PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पयाावरण, वन और जलवाय ुपररवतान मतं्रालय ऄजधसचूना नइ ददल्ली, 1 जून, 2021 का.अ. 2128(ऄ).—एक प्रारुप ऄजधसूचना भारत के राजपत्र, ऄसाधारण में भारत सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय की ऄजधसूचना संख्या का.अ. 3582 (ऄ), तारीख 13 ऄक्टूबर, 2020 द्वारा प्रकाजित की गइ थी जजसमें ईन सभी व्यजियों से, जजनको ईससे प्रभाजवत होने की संभावना थी, ईस तारीख से, जजसको ईि ऄजधसूचना से युि राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थी, साठ ददन की ऄवजध के भीतर, अक्षेप और सुझाव अमंजत्रत दकए गए थ;े और, ईि प्रारुप ऄजधसूचना से युि राजपत्र की प्रजतयां जनता को 13 ऄिूबर, 2020 को ईपलब्ध करा दी गइ थीं;
और, प्रारुप ऄजधसूचना के ईत्तर में व्यजियों और पणधाररयों से कोइ अके्षप और सुझाव प्राप्त नहीं हुए;
और, रामनगर वन्यजीव ऄभयारण्य जम्मू और कश्मीर के संघ राज्य के्षत्र जम्मू जजले में, जम्मू िहर तहसील के नागररक ऄजधकाररता के्षत्र के ऄंतगात अता ह ैऔर जम्मू वन संभाग के रामनगर खंड के कम्पाटामेंट 1 से 4 में िाजमल ह।ै रामनगर वन्यजीव ऄभयारण्य जम्मू िहर के ईत्तरी सीमांत पर जस्ट्थत वन के एक छोटा हररत पैच ह ैजजसे िहर के एकमात्र हररत फुफ्फुस के रूप में जाना जाता ह।ै ऄभयारण्य को सरकारी अदेि सं.136 तारीख 10 ऄप्रैल, 1990 को ऄजधसूजचत दकया गया था। यह वन्यजीव संरक्षण जवभाग, जम्मू और कश्मीर सरकार के प्रिासजनक जनयंत्रण के ऄधीन ह ैऔर आसका प्रबंधन जम्मू वन्यजीव प्रभाग के माध्यम से दकया जाता ह।ै ऄभयारण्य जम्मू वन प्रभाग के रामनगर श्रणेी के रामनगर खंड के कम्पाटामेंट 1,2,3, और 4 में िाजमल ह ैऔर 12.75 वगा दकलोमीटर (एस.अर.ओ के ऄनुसार 31.5 दकलोमीटर) के्षत्र में अच्छाददत ह।ै के्षत्र में सीमांदकत वन िाजमल ह ैऔर यह मोटे तौर पर कील/खंूटे के अकार का ह।ै यह के्षत्र बजस्ट्तयों से जघरा हुअ ह ैऔर भारी जैजवक दबाव का सामना करता ह।ै यह वन्यजीव संरजक्षत के्षत्र वनस्ट्पजत और जीवजंतु की जवजवधता के समृद्ध संग्रह का भंडार ह;ै स.ं 1974] नइ ददल्ली, मगंलवार, जनू 1, 2021/ज् यषे् ठ 11, 1943 No. 1974] NEW DELHI, TUESDAY, JUNE 1, 2021/JYAISHTHA 11, 1943 सी.जी.-डी.एल.-अ.-02062021-227332 CG-DL-E-02062021-227332 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, हाल ही में वनस्ट्पजत ऄध्ययन के ऄनुसार रामनगर वन्यजीव ऄभयारण्य में पौधों की 195 से ऄजधक प्रजाजतयों का अश्रय ह ैजजसमें जडी-बूटी, झाजडयां, बेलें और वृक्ष िाजमल हैं। फाआटो जवजवधता के तलुनात्मक ऄध्ययन से पता चलता ह ै दक वन का यह छोटा पैच जम्मू के असपास वन क्षेत्रों की तलुना में बहुत ऄजधक जवजवध और समृद्ध ह।ै वन्यजीव संरजक्षत के्षत्र के आस पचै के जीवजंतु प्रजाजत में से कुछ, जजसमें सामान्य भारतीय तेंदअु, जचत्तीदार जहरण, बनैला सूऄर, नीलगाय, साही, लाल जंगली पक्षी, मोर, पायथन, रसेल वाआपर, कोबरा ईल्ल ूिाजमल हैं, ऄजस्ट्तत्व और संरक्षण पाते हैं;
और, यह के्षत्र के साथ जमजश्रत झाडी वनों के साथ कभी-कभी चीड वृक्षों से अच्छाददत रहता ह।ै चैंजपयन और सेठ द्वारा संिोजधत वगीकरण के ऄनुसार ऄभयारण्य की वनस्ट्पजत प्रमुख समूह “ईप-ईष्णकरटबंधीय ईत्तरी जमजश्रत िुष्क पणापाती वनों’’ के ऄतंगात अती हैं। ऄभयारण्य में कइ प्रकार के ईप-ईष्णकरटबंधीय चौडे पत्तों वाल ेवृक्ष और झाजडयााँ पाइ जाती हैं, जजसमें प्रमुख ऄकादकया मोडस्ट्टा ह।ै ऄभयारण्य में मुख्य वनस्ट्पजत में फुल्लाइ (ऄकैजिया मोदेस्ट्टा), बबूल (ऄकैजिया जनलोटीका), खैर (ऄकैजिया कैटेचु), हलदीन (ऄदीना कार्डडफोजलया), बाएल (ऐगले मामलेोस), जसररस (ऄजल्बजजया लेबेक), खनवाल (बाईहीजनया पुरपुररया), जसल्क रे (बोम्बक्स केआबा), जििम (डालबेर्डगया जसस्ट्स)ू, तून (तनू दकजलऄटा), बेर (जजजजफस मॉरररटयना), अदद ईपलब्ध ह;ै और, रामनगर वन्यजीव ऄभयारण्य में स्ट्तनधाररयों में नीलगाय (बोसेलाफुस रागलोकामेलसु), जचत्तीदार जहरण (एजक्सस एजक्सस), मुंजक (मनुटीक्स मुनतजक), रहसुेस बंदर (मकाका मुलाट्टा), जसयार (कैजनस ऑररयस), खरगोि (लेपुस जनगररकोजल्लस), साही (हायस्ट्रीक आंजडका), बनैला सूऄर (सस स्ट्रोफा), नेवला (पेस्ट्टेस एड्वडासी), अदद पाए जाते हैं। जबदक संरजक्षत के्षत्र से पक्षी-जीव सफेद बैके्कड और बंगाल जगद्ध (जजप्स बेंगालेंजसस), जिकरा (ऄदक्कजपटेर बाजडईस), ब्ल ूरॉक फाख्ता (कोलुम्बा जलजवया), कोयल (आंडयनामयईस स्ट्कोलोपाकेया), ग्रीन बारबेट (मागलाआमा जेयलाजनका), हाईस जस्ट्वफ्ट (ऄपस ऄजफ्फनस), छोटा ग्रीन बी-इटर (मेरोपस ओररआंटेजलस), सामान्य वूड श्राआक (टेफरोडोररजनस पोंडीकेररऄनुस), वाआट चेक्ड बुलबुल (पयनोनोटस लेईकोगनेयस), रटके्कल फ्रोवेर पेके्कर (डीकेईम एरीथ्रोररन्छा), पाआड बुि चैट (सैजक्सकोला कैपरैटा), वाआट अइ (जोस्ट्टेरोपस पाल्परेबरोसा), अदद ऄजभजलजखत दकए गए हैं। संरजक्षत के्षत्र से सरीसृप जैसे रसेल्स पृथ्वी बोअ (एररक्स कोजनकस), जॉन्स पृथ्वी बोअ (आरयक्स जोहजन), भारतीय चीता (पायथन मोलुरस मोलुरस), जबल्ली सांप (बोआगा रररगोनाटा), सामान्य भारतीय रैट (बंुगारूस केआरूलईेस), रसेल वाआपर (जवपेरा रूस्ट्सेल्ली), अदद ह।ै जबदक जततजलयों की प्रजाजत जैसे पैजपजलयो जडमोलस जडमोलस, पैजपजलयो पोलयटेस रोमुलोईस, पानााजस्ट्सईस डेजल्फईस ऄलककसोनी, डानाईस जलजमऄके लओेपरडुस, पेआररस ब्राजस्ट्सकय, कटोजप्सजलया पयरांथे पयरांथ,े मायकालेजसस जमनेईस जमनेईस, वाजप्थस्ट्मा केयलोजनका हुआबनेदक, फलांटा फलांटा, आयथाजलया ऄकोंथेया, अदद ऄजभजलजखत की गइ ह;ै और, जम्मू िहर के जवस्ट्तार और प्राकृजतक संसाधनों पर बढ़त ेदबाव को ध्यान में रखते हुए, आस वन्यजीव संरजक्षत के्षत्र के असपास के िेष ऄवजिष्ट वन पैचों पर बडा खतरा मडंरा रहा ह ै। आसके साथ ही जहतधारकों के जहतों और घनी जनसंख्या वाल ेजम्मू िहर के प्राकृजतक संसाधनों के संधारणीय ईपयोग पर भी जवचार दकया जाना चाजहए। सरकार की वन्यजीव संरजक्षत क्षेत्रों के चारों तरफ झटके सहन करन ेवाला सुरक्षा कवच बनान ेकी सरकार की नीजत ह ैजजससे जंगली पिुओं को भोजन, अश्रय, प्रसव और जैवजवजवधताओं हतेु अवागमन सुजनजित करने के जलए गजलयारे जमल सकें । ईच्चतम न्यायालय के जनदेिों न ेआसे और दढृ़ता दी ह;ै और, रामनगर वन्यजीव ऄभयारण्य के चारों ओर के के्षत्र को, जजसका जवस्ट्तार और सीमाएं आस ऄजधसूचना के परैा 1 में जवजनर्ददष्ट हैं, पाररजस्ट्थजतकी और पयाावरणीय की दजृष्ट से पाररजस्ट्थजतकी संवेदी जोन के रूप में सुरजक्षत और संरजक्षत करना तथा ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों की श्रेजणयों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजषद्ध करना अवश्यक ह;ै ऄतः, ऄब, केन्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ परठत पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आसमें आसके पिात ्पयाावरण ऄजधजनयम कहा गया ह)ै की धारा 3 की ईपधारा (1) तथा ईपधारा (2) के खंड (v) और खंड (xiv) एवं ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, जम्मू और कश्मीर संघ राज्य के्षत्र के जम्मू जजले के रामनगर वन्यजीव ऄभयारण्य की सीमा के चारों ओर 0 (िून्य) से 1.850 दकलोमीटर तक जवस्ट्ताररत के्षत्र को पाररजस्ट्थजतकी-संवेदी जोन (जजसे आसमें आसके पश् चात ्पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप में ऄजधसूजचत करती ह,ै जजसका ब्यौरा जनम्नानुसार ह,ै ऄथाात् :- [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3
1. पाररजस्ट्थजतकी सवंदेी जोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार रामनगर वन्यजीव ऄभयारण्य की सीमा के चारों ओर 0 (िून्य) दकलोमीटर से 1.850 दकलोमीटर तक जवस्ट्ततृ ह ैऔर पाररजस्ट्थजतकी संवेदी जोन का क्षेत्रफल 10.73 वगा दकलोमीटर ह।ै दजक्षण, दजक्षण-पजिम और पजिम तरफ पाररजस्ट्थजतकी संवेदी जोन पीदढ़यों से जवद्यमान जम्मू िहर नगरपाजलका की वजह से िून्य सीमा तक ह।ै
(2) रामनगर वन्यजीव ऄभयारण्य और आसके पाररजस्ट्थजतकी संवेदी जोन की सीमा का जववरण ईपाबंध-I के रूप में संलग्न ह।ै
(3) सीमा जववरण और ऄक्षांि और देिांतर के साथ पाररजस्ट्थजतकी संवेदी जोन को सीमांदकत करत ेहुए रामनगर वन्यजीव ऄभयारण्य के मानजचत्र ईपाबंध-IIक, ईपाबंध-IIख, ईपाबंध -IIग और ईपाबंध -IIघ के रूप में संलग्न ह।ै
(4) पाररजस्ट्थजतकी संवेदी जोन और रामनगर वन्यजीव ऄभयारण्य की सीमा के भू-जनदेिांकों की सूची ईपाबंध -III की सारणी क और सारणी ख में दी गइ ह।ै
(5) रामनगर वन्यजीव ऄभयारण्य के प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेदी जोन के ऄतंगात कोइ ग्राम या नगर के्षत्र नहीं अते हैं।
2. पाररजस्ट्थजतकी सवंदेी जोन के जलए अचंजलक महायोजना.– (1) संघ राज्य के्षत्र सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोजनों के जलए, राजपत्र में आस ऄजधसूचना के प्रकािन की तारीख से दो वषा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और आस ऄजधसूचना में ददए गए ऄनुबंधों का पालन करते हुए, संघ राज्य के्षत्र सरकार के सक्षम प्राजधकारी के ऄनुमोदन के जलए एक अंचजलक महायोजना बनायेगी।
(2) संघ राज्य के्षत्र सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना में जवजनर्ददष् ट दकए गए हों के ऄनुसार और सुसंगत कें रीय और संघ राज्य के्षत्र जवजधयों के ऄनुरूप तथा संघ राज्य क्षते्र सरकार द्वारा जारी मागाजनदिेों, यदद कोइ हों, द्वारा तैयार होगी ।
(3) अंचजलक महायोजना, ईि योजना में पाररजस्ट्थजतकी और पयाावरण संबंधी सरोकारों को समाकजलत करने के जलए संघ राज्य के्षत्र सरकार के जनम्नजलजखत जवभागों के परामिा से तैयार होगी, ऄथाात:्-
(i) पयाावरण और वन;
(ii) कृजष;
(iii) राजस्ट्व;
(iv) िहरी जवकास;
(v) ससचाइ और बाढ़ जनयंत्रण;
(vi) संघ राज्य क्षेत्र प्रदषूण जनयंत्रण बोडा;
(vii) अवास और िहरी जवकास;
(viii) ग्रामीण जवकास;
(ix) लोक जनमााण और जवद्यतु जवकास;
(x) अपदा प्रबंधन;
(xi) नगर जनगम पुछं;
(xii) िहरी योजना जवभाग पुंछ; और
(xiii) पंचायती राज।
(4) अंचजलक महायोजना ऄनमुोददत जवद्यमान भू-ईपयोग, ऄवसंरचना और दरयाकलापों पर कोइ जनबंधन ऄजधरोजपत नहीं करेगी जब तक आस ऄजधसूचना में जवजनर्ददष्ट न हो, तथा अचंजलक महायोजना में सभी ऄवसंरचनाओं और दरयाकलापों में जो ऄजधक दक्षता और पाररजस्ट्थजतकी-ऄनुकूल हों का संवधान करेगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(5) अंचजलक महायोजना में ऄनाच्छाददत क्षेत्रों की पुनः बहाली, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मृदा और नमी के संरक्षण, स्ट्थानीय समुदायों की अवश्यकताओं तथा पाररजस्ट्थजतकी और पयाावरण के ऐसे ऄन्य पहलओुं की व्यवस्ट्था की जाएगी जजन पर ध्यान ददया जाना अवश्यक ह।ै
(6) अंचजलक महायोजना में सभी जवद्यमान पूजा स्ट् थलों, ग्रामों और िहरी बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजष क्षेत्रों, उपजाउ भूजम, ईद्यानों और ईद्यानों की तरह के हररत क्षेत्रों, ईद्यान कृजष क्षेत्रों, बगीचों, झीलों और ऄन्य जल जनकायों का ऄभ्यंकन करेगी और आस में जवद्यमान और प्रस्ट्ताजवत भू- ईपयोग की जविेषताओं का ब्यौरा दनेे वाल ेऄनुसमर्डथत मानजचत्र भी ददए जाएंगे।
(7) अंचजलक महायोजना पाररजस्ट्थजतकी संवेदी जोन में जवकास को जवजनयजमत करेगी और सारणी में सूचीबद्ध पैरा-4 में प्रजतजषद्ध और जवजनयजमत दरयाकलापों का ऄनुपालन करेगी और स्ट्थानीय समुदायों की जीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी ऄनुकूल जवकास को सुजनजित और ईसकी ऄजभवृजद्ध भी करेगी।
(8) अंचजलक महायोजना, प्रादेजिक जवकास योजना की सह-जवस्ट्तारी होगी ।
(9) आस प्रकार ऄनुमोददत अंचजलक महायोजना आस ऄजधसूचना के ईपबंधों के ऄनुसार जनगरानी के ऄपन ेकायों को करन े के जलए एक संदभा दस्ट्तावेज तैयार करेगी ।
3. सघं राज्य क्षते्र सरकार द्वारा दकए जान ेवाल ेईपाय.- संघ राज्य क्षेत्र सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात:्-
(1) भ-ूईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन में वनों, ईद्यान कृजष क्षेत्रों, कृजष क्षेत्रों, मनोरंजन के प्रयोजनों के जलए जचजन्हत दकए गए ईद्यानों और खुले स्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक दरयाकलापों के जलए ईपयोग या संपररवतान नहीं दकया जाएगा:
परन्त ुपाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क), में जवजनर्ददष्ट प्रयोजन से जभन्न प्रयोजन के जलए कृजष और ऄन्य भूजम का संपररवतान, जनगरानी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा ऄनुमोदन से क्षेत्रीय नगर योजना ऄजधजनयम तथा यथा लाग ू केन्रीय सरकार या संघ राज्य के्षत्र सरकार के ऄन्य जनयमों और जवजनयमों के ऄधीन तथा आस ऄजधसूचना के ईपबंधों के ऄनुसार स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को पूरा करने के जलए ऄनुज्ञात दकया जाएगा:-
(i) जवद्यमान सडकों को चौडा करना और ईन्हें सुदढृ़ करना और नइ सडकों का संजनमााण;
(ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रदषूण ईत्पन्न न करन ेवाले लघ ुईद्योग;
(iv) कुटीर ईद्योगों जजनके ऄंतगात ग्रामीण ईद्योग भी हैं; सुजवधाजनक भंडार और स्ट्थानीय सुजवधाएं सहायक पाररजस्ट्थजतकी पयाटन जजसके ऄतंगात गृहवास सजम्मजलत ह;ै और
(v) पैरा 4 के ऄधीन ददए गए संवर्डधत दरयाकलाप:
परंत ुयह और भी दक क्षेत्रीय नगर योजना ऄजधजनयम के ऄधीन सक्षम प्राजधकारी के पूवा ऄनमुोदन के जबना तथा संघ राज्य क्षेत्र सरकार के ऄन्य जनयमों और जवजनयमों और संजवधान के ऄनचु्छेद 244 के ईपबंधों तथा तत्समय प्रवृत्त जवजध, जजसके ऄंतगात ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता) ऄजधजनयम, 2006 (2007 का 2) भी अता ह,ै का ऄनुपालन दकए जबना वाजणजज्यक या औद्योजगक जवकास दरयाकलापों के जलए जनजातीय भूजम का ईपयोग ऄनुज्ञात नहीं होगा:
परंत ुयह और भी दक पाररजस्ट् थजतकी संवेदी जोन के भीतर अने वाली भूजम के ऄजभलेखों में हुइ दकसी गलती को, मानीटरी सजमजत के जवचार प्राप्त करन ेके पिात,् कें र िाजसत प्रदेि सरकार द्वारा प्रत्येक मामल ेमें एक बार सुधारा जाएगा और ईि गलती को सुधारन ेकी सूचना कें रीय सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय को दी जाएगी:
परंत ुयह और भी दक ईपयुाि गलती को सुधारन ेमें, आस ईप-पैरा में यथा ईपबंजधत के जसवाय, दकसी भी दिा में भू-ईपयोग का पररवतान सजम्मजलत नहीं होगा;
[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 (ख) ऄनपु्रयुक् त या ऄनुत् पादक कृजष क्षेत्रों में पनु: वनीकरण तथा पयाावासों और जैव- जवजवधता की बहाली के प्रयास दकए जाएंगे ।
(2) प्राकृजतक जल स्रोत.- अंचजलक महायोजना में सभी प्राकृजतक जल स्त्रोतों के अवाह क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण और नवीकरण के जलए योजना सजम्मजलत होगी और कें र िाजसत प्रदेि सरकार द्वारा ऐसे क्षेत्रों पर या ईनके जनकट जवकास दरयाकलापों प्रजतजषद्ध करने के बारे में जो ऐसे क्षेत्रों के जलए ऄजहतकर हो ऐसी रीजत से मागादिाक जसद्धांत तैयार दकए जाएगंे।
(3) पयाटन या पाररजस्ट्थजतकी पयाटन.– )क ( पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन दरयाकलाप या जवद्यमान पयाटन दरयाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन के जलए होगा । (ख) पाररजस्ट्थजतकी पयाटन महायोजना संघ राज्य के्षत्र के पयाावरण और वन जवभागों के परामिा से पयाटन जवभाग द्वारा बनायी जाएगी । (ग) पयाटन महायोजना अंचजलक महायोजना का घटक होगी । (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जायेगी। (ङ) पाररजस्ट्थजतकी पयाटन संबंधी दरयाकलाप जनम् नानुसार जवजनयजमत दकए जाएंग ेऄथाात्:-
(i) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी ऄजधक जनकट हो दकसी होटलों या ररजॉटा का नया सजन्नमााण ऄनुज्ञात नहीं दकया जाएगा:
परन्तु संरजक्षत के्षत्र की सीमा से एक दकलोमीटर की दरूी से परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक होटलों और ररजॉटा का स्ट्थापन केवल पूवा पररभाजषत और नामजनर्ददष्ट क्षेत्रों में पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए ही ऄनजु्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पयाटन दरया-कलापों या जवद्यमान पयाटन दरयाकलापों का जवस्ट्तार, केन्रीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय द्वारा जारी मागादिाक जसद्धांतो तथा पाररजस्ट्थजतकी पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देने वाल ेराष्ट्रीय व्याघ्र संरक्षण प्राजधकरण द्वारा जारी पाररजस्ट्थजतकी पयाटन संबंधी मागादिाक जसद्धांतो (समय-समय पर यथा संिोजधत) के ऄनुसार होगा;
(iii) अंचजलक महायोजना का ऄनुमोदन होने तक, पयाटन के जलए जवकास और जवद्यमान पयाटन दरयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजनर्ददष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के अधार पर संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नए होटल, ररजाटा या वाजणजज्यक स्ट्थापन का संजन्नमााण ऄनजु्ञात नहीं होगा ।
(4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अने वाले बहुमूल्य प्राकृजतक जवरासत के सभी स्ट्थलों जैसे दक जीन कोि अरजक्षत के्षत्र, िैल जवरचनाएं, जल प्रपातो, झरन,े दरो, ईपवनों, गुफाए,ं स्ट्थलों, वनपथ, रोहण मागा, ईत्प्रपातो अदद की पहचान की जाएगी और ईनकी सुरक्षा और संरक्षण के जलए अंचजलक महायोजना के भाग के रूप में एक जवरासत संरक्षण योजना बनायी जाएगी।
(5) मानव जनर्डमत जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, कलाकृजत- क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्य संबधी, सौंदयाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण के जलए अंचजलक महायोजना के भाग के रूप में एक जवरासत संरक्षण योजना बनायी जाएगी।
(6) ध् वजन प्रदषूण.– पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदषूण (जवजनयमन और जनयतं्रण) जनयम, 2000 में जनयत ईपबंधों के ऄनुसार में पाररजस्ट्थजतकी-संवेदी जोन में ध्वजन प्रदषूण के जनयंत्रण और जनवारण का ऄनुपालन दकया जाएगा।
(7) वाय ु प्रदषूण.- पाररजस्ट्थजतकी संवेदी जोन में, वाय ु प्रदषूण की जनवारण और जनयंत्रण, वाय ु (प्रदषूण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों के ऄनुसार ऄनुपालन दकया जाएगा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन में ईपचाररत बजहस्राव का जनस्ट्सारण, और पयाावरण ऄजधजनयम ऄधीन बनाए गए जनयमों के ऄन्तगात सजम्मजलत दकए गए पयाावरणीय प्रदषूण के जनस्ट्सारण संबंधी साधारण मानकों या संघ राज्य के्षत्र सरकार द्वारा जनयत मानकों, आनमें जो भी ऄजधक कठोर हों, के ऄनुसार दकया जाएगा।
(9) ठोस ऄपजिष्ट.- ठोस ऄपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन में ठोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357(ऄ), तारीख 8 ऄप्रैल, 2016 के द्वारा प्रकाजित ठोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा;
(ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप ठोस ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन (इएसएम) ऄनुज्ञात दकया जा सकेगा।
(10) जवै जचदकत्सा ऄपजिष् ट.- जैव जचदकत्सा ऄपजिष् ट का प्रबंधन जनम्नानुसार दकया जाएगा.- (क) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की ऄजधसूचना सं. सा.का.जन 343 (ऄ), तारीख 28 माचा, 2016 के द्वारा प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप जैव-जचदकत्सा ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा।
(11) प्लाजस्ट्टक ऄपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं. सा.का.जन 340(ऄ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(12) जनमााण और जवध्वसं ऄपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं. सां.का.जन 317(ऄ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा ।
(13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय की समय-समय पर यथासंिोजधत द्वारा प्रकाजित इ–ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(14) यानीय-यातायात.- वाहन-यातायात का संचलन अवास-ऄनुकूल तरीके से जवजनयजमत दकया जाएगा और आस संबंध में अंचजलक महायोजना में जविेष ईपबंध सजम्मजलत दकए जाएगंे तथा अंचजलक महायोजना के तैयार होने और संघ राज्य के्षत्र सरकार के सक्षम प्राजधकारी द्वारा ऄनुमोददत दकए जान ेतक, जनगरानी सजमजत सुसंगत ऄजधजनयमों और ईनके ऄधीन बनाए गए जनयमों और जवजनयमों के ऄनुसार वाहनों की अवाजाही के ऄनुपालन की जनगरानी करेगी।
(15) यानीय प्रदषूण.- लागू जवजधयों के ऄनुपालन में वाहन प्रदषूण का जनवारण और जनयंत्रण दकया जाएगा और स्ट्वच्छक ईंधन के ईपयोग के जलए प्रयास दकए जाएंगे।
(16) औद्योजगक इकाआया.ं- (i) राजपत्र में आस ऄजधसूचना के प्रकािन पर या ईसके पिात ्पाररजस्ट्थजतकी संवेदी जोन के भीतर कोइ नए प्रदजूषत ईद्योगों की स्ट्थापना की ऄनुज्ञा नहीं दी जाएगी।
(ii) केन्रीय प्रदषूण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में आस प्रकार जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन के भीतर केवल गैर-प्रदषूणकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि, गैर प्रदषूणकारी ईद्योगों को बढ़ावा ददया जाएगा।
(17) पहाडी ढलानों को सरंक्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) अंचजलक महायोजना पहाडी ढलानों पर क्षेत्रों का संकेत होगा जहां दकसी भी संजनमााण की ऄनुज्ञा नहीं दी जाएगी;
[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 (ख) कटाव के एक ईच्च जडग्री के साथ जवद्यमान खडी पहाडी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनुज्ञा नहीं दी जाएगी ।
4. पाररजस्ट्थजतकी सवंदेी जोन में प्रजतजषद्ध और जवजनयजमत दकए जान ेवाल े दरयाकलापों की सचूी.- पाररजस्ट्थजतकी संवेदी जोन में सभी दरयाकलाप पयाावरण ऄजधजनयम के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों जजसके ऄन्तगात तटीय जवजनयमन जोन, 2011 और पयाावरणीय समाघात जनधाारण ऄजधसूचना, 2006 और ऄन्य लागू जवजधयों के जजसमें वन (संरक्षण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53) सजम्मजलत हैं और दकय ेगये संिोधनों द्वारा िाजसत होंगे और नीचे दी गइ सारणी में जवजनर्ददष्ट रीजत में जवजनयजमत होंगे, ऄथाात ्:- सारणी र. सं .

(ख) खनन प्रचालन, 1995 की ररट याजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमलूपाद बनाम भारत संघ के मामले में माननीय ईच्चतम न्यायालय के अदेि 4 ऄगस्ट्त, 2006 और 2012 की ररट याजचका (जसजवल) सं. 435 में गोवा फाईंडेिन बनाम भारत संघ के मामले में तारीख 21 ऄप्रैल, 2014 के अदेि के ऄनसुरण में होगा ।
2. प्रदषूण (जल, वायु, मृदा, ध्वजन अदद) ईत्पन्न करने वाल े ईद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेदी जोन में कोइ नया ईद्योग लगान ेऔर वतामान प्रदषूणकारी ईद्योगों का जवस्ट्तार करने की ऄनुज्ञा नहीं होगी:
परन्त ुयह दक केन्रीय प्रदषूण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में ऐसा जवजनर्ददष्ट न हों, पाररजस्ट्थजतकी संवेदी जोन के भीतर गैर-प्रदषूणकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि गैर- प्रदषूणकारी कुटीर ईद्यागों को बढ़ावा ददया जाएगा।
3. बृहत जल जवद्युत पररयोजनाओं की स्ट्थापना । प्रजतजषद्ध।
4. दकसी पररसंकटमय पदाथों का ईपयोग या ईत्पादन या प्रस्ट्संकरण । प्रजतजषद्ध।
5. प्राकृजतक जल जनकायों या भूजम क्षेत्र में ऄनुपचाररत बजहस्रावों का जनस्ट्सारण । प्रजतजषद्ध।
6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन में नइ या जवद्यमान अरा जमलों का जवस्ट्तार ऄनुज्ञात नहीं होगा ।

8. वाजणजज्यक होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पयाटन दरयाकलापों लघु ऄस्ट्थायी संरचनाओं के जसवाय संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै नए वाजणजज्यक होटल और ररसोटों को ऄनुज्ञात नहीं दकया जाएगा:
परंतु संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के परे या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक आनमें से, जो भी जनकट हो सभी नए पयाटन दरयाकलाप या जवद्यमान दरयाकलाप का जवस्ट्तार पयाटन महायोजना और यथा लागू मागादिी जसद्धांतों के ऄनुरुप होगा।
9. संजनमााण दरयाकलाप । (क) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट हो, दकसी भी प्रकार के नय ेवाजणजज्यक संजनमााण की ऄनुज्ञा नहीं होगी:
परंतु स्ट्थानीय लोगों को ऄपनी अवास सम्बन्धी जनम्नजलजखत अवश्यकताओं को पूरा करन े के जलए, पैरा 3 के ईप पैरा (1) में सूचीबद्ध दरयाकलापों सजहत ऄपने ईपयोग के जलए, ऄपनी भूजम में भवन ईप-जवजधयों के ऄनुसार, संजनमााण करन ेकी ऄनुज्ञा होगी:
परंत ु यह दक गैर–प्रदषूणकारी लघु ईद्योगों से संबंजधत संजनमााण दरयाकलाप लाग ू जनयमों और जवजनयमों, यदद कोइ हों, के ऄनुसार सक्षम प्राजधकारी की पूवा ऄनजु्ञा से जवजनयजमत दकए जाएंगे और वे न्यूनतम होंगे । (ख) एक दकलोमीटर के्षत्र से परे ये अंचजलक महायोजना के ऄनुसार जवजनयजमत होंगे ।
10. प्रदषूण ईत्पन्न न करन े वाले लघ ु ईद्योग। फरवरी, 2016 में केन्रीय प्रदषूण जनयंत्रण बोडा द्वारा जारी ईद्योगों में वगीकरण के ऄनुसार समय-समय पर यथा संिोजधत गरै-प्रदषूणकारी ईद्योग और ऄपररसंकटमय में, लघ ुऔर सेवा ईद्योग, पुष्प कृजष, कृजष, ईद्यान कृजष या पाररजस्ट्थजतकी संवेदी जोन से देिी सामग्री से ईत्पादों को ईत्पन्न करन े वाल े कृजष अधाररत ईद्योग सक्षम प्राजधकारी द्वारा ऄनुज्ञात होंगे।
11. वृक्षों की कटाइ । (क) संघ राज्य के्षत्र सरकार के सक्षम प्राजधकारी की पूवा ऄनुज्ञा के जबना वन या सरकारी या राजस्ट्व या जनजी भूजम पर वृक्षों की कटाइ की ऄनुज्ञा नहीं होगी । (ख) वृक्षों की कटाइ कें रीय या संबंजधत संघ राज्य के्षत्र के ऄजधजनयमों और ईनके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार जवजनयजमत होगी ।
12. वन ईत्पादों या गैर काष्ठ वन ईत्पादों का संग्रह । लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
13. जवद्युत और संचार टावरों का पररजनमााण और केबलों के जबछाए जाने और ऄन्य बुजनयादी ढांचे । लागू जवजधयों के ऄधीन जवजनयजमत होंगे (भूजमगत केबल के जबछाए जाने को बढ़ावा ददया जा सकेगा)।
14. नागररक सुख सुजवधाओं सजहत ऄवसंरचनाएं । न्यूनीकरण ईपायों को लागू जवजधयों, जनयमों और जवजनयमनों और ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाएगा । [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 9
15. जवद्यमान सडकों को चौडा करना और ईन्हें सुदढृ़ करना तथा नवीन सडकों का संजनमााण । न्यूनीकरण ईपायों को लाग ू जवजधयों, जनयमों और जवजनयमनों तथा ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाएगा ।
16. पयाटन से संबंजधत ऄन्य दरयाकलाप जैसे गमा वाय ु गबु्बारें, हलेीकाप्टर, ड्रोन, माआरोलाआटस, अदद द्वारा पाररजस्ट्थजतकी संवेदी जोन के्षत्र के उपर से ईडना जैसे दरयाकलापों को करना। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।
17. पवातीय ढलानों और नदी तटों का संरक्षण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
18. राजत्र में यानीय यातायात का संचलन । लाग ू जवजधयों के ऄनुसार वाजणजज्यक प्रयोजन के जलए जवजनयजमत होगा।
19. स्ट्थानीय समुदायों द्वारा चल रही कृजष और बागवानी प्रथाओं के साथ डेयररयों, दगु्ध ईत्पादन जल कृजष और मत्स्ट्य पालन। स्ट्थानीय लोगों के ईपयोग के जलए लागू जवजधयों के ऄधीन जवजनयजमत होंगे ।
20. फमों, कारपोरेट और कंपजनयों द्वारा बडे पैमाने पर वाजणजज्यक पिुधन संपदा और कुक्कुट फामों की स्ट्थापना । स्ट्थानीय अवश्यकताओं को परूा करन ेके जलए लाग ूजवजधयों के ऄनुसार जवजनयजमत )ऄन्यथा प्रदान दकए गए (होंगे ।
21. प्राकृजतक जल जनकायों या भू के्षत्र में ईपचाररत ऄपजिष्ट जल या बजहस्रााव का जनस्ट्सारण । जल जनकायों में ईपचाररत ऄपजिष्ट जल या बजहस्रााव के जनस्ट्सारण से बचा जाएगा। ईपचाररत ऄपजिष्ट जल के पुनचारण और पुन:ईपयोग के प्रयास दकए जाएंग ेऄन्यथा ईपचाररत ऄपजिष्ट जल या बजहस्रााव का जनस्ट्सारण लाग ूजवजधयों के ऄनसुार जवजनयजमत होगा।
22. सतही और भूजल का वाजणजज्यक जनष्कषाण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
23. ठोस ऄपजिष् ट प्रबंधन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा।
24. जवदेिी प्रजाजतयों को लाना । लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
25. पाररजस्ट्थजतकी पयाटन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
26. पोजलथीन बैगों का ईपयोग । लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
27. वाजणजज्यक संकेत बोडा और होर्डडग । लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
28. कृजष और ऄन्य ईपयोग के जलए खुल े कंुअ, बोर कंुअ, अदद । लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा । आ. सवंर्डधत दरयाकलाप
29. वषाा जल संचय । सदरय रूप से बढ़ावा ददया जाएगा ।
30. जैजवक खेती। सदरय रूप से बढ़ावा ददया जाएगा ।

32. कुटीर ईद्योग जजसके ऄतंगात ग्रामीण काररगर भी ह।ै सदरय रूप से बढ़ावा ददया जाएगा ।
33. नवीकरणीय उजाा और ईंधन का ईपयोग । बायोगैस, सौर प्रकाि आत्यादद को सदरय रूप से बढ़ावा ददया जाएगा।
34. कृजष वाजनकी । सदरय रूप से बढ़ावा ददया जाएगा ।

39. पयाावरण के प्रजत जागरुकता। सदरय रूप से बढ़ावा ददया जाएगा ।
5. पाररजस्ट्थजतकी सवंदेी जोन ऄजधसचूना की जनगरानी के जलए जनगरानी सजमजत.- कें रीय सरकार, पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 3 की ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करत ेहुए, पाररजस्ट्थजतकी संवेदी जोन की प्रभावी जनगरानी के जलए जनगरानी सजमजत गरठत करती ह,ै जो जनम्नजलजखत से जमलकर बनेगी, ऄथाात:्- र .सं. जनगरानी सजमजत का गठन पद
(i) जजला कलक्टर या ईपायुि ऄध् यक्ष , पदेन;
(ii) क्षेत्रीय वन्यजीव वाडान, जम्मू के्षत्र, जम्मू सदस्ट्य;
(iii) जम्मू-कश्मीर सरकार के पयाावरण, पाररजस्ट्थजतकी और ररमोट सेंससग जवभाग के एक प्रजतजनजध सदस्ट्य;
(iv) क्षेत्रीय ऄजधकारी जम्मू, राज्य प्रदषूण जनयंत्रण बोडा, जम्मू-कश्मीर सरकार सदस्ट्य;
(v) वन्यजीव संरक्षण के के्षत्र में काम करने वाले गैर-सरकारी संगठन के एक प्रजतजनजध (मुख्य वन्यजीव वाडान द्वारा नाजमत), जम्मू - कश्मीर सरकार सदस्ट्य;
(vi) पाररजस्ट्थजतकी और पयाावरण के के्षत्र में एक जविेषज्ञ (जम्मू - कश्मीर के एक प्रजतजष्ठत संस्ट्थान या जवश्वजवद्यालय संघ राज्य क्षेत्र से), जम्मू - कश्मीर सरकार सदस्ट्य;
(vii) जम्मू - कश्मीर सरकार के मुख्य वन्यजीव वाडान द्वारा नाजमत जैव जवजवजधता में एक जविेषज्ञ सदस्ट्य;
(viii) राजस्ट्व जवभाग का एक प्रजतजनजध (जम्मू - कश्मीर सरकार के ईपायुि, जम्मू द्वारा नाजमत), जम्मू - कश्मीर सरकार सदस्ट्य;
(ix) अवास और िहरी/ ग्रामीण जवकास जवभाग के एक प्रजतजनजध (ईपायुि, जम्मू द्वारा नाजमत), जम्मू- कश्मीर सरकार सदस्ट्य;
(x) जम्मू - कश्मीर सरकार के कृजष ईत्पादन जवभाग के एक प्रजतजनजध को ईपायिु, जम्मू द्वारा नाजमत दकया जाना ह ै सदस्ट्य;
(xi) जम्मू - कश्मीर सरकार के ससचाइ और बाढ़ जनयंत्रण जवभाग के एक प्रजतजनजध (ईपायुि, जम्मू द्वारा नाजमत) सदस्ट्य;

6. जनदिे जनबधंन:- (1) जनगरानी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन की मानीटरी करेगी।
(2) जनगरानी सजमजत का कायाकाल ऄगल ेअदेि होने तक होगा, परंत ुयह दक सजमजत के गरै-सरकारी सदस्ट्यों को समय- समय पर संघ राज्य क्षेत्र सरकार द्वारा नामजनर्ददष्ट दकया जाएगा।
(3) ईन दरयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ.
1533 (ऄ), तारीख 14 जसतम्बर, 2006 की ऄनुसूची में सजम्मजलत हैं, और जो पाररजस्ट्थजतकी संवेदी जोन में अत ेहैं, जसवाय आसके जो परैा 4 के ऄधीन सारणी में यथा जवजनर्ददष्ट प्रजतजषद्ध दरयाकलापों के, जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईि ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरण ऄनापजत्त के जलए केरींय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को जनर्ददष्ट दकया जाएगा।
(4) ईन दरयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ. 1533 (ऄ) तारीख 14 जसतंबर, 2006 की ऄनुसूची में सजम्मजलत नहीं ह,ै और जो पाररजस्ट्थजतकी संवेदी जोन में अत ेहैं, जसवाय आसके पैरा 4 के ऄधीन सारणी में यथाजवर्डनष्ट प्रजतजषद्ध दरलाकलापों के जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईसे संबंद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया जाएगा।
(5) जनगरानी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायुि ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का ईल्लघंन करता ह,ै पयाावरण ऄजधजनयम, की धारा 19 के ऄधीन पररवाद फाआल करन ेके जलए सक्षम होगा।
(6) जनगरानी सजमजत मुद्दा दर मदु्दा के अधार पर ऄपेक्षाओं पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधयों या जविेषज्ञों, औद्योजगक संगमों या संबद्ध पणधाररयों के प्रजतजनजधयों को ऄपन ेजवचार-जवमिा में सहायता के जलए अमंजत्रत कर सकेगी ।
(7) जनगरानी सजमजत प्रत्येक वषा की 31 माचा तक के ऄपन ेदरयाकलापों की वार्डषक कारावाइ ररपोटा संघ राज्य क्षेत्र सरकार के मुख्य वन्यजीव वाडान को ईपाबधं-IV में संलग्न प्रोफामाा में ईक् त वषा के 30 जून तक प्रस्ट्तुत करेगी ।
(8) केन्रीय सरकार का पयाावरण, वन और जलवाय ुपररवतान मंत्रालय जनगरानी सजमजत को ऄपन ेकृत्यों के प्रभावी जनवाहन के जलए ऐसे जनदेि दे सकेगा, जो वह ठीक समझे ।
7. ऄजतररक् त ईपाय.- आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए कें रीय सरकार और संघ राज्य के्षत्र सरकार , ऄजतररक् त ईपाय, यदद कोइ हों, जवजनर्ददष् ट कर सकें गी।

8. कोइ ऄन् य महत् वपूणा जवषय । [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 19 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 1st June, 2021 S.O.2128(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O 3582 (E), dated the 13 th October 2020, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 13 th October 2020;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification;
WHEREAS, Ramnagar Wildlife Sanctuary falls within the civil jurisdiction of Jammu City Tehsil, District Jammu in the Union territory of Jammu and Kashmir and comprises of compartments 1 to 4 of the Ramnagar block of Jammu Forest Division. Ramnagar Wildlife Sanctuary located on the northern fringe of Jammu city is a small green patch of forest which is valued as the only green lung of the city. The Sanctuary was notified vide Govt. Order No.136 dated the 10 th April, 1990. It is under the administrative control of Department of Wildlife Protection, Jammu and Kashmir Government and is managed through Wildlife Division Jammu. The Sanctuary comprising of compartments 1,2,3 and 4 of Ramnagar Block of Ramnagar Range of Jammu Forest Division and covers an area of 12.75 square kilometers (31.5 square kilometers as per the S.R.O). The area comprises of demarcated forest and is roughly wedge shaped. The area is surrounded by habitations and faces heavy biotic pressure. This wildlife protected area is repository of rich assemblage of floral and faunal diversity;
AND WHEREAS, according to a recent floral study the Ramnagar Wildlife Sanctuary houses more than 195 species of plants including herbs, shrubs, climbers and tree. A comparative study of phytodiversity shows that this small patch of forest is much more diverse and rich than surrounding forest areas of Jammu. The faunal species, some of which include common Indian leopard, barking deer, wild boar, nilgai, porcupine, red jungle fowl, peafowl, python, russell viper and cobra, owe their existence and protection to this patch of wildlife protected area;
AND WHEREAS, the area is covered with mixed scrub forests with occasional chir trees. The vegetation of the Sanctuary as per the revised classification by Champion and Seth and comes under the major group “Sub-tropical Northern Mixed Dry Deciduous Forests.” A variety of sub-tropical broad leaved trees and shrubs are found in the Sanctuary, the dominant among them being Acacia modesta. The main flora available in the Sanctuary are phullai (Acacia modesta), babul (Acacia nilotica), Khair (Acacia catechu), haldin (Adina cardifolia), bael (Aegle marmelos), siris (Albizzia lebbeck), khanwal (Bauhinia purpurea), silk cotton tree (Bombax ceiba), shisham (Dalbergia sissoo), toon (Toona ciliata), ber (Ziziphus mauritiana), etc;
AND WHEREAS, the mammal species found in the Ramnagar Wildlife Sanctuary are nilgai (Boselaphus traglocamelus) spotted deer (Axis axis), barking deer (Muntiacus muntejak), rhesus monkey (Macaca mulatta), jackal (Canis aureus), hare (Lepus nigricollis), porcupine (Hystrix indica), wild boar (Sus scrofa), mongoose (Herpestes edwardsii), etc. While avifauna recorded from the protected area are white backed or Bengal vulture (Gyps bengalensis), shikra (Accipiter badius), blue rock dove (Columba livia ), koel (Endynamyus scolopacea), green barbet (Magalaima zeylanica), house swift (Apus affinus), small green bee-eater (Merops orientalis), common wood shrike (Tephrodorinis pondicerianus), white checked bulbul (Pycnonotus leucogenys), Tickell‟s frower pecker (Diceum erythrorhyncha), pied bush chat (Saxicola caprata) white eye (Zosterops palperbrosa), etc. Reptiles such as Russell's earth boa (Eryx conicus), John's earth boa (Eryx johnii), Indian python (Python molurus molurus), cat snake (Boiga trigonata), common Indian krait (Bungarus caeruleus), russell viper (Vipera russelli), etc. while butterflies species such as Papilio demoleus demoleus, Papilio polytes romulous, Parnassius delphius alkinsoni, Danaus limiace leopardus, Pieris brassicae, Catopsilia pyranthe pyranthe, Mycalesis mineus mineus, Ypthisma ceylonica huebneci, Phalanta phalantha phalantha, Euthalia aconthea, etc. are recorded from the protected area;
20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, keeping in view the expansion of Jammu city and increasing pressure on the natural resources the threat looming large over the remaining residual forest patches around this wildlife protected area is understandable. At the same time considering the interests of stakeholders and thickly populated Jammu town, sustainable use of natural resources has to be given due consideration. The policy of the government to have shock-absorbing protective covers around Wildlife Protected Areas providing corridors to ensure dispersal and movement of wild animals for food, shelter, procreation and safeguard of biodiversity has been further strengthened by the Supreme Court‟s directions;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Ramnagar Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and
(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 (zero) to 1.850 kilometres around the boundary of Ramnagar Wildlife Sanctuary, in Jammu district in the Union territory of Jammu and Kashmir as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: -
1. Extent and boundaries of Eco-sensitive Zone.– (1) The Eco-sensitive Zone shall be to an extent of 0 (zero) kilometre to 1.850 kilometres around the boundary of Ramnagar Wildlife Sanctuary and the area of the Eco-sensitive Zone is 10.73 square kilometres. Zero extent of Eco-sensitive Zone towards south, south-west and west side is due to the existing Jammu city municipal area prevailing since generations.
(2) The boundary description of Ramnagar Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I.
(3) The maps of the Ramnagar Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC and Annexure-IID.
(4) List of geo-coordinates of the boundary of Ramnagar Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure III.
(5) There is no village or township falling within the proposed Eco-sensitive Zone of Ramnagar Wildlife Sanctuary.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The Union territory Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of Union territory.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union territory Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union territory laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union territory Government, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment and Forest;
(ii) Agriculture;
(iii) Revenue;
(iv) Tourism;
(v) Irrigation and Flood Control;
(vi) Union territory Pollution Control Board.
(vii) Housing and Urban Development;

(viii) Rural Development;
(ix) Public Works and Power Development;
(x) Disaster Management;
(xi) Municipal Corporation Poonch;
(xii) Department of Town Planning Poonch; and
(xiii) Panchayati Raj.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities‟ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the Union territory Government.- The Union territory Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or Union territory Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Union territory Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the Union territory Government, after obtaining the views of Monitoring 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph;
(b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Ecosensitive Zone;
(b) the Eco-Tourism Master Plan shall be prepared by the Union territory Department of Tourism in consultation with Union territory Departments of Environment and Forests;
(c) the Tourism Master Plan shall form a component of the Zonal Master Plan;
(d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Ecosensitive Zone;
(e) the activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the ecotourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution.- Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by Union territory Government whichever is more stringent.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Ecosensitive Zone.
(10) Bio-Medical Waste.- Bio-Medical Waste Management shall be as under:-
(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R.
343 (E), dated the 28 th March, 2016;
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Ecosensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the Union territory Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco Sensitive Zone;
(b) the mining operations shall be carried out in accordance with the order of the Hon‟ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted.
3. Establishment of major hydro-electric project.
Prohibited.
4. Use or production or processing of any hazardous substances.
Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited.
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited.
B. Regulated Activities
8. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 25 Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph
(1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents.
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any;
(b) beyond one kilometer it shall be regulated as per the Zonal Master Plan.
10. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
11. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the Union territory Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or Union territory Act and the rules made thereunder.
12. Collection of Forest produce or Non- Timber Forest produce.
Regulated as per the applicable laws.
13. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws (underground cabling may be promoted).
14. Infrastructure including civic amenities.
Taking measures of mitigation as per the applicable laws, rules and regulations available guidelines.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. (vii) An expert in Biodiversity nominated by the Chief Wildlife Warden, Government of Jammu and Kashmir Member;
(viii) A representative of Revenue Department (to be nominated by the Deputy Commissioner, Jammu), Government of Jammu and Kashmir.

(xiii) Concerned Wildlife Warden Member-Secretary.
6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the Union territory Government from time to time.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the Union territory as per proforma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional Measures.- The Central Government and Union territory Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon‟ble Supreme Court of India or High Court or the National Green Tribunal.
