और, उ. राजप", क# �ितयां जनता को तारीख 6 िसत$बर, 2017 को उपल3ध करा दी गई थ9; और, उ. �ा�प अिधसचूना के �:यु;र म' -ि.य/ और पणधा�रय/ से कोई आ6ेप और सुझाव �ा< नह9 �कए गए; और, िखजा�दया प6ी अभयार=य गुजरात रा>य के क?छ क# खाड़ी के दि6णी तट पर जामनगर िजले म' 22°32’ उ, 70° 08’ पू म' िAथत एक अनूठी भूिमगत पया�वरण--वAथा ह;ै अभयार=य म' दो ताजे पानी क# झील' (उBार बांध) 0.0605 वग� �कलोमीटर के कुल 6े"फल म' ह;ै यह 6े" दोन/ खंड/ म' एक पF# मातृभिूम बांध क# खाड़ी से अलग ह;ै दोन/ झील' परAपर स$बिGधत नह9 ह ैHय/�क वे एक-दसूरे से थोड़ा दरू हI; चूं�क ये झील क?छ समJुी राKीय उLान और अभयार=य क# खाड़ी से सटे हI, इस 6े" म' सूMम और मैOो जीवजGतु और वनAपितय/ के मीठे पानी, समुJी और एAटुअरीन �जाित पाए जाते हI, जो इस 6े" म' 250 से >यादा �जाित पि6य/ और अभयार=य म' कई अGय �ादिेशक जीव/ को आकPष�त करते हI; और, िखजा�दया प6ी अभयार=य के चार/ ओर के 6े" को, िजसका िवAतार और सीमाएं इस अिधसूचना के पैरा 1 म' िविनgद�S हI, पया�वरण क# दिृS से पा�रिAथितक# संवेदी जोन के Xप म' सुरि6त और संरि6त करना तथा आवासीय �बंधन &ारा आनुवंिशक संसाधन/ के सुधार एवं सरं6ण Aथानीय �जाितय/ को पुन: �वेश और उनका पुनवा�स करने के उदेi्य से; पया�वरणीय िश6ा और पा�रिAथितक# अनुसंधान को बढ़ावा दकेर उ. पा�रिAथितक# संवेदी जोन म' उLोग/ और उLोग/ क# lेिणय/ और उनके �चालन तथा �संAकरण/ को �ितिषB करके पा�रिAथितक# और पया�वरणीय दिृS से िखजा�दया प6ी अभयार=य के संरि6त 6े" के आसपास के 6े" को पा�रिAथितक# संवेदी जोन के Xप म' सरंि6त और सुरि6त करना आवiयक ह;ै अतः, अब, केGJीय सरकार, पया�वरण (संर6ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प�ठत पया�वरण (सरं6ण) अिधिनयम, 1986 (1986 का 29) क# धारा 3 क# उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप धारा (3) &ारा �द; शि.य/ का �योग करते mए, गुजरात रा>य म' िखजा�दया प6ी अभयार=य क# सीमा से एक �कलोमीटर तक के िवA ता�रत 6े" को िखजा�दया प6ी अभयार=य पा�रिAथितक# संवेदी जोन (िजसे इसम' इसके पi चात् पा�रिAथितक# संवेदी जोन कहा गया ह)ै के Xप म' अिधसूिचत करती ह,ै िजसके 3यौरे िनpानुसार ह,ै अथा�त् :— ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 1. पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर उसक�उसक�उसक�उसक� सीमाएंसीमाएंसीमाएंसीमाएं.—(1) पा�रिAथितक# सवेंदी जोन, िखजा�दया प6ी अभयार=य क# सीमा स ेएक �कलोमीटर तक के िवAतार के साथ 16.6119 वग� �कलोमीटर के प�रिध 6े" का होगा | (2) िखजा�दया प6ी अभयार=य का सीमा िववरण और इसका पा�रिAथितक# संवेदी जोन उपाबंधउपाबंधउपाबंधउपाबंध IIII म' �दया गया ह ै| (3) अ6ांश और दशेाGतर के साथ पा�रिAथितक# संवेदी जोन का मानिच " और सीमा िववरण उपाबंधउपाबंधउपाबंधउपाबंध IIIIIIIIक,क,क,क, उपाबंधउपाबंधउपाबंधउपाबंध IIIIIIIIख ख ख ख और उपाबंधउपाबंधउपाबंधउपाबंध IIIIIIIIगगगग के Xप म' संलq है । (4) िखजा�दया प6ी अभयार=य और इसके पा�रिAथितक# संवेदी जोन के भ-ूिनदrशांक सारणी ख और सारणी ख म' उपाबंधउपाबंधउपाबंधउपाबंध IIIIIIIIIIII के Xप म' �दया गया है । (5) पा�रिAथितक# संवेदी जोन म' आने वाले पांच Rाम/ क# सूची उपाबंधउपाबंधउपाबंधउपाबंध IVIVIVIV के Xप म' सलंq ह ै| 2222.... पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आंचिलकआंचिलकआंचिलकआंचिलक महायोजनामहायोजनामहायोजनामहायोजना –––– (1) रा>य सरकार, पा�रिAथितक# संवेदी जोन के �योजन/ के िलए राजप" म' इस अंितम अिधसूचना के अिंतम �काशन क# तारीख से दो वष� क# अविध के भीतर, Aथानीय -ि.य/ के परामश� से, और इस अिधसूचना म' �दए गए अनुबधं/ का पालन करते mए आंचिलक महायोजना तैयार करेगी । (2) आचंिलक महायोजना का अनुमोदन रा>य सरकार म' स6म �ािधकारी &ारा �कया जाएगा | (3) पा�रिAथितक# संवेदी जोन के िलए आंचिलक महायोजना रा>य सरकार &ारा ऐसी रीित जैसा इस अिधसूचना म' िविनgद�S ह ैऔर ससंुगत केGJीय और रा>य िविधय/ तथा केGJीय सरकार &ारा जारी माग�दश�क िसBांत/, य�द कोई हो, के अनुXप भी तैयार क# जाएगी | (4) आंचिलक महायोजना िनpिलिखत रा>य िव भाग/ के साथ परामश� से पया�वरणीय और पा�रिAथितक# िवचारण/ को उसम' एक#कृत करने के िलए तैयार क# जाएगी, अथा�त्:—
(i) पया�वरण;
(ii) वन और वGयजीव;
(iii) कृिष ;
(iv) राजA व;
(v) नगर िवकास;
(vi) पय�टन;
(vii) Rामीण िवकास;
(viii) cसंचाई और बाढ़ िनयं"ण;
(ix) नगरपािलका;
(x) पंचायती राज; और
(xi) लोक िन मा�ण िव भाग। (5) आंचिलक महायोजना अनुमो�दत िवLमान भ-ूउपयोग, अवसंरचना: मक और �Oयाकलाप/ पर कोई िनबuधन अिधरोिपत नह9 करेगी जब तक �क इस अिधसूचना म' इस �कार िविनgद�S न हो और आंचिलक महायोजना सभी अवसंरचना और �Oयाकलाप/ म' द6ता और पा�रिAथितक# अनुकूलता का संवB�न करेगी। (6) आंचिलक महायोजना म' अना?छा�दत 6े"/ के जीणvBार, िवLमान जल िनकाय/ के संर6ण, आवाह 6े"/ के �बंधन, जल-संभर/ के �बंधन, भूतल जल के �बंधन, मृदा और नमी संर6ण, Aथानीय समुदाय/ क# आवiयकताw तथा पा�रिAथितक# और पया�वरण से संबंिधत ऐस ेअGय पहलूw, िजन पर xयान दनेा आवiयक ह,ै के िलए उपबंध ह/गे । (7) आंचिलक महायोजना सभी िवLमान पूजा A थल/, Rाम/ और नगरीय बंदोबAत/, वन/ के �कार और �कA म/, कृिष 6े"/, ऊपजाऊ भिूम, ह�रत 6े" जैसे उLान और उसी �कार के A थान, उLान कृिष 6े", फलोउLान, झील/ और अGय जल 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िनकाय/ का अzयकंन करेगी और इस योजना के मानिच" के साथ िवLमान और �Aतािवत भिूम उपयोग िवशेषताw का िववरण संलq होगा । (8) आंचिलक महायोजना पा�रिAथितक# संवेदी जोन म' िवकास को िविनयिमत करेगी और पैरा 4 क# सारणी म' सूचीबB �ितिषB, िविनयिमत �Oयाकलाप/ का अनुसरण करेगी और साथ ही Aथानीय समुदाय/ क# जीिवका सुर6ा के िलए पा�रिAथितक# अनुकूल िवकास को सुिनि|त तथा अिभवृिB करेगी। (9) आंचिलक महायोजना पा�रिAथितक संवेदी जोन म' िवकास को िविनयिमत करेगी िजससे पा�रिAथितक अनुकूल िवकास Aथानीय समुदाय/ क# जीवकोपाज�न सुर6ा के िलए सिुनि|त �कया जा सके । (10) इस �कार अनुमो�दत आंचिलक महायोजना मानीटरी सिमित के िलए इस अिधसूचना म' �दए गए उपबंध/ के अनुसार अपने मानीटरी के कृ:य/ का पालन करने के िलए एक संदभ� दAतावेज होगा। 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय.—रा>य सरकार अिधसूचना के उपबंध/ को �भावी करने के िलए िनpिलिखत उपाय करेगी, अथा�त्:— (1) भूभभूूभू----उपयोग उपयोग उपयोग उपयोग –––– पा�रिAथितक# संवेदी जोन म' वन/, उLान कृिष 6े"/, कृिष 6े"/, पाक� और आमोद-�मोद �योजन/ के िलए अिभिनि|त खुले Aथान/ को वािणि>यक या आवासीय प�रसर या औLोिगक गितिविधय/ के िलए उपयोग नह9 �कया जाएगा या उनके िलए 6े"/ म' संप�रवPत�त नह9 �कया जाएगाः परंतु पा�रिAथितक# संवेदी जोन के भीतर कृिष और अGय भिूम का संप�रवत�न मानीटरी सिमित क# िसफा�रश पर रा>य सरकार के पूव� अनुमोदन से अनु�ात �कया जा सकेगा िजससे Aथानीय िनवािसय/ क# आवासीय आवiयकताw को पूरा �कया जा सके और अGय �Oयाकलाप/ हतुे जैसे:- (i) िवLमान सड़क/ को चौड़ा करना और उGह' सुदढ़ृ करना तथा नई सड़क/ का संिनमा�ण; (ii) बुिनयादी ढांच/ और नाग�रक सुिवधाw का सिंनमा�ण और नवीकरण; (iii) �दषूण उ:पU न करने वाले लघु उLोग; (iv) कुटीर उLोग/ िजनके अंतग�त Rामीण उLोग भी हI; सुिवधाजनक भ=डार और Aथानीय सिुवधाw सहायक पा�रिAथितक# पय�टन म' सि$मिलत गृह वास; और (v) संवPध�त �Oयाकलाप और पैरा 4 के अधीन �दया गया ह:ै परंतु यह और भी �क रा>य सरकार के पूव� अनुमोदन तथा सिंवधान के अनु?छेद 244 और त:समय �वृ; िविध के उपबंध/ के अनुपालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अGय परंपरागत वन िनवासी (वन अिधकार/ क# माGयता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि>यक और औLोिगक िवकास �Oयाकलाप/ के िलए जनजातीय भिूम का उपयोग अनु�ात नह9 होगा: परंतु यह भी �क पा�रिAथितक# संवेदी जोन के भीतर भ-ूअिभलेख/ म' उपसंजात कोई "ु�ट, मानीटरी सिमित के िवचार �ा< करने के प|ात् रा>य सरकार &ारा �:येक मामले म' एक बार सुधारी जाएगी और उ. "ु�ट के सुधार क# सूचना क' Jीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं"ालय को दनेी होगी । परंतु यह भी �क उपयु�. "ु�ट सुधार म' इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म' भ-ूउपयोग का प�रवत�न सि$मिलत नह9 होगा । परंतु यह भी �क ह�रत 6े" म' जसेै वन 6े", कृिष 6े" आ�द म' कोई पा�रणािमक कटौती नह9 होगी और अ�यु. या अनु: पादक कृिष 6े"/ म' वनीकरण और आवासीय �:यावत�न �Oयाकलाप/ सिहत पुन: वनीकरण करने के �यास �कए जाएंगे । (2) �ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत.—आचंिलक महायोजना म' सभी �ाकृितक जल �ोत/ के आवाह 6े" क# पहचान क# जाएगी और उनके संर6ण और कायाक�प के िलए योजना सि$ मिलत होगी रा>य सरकार &ारा इन 6"े/ म' या उनके िनकट िवकास �Oयाकलाप/ जो ऐस े6े"/ के िलए हािनकारक ह,ै को �ितिषB करने के बारे म' ऐसी रीित से माग�दश�क िसBांत तैयार करेगा। (3) पय�टनपय�टनपय�टनपय�टन////पा�रि�थितक� पय�टनपा�रि�थितक� पय�टनपा�रि�थितक� पय�टनपा�रि�थितक� पय�टन.—(क) पा�रिAथितक# संवेदी जोन के भीतर सभी नए पा�रिAथितक# पय�टन �Oयाकलाप या िवLमान पय�टन �Oयाकलाप/ का िवAतार पा�रिAथितक# संवेदी जोन के िलए पय�टन महायोजना के अनुसार होगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (ख) पा�रिAथितक# पय�टन महायोजना रा>य पय�टन िवभाग, &ारा रा>य पया�वरण और वन िवभाग के परामश� से तैयार होगी। (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के Xप म' होगी । (घ) पा�रिAथितक# पय�टन संबंधी �Oयाकलाप िनpानुसार िविनयिमत ह/गे, अथा�त् :- (i) िखजा�दया प6ी अभयार=य क# सीमा से एक �कलोमीटर के भीतर या पा�रिAथितक# संवेदी जोन के िवAतार तक, इनम' जो भी िनकट ह,ै नये होटल और �रसोट� के िनमा�ण अन�ुात नह9 ह/गे और वGयजीव अभयार=य क# सीमा से एक �कलोमीटर क# दरूी से परे पा�रिAथितक# संवेदी जोन के िवAतार तक होटल/ और सैरगाह/ का Aथापन केवल पूव� प�रिनि|त 6े"/ म' पय�टन महायोजना के अनुसार पा�रिAथितक# पय�टन सुिवधाw के िलए ही अनु�ात होगा; (iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय�टन के िलए िवकास और िवLमान पय�टन �Oयाकलाप/ का िवAतार वाAतिवक Aथल िविनgद�S संवी6ा तथा मानीटरी सिमित क# िसफा�रश पर आधा�रत संबंिधत िविनयामक �ािधकरण/ &ारा अनु�ात होगा और पा�रिAथितक# संवेदी जोन म' �कसी नए होटल, सरैगाह या वािणि>यक Aथापन के संिनमा�ण को अनु�ात नह9 �कया जाएगा। (4) नैस"ग�कनैस"ग�कनैस"ग�कनैस"ग�क िवरासतिवरासतिवरासतिवरासत ———— पा�रिAथितक# संवेदी जोन म' मह:वपूण� नैसPग�क िवरासत के सभी Aथल/ जैसे सभी जीन कोश आरि6त 6े", शैल िवरचनाएं, जल �पात/, झरन/, घाटी माग�, उपवन/, गुफाएं, Aथल/, �मण, अfरोहण, �पात/ आ�द क# पहचान क# जाएगी और इनके प�रर6ण और संर6ण के िलए िवरासत संर6ण योजना आंचिलक महायोजना के एक भाग के �प म' तैयार क# जाएगी। (5) मानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थलललल---- पा�रिAथितक# संवेदी जोन म' भवन/, संरचनाw, िश�प-त�य, ऐितहािसक, Aथाप:य स�दय�ता और सांAकृितक मह:व के 6े"/ और �ाचार/ क# पहचान करनी होगी और इनके संर6ण के िलए िवरासत सरं6ण योजना आंचिलक महायोजना के एक भाग के �प म' तैयार क# जाएगी । (6) $ व$ व$ व$ विन �दषूणिन �दषूणिन �दषूणिन �दषूण — पया�वरण (संर6ण) अिधिनयम 1986 के अधीन xविन �दषूण (िविनयमन और िनयं"ण) िनयम, 2000 के अनुसार म' पा�रिAथितक# सवेंदी जोन म' xविन �दषूण के िनयं"ण के िलए िविनयम/ को काया�िGवत करेगा । (7) वायुवायुवायुवायु �दषूण�दषूण�दषूण�दषूण — पा�रिAथितक# संवेदी जोन म', वायु �दषूण के िनवारण और िनयं"ण का वायु (�दषूण िनवारण और िनयं"ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम/ और समय-समय पर यथा संशोिधत के अनुसार �कया जाएगा। (8) बिह�ावबिह�ावबिह�ावबिह�ाव काकाकाका िन�सारिन�सारिन�सारिन�सारणणणण — पा�रिAथितक संवेदी जोन म' उपचा�रत बिह�ाव का िनAसारण पया�वरण (संर6ण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयम/ के अधीन पया�वरणीय �दषूण त:व/ के िनAसारण के िलए सामाGय मानक/ या रा>य सरकार &ारा िनयत मानक/ को जो भी कड़ा हो के उपबंध/ के अनुसार होगा । (9) ठोसठोसठोसठोस अपिश,अपिश,अपिश,अपिश,---- ठोस अपिशS का िनपटान एवं �बGधन िनpानुसार �कया जाएगा:- (क) पा�रिAथितक# संवेदी जोन म' ठोस अपिशS का िनपटान और �बंधन भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं"ालय क# समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अ�ैल, 2016 के तहत �कािशत ठोस अपिशS �बंधन िनयम, 2016 के उपबंध/ के अनुसार �कया जाएगा; 2. 2दषूण (जल, वायु, मृदा 8 विन आ#द) का(रत करने वाले उ;ोग� क� � थापना । (क) पा(रि�थितक� संवेदी जोन म� #कसी नए उ;ोग और िव;मान 2दषूण फैलाने वाले उ;ोग� के िव�तार क� अनुमित नह@ दी जाएगी। (ख) केवल गैर 2दषूणकारी उ;ोग� को पा(रि�थितक� संवेदी जोन के भीतर फरवरी, 2016 म� के'Gीय 2दषूण िनयंHण बोड� Iारा जारी माग�दश�क िसKांत� म� उ;ोग� के वगLकरण के अनुसार अनुMात #कया जाएगा जब तक क� इस अिधसूचना म� अ'यथा िविनPद�Q नह@ कर #दया गया हो। इसके अलावा गैर 2दषूणकारी उ;ोग� क� अिभवृिK क� जाएगी।
3. बृहत जल िव;ुत प(रयोजना प(रयोजना क� �थापना । लागू िविधय� के अनुसार 2ितिषK (अ' यथा उपबंिधत के िसवाय) ह�गे ।
4. #कसी प(रसंकटमय पदाथS का उपयोग या उ पादन या 2सं�करण। लागू िविधय� के अनुसार 2ितिषK (अ' यथा उपबंिधत के िसवाय) ह�गे ।
5. 2ाकृितक जल िनकाय� या सतही TेH म� अनुपचा(रत बिहःUाव का िन�सारण । लागू िविधय� के अनुसार 2ितिषK (अ' यथा उपबंिधत के िसवाय) ह�गे ।
6. नई आरा िमल� क� �थापना। पा(रि�थितक� संवेदी जोन के भीतर नई और िव;मान आरा िमल� का िव� तार अनुMात नह@ होगा ।
7. !ट भW� क� �थापना करना। लागू िविधय� के अनुसार 2ितिषK (अ' यथा उपबंिधत के िसवाय) ह�गे । ख.ख.ख.ख. िविनयिमत ��याकलापिविनयिमत ��याकलापिविनयिमत ��याकलापिविनयिमत ��याकलाप
8. होटल� और (रसोटS क� वािणि�यक �थापना । पा(रि�थितक� पय�टन #$याकलाप� के िलए लघु अ�थायी संरचना� के िसवाय संरिTत TेH क� सीमा से एक #कलोमीटर के भीतर या पा(रि�थितक� संवेदी जोन के िव�तार तक, इनम� जो भी िनकट है, नए वािणि�यक होटल और िवYाम �थल� को अनुMात नह@ #कया जाएगा। परंतु, संरिTत TेH क� सीमा से एक #कलोमीटर से परे या पा(रि�थितक� संवेदी जोन के िव�तार तक जो भी िनकट हो एक #कलोमीटर से सभी नए पय�टक #$याकलाप या िव;मान #$याकलाप का िव�तार पय�टन महायोजना और यथा लागू माग�दश�क िसKांत� के अनु-प होगा।
9. संिनमा�ण #$याकलाप । (क) संरिTत TेH क� सीमा से एक #कलोमीटर के भीतर या पा(रि�थितक� संवेदी जोन क� सीमा तक, इनम� जो भी िनकट हो, #कसी भी 2कार के नये 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] वािणि�यक संिनमा�ण क� अनुMा नह@ होगी: (ख) परंतु �थानीय लोग� को अपनी भूिम म� अपने उपयोग के साथ-साथ भवन उपिविधय� के पैरा 3 के उप पैरा (1) के अनुसार �थानीय िनवािसय� क� आवासीय आव�यकता� को पूरा करने के िलए सूचीबK #$याकलाप� हेतु संिनमा�ण करने क� अनुMा होगी, जैसे :- (i) िव;मान सड़क� को चौड़ा करना, उ'ह� सुदढृ करना और नई सड़क� का संिनमा�ण करना; (ii) बुिनयादी ढांच� और नाग(रक सुिवधा� का संिनमा�ण और नवीकरण करना; (iii) फरवरी, 2016 म� क� Gीय 2दषूण िनयंHण बोड� Iारा #कए गए वगLकरण के अनुसार गैर- 2दषूणकारी लघु उ;ोग� क� �थापना ; (iv) ^ामीण उ;ोग� सिहत कुटीर उ;ोग�, सुिवधा भ_डार� और ^ह-वास सिहत पा(रि�थितक� पय�टन म� सहायक �थानीय सुिवधा� क� `व�था; और (v) इस अिधसूचना म� सूचीबK बढ़ावा #दए गए #$याकलाप । (ग) गैर–2दषूणकारी लघु उ;ोग� से संबंिधत संिनमा�ण #$याकलाप लाग ूिनयम� और िविनयम�, य#द कोई ह�, के अनुसार सTम 2ािधकारी क� पूव� अनुमित से िविनयिमत #कए जाएंगे और वे 'यूनतम ह�गे । (घ) एक #कलोमीटर TेH से परे ये आंचिलक महायोजना के अनुसार िविनयिमत ह�गे ।
10. 2दषूण उ पb न करने वाले लघु उ;ोग । फरवरी 2016 म�, के'Gीय 2दषूण िनयंHण बोड� Iारा जारी उ;ोग� के वगLकरण के अनुसार गैर 2दषूणकारी उ;ोग� और अप(रसंकटमय लघु और सेवा उ;ोग, कृिष, पुcप कृिष, कृिष या उ;ान कृिष आधा(रत उ;ोग जो पा(रि�थितक� संवेदी जोन से दशेी सामि^य� से उ पाद उ पादन करते हd, सTम 2ािधकारी Iारा अनुMात होगे ।
11. वृT� क� कटाई । (क) रा�य सरकार म� सTम 2ािधकारी क� पूव� अनुमित के िबना वन, सरकारी या राज�व या िनजी भूिम पर या वन� म� eकंही वृT� क� कटाई नह@ होगी । (ख) वृT� क� कटाई संबंिधत क� Gीय या रा�य अिधिनयम� और उसके अधीन बनाए गए िनयम� के उपबंध� के अनुसार िविनयिमत होगी ।
12. वन उ पाद� और गैर काc ठ वन उ पाद� का सं^हण (एनटीएफपी) । लागू िविधय� के अधीन िविनयिमत ह�गे ।
13. िव;ुत और दरूसंचार टावर� का प(रिनमा�ण और केबल� को िबछाना तथा अ'य बुिनयादी ढांचे । लागू िविधय� के अधीन िविनयिमत ह�गे (भूिमगत केबल िबछाए जाने को बढ़ावा #दया जाएगा)।
14. नाग(रक सुख सुिवधा� सिहत बुिनयादी ढांचे। 'यूनीकरण के उपाय� के साथ, लागू िविधय� िनयम� और िविनयम� और उपलgध माग�दश�क िसKांत� के अनुसार #कया जाएगा।
15. िव;मान सड़क� को चौड़ा करना और उ'ह� सुदढ़ृ करना तथा नई सड़क� का संिनमा�ण । 'यूनीकरण के उपाय� के साथ, लागू िविधय� िनयम� और िविनयम� और उपलgध माग�दश�क िसKांत� के अनुसार #कया जाएगा।
16. गम� वायु गुgबार�, हेलीकाhटर, iोन, माइ$ोलाइटस, आ#द Iारा पा(रि�थितक� संवेदी जोन TेH के ऊपर से उड़ना जैसे अ'य पय�टन संबंधी #$याकलाप करना। लागू िविधय� के अधीन िविनयिमत ह�गे ।

18. रािH म� यािनक यातायात का संचलन । लागू िविधय� के अधीन वािणि�यक 2योजन के िलए िविनयिमत ह�गे ।
19. �थानीय समुदाय� Iारा चलाई जा रही कृिष और बागवानी 2था� के साथ पशुपालन, दkुध कृिष, जल कृिष और मछली पालन । �थानीय लोग� के उपयोग के िलए लागू िविधय� के अधीन अनुMात ।
20. फमS, कंपिनय�, आ#द Iारा बड़ े पैमाने पर वािणि�यक पशुधन संपदा और कुlकुट फामS क� �थापना । लागू िविधय� के अधीन िविनयिमत ह�गे ।
21. 2ाकृितक जल िनकाय� भू TेH म� उपचा(रत अपिशQ या बिहःUाव� का िन�सारण । उपचा(रत अपिशQ जल या बिहःUाव� के िन�सारण को जल िनकाय� म� 2वेश नह@ करने #दया जाएगा और उपचा(रत अपिशQ जल के पुनःच$ण और पुन: उपयोग के िलए 2यास #कए जाएँग�। और, लागू िविधय� के अनुसार उपचा(रत अपिशQ जल या बिहःUाव का िन�सारण िविनयिमत #कया जाएगा।
22. सतह और भूजल के वािणि�यक िनcकष�ण । लागू िविधय� के अधीन िविनयिमत ह�गे ।
23. खुले कुआँ, बोर कुआँ, आ#द कृिष और अ'य उपयोग । लागू िविधय� के अधीन िविनयिमत ह�गे और स�बK 2ािधकारी Iारा मानीटरी #कया जाएगा।

AND WHEREAS, copies of the Gazette containing the draft notification were made available to the public on the 6th September, 2017;
AND WHEREAS, no objections or suggestions were received from persons and stakeholders in response to the draft notification;
AND WHEREAS, Khijadiya Bird Sanctuary is a unique wetland eco-system located in 22°32’ N, 70° 08’ E in Jamnagar district on the southern coast of Gulf of Kutch, of Gujarat state; there are two fresh water lakes (reclamation dam) in the Sanctuary with total area of 0.0605 square kilometer;
the area is separated from the Gulf by a pucca earthen dam in both the segments; the said two lakes are not inter-linked as they are little bit away from each other, and as these lakes are adjacent to Gulf of Kutch Marine National Park and the Sanctuary, and freshwater, marine and estuarine species of micro and macro fauna and flora are found in this region attracting more than 250 species of birds and many other terrestrial fauna in the Sanctuary ;
AND WHEREAS, formerly this area was a sea-coast and marshy revenue waste land of villages Khijadiya, Jambuda and Dhunvav of Jamnagar district and to prevent salinity ingress and to reclaim the land the erstwhile Navnagar State and subsequently the Government of Gujarat constructed a reclamation bund along the coast, which made a remarkable change and improvement in the situation that prevailed in the past as large pond of sweet water has emerged and this supports a variety of natural aquatic vegetation which in turn supports numerous migratory and resident birds in this area and it is also suitable for their roosting and nesting ;
18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the important herbs from the Khijadiya Bird Sanctuary are Kamal, Poyana (Nymphaea stellata), Darudi (Argemone Mexicana), Ghandhatu, Dholi Talvani (Cleome gyanandra), Pili Tilvan (Cleome viscose), Moti Luni, Lakha Luni (Portulaca oleacea), Ganthiyu (Borreria stricta), Parpat (Oldenlandia sp.), Shulio, Uthanto(Echinops echinatus), Bhangro (Eclipta prostrate), Moti (Lunaea prcumbens), Ubhu Gokharu (Pedalium murex), Harancharo, Paniru (Lepidagathis trinervis) etc. While Vevadi (Cocculus hirsutus), Valur, Parwatti (Cocculus pendulus), Galo (Tinospora cordifolia), Khat- Khatumbo (Cayratia carnosa) and Kapalphodi (Cardiospermum halicacabum), etc.
are climbers recorded from the Khijadiya Bird Sanctuary;
AND WHEREAS, various fish species such as Pupfish (Cyprinodon dispar), Thread Fin (Polynemus tetradactylus), Mud skipper (Boleophthalmus dentatus), Mullet (Mugil carinatus) and Mullet (Mugil oligolepis), etc. are also found in the Sanctuary;
AND WHEREAS, the wetland eco-system of Khijadiya is a wintering ground for migratory waterfowls from Palacarcitic region and serves as an important wintering and breeding ground for many species of wetland birds; and an uncommon breeder in India, Great crested grebe, (Podiceps cristatus), Black-necked Grebe (Podiceps nigricollis), Great Crested Grebe (Podiceps cristatus), Little Grebe (Tachybaptus ruficollis), Dalmatian Pelican (Pelecanus crispus) and Great White Pelican (Pelecanus onocrotalus), Glossy Ibis (Plegadis falcinellus), Eurasian Spoonbill (Platalea leucorodia), Greater Flamingo (Phoenicopterus ruber), Lesser Flamingo (Phoenicopterus minor), Comb Duck(Sarkidiornis melanotos), Eurusian Marsh Harrier (Circus aeruginosus), Eursasian Sparrow Hawk (Accipiter nisus), Oriental Honey Buzzard (Pernis ptilorhynchus), Osprey (Pandion haliaetus), Shikra (Accipiter Collared Pratincole (Glareola pratincola), Small Pratincole (Glareola lacteal), Black-headed Gull (Larus redibundus), Eurasian Cuckoo (Cuculus canorus), Pied Cuckoo (Clamator jacobinus), Asian Koel (Eudynamys scolpacea ), Greater Coucal (Centropus sinensis), Sirkeer Malkoha (Phaenicophaeus leschenenaultii), Greater Short-toed Lark (Calandrella brachydactyla), Indian Bush Lark (Mirafra erythroptera), Rafous-tailed Lark (Calandrella deva), Sand Lark (Calandrella raytal), Oriental Sky Lark (Alauda gulgula), Common Babbler (Turdoides caudatus), Indian Robin (Saxicoloides fulicata cambaiensis), Oriental Magpie Robin(Copsychus saularis), Desert Wheatear (Oenanthe deserti), Isabelline Wheatear (Oenanthe isabellina), etc. are reported the said Sanctuary;
AND WHEREAS, the Globally threatened bird species from the Khijadiya Bird Sanctuary are Dalmatian Pelican (Pelecanus crispus), Darter (Anhinga melanogaster), Painted Stork (Mycteria leucocephala), Black-necked Stork (Ephippiorhynchus asiaticus) and Black-headed Ibis (Threskiornis melanocephalus), etc;
AND WHEREAS, Khijadiya reclamation bund was constructed by the Princely State of Navanagar and Government of Gujarat in 1956 and on realising the importance of the area for the vivid and numerous migratory as well as resident birds, the Government of Gujarat declared this area as Bird Sanctuary vide Government notifications No. AKH-81-WLP-1081-102123/P-2, dated the 27th May, 1981 and AKH-209/82-WLP/1081/102123-V-2, dated the 6th November, 1982;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Khijadiya Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view by habitat management aiming at improving and preserving the genetic resources of the said protected area, reintroduction and rehabilitation of local species, promotion of environmental education and ecological research and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) , read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto one kilometer from the boundary of the Khijadiya Bird Sanctuary in the State of Gujarat as the Khijadiya Bird Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:—
(1) Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall be with a peripheral area of 16.6119 square kilometres with an extent upto one kilometre from the boundary of Khijadiya Bird Sanctuary.

(2) The boundary description of Khijadiya Bird Sanctuary and its Eco-sensitive Zone is given in Annexure-I.
(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-IIA, Annexure-II B and Annexure-II C.
(4) The Geo-coordinates of Khijadiya Bird Sanctuary and its Eco-sensitive Zone are given in Table A and Table B of Annexure-III.
(5) The list of five villages falling within the Eco-sensitive Zone is appended as Annexure- IV.
2. Zonal Master Plan for Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication this final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said Plan, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal ;
(x) Panchayati Raj ; and
(xi) Public Works Department.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and the Plan shall be supported by maps giving details of existing and proposed land use features.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited regulated activities listed in the Table in paragraph 4 and also ensure and promote ecofriendly development for livelihood security of local communities.

(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure ecofriendly development for livelihood security of local communities.
(10) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government:—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use. – Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government to meet the residential needs of the local residents and for activities such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in the Table in paragraph para 4.
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism/ Eco-tourism.-(a) All new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Ecosensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco tourism shall be regulated as under, namely:—
(i) no new construction of hotels and resorts shall be permitted within one kilo meter from the boundary of the Khijadiya Bird Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer: provided that beyond the distance of one kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 hotels and resorts shall be permitted only in pre-defined and designated areas for ecotourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) Till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Ecosensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986, as amended from time to time.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and as amended from time to time..
(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes. - Disposal and management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste. – Bio medical waste management shall be as under:
(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste. - The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change as amended from time to time.
(14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG, etc.
(16) Industrial Units. –
(i) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of industries in the guidelines issued by the Central Pollution Control Board in February 2016, otherwise specified in this notification.
(17) Protection of hill slopes. - The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. Prohibited regulated and promoted activities.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S No Activity Remarks

1. Commercial mining. 2. Setting of industries causing pollution (water, air, soil, noise, etc.).
(a) no new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
(b) Only non-polluting industries shall be permitted within Ecosensitive Zone as per classification of industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
8. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for eco-tourism activities.
Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
(b) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries;
convenience stores and local amenities supporting ecotourism including homestays; and
(v) Promoted activities listed in this Notification.
(c) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any.

(d) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
10. Small scale non polluting industries.
Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority.
11. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
12. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
13. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws(underground cabling may be promoted).
14. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulations and available guidelines.

5. Monitoring Committee:
The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification, comprising of the following, namely:- S. No. Members of Monitoring Committee Designation 1 Collector, Jamnagar district Chairman;

5 One expert in the area Ecology and Environment to be nominated by the Government of Gujarat for a period of three year Member;
6 Regional Officer of the State Pollution Control Board Member;
7 Representative of Department of Environment, Government of Gujarat Member;
8 Concerned Deputy Conservator of Forest, Jamnagar Member Secretary.
6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma given in Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures:-The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
