PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार् ुपररवतान मतं्रालर् अजधसचूना नई दिल्ली, 15 अक् तूबर, 2020 का.आ. 3632(अ).—प्रारुप अजधसूचना भारत के रािपत्र, असाधारण, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान, मंत्रालर् की अजधसूचना सं. का.आ. 4612 (अ), तारीख 23 दिसम्बर, 2019, द्वारा प्रकाजित की गई थी जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाल े रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थ;े और, उि प्रारूप अजधसूचना को अन्तर्वाष्ट करने वाले रािपत्र की प्रजतर्ां िनता को तारीख 24 दिसम्बर, 2019, को उपलब्ध करा िी गई थी; और, प्रारुप अजधसूचना के प्रत्युत्तर में व्यजिर्ों और पणधाररर्ों से कोई भी आक्षेप और सुझाव प्राप्त नहीं हुए थ;े और, रामसागर वन्यजीव अभयारण्य 26° 35’ 21.5” उ अक्ाांश 77° 36’ 25.7” प ूिेशाांतर और 26° 32’ 39.7” उ अक्ाांश और 77° 34’ 21” प ूिेशाांतर के बीच स्थथत ह।ै अभयारण्य राजथथान राज्य में धौलपुर स्जल ेके बरी तहसील में स्जला मुख्यालय धौलपरु के िस्क्ण-पूवव की ओर लगभग 36 दकलोमीटर की िरूी पर स्थथत ह।ै अभयारण्य का कुल क्ेत्रफल
34.41 वगव दकलोमीटर ह।ै यह के्त्र राजथथान वन्य पश ुऔर पक्ी सांरक्ण अस्धस्नयम, 1951 के प्रावधानों के अधीन 7 स.ं 3220] नई दिल्ली, बहृस्ट् पजतवार, अक् तबूर 15, 2020/ आज वन 23, 1942 No. 3220] NEW DELHI, THURSDAY, OCTOBER 15, 2020/ ASVINA 23, 1942 सी.जी.-डी.एल.-अ.-16102020-222500 CG-DL-E-16102020-222500 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] नवम्बर,1955 को ‘ररजवव के्त्र’ अस्धसूस्चत दकया गया था। यह वन्यजीव (सांरक्ण) अस्धस्नयम,1972 के तहत ‘समकक् अभयारण्य’ ह।ै रामसागर वन खांड की प्रारांस्भक अस्धसूचना 21 जून, 1956 को जारी की गई थी। इस वन खांड की अांस्तम अस्धसूचना 21 नवम्बर, 1979 को जारी की गई थी। वन खांड का कुल क्ेत्रफल 34.4101 वगव दकलोमीटर सस्हत इसमें सात कम्पाटवमेंट ह;ै और, रामसागर बाांध के साथ रामसागर सांरस्क्त के्त्र के वनों में थथानीय वनथपस्त और जीवजांतु के पाररस्थथस्तकी थथल के प्रस्तस्नस्ध के रूप में स्वकास की क्मता ह।ै इस के्त्र में वन के प्रकार हैं:- (क) उत्तरी उष्णकरटबांधीय शुष्क पणवपाती कां टीले वन(4बी) (ख) उत्तरी उष्णकरटबांधीय शुष्क पणवपाती वन (5बी), (ग) नाला में उत्तरी शुष्क स्मस्ित पणवपाती वन (सी2) अभयारण्य के बाहरी क्ेत्रों में बडी सांख्या में ग्राम स्थथत ह।ै अभयारण्य के वन इस अधव-शुष्क के्त्र में पाररस्थथस्तकी सुरक्ा स्थथरता और उन्नत पयाववरण प्रिान करते ह।ै इस प्रकार, अभयारण्य का सांरक्ण महत्वपूणव ह।ै रामसागर बाांध 1905 में ससांचाई के उदे्दश्य से पारबती निी पर बनाया गया और तटबांध के स्नचले भाग में ससांचाई के स्लए नहरों की प्रणाली के रूप में स्वद्यमान हैं; और, सांरस्क्त के्त्र में मुख्य वनथपस्त खैर (अकैस्शया कटेचु), रोंझ (अकैस्शया लेउकोफलोइया), कुमथा (अकैस्शया सेनेगाला), ढोंक (एनोगेइसस पेंडुला), हहगंोट (बालास्नटेस इस्जस्शशया), ढाक (बुटेआ मोनोथपमाा), करईल (कैशपारीस डेदकडुआस), हने्स (कशपारीस सेस्पअररया), लासोडा (कोरस्डअ मयक्या), बारना (करेटेइवा रेस्लस्जओसा), थौर (इयुफोरस्बया थपा.), पापडी (होलोशटेस्लया इांटस्ग्रफोस्लया), जामुन (जसजेजगर्म कुजमजन),बेर (स्जजर्फुस मौररटीअना), काला स्सररस (अजल्बजिर्ा लेब्बक), कडम (जमत्राग्नेर् पर्वाफ्लोरा), सेंथा (बउहीस्नया रेकेमोसा), गोयाखैर (डीचरोथटेचयस स्सनेराररया), बाध (दफकस थपा.), गथबेर (जीजर्फोस क्सीलॉपीरूस), स्खरस्न (जिघरटआ टटंकटोररया), आदि ह;ै और, रामसागर वन्यजीव अभयारण्य से मुख्य जीवजांतु भारतीय बनैला सूअर (सस स्ट्रोफा दिथटटुस), रीछ (मेलसास अरजसनस), बनस्बलार (फेस्लस चाउस), ब्लू बुल/नीलगाय (बोसेलाफुस त्रगोचमेलसु), भारतीय खरगोश (लेपुस स्नगरीकोस्ललस रूदफकउडाटुस), हिे हॉग (हसे्मस्चनुस उररटस), धारीिार लकडबग्घा (हाइना हार्ना), जसर्ार (कैजनस ऑररर्स), सामान्य नेवला (हरेपेस्ट्टड इडवाडासी), काला स्हरण (एंरटलोप ेसेर्वाकारपा), कराकल (फेस्लस कराकल), सचांकारा (गजेलला गजेलला), िंगली कुत्ता (कुओन अल्पाइंस), भारतीर् लोमडी (वुल््स बेंगलेंजसस), स्बलली-तेंिआु (फेजलस बेंगलेंजसस), सांभर (रुसा र्नूीक्लोर), जचत्तीिार जहरण (एजक्सस एजक्सस), मगरमच्छ (रोकोडार्लुस पालुथरीस), कछुआ, मगरमच्छ (गस्वअस्लस गेंगेटीकस), आदि अस्भस्लस्खत दकए गए ह;ै और, रामसागर वन्यजीव अभयारण्य की महत्त्वपूणव पक्ी प्रजास्तयाां ब्ल-ूचीक्ड बी-ईटर (मेरोशस पेरस्सकस), ग्रीन बी-ईटर (मेरोशस ओररइांटस्लस), भारतीय रोललर (कोरादकयास बेंघालेंस्सस), सामान्य बाज-कोर्ल (जहइरोकोक्सी वाररउस), रेड-वेंटेड बुलबुल (जपक्नोनोटस केफर), रेस्ट्टेड बंटटंग (मेलोफुस लाथास्म), वाइट-आइड बुज्जाडव (बुटथटुर टैसा), जसरीनवैगेटइल (मोटास्सलला अदकटरेओला), लािा स्पइड वैगेटइल (मोटास्सलला माडेराथपटेंस्सस), साधारण गोल्डन ओररओल (ओररओलुस ओररओलुस), ब्लैक-रम्पेड फ्लेमबैक (स्डनोस्पउम बेंघालेंसे), र्ेलो-रोनेड कठफोडवा (डेंड्रोकोपास महराट्टेंस्सस), आदि हैं; जबदक अभयारण्य से महत्त्वपूणव स्ततली, कीडे-मकोडे, सरीसृप प्रजास्तयाां पायथन (पायथन मोलुरूस), रूथसेल स्वपर (स्पपेरा रूथसेस्लल), कोबरा (नाजा नाजा), रेट स्नेक (पतयस मुकोसुस), सामान्य करैत (बुांगारूस केइरूलेउस), भारतीय मॉनीटर (वारानुस स्ग्रसेउस), आदि अस्भस्लस्खत की गई ह;ै और, अभयारण्य के महत्त्वपूणव िलुवभ, सांकटापन्न और लुप्तप्राय प्रजास्तयों में लकडबग्घा (हाइना हाइना), रीछ (मेलसास अरजसनस), तेंिआु (पेन्थरेा प्रड्यसू) आदि हैं; [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 और, रामसागर वन्यजीव अभयारण्य के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाएां पाररस्थथस्तकी पयाववरणीय से पाररस्थथस्तकी सांवेिी जोन के रूप में पैरा 1 में जवजनर्िाष्ट हैं, जैव स्वस्वस्धता की िजृष्ट सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करने को प्रजतजिद्ध करना आवर्क ह;ै अतः, अब, केन्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (स्जसे इस अस्धसूचना में इसके पश्चात पयाववरण अस्धस्नयम कहा गया ह)ै की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, राजथथान राज्र् के धौलपुर स्जला के रामसागर वन्यजीव अभयारण्य की सीमा के चारों ओर 0 (शून्य) से 1 दकलोमीटर तक जवस्ट्ताररत क्षेत्र को रामसागर वन्यजीव अभयारण्य पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके प चात पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात :-
1. पाररजस्ट्थजतकी संविेी िोन का जवस्ट्तार और सीमाएां.-(1) पाररजस्ट्थजतकी संवेिी िोन का स्वथतार रामसागर वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0 (शून्य) से 1 दकलोमीटर तक स्वथतृत ह ैऔर पाररस्थथस्तकी सांवेिी जोन का क्ेत्रफल 27.50 वगव दकलोमीटर ह।ै अभयारण्य की स्वस्भन्न दिशाओं में पाररस्थथस्तकी सांवेिी जोन का स्वथतार नीचे दिया गया ह:ै दिशा स्वथतार (दकलोमीटर) उत्तर 0 उत्तर-पूवव 1 पूवव 1 िस्क्ण-पूवव 1 िस्क्ण 1 िस्क्ण-पस्श्चम 1 पस्श्चम 1 उत्तर-पस्श्चम 1 पाररस्थथस्तकी सांवेिी जोन का शून्य स्वथतार को उस्चत ठहराया गया- “रामसागर वन्यजीव अभयारण्य की उत्तरी सीमा रामसागर बाांध का तटबांध ह ैजो 1905 में बनाया गया था। बाांध का उपयोग ससांचाई उदे्दश्य के स्लए दकया गया ह।ै उत्तर में तटबांध के ठीक नीचे, बाांध, नहर प्रणाली कृस्ि भूस्म और ग्राम हैं। इस थथायी सांरचना को अभयारण्य के उत्तरी भाग में पाररस्थथस्तकी सांवेिी जोन के रूप में स्लया गया ह।ै तटबांध से आग ेपाररस्थथस्तकी सांवेिी जोन का स्वथतार करन े से थथानीय समुिायों के साथ सांघिव होगा। इसस्लए, पाररस्थथस्तकी सांवेिी जोन सीमा की भौस्तक स्वस्शष्ठता का उपयोग करके सीमा को शून्य रखा गया ह।ै”
(2) पाररजस्ट्थजतकी संवेिी िोन और रामसागर वन्र्िीव अभर्ारण्र् की सीमा का स्ववरण उपाबधं-I के रूप में उपाबांध ह।ै
(3) सीमा जववरण और अक्षांि और िेिांतर के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमाांदकत करते हुए रामसागर वन्र्िीव अभर्ारण्र् के मानजचत्र उपाबधं-IIक, उपाबधं-IIख, उपाबधं-IIग और उपाबधं-IIघ के रूप में उपाबांध ह।ै
(4) पाररजस्ट्थजतकी संवेिी िोन और रामसागर वन्र्िीव अभर्ारण्र् की सीमा के भू-जनिेिांकों की सूची उपाबधं-III की सारणी क और सारणी ख में िी गई ह।ै 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(5) मुख्र् हबंिओुं के भू-जनिेिांकों के साथ प्रथतास्वत पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन े वाले ग्रामों की सूची उपाबधं-IV के रूप में उपाबांध ह।ै
2. पाररजस्ट्थजतकी संविेी िोन के जलए आचंजलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्य के सक्म प्रास्धकारी के अनुमोिन के स्लए इस अजधसूचना में दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी।
(2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट की गई हैं, के अनसुार तथा सुसंगत कें रीर् और राज् र् जवजधर्ों के अनरुुप और कें रीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी ।
(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी.—
(i) पर्ाावरण;
(ii) वन और वन्र्िीव;
(iii) कृजि;
(iv) रािस्ट् व;
(v) िहरी जवकास;
(vi) पर्ाटन;
(vii) ग्रामीण स्वकास;
(viii) हसंचाई और बाढ़ जनर्ंत्रण;
(ix) नगरपाजलका;
(x) पांचायती राज; और
(xi) लोक जन मााण जव भाग।
(4) आंचजलक महार्ोिना अनमुोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दरर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दरर्ाकलापों में, िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवर्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलओुं, जिन पर ध्र्ान िेना आवर्क ह,ै के जलए उपबंध होंगे ।
(6) आंचजलक महार्ोिना स्वद्यमान और प्रथतास्वत भूस्म उपयोग स्वशेिताओं के ब्यौरों से अनुसमर्थवत मानस्चत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजि क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्कंन करेगी।
(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और पैरा-4 में सारणी में सूचीबद्ध प्रजतजिद्ध और जवजनर्जमत दरर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों की जीस्वका को सुरस्क्त करन ेके स्लए पाररजस्ट्थजतकी अनुकूल जवकास को सुस्नस्श्चत और उसकी अस्भवृस्ि भी करेगी। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5
(8) आंचजलक महार्ोिना प्रािेस्शक जवकास र्ोिना की सह जवस्ट्तारी होगी ।
(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार स्नगरानी के अपन ेकार्ों को करन े के जलए स्नगरानी सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी ।
3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेगी, अथाात :-
(1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरांजन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुल ेस्ट्थानों का वाजणजज्र्क या आवासीय या औद्योजगक संबद्ध जवकास दरर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा: परंत ुपाररजस्ट्थजतकी संवेिी िोन के भीतर उपयुवक्त भाग (क) में जवजनर्िाष्ट प्रर्ोिनों से जभन्नों प्रर्ोिनों के जलए कृजि और अन्र् भूजम का संपररवतान स्नगरानी सजमजत की जसफाररि पर और र्था लाग ूऔर क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवर्कताओं को पूरा करन ेके जलए अनुज्ञात दकर्ा िाएगा, िैसे-
(i) जवद्यमान सडकों को चौडा करना और उन्हें सुिढृ़ करना तथा नई सडकों का संजनमााण;
(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रििूण उत्पन्न न करने वाल ेलघ ुउद्योग;
(iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी हैं; सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएां सहार्क पाररजस्ट्थजतकी पर्ाटन स्जसके अन्तगवत गहृ वास सजम्मजलत ह;ै और
(v) पैरा 4 के अधीन दिए गए संवर्धात दरर्ाकलाप: परंत ुर्ह और दक प्रािेस्शक नगर र्ोिना स्वस्ध और राज्य सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्म प्रास्धकारी के पूवव अनुमोिन और संजवधान के अनुच्छेि 244 के उपबांधों या तत्समर् प्रवृत्त जवजध के उपबंधों के अनुपालन के जबना, जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै वाजणजज्र्क र्ा औद्योस्गक जवकास दरर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा: परंत ु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई गलती, स्नगरानी सजमजत के जवचार प्राप्त करने के पश्चात राज्र् सरकार द्वारा प्रत्र्ेक मामल ेमें एक बार ठीक होगी और उि गलती के सुधार की सूचना कें रीर् सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् को िी िाएगी: परंत ुर्ह और भी दक गलती के सुधार में इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू- उपर्ोग का पररवतान सजम्मजलत नहीं होगा; (ख) वनीकरण तथा वास िीणोद्धार दरर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजि क्षते्रों में पुन: वनीकरण करने के प्रर्ास दकए िाएंग।े
(2) प्राकृजतक िल स्रोतों.- आचंजलक महार्ोिना में सभी प्राकृजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दरर्ाकलाप प्रजतजिद्ध करने के बारे में जो ऐसे क्ेत्रों के स्लए अस्हतकर हो ऐसी रीजत से मागविशवक जसद्धांत तैर्ार दकए िाएंगे। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(3) पर्ाटन र्ा पाररस्थथस्तकी पयवटन.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दरर्ाकलाप र्ा जवद्यमान पर्ाटन दरर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररस्थथस्तकी सांवेिी जोन के जलए होगा। (ख) पर्ाटन महार्ोिना, राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप में होगी। (घ) पयवटन महायोजना पाररस्थथस्तकी सांवेिी जोन की वहन क्मता के आधार पर तैयार की जाएगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दरर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे, अथावत :-
(i) सांरस्क्त के्त्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नर् ेवाजणजज्र्क होटल और ररजॉटव के सस्न्नमावण अनजु्ञात नहीं होंग:े परंत,ु यह दक सांरस्क्त के्त्र की सीमा से एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररजॉटव का स्ट्थापना केवल पूवा पररभाजित और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनजु्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर नए पर्ाटन दरर्ाकलापों र्ा जवद्यमान पर्ाटन दरर्ाकलापों का जवस्ट्तार कें रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष् रीर् ा र्ाघ्र स संरक्षण प्राजधकरण, द्वारा िारी पाररस्थथस्तकी–पयवटन, पाररस्थथस्तकी-स्शक्ा और पाररस्थथस्तकी-स्वकास पर बल िेते हुए (समर्- समर् पर र्था संिोजधत) जारी मागाििाक जसद्धांतों के अनुसार होगा;
(iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दरर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िाष्ट संवीक्षा और स्नगरानी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर्े होटल र्ा ररसोटव र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनुज्ञात नहीं दकर्ा िार्ेगा ।
(4) नसैर्गाक जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत के्षत्र, िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाए,ं स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप में परररक्षण और संरक्षण के जलए तैर्ार की िाएगी ।
(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, थथापत्य, सौंियवपूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्ेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तरै्ार की िाएगी।
(6) ध् वजन प्रििूण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििूण (जवजनर्मन और जनर्तं्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार में पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििूण के जनर्ंत्रण और स्नवारण का अनुपालन दकया जाएगा।
(7) वार् ुप्रििूण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रििूण के जनवारण और जनर्ंत्रण का वार्ु (प्रििूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, साधारणों मानकों के उपबांधों के अनुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर् प्रििूण के [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 जनस्ट्सारण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा।
(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान एवं प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रलै, 2016 के अधीन प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन (ईएसएम) अनजु्ञात दकर्ा जा सकेगा।
(10) िैव जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा.- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के अधीन प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरुूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा जा सकेगा।
(11) ्लाजस्ट्टक अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में ्लाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित ्लाजस्ट्टक अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(12) जनमााण और जवध्वसं अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.साां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा ।
(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(14) र्ानीर् यातायात.- यातायात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सस्म्मस्लत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, स्नगरानी सजमजत सुसांगत अस्धस्नयमों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् दियाकलापों के अनुपालन को स्नगरानी करेगी।
(15) र्ानीर् प्रििूण.- लागू जवजधर्ों के अनुपालन में वाहन प्रििूण का स्नवारण और जनर्ंत्रण दकर्ा िाएगा। स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे।
(16) औद्योजगक ईकाइर्ा.ं- (क) राजपत्र में इस अस्धसूचना के प्रकाशन पर या उसके पश्चात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिजूित उद्योगों की स्ट्थापना की अनजु्ञा नहीं िी िाएगी। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) केन्रीय प्रििूण स्नयांत्रण बोडव द्वारा फरवरी, 2016 में जारी मागविशवक स्सिान्तों में उद्योगों के वगीकरण के अनुसार, जब तक दक अस्धसूचना में इस प्रकार स्वस्नर्िवष्ट न हो; पाररस्थथस्तकी सांवेिी जोन के भीतर केवल गैर- प्रििूणकारी उद्योगों को अनुज्ञात दकया जाएगा और इसके अस्तररक्त, गैर प्रििूणकारी उद्योगों को बढ़ावा दिया जाएगा।
(17) पहाडी ढलानों को सरंक्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) आंचजलक महार्ोिना पहाडी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनजु्ञा नहीं िी िाएगी; (ख) कटाव के एक उच्च जडग्री के साथ जवद्यमान खडी पहाडी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनजु्ञा नहीं िी िाएगी ।
4. पाररजस्ट्थजतकी सवंिेी िोन में प्रजतजिद्ध और जवजनर्जमत दकए िान ेवाल ेदरर्ाकलापों की सूची.- पाररजस्ट्थजतकी संवेिी िोन में सभी दरर्ाकलाप पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के उपबंधों और उसके अधीन बनाए गए स्नयमों स्जसके अन्तगवत तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् प्रभाव आकलन अजधसूचना, 2006 और अन्र् लाग ू जवजधर्ां के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), सजम्मजलत हैं और दकर्े गर् ेसंिोधनों द्वारा िाजसत होंगे और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में जवजनर्जमत होंगे, अथाात :- सारणी रम स.ं

(3) अ. प्रजतजिद्ध दरर्ाकलाप
1. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघिाण इकाइर्ां । (क) पाररजस्ट्थजतकी संवेिी िोन के अंतगात वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवर्कताओं जिसमें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत है, के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघिाण इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होंगी: (ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्र्ार्ालर् के आिशे 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) सां. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रैल, 2014 के आििे के अनुसरण में होगा ।
2. प्रििूण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन करने वाले उद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रििूणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी: परन्तु यह दक केन्रीय प्रििूण स्नयांत्रण बोडव द्वारा फरवरी, 2016 में जारी मागव िशवक स्सिान्तों में उद्योगों के वगीकरण के अनुसार जब तक दक अस्धसूचना में ऐसा स्वस्नर्िवष्ट न हों, पाररस्थथस्तकी सांवेिी जोन के भीतर गैर-प्रििूणकारी उद्योगों को अनजु्ञात दकया जाएगा और इसके अस्तररक्त गैर-प्रििूणकारी कुटीर उद्यागों को बढ़ावा दिया जाएगा।
3. बृहत हाइड्रो जवद्युत पररर्ोिना की प्रजतजिद्ध। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 स्ट्थापना ।
4. दकसी पररसंकटमर् पिाथव का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। प्रजतजिद्ध।
5. प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में अनुपचाररत बजहस्रााव का जनस्ट्सारण । प्रजतजिद्ध।
6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट् तार अनुज्ञात नहीं होगा ।
7. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध। आ. जवजनर्जमत दरर्ाकलाप
8. वाजणजज्र्क स्ट्थापनों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दरर्ाकलापों लघु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा: परांतु यह दक सांरस्क्त क्ेत्र की सीमा से एक दकलोमीटर के परे या पाररस्थथस्तकी सांवेिी जोन के स्वथतार तक इनमें स,े जो भी स्नकट हो सभी नए पर्ाटन दरर्ाकलाप र्ा जवद्यमान दरर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागाििी जसद्धांतों के अनुरुप होगा।
9. संजनमााण दरर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के स्वथतार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर्े वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी: परंतु यह दक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवर्कताओं को पूरा करने के जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध दरर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप- जवजधर्ों के अनुसार, संजनमााण करने की अनुज्ञा होगी: परांतु यह दक गैर–प्रििूणकारी लघु उद्योगों से संबंजधत संजनमााण दरर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंग े। (ख) एक दकलोमीटर क्षेत्र से परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे ।
10. प्रििूण उत्पन्न न करने वाले लघु उद्योग । फरवरी, 2016 में केन्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों में वगीकरण के अनुसार गैर-प्रििूणकारी उद्योग और अपररसंकटमय में, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से ििेी सामग्री से उत्पािों को उत्पन्न करने वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे।
11. वृक्षों की कटाई । (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनजु्ञा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत कें रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होग े।
12. वन उत्पािों या गैर काष् ठ वन उत्पािों का संग्रहण । लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे ।
13. जवद्युत और संचार टावरों का पररजनमााण और केबलों के जबछाए िाने और अन्र् बुजनर्ािी ढांचे । लागू जवजधर्ों के अधीन जवजनर्जमत होंगे (भूजमगत केबल के जबछाए िाने को बढ़ावा दिर्ा जा सकेगा)। 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
14. नागररक सुख सुजवधाओं सजहत अवसांरचनाएां । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाना ।
15. जवद्यमान सडकों को चौडा करना और उन्हें सुिढृ़ करना तथा नवीन सडकों का संजनमााण । न्र्ूनीकरण उपार्ों को लागू स्वस्धयों, जनर्मों, जवजनर्मनों तथा उपलब्ध मागविशवक स्सिाांतों के अनुसार दकया जाएगा ।
16. पर्ाटन से संबंजधत अन्र् दरर्ाकलाप िैसे दक पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से गमा वार्ु के गुब्बारे, हेलीका्टर, ड्रोन, माइरोलाइट्स उडाना आदि। लागू जवजधर्ों के अधीन जवजनर्जमत होगा ।
17. पहाडी ढालों और निी तटों का संरक्षण । लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे ।
18. राजत्र में र्ाजनक र्ातार्ात का संचलन । लागू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंगे ।
19. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजि और बागवानी प्रथाओं के साथ िगु्धिाला, िगु्घ उद्योग, कृजि और मछली पालन । स्ट्थानीर् लोगों के उपर्ोग के जलए लागू जवजधर्ों के अधीन अनुज्ञात होगा।
20. फमों, कंपजनर्ों द्वारा बडे पैमाने पर वाजणजज्र्क पिुओं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आवर्कताओं को पूरा करने के जलए लाग ूजवजधर्ों के अधीन जवजनर्जमत (अन्र्था उपबांस्धत के स्सवाय) होंग े।
21. प्राकृजतक िल जनकार्ों र्ा सतही क्षेत्र में उपचाररत बजहस्रााव का स्नथतारण । जल स्नकायों में उपचाररत अपस्शष्ट जल या बजहस्रााव के स्नथसारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुन:चरण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्र्था लागू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचारण या प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा।
22. सतही और भूिल का वाजणजज्र्क प्रर्ोग एवं जनष्किाण । लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे ।
23. ठोस अपजिष्ट का प्रबन्धन। लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे ।
24. खुले कंुआ, बोर कंुआ, आदि कृजि और अन्र् उपर्ोग के जलए । लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे और सम्बद्ध प्राजधकारी द्वारा दरर्ाकलापों की सख्ती से जनगरानी दकया जायेगा।
25. जवििेी प्रिाजतर्ों को लाना । लागू जवजधर्ों के अधीन जवजनर्जमत होगा ।
26. पाररजस्ट्थजतकी पर्ाटन। लागू जवजधर्ों के अधीन जवजनर्जमत होगा ।
27. पोजलथीन बैगों का प्रर्ोग । लागू जवजधर्ों के अधीन जवजनर्जमत होगा ।

(vi) राज्र् सरकार द्वारा नाजमत िैव जवजवधता में एक जविेिज्ञ सिस्ट्र्;
(vii) राज्र् के प्रजतजित संस्ट्थान र्ा जवश्वजवद्यालर् से पाररजस्ट्थजतकी में एक जविेिज्ञ सिस्ट्र्;
(viii) उप वन संरक्षक, राष्ट्रीर् चंबल घजडर्ाल अभर्ारण्र्, सवाई-माधोपुर सिस्ट्र्-सस्चव।
6. जनिेि–जनबधंन.- (1) जनगरानी सजमजत इस अजधसूचना के उपबंधों के अनुपालन को स्नगरानी करेगी।
(2) जनगरानी सजमजत का कार्ाकाल तीन विा तक र्ा राज्र् सरकार द्वारा नई सजमजत के पुन: गठन तक के जलए होगा और तत्पश्चात जनगरानी सजमजत राज्र् सरकार द्वारा गरठत की िाएगी।
(3) उन दियाकलापों की, जो भारत सरकार के तत्कालीन पयाववरण और वन मांत्रालय की अस्धसूचना सांख्याांक का.आ. 1533 (अ), तारीख 14 स्सतम्बर, 2006 की अनुसूची में सस्म्मस्लत हैं, और जो पाररस्थथस्तकी सांवेिी जोन में आत ेहैं, स्सवाय इसके जो परैा 4 के अधीन सारणी में यथा स्वस्नर्िवष्ट प्रस्तजिि दियाकलापों के, जनगरानी सस्मस्त द्वारा वाथतस्वक स्वस्नर्िवष्ट थथलीय िशाओं के आधार पर सांवीक्ा की जाएगी और उक्त अस्धसूचना के उपबांधों के अधीन पूवव पयाववरण अनापस्त्त के स्लए केरींय सरकार के पयाववरण, वन और जलवायु पररवतवन मांत्रालय को स्नर्िवष्ट दकया जाएगा।
(4) इस अजधसूचना के पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजिद्ध दरर्ाकलापों के जसवार्, भारत सरकार के तत् कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अजधसूचना के अनुसूची के अधीन ऐसे अनुसूची में दरर्ाकलापों, जिन्हें सजम्मजलत नहीं दकर्ा गर्ा ह,ै परंतु पाररजस्ट्थजतकी संवेिी िोन में आत ेहैं, ऐसे दरर्ाकलापों की वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं पर आधाररत जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा । 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(5) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपायुक्त ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लघंन करता ह,ै पर्ाावरण (सांरक्ण) अजधजनर्म, 1986 की धारा 19 के अधीन पररवाि फाइल करने के जलए सक्षम होगा।
(6) जनगरानी सजमजत मुद्दा िर मदु्दा के आधार पर अपेक्षाओं पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपन ेजवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।
(7) जनगरानी सजमजत प्रत्र्ेक विा की 31 माचा तक के अपने दरर्ाकलापों की वार्िाक कारावाई ररपोटा राज् र् के मुख् र् वन् र्िीव वाडान को उपाबधं V में संलग्न प्रोफामाा में उक् त विा के 30 िून तक प्रस्ट्ततु करेगी ।
(8) केन्रीर् सरकार का पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् जनगरानी सजमजत को अपन ेकृत्र्ों के प्रभावी जनवाहन के जलए समर्-समर् पर ऐसे जनिेि िे सकेगा, िो वह ठीक समझे ।

8. कोई अन् र् महत् वपूणा मामला । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 15th October, 2020 S.O. 3632 (E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 4612 (E), dated the 23 rd December, 2019, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 24 th December, 2019; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification; AND WHEREAS, Ramsagar Wildlife Sanctuary is situated between 26 35’ 21.5” N latitude 77 36’ 25.7” E longitude and 26 32’ 39.7” N latitude and 77 34’ 21” E longitude. The Sanctuary is situated about 36 kilometres towards south-east of Dholpur district head-quarters in Bari Tehsil of Dholpur district in the state of Rajasthan. The total area of the Sanctuary is 34.41 square kilometres. This area was notified as 'Reserved Area' on 7 th November, 1955 under the provisions of the Rajasthan Wild Animals and Birds Protection Act, 1951. It is a 'Deemed Sanctuary' under the Wildlife (Protection) Act, 1972. Preliminary notification for Forest Block Ramsagar was issued on 21 st June
1956. Final notification of this forest block was issued on 21 st November, 1979. It comprises of seven compartments with the total area of the forest block 34.4101 square kilometres; AND WHEREAS, the forests of Ramsagar Protected Area along with the Ram Sagar Dam has potential for development into an ecological site representative of the local flora and fauna. The forest types in the region are – (a) Northern Tropical Dry Deciduous Thorn Forest (4B) (b) Northern Tropical Dry Deciduous Forest (5B), (c) Northern Dry Mixed Deciduous Forest (C2) in Nallas. The Ramsagar dam was built in 1905 on river Parbati for purpose of irrigation and downstream of the embankment exists as a system of canals for irrigation; AND WHEREAS, the major flora in the protected area are khair (Acacia catechu), ronjh (Acacia leucophloea), kumtha (Acacia Senegal), dhonk (Anogeissus pendula), hingot (Balanites aegyptica), Dhak (Butea monosperma), Careel (Capparis deciduas), Heens (Capparis sepiaria), lasoda (Cordia myxa), barna (Crataeva religiosa), thor (Euphorbia spp.), papdi (Holoptelia integrifolia), jamun (Syzygium cumini), ber (Zizyphus mauritiiana), kala siris (Albizzia lebbeck), kadam (Mitragyna parviflora), sentha (Bauhinia racemosa), goya khair (Dichrostachys cineraria), badh (Ficus spp.), gathber (Zizyphus xylopyrus), khirni (Wrightia tinctoria), etc; AND WHEREAS, the major fauna recorded from the Ramsagar Wildlife Sanctuary are Indian wild boar (Sus sacrofa cristatus), sloth bear (Melursus ursinus), jungle cat (Felis chaus), blue bull/nilgai (Boselaphus tragocamelus), Indian hare (Lepus nigricollis ruficaudatus), hedge hog (Hemiechinus auritus), striped hyena (Hyaena hyaena), jackal (Canis aureus), common mongoose (Herpested edwardsii), black buck (Antilope cervicarpa), caracal (Felis caracal), chinkara (Gazelle gazelle), wild dog (Cuon alpines), Indian fox (Vulpes bengalensis), cat-leopard (Felis bengalensis), sambhar (Cervus unicolor), spotted deer (Axis axis), crocodile (Crocodylus palustris), turtle, alligator (Gavialis gangeticus), etc; AND WHEREAS, the important bird species of the Ramsagar Wildlife Sanctuary are blue-cheeked bee-eater (Merops persicus), green bee-eater (Merops orientalis), Indian roller (Coracias benghalensis), common hawk-cuckoo (Hierococcyx varius), red-vented bulbul (Pycnonotus cafer), crested bunting (Melophus lathami), white-eyed buzzard (Butastur teesa), citrine wagtail (Motacilla citreola), large pied wagtail (Motacilla maderaspatensis), simple golden oriole (Oriolus oriolus), black-rumped flameback (Dinopium benghalense), yellowcrowned woodpecker (Dendrocopos mahrattensis), etc; While the important butterfly, insects, reptiles species recorded from the Sanctuary are Python (Python molurus), Russels’s viper (Pipera russelli), cobra (Naja naja), rat snakes (Ptyas mucosus), common Krait (Bungarus caeruleus), Indian Monitor (Varanus griseus), etc; AND WHEREAS, the important rare, threatened and endangered species of the Sanctuary are hyaena (Hyaena hyaena), sloth bear (Melursus ursinus), leopard (Panthera pardus) etc; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Ramsagar Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 (zero) to one kilometre around the boundary of Ramsagar Wildlife Sanctuary, in Dholpur district in the State of Rajasthan as the Ramsagar Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: -
1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 0 (zero) to 1 kilometre around the boundary of Ramsagar Wildlife Sanctuary and the area of the Eco-sensitive Zone is
27.50 square kilometres. The extent of Eco-sensitive Zone at various direction of the Sanctuary are given below: Direction Extent (kilometre) North 0 North- East 1 East 1 South-East 1 South 1 South-West 1 West 1 North-West 1 Zero extent of Eco-sensitive Zone was justified as – “The northern boundary of the Ramsagar Wildlife Sanctuary is the embankment of Ramsagar Dam which was built in 1905. The dam is used for irrigation purpose. Just below the embankment in the north, there is the canal system from the dam, agriculture fields and villages. This permanent structure has been taken as the Eco-sensitive Zone boundary in northern part of Sanctuary. Extending the Eco-sensitive Zone beyond the embankment will result in conflict with local communities. Hence, using the physical feature as the Eco-sensitive Zone boundary the extent has been kept as zero. 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) The boundary description of the Ramsagar Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I.
(3) The maps of the Ramsagar Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC and Annexure-IID.
(4) List of geo-coordinates of the boundary of the Ramsagar Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure III.
(5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Ecosensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj; and
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as -
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by the State Government, whichever is more stringent.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.
(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:-
(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28 th March,
2016.
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco Sensitive Zone;
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. Union of India in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted.
3. Establishment of major hydro-electric project. Prohibited.
4. Use or production or processing of any hazardous substances. Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited. 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited. B. Regulated Activities
8. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that the local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per the building bye-laws to meet the residential needs of the local residents:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
10. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the competent authority.
11. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
12. Collection of Forest produce or Non- Timber Forest produce. Regulated as per the applicable laws.
13. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws (underground cabling may be promoted).
14. Infrastructure including civic amenities. Taking measures of mitigation as per the applicable laws, rules and regulations available guidelines.
15. Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation as per the applicable laws, rules, regulations & available guidelines.
16. Undertaking other activities related to tourism like flying over the Ecosensitive Zone area by hot air balloon, helicopter, drones, microlites, etc. Regulated as per the applicable laws. [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27
17. Protection of hill slopes and river banks. Regulated as per the applicable laws.
18. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
19. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.
20. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies. Regulated (except otherwise provided) as per the applicable laws except for meeting local needs.
21. Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.
22. Commercial extraction of surface and ground water. Regulated as per the applicable laws.
23. Solid Waste Management. Regulated as per the applicable laws.
24. Open well, bore well and the like for agriculture or other usage Regulated under applicable laws and the activity shall be strictly monitored by the concerned authority.
25. Introduction of exotic species. Regulated as per the applicable laws.
26. Eco-tourism. Regulated as per the applicable laws.
27. Use of polythene bags. Regulated as per the applicable laws.
28. Commercial sign boards and hoardings. Regulated as per the applicable laws. C. Promoted Activities
29. Rain water harvesting. Shall be actively promoted.
30. Organic farming. Shall be actively promoted.
31. Adoption of green technology for all activities. Shall be actively promoted.
32. Cottage industries including village artisans, etc. Shall be actively promoted.
33. Use of renewable energy and fuels. Bio-gas, solar light and the like shall be actively promoted.
34. Agro-Forestry. Shall be actively promoted.
35. Plantation of Horticulture and Herbals. Shall be actively promoted.
36. Use of eco-friendly transport. Shall be actively promoted.
37. Skill Development. Shall be actively promoted.
38. Restoration of degraded land or forests or habitat. Shall be actively promoted.
39. Environmental awareness. Shall be actively promoted.
5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- Sl. (vii) One expert in Ecology from reputed institution or university of the State Member;
(viii) Deputy Conservator of Forests, National Chambal Ghariyal Sanctuary, Sawai-madhopur Member-Secretary.
6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Monitoring Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
