और, उ- ा8प अिधसूचना क% राजप$ क% ितयां जनता को 19 जून, 2018 को उपल2ध करा दी गई थ9; और, उ- ा�प अिधसचूना के :यु5र म' ,ि-य. और पणधा!रय. से कोई आ;ेप और सुझाव ा< नह9 =ए थे; उधयामाथ�नदापुरम प;ी अभयार>य का ;े$ 0.453 वग� �कलोमीटर ;े$ म' फैला =आ (45.28 हBेटेयर) है और यह तिमलनाडु राDय म' िथ8व8र िजला के िथ8थूरईप.डी तालकु म' िEथत ह।ै लोक िनमा�ण िवभाग &ारा अनुरि;त एक Gसचाई टैकँ को जल िनकाय. म' रहने वाले प;ी-जीव के संर;ण के िलए 1998 म' (जी.ओ.एम एम.संIया 379 पया�वरण एवं वन िवभाग, �दनांक-31.12.1998) प;ी अभयार>य घोिषत �कया गया था; और, अभयार>य लंबे समय तक वासी जल प;ी समूह जैस ेब5ख. और बगुल. के िलए आहार और शीतकालीन बसेरा Eथल के बजाए ह।ै Eथानीय वासी और आवासीय जल पि;य. के िलए मह5पूण� बसेरा Eथल ह।ै यहां सामाMय प;ी �लैक-�ाउन नाइट हरेॉन (नयिसटीकोर�स नयिसटीकोर�स), िल�टल कॉम�र�ट (फला�ोरो�स िनगरे) पाए जाते ह।ै यहां यह उ�लेख करना रोचक ह ै�क यह Eथल ओपनिब�ड Eटोक� (अना�टोमुस ओस कटंस) (5,000 से अिधक) के सबस ेबड़ ेसमूह को आOय दान करता ह।ै अMय िविशP जाितयां जो बसेरा के िलए अधीर के दौरान अिधक संIया म' एक$ होती ह,ै उनम' ओ!रएंटल Rहाइट इ2स (थरेि�करिनस मेलानोकेफलुस) शािमल ह;ै और, यह पया�वास ब5ख. क% तीन आवासीय जाितय. अथा�त् लEसेर िRहGEलग ब5ख (द�$ोकयगना जवािनका), कोUब ब5ख (स'किडयो�रिनस मलैानोटोस) और Eपॉटिबल ब5ख (अनास पोइ कलोरयंचा) के जनन के िलए आदश- ह।ै अMय जाितय. जो यहां रीड बेड और .लो/टग वनEपित पर 0जनन करती ह;ै ये ह-ै इंिडयन बWगनी मुरहने (पोरफय�रओ 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पोरफय�रया), इंिडयन मौरह' (ग2लीनु2ला चलोरोपुस), �फज'ट-टीलेड जैकाना (हय$ोफिसअनुस िच3कुस), वाइट-XेEटेड वाटर-हने (अमाउरो4नस पोइिनकु3स) भूिम पर घोषला बनाने वाले प;ी रेड-वाY�ट लिZवग (वने2लुस इंिडकुस) थोड़ी सIंया म' ह।ै वासी और आंिशक 8प स ेआवासीय कॉमन कौट (फुिलका अ5ा) घ.सले इस आ\�भिूम म' घ.षला बनाने हW। बगुल. क% जाितय. म' से Eपॉट िब�ड पेिलकन (पेलेकनुस फिल6प�िसस), पWटेड Eटोक� (मय�टे�रया लेउकोकेफला), यूरेिशयन Eपूनिबल (पलाटालेय लेय�को3 दया) छोटी संIया म' यहां आते हW; और, पा!रिEथितक% संवेदी जोन ;े$ क% जनसंIया लगभग 8700 संIया अिधकांश पर िनभ�र हW और शषे खेतो म' दिैनक मजदरूी Oिमक. के 8प काय� करते हW; ;े$ क% महsवपणू� अथ�,वEथा मुIय 8प से कृिष ह ैऔर पा!रिEथितक% संवेदी ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 जोन का ;े$ 80% से अिधक कृिष के उपयोग म' ह ैऔर शेष ;े$ मछली पालन, पशुपालन और अMय संबंिधत �hयाकलाप. के उपयोग के िलए ह;ै औरऔरऔरऔर,,,, उधयामाथ�नदापुरम प;ी अभयार>य के चार. ओर के ;े$ को, िजसका िवEतार और सीमाएं इस अिधसूचना के पैराeाफ 1 म' िविनtदP हW, पा!रिEथितक% और पया�वरणीय क% दिृP से पा!रिEथितक% संवेदी जोन के 8प म' सुरि;त और संरि;त करना तथा उ- पा!रिEथितक% संवेदी जोन म' उrोग. या उrोग. क% Oेिणय. के चालन तथा संEकरण को ितिषu करना आवvयक ह;ै अतः, अब, केM\ीय सरकार, पया�वरण (सरं;ण) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प!ठत पया�वरण (संर;ण) अिधिनयम, 1986 (1986 का 29) (िजसे इसमे इसके पiात् पया�वरण अिधिनयम कहा ँगया ह)ै क% उपधारा (1) तथा धारा 3 क% उपधारा (2) एवं उपधारा (3) के खंड (v) और खंड (xiv) &ारा द5 शि-य. का योग करते =ए, तिमलनाडु राDय म' उधयामाथ�नदापुरम प;ी अभयार>य क% सभी सीमाy के चार. ओर 0.50 �कलोमीटर तक िवEता!रत ;े$ को उधयामाथ�नदापुरम प;ी अभयार>य पा!रिEथितक% संवेदी जोन (िजसे इसम' इसके पv चात् पा!रिEथितक% संवेदी जोन कहा गया ह)ै के 8प म' अिधसूिचत करती ह,ै िजसका िववरण िनzानुसार ह,ै अथा�त् :-- 1.1.1.1. पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर सीमासीमासीमासीमा--(1) पा!रिEथितक% संवेदी जोन का िवEतार उधयामाथ�नदापुरम प;ी अभयार>य क% सीमा के आसपास 0.50 �कलोमीटर एक समान ह ै और पा!रिEथितक% संवेदी जोन का ;े$ 2.213 वग� �कलोमीटर ह।ै (2) पा!रिEथितक% संवेदी जोन क% सीमा का वण�न उपाबंधउपाबंधउपाबंधउपाबंध----IIII के 8प म' संल{ ह।ै (3) पा!रिEथितक% संवेदी जोन क% सीमा का सीमांकन दशा�ने वाले संरि;त ;े$ का मानिच$ उपाबंधउपाबंधउपाबंधउपाबंध----IIIIIIIIकककक से उपाबंधउपाबंधउपाबंधउपाबंध----IIIIIIIIचचचच म' ह।ै (4) पा!रिEथितक% संवेदी जोन और संरि;त ;े$ क% सीमा के भ-ूिनदjशांक. क% सूची उपाबंधउपाबंधउपाबंधउपाबंध----III III III III म' ह।ै (5) मुख Gबदyु के भ-ूिनदjशांक. के साथ पा!रिEथितक% संवेदी जोन के अंतग�त आने वाले eाम. क% सूची उपाबंधउपाबंधउपाबंधउपाबंध----IVIVIVIV के 8प म' संल{ ह।ै 2222.... पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आंचिलकआंचिलकआंचिलकआंचिलक महायोजनामहायोजनामहायोजनामहायोजना.–(1) राDय सरकार, पा!रिEथितक% संवेदी जोन के योजन के िलए, राजप$ म' अंितम अिधसूचना के काशन क% तारीख स ेदो वष� क% अविध के भीतर, Eथानीय ,ि-य. के परामश� से और इस अिधसूचना म' �दए गए अनुबंध. का पालन करते =ए, राDय सरकार के स;म ािधकारी के अनुमोदनाथ�, एक आंचिलक महायोजना बनाएगी। (2) राD य सरकार &ारा पा!रिEथितक% संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म' िविनtद| ट रीित से तथा ासंिगक क' \ीय और राD य िविधय. के अनु8प तथा क' \ीय सरकार &ारा जारी �दशा िनदjश., य�द कोई ह., के अनुसार बनायी जाएगी । (3) आंचिलक महायोजना म' पा!रिEथितक% और पया�वरण संबंधी सरोकार. को शािमल करने के िलए इसे राD य सरकार के िनzिलिखत िवभाग. के परामश� से बनाया जाएगा, अथा�त्:--

(i) पया�वरण;

(ii) वन और वMयजीव;

(iii) कृिष;

(iv) राजE व;

(v) शहरी िवकास;

(vi) पय�टन;

(vii) eामीण िवकास;

(ix) नगरपािलका;

(x) पंचायती राज;

(xi) लोक िन मा�ण िव भाग;

(xii) राजमाग�; और

(xiii) तिमलनाडु राDय दषूण िनयं$ण बोड�। (4) जब तक इस अिधसूचना म' िविनtदP न हो, आंचिलक महायोजना म' वत�मान म' अनुमो�दत भ-ूउपयोग, अवसंरचना और �hयाकलाप. पर कोई ितबंध नह9 लगाया जाएगा तथा आचंिलक महायोजना म' सभी अवसंरचनाy और �hयाकलाप. म' सुधार करके उMह ेअिधक द; और पा!रिEथितक%-अनुकूल बनाने क% ,वEथा क% जाएगी। (5) आंचिलक महायोजना म' वनरिहत और अवhिमत ;े$. के सुधार, िवrमान जल िनकाय. के संर;ण, आवाह ;$े. के बंधन, जल-संभर. के बंधन, भ-ूजल के बंधन, मृदा और नमी के संर;ण, Eथानीय जनता क% आवvयकताy तथा पा!रिEथितक% एव ंपया�वरण के ऐसे अMय पहलyु क% ,वEथा क% जाएगी िजन पर ~यान �दया जाना आवvयक ह।ै (6) आंचिलक महायोजना म' सभी िवrमान पूजा E थल., eाम. एवं शहरी बिEतय., वन. क% Oिेणय. एव ं�कE म., कृिष ;े$., ऊपजाऊ भिूम, उrान. एवं उrान. क% तरह के ह!रत ;े$., बागवानी ;े$., बगीच., झील. और अMय जल िनकाय. क% सीमा का िनधा�रण �कया जाएगा तथा सहायक मानिच$ भी �दया जाएगा और इस महायोजना म' िवrमान और Eतािवत भ-ू उपयोग क% िवशेषताy का 2यौरा दनेे वाले मानिच$ भी �दए जाएंगे। (7) आंचिलक महायोजना म' पा!रिEथितक% संवेदी जोन म' होने वाले िवकास का िविनयमन �कया जाएगा और सारणी म' यथासूचीबu ितिषu एवं िविनयिमत �hयाकलाप. का पालन �कया जाएगा। इसम' E थानीय जनता क% आजीिवका क% सुर;ा के िलए पा!रिEथितक%-अनुकूल िवकास का भी सुिनiय एवं संवध�न �कया जाएगा। (8) आंचिलक महायोजना, ;े$ीय िवकास योजना क% सह-कािलक होगी । (9) आंचिलक महायोजना पा!रिEथितक% संवेदी जोन म' िवकास को िविनयिमत �कया जाएगा ता�क E थानीय समदुाय. क% आजीिवका सुर;ा के िलए, पा!रिEथितक% अनुकूल िवकास सुिनिv चत �कया जा सके। (10) अनुमो�दत आंचिलक महायोजना, िनगरानी सिमित के िलए एक सदंभ� दEतावेज होगी ता�क वह इस अिधसूचना के उपबंध. के अनुसार िनगरानी के अपने कत�,. का िनव�हन कर सके । 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय....---- राDय सरकार इस अिधसूचना के उपबंध. को भावी बनाने के िलए िनzिलिखत उपाय करेगी, अथा�त्:-- (1) भूभभूूभू----उपयोग.उपयोग.उपयोग.उपयोग.–––– (क) पा!रिEथितक% संवेदी जोन म' वन., बागवानी ;े$., कृिष ;े$., मनोरंजन के िलए िचिMहत उrान. और खुले Eथान. का वृहद वािणिDयक या आवासीय प!रसर. या औrोिगक �hयाकलाप. के िलए योग या संप!रवत�न अनु�ात नह9 �कया जाएगा: परंतु पा!रिEथितक% संवेदी जोन के भीतर भाग (क) म' िविनtदP योजन से िभq योजन के िलए कृिष और अMय भिूम का संप!रवत�न, िनगरानी सिमित क% िसफा!रश पर और स;म ािधकारी के पूव� अनुमोदन से, ;े$ीय नगर योजना अिधिनयम तथा यथा लागू केM\ीय/राDय सरकार के अMय िनयम. एवं िविनयम. के अधीन तथा इस अिधसूचना के उपबंध. के अनुसार Eथानीय िनवािसय. क% िनzिलिखत आवासीय ज8रत. को पूरा करने के िलए अनु�ात �कया जाएगा: (i) िवrमान सड़क. को चौड़ा करना, उMह' सुदढृ करना और नई सड़क. का सिंनमा�ण करना; (ii) बुिनयादी ढांच. और नाग!रक सुिवधाy का संिनमा�ण और नवीकरण; (iii) दषूण उ:पq न करने वाले लघ ुउrोग; (iv) कुटीर उrोग एवं eाम उrोग; पा!रिEथितक% पय�टन म' सहायक सुिवधा भ>डार, Eथानीय सिुवधाएं तथा eह वास; और (v) बढ़ावा �दए गए और पैरा-4 म' उि�लिखत �hयाकलाप। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 परंतु यह भी �क ;े$ीय शहरी िनयोजन अिधिनयम के अधीन स;म ािधकारी के पूव� अनुमोदन के िबना तथा राDय सरकार के अMय िनयम. एवं िविनयम. एवं सिंवधान के अनुaछेद 244 के उपबंध. तथा त:समय वृ5 िविध, िजसके अतंग�त अनुसिूचत जनजाित और अMय परंपरागत वन िनवासी (वन अिधकार. क% माMयता) अिधिनयम, 2006 (2007 का 2) भी आता ह,ै का अनुपालन �कए िबना वािणिDयक या औrोिगक िवकास �hयाकलाप. के िलए जनजातीय भूिम का योग अनु�ात नह9 होगा; परंतु यह भी �क पा!रिE थितक% संवेदी जोन के अंतग�त आने वाली भिूम के अिभलेख. म' =ई �कसी $ु!ट को, िनगरानी सिमित के िवचार ा< करने के पiात्, राDय सरकार &ारा :येक मामल ेम' एक बार सुधारा जाएगा और उ- $ु!ट को सुधारने क% सूचना क' \ीय सरकार के पया�वरण, वन और जलवायु प!रवत�न मं$ालय को दी जाएगी ; 18. पव�तीय ढलान. और नदी तट. का संर;ण । लागू िविधय. के अधीन िविनयिमत होगा । 19. राि$ म' सड़क यातायात का संचलन। लागू िविधय. के अधीन वािणिDयक योजन के िलए िविनयिमत होगा । 20. Ms.No.379 Environment and Forests Department dated the 31 st December, 1998) for the conservation of avian fauna that inhabit the water body; AND WHEREAS, the Sanctuary is an important roosting site for local migrants and resident water bird rather than feeding and wintering grounds for the long distant migrant water bird groups such as ducks and waders; the common generalists are Black-crowned Night Heron (Nycticorax nycticorax), Little Cormorant (Phalacrocorax niger) and this site, probably, supports the largest congregation of Openbilled Stork (Anastomus oscitans) (over 5,000), and other notable species which congregate more in numbers during dusk hours for roosting include Oriental White Ibis (Threskiornis melanocephalus); AND WHEREAS, this habitat is ideal for the breeding of three resident species of ducks namely Lesser Whistling Duck (Dendrocygna javanica) Comb Duck (Sarkidiornis mealanotos) and Spotbilled Duck (Anas poecilorhyncha); other species which breed here on the reed beds and floating vegetation are Indian Purple Moorhen, (Porphyrio porphyria), Indian Moorhen (Gallinulla chloropus), Pheasant-tailed Jacana (Hydrophasianus chirurcus), White-breasted Water-hen (Amaurornis phoenicurus); the bird nesting on the ground is Red-wattled Lapwing (Vanellus indicus); and a small number of migratory and partially resident Common Coot (Fulica atra) utilise this wetland for nesting; among the heronry species which occasionally visits in small numbers are the Spot billed Pelican (Pelecanus philippensis), Painted Stork (Mycteria leucocephala), and Eurasian Spoonbill (Platalea leuccorodia); AND WHEREAS, the daily arrival of roosting birds in the dusk and departure to neighbouring wetlands and paddy fields for feeding in the dawn in such a large numbers is the unique feature of this sanctuary and successful management measures will attract more breeding species and wintering species to enhance the diversity which in turn will attract more tourists, birdwatchers and students; the best time to visit the Sanctuary for bird watching is November-January when bird population and species diversity is at the highest and the earthen mounds provide suitable trees for perching and roosting; AND WHEREAS, the Sanctuary is basically an irrigation tank that is used for storing water for agriculture, which receives water from Mettur dam from August onwards which is further supplemented by the northeast monsoons from October till January; the tank remains completely dry from March to August; and as the Sanctuary is basically an irrigation tank, there is no natural forest within the Sanctuary; Babul (Acacia nilotica) plantations were raised by the Social Forestry wing of the Forest Department during 1985-86 and the other major flora in the tank bunds and foreshore are Inca dulce, Prosopis juliflora,Terminalia arjuna, Ficus bengalensis, Syzigium cumini and Pongamia pinnata, etc which are used for roosting and nesting by the migratory birds like Open billed stork, White ibis etc.; AND WHEREAS, the Sanctuary has 55 species of avian fauna visiting and residing in this small tank spread over 45.285 hectare; the common generalists are Black-crowned Night Heron (Nycticorax nycticoras), Little Cormorant (Phalacrocorax niger) etc. and proper successful management measures will attract more breeding species and wintering species, and the sanctuary has good variety of water and land birds e.g. Little grebe (Tachybaptus ruficollius), Grey Pelican (Pelecanus thilippenisis), Little cormorant (Phalacrocorax 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] niger), Great cormorant (Phalacrocorax carbo), Darter (Anhinga rufa), Oriental Honey-Buzzard (Pernis ptilorhynchus), Black-shouldered Kite (Elanus caeruleus), Barhminy Kite (Haliastur Indus), Western Marsh- Harrier (Circus aeruginosus), Shikra (Accipiter badius), Grey Francolin (Francolinus pondicerianus), Common Quail (Coturnix coturnix), Indian Peafowl (Pavo cristatus) etc.; AND WHEREAS, the good diversity of mammals, reptiles, amphibians, dragonflies, damselflies and butterflies has been recorded in the Sanctuary; example of mammals are Indian Grey Mongoose (Herpestes edwardsii), Three striped palm Squirrel (Funambulus palmarum), Indian flying fox (Pteropus giganteus), Golden Jackal (Canis aureus), Jungle Cat (Felis chaus), Domestic Cow (Bos Taurus) etc; example of reptiles are House Gecko (Hemidactylus frenatus), Spotted Indian Geock (Hemidactylus brookli), Garden Lizard (Calotes versicolor), Green lizard (Calotes calotes), Monitor lizard (Varanus bengalensis,) etc; and example of reptiles are Common Indian Toad (Duttaphrynus melanostictus), Narrow mouthed frog (Microhyla ornate), Painted frog (Kaloula taprobanica), Common tree frog (Polypedatus maculates), Skipper frog (Euphlyctis cyanophlyctis) etc; example of butterflies include Blue Pansy (Junonia orithya), Blue Tiger (Tirumala limniace), Common Bush brown (Mycalesis perseus), Common Emigrant (Catopsilia Pomona), Common Evening Brown (Melanitis ismene), Common Grass Yellow (Eurema hecabe) etc.; AND WHEREAS, the Sanctuary has many endangered species e.g. Great Cormorant (Phalacrocorax carbo), Little Green Heron (Butorides striatus), Yellow Bittern (Lxobrychus sinensis), Chestnut Bittrem (Lxobrychus cinnamomeus), Black Bittern (Dupetor flavicollis), Comb Duck (Sarkidiornis melanotos), etc. and the rare species present in the sanctuary are Spot-billed Pelican (Pelecanus philippensis) and Painted Strok (Mycteria leucocephala); AND WHEREAS, the population of the Eco-sensitive Zone area is around 8700 Nos, most of the people depend on agriculture and the remaining work in the agricultural fields as daily wage workers; the important economy of the area is primarily agriculture and more than 80% of the Eco-sensitive Zone area is in agricultural use and remaining areas are used for fishing, animal husbandry and other related activities; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1, around the protected area of Udhayamarthandapuram Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and

(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an uniform extent of 0.50 Kilometre in all the directions around the boundary of Udhayamarthandapuram Bird Sanctuary in the State of Tamil Nadu as Udhayamarthandapuram Bird Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-Sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone. - (1) The extent of Eco-sensitive Zone is uniformly 0.50 Kilometre in all the directions around the boundary of Udhayamarthandapuram Bird Sanctuary and the area of the Eco-Sensitive Zone is 2.213 square kilometers.

(2) The boundary description of the Eco Sensitive Zone is appended at Annexure-I.

(3) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure-IIA to Annexure-IIF.

(4) List of geo co-ordinates of the boundary of the Protected Area and the Eco-sensitive Zone is at Annexure- III.

(5) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.

2. Zonal Master Plan for Eco-Sensitive Zone. - (1) The State Government shall, for the purposes of the Eco-Sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23

(2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipal;

(x) Panchayati Raj;

(xi) Public Works Department;

(xii) Highways; and

(xiii) Tamil Nadu State Pollution Control Board.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited, regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

(10) The said Master Plan shall regulate development in Eco-Sensitive Zone so as to ensure eco-friendly development for Security of local communities livelihood.

3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-Sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purpose other than that specified in clause

(a) above, within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] other rules and regulations of the Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities;

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone.

(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometres from the boundary of the Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco- Sensitive Zone area. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-Sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.

(7) Air pollution.- Prevention and control of air pollution in the Eco-Sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents. - Discharge of treated effluent in Eco-Sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by the State Government whichever is more stringent.

(9) Solid wastes. - Disposal and management of solid wastes shall be as under:-

(i) the solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone;

(ii) safe and Environmentally Sound Management (ESM) of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(10) Bio-medical waste. – Bio-Medical Waste Management shall be as under-

(i) the Bio-Medical Waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016;

(ii) safe and Environmentally Sound Management (ESM) of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- Sensitive Zone.

(11) Plastic Waste Management. - The Plastic Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.

(12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.

(13) E-waste. - The E-Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units. – (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-Sensitive Zone.

(iii) Only non-polluting industries shall be allowed within Eco-Sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes. - The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion.

4. List of activities prohibited or to be regulated within the Eco-Sensitive Zone.- All activities in the Eco-Sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial Mining. (a) All new (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for personal consumption;

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P. (C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P. (C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc). New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:

Provided that, non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition the, non-polluting cottage industries shall be promoted.

3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per the applicable laws.

4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per the applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per the applicable laws. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27

6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per the applicable laws. B. Regulated Activities

8. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

9. Construction activities.

(a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents, such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution as per the classification done by the Central Pollution Control Board;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including homestays; and

(v) promoted activities listed in this notification:

Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

10. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the competent authority. 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

11. Felling of Trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

12. Collection of Forest Produce or Non-Timber Forest Produce. Regulated as per the applicable laws.

13. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws (underground cabling may be promoted).

14. Establishment of large scale commercial livestock and poultry farms by firms, corporate and companies. Regulated (except as otherwise provided) as per the applicable laws except for meeting local needs.

15. Infrastructure including civic amenities. Taking measures of mitigation, as per applicable laws, rules, regulations and available guidelines.

16. Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation, as per applicable laws, rules, regulations and available guidelines.

17. Undertaking other activities related to tourism like over flying the Eco- Sensitive Zone area by hot air balloon, helicopter, drones, microlites, etc. Regulated as per the applicable laws.

18. Protection of hill slopes and river banks. Regulated as per the applicable laws.

19. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.

20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.

21. Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per the applicable laws.

22. Commercial extraction of surface and ground water. Regulated as per the applicable law.

23. Open Well, Bore Well, etc. for agriculture or other usage. Regulated under applicable laws and the activity shall be strictly monitored by the concerned authority.

24. Solid Waste Management. Regulated as per the applicable laws.

25. Introduction of exotic species. Regulated as per the applicable laws.

26. Eco-tourism. Regulated as per the applicable laws.

27. Use of polythene bags. Regulated as per the applicable laws.

29. Rain water harvesting. Shall be actively promoted.

30. Organic farming. Shall be actively promoted.

31. Adoption of green technology for all activities. Shall be actively promoted.

32. Cottage industries including village artisans, etc. Shall be actively promoted.

33. Use of renewable energy and fuels. Bio-gas, solar light, etc. to be actively promoted.

34. Agro-Forestry. Shall be actively promoted.

35. Use of eco-friendly transport. Shall be actively promoted.

36. Skill development. Shall be actively promoted.

37. Restoration of degraded land/forests/habitats. Shall be actively promoted.

38. Environmental awareness. Shall be actively promoted.

5. Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification. - For effective monitoring of the provisions of this notification, the Central Government, under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, hereby constitutes a Monitoring Committee, comprising of the following, namely: -

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring Committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per performa given in Annexure V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional Measures.-The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
