होता ह;ै और, इस 8े# म( िविभO मह=वपूण� जाितयां जैस ेत(दआु (प�थरेा पाड स), िसयार (कैिनस ऑ�रयस), धारीदार लकड़बPघा (हाइना हाइना), आ�द इस 8े# म( पाए जाते हS। वनFपित और जीवजंतु इस अभयारCय के समUृ जैिवक मह=व का ितिनिध=व करते हS और संरि8त 8े# म( जंगल िब�ली (फेिलस चाउस), छोटा भारतीय मुसंग (िववेरा िजबेथा), सामाBय नेवला (हप��टेस एडव�स ), भारतीय साही (िहि�ट्र�स इंिडका), नीलगाय (बोसेलाफस �ागोकेमेलस), रीसस बंदर (मकाका मुलटा), खरगोश (लेपस िनगरेसिेलस), आ�द, और आवासी और वासी पि8य/ क$ लगभग 200 जाितयां पायी जाती हS। यहा ंक$ जीवजतुं िविवधता Fतनधा रय/ क$ 17 जाितय/, पि8य/ क$ लगभग 201 जाितय/, सरीसृप/ क$ 12 जाितय/, उभयचर/ क$ 5 जाितय/, िततिलय/ क$ 63 जाितय/ और Wगैनफलीज क$ 05 जाितय/ आ�द का ितिनिध=व करती हS। अभयारCय म( पाए जाने वाले मुख वनFपितय/ म( धाक (�यू�टया मोनोसपमा ), इंदरजो (होलोरहनेा !यूब�स�स), भारतीय ए�म (होलो!लेटा इि$टि%फोिलया), कदबं (िम'ा(ा परिवफोिलया), झंड ()ोसोिपस िसना�रया), जाल (स*वाडोरोरा ओलेडो�स), लसरुा (कोरिडया माइ�सा), मेFYयूइट ()ोसोिपस जूली.लोरा), ढोक (एनोगाइिसस प�डुला), सलाई (बोसवेिलया सेराटा), आ�द, हS; और, असोला भAी वBयजीव अभयारCय के चार/ ओर के 8े# को, िजसका िवFतार और सीमाएं इस अिधसूचना के परैा 1 म( िविन[द4 हS, पया�वरण क$ दिृ4 से पा रिFथितक$ संवेदी जोन के ;प म( सरुि8त और संरि8त करना तथा उ. पा रिFथितक$ संवेदी जोन म( उMोग/ या उMोग/ के वग\ के चालन तथा संFकरण करने को ितिषU करना आव^यक ह;ै अतःअतःअतःअतः,,,, अब, केB`ीय सरकार, पया�वरण (संर8ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प ठत पया�वरण (सरं8ण) अिधिनयम, 1986 (1986 का 29) (िजसे इसम ेइसके पbात् पया�वरण अिधिनयम कहाँ गया है) क$ उपधारा (1) और धारा 3 क$ उपधारा (2) एवं उपधारा (3) के खंड (v) और खंड (xiv) 'ारा द> शि.य/ का योग करते @ए, ह रयाणा राeय के फरीदाबाद और गु�Nाम िजले म( असोला भाटी वBयजीव अभयारCय क$ सीमा के चार/ ओर 100 मीटर से 1000 मीटर तक िवस् ता रत 8े# को पा रिFथितक$ संवेदी जोन (िजसे इसम( इसके प^ चात् पा रिFथितक$ संवेदी जोन कहा गया ह)ै के ;प म( अिधसूिचत करती ह,ै िजसका िववरण िनfानुसार है, अथा�त् :- 1.1.1.1. पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर उसक�उसक�उसक�उसक� सीमाएंसीमाएंसीमाएंसीमाएं....- (1) पा रिFथितक$ संवेदी जोन का िवFतार संरि8त 8े# क$ सीमा स े 100 मीटर स े 1000 मीटर तक होगा जो असोला भाटी वBयजीव अभयारCय ह ैऔर पा रिFथितक$ संवेदी जोन का कुल 8े#फल 12.17 वग� �कलोमीटर ह,ै िजसम( से 0.35 वग� �कलोमीटर गु;Nाम िजल ेम( ह ैऔर 11.82 वग� �कलोमीटर फरीदाबाद िजले म( ह।ै (2) असोला भाटी वBयजीव अभयारCय का मानिच# पा रिFथितक$ संवेदी जोन का सीमांकन, सीमाg के 5यौरे और अ8ांश/ तथा दशेांतर/ के साथ उपाबंधउपाबंधउपाबंधउपाबंध----I के ;प म( संलi ह ै। (3) असोला भाटी वBयजीव अभयारCय के पा रिFथितक$ संवेदी जोन के भ-ूिनदjशांक/ क$ सूची उपाबंधउपाबंधउपाबंधउपाबंध----II के ;प म( संलi है । (4) मुGय kबदgु पर उनके भ-ूिनदjशांक/ के साथ पा रिFथितक$ संवेदी जोन के अंतग�त आने वाल े Nाम/ क$ सूची उपाबंधउपाबंधउपाबंधउपाबंध----III के ;प म( संलi ह ै। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 2222.... पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आंचिलकआंचिलकआंचिलकआंचिलक महायोजनामहायोजनामहायोजनामहायोजना....––––(1) राeय सरकार, पा रिFथितक$ संवेदी जोन के योजन के िलए, राजप# म( इस अिधसूचना के काशन क$ तारीख से दो वष� क$ अविध के भीतर, Fथानीय -ि.य/ के परामश� से और इस अिधसूचना म( �दए गए अनुबंध/ का पालन करते @ए राeय सरकार के स8म ािधकारी के अनुमोदनाथ� एक आंचिलक महायोजना तैयार करेगी। (2) पा रिFथितक$ संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म( िविन[दl ट रीित से राe य सरकार 'ारा ासंिगक क( `ीय और राe य िविधय/ तथा क( `ीय सरकार 'ारा जारी माग�िनदjश/, य�द कोई ह/, के अनु;प तैयार क$ जाएगी । (3) आंचिलक महायोजना, पा रिFथितक$ और पया�वरणीय संबंधी सरोकार/ को उ. योजना म( समाकिलत करने के िलए राe य सरकार के िनfिलिखत िवभाग/ के परामश� से तैयार क$ जाएगी:-
(i) पया�वरण;
(ii) वन और वBयजीव;
(iii) कृिष;
(iv) राजF व;
(v) शहरी िवकास;
(vi) पय�टन;
(vii) Nामीण िवकास;
(viii) kसचाई और बाढ़ िनयं#ण;
(ix) नगरपािलका ;
(x) पंचायती राज; और
(xi) लोक िन मा�ण िव भाग। (4) जब तक इस अिधसूचना म( िविन[द4 न हो, आंचिलक महायोजना म( वत�मान म( अनुमो�दत भ-ूउपयोग, अवसंरचना और �mयाकलाप/ पर कोई ितबंध नह< लगाया जाएगा तथा आचंिलक महायोजना म( सभी कार क$ अवसंरचनाg और �mयाकलाप/ क$ बेहतरी क$ -वFथा क$ जाएगी िजससे �क वे अिधक द8 और पा रिFथितक$ अनुकूल बन सक( । (5) आंचिलक महायोजना म( अनाnछा�दत 8े#/ के जीण\Uार, िवMमान जल िनकाय/ के संर8ण, आवाह 8े#/ के बंधन, जल-सभंर/ के बंधन, भ-ूजल के बंधन, मदृा और नमी के संर8ण, Fथानीय जनता क$ आव^यकताg तथा पा रिFथितक$ एवं पया�वरण के ऐसे अBय पहलुg, िजन पर pयान दनेा आव^यक ह,ै क$ -वFथा क$ जाएगी । (6) आंचिलक महायोजना म( सभी िवMमान पूजा F थल/, Nाम/ और शहरी बिFतय/, वन/ के कार/ और �कF म/, आ�दवासी 8े#/, कृिष 8े#/, ऊपजाऊ भिूम, उMान/ एवं उMान/ क$ तरह के ह रत 8े#/, बागवानी 8े#/, बगीच/, झील/, नमभिूमय/ और अBय जल िनकाय/ क$ सीमा का िनधा�रण �कया जाएगा तथा सहायक मानिच# भी �दया जाएगा। इस महा-योजना से संबंिधत सहायक मानिच# म( िवMमान और Fतािवत भूिम के उपयोग क$ िवशेषताg का 5यौरा �दया जाएगा। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) आंचिलक महायोजना के अंतग�त पा रिFथितक$ संवेदी जोन म( िवकास को िविनयिमत करेगी और पैरा 4 क$ सारणी म( सूचीबU ितिषU, िविनयिमत �mयाकलाप/ का पालन करेगी तथा F थानीय समदुाय/ क$ आजीिवका सुर8ा के िलए, पा रिFथितक$ अनुकूल िवकास सुिनि^ चत करेगी तथा संव3धत करेगी। (8) आंचिलक महायोजना 8े#ीय िवकास योजना क$ सह-कािलक होगी । (9) इस कार अनुमो�दत आंचिलक महायोजना इस अिधसूचना के उपबंध/ के अनुसार, मानीटरी के अपने कृ=य/ को करने के िलए मानीटरी सिमित के िलए एक संदभ� दFतावेज होगी। 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय....---- राeय सरकार इस अिधसूचना के उपबंध/ को भावी करने के िलए िनfिलिखत उपाय करेगी, अथा�त्:- (1) भूभभूूभू----उपयोगउपयोगउपयोगउपयोग....–––– (क) पा रिFथितक$ संवेदी जोन म( वन/, बागवानी 8े#/, कृिष 8े#/, आमोद- मोद के योजन के िलए िचिBहत �कए गए उMान/ और खुल ेFथान/ का बड़ ेवािणिeयक या आवासीय प रसर/ संबंधी औMोिगक �mयाकलाप/ के िलए उपयोग या संप रवत�न नह< �कया जाएगा: परंतु पा रिFथितक$ संवेदी जोन के भीतर भाग (क) म( िविन[द4 योजन स ेिभO योजन के िलए कृिष और अBय भिूम का संप रवत�न, मानीटरी सिमित क$ िसफा रश पर और यथा लागू और 8े#ीय नगर योजना अिधिनयम तथा केB`ीय या राeय सरकार के अBय िनयम/ तथा िविनयम/ के अधीन स8म ािधकारी के पूव� अनुमोदन से, तथा इस अिधसूचना के उपबंध/ 'ारा Fथानीय िनवािसय/ क$ िनfिलिखत आवासीय ज;रत/ को पूरा करने के िलए अनुrात �कया जाएगा जैसे �क:- (i) िवMमान सड़क/ को चौड़ा करना और उBह( सुदढृ करना तथा नई सड़क/ का िनमा�ण; (ii) बुिनयादी ढांच/ और नाग रक सुिवधाg का िनमा�ण और नवीकरण; (iii) दषूण उ=पO न करने वाले लघ ुउMोग; (iv) Nामीण उMोग/ सिहत कुटीर उMोग; सिुवधा भCडार और गृह वास सिहत Fथानीय सुिवधाएं जो पा रिFथितक$ पय�टन म( सहायक हS; और (v) संव3धत �mयाकलाप पैराNाफ 4 के अधीन �दया गया ह ै: परंतु यह भी �क 8े#ीय शहरी िनयोजन अिधिनयम के अधीन स8म ािधकारी के पूव� अनुमोदन के िबना तथा राeय सरकार के अBय िनयम/ एवं िविनयम/ का अनुपालन �कए िबना तथा संिवधान के अनुnछेद 244 के उपबंध/ तथा त=समय वृ> िविध, िजसके अंतग�त अनुसिूचत जनजाित और अBय परंपरागत वन िनवासी (वन अिधकार/ क$ माBयता) अिधिनयम, 2006 (2007 का 2) भी ह,ै के अनुपालन के िबना, वािणिeयक या औMोिगक िवकास �mयाकलाप/ के िलए जनजातीय भूिम का योग अनुrात नह< होगा: परंतु यह भी �क पा रिF थितक$ संवेदी जोन के भीतर क$ भूिम के अिभलेख/ म( उ=पO �कसी #ु ट क$, मानीटरी सिमित के िवचार ा? करने के पbात्, राeय सरकार 'ारा =येक मामले म( एक बार शुिU क$ जाएगी और उ. #ु ट के शुिUकरण क$ सूचना क( `ीय सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय को दी जाएगी: परंतु यह भी �क उपयु�. #ु ट के शुिUकरण म(, इस उप-पैरा म( यथा उपबंिधत के िसवाय, �कसी भी दशा म( भ-ूउपयोग का प रवत�न सि%मिलत नह< होगा: (ख) अनु युY त या अनु= पादक कृिष 8े#/ म( पुन: वनीकरण के तथा पया�वास और जैव-िविवधता क$ बहाली के यास �कए जाएंगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (2) �ाकृितक जल ोत�ाकृितक जल ोत�ाकृितक जल ोत�ाकृितक जल ोत.- आचंिलक महायोजना म( सभी ाकृितक जल wोत/ क$ पहचान क$ जाएगी और उनके संर8ण और पुनन�वीकरण के िलए योजना सि%मिलत होगी राeय सरकार 'ारा ऐसे 8े#/ या उनके िनकट िवकास �mयाकलाप/ जो ऐसे 8े#/ के िलए हािनकारक ह,ै को ितिषU करने के िलए ऐसी रीित से माग�दश�क िसUांत तैयार करेगा। (3) पय�टनपय�टनपय�टनपय�टन या पा�रि�थितक�या पा�रि�थितक�या पा�रि�थितक�या पा�रि�थितक�----पय�टन.पय�टन.पय�टन.पय�टन.----(क) पा रिFथितक$ सवेंदी जोन के भीतर सभी नए पय�टन �mयाकलाप या िवMमान पय�टन �mयाकलाप/ का िवFतार पा रिFथितक$ संवेदी जोन सबंंधी पय�टन महायोजना के अनुसार होगा । (ख) पा रिFथितक$-पय�टन महायोजना पय�टन िवभाग 'ारा राeय सरकार के पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना का एक घटक होगी । (घ) पा रिFथितक$-पय�टन संबंधी �mयाकलाप िनfानुसार िविनयिमत ह/गे, अथा�त् :- (i) असोला भाटी वBयजीव अभयारCय क$ सीमा से एक �कलोमीटर के भीतर या पा रिFथितक$ संवेदी जोन के िवFतार तक इनम( जो भी िनकट ह ैनये होटल और रसोट� का िनमा�ण अनुrात नह< ह/गेः परंतु, वBयजीव अभयारCय क$ सीमा से एक �कलोमीटर क$ दरूी से परे पा रिFथितक$ संवेदी जोन के िवFतार तक होटल/ और सैरगाह/ का Fथापन केवल पूव� प रिनिbत 8े#/ म( पय�टन महायोजना के अनुसार पा रिFथितक$ पय�टन सुिवधाg के िलए ही अनुrात होगा; (ii) पा रिFथितक$ संवेदी जोन के भीतर सभी नए पय�टन �mयाकलाप/ या िवMमान पय�टन �mयाकलाप/ का िवFतार पा रिFथितक$ पय�टन पर जोर दतेे @ए क( `ीय सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय के माग�दश�क िसUांत/ के 'ारा तथा राl zीय { या| संर8ण ािधकरण, 'ारा जारी पा रिFथितक$ पय�टन (समय-समय पर यथा संशोिधत) माग�दश�क िसUांत/ के अनुसार होगा; (iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक पय�टन के िलए िवकास और िवMमान पय�टन �mयाकलाप/ के िवFतार वाFतिवक Fथल िविन[द4 संवी8ा तथा मानीटरी सिमित क$ िसफा रश पर स%बU िविनयामक ािधकारी 'ारा अनुrात �कया जाएगा और �कसी नए होटल/ रस\ट या वािणिeयक Fथापन/ के संिनमा�ण क$ अनुrा नह< दी जाएगी। (4) �ाकृितक�ाकृितक�ाकृितक�ाकृितक िवरासतिवरासतिवरासतिवरासत....–––– पा रिFथितक$ संवेदी जोन म( ब@मू�य ाकृितक िवरासत के सभी Fथल/ जैस े �क सभी जीन पूल रजव� 8े#, शैल संरचना, जल पात, झरने, दरj, उपवन, गुफाएं, Fथल, वनपथ, रोहण माग�, उ= पात आ�द क$ पहचान क$ जाएगी तथा उनक$ सुर8ा एवं संर8ण के िलए िवरासत संर8ण योजना बनायी जाएगी जो आंचिलक महायोजना का भाग होगी । (5) मानव िन$मत िवरासत � थमानव िन$मत िवरासत � थमानव िन$मत िवरासत � थमानव िन$मत िवरासत � थलललल....---- पा रिFथितक$ संवेदी जोन म( भवन/, संरचनाg, कृि#म 8े#/, ऐितहािसक, कला=मक और सांFकृितक मह=व के 8े#/ क$ पहचान क$ जाएगी और उनके संर8ण के िलए िवरासत संर8ण योजना बनायी जाएगी जो आंचिलक महायोजना का भाग होगी। (6) % व% व% व% विन �दषूणिन �दषूणिन �दषूणिन �दषूण....- पा रिFथितक$ संवेदी जोन म( p विन दषूण का िनवारण और िनयं#ण पया�वरण अिधिनयम के अधीन बनाए गए pविन दषूण (िविनयमन और िनयं#ण) िनयम, 2000 के अनुसार �कया जाएगा। (7) वायुवायुवायुवायु �दषूण�दषूण�दषूण�दषूण.- पा रिFथितक$ संवेदी जोन म(, वायु दषूण का िनवारण एवं िनयं#ण, वायु ( दषूण िनवारण और िनयं#ण) अिधिनयम, 1981 (1981 का 14) के उपबंधो और उसके अधीन बनाए गए िनयम/ के अनुसार �कया जाएगा। (8) बिह ावबिह ावबिह ावबिह ाव काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण....- पा रिFथितक$ संवेदी जोन म( उपचा रत बिहwाव का िनFसारण, पया�वरण अिधिनयम और उसके अधीन बनाए गए िनयम/ के अBतग�त शािमल �कए गए पया�वरणीय दषूण के िनFसारण संबंधी साधारण मानक/ या राeय सरकार 'ारा िनयत मानक/ के अनुसार �कया जाएगा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (9) ठोसठोसठोसठोस अपिश- अपिश- अपिश- अपिश- ....---- ठोस अपिश4/ का िनपटान और बंधन िनfिलिखत ;प म( होगा:- (क) पा रिFथितक$ संवेदी जोन म( ठोस अपिश4 का िनपटान भारत सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय क$ अिधसूचना सं. का.आ. 1357(अ), �दनांक 8 अ ैल, 2016 के तहत कािशत ठोस अपिश4 बंधन िनयम, 2016 के उपबंध/ के अनुसार �कया जाएगा। गैर-जैिवक पदाथ\ का िनपटान पा रिFथितक$ संवेदी जोन से बाहर िचिBहत �कए गए Fथान पर पया�वरण-अनुकूल रीित से �कया जाएगा; (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 100 meters to 1000 meters around the boundary of the Asola Bhatti Wildlife Sanctuary, in Faridabad and Gurugram districts in the State of Haryana as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: -
1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 100 meters to 1000 metres from the boundary of the protected area, that is the Asola Bhatti Wildlife Sanctuary and the total area of the Eco-sensitive Zone is about 12.17 square kilometres, out of which 0.35 square kilometres falls in Gurugram district and 11.82 square kilometres in Faridabad district.
(2) The map of the Asola Bhatti Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-I.
(3) List of geo-coordinates of Eco-sensitive Zone of Asola Bhatti Wildlife Sanctuary are given in Annexure-II.
(4) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-III.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj; and
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as -
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the Asola Bhatti Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the said Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes.- Disposal and management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Ecosensitive Zone.
(10) Bio-medical waste.– Bio-medical waste management shall be as under.-
(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28 th March, 2016;
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Ecosensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19
(13) E-waste.- The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be in accordance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per the applicable laws.
4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per the applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per the applicable laws.
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per the applicable laws. B. Regulated Activities
8. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
10. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the competent authority.
11. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
12. Collection of Forest Produce or Non-Timber Forest Produce. Regulated as per the applicable laws.
13. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws (underground cabling may be promoted).
14. Infrastructure including civic amenities. Taking measures of mitigation as per the applicable laws, rules and regulations available guidelines.
15. Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation as per the applicable laws, rules and regulations and available guidelines.
16. Undertaking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, microlites, etc. Regulated as per the applicable laws.
17. Protection of hill slopes and river banks. Regulated as per the applicable laws.
18. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
19. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.
20. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies. Regulated (except otherwise provided) as per the applicable laws except for meeting local needs.
21. Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.

5. Monitoring Committee for Monitoring Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification, the Central Government under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. 38. Restoration of degraded land/ forests/ habitat. Shall be actively promoted.

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
