स.ं 1934] नइ ददल्ली, बहृस्ट् पजतवार, जुलाइ 02, 2020/अषाढ़ 11, 1942 No. 1934] NEW DELHI, THURSDAY, JULY 02, 2020/ASADHA 11, 1942 सी.जी.-डी.एल.-अ.-03072020-220342 CG-DL-E-03072020-220342 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] औ , कुद्रेमुख - 135 1900 औ औ ए और कुद्रेमुख राष्ट्रीय ईद्यान के प्रमुख वन प्रकार ( जपयन और सेठ 1968) दजक्षणी पहाडी के िीषा ईष्णकरिबंधीय सदाबहार वनों (1ए/सी3) (िोला), ईष्णकरिबंधीय अद्रा सदाबहार वन (1ए/सी4), पज चम तिीय ऄधा- सदाबहार वन (2ए/सी2), दजक्षण भारतीय अद्रा पणापाती वन (3बी/सी2) और दजक्षण भारतीय ईपोष्णकरिबंधीय पहाडी सवाना (8ए(सी1/डी एस) में वगीकृत दकया गया ह;ै और, कुद्रेमुख राष्ट्रीय ईद्यान के वनस्ट्पजत मलू्य के ऄजतररि कुद्रेमुख राष्ट्रीय ईद्यान के जीवजन्तु मूल्य , कुद्रेमुख भारत और जवश्व में लघ ु वानर (कुद्रेमुख राष्ट्रीय ईद्यान ) का एक बडी जीवसंख्या के जलए बडा कें द्र/अवास बना हुअ ह;ै राष्ट्रीय ईद्यान, जवश्व के सबसे लंबे जवषलैे सांप ककग कोबरा का भी वास ह ैऔर मालाबार तवांग ुकुद्रेमुख का स्ट्थाजनक दलुाभ नर-वानर ह;ै यह राष्ट्रीय ईद्यान अद्रा ईष्णकरिबंधीय सदाबहार वन का प्रजतजनजधत्व ह ैआसमें मुख्य तीन साहारी जैसे- बाघ,तेंदअु और जंगली कुते्त पाए जाते हैं; कुद्रेमुख राष्ट्रीय ईद्यान जीवजंतु जैसे- सरीसृप, ईभयचर और मछजलयों के जलए ईच्च स्ट्तरीय स्ट्थाजनकता रखता ह।ै आस राष्ट्रीय ईद्यान में पाये जान ेवा ऄन्य प्रजाजतयों में एजियाइ हाथी, भारतीय गौर, सांभर जहरण, मुंजक/मुनतजक, जचत्तीदार जहरण, जपसूरी, रीछ, धारीदार लकडबग्घा, कस्ट्तूरी-मृग, जंगली सुऄर, हनंुमान लगंूर, बोनि मकाक, मालाबार जविाल जगलहरी, मोर, पायथन और माला , अदद सजममजलत ह;ै कुद्रेमुख राष्ट्रीय ईद्यान क्षते्र कें द्रीय पज चमी घाि में के जलए गमा स्ट्थान में सबसे गमा स्ट्थान के रुप में जाना जाता है;

और, सभी मूल्यों में से, कुद्रेमुख का पाररजस्ट्थजतक तंत्र सेवा मूल्य बहुत महत्व का ह;ै कुद्रेमुख राष्ट्रीय ईद्यान तुंगा, भाद्रा और नथेरावाथी जैसी मुख्य नददयों के जलए मुख्य स्त्रोत और जलग्रहण ह ैऔर स्ट्व , गुरुपरुा, येन्नेहोल े और सीथानाधी जैसी ऄन्य छोिी नददयों के जलए जल ग्रहण जो स्ट्थानीय लोगों के जलए एकमात्र साधन और क्षेत्रीय ऄथाव्यवस्ट्था में एक भूजमका जनभाती ह;ै कुद्रेमुख दजक्षण भारत में एक ईच्चतम वषाा वृजि (प्रजत वषा 7000 जम. मी. औसत) स्ट्थान ह;ै आसके ऄजतररि, कुद्रमेुख के अद्रा सदाबहार िोला वन एक स्ट्पंज की तरह काया करत े , आस प्रकार पानी की भारी मात्रा भूजमगत ररजवा के रुप में रहती ह ैजो दक साल भर में धीरे-धीरे नददयों में जाती ह ैऔर भौगोजलक दजृि से, राष्ट्रीय ईद्यान क्षेत्र (दजक्षण पज चम मानसून सहायता से) क्षेत्रीय जलवायु पर एक जविाल और स्ट्थायी प्रभाव रखती ह;ै आसके ऄलावा, कुद्रेमुख राष्ट्रीय ईद्यान ईच्चतम स्ट्थायी बायोमास में से एक ह ैजजसे प्रजत हके्िेयर 250-300 िन औसत ऄनुमान लगाया जाता ह ैऔर आसजलए यह एक बृहत ्काबान भूमंडलीय तापन का प्रजतकारक और जलवायु पररवतान के तथ्य के रुप में काया करता ह;ै और, कुद्रेमुख राष्ट्रीय ईद्यान कैलोफ म एपेिालम (होली ), सल्फोरािम ( ), डायोस्ट्पायरोस कैं डो ( ), कैनेरेजनजसस ( ), परजवफ्लोरा ( ), होजपया ( ), स्ट्पथलुता (अर्ककड), गार्ससजनया आंजडका (को म), हायडेनोकापास पेंिेंड्रा ( , , ), ऄटे्ठनअुत े (रिामा ), ;

और, कुद्रेमुख राष्ट्रीय ईद्यान के चारों ओर के क्षेत्र को, जजसका जवस्ट्तार और सीमाए पैरा 1 में जवजनर्कदि हैं, की दजृि सुरजक्षत और संरजक्षत करना और ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों के के प्रचालन और प्रसंस्ट्करण करन े को प्रजतजषद्ध करना अवयक ह;ै ऄतः, , केन्द्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ परठत पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) ( ) की धारा 3 की ईपधारा (1) और ईपधारा (2) के खंड (v) और खंड (xiv) (3) द्वारा प्रदत्त िजियों का प्रयोग करत ेहुए, राज्य जचकमंगलुरू औ ईडुप्पी कुद्रेमुख राष्ट्रीय ईद्यान की सीमा के चारों ओर 0 ( ) 9.60 तक जवस्ट्ताररत क्षेत्र को कुद्रेमुख राष्ट्रीय ईद्यान पाररजस्ट्थजतकी संवेदी जोन (जजसे आस ऄजधसूचना में आसके प चात् पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप में ऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार ह,ै ऄथाात ्:-

1. पाररजस्ट्थजतकी सवंदेी जोन का जवस्ट्तार और सीमाए .-(1) पाररजस्ट्थजतकी संवेदी जोन कुद्रेमुख राष्ट्रीय ईद्यान 0 ( ) ( ने कुद्रेमुख राष्ट्रीय ईद्यान ) 9.60 औ

316.63 ।

(2) कुद्रेमुख राष्ट्रीय ईद्यान और पाररजस्ट्थजतकी संवेदी जोन की सीमा का ईपाबधं-I के रूप में ईपाबद्ध ह।ै

(3) सीमा जववरण और ऄक्षािं और दिेांतर के साथ पाररजस्ट्थजतकी संवेदी जोन के कुद्रेमुख राष्ट्रीय ईद्यान मानजचत्र ईपाबधं-II , ईपाबधं-II , ईपाबधं-II , ईपाबधं-II औ ईपाबधं-IIङ के रूप में ईपाबद्ध ह।ै

(4) पाररजस्ट्थजतकी संवेदी जोन और कुद्रेमुख राष्ट्रीय ईद्यान की सीमा के भू-जनदेिांकों की सूची ईपाबधं-III सारणी क और ख में दी गइ ह।ै

(5) - पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अन ेवाल ेग्रामों, औ सूची ईपाबधं IV , औ ह।ै

2. पाररजस्ट्थजतकी सवंदेी जोन के जलए अचंजलक महायोजना.– (1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोजनों के जलए, राजपत्र में आस ऄजधसूचना के प्रकािन की तारीख से दो वषा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और आस ऄजधसूचना में ददए गए ऄनुबंधों का पालन करत े हुए, राज्य सरकार के सक्षम प्राजधकारी के ऄनुमोदनाथा एक अंचजलक महायोजना बनायेगी।

(2) राज् य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना में जवजनर्कदष् ि दकए गए हों के ऄनुसार तथा सुसंगत कें द्रीय और राज् य जवजधयों के ऄनरुूप तथा कें द्रीय सरकार द्वारा जारी मागादिान, यदद कोइ हों, द्वारा तैयार की जाएगी ।

(3) अंचजलक महायोजना, ईि योजना में पाररजस्ट्थजतकी और पयाावरण संबंधी सरोकारों को समाकजलत करने के जलए राज् य सरकार के जनम्नजलजखत जवभागों के परामिा स ेतैयार की जाएगी, ऄथाात:्-

(i) पयाावरण;

(ii) वन और वन्यजीव;

(iii) िहरी जवकास;

(iv) पयािन;

(v) पाजलका;

(vi) राजस्ट् व;

(vii) कृजष;

(viii) ग्रामीण जवकास

(ix) व्रसचाइ और बाढ़ जनयंत्रण;

(x) पंचायती राज;

(xi) कनाािक राज्य प्रदषूण जनयंत्रण बोडा; औ

(xii) लोक जन मााण जव भाग।

(4) अंचजलक महायोजना ऄनुमोददत जवद्यमान भू-ईपयोग, ऄवसंरचना और दक्रयाकलापों पर कोइ जनबंधन ऄजधरोजपत नहीं करेगी जब तक आस ऄजधसूचना में जवजनर्कदि न हो, तथा अचंजलक महायोजना में सभी ऄवसंरचनाओं और दक्रयाकलापों में जो ऄजधक दक्षता और पाररजस्ट्थजतकी-ऄनकूुल हों का संवधान करेगी ।

(5) अंचजलक महायोजना में ऄनाच्छाददत क्षेत्रों की पुनः बहाली, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मृदा और नमी के संरक्षण, स्ट्थानीय समुदायों की अवयकताओं तथा पाररजस्ट्थजतकी और पयाावरण के ऐसे ऄन्य पहलओुं की व्यवस्ट्था की जाएगी जजन पर ध्यान ददया जाना अवयक ह।ै

(6) अंचजलक महायोजना में सभी जवद्यमान पूजा स्ट् थलों, ग्रामों और िहरी बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजष क्षेत्रों, उपजाउ भूजम, ईद्यानों और ईद्यानों की तरह के हररत क्षेत्रों, ईद्यान कृजष क्षेत्रों, बगीचों, झीलों और ऄन्य जल जनकायों का ऄभ्यंकन करेगी और आस में जवद्यमान और प्रस्ट्ताजवत भू- ईपयोग की जविेषताओं का ब्यौरा देन े वाले ऄनुसमर्सथत मानजचत्र भी ददए जाएंगे।

(7) अंचजलक महायोजना पाररजस्ट्थजतकी संवेदी जोन में जवकास को जवजनयजमत करेगी और सारणी में सूचीबद्ध पैरा-4 में प्रजतजषद्ध और जवजनयजमत दक्रयाकलापों का ऄनुपालन करेगी और स्ट्थानीय समुदायों की जीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी ऄनुकूल जवकास को सुजनजित और ईसकी ऄजभवृजद्ध भी करेगी।

(8) अंचजलक महायोजना, प्रादेजिक जवकास योजना की सह-जवस्ट्तारी होगी ।

(9) आस प्रकार ऄनुमोददत अंचजलक महायोजना आस ऄजधसूचना के ईपबंधों के ऄनुसार मानीिरी के ऄपने कायों को करने के जलए एक संदभा दस्ट्तावेज तैयार करेगी ।

3. राज्य सरकार द्वारा दकए जान ेवाल ेईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करन ेके जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:-

(1) भ-ूईपयोग.– ( ) पाररजस्ट्थजतकी संवेदी जोन में वनों, ईद्यान कृजष क्षेत्रों, कृजष क्षेत्रों, के प्रयोज के जलए जचजन्हत दकए गए पाकों और खुल ेस्ट्थानों का वाजणजज्यक औद्योजगक संबद्ध जवकास दक्रयाकलापों के जलए ईपयोग या संपररवतान नहीं होगा:

परंत ु पाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क) में जवजनर्कदि प्रयोज से जभन्न प्रयोजन के जलए कृजष और ऄन्य भूजम का संपररवतान मानीिरी सजमजत की जसफाररि पर और यथा लाग ूऔर क्षेत्रीय नगर योजना ऄजधजनयम औ केन्द्रीय सरकार या राज्य सरकार के ऄन्य जनयमों तथा जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन से, औ आस ऄजधसूचना के ईपबंधों द्वारा स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवयकताओं को पूरा करन े के जलए ऄनुज्ञात दकया जाएगा, जैसे:-

(i) जवद्यमान सडकों को चौडा करना और ईन्हें सुद ृ करना तथा नइ सडकों का संजनमााण;

(ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;

(iii) प्रदषूण ईत्पन्न न करने वाल ेलघ ुईद्योग;

(iv) कुिीर ईद्योगों जजनके ऄंतगात ग्रामीण ईद्योग भी हैं; सुजवधाजनक भण्डार और स्ट्थानीय सुजवधाए सहायक [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 पाररजस्ट्थजतकी पयािन ह वास सजममजलत ह;ै और

(v) पैरा 4 के ए ए संवर्सधत दक्रयाकलाप:

परंत ु यह और दक नगर योजना ऄजधजनयम और ऄन्य जनयमों और जवजनयमों के औ संजवधान के ऄनचु्छेद 244 तत्समय प्रवृत्त जवजध के ईपबंधों के ऄनुपालन के जबना, जजसके ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता) ऄजधजनयम, 2006 (2007 का 2) भी ह,ै वाजणजज्यक या औ जवकास दक्रयाकलापों के जलए जनजातीय भूजम का ईपयोग ऄनुज्ञात नहीं होगा:

परंत ु यह और भी दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भू-ऄजभलेखों में ईपसंजात कोइ , मानीिरी सजमजत के जवचार प्राप्त करन ेके प चात राज्य सरकार द्वारा प्रत्येक मामल ेमें एक बार की जाएगी और ईि के की सूचना कें द्रीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को दी जाएगी:

परंत ुयह और भी दक संिोधन में आस ईप पैरा के ऄधीन यथा-ईपबंजधत के जसवाय दकसी भी दिा में भू-ईपयोग का पररवतान सजममजलत नहीं होगा;

( ) वनीकरण तथा वास जीणोद्धार दक्रयाकलापों सजहत ऄनप्रयुक् त या ऄनुत् पादक कृजष क्षते्रों में पुन: वनीकरण करने के प्रयास दकए जाएंग।े

(2) प्राकृजतक जल स्रोतों.- अचंजलक महायोजना में सभी प्राकृजतक जल स्रोतों के अवाह क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण और नवीकरण के जलए महायोजना सजम मजलत होगी और राज् य सरकार द्वारा आन क्षेत्रों पर या ईनके जनकि जवकास दक्रयाकलाप प्रजतजषद्ध करन ेके ए ऐसी रीजत से जसद्धांत तैयार दकए जाएगंे ।

(3) पयािन या .- (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयािन दक्रयाकलाप या जवद्यमान पयािन दक्रयाकलापों का जवस्ट्तार पयािन महायोजना के ऄनुसार के जलए होगा। (ख) पयािन महायोजना राज्य पयािन जवभाग द्वारा राज्य पयाावरण और वन जवभाग के परामिा से तैयार होगी। (ग) पयािन महायोजना अंचजलक महायोजना के एक घिक के रूप में होगी। (घ) ए । (ङ) पाररजस्ट्थजतकी पयािन संबंधी दक्रयाकलाप जनम्नानुसार जवजनयजमत होंगे:-

(i) की सीमा से एक दकलोमीिर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकि ह,ै नये वाजणजज्यक होिल और ऄनुज्ञात नहीं होंग:े परंत,ु की सीमा से एक दकलोमीिर की दरूी से परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक होिलों और का स्ट्थाप केवल पूवा पररभाजषत और नामजनर्कदि क्षेत्रों में पयािन महायोजना के ऄनुसार पाररजस्ट्थजतकी पयािन सुजवधाओं के जलए ही ऄनजु्ञात होगा;

(ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर नए पयािन दक्रयाकलापों या जवद्यमान पयािन दक्रयाकलापों का जवस्ट्तार कें द्रीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय के मागादिाक जसद्धांतों के द्वारा तथा राष् रीय ा याघ्र संरक्षण प्राजधकरण, द्वारा जारी – , - औ - ए (समय-समय पर यथा-संिोजधत) मागादिाक जसद्धांतों के ऄनुसार होगा;

(iii) अंचजलक महायोजना का ऄनुमोदन दकए जाने तक, पयािन के जलए जवकास और जवद्यमान पयािन दक्रयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्कदि संवीक्षा और सजमजत की जसफाररि पर अधाररत संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के दकसी नय ेहोिल या या वाजणजज्यक स्ट्थाप का संजनमााण ऄनुज्ञात नहीं दकया जायेगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(4) नसैर्सगक जवरासत.- पाररजस्ट्थजतकी संवेदी जोन में महत्वपूणा नैसर्सगक जवरासत के सभी स्ट्थलों जैसे जीन कोि अरजक्षत के्षत्र, िैल जवरचनाएं, जल प्रपातों, झरनों, घािी मागों, ईपवनों, गुफाए,ं स्ट्थलों, भ्रमण, ऄश्वरोहण, प्रपातों अदद की पहचान की जाएगी और जवरासत संरक्षण योजना अंचजलक महायोजना के भाग के रुप में परररक्षण और संरक्षण के जलए तैयार की जाएगी ।

(5) मानव जनर्समत जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, जिल्प-तथ्य, ऐजतहाजसक, , और सांस्ट्कृजतक महत्व के क्षेत्रों की औ पहचान और ईनके संरक्षण के जलए जवरासत योजना अंचजलक महायोजना के भाग के रुप में तैयार की जाएगी।

(6) ध् वजन प्रदषूण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदषूण (जवजनयमन और जनयंत्रण) जनयम, 2000 में जनयत ईपबंधों के ऄनुसार में पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदषूण के जनयंत्रण औ ए ।

(7) वाय ुप्रदषूण.- पाररजस्ट्थजतकी संवेदी जोन में, वाय ुप्रदषूण के जनवारण और जनयंत्रण का वायु (प्रदषूण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया जाएगा।

(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन में ईपचाररत बजहस्राव का जनस्ट्सारण, साधा मानकों के पयाावरणीय ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अने वाल े पयाावरणीय प्रदषूण के जनस्ट्सारण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक कठोर हो, के ईपबंधों के ऄनुसार होगा।

(9) ठोस ऄपजिि.- ठोस ऄपजिि का जनपिान एवं प्रबंधन जनम्नानुसार दकया जाएगा:- ( ) पाररजस्ट्थजतकी संवेदी जोन में ठोस ऄपजिि का जनपिान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357(ऄ), 8 ऄप्रैल, 2016 प्रकाजित ठोस ऄपजिि प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथों का जनपिान पाररजस्ट्थजतकी संवेदी जोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा;

( ) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों ( ए ए ) का ईपयोग करत ेहुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप ठोस ऄपजिि का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया ।

(10) जवै जचदकत्सा ऄपजिष् ि.- जैव जचदकत्सा ऄपजिष् ि का प्रबंधन जनम्नानुसार दकया जाएगा.- ( ) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिि का जनपिान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन 343 (ऄ), 28 माचा, 2016 प्रकाजित जैव जचदकत्सा ऄपजिि प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा;

( ) पाररजस्ट्थजतकी सं दी जोन में पहचान ेगए प्रौद्योजगदकयों का प्रयोग करत ेहुए जवद्यमान जनयमों और जवजनयमों के ऄनरुूप जैव-जचदकत्सा ऄपजिि का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया ।

(11) प्लाजस्ट्िक ऄपजिि प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्िक ऄपजिि प्रबंध का जनपिान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं. .का.जन 340(ऄ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्िक ऄपजिि प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।

(12) जनमााण और जवध्वसं ऄपजिि प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में संजनमााण और जवध्वंस ऄपजिि प्रबंध का जनपिान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं. .का.जन 317(ऄ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा । [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7

(13) इ–ऄपजिि.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिि प्रबंध का जनपिान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत द्वारा प्रकाजित इ–ऄपजिि प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।

(14) यानीय .- की यानीय गजतजवजधयां अवास के ऄनुकूल जवजनयजमत होंगी और आस संबंध में अंचजलक महायोजना में जविेष ईपबंध दकए जाएंग े और अंचजलक महायोजना के तैयार होने और राज्य सरकार के सक्षम प्राजधकारी द्वारा ऄनुमोददत होने तक, सजमजत औ ए ए जनयमों और जवजनयमों के ऄनुसार यानीय के ऄनुपालन को मानीिर करेगी ।

(15) यानीय प्रदषूण.- लाग ू जवजधयों के वाहन प्रदषूण और जनयंत्रण दकया जाएगा। स्ट्वच्छक ईंधन के ईपयोग के जलए प्रयास दकए जाएंगे।

(16) औद्योजगक इकाआया.ं- (i) चात पाररजस्ट्थजतकी संवेदी जोन के भीतर कोइ नए प्रदजूषत ईद्योगों की स्ट्थापना की ऄनुमजत नहीं दी जाएगी।

(ii) , 2016 , ; - ए औ , ए ।

(17) पहाडी ढलानों को सरंक्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) अंचजलक महायोजना पहाडी ढलानों पर क्षेत्रों का संकेत होगा जहां दकसी भी संजनमााण की ऄनुमजत नहीं दी जाएगी। (ख) किाव के एक ईच्च जडग्री के साथ जवद्यमान खडी पहाडी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनुमजत नहीं दी जाएगी ।

4. पाररजस्ट्थजतकी सवंदेी जोन में प्रजतजषद्ध और जवजनयजमत दकए जान ेवाल ेदक्रयाकलापों की सचूी.- पाररजस्ट्थजतकी संवेदी जोन में सभी दक्रयाकलाप पयाावरण ऄजधजनयम के ईपबंधों और ए ए तिीय जवजनयमन जोन, 2011 और पयाावरणीय समाधान जनधाारण ऄजधसूचना, 2006 और ऄन्य लागू जवजधयां जजसमें वन (संरक्षण) ऄजधजनयम, 1980 (1980 69), भारतीय वन ऄजधजनयम, 1927 (1927 16), वन्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 53) सजममजलत हैं और ईस पर दकये गये संिोधनों द्वारा िाजसत होंग ेऔर नीचे दी गइ सारणी में जवजनर्कदि रीजत में जवजनयजमत होंग,े ऄथाात ्:- सारणी क्रम स.ं

1. वाजणजज्यक खनन, पत्थर ईत्खनन और ऄपघषाण आकाइयां । (क) वास्ट्तजवक स्ट्थानीय जनवाजसयों की घरेल ूअवयकताओं जजसमें जनजी ईपयोग के जलए मकानों के संजनमााण या मरममत के जलए धरती को खोदना और मकान बनान ेके जलए देिी िाआल्स या ईंिों का जनमााण करना भी सजममजलत ह,ै के जसवाय सभी प्रकार के नए और जवद्यमान खनन (लघ ु और वृहत खजनज), पत्थर की खानें और ईनकों तोडन ेकी आकाआयां तत्काल प्रभाव से प्रजतजषद्ध होगी। (ख) खनन प्रचालन, माननीय ईच्चतम न्यायालय की ररि याजचका (जसजवल) सं. 1995 का 202 िी.एन.

गौडाबमान जथरुमूलपाद बनाम भारत संघ के मामल ेमें 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अदेि तारीख 4 ऄगस्ट्त, 2006 और ररि याजचका (सी) सं. 2012 का 435 गोवा फाईंडेिन बनाम भारत संघ के मामले में तारीख 21 ऄप्रलै, 2014 के अदेि के ऄनुसरण में प्रचालन होगा ।

2. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन के भीतर नइ और जवद्यमान अरा जमलों का जवस्ट् तार ऄनजु्ञात नहीं होगा ।

3. प्रदषूण (जल, वायु, मृदा, ध्वजन, अदद) ईत्पन करन ेवाल ेईद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेदी जोन में कोइ नया ईद्योग लगान े और वतामान प्रदषूणकारी ईद्योगों का जवस्ट्तार करने की ऄनजु्ञा नहीं होगी:

4. जलावन लकडी का वाजणजज्यक ईपयोग । लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन् यथा ईपबंजधत के जसवाय) होंगे ।

5. बृहत जल जवद्युत पररयोजना की स्ट्थापना। लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन् यथा ईपबंजधत के जसवाय) होंगे ।

6. दकसी पररसंकिमय पदा का ईपयोग या ईत्पादन या प्रसंस्ट्करण। लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन् यथा ईपबंजधत के जसवाय) होंगे ।

7. प्राकृजतक जल जनकायों या क्षते्र भूजम में ऄनुपचाररत बजहस्रााव का जनस्ट्सारण । लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन् यथा ईपबंजधत के जसवाय) होंगे ।

8. नए काष् ठ अधाररत ईद्योग। पाररजस्ट्थजतक संवेदी जोन की सीमाओं के भीतर नए काष् ठ अधारर त ईद्योगों की स्ट् थापना को ऄनुज्ञात नहीं दक या जाएगा:

परंतु जव द्यमान काष् ठ अधारर त ईद्योग तब तक जारी रह सकें गे।

9. पवन चदक्कयां लगाना । लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन् यथा ईपबंजधत के जसवाय) होंगे ।

10. ईंि भट्टों की स्ट्थापना । लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन् यथा ईपबंजधत के जसवाय) होंगे । . जवजनयजमत दक्रयाकलाप

11. पोजलथीन बैगों का ईपयोग । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

12. वाजणजज्यक होिलों और ररसोिों की स्ट्थापना । पाररजस्ट्थजतकी पयािन दक्रयाकलापों लघु ऄस्ट्थायी संरचनाओं के जसवाय संरजक्षत क्षेत्र की सीमा से एक दकलोमीिर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकि ह,ै नए वाजणजज्यक होिल और को ऄनुज्ञात नहीं दकया जाएगा:

ए सभी नए पयािन दक्रयाकलाप या जवद्यमान दक्रयाकलाप का जवस्ट्तार पयािन महायोजना और यथा-लाग ू [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 9 मागादिी जसद्धांतों के ऄनुरुप होगा।

13. संजनमााण दक्रयाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीिर के भीतर या पाररजस्ट्थजतकी संवेदी जोन तक, आनमें जो भी जनकि हो, दकसी भी प्रकार के नये वाजणजज्यक संजनमााण की ऄनुज्ञा नहीं होगी:

परंत ु स्ट्थानीय लोगों को ऄपनी अवास समबन्धी जनम्नजलजखत अवयकताओं को परूा करन ेके जलए, पैरा 3 के ईप पैरा (1) में सूचीबद्ध दक्रयाकलापों सजहत ऄपने योग के जलए, ऄपनी भूजम में भवन ईप-जवजधयों के ऄनुसार, संजनमााण करने की ऄनुज्ञा होगी, :

गैर–प्रदषूणकारी लघु ईद्योगों से संबंजधत संजनमााण दक्रयाकलाप लाग ूजनयमों और जवजनयमों, यदद कोइ हों, के ऄनुसार सक्षम प्राजधकारी की पूवा ऄनुमजत से जवजनयजमत दकए जाएंगे और वे न्यूनतम होंग े। (ख) एक दकलोमीिर क्षेत्र से ये अंचजलक महायोजना के ऄनुसार जवजनयजमत होंगे ।

14. वृक्षों की किाइ । (क) राज्य सरकार में सक्षम प्राजधकारी की पूवा ऄनुमजत के जबना वन, सरकारी या राजस्ट्व या जनजी भूजम पर वृक्षों की किाइ नहीं होगी । (ख) वृक्षों की किाइ संबंजधत कें द्रीय या राज्य ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंध के ऄनुसार जवजनयजमत होंगे ।

15. सतही और भूजल का वाजणजज्यक ईपयोग एवं जनष्कषाण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

16. जवद्युत और संचार िावरों का पररजनमााण और केबलों के जबछाए जान े और ऄन्य बुजनयादी ढांचे । लाग ू जवजधयों के ऄधीन जवजनयजमत होंग े (भूजमगत केबल के जबछाए जाने को बढ़ावा ददया )।

17. होिलों और लॉज के जवद्यमान पररसरों में बाड लगाना । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

18. जवद्यमान सडकों को चौडा करना और ईन्हें सुद ृ करना तथा नवीन सडकों का संजनमााण । न्यूनीकरण ईपायों , जनय और जवजनयम ईपलब्ध ए ।

19. राजत्र में याजनक यातायात का संचलन । लाग ू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए जवजनयजमत ।

20. जवदेिी प्रजाजतयों को लाना । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

21. पहाडी ढालों और नदी तिों का संरक्षण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

22. प्राकृजतक जल जनकायों या सतही के्षत्र में ईपचाररत बजहस्रााव का रण । बजहस्रााव बचा जाएगा और ईपचाररत ऄपजिि जल के पुन:चक्रण और पुन:ईपयोग के जलए प्रयास दकए जाएंगे। ऄन्यथा लागू जवजधयों के ऄनुसार ईपचाररत बजहस्रााव के पुनचाक्रण/प्रवाह के जनवाहन को जवजनयजमत दकया जाएगा।

23. वाजणजज् यक साआनबोडा और होर्डडग। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

24. प्रदषूण ईत्पन्न न करन ेवाले लघु ईद्योग । फरवरी, 2016 में केन्द्रीय प्रदषूण जनयंत्रण बोडा द्वारा जारी ईद्योगों के वगीकरण के ऄनुसार गैर-प्रदषूणकारी ईद्योग और 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ऄपररसंकि में, लघ ु और सेवा ईद्योग, कृजष, पुष्प कृजष, ईद्यान कृजष या पाररजस्ट्थजतकी संवेदी जोन से देिी सामग्री से ईत्पादों को ईत्पन्न करने वाले कृजष अधाररत ईद्योग सक्षम प्राजधकारी द्वारा ऄनुज्ञात होंगे।

25. वन ईत्पादों गरै काष् ठ वन ईत्पादों का संग्रहण। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

26. वायु और याजनक प्रदषूण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

27. कृजष प्रणाजलयों में अमूल पररवतान । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

28. नागररक सुख सुजवधाओं सजहत ए । न्यूनीकरण ईपायों को लागू जवजधयों, जनयमों और जवजनयमनों और ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाना ।

29. पयािन से संबंजधत ऄन्य दक्रयाकलाप जैसे गमा वायु गबु्बारें, हलेीकाप्िर, ड्रोन, माआक्रोलाआिस, अदद द्वारा पाररजस्ट्थजतकी संवेदी जोन क्षेत्र के उपर से ईडना जैसे दक्रयाकलाप करना। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

30. स्ट्थानीय समुदायों द्वारा चल रही कृजष और बागवानी प्रथाओं के साथ िाला, दगु्घ ईद्योग, कृजष और मछली पालन । स्ट्थानीय लोगों के ईपयोग के जलए लागू जवजधयों के ऄधीन ऄनुज्ञात ।

31. फ , कारपोरेि और कंपजनयों द्वारा बडे पैमाने पर वाजणजज्यक पिओुं और पोल्री फामों की स्ट्थापना । लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

32. ठोस ऄपजिि का प्रबन्धन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे ।

33. पाररजस्ट्थजतकी पयािन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होंगे । . सवंर्सधत दक्रयाकलाप

34. वषाा जल संचयन । सदक्र य रूप से बढ़ावा ददया जाएगा ।

35. जैजवक खेती। सदक्र य रूप से बढ़ावा ददया जाएगा ।

36. सभी गजतजवजधयों के जलए हररत प्रौद्योजगकी को ग्रहण करना । सदक्र य रूप से बढ़ावा ददया जाएगा ।

37. कुिीर ईद्योगों जजसके ऄंतगात ग्रामीण कारीगर भी हैं। सदक्र य रूप से बढ़ावा ददया जाएगा ।

38. नवीकरणीय उजाा और ईंधन का ईपयोग। बायोगैस, सौर प्रकाि, आत् यादद को बढ़ावा ददया जाना ह ै।

39. कृजष वाजनकी । सदक्र य रूप से बढ़ावा ददया जाएगा ।

40. बागान लगाना और जडी बूरियों का रोपण । सदक्र य रूप से बढ़ावा ददया जाएगा ।

41. पाररजस्ट्थजतकी ऄनुकूल पररवहन का ईपयोग । सदक्र य रूप से बढ़ावा ददया जाएगा ।

42. कौिल जवकास । सदक्र य रूप से बढ़ावा ददया जाएगा ।

43. जनम्नीकृत भूजम/ वन / वास की बहाली । सदक्र य रूप से बढ़ावा ददया जाएगा ।

5. ए मानीिरी सजमजत- कें द्रीय सरकार, पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 3 की ईपधारा (3) ए मानीिरी सजमजत करती ह,ै जो जनम्नजलजखत से जमलकर बनगेी :- . . नाम

(i) क्षेत्रीय अयुि, मैसूर ऄध्यक्ष, ;

(ii) पयाावरण जवभाग, कनाािक सरकार के प्रजतजनजध सदस्ट्य;

(iii) कनाािक सरकार के िहरी जवकास जवभाग के प्रजतजनजध सदस्ट्य;

(iv) कनाािक राज्य प्रदषूण जनयंत्रण बोडा के प्रजतजनजध सदस्ट्य;

(v) प्रत्येक मामले में एक वषा की ऄवजध के जलए कनाािक सरकार द्वारा पयाावरण के के्षत्र में काम करन ेवाले गरै-सरकारी संगठन का एक प्रजतजनजध सदस्ट्य;

(vi) प्रत्येक मामले में एक वषा की ऄवजध के जलए कनाािक सरकार द्वारा पाररजस्ट्थजतकी और पयाावरण के के्षत्र में एक नामजनर्कदष् ि जविेषज्ञ सदस्ट्य;

(vii) ईपायुि या ईनके प्रजतजनजध, जचकमंगलरूु सदस्ट्य;

(viii) ईपायुि या ईनके प्रजतजनजध, ईडुपी सदस्ट्य;

(ix) ईपायुि या ईनके प्रजतजनजध, दजक्षण कन्नड सदस्ट्य;

(x) मु गेरे जनवााचन के्षत्र से जवधान सभा के सदस्ट्य सदस्ट्य; *

(xi) करकला जनवााचन के्षत्र से जवधान सभा के सदस्ट्य सदस्ट्य; *

(xii) जनवााचन के्षत्र से जवधान सभा के सदस्ट्य; सदस्ट्य; *

(xiii) जनवााचन के्षत्र से जवधान सभा के सदस्ट्य सदस्ट्य; *

(xiv) ईप वन संरक्षक, कुद्रेमुख वन्यजीव प्रभाग, करकला सदस्ट्य- सजचव। * (आस िता के ऄधीन रहत ेहुए दक कनाािक राज् य सरकार ऄन् य बातों के साथ सुसंगत ऄनुमोदन, जजसके ऄंतगात कनाािक जवधान सभा के सभापजत की ऄनुज्ञा भी ह,ै यदद ऄपेजक्षत हो, ऄजभप्राप् त करेगी) ।

6. जनदिे जनबधंन:- (1) मानीिरी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन की मानीिरी करेगी।

(2) मानीिरी सजमजत का कायाकाल तीन वषा तक या राज्य सरकार द्वारा नइ सजमजत का पुनगाठन दकए जाने तक होगा और तत्पिात् मानीिरी सजमजत राज्य सरकार द्वारा गरठत की जाएगी।

(4) ईन दक्रयाकलापों की, जो भारत के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ.1533(ऄ), तारीख 14 जसतंबर, 2006 की ऄनुसूची में सजममजलत नहीं ह,ै और जो पाररजस्ट्थजतकी संवेदी जोन में अत ेहैं, जसवाय आसके पैरा 4 के ऄधीन सारणी में यथाजवजनर्कदि प्रजतजषद्ध दक्रयाकलापों के, मानीिरी सजमजत द्वारा वास्ट्तजवक जवजनर्कदि स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईसे संबंद्ध जवजनयामक प्राजधकरणों को जनर्कदि दकया जाएगा।

(5) मानीिरी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायुक् त या संबंजधत ईपायुि ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का ईल्लघंन करता ह,ै पयाावरण (संरक्षण) ऄजधजनयम, की धारा 19 के ऄधीन पररवाद दायर करन ेके जलए सक्षम होगा।

(6) मानीिरी सजमजत मुद्दा दर मुद्दा के अधार पर ऄपके्षाओं पर जनभार रहत े हुए संबद्ध जवभागों के प्रजतजनजधयों या जविेषज्ञों, औद्योजगक संगमों या संबद्ध पणधाररयों के प्रजतजनजधयों को, ऄपन ेजवचार-जवमिा में सहायता के जलए अमंजत्रत कर सकेगी ।

(7) मानीिरी सजमजत प्रत्येक वषा की 31 माचा तक के ऄपन े दक्रयाकलापों की वार्सषक कारावाइ ररपोिा राज्य के मखु्य वन्यजीव वाडान को, ईपाबधं-V में संलग्न प्रपत्र के ऄनुसार, ईस वषा की 30 जून तक प्रस्ट्तुत करेगी ।

(8) केन्द्रीय सरकार का पयाावरण, वन और जलवाय ुपररवतान मंत्रालय मानीिरी सजमजत को ईसके कृत्यों के प्रभावी जनवाहन के जलए ऐसे जनदेि दे सकेगा जो वह ईजचत समझे ।

8. कोइ ऄन् य महत् वपूणा मामला । 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 2nd July, 2020 S.O. 2188(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O.

3859 (E), dated the 25 th October, 2019, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 25 th October, 2019;

AND WHEREAS, objections and suggestions were received from persons and stakeholders in response to the aforesaid draft notification and were duly considered by the Central Government;

AND WHEREAS, Kudremukh National Park lies between the 13 0 01’ to 13 0 29’ North Latitude and 75 0 01’ to 75 0 25’ East Longitude and spread over an area of 600.57 square kilometers; and the National Park is located at the tri-junction of Chikkamagaluru, Dakshina Kannada and Udupi districts in the State of Karnataka and at the middle of Central Western Ghats (the stretch between Goa and Nilgiris), remains part of one of the 34 bio-diversity hotspots of the world and became signpost of tropical biological richness;

AND WHEREAS, the National Park is a unique landscape of low elevation wet evergreen forests and Shola-Grassland Biome in the entire stretch of the Western Ghats;

AND WHEREAS, Kudremukh landscape represents a wide range of altitudes from 135 meters mean sea level to uplands 1900 meters mean sea level and accordingly has a wide range of vegetation and attendant fauna and the major forest types of Kudremukh National Park is classified under (Champion & Seth 1968): the southern hill top tropical evergreen forests (1A/C3) [Sholas], Tropical wet evergreen forests (1A/C4), West coast semi-evergreen forests (2A/C2), South Indian Moist Deciduous Forests (3B/C2) & South Indian subtropical hill savanna (8A (C 1/DS);

AND WHEREAS, apart from the floral value of Kudremukh National Park, the faunal values of Kudremukh National Park is of critical importance, Kudremukh is the largest remaining home/habitat for the single largest population of the lion tailed macaques (a flagship species of Kudremukh National Park) in India and world;

the National Park is also home for King Cobra, the longest venomous snake in the world and Malabar Slender Loris a rare primate endemic to Kudremukh; the National Park is a representative of Tropical wet evergreen forest holding the assemblage of three top carnivores like tiger, leopard and wild dogs; Kudremukh National Park holds high degree of endemism for faunal groups like reptiles, amphibians and fishes. Insects represent the most diverse faunal species followed by birds inside the National Park area; other important fauna occurring in this National Park include Asiatic elephant, Indian gaur, sambar deer, barking deer/muntjac, spotted deer, mouse deer, sloth bear, striped hyena, chevrotain, wild pig, hanuman langur, bonnet macaque, Malabar giant squirrel, peacock, python and Malabar civet cat etc.; Kudremukh National Park is considered as a hottest hotspot for orchids in central Western Ghats;

AND WHEREAS, among its values, the ecosystem services provided by Kudremukh National Park is of great importance; Kudremukh National Park is the fountain head and catchment for major rivers like Tunga, Bhadra and Nethravathi and also catchments for other minor rivers like Swarna, Gurupura, Yennehole and Seethanadhi, forming the lifeline of three districts and plays a vital role in the regional economy; Kudremukh receives one of the highest rainfalls in South India (average of 7000 mm per year), further, the wet evergreen shola forest of Kudremukh act like a sponge, thus huge quantity of water is held as underground reserve and the same is released slowly into rivers throughout the year; geographically, the National Park area holds a vast and enduring effect on the regional climate (by aiding the SW Monsoon), further, Kudremukh National Park holds one of the highest standing biomass estimated at an average of 250-300 tons per hectare and therefore, acts as one of the great carbon sinks, an antidote to global warming and climate change;

AND WHEREAS, the major floral species recorded from the Kudremukh National Park includes Calophyllum apetalum (holi honne), Cinnamomum sulphuratum (dalchini), Diospyros candollena (kari mara), Hopea canarensis (malai haiga), Hopea parviflora (kiral bogi), Hopea ponga (doddele bogi), Vanda spathulata [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 29 (orchid), Garcinia indica (kokum), Hydnocarpus pentandra (chalmogra yenne mara, mirolhakai, durti), Knema attenuate (Raktamara), etc;

AND WHEREAS, as per the International Union for Conservation of Nature and Natural Resources (IUCN) some of the species which fall under category of Critically Endangered, Endangered, Vulnerable, Near Threatened are found in Kudremukh National Park includes mammals such as Panthera tigris (tiger), Panthera pardus (common leopard), Prionailurus rubiginosus (rusty spotted cat), Viverra civettina (Malabar civet), Melursus ursinus (sloth bear), Elephas maximus (Asian elephant), Bos gaurus (gaur), Cervus unicolor (sambar), Petinomys uscocapillus (small Travancore flying squirrel), Ratufa indica (Indian giant squirrel), Manis Crassicaudata (Indian pangolin), Platacanthomys lasiurus (Malabar spiny dormouse), Lutra lutra (common otter), Anoxy Cinerea (claw less otter), etc;

AND WHEREAS, important birds, reptiles, amphibians and butterflies found in the National Park includes Anthracoceros coronaatus (Malabar pied hornbill), Buceros bicornis (great hornbill), Ichthyophaga ichthyaetus (gray headed fish eagle), Anhinga melanogaster (darter), Ciconia episcopus (woolly –necked stork), Ficedula nigrorufa (black and orange flycatcher), Eumyias albicaudata (Nilgiri fly catcher), Indotestudo foresteni (tortoise), Geochelone elegans (Indian flap shell turtle), Crocodylus palustris (crocodiles), Naja Naja (spectacled cobra), Ophiophagus Hannah (king cobra), Ansonia ornate (Malabar torrent toad), Bufo beddomii (Beddomi’s toad), Ramanella montana (Jerdon's narrow-mouthed frog), Indirana leithii (Leith's leaping frog or Matheran Indian frog), Limnonectes limochaIrs ( Indian cricket frog), Micrixalus saxicolus (Malabar tropical frog), Nyctibatrachus deccanensis (Deccan night frog, Deccan wrinkled frog), Nyctibatrachus major (Malabar night frog), Nyctibatrachus sancti palustris (coorg night frog or sacred swamp wrinkled frog), Rana aurantiaca (Trivandrum frog, the common wood frog), Rana temporalis (bronzed frog or Gunther’s golden-backed frog), Tomoptema rufescens (Rufescent Burrowing frog), Idea malbarica (Malabar tree nymph), etc;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1, around the protected area of the Kudremukh National Park as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 (zero) to 9.60 kilometres around the boundary of Kudremukh National Park, in Chikkamagaluru, Dakshina Kannada and Udupi districts in the State of Karnataka as the Kudremukh National Park Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: -

1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 0 (zero) to 9.60 kilometres around the boundary of Kudremukh National Park and the area of the Ecosensitive Zone is 316.63 square kilometres, (zero extent of Eco-sensitive Zone in the northern side of the Kudremukh National Park is due to adjoining of Someshwara Wildlife Sanctuary).

(2) The boundary description of Kudremukh National Park and its Eco-sensitive Zone is appended in Annexure-I.

(3) The maps of the Kudremukh National Park demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC, Annexure-IID and Annexure-IIE.

(4) List of geo-coordinates of the boundary of Kudremukh National Park and Eco-sensitive Zone are given in Table A and Table B of Annexure III.

(5) The list of enclave villages, villages falling in the proposed Eco-sensitive Zone and area of reserved forest along with their geo co-ordinates at prominent points is appended as Table A, Table B and Table C of Annexure-IV.

2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication 30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Urban Development;

(iv) Tourism;

(v) Municipal;

(vi) Revenue;

(vii) Agriculture;

(viii) Rural Development;

(ix) Irrigation and Flood Control;

(x) Panchayati Raj;

(xi) Karnataka State Pollution Control Board; and

(xii) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purpose other than that specified at clause (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State the Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Ecosensitive Zone.

(e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the ecotourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government, whichever is more stringent.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-

(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Ecosensitive Zone.

(10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:-

(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28 th March, 2016.

(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Ecosensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.

(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.

(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.

(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State [भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 33 Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for personal consumption;

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N.

Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

2. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

3. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).

New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:

Provided that non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted.

4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.

5. Establishment of major hydro-electric Prohibited (except as otherwise provided) as per the 34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] S. No.

10. Setting up of brick kilns. Prohibited (except as otherwise provided) as per the applicable laws.

B. Regulated Activities

11. Use of polythene bags. Regulated as per the applicable laws.

12. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for ecotourism activities:

Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

13. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:

Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

14. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

15. Commercial extraction of surface and ground water.

Regulated as per the applicable laws.

16. Erection of electrical and communication towers and laying of cables and other Regulated under applicable laws (underground cabling may be promoted).

The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water.

Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.

24. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the competent Authority.

25. Collection of Forest produce or Non- Timber Forest produce.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification, under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- Sl. 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Monitoring Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. Supreme Court, etc orders. - The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.

Further it moves along the Kaopali stream towards South East direction and joins Someshwara Reserve Forest boundary. Further the Eco-Sensitive Zone boundary continues along the Someshwara Reserve Forest boundary towards South East andagain join the Kudremukh National Park boundary line at Durga. Further it moves along the Kudremukh National Park boundary in South easterly and then North easterly direction till it reaches the Northern tip of Narasimha Parvatha State Forest. Then it joins to peak point 767 near Kote. The Eco-Sensitive Zone boundary line merges with the Eastern Eco- Sensitive Zone boundary line of Someshwara Wildlife Sanctuary.

East:- Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Narasimha Parvatha State Forest in the village Hasanabalu in South Easterly direction and reaches the peak point 741 near Hasanabalu it cuts the Bailubaru stream and then cuts across the Hasanabalu Kigga road at Hasanabalu and cuts the Masagi village boundary near Harahari stream. Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Narasimha Parvatha State Forest in the village Masagi towards South East and East and joins the Migga village boundary near Malathi stream. Further the Eco- Sensitive Zone boundary runs along the 1 Km parallel line to Narasimha Parvatha SF in the village Migga towards South and cut the Malathi stream and further it moves towards the South East and joins the Markal village boundary near tri junction of Hasanabalu Kigga road and Malathi stream. Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Narasimha Parvatha State Forest in Markal Village and moves towards South East and cuts the Magodu stream. Further moving East along the stream and then South passing near peak point 862 near Kigga and joins the Yadalli village boundary near Hulgarbail. Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Narasimha Parvatha State Forest in the village Hulgar bail towards South and cuts the Nalini stream and then it moves towards East and South East and cuts the Thunga river near Sunkadamakki and joins the Nemmar village boundary near Maruvinakombe. Further it moves towards South along the road and joins the Heruru village boundary. Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Thungabadra State Forest in the village Heruru and reaches the Puttagodu village boundary. Further Eco-Sensitive Zone line moves along the ridge of peak point 1044 and joins the Sringeri Taluk boundary near Hagalgangi. Further it moves along the taluk boundary and along the streams North east to the peak point 943 it joins the road near Harasige of Haralvani village. Further the line travels along the road towards South Easterly in the Haralvai village up to Golugodu stream and joins the Meguru village boundary. Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Thungabadra State Forest in the village of Meguru and joins the Bhairadevaru village boundary. Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Thungabadra SF in the village Bhairadevaru upto the Balekodige Attikodige road near Balekodige. Futher the line traverses along the road up to Bilalkoppa dispensary and joins Attikodige village boundary. Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Thungabadra State Forest in the village in Attikodige and joins the Cowanhalla coffee estate road. Further it moves towards East and South along the road along the boundary of Cownahalla coffee estate. Further it moves South west along the forest village boundary below peakpoint 1406 and 1207 and joins the Horanadu stream.

Further the Eco-Sensitive Zone boundary runs parallel to Thungabadra Sate Forest boundary towards West and Southerly in the villages Horanadu, Mavinakere, Kalkodu and it meets the Bhadra river which separate Kalkodu and Samse village.Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to South Bhadra State Forest in the village Samse towards South and easterly crossing Katnipal Hamlet, crossing Samse hole and State Highway no.66, crossing Hosanala coffee estate and reaches the cart road inside Samse tea estate in the village Samse and then reaches the Kalasa village boundary. Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Naravi Reserve Forest in the village Kalasa and Marasanige village towards easterly crossing Horemakki, Aggalgudda. And reaches the Balgi village. Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Naravi Reserve Forestin the village Balgi crossing Maltikhan coffee estate, Hulikhan coffee estate and reaches a cart road inside Hulikhan coffee estate and reaches Durgadalli village boundary. Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Naravi Reserve Forestin the village Durgadahalli crossing Horikhan coffee estate labourers lines and touches Balur State Forest.

South:- Then the line traverses along the Balur State Forest boundary towards East and then connects the Charmadi road and then moves along the Charmadi Ghat road towards South West and connects with the Charamdi Kanapadi Reserve Forest boundary near Nadumane. Further it moves along the Charmadi Kanapadi Reserve Forest boundary towards North, South West, and turns Northerly it reaches the Bandaje stream at Allandadka. Further it moves along the stream and reaches the Bandage Malavathige road near Hosabettu. Then it moves towards North along the road and sub stream and reaches the tri junction of Mitthabagilu and Bangadi Pete road at Kellur. Further it moves towards South along the road upto Bangadi Pete. Further the Eco-Sensitive Zone boundary runs along the 1 Km parallel line to Naravi Reserve Forestin the village Nadabettu towards South and joins the Indabettu Mura road and reaches the tri junction of Surlodi Paranadka roads at Mura further it moves along the road towards North West and reaches the stream near Idiyalugudda.
