includes Andaman king cobra (Ophiophaghus Hannah), Andaman cobra (Naja sagittifera), Saltwater crocodile (Crocodylus porosus), Andaman bent-toed gecko (Cyrodactylus rubidus), Andaman green gecko (Phelsuma andamanense), Flat tailed gecko (Cosymbotus platyurus), Andaman krait (Bungarus andamanensis), Water monitor lizard (Varanus salvator), Green sea turtle (Chelonian mydas), Hawksbill sea turtle (Eretmochelys coriacea), Leatherback sea turtle (Dermochelys coriacea), Olive ridley sea turtle (Lepidochelys olivacea), Anderson’s pit viper (Trimeresurus andersoni), Cantor’s pit viper (Trimeresurus cantor), Andaman keel back snake (Xenochrophis elanzostus), Red tailed trinket snake (Elaphe oxycephala), etc; Sea Snakes are also seen in the beaches and in the adjoining vegetation;
the National Park is housing about 227 species of insects and butterflies;
AND WHEREAS, Saddle Peak National Park is very rich in avian fauna and 89 species of birds have been recorded from the National Park which includes Indian pond heron or paddy bird (Ardeola grayii), Larger egret or great white heron (Ardea alba), Little egret (Egreeta garzetta), Eastern reef heron(Egretta sacra), Lesser whistling teal or tree ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 duck (Dendrocygna javanica), Common teal (Anas crecca), Grey Andaman or oceanic teal (Anas gibberifrons ), Andaman black crested Baza (Aviceda leuphotes), White bellied sea eagle(Haliaetus leucogaster), Andaman Dark serpent Eagle(Spilornis elgini), Andaman banded crake(Rallina canningi), Andaman White breasted Waterhen (Amaurornis phoenicurus), Kora or Water cock(Gallicrex cinerea), Black bellied or Grey plover(Pluvialis squatarola), Large sand plover(Chradrius leschenaultia), Eastern sand plover(Charadrius asiaticus), Kentish plover(Charadrius alexandrines), Pamirs lesser sand plover(Charadrius mongolus), Whimbrel (Numenius phaeopus), Curlew (Numenius arquata), etc;
AND WHEREAS, the important threatened/rare plant species of the National park are Didu (Bombax insigne), Tadehagi triquetrum, Amoora manii, Plecospermum andamanicum, Olax imbricate, Pittospermum ferrugineum, etc;
AND WHEREAS, the sea shore, river beds, creeks, mud flats as well as sandy beaches serve as an excellent habitat for the endangered species like salt water crocodile, turtles and Water monitor lizard and the forest area around the Saddle Peak National Park experiences anthropogenic pressures to certain extent from the people living in the vicinity of the forests;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the Saddle Peak National Park as Eco- sensitive Zone from ecological and environmental point of view to maintain the biological diversity at ecosystem, habitat, species, population and genetic levels and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by the sub section (1), clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (protection) Rules, 1986, the Central Government hereby notifies an area of 16.84 square kilometers as Eco-sensitive Zone around the Saddle Peak National Park, to an extent varying from 0 km to 0.6 kilometer towards East, one kilometer towards South and West, and 0.2 Kilometer to 1 Kilometer towards North directions from the boundary of the Saddle Peak National Park in the Union territory of Andaman and Nicobar Islands as the Saddle Peak National Park Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
(1) Extent and boundaries of Eco-sensitive Zone. – (1) The extent of Eco-sensitive Zone varies from zero to 1.0 kilometre around the Saddle Peak National Park, the area of Eco-sensitive Zone is 16.84 square kilometres with an extent of one kilometer towards South, West and North directions and from 0 to 0.6 kilometer towards East side from the boundary of the Saddle Peak National Park, the boundaries of Eco-sensitive Zone of Saddle Peak National Park are located in the District of Middle and North Andaman of Andaman and Nicobar Islands situated between North Latitude 13°06’56.848”N to 13°12’32.714” N and East Longitude 92° 59’ 57.689” E to 93° 02’ 25.282” E, the Eastern boundary of the Saddle Peak National Park is coinciding with the high-tide line (HTL) and there is no land mass available, the sea area is already protected under Coastal Regulation Zone/Island Protection Zone Notification and hence ‘zero’ kilometer Eco-sensitive Zone extent is proposed in the eastern side of the Protected Area.
(2) The detailed boundary description of the Eco-sensitive Zone of Saddle Peak National Park is appended to this notification as Annexure- I.
(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-II A, Annexure –II B and Annexure-II C.
(4) The geo-coordinates of Saddle Peak National Park and its Eco-sensitive Zone are given in Table A and Table B of Annexure-III.
(5) The status of all the area falling inside the Eco-sensitive Zone is Reserved Forests.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The Union Territory Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority of the Union Territory.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union Territory Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union Territory laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Union Territory Departments, for integrating the ecological and environmental considerations into the said Plan, namely:- 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department;
(xii) Fisheries;
(xiii) Andaman Lakshadweep Harbour Works and other Research Institutions;
(xiv) Tribal department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the said Plan shall be supported by maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities.
(10) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the Union Territory Government - The Union Territory Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant laws of the Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:- i. widening and strengthening of existing roads and construction of new roads;
ii. construction and renovation of infrastructure and civic amenities;
iii. small scale industries not causing pollution;
iv. Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. promoted activities and given under para 4.

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Union Territory Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area such as forest area and agricultural area.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union Territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism:- (a) All new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the Union Territory Department of Tourism in consultation with Union Territory Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be permitted within one kilometer from the boundary of the Saddle Peak National Park or upto the extent of the Eco-sensitive Zone whichever is nearer: provided that beyond the distance of one kilometer from the boundary of the National Park till the extent of the Ecosensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism; eco-education and eco-development and based on the carrying capacity study of the eco-sensitive zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation within six months from the date of publication of this notification in the official Gazatte and such plan shall from part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation within six months from the date of publication of this notification in the official Gazatte and such plan shall from part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986, as amended from time to time.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder, as amended from time to time.
(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:- a. the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; as amended form time to time the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone.
b. Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste. – (a) Bio medical waste management shall be as under: the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016, as amended from time to time.
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste. - The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the Union Territory Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG, etc.
(16) Industrial units. –(i) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless so otherwise specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes. - The protection of hill slopes shall be as under:
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted:-
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (water, air, soil, noise, etc.).
(a) No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
(b) Only non-polluting industries shall be permitted within the Ecosensitive Zone as per classification of industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
8. River aquaculture. Prohibited (except as otherwise provided) as per applicable laws.
9. Fishing by mechanized boat in large scale commercial manner.
Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
10. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone, whichever is nearer:

(b) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including homestays; and
(v) Promoted activities listed in this Notification.
(c) Further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(d) beyond one kilometer it shall be regulated as per the Zonal Master Plan.
12. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority.
13. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
14. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
15. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws (underground cabling may be promoted).
16. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulations and available guidelines.
17. Widening and strengthening of existing roads and construction of new roads.

18. Undertaking other activities related to tourism like over flying the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

23. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water, and the discharge of treated waste water/effluent shall be regulated as per applicable laws.
24. Commercial extraction of surface and ground water.
Regulated under applicable laws.
25. Open well, bore well etc. for agriculture or other usage.
Regulated under applicable laws and the activity shall be strictly monitored by concerned authority.
26. Solid waste management. Regulated under applicable laws.
27. Introduction of exotic species. Regulated under applicable laws.
28. Eco-tourism. Regulated under applicable laws.
29. Use of polythene bags. Regulated under applicable laws.
30. Commercial sign boards and hoardings.

31. Traditional fishing. Regulated in accordance with the Andaman and Nicobar Islands Marine Fishing Regulations, 2003.

5. Monitoring Committee:
The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:-
1. Deputy Commissioner, North and Middle Andaman Chairman;
2. Divisional Forest Officer, Diglipur Member;
3. Joint Director, Agriculture, North and Middle Andaman Member;

4. Director, Tourism or his representative Member;
5. Director, Fisheries or his representative Member;
6. Senior Veterinary Officer, Diglipur Member;
7. Member of the Union territory Biodiversity Board Member;
8. A representative of Non-Governmental Organisation working in the field of wildlife conservation to be nominated by the Union Territory Government Member;
9. A expert in Biodiversity nominated by the Union Territory Government Member;
10. Divisional Forest Officer (WL) Mayabunder Member Secretary.
6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring Committee shall be for three years or till the re-constitution of the new Committee by the Union Territory Government and subsequently the Monitoring Committee shall be constituted by the Union Territory Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5 )The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the Union Territory as per proforma given in Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures: The Central Government and Union Territory Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Order of Supreme Court etc. :The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or National Green Tribunal.

EAST – Thence the boundary starts from a point A at grid reference of north latitude 13°12’5.988” and east longitude of 93° 02’25.282” and proceeds along the High tide level of the east coast and reaches a Point J at a grid reference of north latitude 13°10’52.9” and east longitude 93°01’57.4” at a distance of 2.397 km and thereafter the boundary of Eco-sensitive Zone of Saddle Peak National Park will follow the boundary of Saddle Peak National Park paralleling at 0 distance and meets at a point I at a grid reference of north latitude 13°07’29.468” and east longitude 93°01’50.977”after traversing a distance of 6.795 kilometer Km and thereafter the boundary will follow the coastal boundary and proceeds further to a point H at a grid reference of north latitude 13°06’56.848” and east longitude 93°01’52.69” covering a distance of 1.0 kilometer.
SOUTH – Thence the boundary starts from a point H a grid reference of north latitude 13°06’56.848” and east longitude 93°01’52.69” and proceeds towards west and reaches a point G at a distance of 3.486 kilometer at a grid reference of north latitude 13°07’7.799” and east longitude 92°59’57.439”, then the boundary proceeds towards North West direction for a distance of 1.304 kilometer and reaches a point F grid reference of north latitude 13°07’34.114” and east longitude 92°59’27.834”.
WEST – Thence the boundary starts from the point F at a grid reference of north latitude 13°07’34.114” and east longitude 92°59’27.834” and proceeds towards north direction to a distance of 8.486 kilometer and reaches a point E at a grid reference North latitude 13°12’10.391” and East longitude 92°59’28.284”.
