PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 2925] No. 2925] NEW DELHI, MONDAY, OCTOBER 16, 2017/ASVINA 24, 1939 पर्यावरण, वन और जलवयर् ुपररवर्ान मतं्रयलर् अधिसचूनय नई दिल्ली, 12 अक् र्ूबर, 2017 कय.आ. 3342(अ).—प्रयरुप अधिसूचनय भयरर् के रयजपत्र असयियरण में सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 351 (अ), र्यरीख 6 फरवरी, 2017 द्वयरय प्रकयधिर् की गई थी धजसमें ऐसे सभी व्यधिर्ों से, धजनकी उससे प्रभयधवर् होने की संभयवनय थी, उस र्यरीख से, धजसको अधिसूचनय को अन्र्र्वाष्ट करन े वयल े रयजपत्र की प्रधर्र्यं जनर्य को उपलब्ि करय िी गई थीं, सयठ दिन की अवधि के भीर्र आक्षपे और सुझयव आमंधत्रर् दकए गए थ;े और, उि प्रयरुप अधिसूचनय के प्रत्र्ुत्तर में दकन्हीं व्यधिर्ों और पणियररर्ों से कोई आक्षपे और सुक्षयव प्रयप्त नहीं हुए थ;े और, जेसोर वन्र्जीव अभर्यरण्र् गुजरयर् के िो अति महत्वपणूा संरधक्षर् क्षेत्रों में से एक ह,ै र्ह अरयवली पहयडी श्रेणी के अद्भरू् पयररधथथधर्की र्ंत्र कय प्रधर्धनधित्व करर्य ह ै अभर्यरण्र् के प्रमखु प्रजयधर्र्ों में री और िलुाभ और संकटापन्न जैधवक धवधविर्य के िीर्ाकयलीन संरक्षण और सुरक्षय के मुख्र् उदे्दश्य सतिि, जेसोर वन्र्जीव अभर्यरण्र् कय क्षेत्र 180.66 वगा दकलोमीटर र्क फैलय ह ैऔर र्ह गुजरयर् रयज्र् के बनसकयंथय धजलय में अमीरगढ़ और ियंर्ीवयडय र्यलुकों में अब धथथर् ह;ै और, अभर्यरण्र् बनसकयंथय धजलय के उत्तर पधिमी भयग में, बनस निी के पधिम में और सीपू निी के पूवा में धथथर् ह ै बनस निी अभर्यरण्र् के धलए पूवी सीमय बनयर्ी ह ैऔर उि अभर्यरण्र् गुजरयर् और रयजथथयन में अन्र् संरधक्षर् क्षेत्रों के सयथ धनकटर्य बनयए रखन ेवाला एक महत्वपूणा संरधक्षर् के्षत्र ह;ै और, जेसोर वन में प्रचुर वनथपधर् जैव धवधविर्य सतिि उष्णकरटबंिीर् िुष्क पणापयर्ी वन और रेधगथर्यनी कांटेदार वन के रूप में वगीकृर् ह ैऔर थर्नियररर्ों, सरीसृपों, कीटों और पक्षी जीवों की तिन्न-तिन्न ककस्म ेभी िैं और क्षेत्र महत्वपूणा नदिर्ों जैसे सीपू और बनस कय जलग्रहण क्षेत्र ह,ै बनसकयंथय धजले की जल कोष्ठक की ररचयर्जिंग में एक महत्वपूणा भूधमकय धनभयर्य ह;ै और, अभर्यरण्र् के क्षेत्र में प्रचुर वनथपधर् और जीव जन्र् ुके सयथ औषिी पादपों की अच् ी संख्र्य कय संभरण ह ैऔर उि अभर्यरण्र् में वृक्षों, झयधडर्ों, पवार्रोधहर्ों, जडीबूरटर्ों, सेजों, र्यस प्रजयधर्र्ों आकद की अच् ी संख्र्य कय भी संभरण ह ै कु वनथपधर् की मुख्र् प्रजयधर्र्ों में बुटेअ मोनोस्परमा, अनोगेइससुस पेंडुला, लयन्नयइअ कोरोमयंिेलीकय, िीओसपर्रोस मेलयनोक्सर्लोन, कैधिर्य दफसर्ुलय, आदि सधममधलर् ह ै;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, अभर्यरण्र् में 10 उभर्चरों की प्रजयधर्र्यं, 35 सरीसृपों की प्रजयधर्र्यं, 212 पधक्षर्ों की प्रजयधर्र्यं और 27 थर्नियररर्ों की प्रजयधर्र्यं कय वयस ह ै री (मलेोसेरस अरधसनस) अभर्यरण्र् की मुख्र् प्रजयधर् ह ैऔर अभर्यरण्र् क्षेत्र में र्ेंिआु (पैंथरय पयडास) िीषा परितियों में से एक परििी ह ै धजसकय वयस र्हयं ह ैऔर अभर्यरण्र् में वास करन ेवाले अन्र् थर्नियररर्ों में धचत्तीियर लकडबग्र्य (हनैय हनैय), जंगली धबल्ली(फेधलस चयउस), धसर्यर (कैधनस ऑररर्स), भयरर्ीर् लोमडी (वुल््स बेंगलेंधसस), सयमयन्र् लगंूर (सेमनोपीथेकुस इंटेल्लुस), नील गयर् (बोसेलयफुस ट्ररयगोकेमेलुस), पेल हजेहोग (हमेीधचनस मयइक्रोप्रस), भयरर्ीर् गेरधबल (टटेरय इंधडकय), आदि सधममधलर् हैं;
और, अभर्यरण्र् के अत्रं्र् बंि आसपयस के क्षेत्र में मयनव बथर्ी, चालू रही धवकयसयत्मक दक्रर्यकलयप, औद्योगीकरण और खनन दक्रर्यकलयप अभर्यरण्र् के चयरों ओर ह,ै उधचर् सुरक्षय उपयर्ों और को मदे्दनजर रखर्े हुए दीर्घ कातलक वन्र्जीव संरक्षण ऐसे दक्रर्यकलयपों पर तनयत्रण की आवश्यकिा ह;ै और, जेसोर वन् र्जीव अभर्यरण्र्, के चयरों ओर के क्षेत्र को, पयररधथथधर्की र्थय पर्यावरण की िधृष्ट से पयररधथथधर्की संवेिी जोन के रूप में सुरधक्षर् और करनय आवश्र्क ह;ै अर्ः, अब, केन्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के साथ पठिि पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप धारा (3) केन्र सरकयर द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर् ेहुए, जेसोर वन् र्जीव अभर्यरण्र् की सीमय के संरधक्षर् क्षेत्र से 0 ककलोमीटर से 3.2 ककलोमीटर र्क के धवथ र्यररर् क्षेत्र को जेसोर वन् र्जीव अभर्यरण्र् गुजरयर् रयज्र् में अमीरगढ़ और ियंर्ीवयडय र्यलुकों में जेसोर वन में पयररधथथधर्की संवेिी जोन (धजसे इसमें इसके पश् चयर्प पयररधथथधर्की संवेिी जोन कहय गर्य ह)ै के रूप में अधिसूधचर् करर्ी ह,ै धजसकय धववरण धनम्नयनुसयर ह,ै अथयार्प :—
(1) पयररधथथधर्की सवंिेी जोन कय धवथर्यर और उसकी सीमयए.ं—(1) पयररधथथधर्की संवेिी जोन कय धवथर्यर जेसोर वन्र्जीव अभर्यरण्र् के चयरों ओर 0 से 3.2 दकलोमीटर र्क फैलय ह ै रयजथथयन के सयथ अन्र्ररयज्र्ीर् सीमय से उत्तरी और पूवोत्तर कदशाओं की ओर कय धवथर्यर िनू्र् ह ै 0 धवथर्यर कय एक बबंि ुबनस निी की अवतस्थति के कारण िभेलय ग्रयम के पूवा की ओर भी ह ै पयररधथथधर्की संवेिी जोन कय क्षेत्र 116.01 वगा दकलोमीटर ह ै
(2) पयररधथथधर्की संवेिी जोन सीमय के अभर्यरण्र् कय मयनधचत्र उपयबिं I में ह ै और जेसोर वन्र्जीव अभर्यरण्र् और पयररधथथधर्की संवेिी जोन की सीमय के भू-धनिेियंकों की सूची उपयबिं I (क) और (ख) में ह ै
(3) पयररधथथधर्की संवेिी जोन की सीमय कय वणघन उपयबिं II के रुप में उपयबद्ध ह ै|
(4) मुख्र् बबंिओुं के भू धनिेियंकों के सयथ पयररधथथधर्की संवेिी जोन के अंर्गार् आन े वयले 29 ग्रयमों की सूची उपयबिं III के रुप में उपयबद्ध ह ै|
2. पयररधथथधर्की संविेी जोन के धलए आचंधलक महयर्ोजनय –(1) रयज्र् सरकयर, पयररधथथधर्की संवेिी जोन के प्रर्ोजन के धलए रयजपत्र में इस अधिसूचनय के अंधर्म प्रकयिन की र्यरीख से िो वषा की अवधि के भीर्र, थथयनीर् व्यधिर्ों के परयमिा से और इस अधिसूचनय में कदए गए अनुबंिों का पालन करि ेहुए आंचधलक महयर्ोजनय र्रै्यर करेगी
(2) इस प्रकयर र्ैर्यर दकए गए आचंधलक महयर्ोजनय अधिसूचनय में धवधनर्िाष्ट िर्ा के अनरुूप होंगे और पर्यावरणीर् प्रभयव ियधमल होंगे
(3) आंचधलक महयर्ोजनय रयज् र् सरकयर में सक्षम प्रयधिकयरी द्वयरय अनुमोदिर् होगी
(4) पयररधथथधर्की संवेिी जोन के धलए आचंधलक महयर्ोजनय इस अधिसूचनय में धवधनर्िाष् ट रूप में ऐसी रीधर् में रयज् र् सरकयर र्थय सुसंगर् कें रीर् सरकयर और रयज् र् सरकयर धवधिर्ों के अनरुूप भी र्थय कें रीर् सरकयर द्वयरय जयरी मयगाधनिेि, र्दि कोई हों, द्वयरय र्ैर्यर होगी
(5) आंचधलक महयर्ोजनय सभी संबंधिर् रयज् र् सरकयर के धवभयगों के परयमिा से र्ैर्यर होगी, अथयार्प:--
(i) पर्यावरण;
(ii) वन और वन्र्जीव;
(iii) कृधष ;
(iv) रयजथ व;
(v) शिरी धवकयस;
(vi) पर्ाटन;
(vii) ग्रयमीण धवकयस;

(viii) बसंचयई और बयढ़ धनर्ंत्रण;
(ix) नगरपयधलक;
(x) पंचयर्र्ी रयज;
(xi) गुजराि रयज् र् प्रिषूण धनर्ंत्रण बोडा

(6) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भू-उपर्ोग, अवसंरचनयत् मक और दक्रर्यकलयपों पर कोई धनबिंिन िब िक अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में और आचंधलक महयर्ोजनय में सभी अवसंरचनय और अधिक प्रभयवी और पयररधथथधर्की अनुकूल दक्रर्यकलयप कयरक इस प्रकयर धवधनर्िाष् ट न हो
(7) आचंधलक महयर्ोजनय में अनयच् यदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मृिय और नमी संरक्षण, थथयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधथथधर्की और पर्यावरण से संबंधिर् ऐसे अन्र् पहलओुं, धजन पर ध्र्यन िेनय आवश्र्क ह,ै के धलए उपबंि होंगे
(8) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय थ थलों, ग्रयमों और नगरीर् बंिोबथर्ों, वनों के प्रकयरों और दकथ मों, कृधष क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षते्र जैसे उद्ययन और उसी प्रकयर के थ थयन, उद्ययन कृधष के्षत्र, फलोद्ययन, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी और समथानकयरी मयनधचत्र िथा धवद्यमयन और प्रथर्यधवर् भूधम के उपर्ोग की धविेषर्यओं के ब्र्ौरे िेर् ेहुए मयनधचत्रों द्वयरय समर्थार् होगी
(9) आंचधलक महयर्ोजनय पयररधथथधर्की संवेिी जोन में धवकयस को तवतनयतमि करेगी और अधिसूचनय में धवधनर्िाष्ट प्रतितिद्ध तवतनयतमि और संवर्िार् दक्रर्यकलयपों का पालन करेगी तजससे स्थानीय समुदायों की आजीतवका सुरिा के तलए पाठरतस्थतिकी अनुकूल तवकास को सुतनतिि ककया जा सके
(10) इस प्रकयर अनुमोदिर् आचंधलक महयर्ोजनय इस अधिसूचनय में कदए गए उपबंिों के संबधों में अपने कयर्ों को करन ेके धलए मयनीटरी सधमधर् के धलए एक संिभा िथर्यवेज िोगी
3. रयज्र् सरकयर द्वयरय दकए जयन े वयल े उपयर्-- रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करने के धलए धनम्नधलधखर् उपयर् करेगी, अथयार्प :--
(1) भ-ूउपर्ोग - पयररधथथधर्की संवेिी जोन में आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्हर् दकए गए हैं वनों, उद्ययन-कृधष क्षेत्रों, कृधष क्षेत्रों, पयकों और खुल ेथथयनों कय वयधणधज्र्क और औद्योधगक संबद्ध धवकयस दक्रर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय :
परंर् ुपयररधथथधर्की संवेिी जोन के भीर्र कृधष भूधम कय संपररवर्ान, मयनीटरी सधमधर् की धसफयररि पर और रयज्र् सरकयर के पूवा अनुमोिन से, थथयनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करन ेके धलए और पैरय 4 की सयरणी के थर्ंभ
(2) में सूचीबद्ध दक्रर्यकलयपों को पूरय करन ेके धलए अनुज्ञयर् होंग,े अथयार्प :-
(i) पयररधथथधर्की अनुकूल पर्ाटन दक्रर्यकलयपों के धलए पर्ाटकों के अथ थयर्ी आवयसन के धलए पयररधथथधर्की अनुकूल आरयमगयह जैसे टेंट, लकडी के मकयन आदि ;
(ii) धवद्यमयन सडकों को चौडय करनय और उन्हें सुिढृ करनय और नई सडकों कय संधनमयाण;
(iii) प्रिषूण उत्पन्न न करन ेवयले लर्ु उद्योग;
(iv) वषया जल संचर्, और
(v) कुटीर उद्योग, धजसके अंर्गार् ग्रयमीण उद्योग, सुधवियजनक भंडयर और थ थयनीर् सुधवियएं भी हैं :
परंर् ुर्ह और दक जनजयर्ीर् भूधम कय उपर्ोग रयज्र् सरकयर के पूवा अनुमोिन और संधवियन के अनुच् ेि 244 र्य र्त्समर् प्रवृत्त धवधि धजसके अंर्गार् अनसूुधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै के उपबंिों के अनपुयलन के धबनय, वयधणधज्र्क र्य उद्योग धवकयस दक्रर्यकलयपों के धलए अनुज्ञयर् नहीं होगय :
परंर् ुर्ह और भी दक पयररधथथधर्की संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई तु्ररट, मयनीटरी सधमधर् के धवचयर प्रयप्त करने के पियर्प रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक बयर संिोधिर् होगी और उि तु्ररट के संिोिन की सूचनय कें रीर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् को िेनी होगी 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंर् ुर्ह भी दक उपर्ुाि तु्ररट के संिोिन में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू- उपर्ोग कय पररवर्ान सधममधलर् नहीं होगय परंर् ुर्ह भी दक हररर् क्षेत्र जैसे वन क्षेत्र, कृधष क्षेत्र आदि में कोई पयररणयधमक कटौर्ी नहीं होगी और अनप्रर्ुक् र् र्य अनुत् पयिक कृधष क्षेत्रों में पनु: वनीकरण करन ेके प्रर्यस दकए जयएंगे
(2) प्रयकृधर्क जल स्रोर्ों - आचंधलक महयर्ोजनय में सभी प्रयकृधर्क जल स्रोर्ों के आवाि िेत्र की पहचयन की जयएगी िथा उनके संरक्षण और पुनरुद्भूर्करण के धलए र्ोजनय सधम मधलर् होगी और रयज् र् सरकयर द्वयरय र्य उनके धनकट धवकयस दक्रर्यकलयप प्रधर्धषद्ध करने के धलए ऐसी रीधर् से मयगाधनिेि र्रै्यर दकए जयएंगे
(3) पाठरतस्थतिकी पर्ाटन – (क) पयररधथथधर्की संवेिी जोन के भीर्र पर्ाटन संबंिी दक्रर्यकलयप पर्ाटन महयर्ोजनय के अनुसयर होंगे जो दक आंचधलक महयर्ोजनय के भयग रूप में होगी (ख) पाठरतस्थतिकी पर्ाटन महयर्ोजनय, पर्ाटन धवभयग, गुजराि सरकयर द्वयरय रयजथ व और वन धवभयग, गुजराि सरकयर के परयमिा से र्ैर्यर होगी (ग) पर्ाटन महयर्ोजनय आंचधलक महयर्ोजनय के एक र्टक के रूप में होगी (र्) पर्ाटन संबंिी दक्रर्यकलयप धनम नधलधखर् के अिीन धवधनर्धमर् होंग,े अथयार्प
(i) जेसोर वन्र्जीव अभर्यरण्र् की सीमय से 1 दकलोमीटर के भीर्र र्य पयररधथथधर्की संवेिी जोन कय धवथर्यर र्क, इसमें जो भी तनकट हो होटल और ररसोटा के नए संधनमयाण अनुज्ञयर् नहीं होंगे र्थयधप वन्र्जीव अभर्यरण्र् की सीमय से एक दकलोमीटर की िरूी से परे पयररधथथधर्की संवेिी जोन के धवथर्यर र्क नए होटल और ररसोटो की थथयपनय को पूवा अभ्यंककि और धवधनर्िाष्ट क्षते्रों में पयररधथथधर्की पर्ाटन महयर्ोजनय के अनुसयर अनजु्ञयर् दकर्य जयएगय;
(ii) पयररधथथधर्की संवेिी जोन के भीर्र सभी नए पर्ाटन दक्रर्यकलयपों र्य धवद्यमयन पर्ाटन दक्रर्यकलयपों कय धवथर्यर केद्रीय, सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् द्वारा जारी मयगाििाक धसद्धयंर्ों के र्थय रयष् ट्रीर् ा र्यघ्र स संरक्षण प्रयधिकरण, पयररधथथधर्की पर्ाटन (समर्-समर् पर र्थय संिोधिर्) मयगाििाक धसद्धयंर्ों के अनुसयर, पयररधथथधर्की पर्ाटन होगय;
(iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयने र्क, पर्ाटन के धलए धवकयस और धवद्यमयन पर्ाटन दक्रर्यकलयपों के धवथर्यर को वयथर्धवक थथल धवधनर्िाष्ट संवीक्षय र्थय मयनीटरी सधमधर् की धसफयररि पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य जाएगा
(4) धनगरयनी सधमधर् -- प्रथम धनगरयनी सधमधर् की अवधि के पूरय होन ेपर, रयज्र् सरकयर, कें रीर् सरकयर को तनर्दघष्ट ककए धबनय पैरय 5 में िी गई संरचनय के अनुसयर बयि में धनगरयनी सधमधर्र्ों कय पुन: गठन करेगी
(5) नसैर्गाक धवरयसर् -- पयररधथथधर्की संवेिी जोन में महत्वपूणा नैसर्गाक धवरयसर् के सभी थथलों जैसे सभी जीन कोि आरधक्षर् के्षत्र, िैल धवरचनयएं, जल प्रपयर्ों, झरनों, र्यटी मयगों, उपवनों, गुफयए,ं थथलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और उन्हें संरधक्षर् दकर्य जयएगय र्थय उनकी सुरक्षय और संरक्षय के धलए इस अधिसूचनय के अंधर्म प्रकयिन की र्यरीख से ह मयस के भीर्र, उपर्ुि र्ोजनय िैयार की जाएगी और ऐसी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगय
(6) मयनव धनर्मार् धवरयसर् थ थल - पयररधथथधर्की संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंथकृधर्क महत्व के क्षेत्रों की पहचयन की जयएगी और इस अधिसूचनय के प्रकयिन की र्यरीख से ह मयस के भीर्र उनके संरक्षण की र्ोजनयएं र्ैर्यर की जयएंगी र्थय ऐसी र्ोजनय आंचधलक महयर्ोजनय में समातवष्ट की जाएगी
(7) ध् वधन प्रिषूण – पयररधथथधर्की संवेिी जोन में ध् वधन प्रिषूण के धनर्ंत्रण के धलए गुजराि रयज् र् सरकयर कय पर्यावरण धवभयग र्य रयज् र् प्रिषूण धनर्ंत्रण पर्यावरण (संरक्षण) अधिधनर्म, 1986, के अिीन बनाए गए बोडा ध्वधन प्रिषूण (धवधनर्मन और धनर्ंत्रण) धनर्म 2000 उपबंिों के अनुसयर ध्वधन प्रिषूण के धनर्ंत्रण के धवधनर्मों को कयर्याधन्वर् करेगय
(8) वयर् ुप्रिषूण - पयररधथथधर्की संवेिी जोन में, वयर्ु प्रिषूण के धनर्ंत्रण के धलए धवधनर्मों का वयर्ु (प्रिषूण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर अनुपालन ककया जाएगा

(10) ठोस अपधिष्ट -- ठोस अपधिष्टों कय धनपटयन धनम्नधलधखर् रूप में होगय--

(13) सधंनमयाण और धवध्वसं अपधिष्ट प्रबिंन: - पयररधथथधर्की संवेिी जोन में संधनमयाण और धवध्वंस अपधिष्ट प्रबंि भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सय.कय.धन 317(अ), र्यरीख 29 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धवध्वंस प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय
(14) ई–अपधिष्ट:- पयररधथथधर्की संवेिी जोन में ई–अपधिष्ट प्रबंि भयरर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् द्वयरय ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय
(15) र्यनीर् पररवहन: - पररवहन का र्यनीर् संचलन आवयस अनुकूल रीधर् में धवधनर्धमर् ककया जाएगा और इस संबंि में आंचधलक महयर्ोजनय में धवधनर्िाष्ट उपबंि समयधवष्ट दकए जयएंग ेऔर आंचधलक महयर्ोजनय के र्ैर्यर होने और रयज्र् सरकयर के सक्षम प्रयधिकयरी द्वयरय के अनुमोदिर् होने र्क, मयनीटरी सधमधर् सुसंगर् अधिधनर्मों र्थय र्ििीन बनयए गए धनर्मों और धवधनर्मों के अिीन र्यनीर् संचलन के अनुपयलन को मयनीटर करेगी
(16) औद्योधगक ईकयइर्य ं– (क) प्रथर्यधवर् पयररधथथधर्की संवेिी जोन के भीर्र नए कयष्ठ आियररर् उद्योगों के दकसी थथयपन की अनुज्ञय धवधि के अनुसयर थथयधपर् धवद्यमयन कयष्ठ आियररर् उद्योगों के धसवयए नहीं िी जयएगी (ख) प्रथर्यधवर् पयररधथथधर्की संवेिी जोन के भीर्र जल, वयर्ु, मृिय, ध्वधन प्रिषूण कयररर् करन ेवयल ेदकसी नए उद्योग के दकसी थथयपन की अनुज्ञय नहीं िी जयएगी
4. पयररधथथधर्की सवंिेी जोन में प्रधर्धषद्ध र्य धवधनर्धमर् दकए जयन ेवयल ेदक्रर्यकलयपों की सचूी - पयररधथथधर्की संवेिी जोन में सभी दक्रर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) और िद्धीन बनाए गए तनयमों तजनके अन्िगघि र्टीर् धवधनर्मन जोन (सीआरजेड), 2011 और पर्यावरणीर् प्रभयव आकलन (ईआईए ) अधिसूचनय, 2006 और वन (संरक्षण) अधिधनर्म, 1980 (1980 के 69), भयरर्ीर् वन अधिधनर्म, 1927 (1927 के 16), वन्र्जीव (संरक्षण) अधिधनर्म, 1972 (1972 के 53) के उपबंिों र्थय उनमें दकए गए संिोिनों द्वयरय ियधसर् होंगे और नीचे िी गई सयरणी में धवधनर्िाष्ट रीधर् में धवधनर्धमर् होंगे, अथयार्प :-- क्रम स.ं दक्रर्यकलयप टीकय-रट्पणी

(ख) खनन संदक्रर्यएं, ररट र्यधचकय (धसधवल) सं. 1995 कय 202 टी.एन. गौडयबमान धथरुमलूपयि बनयम भयरर् सरकयर के मयमले में उच्चर्म न्र्यर्यलर् के आिेि र्यरीख 4 अगथर्, 2006 और ररट र्यधचकय (सी) सं. 2012 कय 435 गोवय फयउंडेिन बनयम भयरर् सरकयर के मयमले में र्यरीख 21 अप्रलै, 2014 के आिेि के अनुसयर की जयएंगी
2. प्रिषूण (जल, वयर्,ु मृिय, ध् वधन आदि) कयररर् करन ेवयले उद्योगों की थ थयपनय पयररधथथधर्की संवेिी जोन में नए उद्योग और में धवद्यमयन प्रिषूणकारी उद्योगों के धवथर्यर को अनुज्ञय नहीं दी जाएगी 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जब र्क दक अधिसूचनय में इस प्रकयर धवधनर्िाष्ट न हो, फरवरी, 2016 में कें रीर् प्रिषूण धनर्ंत्रण बोडा द्वयरय जयरी दिियधनिेिों में उद्योगों के वगीकरण के अनुसयर पयररधथथधर्की संवेिी जोन के भीर्र केवल गरै- प्रिषूणकारी उद्योगों की अनुज्ञय िी जयएगी
3. बृहर् जल धवदु्यर् पररर्ोजनय की थथयपन लयग ू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे
4. दकसी पररसंकटमर् पियथों कय उपर्ोग र्य उत्पयिन र्य प्रसंथकरण लयग ू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे
5. प्रयकृधर्क जल धनकयर्ों र्य भूधम के्षत्र में अनुपचयररर् बधहस्त्रयवों कय धनथसयरण लयग ू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे
6. नई आरय धमलों की थथयपनय पयररधथथधर्की संवेिी जोन के भीर्र नई या धवद्यमयन आरय धमलों कय धवथ र्यर अनुज्ञयर् नहीं होगय
7. जलयवन लकडी कय वयधणधज्र्क उपर्ोग लयग ू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे
8. पोधलथीन बैगों कय उपर्ोग लयग ू धवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे
9. ईंट भट्टों की थथयपनय करनय लयग ूधवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्)
10. मध्यम धनत्व के फाइबर बोर्घ/ पार्टघकल बोर्घ की स्थापना लयग ूधवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्)
11. वयधणधज्र्क हलेीकय्टर सेवा। लयग ूधवधिर्ों के अनुसयर प्रधर्धषद्ध (अन् र्थय उपबंधिर् के धसवयर्) धवधनर्धमर् दक्रर्यकलयप
12. होटलों और ररसोटों की वयधणधज्र्क थथयपनय पयररधथथधर्की पर्ाटन दक्रर्यकलयप संबंधी लर्ु अथथयर्ी संरचना के तसवाय आवयस के जेसोर वन्यजीव अियारण्य के संरधक्षर् क्षेत्र की सीमय के एक दकलोमीटर र्य पयररधथथधर्की संवेिी जोन की सीमय र्क, जो भी धनकट हो, के भीर्र ही नए वयधणधज्र्क होटलों और ररसोटों को अनजु्ञयर् दकर्य जयएगय:
परन्र् ु संरधक्षर् क्षेत्र की सीमय से एक दकलोमीटर से परे या पयररधथथधर्की संवेिी जोन के धवथर्यर र्क जो िी तनकट िों सभी नए पर्ाटन दक्रर्यकलयपों र्य धवद्यमयन दक्रर्यकलयपों कय धवथर्यर पर्ाटन महयर्ोजनय और यथा लाग ूमागघदशघक तसद्धांिों के अनरुुप होगय
13. संधनमयाण दक्रर्यकलयप संरधक्षर् क्षेत्र की सीमय से एक दकलोमीटर के भीर्र र्य पयररधथथधर्की संवेिी जोन के धवथर्यर र्क,जो भी धनकट हो, दकसी भी प्रकयर कय नया वयधणधज्र्क संधनमयाण अनुज्ञयर् नहीं दकर्य जयएगय:
परंर्ु थ थयनीर् लोगों को परैय के 6 उप पैरय (1) में सूचीबद्ध दक्रर्यकलयपों सधहर् उनके उपर्ोग के धलए उनकी भूधम में थथयनीर् तनवातसयों की आवयसीर् आवश्र्कर्यओं को पूरय करन े धलए संधनमयाण करन े की अनुमधर् भवन उपधवधिर्ों के अनुसयर िी जयएगी
(i) धवद्यमयन सडकों को चौडय करनय और उन्हें सुिढृ करनय और नई सडकों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुख-सुधवियओं कय संधनमयाण II (ii) 7 और नवीकरण;
(iii) कुटीर उद्योगों धजनके अंर्गार् ग्रयमीण उद्योग हैं; सुधविय भण्डयर और थथयनीर् सुख सुधवियओं जो पयररधथथधर्की पर्ाटन में, धजस में ग्रह वयस भी ह,ै सहयर्क हो; और
(iv) इस अधिसूचनय में सूचीबद्ध संवर्िार् दक्रर्यकलयपों की सूची :
14. होटलों और लॉज के धवद्यमयन पररसरों में बयड लगयनय लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े
15. प्रिषूण उत्पन्न न करन ेवयले लर्ु उद्योग फरवरी, 2016 में केन्रीर् प्रिषूण धनर्ंत्रण बोडा द्वयरय जयरी उद्योगों में वगीकरण के अनुसयर शे्वि वगघ के रूप में पठरिातिि गैर-प्रिषूणकयरी उद्योग और अपठरसंकटमय, लर् ु और सेवय उद्योग, कृधष, पुष्प कृधष, उद्ययन कृधष र्य पयररधथथधर्की संवेिी जोन से िेिी सयमग्री से उत्पयिों को उत्पन्न करने वयले कृधष आियररर् उद्योग सक्षम प्रयधिकयरी द्वयरय अनुज्ञयर् होंगे
16. वृक्षों की कटयई (क) रयज्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुमधर् के धबनय वन, सरकयरी र्य रयजथव र्य धनजी भूधम पर वृक्षों की कोई कटयई नहीं होगी (ख) वृक्षों की कटयई संबंधिर् कें रीर् र्य रयज्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंि के अनुसयर धवधनर्धमर् होगी
17. धवदु्यर् केबलों और िरूसंचयर टयवरों कय पररधनमयाण और केबलों का धब यया जयना और अन्र् बुधनर्यिी ढयंचे रेल लाइनों के तसवाय लयग ू धवधिर्ों के अिीन धवधनर्धमर् होंगे भूधमगर् केबल के धब यए जयने को बढ़यवय दिर्य जयएगय

21. प्रयकृधर्क जल धनकयर्ों र्य सर्ही के्षत्र में उपचयररर् अपधिष्ट जल/बधहस्रयाव कय धनथसयरण उपचयररर् अपधिष्ट जल/बधहस्रयाव के धनथसयरण को जल धनकयर्ों में प्रवेि नहीं करन े दिर्य जयएगय उपचाठरि अपतशष्ट जल का पुनचघिण और पुन: उपयोग करने का प्रयास ककया जाएगा अन्र्थय लयगू धवधिर्ों के अनुसयर उपचयररर् जल बधहस्रयाव कय धनथसयरण धवधनर्धमर् दकर्य जयएगय
22. सर्ह और भूजल कय वयधणधज्र्क उपयोग और धनष्कषाण लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंगे
23. वयर्ु, र्यधनक और ध्वधन प्रिषूण लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंगे
24. धविेिी प्रजयधर्र्ों को लयनय लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंगे
25. वयधणधज् र्क सयइनबोडा और होर्डिंग लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े

5. धनगरयनी सधमधर् - कें रीर् सरकयर, पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 3 की उपियरय (3) के अधीन इस अधिसूचना के उपबंधों की प्रिावी मानीटरी के तलए पिली धनगरीनी सधमधर् गरठर् करर्ी ह,ै पहली धनगरयनी सधमधर् की अवधि के परूय होने पर, रयज्र् सरकयर कें द्रीय सरकयर को तनर्दघष्ट ककए धबनय तनम्नतलतखि संरचनय के अनुसयर पिािविी धनगरयनी सधमधर्र्ों कय पुनगघिन करेगी:
(i) कलेक्टर, बनयसकयंथा -अध् र्क्ष;
(ii) प्रकृधर् संरक्षण के क्षेत्र में कयर्ा करन ेवयले गैर सरकयरी संगठनों (धजसके अंर्गार् धवरयसर् संरक्षण भी ह)ै कय र्ीन वषा की अवधि के धलए सरकयर द्वयरय नयमधनर्िाष्ट -सिथर्;
II (ii) 9 दकए जयने वयलय एक प्रधर्धनधि
(iii) क्षेत्रीर् अधिकयरी, गुजरयर् रयज्र् प्रिषूण धनर्ंत्रण बोडा, बनयसकयंथा -सिथर्;

(v) गुजरयर् सरकयर के पर्यावरण और वन धवभयग द्वयरय नयम धनर्िाष्ट एक प्रधर्धनधि -सिथर्;
(vi) पयररधथथधर् धवज्ञयन और पर्यावरण के क्षेत्र में गुजरयर् सरकयर द्वयरय नयधमर् एक प्रधर्धनधि -सिथर्;

6.धनिेि धनबिंन -(1) मानीटरी सधमधर् कय कयर्ाकयल र्ीन वषा र्क र्य रयज्र् सरकयर द्वयरय नई सधमधर् के पुन: गठन के धलए होगय और बयि में धनगरयनी सधमधर् रयज्र् सरकयर द्वयरय गरठर् की जयएगी
(2) मयनीटरी सधमधर् इस अधिसूचनय के उपबंिों के अनुपयलन को मयनीटर करेगी
(3) धनगरयनी सधमधर् उन दक्रर्यकलयपों को अनुज्ञयर् निीं करेगी जो भयरर् सरकयर के र्त्कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनयओं अथयार्प पर्यावरण प्रभयव मूल्र्यंकन अतधसूचना, 2006 सं.कय.आ.1533 (अ), र्यरीख 14 धसर्ंबर, 2006 और र्टीर् धवधनर्म जोन, 2011 सं.कय.आ 19 (अ), र्यरीख 6 जनवरी, 2011 र्थय इनमें दकए गए पररवर्ी संिोिनों की अनुसूची के अरं्गार् आर् ेहैं और जो पयररधथथधर्की संवेिी जोन की सीमय में भी आर् ेहैं धजनमें इस अधिसूचनय के परैय-4 में िी गई सयरणी में र्थयधवधनर्िाष्ट प्रधर्धषद्ध दक्रर्यकलयप भी ियधमल िैं श्वेर् श्रणेी के उद्योगों को ही ‘’उद्योगों के वगीकरण, 2016’’ के धलए केन्रीर् प्रिषूण धनर्ंत्रण बोडा द्वयरय जयरी मयगाििी धसद्धयंर्ों में धवधनर्िाष्ट मयनय जयएगय

8. कोई अन् र् महत् वपूणा धवषर् II (ii) 15 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 12th October, 2017 S.O. 3342(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 351(E), dated the 6 th February, 2017, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification;
AND WHEREAS, the Jessore Wildlife Sanctuary is one of the two most important Protected Areas of Gujarat, representing the unique ecosystem of Aravalli mountain range. With the prime aim of long term protection and conservation of the flagship species of the Sanctuary, Sloth Bear and the rare and endangered biological diversity, the Jessore Wildlife Sanctuary is spread over an area of 180.66 square kilometres and is located in Talukas Amirgadh and Dantivada in Banaskantha district in the State of Gujarat State;
AND WHEREAS, the Sanctuary is situated in the North-Western part of Banaskantha district, west to the Banas River and east to the Sipu River. Banas River forms the Eastern boundary for the Sanctuary and the said Sanctuary is an important protected area maintaining contiguity with other Protected Areas in Gujarat and Rajasthan;
AND WHEREAS, Jessore forest is categorised as Tropical Dry Deciduous and Desert Thorn Forest, with rich plant biodiversity and also varieties of mammals, reptiles, insects and avifauna and the area is catchment of important rivers like Sipu and Banas, playing an important role in recharging the water table of Banaskantha district;
AND WHEREAS, the sanctuary supports good number of medicinal plants along with rich flora and fauna of the region and the said Sanctuary also supports a good number of trees, shrubs, climbers, herbs, sedges, grass species, etc. Some of the major species of Flora include Butea monosperma, Anogeissus pendula, Lannea coromandelica, Diospyros melanoxylon, Cassia fistula, etc;
AND WHEREAS, the Sanctuary is home to 10 species of amphibians, 35 species of reptiles, 212 species of birds, and 27 species of mammals. Sloth bear (Melursus ursinus) is the flagship species of the Sanctuary and the leopard (Pathera pardus) is one of the top inhabiting predators and the other mammals inhabiting the Sanctuary include the striped hyaena (Hyaena hyaena), jungle cat (Felis chaus), jackal (Canis aureus), Indian fox (Vulpes bengalensis), Hanuman langur (Semnopithecus entellus), Nilgai (Boselaphus tragocamelus), Pale hedgehog (Hemiechinus micropus), Indian Gerbil (Tatera indica), etc.;
AND WHEREAS, the extremely closed vicinity of the sanctuary to human habitation, ongoing developmental activities, industrialization and mining activities around the Sanctuary, necessitate the requirement of proper safeguards and control over such activities in view of long term wildlife conservation;
AND WHEREAS, it is necessary to conserve and protect the area around the protected area of the Jessore Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view.
NOW THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub - section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and subrule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area with an extent ranging from 0 kilometre to 3.2 kilometres from the boundary of the protected area of the Jessore Wildlife Sanctuary in Amirgadh and Dantivada Talukas in the State of Gujarat as the Jessore Wildlife Sanctuary Eco-sensitive Zone (herein after called as Eco-sensitive Zone).
1. Extent and boundaries of Eco-sensitive Zone.—(1) The extent of the Eco-sensitive Zone varies from 0 to 3.2 kms. around Jessore Wildlife Sanctuary. Zero extent is towards Northern and North-eastern sides sharing interstate boundary with Rajasthan. 0 extent is also at one point towards East at Dabhela village due to location of River Banas. The area of the Eco-sensitive Zone is 116.01 square kilometres.

(2) The map of the Sanctuary demarcating the Eco-sensitive Zone boundary is at Annexure I and the list of geo co-ordinates of the boundary of Jessore Wildlife sanctuary and Eco -sensitive Zone is at Annexure I (A) and (B) respectively.
(3) The Boundary description Eco-sensitive Zone is appended as Annexure II.
(4) The list of 29 villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure III.
2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan so prepared shall commensurate with the stipulation specified in the Notification and include the environmental implications.
(3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipality;
(x) Panchayati Raj;
(xi) Gujarat State Pollution Control Board;
(xii) Public Works Department.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, archaeological monuments, heritage structures, villages and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and promoted activities specified in the Notification so as to ensure Eco-friendly development for livelihood security of local communities.

(10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed in column (2) of the Table in paragraph 4, namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism activities;
(ii) widening and strengthening of existing roads and construction of new roads;
(iii) small scale industries not causing pollution;
(iv) rainwater harvesting; and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or and restrict development activities within the catchment areas.
(3) Eco-tourism.—(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-tourism Master Plan shall be prepared by the Department of Tourism, Government of Gujarat in consultation with Department of Revenue and Forests, Government of Gujarat.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities relating to tourism shall be regulated as under, namely.-
(i) No new construction of hotels and resorts shall be allowed within 1 km. from the boundary of the Jessore Wildlife Sanctuary or upto the extent of the Eco-Sensitive Zone whichever is nearer. and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Ecotourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by the National Tiger 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Conservation Authority (as amended from time to time) with emphasis on Eco-tourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Monitoring Committee.—Upon completion of the term of the first Monitoring Committee, the State Government shall re-constitute the subsequent Monitoring Committees as per the composition given at Para 5, without referring to the Central Government.
(5) Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(6) Man-made heritage sites.—Buildings, structures, artefacts areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(7) Noise pollution.—The Environment Department of the State Government or Gujarat State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 formed under the Environment (Protection) Act, 1986.
(8) Air pollution.—Regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with.
(9) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made thereunder .–
(10) Solid wastes. —Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016.
(ii) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(11) Bio-medical waste.—(i)The bio-medical waste management and disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28 th March, 2016
(ii) No common treatment facility or incineration shall be permitted within the Eco -sensitive Zone.
(12) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016.
(13) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E), dated the 29th March, 2016.

(14) E-waste.—The E-Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change .
(15) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(16) Industrial Units.—(a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.—All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:— Sl. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N.
Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new industries and expansion of existing polluting industries in the Eco-sensitive Zone shall be permitted.
Only non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major thermal and hydroelectric projects.

4. Use or production or processing of any hazardous substances.

6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
7. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
8. Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
10. Setting up of Medium Density Fibreboard/Particle Board.
Prohibited (except as otherwise provided) as per applicable laws.
11. Commercial Helicopter Services. Prohibited (except as otherwise provided) as per applicable laws.
Regulated activities
12. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area of Jessore Wildlife sanctuary or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
13. Construction activities. No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 6 as per building bye-laws to meet the residential needs of the local residents such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) cottage industries including village industries;
convenience stores & local amenities supporting ecotourism including home stays; and
(iv) promoted activities listed in this Notification.

14. Fencing of premises of hotels and lodges.
Regulated under applicable laws.
15. Small scale non polluting industries. Non polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
16. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
17. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws except railway lines.
Underground cabling may be promoted.
18. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
19. Protection of Hill Slopes and river banks. Regulated under applicable laws.
20. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
21. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water.
Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
22. Commercial use and extraction of surface and ground water.
Regulated under applicable laws.
23. Air, vehicular and Noise pollution. Regulated under applicable laws.
24. Introduction of Exotic species. Regulated under applicable laws.
25. Commercial Sign boards and hoardings. Regulated under applicable laws.
26. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
27. Collection of Forest produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws except for local people.
28. Under taking other activities related to tourism like over flying the Eco Sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

5. Monitoring Committee.—(1) The Central Government hereby constitutes the first Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986. Upon completion of the term of the first Monitoring Committee, the State Government shall re-constitute the subsequent Monitoring Committees as per the following composition without referring to the Central Government:-
(i) Collector, Banaskantha —Chairperson;
(ii) A representative of Non-governmental Organisation working in the field of environment (including heritage conservation) to be nominated by the Government of India for a period of three years —Member;
(iii) Regional Officer, Gujarat State Pollution Control Board, Banaskantha —Member;
(iv) Senior Town Planner of the area —Member;
29. Solid Waste Management. Regulated under applicable laws.
30. Eco-tourism. Regulated under applicable laws
31. Biomedical Waste Management. Regulated under applicable laws.
32. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
Promoted activities
33. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
34. Organic farming. Shall be actively promoted.
35. Adoption of green technology for all activities.

36. Rain water harvesting. Shall be actively promoted.
37. Cottage industries including village artisans.

39. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted
40. Agro Forestry. Shall be actively promoted.
41. Environmental Awareness. Shall be actively promoted.
42. Use of eco-friendly transport. Shall be actively promoted.
43. Skill Development. Shall be actively promoted.
44. Restoration of Degraded Land/ Forests/ Habitat.
Shall be actively promoted.

(v) A representative of the Department of Forest and Environment, Government of Gujarat —Member;
(vi) One expert in the area of Ecology and Environment to be nominated by the Government of Gujarat for a period of three years —Member;
(vii) Member, State Biodiversity Board —Member;
(viii) Deputy Conservator of Forests (In Charge of the Jessore Wildlife Sanctuary), Banaskantha —Member Secretary.
6.Terms of Reference.-
(1) The tenure of the Committee shall be three years or till the constitution of the new committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment, 2006 vide S.O. 1533 (E), dated the 14th September, 2006, and Coastal Regulation Zone, 2011 vide S.O. No. 19(E) dated 6 th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14 th September, 2006 and S.O. 19 (E) dated 6 th January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wild Life Warden of the State under intimation to the Ministry of Environment, Forest and Climate Change as per proforma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
