PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् अजधसचूना नई दिल्ली, 12 अक् तूबर, 2020 का.आ. 3583.(अ)—एक प्रारुप अजधसूचना भारत के रािपत्र, असाधारण में भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान, मंत्रालर् की अजधसूचना सं. का.आ. 1016 (अ), तारीख 6 मार्च, 2020, द्वारा प्रकाजित की गई थी जिसमें ऐसे सभी व्यजिर्ों से, जिनके उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना से र्ुि रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उि प्रारूप अजधसूचना से र्ुि रािपत्र की प्रजतर्ां िनता को तारीख 6 मार्च, 2020, को उपलब्ध करा िी गई थी;

और, मनाली वन्र्िीव अभर्ारण्र् वन्र्िीवों की वास जविेष जवजवधताओं के जलए िाना िाता ह,ै अभर्ारण्र् में मखु्र् वन्र्िीव प्रिाजतर्ां तेंिआु (पैंथरेा पाडास), तेंिआु जबल्ली (फेजलस बेंगालेंजसस), िंगली जबल्ली (फेजलस चाउस), जहमालर्न जसवेट (पैगोमा लारवाटा), जहमालर्न र्लेो थ्रोटेड माटेन (माटेस फ्लैजवगलुा), काला भाल ू(सेलेनारैक्टस जथबेटानस), साही (जहस्ट्रीक्स इंजडका), फ्लांइग जगलहरी (पेटौररस्ट्ता पेटौररस्ट्ता), बंिर (मकाका मुल्लाटा), लंगरू (प्रेजस्ट्बरटस एंटेलस), गोरल (नेमोरहडेस गोरल), काकड (मुनटिैकस मुंटिैक), जसर्ार (कैजनस ऑररर्स), वेस्ट्टना रागोपैन (रगोपैन मलेानोसेफालस), आदि पाई िाती हैं, अभर्ारण्र् जहमाचल प्रिेि में पाए िाने वाली तीतर की सात प्रिाजतर्ों में से चार प्रिाजतर्ों का वास स्ट्थल ह,ै इसे भारत में जहमालर्ी के्षत्र में प्रजतबंजधत जहमालर्ी मोनाल, स्ट्थाजनक िलुाभ प्रिाजतर्ों के जलए महत्वपूणा पक्षी के्षत्र के रूप में मान्र्ता िी गई ह,ै अभर्ारण्र् में सामान्र्तः पक्षी िैसे व्हाइट के्रस्ट्टेड कलीि, चुकर, ब्लैक और ग्रे तीतर और सरीसृप िैसे सांप, मॉनीटर जछपकली में पाए िात ेह;ै और, मनाली वन्र्िीव अभर्ारण्र् के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाएं पाररस्थथस्तकी पयाचवरणीय से पाररस्थथस्तकी संवेदी जोन के रूप में परैा 1 में जवजनर्िाि हैं, जैव स्वस्वस्िता की िजृि से सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वर्गों के प्रचालन और प्रसंस्ट्करण करन ेको प्रजतजषद्ध करना आवर्क ह;ै [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 अतः, अब, केन्र्द्ीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (स्जसे इस अस्िसूर्ना में इसके प चात पयाचवरण अस्िस्नयम कहा र्गया ह)ै की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, स्हमार्ल प्रदेश राज्र् के कुल्ल ू स्जला के मनाली वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 120 मीटर से
1.800 ककलोमीटर तक जवस्ट्ताररत क्षेत्र को मनाली वन्र्िीव अभर्ारण्र् पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके प चातप पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाातप :-
1.पाररजस्ट्थजतकी संविेी िोन का जवस्ट्तार और सीमाएं.-(1) पाररजस्ट्थजतकी संवेिी िोन का स्वथतार मनाली वन्र्िीव अभर्ारण्र् की सीमा के र्ारों ओर 120 मीटर से 1.800 दकलोमीटर तक ह ैऔर पाररस्थथस्तकी संवेदी जोन का क्षेत्रफल
15.68 वर्गच ककलोमीटर ह।ै पाररजस्ट्थजतकी-संवेिी िोन का के्षत्र जववरण जनम् नानुसार ह:ै- क्र. स.ं वन का नाम कम्पाटामेंट की सखं्र्ा क्षते्र वगा दकलोमीटर में 1 डी पी एफ 2/4 संचल िील सम्पूणा 1.287 2 डी पी एफ 2/3 िैनग िील सम्पूणा 4.997 3 डी पी एफ 1/1 बिरंुिी सी-Iए, Iबी, IIए, VI 1.790 4 डी पी एफ 2/7 कजनर्ालघर सी-I,III 1.938 5 III वगा वन 5.668 कुल 15.68
(2) मनाली वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का वणान उपाबधं-I के रूप में संलग् न ह।ै
(3) सीमा जववरण और अक्षांि और िेिांतर के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करत े हुए मनाली वन्र्िीव अभर्ारण्र् का मानजचत्र उपाबधं-IIक और उपाबधं-IIख के रूप में संलग् न ह।ै
(4) पाररजस्ट्थजतकी संवेिी िोन और मनाली वन्र्िीव अभर्ारण्र् की सीमा के भू-जनिेिांकों की सूची उपाबधं-III की सारणी क और सारणी ख में िी गई ह।ै
(5) पाररजस्ट्थजतकी संवेिी िोन के अतंगात कोई रािस्ट्व ग्राम नहीं ह।ै
2. पाररजस्ट्थजतकी संविेी िोन के जलए आचंजलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्य के सक्षम प्रास्िकारी के अनुमोदन के स्लए इस अजधसूचना में दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी।
(2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए हैं, के अनुसार तथा सुसंगत कें र्द्ीर् और राज् र् जवजधर्ों के अनरुुप और कें र्द्ीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी ।
(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी.-
(i) पर्ाावरण;
(ii) वन और वन्र्िीव;
(iii) कृजष;

(iv) रािस्ट् व;
(v) िहरी जवकास;
(vi) पर्ाटन;
(vii) ग्रामीण जवकास;
(viii) पसंचाई और बाढ़ जनर्ंत्रण;
(ix) नगरपाजलका;
(x) पंचार्ती राि;
(xi) जहमाचल राज्र् प्रिषूण जनर्ंत्रण बोडा; और
(xii) लोक जन मााण जव भाग।
(4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दक्रर्ाकलापों में, िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समिुार्ों की आवर्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलओुं, जिन पर ध्र्ान िेना आवर्क ह,ै के जलए उपबंध होंग े।
(6) आंचजलक महार्ोिना स्वद्यमान और प्रथतास्वत भूस्म उपयोर्ग स्वशेषताओं के ब्यौरों से अनुसमर्थचत मानस्र्त्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजष क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजष क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्कंन करेगी।
(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और पैरा-4 में सारणी में सूचीबद्ध प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों की जीस्वका को सुरस्क्षत करन ेके स्लए पाररजस्ट्थजतकी अनुकूल जवकास को सुस्नस्ित और उसकी अस्भवृस्ि भी करेर्गी।
(8) आंचजलक महार्ोिना प्रादेस्शक जवकास र्ोिना की सह जवस्ट्तारी होगी ।
(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार स्नर्गरानी के अपन ेकार्ों को करने के जलए स्नर्गरानी सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी ।
3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेगी, अथाातप:-
(1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजष क्षेत्रों, कृजष क्षेत्रों, मनोरंजन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुल ेस्ट्थानों का वाजणजज्र्क या आवासीय या औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा:
[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 परंत ुपाररजस्ट्थजतकी संवेिी िोन के भीतर उपयुचक्त भार्ग (क) में जवजनर्िाि प्रर्ोिनों से जभन्नों प्रर्ोिनों के जलए कृजष और अन्र् भूजम का संपररवतान स्नर्गरानी सजमजत की जसफाररि पर और र्था लाग ूऔर क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्र्द्ीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवर्कताओं को पूरा करन ेके जलए अनुज्ञात दकर्ा िाएगा, िैसे:-
(i) जवद्यमान सडकों को चौडा करना और उन्हें सुिढृ़ करना तथा नई सडकों का संजनमााण;
(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रिषूण उत्पन्न न करन ेवाले लघु उद्योग;
(iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी हैं; सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन स्जसके अन्तर्गचत र्गहृ वास सजम्मजलत ह;ै और
(v) पैरा 4 के अिीन कदए र्गए संवर्धात दक्रर्ाकलाप:
परंत ुर्ह और दक प्रादेस्शक नगर र्ोिना स्वस्ि और राज्य सरकार के अन्र् जनर्मों और जवजनर्मों के अिीन सक्षम प्रास्िकारी के पूवच अनुमोदन और संजवधान के अनुच्छेि 244 के उपबंिों या तत्समर् प्रवृत्त जवजध के उपबंधों के अनुपालन के जबना, जिसके अिीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै वाजणजज्र्क र्ा औद्योस्र्गक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा:
परंत ु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई र्गलती, स्नर्गरानी सजमजत के जवचार प्राप्त करने के पश्चातप राज्र् सरकार द्वारा प्रत्र्ेक मामल ेमें एक बार ठीक होगी और उि र्गलती के सुिार की सूचना कें र्द्ीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी:
परंत ुर्ह और भी दक र्गलती के सुधार में इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू- उपर्ोग का पररवतान सजम्मजलत नहीं होगा;
(ख) वनीकरण तथा वास िीणोद्धार दक्रर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजष क्षेत्रों में पनु: वनीकरण करने के प्रर्ास दकए िाएंग।े
(2) प्राकृजतक िल स्रोतों.- आचंजलक महार्ोिना में सभी प्राकृजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दक्रर्ाकलाप प्रजतजषद्ध करने के बारे में जो ऐसे क्षेत्रों के स्लए अस्हतकर हो ऐसी रीजत से मार्गचदशचक जसद्धांत तैर्ार दकए िाएंगे।
(3) पर्ाटन र्ा पाररस्थथस्तकी पयचटन.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररस्थथस्तकी संवेदी जोन के जलए होगा। (ख) पाररस्थथस्तकी पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप में होगी। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (घ) पयचटन महायोजना पाररस्थथस्तकी संवेदी जोन की वहन क्षमता के आिार पर तैयार की जाएर्गी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे, अथाचतप:-
(i) संरस्क्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नर् ेवाजणजज्र्क होटल और ररजॉटच के सस्न्नमाचण अनजु्ञात नहीं होंग:े परंत,ु यह कक संरस्क्षत के्षत्र की सीमा से एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररजॉटच का स्ट्थापना केवल पूवा पररभाजषत और नामजनर्िाि क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनजु्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार कें र्द्ीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष् रीर् व् र्ाघ्र स संरक्षण प्राजधकरण, द्वारा िारी पाररस्थथस्तकी–पयचटन, पाररस्थथस्तकी- स्शक्षा और पाररस्थथस्तकी-स्वकास पर बल देते हुए (समर्-समर् पर र्था संिोजधत) जारी मागाििाक जसद्धांतों के अनुसार होगा;
(iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िाि संवीक्षा और स्नर्गरानी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर्े होटल र्ा ररसोटच र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनजु्ञात नहीं दकर्ा िार्ेगा ।
(4) नसैर्गाक जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत के्षत्र, िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाएं, स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप में परररक्षण और संरक्षण के जलए तैर्ार की िाएगी ।
(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, थथापत्य, सौंदयचपूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तरै्ार की िाएगी।
(6) ध् वजन प्रिषूण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रिषूण (जवजनर्मन और जनर्तं्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार में पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिषूण के जनर्ंत्रण और स्नवारण का अनुपालन ककया जाएर्गा।
(7) वार् ुप्रिषूण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रिषूण के जनवारण और जनर्ंत्रण का वार्ु (प्रिषूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, साधारणों मानकों के उपबंिों के अनुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर् प्रिषूण के जनस्ट्सारण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा।
(9) ठोस अपजिि.- ठोस अपजिि का जनपटान एवं प्रबंधन जनम्नानुसार दकर्ा िाएगा:- [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिि का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रैल, 2016 के अिीन प्रकाजित ठोस अपजिि प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा;
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिि का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन (ईएसएम) अनुज्ञात दकर्ा जा सकेर्गा।
(10) िैव जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा.- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिि का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के अिीन प्रकाजित िैव जचदकत्सा अपजिि प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिि का सुरजक्षत और पर्ाावरण-अनकूुल प्रबंधन अनुज्ञात दकर्ा जा सकेर्गा।
(11) टलाजस्ट्टक अपजिि प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में टलाजस्ट्टक अपजिि प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित टलाजस्ट्टक अपजिि प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(12) जनमााण और जवध्वसं अपजिि प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिि प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा ।
(13) ई–अपजिि.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिि प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिि प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(14) र्ानीर् यातायात.- यातायात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध में आंचजलक महार्ोिना में जविेष उपबंध सस्ममस्लत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, स्नर्गरानी सजमजत सुसंर्गत अस्िस्नयमों और उसके अिीन बनाए र्गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् कियाकलापों के अनुपालन को स्नर्गरानी करेगी।
(15) र्ानीर् प्रिषूण.- लागू जवजधर्ों के अनुपालन में वाहन प्रिषूण का स्नवारण और जनर्ंत्रण दकर्ा िाएगा। स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे।
(16) औद्योजगक ईकाइर्ा.ं- (i) राजपत्र में इस अस्िसूर्ना के प्रकाशन पर या उसके प चात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिजूषत उद्योगों की स्ट्थापना की अनजु्ञा नहीं िी िाएगी।
(ii) केन्रीय प्रदषूण स्नयंत्रण बोर्च द्वारा फरवरी, 2016 में जारी मार्गचदशचक स्सिान्तों में उद्योर्गों के वर्गीकरण के अनुसार, जब तक कक अस्िसूर्ना में इस प्रकार स्वस्नर्दचष्ट न हो; पाररस्थथस्तकी संवेदी जोन के भीतर केवल र्गैर- प्रदषूणकारी उद्योर्गों को अनुज्ञात ककया जाएर्गा और इसके अस्तररक्त, र्गैर प्रदषूणकारी उद्योर्गों को बढ़ावा कदया जाएर्गा। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(17) पहाडी ढलानों को सरंक्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) आंचजलक महार्ोिना पहाडी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनजु्ञा नहीं िी िाएगी;
(ख) कटाव के एक उच् च जडग्री के साथ जवद्यमान खडी पहाडी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी ।
4. पाररजस्ट्थजतकी सवंिेी िोन में प्रजतजषद्ध और जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सूची.- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अिीन बनाए र्गए स्नयमों स्जसके अन्तर्गचत तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् प्रभाव आकलन अजधसूचना, 2006 और अन्र् लाग ू जवजधर्ां के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), सजम्मजलत हैं और दकर्े गर्े संिोधनों द्वारा िाजसत होंग ेऔर नीचे िी गई सारणी में जवजनर्िाि रीजत में जवजनर्जमत होंगे, अथाातप :- सारणी क्रम स.ं

1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघषाण इकाइर्ां । (क) पाररजस्ट्थजतकी संवेिी िोन के अंतगात वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेल ू आवर्कताओं जिसमें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत ह,ै के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघ ु और वृहत खजनि), पत्थर उत्खनन और अपघषाण इकाइर्ां तत्काल प्रभाव से प्रजतजषद्ध होंगी;
(ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमलूपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्र्ार्ालर् के आदेश 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामल ेमें तारीख 21 अप्रलै, 2014 के आिेि के अनुसरण में होगा ।
2. प्रिषूण (िल, वार्,ु मृिा, ध्वजन, आदि) उत्पन करन ेवाल ेउद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रिषूणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी:
परन्त ु यह कक केन्रीय प्रदषूण स्नयंत्रण बोर्च द्वारा फरवरी, 2016 में जारी मार्गच दशचक स्सिान्तों में उद्योर्गों के वर्गीकरण के अनुसार जब तक कक अस्िसूर्ना में ऐसा स्वस्नर्दचष्ट न हों, पाररस्थथस्तकी संवेदी जोन के भीतर र्गैर-प्रदषूणकारी उद्योर्गों को अनुज्ञात ककया जाएर्गा और इसके अस्तररक्त र्गैर-प्रदषूणकारी कुटीर उद्यार्गों को बढ़ावा कदया जाएर्गा।
3. बृहत िल जवदु्यत पररर्ोिना की प्रजतजषद्ध। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 स्ट्थापना ।
4. दकसी पररसंकटमर् पिाथच का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। प्रजतजषद्ध।
5. प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में अनुपचाररत बजहस्रााव का जनस्ट्सारण । प्रजतजषद्ध।
6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट् तार अनुज्ञात नहीं होगा ।
7. ईंट भट्टों की स्ट्थापना करना। प्रजतजषद्ध।
8. िलावन लकडी का वाजणजज्र्क उपर्ोग । प्रजतजषद्ध।
9. पोजलथीन बैगों का उपर्ोग । प्रजतजषद्ध। आ. जवजनर्जमत दक्रर्ाकलाप
10. वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों लघ ु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा:
परंत ुयह कक संरस्क्षत के्षत्र की सीमा से एक ककलोमीटर के परे या पाररस्थथस्तकी संवेदी जोन के स्वथतार तक इनमें से, जो भी स्नकट हो सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागाििी जसद्धांतों के अनुरुप होगा।
11. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत के्षत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के स्वथतार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर् ेवाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी:
परंत ु यह कक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवर्कताओं को पूरा करने के जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध दक्रर्ाकलापों सजहत अपन े उपर्ोग के जलए, अपनी भूजम में भवन उप-जवजधर्ों के अनुसार, संजनमााण करने की अनुज्ञा होगी:
परंत ुयह कक गैर–प्रिषूणकारी लघु उद्योगों से संबंजधत संजनमााण दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंग ेऔर वे न्र्ूनतम होंग े। (ख) एक दकलोमीटर के्षत्र से परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे ।
12. प्रिषूण उत्पन्न न करने वाल े लघ ु उद्योग। फरवरी, 2016 में केन्र्द्ीर् प्रिषूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों में वगीकरण के अनुसार गरै-प्रिषूणकारी उद्योग और अपररसंकटमय 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] में, लघ ु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करने वाल े कृजष आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनजु्ञात होंगे।
13. वृक्षों की कटाई । (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनजु्ञा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत कें र्द्ीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होगे ।
14. वन उत्पािों या गैर काष् ठ वन उत्पािों का संग्रहण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
15. जवदु्यत और संचार टावरों का पररजनमााण और केबलों के जबछाए िाने और अन्र् बुजनर्ािी ढांचे । लाग ूजवजधर्ों के अधीन जवजनर्जमत होंग े(भूजमगत केबल के जबछाए िाने को बढ़ावा दिर्ा जा सकेर्गा)।
16. नागररक सुख सुजवधाओं सजहत अवसंरर्नाएं । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाना ।
17. जवद्यमान सडकों को चौडा करना और उन्हें सुिढृ़ करना तथा नवीन सडकों का संजनमााण । न्र्ूनीकरण उपार्ों को लार्ग ूस्वस्ियों, जनर्मों और जवजनर्मनों तथा उपलब्ध मार्गचदशचक स्सिांतों के अनुसार ककया जाएर्गा ।
18. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे दक पाररजस्ट्थजतकी संवेिी िोन के्षत्र के ऊपर से गमा वार् ु के गुब्बारे, हलेीकाटटर, ड्रोन, माइक्रोलाइट्स उडाना आदि। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा ।
19. पहाडी ढालों और निी तटों का संरक्षण। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
20. राजत्र में र्ाजनक र्ातार्ात का संचलन । लाग ू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंगे ।
21. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजष और बागवानी प्रथाओं के साथ दगु्ििाला, िगु्घ उद्योग, कृजष और मछली पालन । स्ट्थानीर् लोगों के उपर्ोग के जलए लाग ूजवजधर्ों के अधीन अनुज्ञात।
22. फमों, कंपजनर्ों द्वारा बडे पमैाने पर वाजणजज्र्क पिुओं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आवर्कताओं को परूा करन ेके जलए लाग ूजवजधर्ों के अधीन जवजनर्जमत (अन्र्था उपबंस्ित के स्सवाय) होंगे ।
23. प्राकृजतक िल जनकार्ों र्ा सतही के्षत्र में उपचाररत बजहस्रााव का स्नथतारण । जल स्नकायों में उपर्ाररत अपस्शष्ट जल या बजहस्रााव के स्नथसारण से बचा िाएगा और उपचाररत अपजिि िल के पुन:चक्रण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्र्था लागू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचाक्रण या प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11
24. सतही और भूिल का वाजणजज्र्क प्रर्ोग एवं जनष्कषाण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
25. ठोस अपजिि का प्रबन्धन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
26. जविेिी प्रिाजतर्ों को लाना । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा ।
27. पाररजस्ट्थजतकी पर्ाटन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
28. वाजणजज् र्क सूर्नापट्ट और होर्डंग। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
29. रैककंग और कैपम्पगं। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा ।
30. फोटोग्राफी वाजणजज्र्क। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगा । इ. सवंर्धात दक्रर्ाकलाप
31. वषाा िल संचर्न । सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
32. िैजवक खेती। सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
33. सभी गजतजवजधर्ों के जलए हररत प्रौद्योजगकी को अंर्गीकृत करना । सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।
34. कुटीर उद्योगों जिसके अंतगात ग्रामीण कारीगर, आदि भी हैं। सदक्र र् रूप से बढ़ावा दिर्ा िाएगा।

5. पाररस्थथस्तकी संवदेी जोन की अस्िसरू्ना की स्नर्गरानी के स्लए स्नर्गरानी सजमजत- कें र्द्ीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अिीन इस अस्िसूर्ना के उपबंिों की प्रभावी जनगरानी के स्लए जनगरानी सजमजत का र्गठन करती ह,ै िो जनम्नजलजखत से जमलकर बनगेी, अथाचत:्- क्र.स. स्नर्गरानी सजमजत का गठन पदाजभिान

(ii) राज्र् सरकार द्वारा नामजनर्िाि दकए िाने वाले वन्र्िीव संरक्षण के के्षत्र में काम करने वाल ेगैर-सरकारी संगठन का प्रजतजनजध सिस्ट्र्;
(iii) राज्र् प्रिषूण जनर्ंत्रण बोडा के क्षेत्रीर् कार्ाकारी इंिीजनर्र सिस्ट्र्;
(iv) के्षत्र के ज्रे्ष्ठ नगर जनर्ोिक सिस्ट्र्;
(v) राज्र् के प्रजतजष्ठत संस्ट्थान र्ा जव वजवद्यालर् से पाररजस्ट्थजतकी और पर्ाावरण में एक जविेषज्ञ सिस्ट्र्;
(vi) राज्र् सरकार द्वारा नामजनर्िाि दकए िाने वाले िैव जवजवधता में एक जविेषज्ञ सिस्ट्र्;
(vii) प्रभागीर् वनाजधकारी, (वन्र्िीव), कुल्ल ू सिस्ट्र्;

6. जनिेि–जनबधंन.- (1) जनगरानी सजमजत इस अजधसूचना के उपबंधों के अनुपालन को स्नर्गरानी करेगी।
(2) जनगरानी सजमजत का कार्ाकाल तीन वषा तक र्ा राज्र् सरकार द्वारा नई सजमजत के पुन: गठन तक के जलए होगा और तत्प चात जनगरानी सजमजत राज्र् सरकार द्वारा गरठत की िाएगी।
(3) उन कियाकलापों की, जो भारत सरकार के तत्कालीन पयाचवरण और वन मंत्रालय की अस्िसूर्ना संखयांक का.आ. 1533 (अ), तारीख 14 स्सतमबर, 2006 की अनुसूर्ी में सस्ममस्लत हैं, और जो पाररस्थथस्तकी संवेदी जोन में आत ेहैं, स्सवाय इसके जो पैरा 4 के अिीन सारणी में यथा स्वस्नर्दचष्ट प्रस्तजषि कियाकलापों के, जनगरानी सस्मस्त द्वारा वाथतस्वक स्वस्नर्दचष्ट थथलीय दशाओं के आिार पर संवीक्षा की जाएर्गी और उक्त अस्िसूर्ना के उपबंिों के अिीन पूवच पयाचवरण अनापस्त्त के स्लए केरींय सरकार के पयाचवरण, वन और जलवाय ुपररवतचन मंत्रालय को स्नर्दचष्ट ककया जाएर्गा।
(4) इस अजधसूचना के पैरा 4 के अधीन सारणी में र्था जवजनर्िाि प्रजतजषद्ध दक्रर्ाकलापों के जसवार्, भारत सरकार के तत् कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अजधसूचना के अनुसूची के अधीन ऐसे अनुसूची में दक्रर्ाकलापों, जिन्हें सजम्मजलत नहीं दकर्ा गर्ा ह,ै परंत ुपाररजस्ट्थजतकी संवेिी िोन में आते हैं, ऐसे दक्रर्ाकलापों की वास्ट्तजवक जवजनर्िाि स्ट्थलीर् ििाओं पर आधाररत जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िाि दकर्ा िाएगा ।
(5) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपायुक्त ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता ह,ै पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन पररवाि फाइल करन ेके जलए सक्षम होगा।
(6) जनगरानी सजमजत मुद्दा िर मदु्दा के आधार पर अपेक्षाओं पर जनभार रहत ेहुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेषज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपन ेजवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।
(7) जनगरानी सजमजत प्रत्र्ेक वषा की 31 माचा तक के अपन ेदक्रर्ाकलापों की वार्षाक कारावाई ररपोटा राज् र् के मुख् र् वन् र्िीव वाडान को उपाबंध IV में संलग्न प्रोफामाा में उक् त वषा के 30 िून तक प्रस्ट्तुत करेगी ।
(8) केन्र्द्ीर् सरकार का पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् जनगरानी सजमजत को अपन े कृत्र्ों के प्रभावी जनवाहन के जलए समर्-समर् पर ऐसे जनिेि िे सकेगा, िो वह ठीक समझे ।

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 6 th March, 2020;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification;
AND WHEREAS, the Manali Wildlife Sanctuary situated at a distance around 300 kilometers from Shimla and 45 kilometers from Kullu in District Kullu of Himachal Pradesh which provides home to a variety of endemic flora and fauna, the Sanctuary has several important values from ecological, faunal, floral, geomorphologic and recreational and research/educational perspective, the total area of the Sanctuary is 29.00 square kilometers;

AND WHEREAS, Manali Wildlife Sanctuary is known to harbor exceptional varieties of wildlife, the main wildlife species found in the Sanctuary are leopard (Panthera pardus), leopard cat (Felis bengalensis), jungle cat (Felis chaus), Himalayan civet (Pagoma larvata), Himalayan yellow throated marten (Martes flavigula), black bear (Selenarctus thibetanus), porcupine (Hystrix indica), flying squirrel (Petaurista petaurista), monkey (Macaca mullata), langoor (Presbytis entellus), goral (Nemorhaeadus goral), barking deer (Muntjacus muntjack), jackal (Canis aureus), western tragopan (Tragopan melanocephalus), etc., the Sanctuary is the habitat of four species of pheasants out of seven species found in Himachal Pradesh, it has been recognized as important bird area for Himalayan Monal, endemic vulnerable species restricted to Himalayan region in India, birds such as white crested kalij, chukor, black and grey partridge and reptiles such as snakes, monitor lizard are of commonly found in the Sanctuary;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Manali Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section
(2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 17 1986, the Central Government hereby notifies an area to an extent varying from 120 metres to 1.800 kilometres around the boundary of Manali Wildlife Sanctuary, in Kullu Districts in the State of Himachal Pradesh as the Manali Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: - Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 120 metres to
1.800 kilometres around the boundary of Manali Wildlife Sanctuary and the area of the Eco-sensitive Zone is 15.68 square kilometres. (2) The boundary description of Manali Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I.
(3) The maps of the Manali Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB.
(4) Lists of geo-coordinates of the boundary of Manali Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure-III.
(5) There are no Revenue villages inside the proposed Eco-sensitive Zone.
2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Ecosensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Himachal State Pollution Control Board; and
(xii) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, ecoeducation and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.
(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:-
(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28 th March,
2016.
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco Sensitive Zone;
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 notification and in addition the non-polluting cottage industries shall be promoted.
3. Establishment of major hydro-electric project.
Prohibited.
4. Use or production or processing of any hazardous substances.
Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited.
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited.
8. Commercial use of firewood. Prohibited.
9. Use of polythene bags. Prohibited.
B. Regulated Activities
10. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents.
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
12. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the competent Authority.
13. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
14. Collection of Forest produce or Non- Timber Forest produce.
Regulated as per the applicable laws.
15. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws (underground cabling may be promoted).
16. Infrastructure including civic amenities. Taking measures of mitigation as per the applicable laws, 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] rules and regulations and available guidelines.
17. Widening and strengthening of existing roads and construction of new roads.

18. Undertaking other activities related to tourism like flying over the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.
Regulated as per the applicable laws.
19. Protection of hill slopes and river banks. Regulated as per the applicable laws.
20. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
21. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted as per the applicable laws for use of locals.
22. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies.
Regulated (except as otherwise provided) as per the applicable laws except for meeting local needs.
23. Discharge of treated waste water or effluents in natural water bodies or land area.
The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.
24. Commercial extraction of surface and ground water.
Regulated as per the applicable laws.
25. Solid waste management. Regulated as per the applicable laws.
26. Introduction of exotic species. Regulated as per the applicable laws.
27. Eco-tourism. Regulated as per the applicable laws.
28. Commercial sign boards and hoardings. Regulated as per the applicable laws.
29. Tracking and camping. Regulated as per the applicable laws.
30. Photography commercial. Regulated as per the applicable laws.
C. Promoted Activities
31. Rain water harvesting. Shall be actively promoted.
32. Organic farming. Shall be actively promoted.
33. Adoption of green technology for all activities.
Shall be actively promoted.
34. Cottage industries including village artisans, etc.
Shall be actively promoted.
35. Use of renewable energy and fuels. Bio-gas, solar light, etc. shall be actively promoted.
36. Agro-Forestry. Shall be actively promoted.
37. Plantation of Horticulture and Herbals. Shall be actively promoted.
38. Use of eco-friendly transport. Shall be actively promoted.
39. Skill Development. Shall be actively promoted.
40. Restoration of degraded land/ forests/ habitat.
Shall be actively promoted.
41. Environmental awareness. Shall be actively promoted.
5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- Sl. (v) One expert in Ecology and environment from reputed institution or University of the State Member;
(vi) One expert in Biodiversity to be nominated by the State Government Member;
(vii) Divisional Forest Officer, (Wildlife), Kullu Member;
(viii) Divisional Forest Officer, Kullu Member-Secretary.
6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure-IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and the State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
