PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पयाावरण, वन और जलवाय ुपररवतान मतं्रालय ऄजधसचूना नइ ददल्ली, 17 जनवरी, 2022 का.अ. 210(ऄ).—प्रारुप ऄजधसूचना भारत के राजपत्र, ऄसाधारण में भारत सरकार के पयाावरण, वन और जलवायु पररवतान, मंत्रालय की ऄजधसूचना सं. का.अ. 122(ऄ), तारीख 12 जनवरी, 2021, द्वारा प्रकाजित की गइ थी जजसमें ऐसे सभी व्यजियों से, जजनकी ईससे प्रभाजवत होने की संभावना थी, ईस तारीख से, जजसको ईि ऄजधसूचना को ऄन्तर्ववष्ट करने वाल े राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थीं, साठ ददन की ऄवजध के भीतर अक्षपे और सुझाव अमंजत्रत दकए गए थ;े और, ईि प्रारूप ऄजधसूचना को ऄन्तर्ववष्ट करन े वाले राजपत्र की प्रजतयां जनता को तारीख 13 जनवरी, 2021, को ईपलब्ध करा दी गइ थी; और, पूवोि प्रारुप ऄजधसूचना के ईत्तर में व्यजियों और पणधाररयों से कोइ भी अक्षेप और सुझाव प्राप्त नहीं हुए; और, सुरीनसार–मनसार वन्यजीव ऄभयारण्य ईत्तर में तवी नदी, पूवा में ईधमपुर-सांबा सड़क और गोम्बीर खाड, दजक्षण-पूवा में बोट्टल-बीलौर सड़क और मनसार झील, ईत्तर-पजिम में तवी नदी और सुरीनसार झील के बीच 97.82 वगा दकलोमीटर के क्षेत्र में ऄवजस्ट्थत ह ैऔर ऄभयारण्य तीन जजलों जम्मू-ईधमपुर और सांबा में फैला हुअ ह ैऔर मुख्य भाग संघ राज्यक्षेत्र जम्मू और कश्मीर के जम्मू जजला में पड़ता ह;ै और, सुरीनसार–मनसार वन्यजीव ऄभयारण्य ऄजधसूचना संख्या एसअरओ 138 तारीख 10 ऄप्रलै, 1990 के द्वारा वन्यजीव ऄभयारण्य घोजित दकया गया था और ऄभयारण्य में प्रजतरूप सुरीनसार और मनसार झील भी िाजमल ह ै जजसे 2005 में ऄन्तरााष्ट्रीय महत्त्व की रामसर अर्द्ाभूजम सूची में जोड़ा गया था और भारत सरकार के राष्ट्रीय अर्द्ाभूजम संरक्षण कायाक्रम में भी िाजमल दकया गया ह;ै स.ं 206] नइ ददल्ली, सोमवार, जनवरी 17, 2022/पौि 27, 1943 No. 206] NEW DELHI, MONDAY, JANUARY 17, 2022/PAUSHA 27, 1943 सी.जी.-डी.एल.-अ.-19012022-232733 CG-DL-E-19012022-232733 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, क्षेत्र जवजभन्न जंगली वनस्ट्पजत और जीवजंत ुप्रजाजतयों के प्रवधान, संरक्षण और स्ट्थायीकरण के जलए “जीन पूल” का प्रजतजनजधत्व करता ह ैऔर सुरीनसार-मनसार वन्यजीव ऄभयारण्य से ऄजभजलजखत की गइ जीवजंतु प्रजाजतयों में स्ट्तनधाररयों की 15 प्रजाजतयां, पजक्षयों की 86 प्रजाजतयां, सरीसृपों की 17 प्रजाजतयां, मछजलयों की 8 प्रजाजतयां (कोटवल.2012) िाजमल हैं; और, सुरीनसार–मनसार वन्यजीव ऄभयारण्य और आसके जनकटवती वन क्षेत्र को समृद्ध वन्यजीव और लुप्तप्राय जीवजंतु जैसे भारतीय लॉन्ग जबल्लड जगद्ध (जजप्स आंजडकस), भारतीय वाआट-बैक्कड जगद्ध (जजप्स बेंगालेंजसस), स्ट्टेप्पे इगल (ऄक्यूआला जनपालेंजसस), सामान्य तेंदअु (पेन्थरेा प्रड्यूस), भारतीय मॉजनटर जलजााड (वारानुस बेंगालेंजसस) की लाभप्रद जनसंख्या के वास स्ट्थल होने के कारण संरक्षण के ईदे्दश्य से प्राथजमकता दी जाती ह;ै और, ऄभयारण्य में मुख्य जीवजंतु प्रजाजतयां मुंजक (मुजन्टएक्स मुन्तजक), नीलगाय (बोसेलाफुस रागोकमेलुस), गोरल (नेमोरहाआदसु गोरल), बनैला सूऄर (सस स्ट्क्रोफा), जसयार (कैजनस ऑररयस), खरगोि(लेपुस जनगरीकोजल्लस), जंगली जबल्ली (फेजलस चाउसा), साही (जहस्ट्रीक्स आंजडका), नेवला (हपास्ट्टेस एड्वडासी), ऄगामा जलजााड (ऄगामा ऄगरोनेंजसस), ग्राडान जलजााड (कलोटेस वेजसकॉलोर), भारतीय कोबरा (नाजा नाजा), सामान्य करैत (बंुगेरस कैरुलस), रूस्ट्सेल वाआपर (जवपेरा रूस्ट्सेली रूस्ट्सेली), रैट स्नेक (पटयास मकुोसुस), ग्रास स्नेक (ऄजम्फआस्ट्मा स्ट्टोलाटा), कैट स्नेक (बोआगा टरीगोनाटा), भारतीय कुकरी स्नेक (ओलीजगडोन ओरनेंजसस), चेके्करेड कीलबैक स्नेक (एक्सनोचरोदफस जपसकटोर), भारतीय बुल्ल मेंढक (हापलोबातराकस रटग्रीजनस), भारतीय टोड (बुफो मेलनेोजस्ट्टकस), माबालेड टोड (बुफो स्ट्टोमाटीकस), अदद पाइ जाती हैं; और, क्षेत्र में महत्त्वपणूा पक्षी प्रजाजतयों में मयूर पक्षी (पावो दक्रस्ट्टेट), रेड जंगली मुरगा (गल्लुस गल्लुस), काला तीतर (फरान्कोजलनुस फरांकोजलनुस), ग्र ेतीतर (फरांकोजलनुस पोंडीकेरीऄनुस), बुि दिल (परेडीकुलाटा एजसयारटका), रेड कछुअ डव (स्ट्टरेपटोपेजलया रराक्यूआबारीका), ब्ल ूरॉक कबूतर (कोलुम्बा जलजवया), ररग डव (स्ट्टरेपटोपेजलया जसकेक्टो), स्ट्पोटे्टड छोटा ईल्ल ू (एथेना बरामा), ब्ल ू जे (कोराजसयस बेंगालेंजसस), पैराकैटस (पजसट्टाकुला कयानौकेफला), हूपे (ईपुप एपोपस), एजियन कोआल (आईद्यानमय स्ट्कोलोपाकेया), बाब्बलेरस (तुरडोआड्स कौडाटस) जवद्यमान ह;ै और, िीत ऊतु के दौरान प्रजतरूप सुरीनसार-मनसार झीलें जलकुक्कुट की जनसखं्या की ऄच्छी संख्या को अकर्वित करती हैं और झील े प्रवासी जलकुक्कुट जैसे सामान्य टील (ऄनास के्रक्का), माल्लाडा (ऄनास प्लैटीररनचोस), सामान्य पोचाडा (ऄनास फेरीना), टफरटड बतख (ऄयथया फुजलगअु), गडवाल (ऄनास स्ट्टरपेरा), ब्राह्मणी बतख (टडोनाा फेररूजगनेया), जवजजयन (ऄनास पेनेलोप)े, ग्रे बगलुा (ऄरदयेा जसनेरा), पोंड बगुला (ऄरदेया गरायी), नाआट बगुला (न्यजिसोरक्स न्यजिसोरक्स), छोटा आग्रेट (आगरेट्टा गरजेट्टा), केट्टल आग्रेट (बुबुलकस आजबस), भारतीय मूरहने (गजल्लनलुा चलोरोपस), पपाल मूरहने (पेरचुररओ ओरफयरो), वाआट बे्रस्ट्टेड ककगदफिर (हलयकोनस समयरनेंजसस), सामान्य ककगदफिर (ऄलकेडो ऄजथथस), ग्र ेवैगटेल (मोटादकल्ला जसनेरा), तीतर टेल्ड जकाना (ह्य्द्र्द्ोफाजसऄनुअ जचरुरगुस), अदद के जलए अदिा और अकिाक वास स्ट्थान ह;ै और, प्रजतरूप झील सीअइटीइएस पररजिष्ट में सूचीबद्ध कछुओं की महत्त्वपूणा प्रजाजतयों ऄथाात् भारतीय फ्लपैिलै कछुअ (जलस्ट्सेमस् पुन्कटाटा) और भारतीय सॉफ्ट-िेल कछुअ (नीस्ट्सोजनया गगंेरटकस्) को भी अश्रय प्रदान करती हैं और झीलें संरजक्षत क्षेत्र के ऄंतगात अने वाले दजानों ग्रामों के जलए पीने और ससचाइ के जल का स्त्रोत भी है; और, सुरीनसार–मनसार वन्यजीव ऄभयारण्य में ईत्तरी िुष्क जमजश्रत पणापाती वन, जहमालयन ईप- ईष्णकरटबंधीय झाड़ी वन, जहमालयन ईप-ईष्णकरटबंधीय पाआन वन, जनचला जिवाजलक चीड़ पाआन वन, दोदोजनया झाड़ी वन अत ेह ैऔर वन्यजीव ऄभयारण्य में और असपास मखु्य वनस्ट्पजत ऄकैजिया कटेचु, ऄकैजिया जनलोरटका, ऄकैजिया मोडेस्ट्टा, दफकस रेकेमोसा, दफकस बेंगालेंजसस, दफकस रेजलजगओसा, बुटेया मोनोस्ट्पेमाा, लान्नेया कोरोमंडाजलका, ऄलजबजिया लेब्बेक, मल्लोटोस दफजलप्पेंजसस, डोडोनेया जवस्ट्कोसा, ऄधाटोडा वजसका, काररस्ट्सा जस्ट्पनारूम, कोलेबरोदकया ओप्पोजसरटफ्फोजलया, नेरीयम आंजडकम, डालबेरजगया जसस्ट्सू, पुजनका ग्रानातुम, मुरैना कोआजनजग, अपोमेया दफसतुला, सच्चारूम स्ट्पोनटाजनयम, कयम्बोपोगोन स्ट्पा, जपनुस रोक्बुरघी, जजजजफस जुजुबा, जसजेजगयम कुजमजन, आम्बजलका ओजफ्फदकनाजलस, वुडफोर्वडया फरूरटकोसा, रूमेक्स हस्ट्टातुस , अदद पाइ जाती हैं; और, सुरीनसार–मनसार वन्यजीव ऄभयारण्य के चारों ओर के क्षेत्र को, जजसका जवस्ट्तार और सीमाएं आस ऄजधसूचना के पैरा 1 में जवजनर्ददष्ट हैं, पाररजस्ट्थजतकी, पयाावरणीय और जैव-जवजवधता की दजृष्ट से पाररजस्ट्थजतकी संवेदी जोन के रूप में [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 सुरजक्षत और संरजक्षत करना तथा ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों के समूहों का तथा ईनके प्रचालन एवं प्रसंस्ट्करण को जनजिद्ध करना अवश्यक ह;ै ऄतः, ऄब, केन्र्द्ीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ परठत पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आसमें आसके पिात् पयाावरण ऄजधजनयम कहा गया ह)ै की ईपधारा

(1) तथा धारा 3 की ईपधारा (2) खंड (v) और खंड (xiv) एवं ईपधारा (3) के द्वारा प्रदत्त िजियों का प्रयोग करते हुए, कें र्द् िाजसत प्रदेि जम्म ूकश्मीर के जम्मू जजला के सुरीनसार–मनसार वन्यजीव ऄभयारण्य की सीमा के चारों ओर (0) िून्य से 3.459 दकलोमीटर तक 72.42 वगा दकलोमीटर जवस्ट्ताररत क्षेत्र सुरीनसार–मनसार वन्यजीव ऄभयारण्य के पाररजस्ट्थजतकी संवेदी जोन (जजसे आसमें आसके पश् चात् पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप में ऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार ह,ै ऄथाात:्-

1. पाररजस्ट्थजतकी संवदेी जोन का जवस्ट्तार और सीमा.-(1) सुरीनसार–मनसार वन्यजीव ऄभयारण्य की सीमा के चारों ओर िून्य से 3.459 दकलोमीटर तक के जवस्ट्तार के साथ पाररजस्ट्थजतकी संवेदी जोन 72.42 वगा दकलोमीटर होगा और सुरीनसार–मनसार वन्यजीव ऄभयारण्य के पजिमी भाग पर नंदानी वन्यजीव ऄभयारण्य के साथ जनकटवती सीमा के कारण पाररजस्ट्थजतकी संवेदी जोन का िून्य जवस्ट्तार ह।ै

(2) सुरीनसार–मनसार वन्यजीव ऄभयारण्य और आसके पाररजस्ट्थजतकी संवेदी जोन की सीमा का जववरण ईपाबधं-I के रूप में ईपाबद्ध ह।ै

(3) सीमा जववरण और ऄक्षािंों और देिांतरों के साथ पाररजस्ट्थजतकी संवेदी जोन को सीमांदकत करत े हुए वन्यजीव ऄभयारण्य के मानजचत्र ईपाबधं -IIक, ईपाबधं -IIख और ईपाबधं -IIग के रूप में ईपाबद्ध ह।ै

(4) सुरीनसार–मनसार वन्यजीव ऄभयारण्य और पाररजस्ट्थजतकी संवेदी जोन की सीमा के भू-जनदेिांकों की सूची ईपाबधं - III की सारणी क और सारणी ख में दी गइ ह।ै

(5) मुख्य सबदओुं पर भू-जनदेिांकों के साथ पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अन ेवाल ेग्रामों की सूची ईपाबधं-IV के रूप में ईपाबद्ध ह।ै

2. पाररजस्ट्थजतकी सवंदेी जोन के जलए अचंजलक महायोजना– (1) संघ राज्यक्षेत्र सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोजनों के जलए राजपत्र में आस ऄजधसूचना के प्रकािन की तारीख से दो विा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और संघ राज्यक्षेत्र के सक्षम प्राजधकारी के ऄनुमोदन के जलए आस ऄजधसूचना में ददए गए ऄनुबंधों का पालन करत े हुए अंचजलक महायोजना तैयार करेगी और संघ राज्यक्षेत्र में सक्षम प्राजधकारी द्वारा जवजधवत ऄनुमोददत दकया जाएगा।

(2) संघ राज्यक्षेत्र सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना में जवजनर्ददष् ट दकए गए हैं, के ऄनुसार तथा सुसंगत कें र्द्ीय और संघ राज्यक्षेत्र जवजधयों के ऄनुरुप और कें र्द्ीय सरकार द्वारा जारी मागाजनदेिों, यदद कोइ हों, द्वारा तैयार होगी ।

(3) अंचजलक महायोजना, ईि योजना में पाररजस्ट्थजतकी और पयाावरणीय बातों को समाकजलत करन ेके जलए संघ राज्य क्षत्र सरकार के जनम्नजलजखत जवभागों के परामिा से तैयार होगी.-

(i) पयाावरण, पाररजस्ट्थजतकी और ररमोट सेंससग;

(ii) वन;

(iii) कृजि;

(iv) राजस्ट्व;

(v) िहरी और नगर पाजलका;

(vi) पयाटन जवभाग के ऄंतगात सुरीनसार–मनसार जवकास प्राजधकरण;

(vii) ससचाइ और बाढ़ जनयंत्रण;

(viii) ऄजधसूजचत नगर क्षेत्र सजमजत;

(ix) ग्रामीण जवकास एवं पंचायती राज; और 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(x) लोक जनमााण जवभाग।

(4) अंचजलक महायोजना ऄनमुोददत जवद्यमान भू-ईपयोग, ऄवसंरचना और दक्रयाकलापों पर कोइ जनबंधन ऄजधरोजपत नहीं करेगी जब तक दक आस ऄजधसूचना में आस प्रकार जवजनर्ददष् ट न हो और अचंजलक महायोजना सभी ऄवसंरचना और दक्रयाकलापों में, जो ऄजधक दक्षता और पाररजस्ट्थजतकी ऄनुकूल हों, का संवधान करेगी ।

(5) अंचजलक महायोजना में ऄनाच्छाददत क्षेत्रों के जीणोद्धार, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदा और नमी संरक्षण, स्ट्थानीय समुदायों की अवश्यकताओं तथा पाररजस्ट्थजतकी और पयाावरण से संबंजधत ऐसे ऄन्य पहलओुं, जजन पर ध्यान दनेा अवश्यक ह,ै के जलए ईपबंध होंग े।

(6) अंचजलक महायोजना जवद्यमान और प्रस्ट्ताजवत भूजम ईपयोग जविेिताओं के ब्यौरों से ऄनुसमर्वथत मानजचत्र के साथ सभी जवद्यमान पूजा स्ट् थलों, ग्रामों और नगरीय बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजि क्षते्रों, उपजाउ भूजम, हररत क्षेत्र जैसे ईद्यान और ईसी प्रकार के स्ट् थान, ईद्यान कृजि क्षेत्र, फलोईद्यान, झीलों और ऄन्य जल जनकायों का ऄभयांकन करेगी।

(7) अंचजलक महायोजना में पाररजस्ट्थजतकी संवेदी जोन में जवकासात्मक दक्रयाकलापों को जवजनयजमत करन ेके जलए प्रदक्रया प्रदान की जाएगी और सारणी में यथासूचीबद्ध पैरा 4 में प्रजतजिद्ध और जवजनयजमत दक्रयाकलापों का पालन दकया जाएगा। आसमें स्ट् थानीय समुदायों की अजीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-ऄनुकूल जवकास का भी सुजनिय और संवधान दकया जाएगा।

(8) अंचजलक महायोजना प्रादेजिक जवकास योजना की सह जवस्ट्तारी होगी।

(9) ऄनुमोददत अंचजलक महायोजना मानीटरी सजमजत के जलए एक संदभा दस्ट्तावेज होगी तादक वह आस ऄजधसूचना के ईपबंधों के ऄनुसार मानीटरी के ऄपने कताव्यों का जनवाहन कर सके।

3. सघं राज्यक्षते्र सरकार द्वारा दकए जान ेवाल ेईपाय.- संघ राज्यक्षेत्र सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करन े के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात:्-

(1) भू-ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन में वनों, ईद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के प्रयोजनों के जलए जचजन्हत दकए गए पाकों और खुले स्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक संबद्ध जवकास दक्रयाकलापों के जलए ईपयोग या संपररवतान नहीं होगा: परंत ुपाररजस्ट्थजतकी संवेदी जोन के भीतर आसमें जवजनर्ददष्ट प्रयोजनों से जभन्न प्रयोजनों के जलए कृजि और ऄन्य भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और यथा लागू और क्षेत्रीय नगर योजना ऄजधजनयम और केन्र्द्ीय सरकार या संघ राज्यक्षेत्र सरकार के ऄन्य जनयमों तथा जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन से, और आस ऄजधसूचना के ईपबंधों द्वारा स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को पूरा करन ेके जलए ऄनजु्ञात दकया जाएगा, जैसे-

(i) जवद्यमान सड़कों को चौड़ा करना और ईन्हें सुदढृ़ करना तथा नइ सड़कों का संजनमााण;

(ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;

(iii) प्रदिूण ईत्पन्न न करन ेवाले लघ ुईद्योग;

(iv) कुटीर ईद्योगों जजनके ऄंतगात ग्रामीण ईद्योग भी हैं; सुजवधाजनक भण्डार और स्ट्थानीय सुजवधाएं सहायक पाररजस्ट्थजतकी पयाटन जजसके ऄन्तगात गृह वास सजम्मजलत ह;ै और

(v) पैरा 4 के ऄधीन ददए गए संवर्वधत दक्रयाकलाप: परंतु यह भी दक क्षेत्रीय िहरी जनयोजन ऄजधजनयम तथा संघ राज्यक्षेत्र सरकार के ऄन्य जनयमों और जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन के जबना और संजवधान के ऄनुच्छेद 244 के ईपबंधों तथा तत्समय प्रवृत्त जवजध, जजसके ऄंतगात ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता) ऄजधजनयम, 2006 (2007 का 2) भी अता ह,ै का ऄनुपालन दकए जबना वाजणजज्यक या औद्योजगक जवकास दक्रयाकलापों के जलए जनजातीय भूजम का प्रयोग ऄनुमत नहीं होगा: परंत ु यह और भी दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भू-ऄजभलेखों में ईपसंजात कोइ गलती, मानीटरी सजमजत के जवचार प्राप्त करने के पिात ्संघ राज्यक्षेत्र सरकार द्वारा प्रत्येक मामले में एक बार ठीक होगी और ईि गलती के सुधार की सूचना कें र्द्ीय सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय को दी जाएगी: [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 परंत ुयह और भी दक गलती के सुधार में आस ईप पैरा के ऄधीन यथा ईपबंजधत के जसवाय दकसी भी दिा में भू-ईपयोग का पररवतान सजम्मजलत नहीं होगा। (ख) वनीकरण तथा वास जीणोद्धार दक्रयाकलापों सजहत ऄनप्रयुक् त या ऄनुत् पादक कृजि क्षते्रों में पुन: वनीकरण करने के प्रयास दकए जाएंगे।

(2) प्राकृजतक जल स्रोतों.- अचंजलक महायोजना में सभी प्राकृजतक झरनों के अवाह क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण और नवीकरण के जलए योजना सजम् मजलत होगी और संघ राज्य क्षेत्र सरकार द्वारा ऐसे क्षेत्रों पर या ईनके जनकट जवकास दक्रयाकलाप प्रजतजिद्ध करने के बारे में जो ऐसे क्षेत्रों के जलए ऄजहतकर हो ऐसी रीजत से मागादिाक जसद्धांत तैयार दकए जाएंगे।

(3) पयाटन या पाररजस्ट्थजतकी पयाटन.- (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन दक्रयाकलाप या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन के जलए होगा। (ख) पाररजस्ट्थजतकी पयाटन महायोजना संघ राज्यक्षेत्र पयाटन जवभाग द्वारा संघ राज्यक्षेत्र पयाावरण और वन जवभाग के परामिा से तैयार होगी। (ग) पयाटन महायोजना अंचजलक महायोजना के एक घटक के रूप में होगी। (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जाएगी। (ङ) पाररजस्ट्थजतकी पयाटन संबंधी दक्रयाकलाप जनम्नानुसार जवजनयजमत होंगे, ऄथाात:्-

(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै नय ेवाजणजज्यक होटल और ररजॉटा के सजन्नमााण ऄनजु्ञात नहीं होंगे: परंत,ु यह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की दरूी से परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक होटलों और ररजॉटा का स्ट्थापना केवल पूवा पररभाजित और नामजनर्ददष्ट क्षेत्रों में पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए ही ऄनजु्ञात होगा;

(ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर नए पयाटन दक्रयाकलापों या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार कें र्द्ीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय के मागादिाक जसद्धांतों के द्वारा तथा राष् रीय ा याघ्र स संरक्षण प्राजधकरण, द्वारा जारी पाररजस्ट्थजतकी–पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल दतेे हुए (समय- समय पर यथा संिोजधत) जारी मागादिाक जसद्धांतों के ऄनुसार होगा;

(iii) अंचजलक महायोजना का ऄनुमोदन दकए जान ेतक, पयाटन के जलए जवकास और जवद्यमान पयाटन दक्रयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्ददष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि पर अधाररत संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नये होटल या ररसोटा या वाजणजज्यक स्ट्थापना का संजनमााण ऄनुज्ञात नहीं दकया जायेगा ।

(4) नसैर्वगक जवरासत.- पाररजस्ट्थजतकी संवेदी जोन में महत्वपणूा नैसर्वगक जवरासत के सभी स्ट्थलों जैसे जीन कोि अरजक्षत के्षत्र, िैल जवरचनाएं, जल प्रपातों, झरनों, घाटी मागों, ईपवनों, गुफाए,ं स्ट्थलों, भ्रमण, ऄश्वरोहण, प्रपातों अदद की पहचान की जाएगी और जवरासत संरक्षण योजना अंचजलक महायोजना के भाग के रुप में परररक्षण और संरक्षण के जलए तैयार की जाएगी ।

(5) मानव जनर्वमत जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, जिल्प-तथय, ऐजतहाजसक, स्ट्थापत्य, सौंदयापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और ईपक्षेत्रों पहचान और ईनके संरक्षण के जलए जवरासत योजना अंचजलक महायोजना के भाग के रुप में तयैार की जाएगी।

(6) ध् वजन प्रदिूण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदिूण (जवजनयमन और जनयतं्रण) जनयम, 2000 में जनयत ईपबंधों के ऄनुसार में पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदिूण के जनयंत्रण और जनवारण का ऄनुपालन दकया जाएगा।

(7) वाय ुप्रदिूण.- पाररजस्ट्थजतकी संवेदी जोन में, वायु प्रदिूण के जनवारण और जनयंत्रण का वायु (प्रदिूण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया जाएगा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेदी जोन में ईपचाररत बजहस्राव का जनस्ट्सरण, साधारण मानकों के ईपबंधों के ऄनुसार पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अने वाले पयाावरणीय प्रदिूण के जनस्ट्सरण के जलए साधारण मानकों या संघ राज्य क्षेत्र सरकार द्वारा जनयत मानकों, जो भी ऄजधक कठोर हो, के ईपबंधों के ऄनुसार होगा।

(9) ठोस ऄपजिष्ट.- ठोस ऄपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन में ठोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357(ऄ), तारीख 8 ऄप्रैल, 2016 के द्वारा प्रकाजित ठोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप ठोस ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा।

(10) जैव जचदकत्सा ऄपजिष् ट.- जैव जचदकत्सा ऄपजिष् ट का प्रबंधन जनम्नानुसार दकया जाएगा.- (क) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन 343 (ऄ), तारीख 28 माचा, 2016 के द्वारा प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप जैव-जचदकत्सा ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा।

(11) प्लाजस्ट्टक ऄपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सा.का.जन 340(ऄ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।

(12) जनमााण और जवध्वसं ऄपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सां.का.जन 317(ऄ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।

(13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत द्वारा प्रकाजित इ–ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।

(14) यानीय यातायात.- यातायात की यानीय गजतजवजधयां अवास के ऄनुकूल जवजनयजमत होंगी और आस संबंध में अंचजलक महायोजना में जविेि ईपबंध सजम्मजलत दकए जाएंगे और अंचजलक महायोजना के तैयार होने और संघ राज्यक्षेत्र सरकार के सक्षम प्राजधकारी द्वारा ऄनुमोददत होने तक, मानीटरी सजमजत सुसंगत ऄजधजनयमों और ईसके ऄधीन बनाए गए जनयमों और जवजनयमों के ऄनुसार यानीय दक्रयाकलापों के ऄनपुालन की मानीटरी करेगी।

(15) यानीय प्रदिूण.- लागू जवजधयों के ऄनुपालन में यान प्रदिूण का जनवारण और जनयंत्रण दकया जाएगा और स्ट्वच्छक ईंधनों के ईपयोग के जलए प्रयास दकए जाएंगे।

(16) औद्योजगक इकाआया.ं- (क) राजपत्र में आस ऄजधसूचना के प्रकािन पर या ईसके पिात पाररजस्ट्थजतकी संवेदी जोन के भीतर कोइ नए प्रदजूित ईद्योगों की स्ट्थापना की ऄनुज्ञा नहीं दी जाएगी। (ख) केन्र्द्ीय प्रदिूण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में आस प्रकार जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन के भीतर केवल गैर-प्रदिूणकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि, गरै प्रदिूणकारी ईद्योगों को बढ़ावा ददया जाएगा।

(17) पहाड़ी ढलानों को सरंक्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) अंचजलक महायोजना पहाड़ी ढलानों पर क्षेत्रों का संकेत होगा जहां दकसी भी संजनमााण की ऄनुज्ञा नहीं दी जाएगी; [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 (ख) कटाव के एक ईच्च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनुज्ञा नहीं दी जाएगी ।

4. पाररजस्ट्थजतकी सवंदेी जोन में प्रजतजिद्ध और जवजनयजमत दकए जान ेवाल ेदक्रयाकलापों की सचूी.- पाररजस्ट्थजतकी संवेदी जोन में सभी दक्रयाकलाप पयाावरण ऄजधजनयम के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों जजसके ऄन्तगात तटीय जवजनयमन जोन, 2011 और पयाावरणीय समाघात जनधाारण ऄजधसूचना, 2006 और ऄन्य लागू जवजधयों के जजसमें वन (संरक्षण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53) सजम्मजलत हैं और दकये गये संिोधनों द्वारा िाजसत होंगे और नीचे दी गइ सारणी में जवजनर्ददष्ट रीजत में जवजनयजमत होंगे, ऄथाात ्:- सारणी क्रम स.ं दक्रयाकलाप वणान क. प्रजतजिद्ध दक्रयाकलाप

1. वाजणजज्यक खनन, पत्थर ईत्खनन और ऄपघिाण आकाआयां। (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर वास्ट्तजवक स्ट्थानीय जनवाजसयों की घरेलू अवश्यकताओं जजसमें मकानों के संजनमााण या मरम्मत के जलए धरती को खोदना सजम्मजलत है, के जसवाय सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनज), पत्थर ईत्खनन और ऄपघिाण आकाआयां तत्काल प्रभाव से प्रजतजिद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट याजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाद बनाम भारत संघ के मामले में माननीय ईच्चतम न्यायालय के अदिे 4 ऄगस्ट्त, 2006 और 2012 की ररट याजचका (जसजवल) सं. 435 में गोवा फाईंडेिन बनाम भारत संघ के मामले में तारीख 21 ऄप्रैल, 2014 के अदिे के ऄनुसरण में होगा ।

2. प्रदिूण (जल, वायु, मृदा, ध्वजन, अदद) ईत्पन करने वाले ईद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेदी जोन में कोइ नया ईद्योग लगाने और वतामान प्रदिूणकारी ईद्योगों का जवस्ट्तार करने की ऄनुज्ञा नहीं होगी: परंतु यह दक, केन्र्द्ीय प्रदिूण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में ऐसा जवजनर्ददष्ट न हों, पाररजस्ट्थजतकी संवेदी जोन के भीतर गैर-प्रदिूणकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि गैर-प्रदिूणकारी कुटीर ईद्यागों को बढ़ावा ददया जाएगा।

3. बृहत जल जवद्युत पररयोजना की स्ट्थापना । प्रजतजिद्ध।

4. दकसी पररसंकटमय पदाथा का ईपयोग या ईत्पादन या प्रसंस्ट्करण। प्रजतजिद्ध।

5. प्राकृजतक जल जनकायों या क्षेत्र भूजम में ऄनुपचाररत बजहस्रााव का जनस्ट्सारण । प्रजतजिद्ध।

6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन के भीतर नइ अरा जमलों की स्ट्थापना और जवद्यमान अरा जमलों का जवस्ट् तार ऄनुज्ञात नहीं होगा।

7. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध।

8. जलावन लकड़ी का वाजणजज्यक ईपयोग । प्रजतजिद्ध। अ. जवजनयजमत दक्रयाकलाप

9. वाजणजज्यक होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पयाटन दक्रयाकलापों लघु ऄस्ट्थायी संरचनाओं के जसवाय संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट है, नए वाजणजज्यक 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] होटल और ररसोटों को ऄनुज्ञात नहीं दकया जाएगा: परंतु यह दक, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के परे या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक आनमें से, जो भी जनकट हो सभी नए पयाटन दक्रयाकलाप या जवद्यमान दक्रयाकलाप का जवस्ट्तार पयाटन महायोजना और यथा लागू मागादिी जसद्धांतों के ऄनुरुप होगा।

10. संजनमााण दक्रयाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट हो, दकसी भी प्रकार के नये वाजणजज्यक संजनमााण की ऄनुज्ञा नहीं होगी: परंतु यह दक, स्ट्थानीय लोगों को ऄपनी अवास सम्बन्धी जनम्नजलजखत अवश्यकताओं को परूा करने के जलए, पैरा 3 के ईप पैरा

(1) में सूचीबद्ध दक्रयाकलापों सजहत ऄपने ईपयोग के जलए, ऄपनी भूजम में भवन ईप-जवजधयों के ऄनुसार, संजनमााण करने की ऄनजु्ञा होगी: परंतु यह दक, गैर–प्रदिूणकारी लघु ईद्योगों से संबंजधत संजनमााण दक्रयाकलाप लागू जनयमों और जवजनयमों, यदद कोइ हों, के ऄनुसार सक्षम प्राजधकारी की पूवा ऄनुमजत से जवजनयजमत दकए जाएंगे और वे न्यूनतम होंगे । (ख) एक दकलोमीटर क्षेत्र से परे ये अंचजलक महायोजना के ऄनुसार जवजनयजमत होंगे ।

11. प्रदिूण ईत्पन्न न करने वाले लघु ईद्योग। फरवरी, 2016 में केन्र्द्ीय प्रदिूण जनयंत्रण बोडा द्वारा जारी ईद्योगों में वगीकरण के ऄनुसार समय-समय पर यथा संिोजधत गैर-प्रदिूणकारी ईद्योग और ऄपररसंकटमय में, लघु और सेवा ईद्योग, कृजि, पुष्प कृजि, ईद्यान कृजि या पाररजस्ट्थजतकी संवेदी जोन से दिेी सामग्री से ईत्पादों को ईत्पन्न करने वाले कृजि अधाररत ईद्योग सक्षम प्राजधकारी द्वारा ऄनुज्ञात होंगे।

12. वृक्षों की कटाइ। (क) संघ राज्य क्षेत्र सरकार में सक्षम प्राजधकारी की पूवा ऄनुज्ञा के जबना वन, सरकारी या राजस्ट्व या जनजी भूजम पर या वनों में वृक्षों की कटाइ नहीं होगी । (ख) वृक्षों की कटाइ संबंजधत कें र्द्ीय या संघ राज्यक्षेत्र ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंध के ऄनुसार जवजनयजमत होगे।

13. वन ईत्पादों या गैर काष् ठ वन ईत्पादों का संग्रहण । लागू जवजधयों के ऄनुसार जवजनयजमत होंगे ।

14. जवद्युत और संचार टावरों का पररजनमााण और केबलों के जबछाए जाने और ऄन्य बुजनयादी ढांचे । लागू जवजधयों के ऄधीन जवजनयजमत भूजमगत केबल जबछाने को बढ़ावा ददया जाएगा।

15. नागररक सुख सुजवधाओं सजहत ऄवसंरचनाएं । न्यूनीकरण ईपायों को लागू जवजधयों, जनयमों और जवजनयमनों और ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाएगा।

16. जवद्यमान सड़कों को चौड़ा करना और ईन्हें सुदढृ़ करना तथा नवीन सड़कों का संजनमााण । न्यूनीकरण ईपायों को लागू जवजधयों, जनयमों और जवजनयमनों तथा ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाएगा।

17. पयाटन से संबंजधत ऄन्य दक्रयाकलाप जैसे गमा वायु गुब्बारें, हलेीकॉप्टर, ड्रोन, माआक्रोलाआटस, अदद द्वारा पाररजस्ट्थजतकी संवेदी जोन क्षेत्र के उपर से ईड़ना जैसे लागू जवजधयों के ऄनुसार जवजनयजमत होंगे । [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 9 दक्रयाकलाप करना।

18. पहाड़ी ढालों और नदी तटों का संरक्षण । लागू जवजधयों के ऄनुसार जवजनयजमत होंगे ।

19. राजत्र में याजनक यातायात का संचलन । लागू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए जवजनयजमत होंगे ।

20. स्ट्थानीय समुदायों द्वारा चल रही कृजि और बागवानी प्रथाओं के साथ दगु्धिाला, दगु्घ ईद्योग, कृजि और मछली पालन । स्ट्थानीय लोगों के ईपयोग के जलए लागू जवजधयों के ऄधीन ऄनुज्ञात होंगे।

21. प्राकृजतक जल जनकायों या सतही क्षेत्र में ईपचाररत बजहस्रााव का जनस्ट्तारण । जल जनकायों में ईपचाररत ऄपजिष्ट जल या बजहस्रााव के जनस्ट्सारण स े बचा जाएगा और ईपचाररत ऄपजिष्ट जल के पुन:चक्रण और पुन:ईपयोग के जलए प्रयास दकए जाएंगे। ऄन्यथा लागू जवजधयों के ऄनुसार ईपचाररत बजहस्रााव के पुनचाक्रण या प्रवाह के जनवाहन को जवजनयजमत दकया जाएगा।

22. सतही और भूजल का वाजणजज्यक जनष्किाण । लागू जवजधयों के ऄनुसार जवजनयजमत होंगे ।

23. फमों, जनगम और कंपजनयों द्वारा बडे़ पैमाने पर वाजणजज्यक पिुओं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीय अवश्यकताओं को पूरा करने के ऄलावा लागू जवजधयों के ऄधीन जवजनयजमत होंगे ।

24. खुले कंुअ, बोर कंुअ, अदद कृजि और ऄन्य ईपयोग के जलए । सम्बद्ध प्राजधकारी द्वारा दक्रयाकलापों की सख्ती से मानीटरी की जायेगी।

25. ठोस ऄपजिष्ट का प्रबन्धन। लागू जवजधयों के ऄनुसार जवजनयजमत होंगे ।

26. पाररजस्ट्थजतकी पयाटन। लागू जवजधयों के ऄनुसार जवजनयजमत होंगे ।

27. वाजणजज् यक सूचनापट्ट और होडिडग। लागू जवजधयों के ऄनुसार जवजनयजमत होंगे ।

28. पोजलथीन बैगों का प्रयोग । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

29. जवदिेी प्रजाजतयों को लाना । लागू जवजधयों के ऄनुसार जवजनयजमत होंगे । आ. सवंर्वधत दक्रयाकलाप

30. विाा जल संचयन। सदक्र य रूप से बढ़ावा ददया जाएगा।

31. जैजवक खेती। सदक्र य रूप से बढ़ावा ददया जाएगा।

32. सभी गजतजवजधयों के जलए हररत प्रौद्योजगकी को ऄंगीकृत करना । सदक्र य रूप से बढ़ावा ददया जाएगा।

33. कुटीर ईद्योगों जजसके ऄंतगात ग्रामीण कारीगर भी हैं। सदक्र य रूप से बढ़ावा ददया जाएगा।

34. नवीकरणीय उजाा और ईंधन का ईपयोग । बायोगैस, सौर प्रकाि, आत् यादद को बढ़ावा ददया जाएगा।

35. कृजि वाजनकी । सदक्र य रूप से बढ़ावा ददया जाएगा।

36. बागान लगाना और जड़ी बूरटयों का रोपण । सदक्र य रूप से बढ़ावा ददया जाएगा।

37. पाररजस्ट्थजतकी ऄनुकूल पररवहन का ईपयोग । सदक्र य रूप से बढ़ावा ददया जाएगा।

38. कौिल जवकास । सदक्र य रूप से बढ़ावा ददया जाएगा।

39. जनम्नीकृत भूजम/वन/वास की बहाली । सदक्र य रूप से बढ़ावा ददया जाएगा।

5. पाररजस्ट्थजतकी सवंदेी जोन ऄजधसचूना की मानीटरी के जलए मानीटरी सजमजत.- कें र्द्ीय सरकार, पयाावरण ऄजधजनयम की धारा 3 की ईपधारा (3) के ऄधीन आस ऄजधसूचना के ईपबंधों की प्रभावी मानीटरी के जलए, मानीटरी सजमजत का गठन करती ह,ै जो जनम्नजलजखत से जमलकर बनेगी, ऄथाात:्- क्र.स.ं जनगरानी सजमजत का गठन पद

1. संभागीय अयुि, जम्मू ऄध् यक्ष;

2. जजला कलेक्टर / ईपायुि, ईधमपुर / जम्मू / सांबा सदस्ट्य;

3. क्षेत्रीय वन्यजीव वाडान, जम्मू क्षेत्र, जम्मू सदस्ट्य;

4. वन, पाररजस्ट्थजतकी और ररमोट सेंससग जवभाग, जम्मू और कश्मीर सरकार या पाररजस्ट्थजतकी के एक प्रजतजनजध या पयाावरण के क्षेत्र में एक जविेिज्ञ को संघ राज्यक्षेत्र की सरकार द्वारा नाजमत दकया जाना है सदस्ट्य;

5. गैर-सरकारी संगठन (पाररजस्ट्थजतकी, पयाावरण संरक्षण सजहत जवरासत संरक्षण के क्षेत्र में काम करने वाले) के एक प्रजतजनजध को संघ राज्यक्षेत्र सरकार द्वारा नाजमत दकया जाना है सदस्ट्य;

6. सदस्ट्य, जम्मू और कश्मीर जैव जवजवधता पररिद सदस्ट्य;

7. अवास और िहरी जनयोजन जवभाग / ग्रामीण जवकास जवभाग के प्रजतजनजध सदस्ट्य;

8. कृजि ईत्पादन जवभाग के प्रजतजनजध सदस्ट्य;

9. वन्यजीव वाडान, कठुअ क्षेत्र सदस्ट्य- सजचव

6. जनदेि-जनबधंन.- (1) मानीटरी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन की मानीटरी करेगी।

(2) मानीटरी सजमजत का कायाकाल ऄगले अदेि होने तक दकया जाएगा, परंत ुयह दक सजमजत के गैर-सरकारी सदस्ट्यों को समय-समय पर संघ राज्यक्षेत्र सरकार द्वारा नामजनर्ददष्ट दकया जाएगा।

(3) ईन दक्रयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ. 1533 (ऄ), तारीख 14 जसतम्बर, 2006 की ऄनुसूची में सजम्मजलत हैं, और जो पाररजस्ट्थजतकी संवेदी जोन में अत े हैं, जसवाय आसके जो पैरा 4 के ऄधीन सारणी में यथा जवजनर्ददष्ट प्रजतजिद्ध दक्रयाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईि ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरण ऄनापजत्त के जलए कें र्द्ीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को जनर्ददष्ट दकया जाएगा।

(4) ईन दक्रयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ. 1533 (ऄ) तारीख 14 जसतंबर, 2006 की ऄनुसूची में सजम्मजलत नहीं ह,ै और जो पाररजस्ट्थजतकी संवेदी जोन में अते हैं, जसवाय आसके पैरा 4 के ऄधीन सारणी में यथाजवर्वनष्ट प्रजतजिद्ध दक्रलाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईसे संबंद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया जाएगा।

(5) मानीटरी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायुि ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का ईल्लघंन करता ह,ै पयाावरण ऄजधजनयम की धारा 19 के ऄधीन पररवाद फाआल करन ेके जलए सक्षम होगा।

(6) मानीटरी सजमजत मुद्दा दर मदु्दा के अधार पर ऄपेक्षाओं पर जनभार रहत े हुए संबद्ध जवभागों के प्रजतजनजधयों या जविेिज्ञों, औद्योजगक संगमों या संबद्ध पणधाररयों के प्रजतजनजधयों को ऄपने जवचार-जवमिा में सहायता के जलए अमंजत्रत कर सकेगी ।

(7) मानीटरी सजमजत प्रत्येक विा की 31 माचा तक के ऄपन े दक्रयाकलापों की वार्विक कारावाइ ररपोटा संघ राज्य क्षेत्र के मुख् य वन् यजीव वाडान को ईपाबधं-V में ईपाबद्ध प्रोफामाा में ईक् त विा के 30 जून तक प्रस्ट्तुत करेगी ।

(8) केन्र्द्ीय सरकार का पयाावरण, वन और जलवायु पररवतान मंत्रालय मानीटरी सजमजत को ऄपने कृत्यों के प्रभावी जनवाहन के जलए ऐसे जनदेि दे सकेगा, जो वह ठीक समझे । [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 11

7. ऄजतररक् त ईपाय.- आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए कें र्द्ीय सरकार और संघ राज्य क्षेत्र सरकार, ऄजतररक् त ईपाय, यदद कोइ हों, जवजनर्ददष् ट कर सकें गी।

8. ईच्चतम न्यायालय, के अदेि अदद.- आस ऄजधसूचना के ईपबंध भारत के माननीय ईच्चतम न्यायालय या ईच्च न्यायालय या राष् रीय हररत ऄजधकरण द्वारा पाररत दकए गए या पाररत दकए जाने वाल ेअदिे, यदद कोइ हो, के ऄध्यधीन तवी नदी के साथ मुड़ती ह।ै पाररजस्ट्थजतकी संवेदी जोन नंदनी वन्यजीव ऄभयारण्य के साथ सुरीनसार–मनसार वन्यजीव ऄभयारण्य की सीमा के साथ िून्य रखा गया ह,ै पाररजस्ट्थजतकी संवेदी जोन दोअ ग्राम के ईत्तर के साथ 8. कोइ ऄन् य महत् वपूणा जविय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi,the 17 th January, 2022 S.O. 210(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 122 (E), dated the 12 th January, 2021, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 13 th January, 2021; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification; AND WHEREAS, the Surinsar-Mansar Wildlife Sanctuary with an area of 97.82 square kilometers, is located between river Tawi in the North, Udhampur-Samba road and Gombir Khad in the East, Bottal-Bilour road and Mansar Lake in the South-East, river Tawi and Surinsar Lake in the North- 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] West and the Sanctuary is spread over three districts of Jammu, Udhampur and Samba and the major part falls in the Jammu District in the Union Territory of Jammu and Kashmir; AND WHEREAS, the Surinsar-Mansar Wildlife Sanctuary was declared as Wildlife Sanctuary vide notification number SRO 138 dated 10 th April 1990 and the Wildlife Sanctuary also includes twin Surinsar and Mansar Lake which was added in the list of Ramsar Wetlands of international importance in the year 2005 and also included in the National Wetland Conservation Programme of Government of India; AND WHEREAS, the area represents a ―gene pool‖ for propagation, protection and perpetuation of various wild flora and fauna species and the recorded faunal species from Surinsar-Mansar Wildlife Sanctuary includes 15 species of mammals, 86 species of birds, 17 species of reptiles, 8 species of fishes (Kotwal. 2012); AND WHEREAS, the Surinsar-Mansar Wildlife Sanctuary and its adjacent forest area are given priority for protection purpose due to its rich wildlife and harbors viable population of the endangered faunal species like Indian long billed vulture (Gyps indicus), Indian white-backed vulture (Gyps bengalensis), steppe eagle (Aquila nipalensis), common leopard (Panthera pardus), Indian monitor lizard (Varanus bengalensis); AND WHEREAS, the major faunal species found in the Sanctuary are barking deer (Muntiacus muntejak), nilgai (Boselaphus tragocamelus), goral (Nemorhaedus goral), wild boar (Sus scorfa), jackal (Canis aureus), hare (Lepus nigricollis), jungle cat (Felis chaua), porcupine (Hystrix indica), mongoose (Herpestes edwardis), agama lizard (Agama agronensis), garden lizard (Calotes vesicolor), Indian cobra (Naja naja), common krait (Bungarus caerulus), Russel's viper (Vipera russeli russeli), rat snake (Ptyas mucosus), grass snake (Amphiesma stolata), cat snake (Boiga trigonata), Indian kukri snake (Oligidon ornensis), checkered keelback snake (Xenochrophis piscator), Indian bull frog (Haplobatracus tigrinis), Indian toad (Bufo melanosticus), marbled toad (Bufo stomaticus) etc; AND WHEREAS, the important avi-faunal species present in the area are pea fowl (Pavo cristatus), Red jungle fowl (Gallus gallus), black partridges (Francolinus francolinus), grey partridge (Francolinus pondicerianus), bush quil (Prediculata asiatica), red turtle dove (Streptopelia tranquebarica), blue rock pigeon (Columba livia), ring dove (Streptopelia cecacto), spotted owlet (Athena brama), blue jay (Coracias benghalensis), parakeets (Psittacula cyanoocephala), hoope (Upup aepops), Asian koel (Eudyanmys scolopacea), babblers (Turdoides caudatus); AND WHEREAS, the Surinsar-Mansar twin scared lakes attract a good number of waterfowl populations during the winter months and the lakes are an ideal and attractive habitat for migratory waterfowl such as common teal (Anas crecca), mallard (Anas platyrhynchos), common pochard (Anas ferina), tufted duck (Aythya fuligua), gadwall (Anas strpera), brahminy duck (Tadorna ferruginea, wigeon (Anas penelope), grey heron (Ardea cinera), pond heron (Ardea grayii), night heron (Nycticorax nycticorax), little egret (Egretta garzetta), cattle egret (Bubulcus ibis), Indian moorhen (Gallinula chloropas), purple moorhen (Perchurio orphyroo), white breasted kingfisher (Halycons smyrnensis), common kingfisher (Alcedo atthis), grey wagtail (Motacilla cinera), pheasent tailed jacana (Hydrophasianua chirurgus) etc. AND WHEREAS, the twin lake also supports important species of turtles namely, Indian flapshell turtle (Lissemys punctata) and Indian soft-shell turtle (Nilssonia gangeticus) listed in CITES Appendices and the lakes are also a source of drinking and irrigation water to dozens of villages falling down stream to the protected area. AND WHEREAS, the Surinsar-Mansar Wildlife Sanctuary consists of northern dry mixed deciduous forests, Himalayan sub-tropical scrub forests, Himalayan subtropical pine forest, lower Shiwalik chir pine forest, Dodonea scrub forests and the major vegetation found in and around wildlife sanctuary are Acacia catechu, Acacia nilotica, Acacia modesta, Ficus recemosa, Ficus bengalensis, Ficus religiosa, Butea monosperma, Lannea coromandalica, Albizzia lebbeck, Mallotous philippensis , Dodonea viscosa, Adhatoda vasica, Carissa spinarum, Colebrookia oppositiffolia, Nerium indicum, Dalbergia sissoo, Punica granatum, Murraya koenigii, Ipomea fistula, Saccharum spontanium, Cymbopogon spp, Pinus roxburghii., Zizyphus Jujuba, Syzygium cumini, Emblica officinalis, Woodfordia fruticosa, Rumex hastatus etc.; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 19 Surinsar-Mansar Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and

(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of 72.42 square kilometers to an extent varying from (0) Zero to 3.459 kilometers around the boundary of Surinsar-Mansar Wildlife Sanctuary, in the Union territory of Jammu and Kashmir as the Surinsar-Mansar Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be of 72.42 square kilometres with an extent zero to 3.459 kilometres around the boundary of Surinsar-Mansar Wildlife Sanctuary and the zero extent of the Eco-sensitive zone is due to contiguous border with Nandani Wildlife Sanctuary on the western side of the Surinsar-Mansar Wildlife Sanctuary.

(2) The boundary description of the Surinsar-Mansar Wildlife Sanctuary and its Eco-sensitive Zone as appended as Annexure-I.

(3) The maps of the Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC.

(4) Lists of geo co-ordinates of the boundary of Surinsar-Mansar Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure-III.

(5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.

2. Zonal Master Plan for Eco-sensitive Zone.- (1) The Union territory Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification and get it duly approved by the competent authority in the Union territory.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union territory Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union territory laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union territory Government, for integrating the ecological and environmental considerations into the said plan - i. Environment, Ecology and Remote Sensing; ii. Forest; iii. Agriculture; iv. Revenue; v. Urban and Municipality; vi. Surinsar-Mansar Development Authority under Tourism Department; vii. Irrigation and Flood Control; viii. Notified town area committee; ix. Rural Development and Panchayati Raj; and x. Public Works Department. 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Ecosensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities‘ livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by the Union Territory Government.- The Union territory Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at herein above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or Union territory Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given under paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Union Territory Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the Union territory Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 21

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Ecosensitive Zone.

(b) The Tourism Master Plan shall be prepared by the Union territory Department of Tourism in consultation with the Union territory Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Ecosensitive Zone.

(e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the ecotourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 made under the Environment Act.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.

(8) Discharge of effluents.- Discharge of treated effluents in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made there under or standards stipulated by the Union territory Government, whichever is more stringent.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under- 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed of in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under-

(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28 th March, 2016;

(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Ecosensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.

(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.

(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the Union territory Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.

(b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Ecosensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 23 Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. No. Activity Description A. Prohibited Activities

1. Commercial mining, stone quarrying and crushing units.

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco- sensitive Zone;

(b) The mining operations shall be carried out in accordance with the order of the Hon‘ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:

Provided that, non-polluting industries shall be allowed within Eco-Sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.

3. Establishment of major hydroelectric project. Prohibited

4. Use or production or processing of any hazardous substance. Prohibited

5. Discharge of untreated effluents in natural water bodies or land area. Prohibited

6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited

8. Commercial use of firewood Prohibited B. Regulated Activities

9. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of the Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of the Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Master Plan and guidelines as applicable.

10. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

11. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.

12. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the Union Territory Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or Union Territory Act and the rules made there under.

13. Collection of Forest Produce or Non-Timber Forest Produce. Regulated under applicable laws.

14. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws of underground cabling may be promoted.

15. Infrastructure including civic amenities. Taking measures of mitigation, as per applicable laws, rules and regulations and available guidelines.

16. Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation, as per applicable laws, rules and regulations and available guidelines.

17. Undertaking other activities related to tourism like over flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated as per the applicable laws. [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 25

18. Protection of Hill Slopes and river banks. Regulated as per the applicable laws.

19. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.

20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.

21. Discharge of treated waste water/effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per the applicable laws.

22. Commercial extraction of surface and ground water. Regulated under applicable laws.

23. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies. Regulated as per applicable laws except for meeting local needs.

24. Open Well, Bore Well, etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority.

25. Solid Waste Management. Regulated as per the applicable laws.

26. Eco-tourism. Regulated as per the applicable laws.

27. Commercial Sign boards and hoardings. Regulated as per the applicable laws.

28. Use of polythene bags. Regulated as per the applicable laws.

29. Introduction of exotic species Regulated as per the applicable laws. C. Promoted Activities

30. Rain water harvesting. Shall be actively promoted.

31. Organic farming. Shall be actively promoted.

32. Adoption of green technology for all activities. Shall be actively promoted.

33. Cottage industries including village artisans, etc. Shall be actively promoted.

34. Use of renewable energy and fuels. Bio-gas, solar light etc. shall be actively promoted.

35. Agro-Forestry. Shall be actively promoted.

36. Plantation of Horticulture and Herbals. Shall be actively promoted.

38. Skill Development. Shall be actively promoted.

39. Restoration of Degraded Land/ Forests/ Habitat. Shall be actively promoted.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment Act, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. 3. Regional Wildlife Warden, Jammu Region, Jammu Member;

4. One representative of department of Forests, Ecology and Remote Sensing, Government of Jammu and Kashmir or an expert in area of Ecology and Environment to be nominated by Union Territory Government. Member;

5. One representative of the Non-Governmental Organization (working in the field of Ecology, Environment including Heritage Conservation) to be nominated by the Union Territory Government Member;

6. Member, Jammu and Kashmir Biodiversity Council Member;

7. A representative of Housing and Urban Planning Department/Rural Development Department Member;

8. A representative of Agriculture Production Department Member;

9. Wildlife Warden, Kathua region Member- Secretary

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the Union territory Government from time to time.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 27

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the Union territory as per proforma appended at Annexure V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional measures. The Central Government and Union territory Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. Orders of Courts or Tribunal, etc.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon‘ble Supreme Court of India or High Court or the National Green Tribunal. GARKOTI, Scientist ‗G‘ ANNEXURE- I BOUNDARY DESCRIPTION OF ECO-SENSITIVE ZONE OF SURINSAR-MANSAR WILDLIFE SANCTUARY In the Eastern side the Eco-sensitive Zone passes through the villages Payem, Doon crosses the Dhar road and Kathel village villages and runs along the Gambhir Khad upto village Pardeh. In the South-Eastern side, the Eco-sensitive Zone enters the Co 6 Mansar Block Jindrah transverse it on Southern side of village Undahal enters into 5 Mansar Block Jindrah of Forest Division Jammu and then enters in Co. 43/Mahoregarh Range of Forest Division Samba and then Co. 42/Mahoregarh Range and crosses the Mansar Samba Road. In the Southern side, the Eco-sensitive Zone transverse through Co 39/Mahoregarh, Co 38/ Mahoregarh North of village Babnergarh, then 36/Mahoregarh South of Mansar Forest, 33/ Mahoregarh, 32/Mahoregarh, 30/Mahoregarh North of Village Kumn, 29/Mahoregarh, enters 23/Purmandal (Forest Division Samba) and 21/Purmandal and then along the boundary of 20/ Purmandal and 21/Purmandal and moves forward along the boundary of 20/Purmandal and 44/Bahu and 33/ Purmandal and 44/Bahu, boundary of 33/Purmandal and enters into 34/ Purmandal south of village Dager and joins with Samani Nallah north of village Panjowa. In the South-Western side, the Eco-sensitive Zone move along boundary of 34/ Purmandal and 35/ Purmandal, move along the Samani Nallah and move along the boundary of Co 42/Bahu and 35/ Purmandal, Co 46/Bahu and 35/ Purmandal, Co 46/Bahu and 41/ Purmandal, Co 47/Bahu and 41/ Purmandal, Co 48/Bahu and 41/Purmandal, along the boundary of 48/Bahu, 49/Bahu and 50/Bahu. In the Western side, the Eco-sensitive Zone moves along the boundary of the 51/Bahu, 52/Bahu North of village Athem, crosses the Surinsar-Sidhra road, enters into Co 53/Bahu, then 56/Bahu, moves along the boundary of between 58/Bahu and 59 Bahu, then touches the river Tawi. The Eco-sensitive Zone move along the Tawi along the boundary upto Co 15/Jindrah. The Eco-sensitive Zone has been kept zero along the boundary of Surinsar-Mansar Wildlife Sanctuary with the Nandani Wildlife Sanctuary. The Eco-sensitive Zone moves along the North of Village Doa, enters into Co 5 Tunnel Block Jindrah Range, then into 4 Tunnel Block Jindrah Range. In the North-Western side, the Eco-sensitive Zone enters into Co 4/T, then South of village Tara, then along the South of village Kah. In the Northern side, the Eco-sensitive Zone enters into the Rifle Range, upto North of Village Martin, then enters into the Nallah North of Village Nagola, move along the Nallah upto the North of village Upli Sari and Dhan. Then the Eco-sensitive Zone move forward North of the villages Pera, Buthana.
