(i) पया�वरण;
(ii) वन और व=यजीव;

(v) शहरी िवकास;
(vi) पय�टन;
(vii) Gामीण िवकास;
(viii) Kसचाई और बाढ़ िनयं$ण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िन मा�ण िव भाग;
(xii) राजमाग�; और
(xiii) पिAम बंगाल राjय दषूण िनयं$ण बोड�। (4) जब तक इस अिधसूचना म' िविनOदP न हो, आंचिलक महायोजना म' वत�मान म' अनुमो�दत भ-ूउपयोग, अवसंरचना और �sयाकलाप. पर कोई ितबंध नह3 लगाया जाएगा तथा आचंिलक महायोजना म' सभी अवसंरचनाM और �sयाकलाप. के सुधार क% ,वDथा क% जाएगी िजससे �क वे अिधक द: और पा!रिDथितक% अनुकूल बन सक' । (5) आंचिलक महायोजना म' वन रिहत एवं अवsिमत :े$. क% बहाली, िवVमान जल िनकाय. के संर:ण, आवाह :े$. के बंधन, जल-सभंर. के बंधन, भ-ूजल के बंधन, मदृा और नमी के सरं:ण, Dथानीय जनता क% आवCयकताM तथा पा!रिDथितक% एवं पया�वरण के ऐसे अ=य पहलMु क% ,वDथा क% जाएगी िजन पर tयान दनेा आवCयक ह।ै (6) आंचिलक महायोजना म' सभी िवVमान पूजा D थल., Gाम. एवं शहरी बिDतय., वन. क% _ेिणय. एवं �कD म., कृिष :े$., ऊपजाऊ भिूम, उVान. एवं उVान. क% तरह के ह!रत :े$., बागवानी :े$., बगीच., झील., नमभिूमय. और अ=य जल िनकाय. क% सीमा का िनधा�रण �कया जाएगा तथा सहायक मानिच$ भी �दया जाएगा। इस महायोजना म' िवVमान और Dतािवत भ-ू उपयोग क% िवशेषताM का 2यौरा दनेे वाले मानिच$ भी �दए जाएंगे। (7) आंचिलक महायोजना म' पा!रिDथितक% संवेदी जोन म' होने वाले िवकास का िविनयमन �कया जाएगा और सारणी के पैराGाफ 4 म' यथा सूचीबc ितिषc, एवं िविनयिमत �sयाकलाप. का पालन �कया जाएगा। इसम' D थानीय जनता क% आजीिवका क% सुर:ा के िलए पा!रिDथितक% अनुकूल िवकास का भी सिुनAय और संवध�न �कया जाएगा। (8) अनुमो�दत आंचिलक महायोजना, िनगरानी सिमित के िलए एक संदभ� दDतावेज होगी ता�क वह िनगरानी के अपने कत�,. का इस अिधसूचना के उपबंध. के अनुसार िनव�हन कर सके। 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय....---- राjय सरकार इस अिधसूचना के उपबंध. को भावी बनाने के िलए िनnिलिखत उपाय करेगी, अथा�त् :-- (1) भूभभूूभू----उपयोग.उपयोग.उपयोग.उपयोग.---- पा!रिDथितक% संवेदी जोन म' वन., बागवानी :े$., कृिष :े$., उVान. तथा आमोद- मोद के योजन के िलए िचि=हत �कए गए खुले Dथान. का बड़ ेवािणिjयक और आवासीय प!रसर. संबंधी औVोिगक �sयाकलाप. के िलए उपयोग या संप!रवत�न नह3 �कया जाएगा: परंतु पा!रिDथितक% संवेदी जोन के भीतर कृिष और अ=य भिूम का संप!रवत�न मानीटरी सिमित क% िसफा!रश पर और राjय सरकार के पूव� अनुमोदन से, Dथानीय िनवािसय. क% िनnिलिखत आवासीय आवCयकताM को और �sयाकलाप. को पूरा करने के िलए अनुwात �कया जाएगा, जैस-े (i) िवVमान सड़क. को चौड़ा करना और उ=ह' सुदढृ करना तथा नई सड़क. का िनमा�ण; (ii) बुिनयादी ढांच. और नाग!रक सुिवधाM का िनमा�ण और नवीकरण; (iii) दषूण उ9पF न करने वाले लघ ुउVोग;
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iv) Gामीण उVोग. सिहत कुटीर उVोग; सुिवधा भ>डार और गृह वास सिहत Dथानीय सुिवधाए ंजो पा!रिDथितक% पय�टन म' सहायक हQ; और (v) पैराGाफ 4 म' वJणत �sयाकलाप. क% अिभवृिc करना: परंतु यह और भी �क :े$ीय नगर योजना अिधिनयम और राjय सरकार के अ=य िनयम. और िविनयम. के अंतग�त स:म ािधकारी के पूर्व अनुमोदन से और संिवधान के अनुyछेद 244 और त9समय वृ6 िविध के उपबंध. के अनुपालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अ=य परंपरागत वन िनवासी (वन अिधकार. क% मा=यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिjयक या उVोग िवकास �sयाकलाप. के िलए जनजातीय भूिम का उपयोग अनुwात नह3 होगा: परंतु यह और भी �क पा!रिDथितक% संवेदी जोन के भीतर भ-ूअिभलेख. म' उपसंजात कोई $ु!ट, मानीटरी सिमित के िवचार ा; करने के पAात् राjय सरकार &ारा 9येक मामले म' एक बार संशोिधत होगी और उ- $ु!ट के संशोधन क% सूचना क' iीय सरकार के पया�वरण, वन और जलवायु प!रवत�न मं$ालय को दी जाएगी: परंतु यह और भी �क उपयु�- $ु!ट का संशोधन म' इस उप-पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म' भू-उपयोग का प!रवत�न सिHमिलत नह3 होगा: परंतु यह और भी �क िजससे ह!रत :े$ म' जैसे वन :े$, कृिष :े$ आ�द म' कोई पा!रणािमक कटौती नह3 होगी और वनीकरण तथा वास जीणfcार �sयाकलाप. सिहत अन युR त या अनु9 पादक कृिष :े$. म' पुन: वनीकरण करने के यास �कए जाएंगे । (2) �ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत.- आचंिलक महायोजना म' सभी ाकृितक जल |ोत., न�दय. और जलसरणी के आवाह :े$. क% पहचान क% जाएगी और उनके सरं:ण और पुनX}भूतकरण के िलए योजना सिH मिलत होगी और राj य सरकार &ारा ऐसे :े$. पर या उनके िनकट िवकास �sयाकलाप ितिषc करने के िलए ऐसी रीित से माग�िनदoश तैयार �कए जाएंगे । (3) पय�टनपय�टनपय�टनपय�टन....---- (क) पा!रिDथितक% संवेदी जोन के भीतर सभी नए पय�टन �sयाकलाप या िवVमान पय�टन �sयाकलाप. का िवDतार पा!रिDथितक% संवेदी जोन संबंधी पय�टन महायोजना के अनुसार होगा । (ख) पय�टन महायोजना पय�टन िवभाग &ारा राjय सरकार के पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना का एक घटक होगी । (घ) पय�टन संबंधी �sयाकलाप िनnानुसार िविनयिमत ह.गे, अथा�त् :- (i) संरि:त :े$ क% सीमा से एक �कलोमीटर के भीतर या पा!रिDथितक संवेदी जोन के िवDतार तक, इनम' जो भी िनकट ह,ै नये होटल और !रसोट� का िनमा�ण अनुwात नह3 ह.गेः परंतु, संरि:त :े$ क% सीमा से एक �कलोमीटर क% दरूी स ेपरे पा!रिDथितक संवेदी जोन के िवDतार तक होटल. और सैरगाह. का Dथापन केवल पूव� प!रिनिAत :े$. म' पय�टन महायोजना के अनुसार पा!रिDथितक पय�टन सुिवधाM के िलए ही अनुwात होगा। (ii) पा!रिDथितक संवेदी जोन के भीतर सभी नए पय�टन �sयाकलाप. या िवVमान पय�टन �sयाकलाप. का िवDतार पा!रिDथितक% पय�टन पर जोर दतेे <ए क' iीय सरकार के पया�वरण, वन और जलवायु प!रवत�न मं$ालय के माग�दश�क िसcांत. के &ारा तथा राq Wीय a या� संर:ण ािधकरण, &ारा जारी पा!रिDथितक पय�टन (समय-समय पर यथा संशोिधत) माग�दश�क िसcांत. के अनुसार होगा; (iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक पय�टन के िलए िवकास और िवVमान पय�टन �sयाकलाप. के िवDतार वाDतिवक Dथल िविनOदP संवी:ा तथा मानीटरी सिमित क% िसफा!रश पर सHबc िविनयामक ािधकारी &ारा अनुwात �कया जाएगा और �कसी नए होटल/!रसfट या वािणिjयक Dथापन. के संिनमा�ण क% अनुwा नह3 दी जाएगी। (4) नैस#गकनैस#गकनैस#गकनैस#गक िवरासतिवरासतिवरासतिवरासत....---- पा!रिDथितक% संवेदी जोन म' मह9वपूण� नैसJगक िवरासत के सभी Dथल. जैसे सभी जीन कोश आरि:त :े$, शैल िवरचनाएं, जल पात., झरन., घाटी माग�, उपवन., गुफाएं, Dथल., �मण, अ�रोहण, पात. आ�द क% पहचान क% जाएगी और उ=ह' संरि:त �कया जाएगा तथा उनक% सुर:ा और संर:ा के िलए इस अिधसूचना के अंितम काशन क% तारीख से छह मास के भीतर, उपयु- योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (5) मानव िन#मत िवरासत � थमानव िन#मत िवरासत � थमानव िन#मत िवरासत � थमानव िन#मत िवरासत � थलललल....---- पा!रिDथितक% संवेदी जोन म' भवन., संरचनाM, िश�प-त�य, ऐितहािसक, कला9मक और सांDकृितक मह9व के :े$. क% पहचान क% जाएगी और इस अिधसूचना के काशन क% तारीख से छह मास के भीतर उनके संर:ण क% योजना तैयार करनी होगी तथा आंचिलक महायोजना म' सिHमिलत क% जाएगी । (6) % व% व% व% विन �दषूणिन �दषूणिन �दषूणिन �दषूण....- पया�वरण (संर:ण) अिधिनयम 1986 के अधीन tविन दषूण (िविनयमन और िनयं$ण) िनयम, 2000 म' िनयत उपबंध. के अनुसरण म' पा!रिDथितक% संवेदी जोन म' tविन दषूण के िनयं$ण के िलए िविनयम. और उसके अधीन समय समय पर बनाए गए संशोिधत िनयम. को काया�ि=वत करेगा। (7) वायुवायुवायुवायु �दषूण�दषूण�दषूण�दषूण .- पा!रिDथितक% संवेदी जोन म', वायु दषूण क% रोकथाम और िनयं$ण वायु ( दषूण िनवारण और िनयं$ण) अिधिनयम, 1981 (1981 का 14) के उपबंध. के अनुसार अनुपालन �कया जाएगा । (8) बिह�ावबिह�ावबिह�ावबिह�ाव काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण.- पा!रिDथितक% संवेदी जोन म' उपचा!रत बिह|ाव का िनDसारण, जल ( दषूण िनवारण तथा िनयं$ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम. तथा समय-समय पर यथा संशोिधत �कए गए उपबंध. के अनुसार होगा । (9) ठोसठोसठोसठोस अपिश-अपिश-अपिश-अपिश-.... ---- ठोस अपिशP. का िनपटान और बंधन िनnिलिखत �प म' होगा - (क) पा!रिDथितक% संवेदी जोन म' ठोस अपिशP िनपटान और बंधन समय-समय पर संशोिधत ठोस अपिशq ट बंधन िनयम, 2016, जो भारत सरकार के पया�वरण, वन और जलवायु प!रवत�न मं$ालय क% अिधसूचना सं. का.आ. 1357(अ) तारीख 8 अ ैल, 2016 &ारा कािशत �कए गए थ,े के उपबंध. के अनुसार �कया जाएगा; (ख) Dथानीय ािधकरण जैव िनnीकरणीय और अजैव िनnीकरणीय संघटक. म' ठोस अपिशP. के पृथ�रण के िलए योजनाएं तैयार कर'गे; (ग) जैव िनnीकरणीय सामGी को अिधमानतः खाद बनाकर या कृिम खेती के माtयम स ेपुनःच�sत �कया जाएगा; (एनटीएफपी) का संGह । लागू िविधय. के अधीन िविनयिमत होगा । 17. िवVुत और संचार टॉवर लगाने, तार-िबछाने तथा अ=य बुिनयादी ढांचे क% ,वDथा । लागू िविधय. के अधीन िविनयिमत होगा । भूिमगत केबल िबछाने को बढ़ावा �दया जाएगा। 18. नाग!रक सुिवधाM सिहत बुिनयादी ढांचा। इसक%,वDथा लागू िविधय., िनयम., िविनयम. और मौजूदा �दशािनदoश. के अनुसार उपशमन उपाय. के साथ क% जाएगी। 19. िवVमान सड़क. को चौड़ा करना, उ=ह' सुदढृ बनाना और नई सड़क. का िनमा�ण । लागू िविधय., िनयम., िविनयम. और मौजूदा �दशािनदoश. के अनुसार उपशमन उपाय. के साथ �कया जाएगा। 20. पय�टन से संबंिधत अ=य �sयाकलाप जैसे �क पा!रिDथितक% संवेदी जोन :े$ के ऊपर से गम� वायु के गु2बारे, हलेीकाNटर, \ोन, माइsोलाइ�स उडाना आ�द। लागू िविधय. के अधीन िविनयिमत होगा ।
21. पव�तीय ढ़लान. और नदी तट. का संर:ण । लागू िविधय. के अधीन िविनयिमत होगा । 22. राि$ म' सड़क यातायात का सचंलन । लागू िविधय. के अधीन वािणिjयक योजन के िलए िविनयिमत होगा । 23.

(iv) Gामीण बंधन िवभाग, पिAम बंगाल सरकार का एक ितिनिध सदD य;
(v) कृिष िवभाग, पिAम बंगाल सरकार का एक ितिनिध सदD य;
(vi) शहरी िवकास और आवास िवभाग, पिAम बंगाल सरकार का एक ितिनिध, सदD य;

AND WHEREAS, the copies of the Gazette containing the said draft notification were made available to the public on the 22 nd February, 2018;
AND WHEREAS, no objections or suggestions were received from persons and stakeholders in response to the said draft notification;
AND WHEREAS, the Chapramari Wildlife Sanctuary with an area of 9.60 square kilometers has a great significance in the forested landscape of Jalpaiguri district of West Bengal along with its forest, riverine ecosystem and adjoining tea gardens and villages including their diverse ethnicities;
AND WHEREAS, the location of the Sanctuary is just under the hills of Kalimpong Division, thus it serves as meeting point of many animals and birds of the plains of Jalpaiguri district and hills of Darjeeling district;
AND WHEREAS, the Sanctuary serves as a vital link between the forests of Sipchu and Khumani in the North and Panjhora Forest Block in the South and this forms a corridor which is widely utilised by migrating elephants moving in both North-South and East-West directions and vice-versa;
AND WHEREAS, the Sanctuary is visited by a number of animal species specified under Schedule-I of the Wildlife (Protection) Act, 1972 (53 of 1972) which includes the Indian Elephant (Elephas maximus), Gaur (Bos gaurus), Chinese Pangolin (Manis pentadactyla), Leopard (Panthera pardus),Indian Rock Python (Python molurus), Malayan Giant Squirrel (Ratufa bicolor), Leopard Cat (Felis benghalensis), etc. Recently it is frequently visited by The Great Indian one horned Rhinoceros (Rhinoceros unicornis) coming from adjoining Gorumara National Park;
AND WHEREAS, the Sanctuary is a paradise for birds such as the Green Magpie (Cissa chinensis), Indian Treepie (Dendrocitta vagabunda), Himalayan Treepie (Dendrocitta sp.), Rufous necked Laughing Thrush (Garrulax ruficollis), Fairy Blue Bird (Irena sp.), Lesser Racket tailed Drongo (Dicrurus remifer), Black headed shrike (Pteruthius rufiventer), Scarlet Minivet (Pericrocotus speciosus), Hill Myna (Gracula religiosa), White Breasted Kingfisher (Halcyon smyrnensis), Three-toed Kingfisher (Ceyx erithaca), Pallas Fishing Eagle (Haliaeetus leucoryphus), Large grey headed Fishing Eagle (Haliaeetus ichthyaetus), Shikra (Accipiter badius), Lesser Adjutant Stork (Leptoptilos javanicus), etc;
AND WHEREAS, for effective conservation and protection of the rich biodiversity of the Sanctuary, the extent of different anthropogenic pressures has to be regulated as the immediate area adjoining this fragile ecosystem is much ecologically sensitive having great impact on this protected area;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Chapramari Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zones;
NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an uniform extent of two kilometres around the boundary of the Chapramari Wildlife Sanctuary in the State of West Bengal as the Chapramari Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:- 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is bounded by 26053’50.4” N latitude and 88 0 53’32.4” E longitude towards east; 26 0 53’06.0” N latitude and 88 0 47’55.8” E longitude towards west; 26056’30.0” N latitude and 88052’32.4” E longitude towards north and 26052’18.1” N latitude and 88053’07.6” E longitude towards south.; the extent of Eco-sensitive Zone is uniform two kilometers around the Chapramari Wildlife Sanctuary and the area of the Eco-Sensitive Zone is 37.60 square kilometers.
(2) The map of the Eco-sensitive Zone boundary along with boundary description is at Annexure I.
(3) The list of geo co-ordinates of the boundary of the protected area and the Eco-sensitive Zone is at Annexure II.
(4) The list of villages within the Chapramari Wildlife Sanctuary Eco-sensitive Zone is appended as Annexure III.
2. Zonal Master Plan for Eco-sensitive Zone. – (1) The State Government shall, for the purpose of effective management of the Eco-Sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this Notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared, in consultation with the following State Departments, for integrating environmental and ecological considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department;
(xii) Highways;
(xiii) West Bengal State Pollution Control Board.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use. – Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities.
Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents and for activities such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies. - The catchment areas of all natural springs, rivers and channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism. - (a) All new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zones whichever is nearer:

Provided that beyond the distance of one kilometre from the Eco-sensitive Zones boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per the Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction shall be permitted within the Eco-sensitive Zone area.
(4) Natural heritage. - All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation within six months from the date of publication of this notification in the official Gazette and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared within six months from the date of publication of this notification in the official Gazette and such plan shall form part of the Zonal Master Plan.
(6) Noise pollution. - The prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986, as amended from time to time.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under, as amended from time to time.
(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder, as amended from time to time.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8 th April, 2016, as amended from time to time;
(b) the local authorities shall draw up plans for segregation of solid wastes into biodegradable and nonbiodegradable components;
(c) the biodegradable materials shall be recycled preferably through composing or vermiculture;
(d) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zones.
(10) Bio-medical waste. - The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28 th March,2016 as amended from time to time.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17 in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317 (E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste. - The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall to be made for use of cleaner fuel.
(16) Industrial units. - (i) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes. - The protection of hill slopes shall be as under: -
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:— TABLE Sl. (a) New (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.
(b) The mining operations shall be carried out in 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs.
UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries including new oil and gas exploration causing pollution (Water, Air, Soil, Noise, etc.)
(a) No new industries and expansion of existing polluting industries in the Eco-sensitive Zone shall be permitted.
(b) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.
3. Establishment of major thermal and major hydroelectric projects.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Setting of new saw mills and wood based industries.
No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
7. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
8. Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
Regulated activities
10. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the protected area or upto the extent of Ecosensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents.
(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
12. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
13. Establishment of large scale commercial livestock and poultry farms by firms, companies, etc.
Regulated under applicable laws.
14. Small scale non-polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority.
15. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
16. Collection of Forest Produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
17. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws. (underground cabling may be promoted).
18. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules, regulations and available guidelines.
19. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules, regulations and available guidelines.
20. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, microlites, etc.

21. Protection of hill slopes and river banks. Regulated under applicable laws.

5. Monitoring Committee.- The Central Government hereby constitutes the Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) Concerned Collector Chairperson;
(ii) a representative of the State Pollution Control Board Member;
(iii) one representative of non-Governmental Organisation (working in the field of environment including heritage conservation) to be nominated by the State Government Member;
(iv) a representative of Rural Management Department, Government of West Bengal Member;
22. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
23. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water, and the discharge of treated waste water/effluent shall be regulated as per applicable laws.
24. Commercial use and extraction of surface and ground water.
Regulated under applicable laws.
25. Open well, bore well etc. for agriculture or other usage.
Regulated under applicable laws and the activity shall be monitored by the concerned authority.
26. Solid waste management /bio-medical waste management.
Regulated under applicable laws.
27. Introduction of exotic species. Regulated under applicable laws.

(v) a representative of Agriculture Department, Government of West Bengal Member;
(vi) a representative of Urban Development and Housing Department, Government of West Bengal Member;
(vii) a representative nominated by the Forest and Environment Department of West Bengal Member;
(viii) an expert in biodiversity to be nominated by the State Government Member;
(ix) an expert in ecology and environment to be nominated by the State Government Member;
(x) in-charge protected area Member-Secretary.
6. Terms of reference. - (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring Committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof shall be scrutinised by the monitoring committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State under intimation to the Ministry of Environment, Forest and Climate Change as per the Performa appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional Measures. - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Supreme court, etc. orders. - The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
