और, उ, �ा8प अिधसूचना क� राजप� क� �ितया ंजनता को 25 मई, 2018 को उपल1ध करा दी गई थ9; और, उ, �ा�प अिधसूचना के �:यु;र म$ +ि,य- और पणधा�रय- से �ा< आ5ेप- और सुझाव- पर मं�ालय म$ िवचार 4कया गया था; िच�ागंुडी प5ी अभयार>य िजसे अ?यथा ‘’िच�ागंडुी क?माई’’ के नाम से जाना जाता ह,ै दि5णी तिमलनाडु के मुदकुुलाथूर तालुक और रामनाथपुरम िजले म$ ि@थत ह।ै यह तिमलनाडु के रामनाथपरुम िजले के िच�ागंडुी Cाम का भाग ह।ै िच�ागंुडी प5ी अभयार>य तिमलनाडु के रामनाथपुरम िजले म$ अ5ांश 09°19’उ और दशेांतर 078°28’28’28’28’पू के बीच ि@थत ह।ै अभयार>य को अनुमािनत 5े� 0.4763 वग� 4कलोमीटर के साथ वष� 1989 म$ घोिषत 4कया गया था। यह िच�ागंुडी Cाम के एस.एफ.स.ं159 म$ ि@थत ह;ै और, इसे व?यजीव सरं5ण अिधिनयम, 1972 क� धारा 18 (1) के अथ� और दायरे के अंतग�त जल- िनकाय- म$ रहने वाले जलीय प5ी जीव- के सरं5ण के उIJेय स े पया�वरण और वन िवभाग (एफ आर वी) के तारीख 21 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िसतKबर, 1989 के शासनादशे सं.684 के #ारा अभयार>य के 8प म$ अिधसूिचत 4कया गया ह।ै यहां देश के िविभN भाग- से आहार के िलए अनके 4क@म के �वासी प5ी आते हO। +@त मौसम के दौरान यहां 43 �जाितय- के लगभग 11000 प5ी सूचीबQ 4कय ेगय ेहO और यहां के महRवपूण� पि5य- म$ वाइट इिबस, 1लैक इिबस, ओपन- िबSलेड @Tोक, सफेद बगुला, मैना, टील, बतख, डारटेरस, हरेोन, पेिलथनस आ4द सिKमिलत हO; और, यह अभयार>य िभN-िभN �कार क� वन@पित और जीवजतंुU का सबस े बड़ा वास ह ै और यहां संकटापN �जाितयाँ �चरु संXया म$ हO िजनम$ पेिलकन, पOटेड @Tोक, यूरािसयन @पुन िबल, वाइट इिबस, डारटेर, फलेZमंगो और कॉमन कूट, िपन टेल, Cागन,े इगरेटस, कोरमोर$\स, 1लैक Zवं]ड ि@टSट, ^कंग 4फशर, कॉमन मैना, बराहZमंनी काइट, @पो_ेड ओवलेट जैस ेजल प5ी और 30 से अिधक अिभिलिखत सामा?य प5ी सिKमिलत हO; और, यह अभयार>य शीतकालीन �वासी पि5य- के िलए आदश� पया�वास हO जहां �जनन और आहार क� दिृb से घ-सल े बनान े और आहार के िलए +ापक दायरा ह।ै दि5ण भारत क� ओर �वास करने वाले औपिनवेिशक पि5य- के पसंदीदा आcय-@थल- म$ से एक ह।ै अdटूबर से फरवरी तक इस अभयार>य म$ मह:वपूण� प5ी आते हO। इस आe�भूिम क� गहराई अिनयिमत ह ैऔर सामा?य वषा� होने क� ि@थत म$ इसम$ 3 से 5 महीने तक जल भरा रहता ह;ै और, यह अभयार>य मूल 8प से Zसंचाई टOक ह ै िजसका उपयोग अdटूबर से जनवरी तक उ;रपवू� मानसनू #ारा संभ�रत जल का कृिष के िलए भंडारण 4कया जाता ह।ै माच� स ेअग@त तक यह यह टOक पूरी तरह सूखा रहता ह।ै चूं4क यह अभयार>य मूल 8प से Zसंचाई टOक ह,ै यहां अभयार>य के अंतग�त कोई �ाकृितक वन नह9 ह।ै 1980 के दशक के दौरान वन िवभाग के सामािजक वािनक� Zवगं #ारा बबूल (अकैिशया िनलो�टका) के पेड़ लगाए गए थे; और, इस अभयार>य क� मXुय वन@पित नीरमुSली (हायगरो�फला �चु�ली (हिैमSट) एम.आर. अSमेइदा), नायउरीिव (अचयरांथसे असपेरा एल.), पनाइ (बोरा�सुस फलाबे�लीफेर एल.), इ8dकु (कलोटरोिपस िगगिंथया (एल.) आर.बीआर.), वे\टुfाया-थाज़हाई (�ीडै�स परोकु ब!स एल.), मौकिथपौ (पारथेिनउम हाय�टेरोफो%स एल.), अवराम, अवाराइ (स&ेा अउरीकुलाटा (एल.) रोdसब) पुिलया मारम (तमा�रनदसु इंिडका एल.), नाई कदगु,ु नाई वाइलेइ (�लेओमे िव�कोसा एल.), नेइवेिलकाटमनाdकु (लपोमोियया कारिनया जा�य.), िवसानुकारंदी (इवा�वालसु अि�सनोइदसे (एल.) एल.), वेSला�रfाइ, कैराfाइ (कुकुिमस �टीवुस एल.) आ4द हO। इस अभयार>य के एक Zसंचाई टOक होने के कारण यहां जीवजतंु �जाितया ं (प5ी जीव- को छोड़कर) बhत कम है ँिजनम$ भारतीय C ेनेवला (हरेपे�टेस इदवारदिस), भारतीय पाSम िगलहरी (फुना बुलुस प�मा%म), िसयार (कैिनस ऑ�रयस), 1लैक-नेपड खरगोश (लेपुस िनगरीकोि�लस) और ब/डीकूट रैट (ब/डीकोटा ब!गाल!िसस) सिKमिलत हO; और, इस अभयार>य म$ िसफ� एक मानव ब@ती ह ैजो इसक� दि5णी सीमा अथा�त ् िच�ांगडुी पर ि@थत ह,ै िजसे िच�ागंडुी गावं कहते हO। इस Cाम म$ मुXयत: अगडे समदुाय के लोग रहते है।ँ अिधकांश Cामवासी मारवार जाित स े सबंंिधत हO। याधवर और िपSलई जाितय- म$ �:येक 40 सद@य- के साथ संXया म$ बराबर ह।ै सभी Cामवासी Zहदं ूधम� को मानते हO। चार Cाम िच�ागंुडी, इराईचीकुलम, एस पी को_ई और प-दमपुली िच�ागंडुी प5ी अभयार>य के िनकट ि@थत ह,ै जो िच�ागंुडी पंचायत क� अिधका�रता म$ आत$ ह;ै और, Cाम क� कुल जनसंXया म$ 2350 पु8ष और 2850 िjयां हO। अिधकतम जनसंXया िच�ागंडुी Cाम म$ ह ैऔर उसके बाद इराईचीकुलम, एसपी को_ाई और प-दमपुली Cाम- म$ ह।ै सभी Cाम- म$ प�रवार- क� कुल संXया ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 910 ह ैऔर लगभग 818 प�रवार- के पास िनजी भूिम ह।ै हालां4क, कुल प�रवार- म$ से आधे से अिधक (690) गरीबी रेखा से नीचे हO। कृिष और सKबर 4kयाकलाप जैसे 4क पशु पालन और कुdकुट –पालन �@तािवत पा�रि@थितक� सवंेदी जोन म$ रहने वाले लोग- के िलए अथ�+व@था का �मुख jोत है।ँ lट और कोयला बनाना भी यहां के लोग- क� आजीिवक़ा का साधन ह;ै अतः, अब, के?eीय सरकार, पया�वरण (संर5ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प�ठत पया�वरण (संर5ण) अिधिनयम, 1986 (1986 का 29) (िजसे इसम$ इसके पoात् पया�वरण अिधिनयम कहा गया ह)ै क� धारा 3 क� उपधारा (1) तथा उपधारा (2) के खडं (v) और खंड (xiv) और उपधारा (3) #ारा �द; शि,य- का �योग करत े hए, तिमलनाडु राqय म$ िच�ांगडुी प5ी अभयार>य क� सभी सीमाU के चार- ओर 0.08 4कलोमीटर से 1.88 4कलोमीटर तक िव@ता�रत 5े� को िच�ांगडुी प5ी अभयार>य पा�रि@थितक� सवंेदी जोन (िजसे इस अिधसूचना म$ इसके पJ चात् पा�रि@थितक� संवेदी जोन कहा गया ह)ै के 8प म$ अिधसूिचत करती ह,ै िजसका िववरण िनtानुसार ह,ै अथा�त् :-- 1.1.1.1. पा�रि�थितक पा�रि�थितक पा�रि�थितक पा�रि�थितक सवंेदीसवंेदीसवंेदीसवंेदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर सीमासीमासीमासीमा....-(1) पा�रि@थितक� संवेदी जोन का िव@तार िच�ागंडुी प5ी अभयार>य के चार- ओर 0.08 4कलोमीटर से 1.88 4कलोमीटर तक ह।ै पा�रि@थितक� संवेदी जोन का 5े�फल 4.7972 वग� 4कलोमीटर ह।ै (2) पा�रि@थितक� संवेदी जोन क� सीमा का वण�न उपाबधंउपाबधंउपाबधंउपाबधं----IIII के 8प म$ संलu ह।ै (3) पा�रि@थितक� सवंेदी जोन क� सीमा का सीमांकन दशा�ने वाले संरि5त 5े� का मानिच� उपाबधंउपाबधंउपाबधंउपाबधं----IIIIIIII कककक----चचचच पर ह।ै (4) पा�रि@थितक� संवेदी जोन और संरि5त 5े� क� सीमा के भू-िनदvशांक- क� सचूी kमश: उपाबधंउपाबधंउपाबधंउपाबधं----III (III (III (III (कककक) ) ) ) और ((((खखखख)))) म$ ह।ै (5) �मुख-@थल- पर भ-ूिनदvशांक- के साथ पा�रि@थितक� संवेदी जोन के अंतग�त आने वाले Cाम- क� सूची उपाबधंउपाबधंउपाबधंउपाबधं----IVIVIVIV के 8प म$ संलu ह।ै 2222.... पा�रि�थितक पा�रि�थितक पा�रि�थितक पा�रि�थितक सवंेदीसवंेदीसवंेदीसवंेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना.–(1) राqय सरकार, पा�रि@थितक� संवेदी जोन के �योजन के िलए, राजप� म$ अंितम अिधसूचना के �काशन क� तारीख से दो वष� क� अविध के भीतर, @थानीय +ि,य- के परामश� से और इस अिधसूचना म$ 4दए गए अनुबंध- का पालन करत े hए, राqय सरकार के स5म �ािधकारी के अनुमोदनाथ�, एक आंचिलक महायोजना बनाएगी। (2) राq य सरकार #ारा पा�रि@थितक� सवंेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म$ िविनwद�x ट ऐसी रीित से तथा सुसंगत क$eीय और राq य िविधय- के अनु8प तथा क$ eीय सरकार #ारा जारी 4दशा िनदvश-, य4द कोई ह-, के अनुसार बनायी जाएगी । (3) आंचिलक महायोजना म$ पा�रि@थितक� और पया�वरण संबंधी सरोकार- को सिKमिलत करने के िलए इसे राq य सरकार के िनtिलिखत िवभाग- के परामश� से बनाया जाएगा, अथा�त्:- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(i) पया�वरण,

(ii) वन और व?यजीव,

(iii) कृिष,

(iv) राज@ व,

(v) शहरी िवकास,

(vi) पय�टन,

(vii) Cामीण िवकास,

(viii) Zसंचाई और बाढ़ िनयं�ण,

(ix) नगरपािलका,

(x) पंचायती राज,

(xi) लोक िन मा�ण िव भाग,

(xii) राजमाग�, और

(xiii) तिमलनाडु राqय �दषूण िनयं�ण बोड�। (4) जब तक इस अिधसूचना म$ िविनwद�b न हो, आंचिलक महायोजना म$ वत�मान म$ अनुमो4दत भू-उपयोग, अवसंरचना और 4kयाकलाप- पर कोई �ितबंध नह9 लगाया जाएगा तथा आचंिलक महायोजना म$ सभी अवसंरचनाU और 4kयाकलाप- म$ सुधार करके उ?ह ेअिधक द5 और पा�रि@थितक�-अनुकूल बनाने क� +व@था क� जाएगी। (5) आंचिलक महायोजना म$ वनरिहत और अवkिमत 5े�- के सुधार, िवzमान जल िनकाय- के संर5ण, आवाह 5े�- के �बंधन, जल-संभर- के �बंधन, भू-जल के �बंधन, मृदा और नमी के संर5ण, @थानीय जनता क� आवJयकताU तथा पा�रि@थितक� एव ंपया�वरण के ऐसे अ?य पहलुU क� +व@था क� जाएगी िजन पर {यान 4दया जाना आवJयक ह।ै (6) आंचिलक महायोजना म$ सभी िवzमान पजूा @ थल-, Cाम- एव ं शहरी बि@तय-, वन- क� cेिणय- एव ं4क@ म-, कृिष 5े�-, ऊपजाऊ भूिम, उzान- एवं उzान- क� तरह के ह�रत 5े�-, बागवानी 5े�-, बगीच-, झील- और अ?य जल िनकाय- क� सीमा का िनधा�रण 4कया जाएगा तथा सहायक मानिच� भी 4दया जाएगा और इस महायोजना म$ िवzमान और �@तािवत भ-ू उपयोग क� िवशेषताU का 1यौरा दनेे वाले मानिच� भी 4दए जाएगंे। (7) आंचिलक महायोजना म$ पा�रि@थितक� संवेदी जोन म$ होने वाले िवकास का िविनयमन 4कया जाएगा और सारणी म$ यथासूचीबQ �ितिषQ एवं िविनयिमत 4kयाकलाप- का पालन 4कया जाएगा और इसम$ @ थानीय जनता क� आजीिवका क� सुर5ा के िलए पा�रि@थितक�-अनुकूल िवकास का भी सुिनoय एवं संवध�न 4कया जाएगा। (8) आंचिलक महायोजना, 5े�ीय िवकास योजना क� सह-कािलक होगी । (9) इस �कार अनुमो4दत आचंिलक महायोजना, िनगरानी सिमित के िलए एक संदभ� द@तावेज होगी ता4क वह इस अिधसूचना के उपबंध- के अनुसार िनगरानी के अपने कत�+- का िनव�हन कर सके । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय....---- राqय सरकार इस अिधसूचना के उपबंध- को �भावी बनान ेके िलए िनtिलिखत उपाय करेगी, अथा�त:्-- (1) भूभभूूभू----उपयोग.उपयोग.उपयोग.उपयोग.–––– (क) पा�रि@थितक� सवंेदी जोन म$ वन-, बागवानी 5े�-, कृिष 5े�-, मनोरंजन के िलए िचि?हत उzान- और खुले @थान- का वृहद वािणिqयक या आवासीय प�रसर- या औzोिगक 4kयाकलाप- के िलए �योग या संप�रवत�न अनु}ात नह9 4कया जाएगा: परंतु पा�रि@थितक� सवंेदी जोन के भीतर भाग (क) म$ िविनwद�b �योजन स ेिभN �योजन के िलए कृिष और अ?य भूिम का संप�रवत�न, िनगरानी सिमित क� िसफा�रश पर और स5म �ािधकारी के पूव� अनुमोदन से, 5े�ीय नगर योजना अिधिनयम तथा यथा लागू के?eीय या राqय सरकार के अ?य िनयम- एवं िविनयम- के अधीन तथा इस अिधसूचना के उपबंध- के अनुसार @थानीय िनवािसय- क� िनtिलिखत आवासीय ज8रत- को पूरा करने के िलए अनु}ात 4कया जाएगा:- (i) िवzमान सड़क- को चौड़ा करना, उ?ह$ सुदढृ करना और नई सड़क- का संिनमा�ण करना; (ii) बुिनयादी ढांच- और नाग�रक सुिवधाU का संिनमा�ण और नवीकरण; (iii) �दषूण उ:पN न करन ेवाले लघु उzोग; (iv) कुटीर उzोग एवं Cाम उzोग; पा�रि@थितक� पय�टन म$ सहायक सुिवधा भ>डार, @थानीय सुिवधाए ंतथा Cह वास; और (v) बढ़ावा 4दए गए पैरा-4 म$ उिSलिखत 4kयाकलाप। परंतु यह भी 4क 5े�ीय शहरी िनयोजन अिधिनयम के अधीन स5म �ािधकारी के पूव� अनमुोदन के िबना तथा राqय सरकार के अ?य िनयम- एवं िविनयम- एवं संिवधान के अनु�छेद 244 के उपबंध- तथा त:समय �वृ; िविध, िजसके अंतग�त अनुसिूचत जनजाित और अ?य परंपरागत वन िनवासी (वन अिधकार- क� मा?यता) अिधिनयम, 2006 (2007 का 2) भी आता ह,ै का अनुपालन 4कए िबना वािणिqयक या औzोिगक िवकास 4kयाकलाप- के िलए जनजातीय भूिम का �योग अनु}ात नह9 होगा: परंतु यह भी 4क पा�रि@ थितक� सवंेदी जोन के अंतग�त आने वाली भूिम के अिभलखे- म$ hई 4कसी �ु�ट को, िनगरानी सिमित के िवचार �ा< करन ेके पoात्, राqय सरकार #ारा �:येक मामले म$ एक बार सुधारा जाएगा और उ, �ु�ट को सुधारन ेक� सूचना क$ eीय सरकार के पया�वरण, वन और जलवाय ुप�रवत�न मं�ालय को दी जाएगी: परंतु यह भी 4क उपयु�, �ु�ट को सुधारन ेम$, इस उप-पैरा म$ यथा उपबंिधत के िसवाय, 4कसी भी दशा म$ भू-उपयोग का प�रवत�न सिKमिलत नह9 होगा । (ख) अन�ुयुd त या अनु: पादक कृिष 5े�- म$ पुन: वनीकरण तथा पया�वास- और जैव- िविवधता क� बहाली के �यास 4कए जाएगं े। (2) �ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत....- आंचिलक महायोजना म$ सभी �ाकृितक जल �ोत- के आवाह 5े�- क� पहचान करके उनके संर5ण और बहाली क� योजना सिK मिलत क� जाएगी और राq य सरकार #ारा माग�दश�क िसQांत इस रीित से बनाए जा�ग े 4क उसम$ इन 5े�- या इनके आसपास के 5े�- के िलए हािनकारक िवकास 4kयाकलाप- को �ितिषQ 4कया गया हो। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) पय�टन पय�टन पय�टन पय�टन या पा�रि�थितक पय�टन.या पा�रि�थितक पय�टन.या पा�रि�थितक पय�टन.या पा�रि�थितक पय�टन.–––– (क) पा�रि@थितक� सवंेदी जोन म$ सभी नए पा�रि@थितक� पय�टन 4kयाकलाप या िवzमान पय�टन 4kयाकलाप- का िव@तार पा�रि@थितक� संवदेी जोन सKबंधी पय�टन महायोजना के अनुसार अनु}ात होगा; (ख) पा�रि@थितक� पय�टन महायोजना राqय सरकार के पया�वरण और वन िवभाग- के परामश� स े पय�टन िवभाग #ारा बनायी जाएगी; (ग) पय�टन महायोजना आंचिलक महायोजना का घटक होगी । (घ) पा�रि@थितक� पय�टन सबंंधी 4kयाकलाप िनK नानुसार िविनयिमत 4कए जाएगं,े अथा�त ्:- (i) व?यजीव अभयार>य क� सीमा से एक 4कलोमीटर के भीतर या पा�रि@थितक� संवदेी जोन क� सीमा तक, इनम$ जो भी अिधक िनकट हो, 4कसी होटल या �रसोट� का नया सिNमा�ण अनु}ात नह9 4कया जाएगा। परंतु, पा�रि@थितक� पय�टन सुिवधाU के िलए व?यजीव अभयार>य क� सीमा से एक 4कलोमीटर क� दरूी से परे पा�रि@थितक� संवेदी जोन क� सीमा तक पूव� प�रभािषत और अिभिहत 5े�- म$ पय�टन महायोजना के अनुसार, नए होटल- और �रसोट� क� @थापना अनु}ात होगी। (ii) पा�रि@थितक सवंेदी जोन के भीतर सभी नए पय�टन 4kयाकलाप- या िवzमान पय�टन 4kयाकलाप- का िव@तार पा�रि@थितक� पय�टन पर जोर दतेे hए क$ eीय सरकार के पया�वरण, वन और जलवाय ुप�रवत�न मं�ालय के माग�दश�क िसQांत- के #ारा तथा राx Tीय � या� सरं5ण �ािधकरण, #ारा जारी पा�रि@थितक पय�टन (समय-समय पर यथा संशोिधत) माग�दश�क िसQांत- के अनुसार होगा; 19. पव�तीय ढलान- और नदी तट- का संर5ण । लागू िविधय- के अधीन िविनयिमत होगा । 20. राि� म$ सड़क यातायात का संचलन । लागू िविधय- के अधीन वािणिqयक �योजन के िलए िविनयिमत होगा । 21. @थानीय जनता #ारा अपनायी जा रही वत�मान कृिष और बागवानी पQितय- के साथ डेय�रयां, द]ुध उ:पादन, जल कृिष और म:@य पालन। @थानीय जनता के �योग के िलए लागू िविधय- के अधीन अनु}ात ह-गे।

S.O. 1929(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 2143 (E), dated the 24 th May, 2018, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, the copies of the Gazette containing the said draft notification were made available to the public on the 25 th May, 2018; AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the aforesaid draft notification were considered in the Ministry; AND WHEREAS, the Chitrangudi Bird Sanctuary otherwise known as “Chitrangudi Kanmai” is located in Mudukulathur taluk and Ramanathapuram district of southern Tamil Nadu. It is a part of Chitrangudi Village of Ramanathapuram District of Tamil Nadu. The Chitrangudi Bird Sanctuary lies between Latitude 09°19’N and 078°28’E Longitude in the Ramanathapuram District of Tamil Nadu. The sanctuary was declared in the year of 1989, with an estimated area of 0.4763 square kilometre. It is located in S.F No. 159 of Chitrangudi Village; AND WHEREAS, It is notified as a sanctuary within the meaning and scope of section 18 (1) of Wildlife Protection Act 1972, through the G.O Ms. No 684, Environment and Forest Department (FRV) dated the 21 st September, 1989 for the conservation of avian fauna that inhabit the water body. Many of the different varieties of migratory birds arrive from various parts of countries for feeding purpose. About 11000 birds belonging to 43 species have been listed during the peak season and the important birds include, white ibis, black ibis, open-billed stork, egrets, mynas, teals, ducks, darters, herons, pelicans etc.; AND WHEREAS, the Sanctuary is biggest resident for variety of floral and faunal diversity and has species richness of nearly threatened species such as Pelican, Painted stork, Eurasian Spoon bill, White ibis, Darter, Flamingo and water birds such as common coot, Pin tail, Garganey, Egrets, Cormorants, Black winged stilt, King fisher, Common myna, Brahminy kite, Spotted Owlet and more than 30 common birds are documented; AND WHEREAS, the sanctuary offers ideal habitat for winter migratory birds with considerable diversity in nesting and feeding behaviour for breeding and feeding. It is one of the preferred nesting sites for heronry species and colonial birds migrating to South India. The feathered visitors flock the sanctuary from October to February. The wetland is irregular in depth and retains water for 3 to 5 months, if rain is normal; AND WHEREAS, the sanctuary is basically an irrigation tank that is used for storing water for agriculture recharged by the northeast monsoons from October till January. The tank remains completely dry from March to August. As the sanctuary is basically an irrigation tank, there is no natural forest within the sanctuary. Babul (Acacia nilotica) plantations were raised by the Social Forestry wing of the Forest Department during 1980s; AND WHEREAS, the major flora in the sanctuary are Neermulli (Hygrophila schulli (Hamilt.) M.R.Almeida), Nayurivi (Achyranthes aspera L.), Panai (Borassus flabellifer L.), Erukku (Calotropis gigantea (L.) R.Br.), Vettukkaayathazhai (Tridax procumbens L.), Mookthipoo (Parthenium hysterophorus L.), Avaram, Avaarai (Senna auriculata (L.) 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Roxb.) Puliya maram (Tamarindus indica L.), Nai kadugu, Nai vaelai (Cleome viscosa L.), Neivelikatamanakku (Ipomoea carnea Jacq.), Vishnukarandi (Evolvulus alsinoides (L.) L.), Vellarikkaai, Keerakkaai (Cucumis sativus L.) etc. The sanctuary being an irrigation tank has very less faunal species (except Avifauna) which include Indian Grey Mongoose (Herpestes edwardsii), Indian Palm Squirrel (Funambulus palmarum), Jackal (Canis aureus), Black -naped Hare (Lepus nigricollis) and Bandicoot Rat (Bandicota bengalensis); AND WHEREAS, the sanctuary has only one settlement that abuts it on the southern border, namely Chitrangudi Village. The village is mainly constituted by forward community population. Majority of the villagers belong to Maravar caste. Yadhavar and Pillai castes are on par in number with 40 members each. All the villagers follow Hindu religion. Four villages, Chitrangudi, Eraichikulam, SP Kottai and Pondampuli are present in the vicinity of the Chitrangudi bird sanctuary under the jurisdiction of Chitrangudi Panchayat; AND WHEREAS, the total population of the village consists of 2350 males and 2850 females. Maximum population is located in Chitrangudi village followed by Eraichikulam, SP Kottai and Pondampuli. Total number of households in all the villages is 910 and nearly 818 households own land; however, more than half of the total households (690) are below poverty line. Agriculture and allied activities such as livestock rearing, poultry are the major sources of economy for the people living in the proposed Eco sensitive zone. Brick making and charcoal making also contribute to their livelihood; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from 0.08 kilometres to 1.88 kilometres around the boundary of Chitrangudi Bird Sanctuary in the State of Tamil Nadu as the Chitrangudi Bird Sanctuary Ecosensitive Zone (hereafter in this notification referred to as the Eco-Sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone. - (1) The extent of Eco-sensitive Zone varies from 0.08 kilometres to

1.88 kilometres around the Chitrangudi Bird Sanctuary. The area of the Eco-Sensitive Zone is 4.7972 square kilometres.

(2) The boundary description of the Eco Sensitive Zone is appended at Annexure I.

(3) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure IIA-F.

(4) List of geo co-ordinates of the boundary of the Protected Area and the Eco-Sensitive Zone is at Annexure III (A) and (B) respectively.

(5) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure IV.

2. Zonal Master Plan for Eco-Sensitive Zone. - (1) The State Government shall, for the purposes of the Eco-Sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority of State.

(2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment,

(ii) Forest and Wildlife,

(iii) Agriculture,

(iv) Revenue,

(v) Urban Development,

(vi) Tourism,

(vii) Rural Development,

(viii) Irrigation and Flood Control,

(ix) Municipal,

(x) Panchayati Raj,

(xi) Public Works Department,

(xii) Highways, and

(xiii) Tamil Nadu State Pollution Control Board. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited, regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for Security of local communities livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-Sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given under paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities;

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone; 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(b) the Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests;

(d) the activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometres from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-Sensitive zone whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-Sensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-Sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.

(7) Air pollution.- Prevention and control of air pollution in the Eco-Sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents. - Discharge of treated effluent in Eco-Sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes. - Disposal and management of solid wastes shall be as under:-

(i) the solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone;

(ii) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(10) Bio-medical waste. – Bio-Medical Waste Management shall be as under:-

(i) the Bio-Medical Waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 29

(ii) safe and Environmentally Sound Management (ESM) of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive Zone.

(11) Plastic Waste Management. - The Plastic Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.

(12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.

(13) E-Waste. - The E-Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units. – (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-Sensitive Zone.

(iii) Only non-polluting industries shall be allowed within Eco-Sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes. - The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion.

(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.

4. List of activities prohibited or to be regulated within the Eco-Sensitive Zone.- All activities in the Eco- Sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial Mining. (a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country 30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] tiles or bricks for housing and for personal consumption;

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P. (C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of

2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc). New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:

Provided that, non-polluting industries shall be allowed within Eco- Sensitive Zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition the, nonpolluting cottage industries shall be promoted.

3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per the applicable laws.

4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per the applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per the applicable laws.

6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per the applicable laws. B. Regulated Activities

8. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

9. Construction activities.

(a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents, such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution as per the classification done by the Central Pollution Control Board;

(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including homestays; and ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 31

(v) promoted activities listed in this notification:

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

10. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.

11. Felling of Trees. a. There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. b. The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.

12. Collection of Forest produce or Non- Timber Forest Produce. Regulated as per the applicable laws.

13. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws of underground cabling may be promoted.

14. Solid Waste Management. Regulated as per the applicable laws.

15. Establishment of large scale commercial livestock and poultry farms by firms, corporate and companies. Regulated (except as otherwise provided) as per the applicable laws except for meeting local needs.

16. Infrastructure including civic amenities. Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.

17. Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.

18. Undertaking other activities related to tourism like over flying the Eco- Sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated as per the applicable laws.

19. Protection of hill slopes and river banks. Regulated as per the applicable laws.

20. Movement of vehicular traffic at night. Regulated for commercial purpose as per the applicable laws.

21. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.

22. Discharge of treated waste water/effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per the applicable laws.

23. Commercial extraction of surface and ground water. Regulated under applicable law.

24. Open Well, Bore Well etc. for agriculture or other usage. Regulated under applicable laws and the activity shall be strictly monitored by the concerned authority.

25. Introduction of Exotic species. Regulated as per the applicable laws.

36. Agro-Forestry. Shall be actively promoted.

37. Use of eco-friendly transport. Shall be actively promoted.

38. Skill Development. Shall be actively promoted.

39. Restoration of Degraded Land/Forests/Habitats. Shall be actively promoted.

40. Environmental awareness. Shall be actively promoted.

5. Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification .-For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 the Central Government hereby constitutes a Monitoring Committee, comprising of the following members namely:-

6. Terms of Reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

2. A representative of Non-government Organisation working in the field of wildlife conservation to be nominated by State Government Member,

3. An expert in Biodiversity nominated by the State Government Member,

4. District Environment Officer, Environment Department Member,

5. Assistant Director, Panchayat, Ramanathapuram Member,

6. Town Planning Officer/ Executive Officer, Panchayat Member,

7. Executive Engineer, Public Works Department, Ramanathapuram Member,

8. District Environmental Engineer, Tamil Nadu State Pollution Control Board, Ramanathapuram Member,

9. Deputy Director, Mines and Minerals Department Member,

10. Wildlife Warden, Gulf of Mannar Marine National Park, Ramanathapuram Member -Secretary ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 33

(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma given in Annexure V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal. [F.
