(i) पया�वरण;
(ii) वन और वJयजीव;
(iii) कृिष और बागवानी;
(iv) राजA व;
(v) नगर िवकास;
(vi) पय�टन सिहत पया�वरण पय�टन;
(vii) mामीण िवकास;
(viii) Uसंचाई और बाढ़ िनयं"ण;
(ix) नगर और शहरी िवकास;
(x) पंचायती राज;
(xi) लोक िन मा�ण िव भाग। (4) आंचिलक महायोजना अनुमो�दत िव^मान भ-ूउपयोग, अवसरंचना और �lयाकलाप0 पर कोई िनबqधन अिधरोिपत नह= करेगी जब तक �क इस अिधसूचना म( और आंचिलक महायोजना म( सभी अवसरंचना और अिधक �भावी और पा�र िA थ ितक अनुकूल �lयाकलाप कारक इस �कार िविन\द�] न हो । (5) आंचिलक महायोजना म( अनाrछा�दत 7े"0 के जीण_aार, िव^मान जल िनकाय0 के संर7ण, आवाह 7े"0 के �बंधन, जल-संभर0 के �बंधन, भूतल जल के �बंधन, मृदा और नमी संर7ण, Aथानीय समुदाय0 क# आवMयकताt तथा पा�रिAथितक और पया�वरण स ेसबंंिधत ऐसे अJय पहलूt, िजन पर @यान दनेा आवMयक ह,ै के िलए उपबधं ह0गे । (6) आंचिलक महायोजना सभी िव^मान पजूा A थल0, mाम0 और नगरीय बंदोबAत0, वन0 के �कार और �कA म0, कृिष 7े"0, ऊपजाऊ भूिम, ह�रत 7े" जैसे उ^ान और उसी �कार के A थान, उ^ान कृिष 7े", फलोउ^ान, झील0 और अJय जल िनकाय0 का अvयकंन करेगी और इस योजना के मानिच" के साथ िव^मान और �Aतािवत भिूम उपयोग िवशेषताt का िववरण संलw होगा । (7) आंचिलक महायोजना पा�रिAथितक संवेदी जोन म( िवकास को िविनयिमत करेगी और सारणी के पैरा 4 म( सूचीबa �ितिषa और िविनयिमत �lयाकलाप0 का पालन करेगी िजसस ेपा�रिAथितक अनुकूल िवकास Aथानीय समुदाय0 क# जीवकोपाज�न सुर7ा के िलए सुिनिxत और �ोNसािहत �कया जा सके । (8) आंचिलक महायोजना इस अिधसूचना म( �दए गए उपबंध0 के अनुसार म( अपने कृNय0 का पालन करने के िलए मानीटरी सिमित के िलए एक संदभ� दAतावेज तैयार करेगी । 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय-------- राdय सरकार इस अिधसूचना के उपबंध0 को �भावी करन ेके िलए िनiिलिखत उपाय करेगी, अथा�त:्-- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (1) भूभभूूभू----उपयोग उपयोग उपयोग उपयोग ––––पा�रिAथितक# सवंेदी जोन म( वन0, उ^ान-कृिष 7े"0, कृिष 7े"0, आमोद-�मोद के �योजन के िलए िचिJहत �कए गए पाकy और खुले Aथान0 का वािणिdयक और औ^ोिगक सबंa िवकास �lयाकलाप0 के िलए उपयोग या संप�रवत�न नह= होगा: परंतु पा�रिAथितक# सवंेदी जोन के भीतर भाग (क) म( िविन\द�] �योजन से िभz �योजन के िलए कृिष और अJय भूिम का संप�रवत�न मानीटरी सिमित क# िसफा�रश पर और यथा लाग ूऔर 7े"ीय नगर योजना अिधिनयम तथा केJcीय/राdय सरकार के अJय िनयम0 तथा िविनयम0 के अधीन स7म �ािधकारी के पूव� अनुमोदन स,े तथा इस अिधसूचना के उपबंध0 'ारा Aथानीय िनवािसय0 क# िनiिलिखत आवासीय ज:रत0 को पूरा करने के िलए अनु|ात �कया जाएगा, जसै:े- (i) िव^मान सड़क0 को चौड़ा करना और उJह( सुदढृ करना तथा नई सड़क0 का संिनमा�ण; (ii) बुिनयादी ढांच0 और नाग�रक सुिवधाt का संिनमा�ण और नवीकरण; (iii) �दषूण उNपz न करन ेवाले लघु उ^ोग; (iv) कुटीर उ^ोग0 िजनके अंतग�त mामीण कारीगर भी हY; सुिवधाजनक भKडार और Aथानीय सुिवधाt सहायक पा�रिAथितक पय�टन म( सि;मिलत mह वास; और (v) सवं�ध�त �lयाकलाप और पैरा 4 के अंतग�त �दया गया ह:ै परंतु यह और भी �क 7े"ीय नगर योजना अिधिनयम और अJय िनयम0 और िविनयम0 के अंतग�त राdय सरकार के पूव� अनुमोदन तथा संिवधान के अनुrछेद 244 और तNसमय �वृ> िविध के उपबंध0 के अनपुालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अJय परंपरागत वन िनवासी (वन अिधकार0 क# माJयता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिdयक या उ^ोग िवकास �lयाकलाप0 के िलए जनजातीय भूिम का उपयोग अनु|ात नह= होगा: परंत ुयह और भी �क पा�रिAथितक# सवंेदी जोन के भीतर भू-अिभलेख0 म( उपसंजात कोई "ु�ट, मानीटरी सिमित के िवचार �ा? करन े के पxात ्राdय सरकार 'ारा �Nयेक मामले म( एक बार संशोिधत होगी और उ/ "ु�ट के संशोधन क# सूचना क( cीय सरकार के पया�वरण, वन और जलवाय ुप�रवत�न म"ंालय को दी जाएगी। परंत ुयह और भी �क उपयु�/ "ु�ट का संशोधन म( इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म( भू-उपयोग का प�रवत�न सि;मिलत नह= होगा; परंत ुयह और भी �क िजससे ह�रत 7े" म( जैसे वन 7"े, कृिष 7े" और �यास0 आ�द म( कोई पा�रणािमक कटौती नह= होगी और अन�यु$ त या अनुN पादक कृिष 7े"0 म( पुन: वनीकरण करने के �यास �कए जाएगं े। (2) �ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत- आचंिलक महायोजना म( सभी �ाकृितक जल �ोत0/न�दय0/जलसरणी क# पहचान क# जाएगी और उसम( उनके संर7ण और पुन��भूतकरण के िलए योजना सि; मिलत होगी । (3) पय�टनपय�टनपय�टनपय�टन–––– (क) पा�रिAथितक सवंेदी जोन के भीतर सभी नए पा�रिAथितक पय�टन �lयाकलाप या िव^मान पय�टन �lयाकलाप0 का िवAतार पय�टन महायोजना के अनुसार आंचिलक महायोजना के िलए होगा । (ख) पय�टन महायोजना पय�टन िवभाग 'ारा राdय पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के :प म( होगी । (घ) पा�रिAथितक पय�टन सबंंधी �lयाकलाप िनiानुसार िविनयिमत ह0गे, अथा�त् :- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (i) खेवनी वJयजीव अभयारKय क# सीमा स ेएक �कलोमीटर के भीतर या पा�रिAथितक सवंेदी जोन के िवAतार तक, इनम( जो भी िनकट ह,ै नये वािणिdयक होटल और �रसोट� अनु|ात नह= ह0गे। परंतु, वJयजीव अभयारKय क# सीमा से एक �कलोमीटर क# दरूी से परे पा�रिAथितक संवेदी जोन के िवAतार तक होटल0 और सरैगाह0 का Aथापन केवल पवू� प�रिनिxत 7े"0 म( पय�टन महायोजना के अनुसार पा�रिAथितक पय�टन सुिवधाt के िलए ही अनु|ात होगा; (ii) पा�रिAथितक सवंेदी जोन के भीतर नए पय�टन �lयाकलाप0 या िव^मान पय�टन �lयाकलाप0 का िवAतार क( cीय सरकार के पया�वरण, वन और जलवाय ुप�रवत�न म"ंालय के माग�दश�क िसaांत0 के 'ारा तथा राO �ीय � या� संर7ण �ािधकरण, 'ारा जारी पा�रिAथितक पय�टन (समय-समय पर यथा संशोिधत) माग�दश�क िसaांत0 के अनुसार, पा�रिAथितक पय�टन, पा�रिAथितक िश7ा और पा�रिAथितक िवकास को महNव दतेे <ए पा�रिAथितक सवंेदी जोन क# वहन 7मता के अ@ययन पर आधा�रत होगा; (iii) आंचिलक महायोजना का अनुमोदन �कए जान े तक, पय�टन के िलए िवकास और िव^मान पय�टन �lयाकलाप0 के िवAतार को वाAतिवक Aथल िविन\द�] सवंी7ा तथा मानीटरी सिमित क# िसफा�रश पर आधा�रत सबंंिधत िविनयामक �ािधकरण0 'ारा अनु|ात �कया होगा । (4) नसै"ग�कनसै"ग�कनसै"ग�कनसै"ग�क िवरासतिवरासतिवरासतिवरासत -------- पा�रिAथितक सवंेदी जोन म( महNवपूण� नैस�ग�क िवरासत के सभी Aथल0 जैसे सभी जीन कोश आरि7त 7े", शैल िवरचनाए,ं जल �पात0, झरन0, घाटी मागy, उपवन0, गुफाएं, Aथल0, �मण, अ�रोहण, �पात0 आ�द क# पहचान क# जाएगी और उJह( संरि7त �कया जाएगा तथा उनक# सुर7ा और संर7ा के िलए इस अिधसूचना के अंितम �काशन क# तारीख स े छह मास के भीतर, उपयु/ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थल ल ल ल ---- पा�रिA थितक सवंदेी जोन म( भवन0, संरचनाt, िश�प-त�य, ऐितहािसक, कलाNमक और सांAकृितक महNव के 7े"0 क# पहचान क# जाएगी और इस अिधसूचना के �काशन क# तारीख स ेछह मास के भीतर उनके सरं7ण क# योजना तैयार करनी होगी तथा आंचिलक महायोजना म( सि;मिलत क# जाएगी । (6) $ व$ व$ व$ विन �दषूणिन �दषूणिन �दषूणिन �दषूण -- पया�वरण (संर7ण) अिधिनयम 1986 के अधीन @विन �दषूण (िविनयमन और िनय"ंण) िनयम, 2000 म( िनयत उपबंध0 के अनुसार म( पा�रिAथितक संवदेी जोन म( @विन �दषूण के िनयं"ण के िलए िविनयम0 को काया�िJवत करेगा । (7) वायुवायुवायुवायु �दषूण�दषूण�दषूण�दषूण- पा�रिAथितक सवंेदी जोन म(, वाय ु�दषूण के िनवारण और िनयं"ण का वाय ु(�दषूण िनवारण और िनयं"ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम0 के उपबंध0 के अनुसार अनुपालन �कया जाएगा । (8) बिह�ाबिह�ाबिह�ाबिह�ावववव काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण- पा�रिAथितक सवंेदी जोन म( उपचा�रत बिह�ाव का िनAसारण, जल (�दषूण िनवारण तथा िनयं"ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम0 के उपबंध0 के अनुसार होगा । (9) ठोसठोसठोसठोस अपिश,अपिश,अपिश,अपिश,---- ठोस अपिश] का िनपटान एव ं�बJधन िनiानुसार �कया जाएगा:- (क) पा�रिAथितक# सवंेदी जोन म( ठोस अपिश] का िनपटान और �बंधन भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं"ालय क# समय-समय पर यथा सशंोिधत अिधसूचना सं. का.आ. 1357(अ), �दनांक 8 अ�ैल, 2016 के तहत �कािशत ठोस अपिश] �बंधन िनयम, 2016 के उपबंध0 के अनुसार �कया जाएगा। अकाब�िनक 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पदाथ_ का िनपटान पा�रिAथितक# सवंेदी जोन से बाहर िचिJहत �कए गए Aथान0 पर पया�वरण-अनुकूल रीित से �कया जाएगा; AND WHEREAS, copies of the Gazette containing the draft notification were made available to the public on the 16th October, 2017;
AND WHEREAS, no objections and suggestions were received from the persons and stakeholders in response to the draft notification;
AND WHEREAS, the Kheoni Wildife Sanctuary is located in Dewas and Sehore Districts of Madhya Pradesh and is spread over in an area of 113344..777788 square kilometres, the said Wildlife Sanctuary almost represents the floral and faunal attributes of the Dewas and Sehore Forested landscape and it is a dry deciduous forest, consisting mainly of Tectona grandis, Anogeissus latifolia and Terminalia alata communities and their associated flora;
AND WHEREAS,, the aforesaid Sanctuary is rich in bio-diversity, 69 tree species, 23 herbs and 12 shrubs species and climbers parasites, grasses and bamboo are also found in the said Sanctuary; 24 mammals, 21 birds, 5 reptiles species have been recorded in Kheoni Wildlife Sanctuary which is inhabited by all the usual animals of the region, such as leopard (Panthera pardus), Wolf (Canis lupus), Jackal (canis aureus), Indian fox (Vulpes bengalensis), striped hyena (Hyaena hyaena) among carnivores and Nilgai (Boselaphus tragocamelus), Chinkara (Gazella gazella bennetti), wild pig (Sus scrofa), barking deer (Muntiacus muntjac), etc. amongst herbivores;
AND WHEREAS, the Kheoni Wildlife Sanctuary is extremely rich in flora and fauna and in biodiversity, the said Sanctuary is the important part of corridor which helps in movement of wildlife from Satpura Tiger Reserve to Melghat Tiger Reserve and movement of wildlife from eastern Madhya Pradesh to western Madhya Pradesh;
AND WHEREAS, the aforesaid Sanctuary has southern tropical dry deciduous teak forest as per Champion and Seth Classification and the trees found in the sanctuary include Tectona grandis, Pterocarpus marsupium, Terminalia allata, Anogeissus latifolia, Acacia catechu, etc.;
AND WHEREAS, the important faunal species of the Kheoni Wildlife Sanctuary include Wolf, Indian Fox, Striped hyena, Spotted Deer, Sambar deer, Chinkara, Wild pig, Chowsingha;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Kheoni Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent up to two kilometers from the periphery of the Kheoni Wildlife Sanctuary in the State of Madhya Pradesh as the Kheoni 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Wlidlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone - (1) The extent of Eco-sensitive Zone is up to two kilometres from the periphery of the Kheoni Wildlife Sanctuary and the area of Eco sensitive Zone is 160 square kilometres, and the map and boundary description of the Eco-sensitive Zone are appended as Annexure-I and Annexure II respectively.
(2) The longitude and latitude of the Kheoni Wildlife Sanctuary and Eco-sensitive Zone are appended as Annexure-III;
(3) The list of villages and their co-ordinates falling under the Eco-sensitive Zone is annexed as Annexure-IV.
2. Zonal Master Plan for the Eco-sensitive Zone – (1) The State Government shall, for the purpose of the Ecosensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said Plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture and Horticulture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism including eco-tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal and Urban Development;
(x) Panchayati Raj;
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and the plan shall be supported by maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government -The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for the activity such as -
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and
(v) promoted activities and given under para 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities.
(2) Natural water bodies. - The catchment areas of all natural springs, rivers or channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism. - (a) All new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within one kilometer from the boundary of the Kheoni Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer; Provided that beyond the distance of one kilometer from the boundary of the said Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for Ecotourism facilities as per the Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) Till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation within six months from the date of publication of this notification in the Official Gazette and such Plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared within six months from the date of publication of this notification in the Official Gazette and such Plan shall form part of the Zonal Master Plan.
(6) Noise pollution: Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986, as amended from time to time.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder, as amended from time to time.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder.
(9) Solid wastes.- Disposal and management of solid wastes shall be as under:
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016, as amended from time to time;
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste.- Bio-medical waste management shall be as under - (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Ecosensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.- The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- The prevention and control of vehicular pollution shall be complied with in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG, etc.

(16) Industrial units: (a) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(b) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 04th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P. (C) No.202 of 1995 and dated 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P. (C) No.435 of 2012.
2. Setting of industries including new oil and gas exploration causing pollution (water, air, soil, noise, etc.)
(a) No new industries and expansion of existing polluting industries in the Eco-sensitive Zone shall be permitted.
(b) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification.
3. Establishment of major thermal and major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.

4. Use or production or processing of any hazardous substances.

6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

8. Commercial use of fire wood. Prohibited (except as otherwise provided) as per applicable laws.
9. Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
10. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc.
Regulated under applicable laws.
12. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents.
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution termed as per Classification done by the Central Pollution Control Board of February 2016;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(v) promoted activities listed in this Notification:
(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(c) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
13. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority.
14. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
15. Collection of Forest Produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
16. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws underground cabling may be promoted.
17. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18. Widening and strengthening of existing roads and construction of new roads.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of, the following namely:-
(a) Divisional Commissioner Ujjain -Chairman;
(b) District Collector Dewas -Member;
(c) Divisional Forest Officer Dewas -Member;
(d) Chief Municipal Officer Nagarpalika Dewas -Member;
(e) Superintendent Engineer Public Health Engineering/Water Resources Department/Public Work Department/Madhya Pradesh Electricity Board, Dewas -Member;
(f) One representative of Non-Governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Madhya Pradesh for a period of three years -Member;
(g) Chief Executive Officer of Zilla Panchayat Dewas District -Member;
(h) An expert in the area of ecology and environment to be nominated by the Government of Madhya Pradesh for a period of three years -Member;
(i) Representative of the Town and Country Planning Board -Member;
(j) Representative of the State Pollution Control Board -Member;
(k) Superintendent of Kheoni Wildlife Sanctuary -Member;
(l) Expert in Biodiversity nominated by the State Government -Member;
(m) Chief Conservator of Forest Ujjain -Member Secretary.
6. Terms of reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring Committee shall be three years or till the constitution of the new Committee by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Ecosensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27 scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned work in-charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per performa appended at Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures. - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Orders of Supreme Court, etc.- The provisions of this notification shall be subject to the orders, if any, passed or to be passed by the Hon’ble Supreme Court of India or High Court or National Green Tribunal.
