PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पयाावरण, वन और जलवाय ुपररवतान मतं्रालय ऄजधसचूना नइ ददल्ली, 17 जनवरी, 2022 का.अ. 213(ऄ).—प्रारुप ऄजधसूचना भारत के राजपत्र, ऄसाधारण, भारत सरकार के पयाावरण, वन और जलवायु पररवतान, मंत्रालय की ऄजधसूचना सं. का.अ. 565 (ऄ), तारीख 5 फरवरी, 2021, द्वारा प्रकाजित की गइ थी जजसमें ऐसे सभी व्यजियों से, जजनकी ईससे प्रभाजवत होने की संभावना थी, ईस तारीख से, जजसको ईि ऄजधसूचना को ऄन्तर्ववष्ट करन ेवाली राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थीं, साठ ददन की ऄवजध के भीतर अक्षेप और सुझाव अमंजत्रत दकए गए थ;े और, ईि प्रारूप ऄजधसूचना को ऄन्तर्ववष्ट करने वाली राजपत्र की प्रजतयां जनता को 5 फरवरी, 2021, को ईपलब्ध करा दी गइ थी;

और, ईि प्रारुप ऄजधसूचना के प्रत्युतर में व्यजियों और पणधाररयों से प्राप्त अक्षेपों और सुझावों पर केन्रीय सरकार द्वारा जवचार दकया गया था;

और, बोर बाघ ररज़वा वधाा जजल ेमें 138.11 वगा दकलोमीटर क्षेत्रफल में फैला हुअ ह ैऔर महाराष्ट्र राज्य में वधाा जजला मुख्यालय से 40 दकलोमीटर और नागपरु से 65 दकलोमीटर की दरूी पर जस्ट्थत ह;ै और, महाराष्ट्र सरकार ने वन्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53) की धारा 38 (v) के प्रावधानों के ऄधीन राजपत्र ऄजधसूचना सं. डब्ल्यूएलपी. 0114/सी.अर.26/एफ-1, तारीख 16 ऄगस्ट्त, 2014 द्वारा बोर बाघ ररज़वा (बोर वन्यजीव ऄभयारण्य, नया बोर वन्यजीव ऄभयारण्य और जवस्ट्तृत नया बोर वन्यजीव ऄभयारण्य) घोजित दकया गया, जजसमें महाराष्ट्र राज्य के जनम्नजलजखत ऄभयारण्य िाजमल हैं, ऄथाात:् स.ं 209] नइ ददल्ली, सोमवार, जनवरी 17, 2022/पौि 27, 1943 No. 209] NEW DELHI, MONDAY, JANUARY 17, 2022/PAUSHA 27, 1943 सी.जी.-डी.एल.-अ.-19012022-232744 CG-DL-E-19012022-232744 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(i) बोर वन्यजीव ऄभयारण्य (61.10 वगा दकलोमीटर) वधाा और नागपुर जजला;

(ii) नया बोर वन्यजीव ऄभयारण्य (60.69 वगा दकलोमीटर) वधाा और नागपरु जजला;

(iii) जवस्ट्तृत नया बोर वन्यजीव (16.32 वगा दकलोमीटर) वधाा और नागपुर जजला ह;ै और, महाराष्ट्र राज्य सरकार ने वन्यजीव (संरक्षण), ऄजधजनयम, 1972 (1972 का 53) की धारा 38 V के प्रावधानों के ऄधीन राजपत्र ऄजधसूचना सं. डब्ल्यूएलपी-0815/सी.अर.261/एफ-1 तारीख 04 ददसंबर, 2015 द्वारा बोर बाघ ररज़वा (बोर वन्यजीव ऄभयारण्य, नया बोर वन्यजीव ऄभयारण्य और जवस्ट्तृत नया बोर वन्यजीव ऄभयारण्य) के

678.15 वगा दकलोमीटर के्षत्र को बफर के्षत्र घोजित दकया गया;

और, बोर बाघ ररज़वा पजक्षयों के समृद्ध वास के जलए जाना जाता ह ैआसमें पजक्षयों की लगभग 160 प्रजाजतयां हैं जजनमें प्रवासी और जलपक्षी िाजमल हैं और आस के्षत्र में भारतीय मूल के क्षेत्रीय पजक्षयों की संख्या भी ऄजभजलजखत की गइ ह ैऔर आस के्षत्र में सारस के्रनस (एटीगोन एटीगोने) का प्रजनन होना ऄजभजलजखत दकया गया ह ैऔर आस के्षत्र में कुछ महत्त्वपूणा पजक्षयों की प्रजाजतयां वाआट-रूम्पेड जगद्ध (जजप्स बेंगालेंजसस), गोल्डन ओररयोल (ओररओलुस कंुडू), बे्रन-दफवेर कूक्कू (जहआरोकोक्कयक्स वैररईस), पैराजडस फ्लाइ कैचर (टेरजप्सफोने पैराजडस), आगीपजतयन जगद्ध (नेओफरोन पेरचनोपटेरूस), रेड-हडे्डेड जगद्ध (सरकोगयपस कालवुस), स्ट्टेप्पे इगल एदिला (एदिला जनपलेंजसस), भारतीय स्ट्पोटे्टड इगल (जसलांगा हास्ट्टाटा), ररवर टना स्ट्टेनाा (स्ट्टेनाा औरांरटया), ब्लैक-हडे्डडे आजबस (टरेसदकओजमस मेलोनाकेफालुस), पेंटेड स्ट्रोक (मायेस्ट्टेररया लेईकोकेफला), वूल्लय नेके्कड स्ट्रोक (दककोजनया आजपस्ट्कुपुस), अदद ऄजभजलजखत की गइ ह;ै और, यह के्षत्र दजक्षणी ईष्णकरटबंधीय िुष्क पणापाती वनों द्वारा बहुत ईच्च वनस्ट्पजत जवजवधता का प्रजतजनजधत्व करता ह ै और आस के्षत्र में जवद्यमान वनस्ट्पजत प्रजाजतयों में कचनार (बईजहजनया राकेमोसा), ओनला (फयल्लांथुस आम्बजलका), ऐन (टेरजमनाजलया टोमेंटोसा), बेहडा(टेरजमनाजलया बेल्लेररका), बेल (एग्ल ेमामेलोस), जबस्ट्टेंद ु(जडओस्ट्पयरोस मोंटाना),जचरोंजी (बुचानाजनया लानजान), गुलार (दफकस गलोमेराटा), जहरदा (टेर्वमनाजलया चेबुला), कुसुम (स्ट्चलेचेरा ओलओेसा), लेंददया (लागसे्ट्टोआजमया पर्ववफ्लोरा), पलास (बुटेसा फरोंदोसा), सलाइ (बोस्ट्वेजल्लया सेरााटा), जिवान (गमेजलना ऄरबोररया), सूयाा (क्यजलया कयलोकारपा), तेंद ु (जडओस्ट्पयरोस मालानोक्यलोन), तोनदरी (केसऄररया टोमेंटोसा), वारंग (कयददया कलयजसना), वाइट कुडा (होलाहनेा ऄंजथडयसेंटररका), अदद िाजमल ह;ै और, बोर बाघ ररज़वा पजक्षयों में स्ट्तनधाररयों की 30 प्रजाजतयों, सरीसृपों की 26 प्रजाजतयों और ईभयचरों की कइ प्रजाजतयों को ऄजभजलजखत दकया गया ह ैऔर यह महत्त्वपूणा लुप्तप्राय और ऄजतसंवेदनिील वन्यजीव जैसे बाघ (पेन्थेरा रटगररस), तेंदअु (पेन्थेरा प्रड्यूस), अलसी रीछ (मलेसास ऄरजसनस), वन्यजीव कुत्ता (कुओन ऄजल्पनेस), फोर होनेड- ऄंटेलोप े(टेटराकेरूस क्यादररकोरजनस), सांभर जहरन (रुसा यनूीक्लोर), अदद को भी अश्रय प्रदान करता ह;ै और, ईपयुाि ऄभयारण्य के मानव वास और चल रही जवकासात्मक दक्रयाकलापों के ऄत्यंत जनकट होने से ऄभयारण्य के जलए, ईजचत सुरक्षा ईपायों और ऐसे दक्रयाकलापों पर जनयंत्रण करन ेकी अवश्यकता है;

और, बोर बाघ ररज़वा के चारों ओर के क्षेत्र को, जजसका जवस्ट्तार और सीमाएं पाररजस्ट्थजतकी पयाावरणीय से पाररजस्ट्थजतकी संवेदी जोन के रूप में पैरा 1 में जवजनर्ददष्ट हैं, जैव जवजवजधता की दजृष्ट सुरजक्षत और संरजक्षत करना और ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करन ेको प्रजतजिद्ध करना अवश्यक ह;ै ऄतः, ऄब, केन्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ परठत पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आस ऄजधसूचना में आसके पश्चात ्पयाावरण ऄजधजनयम कहा गया ह)ै की धारा 3 की ईपधारा (1) और ईपधारा (2) के खंड (v) और खंड (xiv) तथा ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करत ेहुए, महाराष्ट्र राज्य के वधाा जजला के बोर बाघ ररज़वा की सीमा के चारों ओर 0.5 दकलोमीटर से 26.50 दकलोमीटर जवस्ट्ताररत क्षेत्र को पाररजस्ट्थजतकी संवेदी जोन (जजसे आसमें आसके पश् चात् पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप में ऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार ह,ै ऄथाात ्:-

1. पाररजस्ट्थजतकी सवंदेी जोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार बोर बाघ ररज़वा की सीमा के चारों ओर 0.5 दकलोमीटर स े26.50 दकलोमीटर तक जवस्ट्तृत ह ैऔर पाररजस्ट्थजतकी संवेदी जोन का क्षेत्रफल

678.14 वगा दकलोमीटर ह।ै

(2) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार और सीमा का जववरण ईपाबधं-I के रूप में संलग्न ह।ै [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3

(3) मुख्य ऄवस्ट्थानों और भूजम ईपयोग पैटना के भू-जनदेिांकों के साथ बोर बाघ ररज़वा के पाररजस्ट्थजतकी संवेदी जोन के मानजचत्र ईपाबधं-IIक, ईपाबधं-IIख, ईपाबधं-IIग और ईपाबधं-IIघ के रूप में संलग्न ह।ै

(4) बोर बाघ ररज़वा और आसके पाररजस्ट्थजतकी संवेदी जोन की सीमा के भू-जनदेिांकों की सूची ईपाबधं –III की सारणी क और ख के रूप में संलग्न ह।ै

(5) पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अन ेवाले ग्रामों की सूची ईपाबधं-IV में दी गइ ह।ै

2. पाररजस्ट्थजतकी संवदेी जोन के जलए अचंजलक महायोजना– (1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोजनों के जलए राजपत्र में आस ऄजधसूचना के प्रकािन की तारीख से दो विा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और राज्य के सक्षम प्राजधकारी के ऄनुमोदन के जलए आस ऄजधसूचना में ददए गए ऄनुबंधों का पालन करत े हुए अंचजलक महायोजना तैयार करेगी और राज्य में सक्षम प्राजधकारी द्वारा जवजधवत ऄनुमोददत दकया जाएगा।

(2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना में जवजनर्ददष् ट दकए गए हैं, के ऄनुसार तथा सुसंगत कें रीय और राज् य जवजधयों के ऄनुरुप और कें रीय सरकार द्वारा जारी मागाजनदेिों, यदद कोइ हों, द्वारा तैयार होगी ।

(3) बोर बाघ ररज़वा का बफर जोन पाररजस्ट्थजतकी संवेदी जोन का भाग बनेगा और अंचजलक महायोजना की तैयारी के दौरान बाघ संरक्षण योजना को भी ध्यान में रखा जाएगा।

(4) अंचजलक महायोजना, ईि योजना में पाररजस्ट्थजतकी और पयाावरणीय बातों को समाकजलत करने के जलए राज् य सरकार के जनम्नजलजखत जवभागों के परामिा से तैयार होगी, ऄथाात्:-

(i) वन और वन्यजीव;

(ii) पयाावरण;

(iii) कृजि;

(iv) राजस्ट्व;

(v) िहरी जवकास;

(vi) पयाटन;

(vii) नगरपाजलका;

(viii) महाराष्ट्र राज्य प्रदिूण जनयंत्रण बोडा।

(5) अंचजलक महायोजना ऄनमुोददत जवद्यमान भू-ईपयोग, ऄवसंरचना और दक्रयाकलापों पर कोइ जनबंधन ऄजधरोजपत नहीं करेगी जब तक दक आस ऄजधसूचना में आस प्रकार जवजनर्ददष् ट न हो और अचंजलक महायोजना सभी ऄवसंरचना और दक्रयाकलापों में, जो ऄजधक दक्षता और पाररजस्ट्थजतकी ऄनुकूल हों, का संवधान करेगी ।

(6) अंचजलक महायोजना में ऄनाच्छाददत क्षेत्रों के जीणोद्धार, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदा और नमी संरक्षण, स्ट्थानीय समुदायों की अवश्यकताओं तथा पाररजस्ट्थजतकी और पयाावरण से संबंजधत ऐसे ऄन्य पहलओुं, जजन पर ध्यान देना अवश्यक ह,ै के जलए ईपबंध होंगे ।

(7) अंचजलक महायोजना जवद्यमान और प्रस्ट्ताजवत भूजम ईपयोग जविेिताओं के ब्यौरों से ऄनुसमर्वथत मानजचत्र के साथ सभी जवद्यमान पूजा स्ट् थलों, ग्रामों और नगरीय बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, उपजाउ भूजम, हररत क्षेत्र जैसे ईद्यान और ईसी प्रकार के स्ट् थान, ईद्यान कृजि क्षेत्र, फलोईद्यान, झीलों और ऄन्य जल जनकायों का ऄभयांकन करेगी।

(8) अंचजलक महायोजना पाररजस्ट्थजतकी संवेदी जोन में जवकास को जवजनयजमत करने के जलए प्रदकया प्रदान की जाएगी और सारणी में सूचीबद्ध पैरा-4 में प्रजतजिद्ध और जवजनयजमत दक्रयाकलापों का ऄनपुालन करेगी और स्ट् थानीय समुदायों की जीजवका को सुरजक्षत करन ेके जलए पाररजस्ट्थजतकी ऄनुकूल जवकास को सुजनजश्चत और ईसकी ऄजभवृजद्ध भी करेगी।

(9) अंचजलक महायोजना प्रादेजिक जवकास योजना की सह जवस्ट्तारी होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(10) राज्य सरकार द्वारा ऄनुमोददत अंचजलक महायोजना आस ऄजधसूचना के ईपबंधों के ऄनसुार जनगरानी के ऄपन ेकृत्यों को करने के जलए राज्य सरकार द्वारा जनगरानी सजमजत के जलए एक संदभा दस्ट्तावेज तैयार करेगी।

3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करने के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:-

(1) भू-ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन में वनों, ईद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के प्रयोजनों के जलए जचजन्हत दकए गए पाकों और खुल ेस्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक संबद्ध जवकास दक्रयाकलापों के जलए ईपयोग या संपररवतान नहीं होगा:

परंत ुपाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क) में जवजनर्ददष्ट प्रयोजनों से जभन्न प्रयोजनों के जलए कृजि और ऄन्य भूजम का संपररवतान जनगरानी सजमजत की जसफाररि पर और यथा लागू और क्षेत्रीय नगर योजना ऄजधजनयम और केन्रीय सरकार या राज्य सरकार के ऄन्य जनयमों तथा जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन से, और आस ऄजधसूचना के ईपबंधों द्वारा स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को पूरा करन ेके जलए ऄनुज्ञात दकया जाएगा, जैसे-

(i) जवद्यमान सड़कों को चौड़ा करना और ईन्हें सुदढृ़ करना तथा नइ सड़कों का संजनमााण;

(ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;

(iii) प्रदिूण ईत्पन्न न करने वाल ेलघ ुईद्योग;

(iv) कुटीर ईद्योगों जजनके ऄंतगात ग्रामीण ईद्योग भी हैं; सुजवधाजनक भण्डार और स्ट्थानीय सुजवधाएं सहायक पाररजस्ट्थजतकी पयाटन जजसके ऄन्तगात गहृ वास सजम्मजलत ह;ै और

(v) पैरा 4 में ददए गए संवर्वधत दक्रयाकलाप:

परंत ुयह और दक प्रादेजिक नगर योजना ऄजधजनयम और राज्य सरकार के ऄन्य जनयमों और जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन और संजवधान के ऄनचु्छेद 244 के ईपबंधों या तत्समय प्रवृत्त जवजध के ईपबंधों के ऄनुपालन के जबना, जजसके ऄधीन ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता) ऄजधजनयम, 2006 (2007 का 2) भी ह,ै वाजणजज्यक या औद्योजगक जवकास दक्रयाकलापों के जलए जनजातीय भूजम का ईपयोग ऄनुज्ञात नहीं होगा:

परंत ुयह और भी दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भू-ऄजभलेखों में ईपसंजात कोइ गलती, जनगरानी सजमजत के जवचार प्राप्त करन ेके पश्चात ्राज्य सरकार द्वारा प्रत्येक मामले में एक बार ठीक होगी और ईि गलती के सुधार की सूचना कें रीय सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय को दी जाएगी:

परंत ुयह और भी दक गलती के सुधार में आस ईप पैरा के ऄधीन यथा ईपबंजधत के जसवाय दकसी भी दिा में भू-ईपयोग का पररवतान सजम्मजलत नहीं होगा;

(ख) वनीकरण तथा वास जीणोद्धार दक्रयाकलापों सजहत ऄनप्रयुक् त या ऄनुत् पादक कृजि क्षते्रों में पुन: वनीकरण करने के प्रयास दकए जाएंगे।

(2) प्राकृजतक जल स्रोत.- अचंजलक महायोजना में सभी प्राकृजतक झरनों के अवाह क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण और नवीकरण के जलए योजना सजम् मजलत होगी और राज् य सरकार द्वारा ऐसे क्षेत्रों पर या ईनके जनकट जवकास दक्रयाकलाप प्रजतजिद्ध करने के बारे में जो ऐसे क्षेत्रों के जलए ऄजहतकर हो ऐसी रीजत से मागादिाक जसद्धांत तैयार दकए जाएंगे।

(3) पयाटन या पाररजस्ट्थजतकी पयाटन.- (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन दक्रयाकलाप या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन के जलए होगा;

(ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य पयाटन जवभाग द्वारा राज्य पयाावरण और वन जवभाग के परामिा से तैयार होगी;

[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 (ग) पयाटन महायोजना अंचजलक महायोजना के एक घटक के रूप में होगी;

(घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जाएगी;

(ङ) पाररजस्ट्थजतकी पयाटन संबंधी दक्रयाकलाप जनम्नानुसार जवजनयजमत होंगे, ऄथाात:्-

(i) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै नय ेवाजणजज्यक होटल और ररजॉटा के सजन्नमााण ऄनजु्ञात नहीं होंग:े परंत,ु यह दक संरजक्षत के्षत्र की सीमा से एक दकलोमीटर की दरूी से परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक होटलों और ररजॉटा की स्ट्थापना केवल पूवा पररभाजित और नामजनर्ददष्ट क्षेत्रों में पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए ही ऄनजु्ञात होगा;

(ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पयाटन दक्रयाकलापों या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार कें रीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय के मागादिाक जसद्धांतों के द्वारा तथा राष् रीय ा याघ्र स संरक्षण प्राजधकरण, द्वारा जारी पाररजस्ट्थजतकी–पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देते हुए (समय- समय पर यथा संिोजधत) जारी मागादिाक जसद्धांतों के ऄनुसार होगा;

(iii) अंचजलक महायोजना का ऄनुमोदन दकए जाने तक, पयाटन के जलए जवकास और जवद्यमान पयाटन दक्रयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्ददष्ट संवीक्षा और जनगरानी सजमजत की जसफाररि पर अधाररत संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नए होटल या ररसोटा या वाजणजज्यक स्ट्थापना का संजनमााण ऄनुज्ञात नहीं दकया जायेगा ।

(4) नसैर्वगक जवरासत.- पाररजस्ट्थजतकी संवेदी जोन में महत्वपूणा नैसर्वगक जवरासत के सभी स्ट्थलों जैसे जीन कोि अरजक्षत के्षत्र, िैल जवरचनाएं, जल प्रपातों, झरनों, घाटी मागों, ईपवनों, गुफाए,ं स्ट्थलों, भ्रमण, ऄश्वरोहण, प्रपातों अदद की पहचान की जाएगी और जवरासत संरक्षण योजना अंचजलक महायोजना के भाग के रुप में परररक्षण और संरक्षण के जलए तैयार की जाएगी ।

(5) मानव जनर्वमत जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, जिल्प-तथ्य, ऐजतहाजसक, स्ट्थापत्य, सौंदयापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और ईपक्षेत्रों पहचान और ईनके संरक्षण के जलए जवरासत योजना अंचजलक महायोजना के भाग के रुप में तयैार की जाएगी।

(6) ध् वजन प्रदिूण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदिूण (जवजनयमन और जनयतं्रण) जनयम, 2000 में जनयत ईपबंधों के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदिूण के जनयंत्रण और जनवारण का ऄनुपालन दकया जाएगा।

(7) वाय ुप्रदिूण.- पाररजस्ट्थजतकी संवेदी जोन में, वायु प्रदिूण के जनवारण और जनयंत्रण का वायु (प्रदिूण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया जाएगा।

(8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेदी जोन में ईपचाररत बजहस्राव का जनस्ट्सरण, साधारण मानकों के ईपबंधों के ऄनुसार पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अने वाल ेपयाावरणीय प्रदिूण के जनस्ट्सरण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक कठोर हो, के ईपबंधों के ऄनुसार होगा।

(9) ठोस ऄपजिष्ट.- ठोस ऄपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन में ठोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357(ऄ), तारीख 8 ऄप्रैल, 2016 के द्वारा प्रकाजित ठोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा;

(ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप ठोस ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा।

(10) जैव जचदकत्सा ऄपजिष् ट.- जैव जचदकत्सा ऄपजिष् ट का प्रबंधन जनम्नानुसार दकया जाएगा:- 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन 343 (ऄ), तारीख 28 माचा, 2016, के द्वारा प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा;

(ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप जैव-जचदकत्सा ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा।

(11) प्लाजस्ट्टक ऄपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सा.का.जन 340(ऄ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।

(12) जनमााण और जवध्वसं ऄपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सां.का.जन 317(ऄ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा ।

(13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत द्वारा प्रकाजित इ–ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।

(14) यानीय यातायात.- यातायात की यानीय गजतजवजधयां अवास के ऄनुकूल जवजनयजमत होंगी और आस संबंध में अंचजलक महायोजना में जविेि ईपबंध सजम्मजलत दकए जाएंगे और अंचजलक महायोजना के तैयार होने और राज्य सरकार के सक्षम प्राजधकारी द्वारा ऄनुमोददत होने तक, जनगरानी सजमजत सुसंगत ऄजधजनयमों और ईसके ऄधीन बनाए गए जनयमों और जवजनयमों के ऄनुसार यानीय दक्रयाकलापों के ऄनुपालन को जनगरानी करेगी।

(15) यानीय प्रदिूण.- लाग ूजवजधयों के ऄनपुालन में वाहन प्रदिूण का जनवारण और जनयंत्रण दकया जाएगा और स्ट्वच्छक ईंधन के ईपयोग के जलए प्रयास दकए जाएंगे।

(16) औद्योजगक इकाआया.ं- (i) राजपत्र में आस ऄजधसूचना के प्रकािन पर या ईसके पश्चात ्पाररजस्ट्थजतकी संवेदी जोन के भीतर कोइ नए प्रदजूित ईद्योगों की स्ट्थापना की ऄनजु्ञा नहीं दी जाएगी;

(ii) केन्रीय प्रदिूण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में आस प्रकार जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन के भीतर केवल गैर-प्रदिूणकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि, गैर प्रदिूणकारी ईद्योगों को बढ़ावा ददया जाएगा।

(17) पहाड़ी ढलानों को सरंक्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) अंचजलक महायोजना पहाड़ी ढलानों पर क्षेत्रों का संकेत होगा जहां दकसी भी संजनमााण की ऄनजु्ञा नहीं दी जाएगी;

(ख) कटाव के एक ईच्च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनजु्ञा नहीं दी जाएगी।

4. पाररजस्ट्थजतकी सवंदेी जोन में प्रजतजिद्ध और जवजनयजमत दकए जान ेवाल ेदक्रयाकलापों की सूची.- पाररजस्ट्थजतकी संवेदी जोन में सभी दक्रयाकलाप पयाावरण ऄजधजनयम के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों जजसके ऄन्तगात तटीय जवजनयमन जोन, 2011 और पयाावरणीय समाघात जनधाारण ऄजधसूचना, 2006 और ऄन्य लागू जवजधयों के जजसमें वन (संरक्षण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53) सजम्मजलत हैं और दकय ेगये संिोधनों द्वारा िाजसत होंग ेऔर नीचे दी गइ सारणी में जवजनर्ददष्ट रीजत में जवजनयजमत होंगे, ऄथाात ्:- [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 सारणी क्रम स.ं दक्रयाकलाप वणान क. प्रजतजिद्ध दक्रयाकलाप

1. वाजणजज्यक खनन, पत्थर ईत्खनन और ऄपघिाण आकाआयां । (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर वास्ट्तजवक स्ट्थानीय जनवाजसयों की घरेलू अवश्यकताओं जजसमें मकानों के संजनमााण या मरम्मत के जलए धरती को खोदना सजम्मजलत ह,ै के जसवाय सभी प्रकार के नए और जवद्यमान खनन (लघ ुऔर वृहत खजनज), पत्थर ईत्खनन और ऄपघिाण आकाआयां तत्काल प्रभाव से प्रजतजिद्ध होंगी;

(ख) खनन प्रचालन, 1995 की ररट याजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाद बनाम भारत संघ के मामल े में माननीय ईच्चतम न्यायालय के अदेि 4 ऄगस्ट्त, 2006 और 2012 की ररट याजचका (जसजवल) सं. 435 में गोवा फाईंडेिन बनाम भारत संघ के मामल े में तारीख 21 ऄप्रलै, 2014 के अदिे के ऄनुसरण में होगा ।

2. प्रदिूण (जल, वायु, मृदा, ध्वजन, अदद) ईत्पन करन ेवाल ेईद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेदी जोन में कोइ नया ईद्योग लगान ेऔर वतामान प्रदिूणकारी ईद्योगों का जवस्ट्तार करने की ऄनुज्ञा नहीं होगी:

परन्त ुयह दक केन्रीय प्रदिूण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में ऐसा जवजनर्ददष्ट न हों, पाररजस्ट्थजतकी संवेदी जोन के भीतर गैर- प्रदिूणकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि गैर-प्रदिूणकारी कुटीर ईद्यागों को बढ़ावा ददया जाएगा।

3. बृहत जल जवदु्यत पररयोजना की स्ट्थापना । प्रजतजिद्ध।

4. दकसी पररसंकटमय पदाथा का ईपयोग या ईत्पादन या प्रसंस्ट्करण। प्रजतजिद्ध।

5. प्राकृजतक जल जनकायों या क्षेत्र भूजम में ऄनुपचाररत बजहस्रााव का जनस्ट्सारण । प्रजतजिद्ध।

6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन के भीतर नइ अरा जमलों की स्ट्थापना और जवद्यमान अरा जमलों का जवस्ट् तार ऄनुज्ञात नहीं होगा।

7. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध।

8. जलावन लकड़ी का वाजणजज्यक ईपयोग। प्रजतजिद्ध।

9. वाजणजज्यक संकेत बोडा और होर्डडग का प्रयोग । लाग ूजवजधयों के ऄधीन प्रजतजिद्ध दकया जाएगा। प्रबुद्ध संकेत बोडा और होर्डडग को ग्राम स्ट्थानों और नगरों के ऄंतगात प्रजतजिद्ध दकया जाना चाजहए।

10. नइ काष्ठ अधाररत ईद्योग। पाररजस्ट् थजतक संवेदी जोन की सीमाओं के भीतर नए काष् ठ अधाररत ईद्योग की स्ट् थापना को ऄनुज्ञात नहीं दकया जाएगा :

11. वाजणजज्यक होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पयाटन दक्रयाकलापों लघु ऄस्ट्थायी संरचनाओं के जसवाय संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट ह,ै नए वाजणजज्यक होटल और ररसोटों को ऄनुज्ञात नहीं दकया जाएगा:

परंत ुयह दक संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के परे या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक आनमें से, जो भी जनकट हो सभी नए पयाटन दक्रयाकलाप या जवद्यमान दक्रयाकलाप का जवस्ट्तार पयाटन महायोजना और यथा लाग ू मागादिी जसद्धांतों के ऄनुरुप होगा।

12. संजनमााण दक्रयाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट हो, दकसी भी प्रकार के नय ेवाजणजज्यक संजनमााण की ऄनुज्ञा नहीं होगी:

परंत ु यह दक स्ट्थानीय लोगों को ऄपनी अवास सम्बन्धी जनम्नजलजखत अवश्यकताओं को पूरा करने के जलए, पैरा 3 के ईप पैरा (1) में सूचीबद्ध दक्रयाकलापों सजहत ऄपने ईपयोग के जलए, ऄपनी भूजम में भवन ईप-जवजधयों के ऄनुसार, संजनमााण करन े की ऄनुज्ञा होगी:

परंत ु यह दक गैर–प्रदिूणकारी लघु ईद्योगों से संबंजधत संजनमााण दक्रयाकलाप लागू जनयमों और जवजनयमों, यदद कोइ हों, के ऄनुसार सक्षम प्राजधकारी की पूवा ऄनुमजत से जवजनयजमत दकए जाएंगे और वे न्यूनतम होंगे । (ख) एक दकलोमीटर क्षेत्र से परे ये अंचजलक महायोजना के ऄनुसार जवजनयजमत होंगे ।

13. प्रदिूण ईत्पन्न न करन ेवाले लघु ईद्योग। फरवरी, 2016 में केन्रीय प्रदिूण जनयंत्रण बोडा द्वारा जारी ईद्योगों में वगीकरण के ऄनुसार समय-समय पर यथा संिोजधत गरै- प्रदिूणकारी ईद्योग और ऄपररसंकटमय में, लघ ुऔर सेवा ईद्योग, कृजि, पुष्प कृजि, ईद्यान कृजि या पाररजस्ट्थजतकी संवेदी जोन से देिी सामग्री से ईत्पादों को ईत्पन्न करने वाल े कृजि अधाररत ईद्योग सक्षम प्राजधकारी द्वारा ऄनुज्ञात होंगे।

14. वृक्षों की कटाइ। (क) राज्य सरकार में सक्षम प्राजधकारी की पूवा ऄनुज्ञा के जबना वन, सरकारी या राजस्ट्व या जनजी भूजम पर या वनों में वृक्षों की कटाइ नहीं होगी । (ख) वृक्षों की कटाइ संबंजधत कें रीय या राज्य ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंध के ऄनुसार जवजनयजमत होग े।

15. वन ईत्पादों या गैर काष् ठ वन ईत्पादों का संग्रहण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे । [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 9

16. जवदु्यत और संचार टावरों का पररजनमााण और केबलों के जबछाए जान े और ऄन्य बुजनयादी ढांचे । लागू जवजधयों के ऄधीन जवजनयजमत होंगे भूजमगत केबल के जबछाए जाने को बढ़ावा ददया जा सकेगा।

17. नागररक सुख सुजवधाओं सजहत ऄवसंरचनाएं। न्यूनीकरण ईपायों को लागू जवजधयों, जनयमों और जवजनयमनों और ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाना ।

18. जवद्यमान सड़कों को चौड़ा करना और ईन्हें सुदढृ़ करना तथा नवीन सड़कों का संजनमााण । न्यूनीकरण ईपायों को लाग ूजवजधयों, जनयमों और जवजनयमनों तथा ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाएगा ।

19. पयाटन से संबंजधत ऄन्य दक्रयाकलाप जैसे गमा वायु गुब्बारें, हलेीकाप्टर, ड्रोन, माआक्रोलाआटस, अदद द्वारा पाररजस्ट्थजतकी संवेदी जोन क्षेत्र के उपर से ईड़ना जैसे दक्रयाकलाप करना। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

20. पहाड़ी ढालों और नदी तटों का संरक्षण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

21. राजत्र में याजनक यातायात का संचलन । लाग ू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए जवजनयजमत होंगे ।

22. स्ट्थानीय समुदायों द्वारा चल रही कृजि और बागवानी प्रथाओं के साथ दगु्धिाला, दगु्घ ईद्योग, कृजि और मछली पालन । स्ट्थानीय लोगों के ईपयोग के जलए लाग ूजवजधयों के ऄधीन ऄनुज्ञात होंगे ।

23. प्राकृजतक जल जनकायों या सतही के्षत्र में ईपचाररत बजहस्रााव का जनस्ट्तारण । जल जनकायों में ईपचाररत ऄपजिष्ट जल या बजहस्रााव के जनस्ट्सारण से बचा जाएगा और ईपचाररत ऄपजिष्ट जल के पुन:चक्रण और पुन:ईपयोग के जलए प्रयास दकए जाएंगे। ऄन्यथा लाग ू जवजधयों के ऄनुसार ईपचाररत बजहस्रााव के पुनचाक्रण या प्रवाह के जनवाहन को जवजनयजमत दकया जाएगा।

24. सतही और भूजल का वाजणजज्यक जनष्किाण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

25. फमों, जनगम और कंपजनयों द्वारा बडे़ पैमाने पर वाजणजज्यक पिओुं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीय अवश्यकताओं को परूा करने के जलए लाग ू जवजधयों के ऄधीन जवजनयजमत (ऄन्यथा प्रदान दकए गए) होंगे ।

26. खुले कंुअ, बोर कंुअ, अदद कृजि और ऄन्य ईपयोग के जलए । जवजनयजमत और सम्बद्ध प्राजधकारी द्वारा दक्रयाकलापों की सख्ती से जनगरानी की जाएगी।

27. ठोस ऄपजिष्ट का प्रबन्धन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

28. जवदेिी प्रजाजतयों को लाना । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

29. पाररजस्ट्थजतकी पयाटन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे । 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

30. पोजलथीन बैगों का ईपयोग । पाररजस्ट्थजतकी संवेदी जोन के भीतर पॉजलथीन बैग के ईपयोग की ऄनुमजत होगी:

परन्तु यह जवजिष्ट अवश्यकता के अधार पर लागू जवजधयों के ऄधीन जवजनयजमत होगा ।

31. स्ट्पॉट लाआट और फ्लूडडग लाआट का ईपयोग। सभी जवद्यमान और अगामी संस्ट्थान या ईद्योग या पाररजस्ट्थजतकी– पयाटन सुजवधाएं ऄपन े पररसर में पररवेि प्रकाि व्यवस्ट्था का ईपयोग करेंगी तादक राजत्रचर वन्यजीव को कोइ परेिानी न हो:

परंत ु यह दक अपातकालीन संचालन के मामल े में और जनयजमत पैरोडलग के दौरान वन जवभाग या सरकारी एजेंजसयों या संस्ट्थानों को स्ट्पॉटलाआट्स का ईपयोग करन ेकी ऄनुमजत होगी। आ. सवंर्वधत दक्रयाकलाप

32. विाा जल संचयन। सदक्र य रूप से बढ़ावा ददया जाएगा।

33. जैजवक खेती। सदक्र य रूप से बढ़ावा ददया जाएगा।

34. सभी गजतजवजधयों के जलए हररत प्रौद्योजगकी को ऄंगीकृत करना । सदक्र य रूप से बढ़ावा ददया जाएगा।

35. कुटीर ईद्योगों जजसके ऄंतगात ग्रामीण कारीगर भी हैं। सदक्र य रूप से बढ़ावा ददया जाएगा।

36. नवीकरणीय उजाा और ईंधन का ईपयोग । बायोगैस, सौर प्रकाि, आत् यादद को बढ़ावा ददया जाएगा।

37. कृजि वाजनकी । सदक्र य रूप से बढ़ावा ददया जाएगा।

41. जनम्नीकृत भूजम या वन या वास की बहाली । सदक्र य रूप से बढ़ावा ददया जाएगा।

42. पयाावरणीय जागरुकता । सदक्र य रूप से बढ़ावा ददया जाएगा।

5. मानीटरी सजमजत- कें रीय सरकार, पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 3 की ईपधारा (3) के ऄधीन आस ऄजधसूचना के ईपबंधों की प्रभावी मानीटरी के जलए मानीटरी सजमजत का गठन करती ह,ै जो जनम्नजलजखत से जमलकर बनेगी, ऄथाात:्-

1. जजला कलेक्टर, वधाा ऄध् यक्ष, पदेन;

2. जजला कलेक्टर वधाा के प्रजतजनजध, नागपरु सदस्ट्य;

3. क्षेत्र जनदेिक, बोर बाघ ररज़वा के एक प्रजतजनजध सदस्ट्य;

4. महाराष्ट्र सरकार द्वारा पयाावरण के के्षत्र में (जवरासत संरक्षण सजहत) काम करने वाले गैर-सरकारी संगठनों का प्रजतजनजध सदस्ट्य;

5. क्षेत्रीय कायाालय, महाराष्ट्र राज्य प्रदिूण जनयंत्रण बोडा सदस्ट्य;

7. महाराष्ट्र सरकार के पयाावरण जवभाग का एक प्रजतजनजध सदस्ट्य;

9. राज्य जैव जवजवधता बोडा का एक प्रजतजनजध सदस्ट्य;

10. ईप वन संरक्षक, नागपुर सदस्ट्य;

11. ईप वन संरक्षक, वधाा सदस्ट्य-सजचव

6. जनदेि-जनबधंन.- (1) जनगरानी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन को मानीटरी करेगी।

(2) मानीटरी सजमजत का कायाकाल ऄगल ेअदेि होने तक दकया जाएगा, परंत ुयह दक सजमजत के गैर-सरकारी सदस्ट्यों को समय-समय पर राज्य सरकार द्वारा नामजनर्ददष्ट दकया जाएगा।

(3) ईन दक्रयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ.

1533 (ऄ), तारीख 14 जसतम्बर, 2006 की ऄनुसूची में सजम्मजलत हैं, और जो पाररजस्ट्थजतकी संवेदी जोन में अत ेहैं, जसवाय आसके जो परैा 4 के ऄधीन सारणी में यथा जवजनर्ददष्ट प्रजतजिद्ध दक्रयाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईि ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरण ऄनापजत्त के जलए केरींय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को जनर्ददष्ट दकया जाएगा।

(4) ईन दक्रयाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ. 1533 (ऄ) तारीख 14 जसतंबर, 2006 की ऄनुसूची में सजम्मजलत नहीं ह,ै और जो पाररजस्ट्थजतकी संवेदी जोन में अत ेहैं, जसवाय आसके पैरा 4 के ऄधीन सारणी में यथाजवर्वनष्ट प्रजतजिद्ध दक्रलाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईसे संबंद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया जाएगा।

(5) मानीटरी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायुि ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का ईल्लघंन करता ह,ै पयाावरण ऄजधजनयम की धारा 19 के ऄधीन पररवाद फाआल करन ेके जलए सक्षम होगा।

(6) मानीटरी सजमजत मुद्दा दर मदु्दा के अधार पर ऄपेक्षाओं पर जनभार रहत े हुए संबद्ध जवभागों के प्रजतजनजधयों या जविेिज्ञों, औद्योजगक संगमों या संबद्ध पणधाररयों के प्रजतजनजधयों को ऄपन ेजवचार-जवमिा में सहायता के जलए अमंजत्रत कर सकेगी ।

(7) मानीटरी सजमजत प्रत्येक विा की 31 माचा तक के ऄपने दक्रयाकलापों की वार्विक कारावाइ ररपोटा राज् य के मुख् य वन् यजीव वाडान को ईपाबंध-V में संलग्न प्रोफामाा में ईक् त विा के 30 जून तक प्रस्ट्ततु करेगी ।

(8) केन्रीय सरकार का पयाावरण, वन और जलवाय ुपररवतान मंत्रालय मानीटरी सजमजत को ऄपन ेकृत्यों के प्रभावी जनवाहन के जलए ऐसे जनदेि दे सकेगा, जो वह ठीक समझे ।

7. ऄजतररक् त ईपाय.- आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए कें रीय सरकार और राज् य सरकार, ऄजतररक् त ईपाय, यदद कोइ हों, जवजनर्ददष् ट कर सकेंगी।

8. कोइ ऄन् य महत् वपूणा जविय । [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 21 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 17th January, 2022 S.O. 213(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 565 (E), dated the 5 th February 2021, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 5 th February, 2021;

AND WHEREAS, objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification were duly considered by the Central Government;

AND WHEREAS, Bor Tiger Reserve is spread over an area of 138.11 square kilometers in the Wardha district and is located 40 kilometers away from Wardha district headquarters and 65 kilometers away from Nagpur in the State of Maharashtra;

AND WHEREAS, Government of Maharashtra vide its Gazette notification number WLP.

0114/C.R.26/F-1,dated the 16 th August, 2014; has declared Bor Tiger Reserve (Bor Wildlife Sanctuary, New Bor Wildlife Sanctuary and Extended New Bor Wildlife Sanctuary) under the provisions of section 38 V of the Wildlife (Protection) Act, 1972 (53 of 1972) comprising of the following Sanctuaries in the state of Maharashtra, namely :-

(i) Bor Wildlife Sanctuary (61.10 square kilometre) District Wardha and Nagpur;

(ii) New Bor Wildlife Sanctuary (60.69 square kilometre) District Wardha and Nagpur;

(iii) Extended New Bor Wildlife Sanctuary (16.32 square kilometre) District Wardha and Nagpur;

AND WHEREAS, the State Government of Maharashtra vide its Gazette notification number WLP- 0815/C.R.261/F-1 dated the 04 th December, 2015 declared 678.14 square kilometer as the buffer area of Bor Tiger Reserve (Bor Wildlife Sanctuary, New Bor Wildlife Sanctuary & Extended New Bor Wildlife Sanctuary) under the provisions of section 38 V of Wildlife (Protection), Act, 1972 (53 of 1972);

AND WHEREAS, the Bor Tiger Reserve is known to harbor rich avi-fauna with about 160 species of birds including migratory and water birds and a number of territorial birds of Indian origin are also recorded from the area and the breeding of saras cranes (Antigone antigone) have been recorded from this region and some important birds species recorded from the area are white-rumped vulture (Gyps bengalensis), golden oriole (Oriolus kundoo), brain-fever cuckoo (Hierococcyx varius), paradise fly catcher (Terpsiphone paradise), Egyptian vulture (Neophron percnopterus), red-headed vulture (Sarcogyps calvus), steppe eagle aquila (Aquila nipalensis), Indian spotted eagle (Clanga hastata), river tern sterna (Sterna aurantia), black-headed Ibis (Treskiomis melanocephalus), painted stork (Myesteria leucocephala), woolly necked stork (Ciconia episcopus)etc;

AND WHEREAS, the area has very high floral diversity represented by Southern Tropical Dry Deciduous Forests and the floral species present in the area include kachnar (Bauhinia racemosa), aonla (Phyllanthus emblica), ain (Terminalia tomentosa), Behada (Terminalia bellerica), bel (Aegle marmelos), bistendu (Diospyros montana), chironji (Buchanania lanzan), gular (Ficus glomerata), hirda (Terminalia chebula), kusum (Schleichera oleosa), lendia (Lagerstroemia parviflora), palas (Butea frondosa), salai (Boswellia serrata), shiwan (Gmelina arbórea), surya (Xylia xylocarpa), tendu (Diospyros malanoxylon), tondri (Casearia tomentosa), warang (Kydia calycina), white kuda (Holarrhena anthidysentrica) etc;

AND WHEREAS, the Bor tiger reserve records 30 species of mammals, 26 species of reptiles and many species of amphibian and it also supports important endangered and vulnerable wildlife such as tiger (Panthera tigris), leopard (Panthera pardus), sloth bear (Melursus ursinus), wild dog (Cuon alpines), four horned-antelope (Tetracerus quadricornis), sambar deer (Rusa unicolor)etc;

22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the extremely close vicinity of the above-mentioned Sanctuaries to human habitation and ongoing developmental activities, necessitate the requirement of proper safeguards and control over such activities;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Bor Tiger Reserve which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and

(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of

0.5 kilometer to 26.50 kilometers around the boundary of Bor Tiger Reserve as Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone. –(1) The Eco-sensitive Zone shall be to an extent of

0.5 kilometre to 26.50 kilometre around the boundary of Bor Tiger Reserve and the area of the Ecosensitive zone is 678.14 square kilometres.

(2) The extent and boundary description of the Eco-sensitive Zone is appended as Annexure-I.

(3) Map of Eco-sensitive Zone of Bor Tiger Reserve along with geo-coordinates of prominent locations and land use pattern are appended as Annexure-II A, Annexure-II B, Annexure-II C and Annexure-II D.

(4) List of geo-coordinates of the boundary of Bor Tiger Reserve and its Eco-sensitive zone is appended as Table A and B of Annexure-III.

(5) The list of villages falling in the Eco-sensitive Zone is given in Annexure-IV.

2. Zonal Master Plan for Eco-sensitive Zone. - (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent authority of State.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The buffer zone of the Bor Tiger Reserve shall form part of the Eco-sensitive Zone and the Tiger Conservation Plan shall also be taken into consideration during the preparation at the Zonal Master Plan.

(4) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan, namely:-

(i) Forest and Wildlife;

(ii) Environment;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Municipal;

(viii) Maharashtra State Pollution Control Board.

(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(7) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features.

(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.

(9) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(10) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by the State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities:

Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents, such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given under paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Tourism Master Plan shall be prepared by the Department of Tourism in consultation with the State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Ecosensitive Zone.

(e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the ecotourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.

(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and rules made thereunder or standards stipulated by the State Government whichever is more stringent.

(9) Solid wastes.-Disposal and management of solid wastes shall be as under:-

(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.

(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(10) Bio-medical waste. – Bio medical waste management shall be as under:

(a) The Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28 th March, 2016.

(b) Safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.

(12) Construction and demolition waste management. - The construction and demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.

(13) E-waste. - The E-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be in compliance with applicable laws and efforts shall be made for use of cleaner fuel.

(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes. - The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act, and the rules made there under including the Coastal Regulation Zone,2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S. No. Activity Description A. Prohibited Activities

1. Commercial mining, stone quarrying and crushing units.

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco-Sensitive Zone;

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).

New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:

Provided that, non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.

3. Establishment of major hydroelectric project.

Prohibited.

4. Use or production or processing of any hazardous substance.

Prohibited.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited.

6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited.

8. Commercial use of firewood. Prohibited.

9. Commercial sign boards and hoardings.

Prohibited under applicable laws. Illuminated signboards and hoarding should be prohibited except within gaothans and towns.

10. New Wood based industry. Establishment of new wood based industry shall not be permitted within the limits of Eco-sensitive Zone:

Provided that the existing wood-based industry may continue unless prohibited under any law for the time being in force.

B. Regulated Activities

11. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive Zone [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 27 whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

12. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

13. Small scale non-polluting industries.

Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.

14. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.

15. Collection of Forest Produce or Non-Timber Forest Produce.

Regulated under applicable laws.

16. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated under applicable laws of underground cabling may be promoted.

17. Infrastructure including civic amenities.

Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.

18. Widening and strengthening of existing roads and construction of new roads.

Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.

19. Undertaking other activities related to tourism like over flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

Regulated as per the applicable laws.

20. Protection of Hill Slopes and river banks.

Regulated as per the applicable laws.

21. Movement of vehicular traffic at night.

Regulated for commercial purpose under applicable laws.

22. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

Permitted as per the applicable laws for use of locals.

23. Discharge of treated waste water/effluents in natural water bodies or land area.

The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per the applicable laws.

24. Commercial extraction of surface and ground water.

Regulated under applicable laws.

25. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies.

Regulated (except as otherwise provided) as per applicable laws except for meeting local needs.

26. Open Well, Bore Well, etc. for agriculture or other usage.

Regulated and the activity should be strictly monitored by the appropriate authority.

27. Solid Waste Management. Regulated as per the applicable laws.

28. Introduction of Exotic species. Regulated as per the applicable laws.

29. Eco-tourism. Regulated as per the applicable laws.

30. Use of polythene bags. Use of polythene bags are permitted within the Eco-sensitive Zone:

Provided that, based on specific requirement, it shall be regulated as per the applicable laws.

31. Use of spotlight and floodlighting.

All existing and upcoming institutions or industries or ecotourism facilities shall use ambient lighting in their premises so that the nocturnal wildlife does not get disturbed:

Provided that in the case of emergency operations and during regular patrolling the Forest Department or Government agencies or institutions would be permitted to use spotlights.

C. Promoted Activities

32. Rain water harvesting. Shall be actively promoted.

33. Organic farming. Shall be actively promoted.

34. Adoption of green technology for all activities.

Shall be actively promoted.

35. Cottage industries including village artisans, etc.

Shall be actively promoted.

36. Use of renewable energy and fuels.

Bio-gas, solar light etc. shall be actively promoted.

37. Agro-forestry. Shall be actively promoted.

38. Plantation of horticulture and herbals.

Shall be actively promoted.

5. Monitoring Committee. - For effective monitoring of the provisions of this notification under subsection (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely: - S. 1. District Collector, Wardha Chairman, ex-officio;

2. Representative of District Collector, Nagpur Member;

3. A representative of Field Director, Bor Tiger Reserve Member;

4. A representative of Non-Governmental Organizations working in the field of environment (including heritage conservation) to be nominated by the Government of Maharashtra Member;

5. Regional Officer, Maharashtra State Pollution Control Board Member,

6. Senior Town Planner of the area Member;

7. A representative of the Department of Environment, Government of Maharashtra Member;

8. One Expert in the area of ecology and environment to be nominated by the Government of Maharashtra Member;

9. A representative of State Biodiversity Board Member;

10. Deputy Conservator of Forest, Nagpur Member;

11. Deputy Conservator of Forest, Wardha Member-Secretary.

6. Terms of Reference. – (1)The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma given in Annexure V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7.Additional Measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8.Supreme Court, etc. orders. -The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
