PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 221] ubZ fnYyh] eaxyokj] tuojh 15] 2019@ikS"k 25] 1940 No. 221] NEW DELHI, TUESDAY, JANUARY 15, 2019/PAUSHA 25, 1940 पया�वरणपया�वरणपया�वरणपया�वरण, , , , वनवनवनवन औरऔरऔरऔर जलवायुजलवायुजलवायुजलवायु प�रवत�नप�रवत�नप�रवत�नप�रवत�न मं ालयमं ालयमं ालयमं ालय अिधसूचनाअिधसूचनाअिधसूचनाअिधसूचना नई �द�ली, 14 जनवरी, 2019 का.का.का.का.आआआआ.... 313131319999(अ).(अ).(अ).(अ).———— ा�प अिधसूचना भारत सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय क$ अिधसूचना स.ं का.आ. 3575 (अ) तारीख 9 नव%बर, 2017 'ारा भारत के राजप# असाधारण म( कािशत क$ गई थी िजसम( उन सभी -ि.य/ से, िजनको उससे भािवत होने क$ संभावना थी, उस तारीख से, िजसको उ. अिधसूचना क$ राजप# क$ ितयां जनता को उपल3ध करा दी गई थी, साठ �दन क$ अविध के भीतर, आ6ेप और सझुाव आमंि#त �कए गए थे; और,और,और,और, ा�प अिधसूचना के 9यु:र म( -ि.य/ और पणधा रय/ से कोई आ6ेप और सु6ाव ा; नह< =ए थ;े औरऔरऔरऔर, , , , स(चल व>यजीव अभयार?य क$ @थापना 1915 म( =ई थी और यह दशे म( इस तरह के अभयार?य/ म( सबसे पुराना ह ैऔर पिAम बंगाल राBय का एकमा# पहाड़ी अभयार?य ह ैयह अभयार?य 38.88 वग� �कलोमीटर म( फैला =आ ह।ै इस अभयार?य क$ मKुय िवशेषता यह ह ै�क यह पूरी तरह से यह दाMज�Nलंग शहर के पहाड़ी 6े# के बीच और उसके उपनगर/ के िनकट होने के अित र., दाMज�Nलंग शहर के िलए एक पा रि@थितक$ म�Pान और जल भंडार ह।ै एक घनी जनसKंया वाले 6े# के पास ि@थत होने, अनेक अQछी सड़क/ से प=चंने क$ सुगमता के कारण इस अभयार?य के जैव 6े# म( मानव ह@त6पे ब=त अिधक ह।ै स(चल व>यजीव अभयार?य के वन/ म( अनेक �दलच@प और मह9वपूण� वन@पितय/ और जीवज>तुS का वास ह।ै इस अभयार?य के मुKय वन कार/ म( �फर हमेलोक-ओक िमिTत वन, , , , ओक वन और बड़ी पि:य/ वाले सदाबहार वन हU यहाँ लगभग 380-400 फूलदार पौधे और रोडोड(Zन क$ कई जाितयां हU और इस अभयार?य म( मह9वपूण� व>यजीव सेरो, , , , गोरल, , , , त(दआु, , , , िहमालयी 3लैक भालू, , , , लेजर िब�ली, , , , ये�लो [ोटेड माट�न, , , , िगलहरी (िवशाल और \लाइंग), , , , बा]क̂ग िडयर, , , , जंगली सूअर, , , , 3लैक बै_ड खलीज तीतर आ�द पाए जाते हU; और,और,और,और, यह 6े# न केवल @थानीय वन@पितय/ और जीवज>तुS के जीन पूल के अिंतम अवशेष/ पर शोध काय� और उनके संर6ण के पा रि@थितक$ और वै`ािनक कारण/ वरन @थानीय िनवािसय/ के जीवन म( मह9वपूण� भिूमका िनभाने क$ 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] दिृb से तथा स(चल व>यजीव अभयार?य क$ जैव िविवधता क$ वन@पित और जीवज>तुS क$ सरु6ा और भावी संर6ण क$ दिृb से भी मह9वपूण� ह।ै िविभc कार के जनजातीय दबाव/ को िविनयिमत �कया जाना चािहए _य/�क इस नाजुक पा रि@थितक$ णाली के एकदम आस-पास का 6े# पा रि@थितक$ क$ दिृb स ेब=त ही नाजुक ह,ै जो इस सरंि�तसरंि�तसरंि�तसरंि�त �े �े �े �े को काफ$ भािवत करता ह;ै अतःअतःअतःअतः अब पा रि@थितक$, पया�वरण, वान@पितक, जीव ज>तु, भौगोिलक या ािण संबंeता या इनस ेसंबंिधत मह9व के कारण तथा इस अभयार?य और इसके प रसर म( व>यजीव/ के सरं6ण, उ>ह ेबढ़ावा दनेे या उनका िवकास करने के उgेhय से, के>i सरकार पया�वरण (सरं6ण) अिधिनयम, 1986 (1986 का 29) क$ धारा 3 क$ उप-धारा (2) के खंड (v) और खंड (xiv) के साथ प ठत उप-धारा (1) के तहत द: शि.य/ का योग करते =ए और पया�वरण (संर6ण) िनयम, 1986 के िनयम 5 के उप-िनयम (3) के अनुसार, पिAम बंगाल राBय के स�चस�चस�चस�चल व�यजीव अभयार�यल व�यजीव अभयार�यल व�यजीव अभयार�यल व�यजीव अभयार�य के 6े# और सीमा को पा रि@थितक$ संवेदी जोन (िजसे इसम( इसके पh चात् पा रि@थितक$ संवेदी जोन कहा गया ह)ै के mप म( अिधसिूचत करती ह,ै िजसका िववरण िनnानुसार ह,ै अथा�त् :-- 1. पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� सवेंदीसवेंदीसवेंदीसवेंदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर सीमासीमासीमासीमा.- (क) पा रि@थितक$ संवेदी जोन का 6े#फल 40.08 वग� �कलोमीटर ह ैऔर पा रि@थितक$ संवेदी जोन क$ सीमा पिAम बंगाल राBय के दाMज�Nलंग िजले म( स(चल व>यजीव अभयार?य क$ सीमा स े1 �कलोमीटर तक ह ैऔर स(चल व>यजीव अभयार?य के पा रि@थितक$ संवेदी जोन का मानिच#, सीमा वण�न, िनदqशाकं उपाबंध उपाबंध उपाबंध उपाबंध I I I I के mप म( उपाबe हU। (ख) पा रि@थितक$ संवेदी जोन के rाम/ क$ सूची उपाबंधउपाबंधउपाबंधउपाबंध IIIIIIII के �प म( उपाबe ह ै। 2222.... पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� सवेंदीसवेंदीसवेंदीसवेंदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आंचिलकआंचिलकआंचिलकआंचिलक महायोजनामहायोजनामहायोजनामहायोजना –––– (1) राBय सरकार, पा रि@थितक$ संवेदी जोन के योजन के िलए राजप# म( इस अिधसूचना के काशन क$ तारीख से दो वष� क$ अविध के भीतर, @थानीय -ि.य/ के परामश� से और इस अिधसूचना म( �दए गए अनुबंध/ का पालन करते =ए आंचिलक महायोजना तैयार करेगी। (2) राBय सरकार 'ारा पा रि@थितक$ संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित से जो इस अिधसूचना म( िविनsद�t ट �कए गए ह ैके अनुसार तथा सुसंगत क( iीय और राB य िविधय/ के अनु�प और क( iीय सरकार 'ारा जारी माग�िनदqश/, य�द कोई ह/, 'ारा तैयार होगी । (3) आंचिलक महायोजना, उ. योजना म( पा रि@थितक$ और पया�वरणीय बात/ को समाकिलत करने के िलए राB य सरकार के िनnिलिखत िवभाग/ के परामश� से तैयार होगी, अथा�त्:--
(i) पया�वरण;
(ii) वन और व>यजीव;
(iii) कृिष;
(iv) राज@ व;
(v) नगर िवकास;
(vi) पय�टन;
(vii) rामीण िवकास;
(viii) Nसंचाई और बाढ़ िनयं#ण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िन मा�ण िव भाग;
(xii) राजमाग�; और
(xiii) पिAम बंगाल राBय दषूण िनयं#ण बोड�। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 (4) आंचिलक महायोजना अनुमो�दत िवPमान भू-उपयोग, अवसंरचना और �vयाकलाप/ पर कोई िनब̂धन अिधरोिपत नह< करेगी जब तक �क इस अिधसूचना म( इस कार िविनsद�t ट न हो और आचंिलक महायोजना सभी अवसंरचना और �vयाकलाप/ म( जो अिधक द6ता और पा रि@थितक$ अनुकूल ह/ का संवध�न करेगी । (5) आंचिलक महायोजना म( अनाQछा�दत 6े#/ के जीणweार, िवPमान जल िनकाय/ के संर6ण, आवाह 6े#/ के बंधन, जल-संभर/ के बंधन, भूतल जल के बंधन, मृदा और नमी संर6ण, @थानीय समुदाय/ क$ आवhयकताS तथा पा रि@थितक$ और पया�वरण से संबंिधत ऐस ेअ>य पहलुS, िजन पर xयान दनेा आवhयक ह,ै के िलए उपबंध ह/गे । (6) आंचिलक महायोजना सभी िवPमान पूजा @ थल/, rाम/ और नगरीय बि@तय/, वन/ के कार और �क@ म/, कृिष 6े#/, ऊपजाऊ भिूम, ह रत 6े# जैसे उPान और उसी कार के @ थान, उPान कृिष 6े#, फलोउPान, झील/ और अ>य जल िनकाय/ का अzयकंन करेगी । इस योजना के मानिच# के साथ िवPमान और @तािवत भिूम उपयोग िवशेषताS का िववरण अनुसमMथ�त होगा । (7) आंचिलक महायोजना पा रि@थितक$ सवंेदी जोन म( िवकास को िविनयिमत करेगी और सारणी म( सूचीबe ितिषe और िविनयिमत �vयाकलाप/ का अनुपालन करेगी और @ थानीय समदुाय/ के पा रि@थितक$ अनुकूल िवकास के िलए जीवकोपाज�न को सुरि6त करने के िलए सुिनिAत �कया जा सकेगा। (8) आंचिलक महायोजना 6े#ीय िवकास योजना क$ सह िव@तारी होगी । (9) इस कार अनुमो�दत आंचिलक महायोजना इस अिधसूचना के उपबंध/ के अनुसार मानीटरी के अपने कृ9य/ को करने के िलए मानीटरी सिमित के िलए एक संदभ� द@तावेज होगी। 3. रा यरा यरा यरा य सरकारसरकारसरकारसरकार !ारा!ारा!ारा!ारा "कए"कए"कए"कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय-------- राBय सरकार इस अिधसूचना के उपबंध/ को भावी करने के िलए िनnिलिखत उपाय करेगी, अथा�त्:-- (1) भूभभूूभू----उपयोगउपयोगउपयोगउपयोग––––((((कककक) ) ) ) पा रि@थितक$ संवेदी जोन म( वन/, उPान-कृिष 6े#/, कृिष 6े#/, आमोद- मोद के योजन के िलए िचि>हत �कए गए पाक{ और खुले @थान/ का मुKय वािणिBयक या मुKय आवािसय 6े# या मुKय औPोिगक �vयाकलाप/ के िलए उपयोग या संप रवत�न नह< होगा: परंतु पा रि@थितक$ संवेदी जोन के भीतर भाग (क) म( िविनsद�b योजन से िभc योजन के िलए कृिष और अ>य भिूम का संप रवत�न मानीटरी सिमित क$ िसफा रश पर और यथा-लागू और 6े#ीय नगर योजना अिधिनयम तथा के>iीय/राBय सरकार के अ>य िनयम/ तथा िविनयम/ के अधीन स6म ािधकारी के पूव� अनुमोदन स,े तथा इस अिधसूचना के उपबंध/ 'ारा @थानीय िनवािसय/ क$ िनnिलिखत आवासीय जmरत/ को पूरा करने के िलए अनु`ात �कया जाएगा, जैसे:- (i) िवPमान सड़क/ को चौड़ा करना और उ>ह( सुदढृ करना तथा नई सड़क/ का सिंनमा�ण; (ii) बुिनयादी ढांच/ और नाग रक सुिवधाS का संिनमा�ण और नवीकरण; (iii) दषूण उ9पc न करने वाले लघ ुउPोग; (iv) कुटीर उPोग/ िजनके अंतग�त rामीण उPोग भी हU; सुिवधाजनक भ?डार और @थानीय सुिवधाS सहायक पा रि@थितक$ पय�टन म( सि%मिलत rह वास; और (v) संवMध�त �vयाकलाप पैरा 4 के अंतग�त �दया गया ह:ै परंतु यह और भी �क 6े#ीय नगर योजना अिधिनयम और राBय सरकार के अ>य िनयम/ और िविनयम/ के अंतग�त और संिवधान के अनुQछेद 244 और त9समय वृ: िविध के उपबंध/ के अनुपालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अ>य परंपरागत वन िनवासी (वन अिधकार/ क$ मा>यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिBयक या उPोग िवकास �vयाकलाप/ के िलए जनजातीय भिूम का उपयोग अनु`ात नह< होगा: परंतु यह और भी �क पा रि@थितक$ संवेदी जोन के भीतर भ-ूअिभलेख/ म( उपसंजात कोई #ु ट, मानीटरी सिमित के िवचार ा; करने के पAात् राBय सरकार 'ारा 9येक मामल ेम( एक बार संशोिधत होगी और उ. #ु ट के संशोधन क$ सूचना क( iीय सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय को दी जाएगी : 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु यह और भी �क उपयु�. #ु ट का संशोधन म( इस उप पैरा के अधीन यथा-उपबंिधत के िसवाय �कसी भी दशा म( भू-उपयोग का प रवत�न सि%मिलत नह< होगा; (ख) वनीकरण तथा वास जीणweार �vयाकलाप/ सिहत अन यु_ त या अनु9 पादक कृिष 6े#/ म( पुन: वनीकरण करने के यास �कए जाएंगे । (2) $ाकृितक$ाकृितक$ाकृितक$ाकृितक जल जल जल जल &ोत(&ोत(&ोत(&ोत(- आचंिलक महायोजना म( सभी ाकृितक जल �ोत//न�दय//जलसरणी के आवाह 6े#/ क$ पहचान क$ जाएगी और उनके सरं6ण और पुनन�वीकरण के िलए योजना सि% मिलत होगी और राज् य सरकार 'ारा ऐसे 6े#/ पर या उनके िनकट िवकास �vयाकलाप ितिषe करने के िलए ऐसी रीित स ेमाग�िनदqश तैयार �कए जाएगें। (3) पय�टनपय�टनपय�टनपय�टन पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� पय�टनपय�टनपय�टनपय�टन–––– (क) पा रि@थितक$ संवेदी जोन के भीतर सभी नए पा रि@थितक$ पय�टन �vयाकलाप या िवPमान पय�टन �vयाकलाप/ का िव@तार पय�टन महायोजना के अनुसार आंचिलक महायोजना के िलए होगा। (ख) पय�टन महायोजना राBय पय�टन िवभाग 'ारा राBय पया�वरण और वन िवभाग के परामश� स ेतैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के mप म( होगी । (घ) पा रि@थितक$ पय�टन संबंधी �vयाकलाप िनnिलिखत के अधीन िविनयिमत ह/गे, अथा�त्:- (i) सरंि6त 6े# क$ सीमा से एक �कलोमीटर के भीतर या पा रि@थितक$ संवेदी जोन के िव@तार तक, इनम( जो भी िनकट ह,ै नये वािणिBयक होटल और रसोट� अनु`ात नह< ह/गे : परंतु, संरि6त 6े# क$ सीमा से एक �कलोमीटर क$ दरूी से परे पा रि@थितक$ संवेदी जोन के िव@तार तक होटल/ और सैरगाह/ का @थापन केवल पूव� प रभािषत और नामिनsद�b 6े#/ म( पय�टन महायोजना के अनुसार पा रि@थितक$ पय�टन सुिवधाS के िलए ही अनु`ात होगा; (ii) पा रि@थितक$ संवेदी जोन के भीतर नए पय�टन �vयाकलाप/ या िवPमान पय�टन �vयाकलाप/ का िव@तार क( iीय सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय के माग�दश�क िसeांत/ के 'ारा तथा राt �ीय � या� सरं6ण ािधकरण, 'ारा जारी पा रि@थितक$ पय�टन (समय-समय पर यथा-संशोिधत) माग�दश�क िसeांत/ के अनुसार होगा; (iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय�टन के िलए िवकास और िवPमान पय�टन �vयाकलाप/ के िव@तार को वा@तिवक @थल िविनsद�b संवी6ा और मानीटरी सिमित क$ िसफा रश पर आधा रत संबंिधत िविनयामक ािधकरण/ 'ारा अनु`ात �कया जाएगा और पा रि@थितक$ संवेदी जोन के अंदर �कसी नये होटल या सैरगाह या वािणिBयक ित�ान का सिंनमा�ण अनु`ात नह< �कया जायेगा । (4) नैस+ग�कनैस+ग�कनैस+ग�कनैस+ग�क िवरासतिवरासतिवरासतिवरासत -------- पा रि@थितक$ संवेदी जोन म( मह9वपूण� नैसMग�क िवरासत के सभी @थल/ जैसे सभी जीन कोश आरि6त 6े#, शैल िवरचनाएं, जल पात/, झरन/, घाटी माग{, उपवन/, गुफाएं, @थल/, �मण, अ�रोहण, पात/ आ�द क$ पहचान क$ जाएगी और िवरासत संर6ण योजना आंचिलक महायोजना के भाग के �प म( प रर6ण और सरं6ण के िलए तैयार क$ जाएगी । (5) मानव िन+म�त िवरासत � थमानव िन+म�त िवरासत � थमानव िन+म�त िवरासत � थमानव िन+म�त िवरासत � थल ल ल ल ---- पा रि@थितक$ संवेदी जोन म( भवन/, संरचनाS, िश�प-त�य, ऐितहािसक, कला9मक और सां@कृितक मह9व के 6े#/ क$ पहचान और उनके संर6ण के िलए िवरासत योजना आंचिलक महायोजना के भाग के �प म( तैयार क$ जाएगी । (6) - व- व- व- विन $दषूणिन $दषूणिन $दषूणिन $दषूण– पिAम बंगाल राB य सरकार का पया�वरण िवभाग या राB य दषूण िनयं#ण बोड�, पया�वरण (सरं6ण) अिधिनयम, 1986 के अधीन बने xविन दषूण (िविनयमन और िनयं#ण) िनयम, 2000 के उपबंध/ के अनुसार पा रि@थितक$ संवेदी जोन म( x विन दषूण के िनयं#ण संबंधी िविनयम/ को लागू करेगा। (7) वायुवायुवायुवायु $दषूण$दषूण$दषूण$दषूण -- पा रि@थितक$ संवेदी जोन म(, वायु दषूण क$ रोकथाम और िनयं#ण वायु ( दषूण िनवारण और िनयं#ण) अिधिनयम, 1981 (1981 का 14) के उपबंध/ और उसके अधीन बनाए गए िनयम/ और उनम( �कए गए संशोधन/ के अनुसार अनुपालन �कया जाएगा । (8) बिह&ावबिह&ावबिह&ावबिह&ाव काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण -- पा रि@थितक$ संवेदी जोन म( उपचा रत बिह�ाव का िन@सारण, साधारण/ मानक/ के अ>तग�त पया�वरणीय (सरं6ण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयम/ के अधीन आन ेवाले पया�वरणीय ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 दषूण के िन@सारण के िलए साधारण मानक/ या राBय सरकार 'ारा िनयत मानक/, जो भी अिधक कठोर हो, के उपबंध/ के अनुसार होगा। (9) ठोसठोसठोसठोस अपिश4अपिश4अपिश4अपिश4---- ठोस अपिशb का िनपटान एवं ब>धन िनnानुसार �कया जाएगा:- (क) पा रि@थितक$ संवेदी जोन म( ठोस अपिशb का िनपटान और बंधन भारत सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय क$ समय-समय पर यथा-संशोिधत अिधसूचना सं. का.आ. 1357(अ), �दनांक 8 अ ैल, 2016 के तहत कािशत ठोस अपिशb बंधन िनयम, 2016 के उपबंध/ के अनुसार �कया जाएगा। अकाब�िनक पदाथw का िनपटान पा रि@थितक$ संवेदी जोन से बाहर िचि>हत �कए गए @थान/ पर पया�वरण-अनुकूल रीित से �कया जाएगा; The main characteristics of the sanctuary apart from its being entirely hilly is the region lies very close to Darjeeling town and its suburbs and it is an ecological oasis and water bank for Darjeeling town. Because of its close proximity to a densely populated area coupled with its easy accessibility via a number of good roads, human interference with the biotope of the sanctuary is high and variety of interesting and important flora and fauna exists amidst the forest of Senchal Wildlife Sanctuary and the main forest types in the Sanctuary are Fir-Hemlock-Oak mixed forest, Oak forest and broad leaved evergreen forest and there are approximately 380-400 flowering plants, various species of Rhododendron and the important wildlife in the Sanctuary are Serrow, Goral, Leopard, Himalayan Black Bear, Lesser Cats, Yellow throated marten, Squirrels (Giant and Flying), Barking Deer, Wild Boar, Black backed Khaleej Pheasant etc; AND WHEREAS, the area is important not only for ecological and scientific reason of research and preservation of the last remnants of gene pool of indigenous flora and fauna but its importance also lies in respect of the role it plays in the life of local inhabitants and for effective conservation and protection of these floral and faunal Biodiversity of Senchal Wildlife Sanctuary, the extent of different anthropogenic pressures has to be regulated as the immediate area adjoining this fragile ecosystem is much ecologically sensitive having great impact on this Protected Area; NOW THEREFORE, by reason of ecological, environmental, faunal, floral, geographical or zoological association or importance, for the purpose of protecting, propagating or developing wildlife therein or its environment, the Central Government, in exercise of the powers conferred under by sub-section (1) read with clause (v) and clause
(xiv) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, hereby notifies the area and boundary of the Senchal Wildlife Sanctuary in the State of West Bengal as the Senchal Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone. - (1) The area of Eco-sensitive Zone is 40.08 square kilometers and the uniform extent of Eco-sensitive Zone is one kilometer from the boundary of the Senchal Wildlife Sanctuary in the Darjeeling District, the State of West Bengal and the map, boundary description, co-ordinates of Sanchal Wildlife Sanctuary Eco-sensitive Zone is appended at Annexure- I.
(2) The list of Villages of the Eco-sensitive Zone, are appended at Annexure- II.
2. Zonal Master Plan for the Eco-sensitive Zone. – (1) The State Government shall, for the purpose of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this Notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating environmental and ecological considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department;
(xii) Highways; and
(xiv) West Bengal State Pollution Control Board.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4: 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies. - The catchment areas of all natural springs, rivers and channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism/ Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer. However, beyond the distance of 1 kilometer from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on Eco-tourism;
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Eco-sensitive Zone area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution. - The Environment Department of the State Government or West Bengal State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made there under and amendments thereto.
(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made there under or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8 th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste. - Bio-medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification Number GSR 343 (E), dated the 28 th March,2016 as amended from time to time.
(b) Safe and Environmentally Sound Management (ESM) of biomedical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.
(13) E-waste. - The E-Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made there under.
(15) Vehicular Pollution. - Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example Compressed Natural Gas (CNG) etc.
(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(17) Protection of Hill Slopes: The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone notification, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P. (C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P. (C) No.435 of 2012.
2. Setting of industries including new oil and gas exploration causing pollution (Water, Air, Soil, Noise, etc.). No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted. Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major thermal and major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
8. Commercial use of fire wood. Prohibited (except as otherwise provided) as per applicable laws.
9. Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities
10. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or up to the extent of ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies. Regulated under applicable laws.
12. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(v) promoted activities listed in this Notification:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
13. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
14. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
15. Collection of Forest produce or Non-Timber Forest Produce (NTFP). Regulated under applicable laws.
16. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws. Underground cabling may be promoted. 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
17. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
19. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated under applicable laws.
20. Protection of Hill Slopes and river banks. Regulated under applicable laws.
21. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
22. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals.
23. Discharge of treated waste water/effluents in natural water bodies or land area. The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
24. Commercial extraction of surface and ground water. Regulated under applicable laws.
25. Open Well, Bore Well etc. for agriculture or other usage. Regulated and the activity shall be strictly monitored by the appropriate authority.
26. Solid Waste Management/Biomedical Waste Management. Regulated under applicable laws.
27. Introduction of Exotic species. Regulated under applicable laws.
28. Eco-tourism. Regulated under applicable laws.
29. Commercial Sign boards and hoardings. Regulated under applicable laws. C. Promoted Activities
30. Rain water harvesting. Shall be actively promoted.
31. Organic farming. Shall be actively promoted.
32. Adoption of green technology for all activities. Shall be actively promoted.
33. Cottage industries including village artisans, etc. Shall be actively promoted.
34. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted
35. Agro-Forestry. Shall be actively promoted.
36. Use of eco-friendly transport. Shall be actively promoted.
37. Skill Development. Shall be actively promoted.

5. Monitoring Committee: - The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of namely:-
(i) District Magistrate, Darjeeling District Chairman;
(ii) Representative of State Pollution Control Board Member;
(iii) One representative of Non-governmental Organisations Member; working in the field of environment (including heritage conservation) to be nominated by the Government of West Bengal – Member;
(iv) Representative of Rural Management Department, Member; Government of West Bengal
(v) Representative of Agriculture Department, Member; Government of West Bengal
(vi) One expert in the area of ecology and environment to be nominated by the Government of West Bengal Member;
(vii) Expert in Biodiversity nominated by State Govt. Member;
(viii) In charge Protected area Member-Secretary.
6. Terms of Reference. - (1) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden in the state as per pro- forma given at Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
