(i) पया�वरण;
(ii) वन और वAयजीव;
(iii) कृिष;
(iv) राजF व;
(v) नगर िवकास;
(vi) पय�टन;
(vii) Rामीण िवकास;
(viii) {संचाई और बाढ़ िनयं#ण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िन मा�ण िव भाग;
(xii) राजमाग�;
(xiii) पिCम बंगाल राnय दषूण िनयं#ण बोड�। (4) आंचिलक महायोजना अनुमो�दत िवNमान भ-ूउपयोग, अवसंरचना और �mयाकलाप. पर कोई िनब|धन अिधरोिपत नह3 करेगी जब तक �क इस अिधसूचना म' इस कार िविनlद�: ट न हो और आचंिलक महायोजना सभी अवसंरचना और �mयाकलाप. म' जो अिधक द6ता और पा रिFथितक$ अनुकूल ह. का संवध�न करेगी। (5) आंचिलक महायोजना म' अनाuछा�दत 6े#. के जीणfLार, िवNमान जल िनकाय. के संर6ण, आवाह 6े#. के बंधन, जल-संभर. के बंधन, भूतल जल के बंधन, मृदा और नमी संर6ण, Fथानीय समुदाय. क$ आवkयकताK तथा पा रिFथितक$ और पया�वरण से संबंिधत ऐस ेअAय पहलुK, िजन पर Qयान दनेा आवkयक ह,ै के िलए उपबंध ह.गे । (6) आंचिलक महायोजना सभी िवNमान पूजा F थल., Rाम. और नगरीय बंदोबFत., वन. के कार और �कF म., कृिष 6े#., ऊपजाऊ भूिम, ह रत 6े# जैसे उNान और उसी कार के F थान, उNान कृिष 6े#, फलोउNान, झील. और अAय जल िनकाय. और सहायक मानिच#. के साथ भी अ}यंकन करेगी। यह योजना िवNमान और Fतािवत भूिम उपयोग क$ िवशेषताK के �दये िववरण मानिच# &ारा सम9थ�त होगा । (7) आंचिलक महायोजना पा रिFथितक$ संवेदी जोन म' िवकास को िविनयिमत करेगी और सारणी म' सूचीबL ितिषL और िविनयिमत काय�कलाप. का अनुपालन करेगी और F थानीय समुदाय. के जीिवकोपाज�न को सरुि6त करने के िलए पा रिFथितक$ अनुकूल िवक�प को सिुनिCत ओर अिभवृिL करेगी। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (8) इस कार अनुमो�दत आंचिलक महायोजना इस अिधसूचना के उपबंध. के अनुसार मानीटरी के अपने कृ=य. को करने के िलए मानीटरी सिमित के िलए एक संदभ� दFतावेज होगी। 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय-------- राnय सरकार इस अिधसूचना के उपबंध. को भावी करने के िलए िनpिलिखत उपाय करेगी, अथा�त्:-- (1) भूभभूूभू----उपयोग उपयोग उपयोग उपयोग –––– पा रिFथितक$ संवेदी जोन म' वन., उNान-कृिष 6े#., कृिष 6े#., आमोद- मोद के योजन के िलए िचिAहत �कए गए पाक~ और खुले Fथान. का वािणिnयक और औNोिगक संबL िवकास �mयाकलाप. के िलए उपयोग या संप रवत�न नह3 होगा: परंतु पा रिFथितक$ संवेदी जोन के भीतर कृिष और अAय भिूम का संप रवत�न मानीटरी सिमित क$ िसफा रश पर और राnय सरकार के पूव� अनुमोदन से, Fथानीय िनवािसय. क$ िनpिलिखत आवासीय आवkयकताK को और �mयाकलाप. को पूरा करने के िलए अनुPात �कया जाएगा, जैस:े- (i) िवNमान सड़क. को चौड़ा करना और उAह' सुदढृ करना तथा नई सड़क. का सिंनमा�ण; (ii) बुिनयादी ढांच. और नाग रक सुिवधाK का संिनमा�ण और नवीकरण; (iii) दषूण उ=पI न करने वाले लघ ुउNोग; (iv) कुटीर उNोग. िजनके अंतग�त Rामीण उNोग भी ह_; सुिवधाजनक भBडार और Fथानीय सुिवधाK सहायक पा रिFथितक पय�टन म' सि[मिलत Rह वास; और (v) संव9ध�त �mयाकलाप पैरा 4 के अंतग�त �दया गया ह:ै परंतु यह और भी �क 6े#ीय नगर योजना अिधिनयम और राnय सरकार के अAय िनयम. और िविनयम. के अंतग�त स6म ािधकारी के पूव� अनुमोदन से और संिवधान के अनुuछेद 244 और त=समय वृ> िविध के उपबंध. के अनुपालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अAय परंपरागत वन िनवासी (वन अिधकार. क$ माAयता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिnयक या उNोग िवकास �mयाकलाप. के िलए जनजातीय भूिम का उपयोग अनुPात नह3 होगा: परंतु यह और भी �क पा रिFथितक$ संवेदी जोन के भीतर भ-ूअिभलेख. म' उपसंजात कोई #ु ट, मानीटरी सिमित के िवचार ा? करने के पCात् राnय सरकार &ारा =येक मामल ेम' एक बार संशोिधत होगी और उ- #ु ट के संशोधन क$ सूचना क' Eीय सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय को दी जाएगी। परंतु यह और भी �क उपयु�- #ु ट का संशोधन म' इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म' भू-उपयोग का प रवत�न सि[मिलत नह3 होगा; परंतु यह और भी �क िजसस ेह रत 6े# म' जैस ेवन 6े#, कृिष 6े# आ�द म' कोई पा रणािमक कटौती नह3 होगी। (ख) वनीकरण तथा वास जीणfLार �mयाकलाप. सिहत अन यु% त या अनु= पादक कृिष 6े#. म' पुन: वनीकरण करने के यास �कए जाएंगे । (2) �ाकृितक�ाकृितक�ाकृितक�ाकृितक जल जल जल जल �ोत��ोत��ोत��ोत�- आचंिलक महायोजना म' सभी ाकृितक जल �ोत./न�दय./जलसरणी के आवाह 6े#. क$ पहचान क$ जाएगी और उनके सरं6ण और पुनx�भूतकरण के िलए योजना सि[ मिलत होगी और राn य सरकार &ारा ऐसे 6े#. पर या उनके िनकट िवकास �mयाकलाप ितिषL करने के िलए ऐसी रीित से माग�िनदvश तैयार �कए जाएंगे । (3) पय�टनपय�टनपय�टनपय�टन---- (क) पा रिFथितक$ संवेदी जोन के भीतर सभी नए पा रिFथितक$ पय�टन �mयाकलाप या िवNमान पय�टन �mयाकलाप. का िवFतार आंचिलक महायोजना पय�टन महायोजना के अनुसार के िलए होगा । (ख) पा रिFथितक$ पय�टन महायोजना पय�टन िवभाग &ारा राnय पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के �प म' होगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (घ) पा रिFथितक पय�टन संबंधी �mयाकलाप िनpानुसार िविनयिमत ह.गे, अथा�त् :- (i) सरंि6त 6े# क$ सीमा से एक �कलोमीटर के भीतर या पा रिFथितक संवेदी जोन के िवFतार तक, इनम' जो भी िनकट ह,ै नये होटल और रसोट� का िनमा�ण अनुPात नह3 ह.गेः परंतु, संरि6त 6े# क$ सीमा से एक �कलोमीटर क$ दरूी स ेपरे पा रिFथितक संवेदी जोन के िवFतार तक होटल. और सैरगाह. का Fथापन केवल पूव� प रिनिCत 6े#. म' पय�टन महायोजना के अनुसार पा रिFथितक पय�टन सुिवधाK के िलए ही अनुPात होगा; (ii) पा रिFथितक संवेदी जोन के भीतर सभी नए पय�टन �mयाकलाप. या िवNमान पय�टन �mयाकलाप. का िवFतार पा रिFथितक$ पय�टन पर जोर दतेे @ए क' Eीय सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय के माग�दश�क िसLांत. के &ारा तथा रा: �ीय � या� सरं6ण ािधकरण, &ारा जारी पा रिFथितक पय�टन (समय-समय पर यथा संशोिधत) माग�दश�क िसLांत. के अनुसार, होगा; (iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय�टन के िलए िवकास और िवNमान पय�टन �mयाकलाप. के िवFतार वाFतिवक Fथल िविनlद�j संवी6ा तथा मानीटरी सिमित क$ िसफा रश पर स[बL िविनयामक ािधकारी &ारा अनुPात �कया जाएगा और �कसी नए होटल/ रसfट या वािणिnयक Fथापन. के संिनमा�ण क$ अनुPा नह3 दी जाएगी। (4) नैस!ग�कनैस!ग�कनैस!ग�कनैस!ग�क िवरासतिवरासतिवरासतिवरासत ---- पा रिFथितक$ संवेदी जोन म' मह=वपूण� नैस9ग�क िवरासत के सभी Fथल. जैसे सभी जीन कोश आरि6त 6े#, शैल िवरचनाएं, जल पात., झरन., घाटी माग~, उपवन., गुफाएं, Fथल., �मण, अ�रोहण, पात. आ�द क$ पहचान क$ जाएगी और उAह' संरि6त �कया जाएगा तथा उनक$ सुर6ा और सरं6ा के िलए इस अिधसूचना के अंितम काशन क$ तारीख से छह मास के भीतर, उपयु- योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िन!म�त िवरासत � थमानव िन!म�त िवरासत � थमानव िन!म�त िवरासत � थमानव िन!म�त िवरासत � थल ल ल ल ---- पा रिFथितक$ संवेदी जोन म' भवन., संरचनाK, िश�प-त�य, ऐितहािसक, कला=मक और सांFकृितक मह=व के 6े#. क$ पहचान क$ जाएगी और इस अिधसूचना के काशन क$ तारीख से छह मास के भीतर उनके सरं6ण क$ योजना तैयार करनी होगी तथा आंचिलक महायोजना म' सि[मिलत क$ जाएगी । (6) $ व$ व$ व$ विन �दषूणिन �दषूणिन �दषूणिन �दषूण - पया�वरण (संर6ण) अिधिनयम 1986 के अधीन Qविन दषूण (िविनयमन और िनयं#ण) िनयम, 2000 म' िनयत उपबंध. के अनुसार म' पा रिFथितक$ संवेदी जोन म' Qविन दषूण के िनयं#ण के िलए िविनयम. को काया�िAवत करेगा । (7) वायुवायुवायुवायु �दषूण�दषूण�दषूण�दषूण - पा रिFथितक$ संवेदी जोन म', वायु दषूण क$ रोकथाम और िनयं#ण वायु ( दषूण िनवारण और िनयं#ण) अिधिनयम, 1981 (1981 का 14) के उपबंध. के अनुसार अनुपालन �कया जाएगा । (8) बिह�ावबिह�ावबिह�ावबिह�ाव काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण - पा रिFथितक$ संवेदी जोन म' उपचा रत बिह�ाव का िनFसारण, जल ( दषूण िनवारण तथा िनयं#ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम. के उपबंध. के अनुसार होगा । (9) ठोसठोसठोसठोस अपिश, अपिश, अपिश, अपिश, ---- ठोस अपिशj. का िनपटान और बंधन िनpिलिखत �प म' होगा- (क) पा रिFथितक$ संवेदी जोन म' ठोस अपिशj िनपटान और बंधन समय-समय पर संशोिधत ठोस अपिश: ट बंधन िनयम, 2016, जो भारत सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय क$ अिधसूचना स.ं का.आ. 1357(अ) तारीख 8 अ ैल, 2016 &ारा कािशत �कए गए थ,े के उपबंध. के अनुसार �कया जाएगा; (ख) Fथानीय ािधकरण जैव िनpीकरणीय और अजैव िनpीकरणीय संघटक. म' ठोस अपिशj. के संपृथ�न के िलए योजनाएं तैयार कर'गे; (ग) जैव िनpीकरणीय सामRी को अिधमानतः खाद बनाकर या कृिम खेती के माQयम स ेपुनःच�mत �कया जाएगा; S.O. 318(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3344 (E), dated the 12 th October, 2017 inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, the copies of the Gazette containing the said the draft notification were made available to the public on the 16 th October, 2017; AND WHEREAS, no objections and suggestions were received from all persons and stakeholders in response to the said draft notification; AND WHEREAS, the Chinatamoni Kar Bird Sanctuary is located within urban conglomeration of Narendrapur within the jurisdiction of Rajpur–Sonarpur municipality of 24-Parganas (South) District of West Bengal; total area of the Sanctuary is 17.19 acres (6.956 hectare); Chinatamoni Kar Bird Sanctuary is famous for various smaller animals such as Fishing Cat, Jackal, Water Monitor Lizard as well as various snake species; a rich source of avifauna is also present in Sanctuary; AND WHEREAS, Considering the adequate ecological, faunal, natural and zoological significance and in exercise of the power conferred under section 26-A (a) of Wildlife (Protection) Act, 1972 (53 of 1972) and in supersession of Forest Department Notification No. 2869 dated 3 rd July, 1980; AND WHEREAS, the Chintamoni Kar Bird Sanctuary which is situated in Baruipur Sub-division is a part of ancient Sunderban; in the early days River Ganga was following by the side of the Sanctuary; so the establishment of the Sanctuary within the growing urban conglomeration has a paramount significance; AND WHEREAS, Chintamoni Kar Bird Sanctuary its significance in the international context for providing shelter and protection to various species of wildlife particularly birds included in the Red Data Book (R.D.B.) of the International Union for Conservation of Nature and the appendices of the Convention on International Trade in Endangered Species of Wild Flora and Fauna ; various types of smaller animal e.g. Fishing Cat, Jackal, Hare, Water Monitor Lizard and snakes are found in the adjoining villages of the sanctuary; this sanctuary can play a vital role for the conservation of that wildlife; AND WHEREAS, this Sanctuary is a paradise for birds such as Red throated fly catcher, Oriole, Paradise fly catcher, Drongo, Jungle Babbler, Asian Koel, spotted Dove, Common Kingfisher, Indian cuckoo, Rufous Woodpecker, Little Cormorant, Lineated Barbet etc. AND WHEREAS, Chintamoni Kar Bird Wildlife Sanctuary located in the bio- geographic zone 7B (Lower Gangetic Plain) as recognized by Rodgers and Panwar, 1988 (Wildlife Institute of India, Dehradun); this Wildlife 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Sanctuary is visited by number of scheduled animals of the Wildlife (Protection) Act, 1972, which include Civet Cat (Viverridae spp.), Fishing Cat (Felis viverrina), Mangoose (Herpestes spp.), Water Monitor Lizard (Varanus salvator), Jackal (Canis aureus), Squirrel (Funambulus pennanti), Common Fox (Vulpes bengalensis); AND WHEREAS, for effective conservation and protection of these floral and faunal biodiversity of Chintamoni Kar Bird Sanctuary, the extent of different anthropogenic pressures has to be regulated as the immediate area adjoining this fragile ecosystem is much ecologically sensitive having great impact on this protected area; AND WHEREAS, it is necessary to conserve and protect the area around the Chintamoni Kar Bird Sanctuary and propagate improvement and development of the wildlife therein and its environment; AND WHEREAS, it has become necessary to specify certain areas around the Chintamoni Kar Bird Sanctuary as Eco-sensitive Zone and to prohibit industries, operations or processes or class of industries, operations or processes in the said Eco-sensitive Zone. NOW, THEREFORE, in exercise of powers conferred by sub-section (I) and clauses (v) and (xiv) of subsection (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area upto 100 meters (uniform) from the boundary of the protected area of Chinatamoni Kar Bird Sanctuary in the State of West Bengal as the Chinatamoni Kar Bird Sanctuary Eco-Sensitive Zone (hereinafter referred to as Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is bounded by 22 0 25’48.69”N latitude and 88 0 24’10.40”E longitude towards east; 22 0 25’45.67”N latitude and 88 0 23’54.33”E longitude towards west; 22 0 25’57.72”N latitude and 88 0 23’57.76”E longitude towards north and 22 0
25.40.00”N latitude and 88 0 24’8.23”E longitude towards south.
(2) The extent of Eco-sensitive Zone is uniformly 100 meters, covering an area of 0.105 square kilometers.
(3) The map, boundary description of Eco-sensitive Zone, co-ordinates of Wildlife Sanctuary and Eco-sensitive Zone is appended as Annexure-I.
(4)The list of villages are appended as Annexure-II.
2. Zonal Master Plan for the Eco-sensitive Zone. – (1) The State Government shall, for the purpose of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this Notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this Notification for approval of the Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating environmental and ecological considerations into the said plan, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development ;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department;
(xii) Highways;

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use. – Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents and for the activities such as:-
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and
(v) Promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies. - The catchment areas of all natural springs/rivers/channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(3) Tourism. - (a) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Department of Environment and Forest.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be permitted within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that, beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural Heritage. - All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(6) Noise pollution. - The Environment Department of the State Government of West Bengal, State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under, as amended from time to time.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under as amended from time to time.
(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder as amended from time to time.
(9) Solid wastes. - Disposal and management of solid wastes shall be as under:-
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated 8 th April, 2016 as amended from time to time; (b) the local authorities shall draw up plans for the segregation of solid waste into bio-degradable and non bio-degradable components;
(c) the bio-degradable material shall be recycled preferably through composting or vermiculture;
(d) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid waste shall be permitted in the Eco-sensitive Zone. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
(10) Bio-medical waste. - The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification Number GSR 343 (E), dated the 28 th March,2016 as amended from time to time.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.-The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste. - The E-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example Compressed Natural Gas (CNG), etc.
(16) Industrial units. - (i) No new polluting industries shall be permitted to be set up within the eco-sensitive Zone.
(ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification, and in addition, non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes. - The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone notification, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing Mining (minor and major minerals), stone quarrying and crushing units shall be prohibited except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for personal consumption.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P. (C) No.202 of 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P. (C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted. Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless otherwise specified in this notification, and in addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste. No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco-sensitive zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is prohibited.
7. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
8. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
9. Use of polythene bags. Use of polythene bags are permitted within the Eco Sensitive Zone. However, based on specific requirement, it shall be regulated under applicable laws.
10. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities
11. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
12. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc. Regulated under applicable laws.
13. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in subparagraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents.
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
14. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority.
15. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
16. Collection of Forest Produce or Non-Timber Forest Produce (NTFP). Regulated under applicable laws.
17. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws (underground cabling may be promoted).
18. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules, regulations and available guidelines.
19. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules, regulations and available guidelines.
20. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated under applicable laws.
21. Protection of Hill Slopes and river banks. Regulated under applicable laws.
22. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
23. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals.
24. Discharge of treated waste water/effluents in natural water bodies or land area. The discharge of treated waste water/effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water, and the discharge of treated waste, water/effluent shall be regulated as per applicable laws.
25. Commercial extraction of surface and ground water. Regulated under applicable laws.
26. Open well, bore well etc. for agriculture or other usage. Regulated under applicable laws and the activity shall be strictly monitored by the concerned authority.
27. Solid Waste Management. Regulated under applicable laws.
28. Introduction of Exotic species. Regulated under applicable laws.
29. Eco-tourism. Regulated under applicable laws.
30. Commercial sign boards and hoardings. Regulated under applicable laws.
31. Use of destructive methods in fishing for aquatic resources (fishes, prawns, crabs etc. Local). Regulated under applicable laws. 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprising of the following, namely:-
(i) District Magistrate, 24-Parganas (South) Chairman;
(ii) Representative of the Chief Wildlife Member; Warden, West Bengal
(iii) Representative of State Pollution Control Member; Board, West Bengal
(iv) One representative of non-Governmental Member; Organisation working in the field of environment
(v) Representative of Agriculture Department, Member; Government of West Bengal
(vi) Representative of Urban Development and Member; Housing Department, 24-Parganas (South), Government of West Bengal
(vii) An expert in Biodiversity to be nominated by Member, the State Government
(viii) District Wildlife Warden, 24-Parganas (South), Member-Secretary. C. Promoted Activities
32. Rain water harvesting. Shall be actively promoted.
33. Organic farming. Shall be actively promoted.
34. Adoption of green technology for all activities. Shall be actively promoted.
35. Cottage industries including village artisans, etc. Shall be actively promoted.
36. Use of renewable energy and fuels. Bio gas, solar light etc. shall be actively promoted.
37. Agro-forestry. Shall be actively promoted.
38. Use of eco-friendly transport. Shall be actively promoted.
39. Skill development. Shall be actively promoted.
40. Restoration of Degraded Land/ Forests/ Habitat. Shall be actively promoted.
41. Environmental Awareness. Shall be actively promoted.
42. Vegetative fencing. Shall be actively promoted.
43. Natural Habitat restoration. Shall be actively promoted.
44. Sensitization of people, students, tourists for developing eco friendly behaviours and attitudes. Shall be actively promoted.

6. Terms of reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden in the state as per pro- forma appended as Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures: -The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
