Xई थी और व7यजीव वाड�न और पा!रिHथितक$ िवPानी के साथ Hथानीय िनकाय2 िनवा�िचत सदHय2 अMय=, गंडमनयकानूर, थेYप'पाTी, पलायककोTई और कदमािलकंुड ने भाग िलया था। संक�प पा!रत करने के पIात, राजHव िवभाग अिधकारी पे!रयाकुलम ने यह कहते Xए इस �Hताव पर हHता=र नह; �कये �क उ7ह े�दशािनद[श2 और =े�ीय िनरी=ण का अMययन करने के िलए समय चािहए। बXमत अनुमोदन के अनुसार सकं�प पा!रत �कया गया था; और, मेगामलाई व7यजीव अभयारEय Qी िव�लीपूथूर ि\Gलड िगलहरी व7यजीव अभयारEय और पे!रयर बाघ !रजव� से िघरा Xआ ह ैऔर इस अभयारEय म. अि]तीय जैव िविवधता ह ैऔर पिIमी घाट2, के दि=णी भाग म. कई सू^म पया�वास ह_। िवशेषकर तिमलनाडु और केरल के िविश9 जैव िविवधता भ-ूदृ̀ य के भौगोिलक Hथान ह_; और, यह पे!रयर हाथी !रज़व� म. हाथी संर=ण काय�cम के िलए महdवपूण� भ-ूदृ̀ य ह ैऔर यहां बृहत संटे वन और समीपवतe =े�2 स ेस'पक� ता होने के कारण इस व7यजीव अभयारEय म. संकटापf �जाितय2 जसेै सफेद िगलहरी, हाथी, बाघ, त.दआु, नीलिगरी तहर, गौर, gसंह पुhछ वानर, क$ 0ापक िविवधता ह ैऔर इस पया�वास क$ िविवधता म. दलु�भ पौध2, इनवट[iेjस, मछिलय2, उभयचर2 और सरीसृप2 क$ कई �जाितय2 का संयोजन होता ह;ै और, मेगामलाई व7यजीव अभयारEय म. Hथािनक वनHपितS और जीवजंतुS क$ कई �जाितयां ह ैिजसम. वनHपित और जीवजंतुS क$ िविवधता ह।ै संरि=त =े� म. वनHपित के उदाहरण कुल�य अबुसन (अबुसन करी पुम (एल.) मेडीकुस), बलीHटेर करेपेर (कारदीओ पेरमुम हिेलकबबुम एल.), बुTेरkली बीअन (कलीटो�रया टेमटेियया एल.), लो�लीपोप कली'बेर (दी�लो�यलोस पलमाटुस (एल.) सी. जkफरेय), आ�द; जीवजंतु के उदाहरण नीलिगरी लंगूर (तेराचयपीथे�स जोह�ी), तुफटेड \े लंगूर (से�ोिपथकुेस प�रअम), बाघ-टे�ड मका�यू (मकाका िसलेनुस), लघ ुपुhछ वानर (मकाका रदीअटेपू),\े तवांगु (लो�रस लयद ेेरनुस),बाघ (प!थेरा टाइग�रस), त.दआु (पे$थेरा %&ूस), जंगली िब�ली (फेिलस चाउस), आ�द पाए जाते ह_; और, अभयारEय म. पि=य2, िततिलय2, क$ड़-ेमकोड़ ेसरीसृप2 क$ िविवधता ह_। पि=य2 के उदाहरण ओ!रएटल हनी बजड� (पेरिनस पटीलोरहनचुस), जेरदोन बजा (अिवकेदा जेरदोनी), :लाक-शॉ�डरेड काइट (इलानसु के(लेउस), सोट�-टोइड सॉप-ईगल (*करकैटूस ग,लीकुस ), लॉग-िब�लेड िग](गयपस इंिडकुस) आ�द ह;ै उभयचर2 के उदाहरण म.ढक (बुफो कबेर)), सामा7य भारतीय टोड (द.ुाफरयनुस मेलानू टीकटुस),वाटर िHकYपर और िHकYपर म.ढक (इयफ,यि�टस चयनोफ,यक�टस), भारतीय प2ड और \ीन म.ढक(इयफ,यक�टस ह�ेदकटयलुस) आ�द ह;ै अभयारEय म. Hथािनक �जाितयाँ रोज (अटरोफनेउरा प/दीयना), दि=णी बड�gवंग (टरोइदेस िमनोस), वाइट िडHक हजे :लू (केलाटो�या अि,बदी का),नीलिगरी बाघ (परां�टका िनलिगरीइंिसस) आ�द पाई जाती ह;ै और, =े� क$ महdवपूण� अथ�0वHथा मुpय @प से कृिष ह।ै पा!रिHथितक$ संवेदी जोन का 85% से अिधक =े� कृिष उपयोग म. ह ैऔर शेष =े� का �योग पशुपालन और अ7य संबंिधत �cयाकलाप2 के िलए �कया जाता ह;ै अतः, अब, के7Bीय सरकार, पया�वरण (संर=ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प!ठत पया�वरण (सरं=ण) अिधिनयम, 1986 (1986 का 29) (िजस ेइसके पIात इस अिधसूचना म. पया�वरण अिधिनयम कहा गया ह)ै क$ धारा 3 क$ उपधारा )1( और उपधारा (2) के खंड (v) और खंड (xiv) )ारा �दq शि1य2 का �योग करते Xए, तिमलनाडु राGय म. मेगामलाई व7यजीव अभयारEय क$ सीमा के चार2 ओर शू7य �कलोमीटर (गंडामनूर Qेणी क$ पूवe सीमा क$ ओर Qी िव�लीपूथूर ि\Gलड िगलहरी व7यजीव अभयारEय )ारा आhछा�दत ह)ै से 1.7 �कलोमीटर तक िवH ता!रत =े� मेगामलाई व7यजीव अभयारEय को पा!रिHथितक$ संवेदी जोन (िजसे इसके प` चात् इस अिधसूचना म. पा!रिHथितक$ सवेंदी जोन कहा गया ह)ै, के @प म. अिधसूिचत करती ह,ै िजसके िववरण िनsानुसार है, अथा�त् :- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 1. 1. 1. 1. पा�रि�थपा�रि�थपा�रि�थपा�रि�थितक ितक ितक ितक सवेंदीसवेंदीसवेंदीसवेंदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर उसक उसक उसक उसक सीमाएंसीमाएंसीमाएंसीमाएं....----(1) पा!रिHथितक$ संवेदी जोन का िवHतार मेगामलाई व7यजीव अभयारEय के चार2 ओर शू7य �कलोमीटर (गंडामनूर Qेणी क$ पूवe सीमा क$ ओर Qी िव�लीपूथरू ि\Gलड िगलहरी व7यजीव अभयारEय )ारा आhछा�दत है) से 1.7 �कलोमीटर तक िवHतृत ह ैऔर पा!रिHथितक$ संवेदी जोन का =े� 116.73 वग� �कलोमीटर ह।ै (2) पा!रिHथितक$ संवेदी जोन क$ सीमा का वण�न उपाबंध-I के @प म. उपाब] है। (3) पा!रिHथितक$ संवेदी जोन का सीमाकंन करने वाले संरि=त =े� के मानिच� उपाबधं–IIक-ङ के @प म. उपाब] ह।ै (4) पा!रिHथितक$ संवेदी जोन और संरि=त =े� क$ सीमा के भू िनद[शांक उपाबंध III क$ सारणी क और सारणी ख म. दी गई ह।ै (5) मुpय gबंदSु के उनके भ-ूिनद[शांक2 के साथ पा!रिHथितक$ संवेदी जोन म. आने वाले \ाम2 क$ सूची उपाबंध IVके @प म. उपाब] ह।ै 2. 2. 2. 2. पा�रि�थितक पा�रि�थितक पा�रि�थितक पा�रि�थितक संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आंचिलकआंचिलकआंचिलकआंचिलक महायोजनामहायोजनामहायोजनामहायोजना–––– (1) राGय सरकार, पा!रिHथितक$ संवेदी जोन के �योजन2 के िलए राजप� म. इस अिधसूचना के �काशन क$ तारीख से दो वष� क$ अविध के भीतर, Hथानीय 0ि1य2 के परामश� स ेऔर राGय के स=म �ािधकारी के अनुमोदन के िलए इस अिधसूचना म. �दए गए अनुबंध2 का पालन करते Xए आंचिलक महायोजना तैयार करेगी। (2) राGय सरकार )ारा पा!रिHथितक$ संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित स ेजो इस अिधसूचना म. िविनuद�v ट �कए गए ह_ के अनुसार तथा सुसंगत क. Bीय और राG य िविधय2 के अनु प और क. Bीय सरकार )ारा जारी माग�िनद[श2, य�द कोई ह2, )ारा तैयार होगी । (3) आंचिलक महायोजना, उ1 योजना म. पा!रिHथितक$ और पया�वरणीय बात2 को समाकिलत करने के िलए राG य सरकार के िनsिलिखत िवभाग2 के परामश� से तैयार होगी, अथा�त्:-

(i) पया�वरण;

(ii) वन और व7यजीव;

(iii) कृिष;

(iv) राजH व;

(v) नगर िवकास;

(vi) पय�टन;

(vii) \ामीण िवकास;

(viii) gसंचाई और बाढ़ िनयं�ण;

(ix) नगरपािलका;

(x) पंचायती राज;

(xi) लोक िन मा�ण िव भाग;

(xii) राजमाग�; और

(xiii) तिमलनाडु राGय �दषूण िनयं�ण बोड�। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) आंचिलक महायोजना अनुमो�दत िवyमान भ-ूउपयोग, अवसंरचना और �cयाकलाप2 पर कोई िनबzधन अिधरोिपत नह; करेगी जब तक �क इस अिधसूचना म. इस �कार िविनuद�v ट न हो और आचंिलक महायोजना सभी अवसंरचना और �cयाकलाप2 म. जो अिधक द=ता और पा!रिHथितक$ अनुकूल ह2 का संवध�न करेगी । (5) आंचिलक महायोजना म. अनाhछा�दत =े�2 के जीणA]ार, िवyमान जल िनकाय2 के संर=ण, आवाह =े�2 के �बंधन, जल-संभर2 के �बंधन, जल संभर �बंधन, मदृा और नमी संर=ण, Hथानीय समुदाय2 क$ आव`यकताS तथा पा!रिHथितक$ और पया�वरण से संबंिधत ऐस ेअ7य पहलSु, िजन पर Mयान दनेा आव`यक ह,ै के िलए उपबंध ह2गे । (6) आंचिलक महायोजना िवyमान और �Hतािवत भिूम उपयोग िवशेषताS के :यौर2 से अनुसम8थ�त मानिच� के साथ सभी िवyमान पूजा H थल2, \ाम2 और नगरीय बिHतय2, वन2 के �कार और �कH म2, कृिष =े�2, ऊपजाऊ भिूम, ह!रत =े� जैसे उyान और उसी �कार के H थान, उyान कृिष =े�, फलोउyान, झील2 और अ7य जल िनकाय2 का अ{यकंन करेगी। (7) आंचिलक महायोजना पा!रिHथितक$ संवेदी जोन म. िवकास को िविनयिमत करेगी और सारणी म. सूचीब] पैरा म. �ितिष] और िविनयिमत �cयाकलाप2 का अनुपालन करेगी और H थानीय समदुाय2 क$ जीिवका को सुरि=त करने के िलए पा!रिHथितक$ अनुकूल िवकास को सुिनिIत और उसक$ अिभवृि] भी करेगी। (8) आंचिलक महायोजना �ादिेशक िवकास योजना क$ सह-िवHतारी होगी । (9) इस �कार अनुमो�दत आंचिलक महायोजना इस अिधसूचना के उपबंध2 के अनुसार मानीटरी के अपने काय| को करने के िलए मानीटर सिमित के िलए एक संदभ� दHतावेज तैयार करेगी । 3. 3. 3. 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय....- राGय सरकार इस अिधसूचना के उपबंध2 को �भावी करने के िलए िनsिलिखत उपाय करेगी, अथा�त्:- (1) भूभभूूभू----उपयोगउपयोगउपयोगउपयोग....– (क) पा!रिHथितक$ संवेदी जोन म. वन2, उyान कृिष =े�2, कृिष =े�2, मनोरंजन के �योजन2 के िलए िचि7हत �कए गए पाक| और खुले Hथान2 का वािणिGयक या आवासीय या औyोिगक संब] िवकास �cयाकलाप2 के िलए उपयोग या संप!रवत�न नह; होगा: परंतु यह �क पा!रिHथितक$ सवेंदी जोन के भीतर भाग (क) म. िविनuद�9 �योजन2 स ेिभf �योजन के िलए कृिष और अ7य भिूम का संप!रवत�न मानीटरी सिमित क$ िसफा!रश पर और यथा लागू और =े�ीय नगर योजना अिधिनयम और के7Bीय सरकार या राGय सरकार के अ7य िनयम2 तथा िविनयम2 के अधीन स=म �ािधकारी के पूव� अनुमोदन से, और इस अिधसूचना के उपबंध2 )ारा Hथानीय िनवािसय2 क$ िनsिलिखत आवासीय आव`यकताS को पूरा करने के िलए अनुPात �कया जाएगा, जैस:े- (i) िवyमान सड़क2 को चौड़ा करना और उ7ह. सुदढ़ृ करना तथा नई सड़क2 का संिनमा�ण; (ii) बुिनयादी ढांच2 और नाग!रक सुिवधाS का सिंनमा�ण और नवीकरण; (iii) �दषूण उCपf न करने वाले लघु उyोग; (iv) कुटीर उyोग2 िजनके अंतग�त \ामीण उyोग भी ह_; सुिवधाजनक भEडार और Hथानीय सिुवधाएं सहायक पा!रिHथितक$ पय�टन िजसके अ7तग�त \ह वास सि'मिलत ह;ै और (v) पैरा 4 के अधीन �दए गए संव8ध�त �cयाकलाप: परंतु यह और �क �ादिेशक नगर योजना अिधिनयम और राGय सरकार के अ7य िनयम2 और िविनयम2 के अधीन स=म �ािधकारी के पूव� अनुमोदन और संिवधान के अनुhछेद 244 के उपबंध2 या तCसमय �वृq िविध के उपबंध2 के अनुपालन के िबना, िजसके अ7तग�त अनुसूिचत जनजाित और अ7य परंपरागत वन िनवासी (वन अिधकार2 क$ मा7यता) अिधिनयम, ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 2006 (2007 का 2) भी ह,ै वािणिGयक या औyोिगक िवकास �cयाकलाप2 के िलए जनजातीय भिूम का उपयोग अनुPात नह; होगा: परंतु यह और भी �क पा!रिHथितक$ संवेदी जोन के भीतर भ-ूअिभलेख2 म. उपसंजात कोई गलती, मानीटरी सिमित के िवचार �ाD करने के पIात् राGय सरकार )ारा �Cयेक मामले म. एक बार ठीक होगी और उ1 गलती के सुधार क$ सूचना क. Bीय सरकार के पया�वरण, वन और जलवायु प!रवत�न मं�ालय को दी जाएगी: परंतु यह और भी �क गलती के संशोधन म. इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म. भ-ूउपयोग का प!रवत�न सि'मिलत नह; होगा; (ख) वनीकरण तथा वास जीणA]ार �cयाकलाप2 सिहत अन�यु� त या अनुC पादक कृिष =े�2 म. पुन: वनीकरण करने के �यास �कए जाएंगे। (2) �ाकृितक�ाकृितक�ाकृितक�ाकृितक जल जल जल जल �ोत��ोत��ोत��ोत�....- आचंिलक महायोजना म. सभी �ाकृितक जल �ोत2 न�दय2 और जलमाग| के आवाह =े�2 क$ पहचान क$ जाएगी और उनके सरं=ण और नवीकरण के िलए योजना सि' मिलत होगी और राG य सरकार )ारा ऐसे =े�2 पर या उनके िनकट िवकास �cयाकलाप �ितिष] करने के बारे म. जो ऐसे =े�2 के िलए अिहतकर हो ऐसी रीित से माग�दश�क िस]ांत तैयार �कए जाएंगे । (3) पय�टनपय�टनपय�टनपय�टन यायायाया पा�रि�थितक पय�टनपा�रि�थितक पय�टनपा�रि�थितक पय�टनपा�रि�थितक पय�टन.- (क) पा!रिHथितक$ संवेदी जोन के भीतर सभी नए पा!रिHथितक$ पय�टन �cयाकलाप या िवyमान पय�टन �cयाकलाप2 का िवHतार पय�टन महायोजना के अनुसार पा!रिHथितक$ संवेदी जोन के िलए होगा; (ख) पय�टन महायोजना राGय पय�टन िवभाग )ारा राGय पया�वरण और वन िवभाग के परामश� स ेतैयार होगी; (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के @प म. होगी; (घ) पय�टन महायोजना पा!रिHथितक$ संवेदी जोन क$ वहन =मता के आधार पर तैयार क$ जाएगी। (ङ) पा!रिHथितक$ पय�टन संबंधी �cयाकलाप िनsानुसार िविनयिमत ह2गे:- (i) संरि=त =े� क$ सीमा से एक �कलोमीटर के भीतर या पा!रिHथितक$ संवेदी जोन के िवHतार तक, इनम. जो भी िनकट ह,ै नये वािणिGयक होटल और सैरगाह के सिfमा�ण अनुPात नह; ह2गे: परंतु, यह �क संरि=त =े� क$ सीमा से एक �कलोमीटर क$ दरूी से परे पा!रिHथितक$ संवेदी जोन के िवHतार तक होटल2 और !रजॉट� का Hथापना केवल पूव� प!रभािषत और नामिनuद�9 =े�2 म. पय�टन महायोजना के अनुसार पा!रिHथितक$ पय�टन सुिवधाS के िलए ही अनुPात होगा; (ii) पा!रिHथितक$ संवेदी जोन के भीतर नए पय�टन �cयाकलाप2 या िवyमान पय�टन �cयाकलाप2 का िवHतार क. 4774(E), dated the 10 th September, 2018, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 10 th September 2018;

AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the aforesaid draft notification were considered by the Central Government;

AND WHEREAS, the Megamalai Wildlife Sanctuary lies in the southern Western Ghats falling in the State of Tamil Nadu in the revenue districts of Theni and Madurai between 09 0 37’ to 09 0 57’ N latitude and between 77 0 11’ to 77 0 42’ E longitude, total area of Megamalai Wildlife Sanctuary declared is 269.10 square kilometre (26910.815 hectre);

declared also as per resolution passed by the committee formed with Revenue Deparment officer Uthamapalayam, Panchayat Union Chairman of Cumbum, Wildlife Warden and an Ecologist on 04.01.2013, at Cumbum Forest Rest House for the public interest and to conserve the forest and again re-resolution passed on 13.01.2013 including for all 21 items; Revenue Department officer Usilampatti and Chairman Elumalai Town Panchayat and Municipal Chairman, Usilampatti on 19.01.2013 passed resolution of 20 items;

AND WHEREAS, for Gandamanur East block, the committee sat on 21.01.2013 in the chamber of District Backward welfare office under the chairmanship of Revenue Deparment officer Periyakulam and attended by elected members of local bodies, Presidents Gandamanayakanur, Theppampatti, Palayakottai and Kadamalaikundu along with Wildlife Warden and Ecologist. After passing resolution, the Revenue Department officer Periyakulam did not sign the resolution stating that he needed time for studying the guidelines and field inspection. As per majority approval the resolution was passed;

AND WHEREAS, the Megamalai Wildlife Sanctuary is the surrounded by the Srivilliputhur Grizzled Squirrel Wildlife Sanctuary and Periyar Tiger Reserve and this Sanctuary has unique habitat of harboring biodiversity and several microhabitats in southern part of Western Ghats, especially the place of two distinct geographical regions of bio diversity landscape Western Ghats of Tamil Nadu and Kerala;

AND WHEREAS, it is an important landscape for elephant conservation programme in Periyar Elephant Reserve and owing to its large contiguous forests and connectivity with adjoining protected areas, this wildlife Sanctuary has wide varieties of endangered species such as Grizzled Squirrel, Elephant, Tiger, Leopard, Nilgiri tahr, Gaur, Lion Tailed Macaque, etc. And the diversity of habitat has got an assemblage of several species of rare plants, invertebrates, fishes, amphibians and reptiles;

AND WHEREAS, the Megamalai Wildlife Sanctuary has several species of endemic flora and fauna, which has diversity of flora and fauna, examples of flora found in the protected area are Curly abutilon (Abutilon crispum (L.)

Medikus), Blister creeper (Cardiospermum helicababum L.), Butterfly Bean (Clitoria ternateaL.), Lollipop Climber (Diplocyclos palmatus (L.) C. Jeffrey), etc.; examples of fauna are Nilgiri Langur (Semnopithecus johnii), Tufted Grey Langur (Semnopithecus priam), Lion-tailed Macaque (Macaca silenus),Bonnet Macaque (Macaca radiate), Grey Slender Loris (Loris lydekkerianus),Tiger (Panthera tigris),Leopard (Panthera pardus),Jungle Cat (Felis chaus), etc.;

AND WHEREAS, the sanctuary has variety of birds, butterflies, insects, reptiles, examples of birds are Oriental Honey-Buzzard (Pernis ptilorhynchus),Jerdon's Baza(Aviceda jerdoni), Black-shouldered Kite(Elanus caeruleus),Shorttoed Snake-Eagle(Circaetus gallicus ),Long-billed Vulture(Gyps indicus)etc; examples of amphibians are Ferguson's Toad (Bufo scaber), Common Indian Toad (Duttaphrynus melanostictus), Water Skipper or Skipper Frog (Euphlyctis cyanophlyctis), Indian Pond or Green Frog (Euphlyctis hexadactylus), etc. and endemic species found in the Sanctuary are Malabar Rose (Atrophaneura pandiyana), Southern Birdwing (Troides minos),White Disc Hege Blue (Celatoxia albidisca), Nilgiri Tiger (Parantica nilgiriensis), etc.;

AND WHEREAS, the important economy of the area is primarily agriculture, more than 85% of the Ecosensitive Zone area is in agricultural use and remaining areas are used for animal husbandry and other related activities;

NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from zero kilometre (towards the eastern 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] boundary Gandamanur range covered by the Srivilliputhur Grizzled Squirrel Wildlife Sanctuary) to 1.7 kilometre around the boundary of the Megamalai Wildlife Sanctuary in the State of Tamil Nadu as the Megamalai Wildlife Sanctuary Eco-sensitive Zone (here after referred to as the Eco-sensitive Zone), details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone. - (1) The extent of the Eco-sensitive Zone varies from zero kilometer (towards the eastern boundary Gandamanur range covered by the Srivilliputhur Grizzled Squirrel Wildlife Sanctuary) to

1.7 kilometer around the Megamalai Wildlife Sanctuary and the area of the Eco-Sensitive Zone is 116.73 square kilometers.

(2) The boundary description of the Eco-sensitive Zone is appended as Annexure I.

(3) The maps of the Protected Area demarcating the Eco-sensitive Zone boundary are appended as Annexures IIA-E.

(4) The geo co-ordinates of the boundary of the Protected Area and the Eco-sensitive Zone are given in Table A and Table B of Annexure III respectively.

(5) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure IV.

2. Zonal Master Plan for Eco-sensitive Zone. - (1) The State Government shall, for the purpose of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of competent authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating environmental and ecological considerations into the said plan: -

(1) Environment;

(2) Forest and Wildlife;

(3) Agriculture;

(4) Revenue;

(5) Urban Development;

(6) Tourism;

(7) Rural Development ;

(8) Irrigation and Flood Control;

(9) Municipal;

(10) Panchayati Raj;

(11) Public Works Department;

(12) Highways; and

(13) Tamil Nadu State Pollution Control Board.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in table and also ensure and promote eco-friendly development for security of local communities’ livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23

(1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities:

Provided that the conversion of agricultural and other lands, for the purpose other than that specified in clause (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and

(v) promoted activities and given in paragraph 4;

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies. - The catchment areas of all natural springs, rivers or channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or eco-tourism

(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests;

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan;

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone;

(e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution. – Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made there under.

(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental Act and rules made thereunder or standards stipulated by State Government, whichever is more stringent.

(9) Solid wastes. - Disposal and management of solid wastes shall be as under:-

(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone;

(b) safe and Environmentally Sound Management (ESM) of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.

(10) Bio-medical waste. - Bio-medical waste management shall be as under: -

(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March,2016 as amended from time to time.

(b) safe and Environmentally Sound Management (ESM) of biomedical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

(12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.

(13) E-waste. - The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.

(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution. - Prevention and control of vehicular pollution shall be carried out in accordance with applicable laws and efforts shall be made for use of cleaner fuel like CNG, LPG, etc.

(16) Industrial units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under: -

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act, and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife(Protection) Act 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl.No. Activity Description

1. Commercial mining, stone quarrying and crushing units.

(a) All new and existing mining (minor and major minerals) stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bonafide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumalpd Vz. UOI in W.P. (C) No. 202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation z. UOI in W.P. (C) No. 435 of 2012.

2. Setting of industries causing pollution (water, air, soil, noise, etc).

No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted:

Provided that non-polluting industries shall be allowed within Ecosensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.

3. Establishment of major hydroelectric project.

Prohibited (except as otherwise provided) as per applicable laws.

4. Use or production or processing of any hazardous substances.

Prohibited (except as otherwise provided) as per applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited (except as otherwise provided) as per applicable laws.

6. Setting of new saw mills.

No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns.

Prohibited (except as otherwise provided) as per applicable laws.

B. Regulated Activities

8. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or up to the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for eco-tourism activities:

Provided that, beyond one kilometre from the boundary of the Protected Area or up to the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

9. Construction activities.

(a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone, whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents.

Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.

10. Small scale non-polluting industries.

Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority.

11. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.

12. Collection of Forest Produce or Non- Timber Forest Produce (NTFP).

Regulated under applicable laws.

13. Establishment of large scale commercial live stock and poultry farms by firms, corporates, companies.

Regulated under applicable laws.

14. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated under applicable laws (Underground cabling may be promoted).

15. Infrastructure civic amenities.

Shall be done with mitigation measures, as per applicable laws, rules, regulations and available guidelines.

16. Widening and strengthening of existing roads and construction of new roads.

Shall be done with mitigation measures, as per applicable laws, rules, regulations and available guidelines.

17. Undertaking other activities related to tourism like over flying the Ecosensitive Zone area by hot air balloon, helicopter, drones, microlites, etc.

Regulated under applicable laws.

18. Protection of hill slopes and river banks.

Regulated under applicable laws.

19. Movement of vehicular traffic at night.

Regulated for commercial purpose under applicable laws.

20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

Permitted under applicable laws for use of locals.

21. Discharge of treated waste water/effluents in natural water bodies or land area.

The discharge of treated waste water/effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water, otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.

22. Commercial extraction of surface and ground water.

Regulated under applicable laws.

33. Use of renewable energy and fuels. Bio gas, solar light, etc. shall be actively promoted.

34. Agro-forestry. Shall be actively promoted.

35. Use of eco-friendly transport. Shall be actively promoted.

36. Skill development. Shall be actively promoted.

37. Restoration of degraded land/forests/habitats.

Shall be actively promoted.

38. Environmental awareness. Shall be actively promoted.

39. Plantation of horticulture and herbals Shall be actively promoted.

5. Monitoring Committee.— The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification, comprising of the following namely:—

1. District Collector, Theni District, Theni Chairman;

2. A representative of Non-Government Organisation working in the field of wildlife conservation to be nominated by the State Government Member;

3. An expert in Biodiversity nominated by the State Government Member;

4. An expert in Ecology and Environment to be nominated by the State Government Member;

5. A representative from the State Public Works Department Member;

6. A representative from the State Pollution Control Board Member;

7. Wildlife Warden, Megamalai Wildlife Division, Theni Member- Secretary.

6. Terms of Reference.— (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the Monitoring new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner shall be competent to file complaints under section 19 of the Environment Act against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per Performa given in Annexure V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional measures.—The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. Supreme Court, etc. orders. —The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or National Green Tribunal.

GARKOTI, Scientist ‘G’ ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 29 ANNEXURE- I BOUNDARY DESCRIPTION OF ECO-SENSITIVE ZONE OF THE PROTECTED AREA North In northern part of Megamalai Wildlife Sanctuary boundary started from Gandamanur east RF towards east to Andipatty, Elummalai and Doddappanayakanur South RF Joint. It is extended about 10m distance along to the RF Gandamanur East RF and Elumalai RF. In northern boundary of this Sanctuary which is consisting of 4.2 km extended along the Elumalai RF and 5.8 km extented along with Gandamanur East RF.

North East In the north-east part of the Sanctuary consisting in very less portion of Gandmanur range. Here The boundary started with Andipatti and Elumalai RF Joints on the norther portion of the Sanctuary end.

Towards eastern side extending to 3.2km.

East In the Eastern boundary of Sanctuary extended 18.75km in gandamanur range. This part is consisting of Elumalai and Sulapuram RF. And these RF boundary adjacent to the Village boundary of mudurai district.

In other part of the Sanctuary boundary extended about 35km from Kerala Boundary of Southern side. And it starts towards northersn side and anding in chinnamanur range. There was Vannathiprai RF, Koothanachi RF and Erasakkanayakanur RF consisting the eastern boundary of Sanctuary in Cumbu East ange and Chinnamanur Range.

South East The South east portion boundary is not elongated which part of gandamanur east RF from Mayiladumparai village to Sirangikal mottai and another bit of mulakadai village to Aruguveli village. It runs through adjacent revinue and village boundary of Gandamanur east RF South Thence the boundary runs generally towards North west Direction along the southern boundary of Soolapuram Reserved Forests and meets the south east corner of Elumalai Reserved Forests which is also the common boundary between Andipatty and Usilampatty Taluks. Thence boundary runs, through the 19km, along the Kerala state boundary till it meet trijunction point of interstate lines and southern point of Peermedu Ghat road.

South West In South west part consisting about 25km distance from Mayiladimparai village to paluthu village. It is running towards from south to norther side of the gandamanur east RF of Gandamanur Range.

West Thence boundary runs towards northern-eastern direction along the Peermedu Ghat road and thence along the northern boundary of Melagudalur Reserved Forests and thence the boundary runs in northern-eastern and western sides along the peak 425 near 520, near Pandarathurai 404, near 712, 430, 498, 521 runs generally north along the eastern notified boundary of Cumbum Valley east Reserved Forests (Dhonikaradu Block) notified under section 16 of the Tamil Nadu Forest Act 1882 till to meet the starting point. Thence it is running towards erasakkanayakanur RF till the thenpalani or Alagapuri village. This is extened about 75 km distance going through from south to northern wards. And another bit of Gandamanur east RF consisting about 11km running towards south to north.

North West Thence the boundary runs generally towards north and north east direction along the common taluk boundary of Usilampatty and Andipatty which is also the eastern side of Gandamanaickanur Reserved Forests land till it meets the southern boundary of Andipatty southern slopes Rserved Forests, which is the south west point of Andipatty south Reserved Forests. Hence the boundary runs generally towards east and north east direction along the southern boundary of Andipatty south slope Reserved Forests, which is the common boundary of Andipatty and Usilampatty taluks and meets the starting point.
