(i) पया�वरण;
(ii) वन और व>यजीव;
(iii) कृिष;
(iv) राजB व;
(v) नगर िवकास;
(vi) पय�टन;
(vii) dामीण िवकास;
(viii) <संचाई और बाढ़ िनयं"ण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िन मा�ण िव भाग। (5) आंचिलक महायोजना अनुमो�दत िवuमान भ-ूउपयोग, अवसरंचना और �Zयाकलाप. पर कोई िनबvधन अिधरोिपत नह3 करेगी, जब तक �क इस अिधसूचना म& िविनsद�_ ट न हो और आचंिलक महायोजना सभी अवसंरचना और �Zयाकलाप. म& और अिधक द6ता और पा�रिBथितक अनुकूलता का संवध�न करेगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 (6) आंचिलक महायोजना म& अनाbछा�दत 6े". के जीण^qार, िवuमान जल िनकाय. के संर6ण, आवाह 6े". के �बंधन, जल-संभर. के �बंधन, भूतल जल के �बंधन, मृदा और नमी संर6ण, Bथानीय समुदाय. क# आवiयकताN तथा पा�रिBथितक और पया�वरण से संबंिधत ऐस ेअ>य पहलNू, िजन पर @यान दनेा आवiयक ह,ै के िलए उपबंध ह.गे । (7) आंचिलक महायोजना सभी िवuमान पूजा B थल., dाम. और शहरी बंदोबBत., वन. के �कार और �कB म., कृिष 6े"., ऊपजाऊ भूिम, ह�रत 6े" जैसे उuान और उसी �कार के B थान, उuान कृिष 6े", फलोउuान, झील. और अ>य जल िनकाय. का अxयकंन करेगी और उ- योजना के 2यौरे दतेे ;ए िवuमान और �Bतािवत भिूम के उपयोग को समyथ�त �कया जाएगा । (8) आंचिलक महायोजना B थानीय समुदाय. क# जीवकोपाज�न को सुिनिi चत करने के िलए, पा�रिBथितक संवेदी जोन म& िवकास को पा�रिBथितक अनुकूल िवकास के िलए िविनयिमत करेगी। (9) आंचिलक महायोजना इस अिधसूचना म& �दए गए उपबंध. के संबंध म& अपने कायz को करने के िलए िनगरानी सिमित के िलए एक संदभ� दBतावेज तैयार करेगी । 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय-------- राAय सरकार इस अिधसूचना के उपबंध. को �भावी करने के िलए िनlिलिखत उपाय करेगी, अथा�त्:-- (1) भूभभूूभू----उपयोग उपयोग उपयोग उपयोग –––– (क) (क) (क) (क) पा�रिB थितक संवेदी जोन म& वन., उuान-कृिष 6े"., कृिष 6े"., आमोद-�मोद के �योजन के िलए िचि>हत �कए गए पाकz और खुले Bथान. का वािणिAयक और औuोिगक संबq िवकास �Zयाकलाप. के िलए उपयोग या संप�रवत�न नह3 होगा और मानिच" के साथ आंचिलक महायोजना म& Bप{ jप से 6े". को िनधा��रत �कया जाएगा: परंतु पा�रिBथितक संवेदी जोन के भीतर कृिष भूिम का संप�रवत�न मानीटरी सिमित क# िसफा�रश पर और राAय सरकार के पूव� अनुमोदन से, 6े"ीय नगर योजना अिधिनयम के अधीन स6म �ािधकारी के पूव� अनुमोदन के साथ और के>hीय/राAय सरकार के अ>य िनयम. और िविनयम. के jप म& लागू ह.गे, जो Bथानीय िनवािसय. क# आवासीय जjरत. को पूरा करने के िलए ह,ै जैसे:- (i) िवuमान सड़क. को चौड़ा करना और उ>ह& सुदढ़ृ करना तथा नई सड़क. का संिनमा�ण; (ii) बुिनयादी ढांच. और नाग�रक सुिवधाN का संिनमा�ण और नवीकरण; (iii) �दषूण उ`प} न करने वाले लघ ुउuोग; (iv) कुटीर उuोग., िजसके अंतग�त dामीण उuोग भी हY; सुिवधाजनक भ?डार और Bथानीय सिुवधाN सहायक पा�रिBथितक पय�टन िजसके अ>तग�त dह वास भी ह;ै और (v) पैरा 4 के अधीन �दये गए संवyध�त �Zयाकलाप: परंतु यह और भी �क राAय सरकार के पूव� अनुमोदन तथा संिवधान के अनुbछेद 244 और त`समय �वृ9 िविध के उपबंध. के अनुपालन के िबना, िजसके अंतग�त अनुसूिचत जनजाित और अ>य परंपरागत वन िनवासी (वन अिधकार. क# मा>यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिAयक या उuोग िवकास �Zयाकलाप. के िलए जनजातीय भूिम का उपयोग अनु�ात नह3 होगा: परंतु, यह और भी �क पा�रिB थितक संवेदी जोन के भीतर भ-ूअिभलेख. म& उपसंजात कोई "ु�ट, मानीटरी सिमित के िवचार �ा: करने के प�ात् राAय सरकार %ारा �`येक मामले म& एक बार संशोिधत होगी और उ- "ु�ट के संशोधन क# सूचना क& hीय सरकार के पया�वरण, वन और जलवायु प�रवत�न मं"ालय को दनेी होगी: परंतु यह और भी �क उपयु�- "ु�ट का संशोधन म& इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म& भ-ूउपयोग का प�रवत�न सि\मिलत नह3 होगा । (ख) परंत ुयह और भी �क िजससे ह�रत 6े" म& जैसे वन 6े", कृिष 6े" आ�द म& कोई पा�रणािमक कटौती नह3 होगी। (2) �ाकृितक जल "ोत�ाकृितक जल "ोत�ाकृितक जल "ोत�ाकृितक जल "ोत -- आचिंलक महायोजना म& सभी �ाकृितक जल Pोत. क# पहचान क# जाएगी और उनके संर6ण और पुन��भूतकरण के िलए योजना सि\ मिलत होगी और राA य सरकार %ारा ऐसे 6े". पर या उनके िनकट िवकास �Zयाकलाप �ितिषq करने के िलए ऐसी रीित स ेमाग�दश�क िसqांत तैयार �कए जाएंगे । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) पय�टन पय�टन पय�टन पय�टन –––– (क) पा�रिBथितक संवेदी जोन के भीतर सभी नए पा�रिBथितक पय�टन �Zयाकलाप या िवuमान पय�टन संबंधी �Zयाकलाप पा�रिBथितक संवेदी जोन के िलए पय�टन महायोजना के अनुसार ह.गे । (ख) पा�रिBथितक पय�टन महायोजना पय�टन िवभाग, %ारा राAय सरकार के पया�वरण और वन िवभाग के परामश� से तैयार होगी । (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के jप म& होगी । (घ) पा�रिBथितक पय�टन संबंधी �Zयाकलाप िन\ निलिखत के अधीन िविनयिमत ह.गे, अथा�त् :- (i) नर<संहगढ़ व>यजीव अभयार?य क# सीमा से एक �कलोमीटर के भीतर तक या पा�रिBथितक संवेदी जोन के िवBतार तक, इनम& जो भी िनकट ह,ै होटल. और �रसोटz के �कसी नए सि}मा�ण को अनु�ात नह3 �कया जाएगा। परंतु, पा�रिBथितक संवदेी जोन के िवBतार के एक �कलोमीटर से परे और पा�रिBथितक संवेदी जोन के िवBतार तक सभी नए पय�टक �Zयाकलाप या िवuमान �Zयाकलाप का िवBतार पय�टन महायोजना के अनुसार होगा; (ii) पा�रिBथितक संवेदी जोन के भीतर सभी नए पय�टन �Zया-कलाप या िवuमान पय�टन �Zयाकलाप. के िवBतार के>hीय सरकार, पया�वरण, वन और जलवायु प�रवत�न मं"ालय %ारा जारी माग�दश�क िसqांत. तथा पा�रिBथितक पय�टन पर बल दतेे ;ए रा�ीय बाघ संर6ण �ािधकरण %ारा जारी पा�रिBथितक पय�टन माग�दश�क िसqांत. (समय-समय पर यथा सशंोिधत) के अनुसार होगा । (iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय�टन के िलए िवकास और िवuमान पय�टन �Zयाकलाप. के िवBतार को वाBतिवक Bथल िविनsद�{ संवी6ा तथा मानीटरी सिमित क# िसफा�रश पर आधा�रत संबंिधत िविनयामक �ािधकरण. %ारा अनु�ात �कया जाएगा । (4) नैस&ग�कनैस&ग�कनैस&ग�कनैस&ग�क िवरासतिवरासतिवरासतिवरासत ---- पा�रिBथितक संवेदी जोन म& मह`वपूण� नैसyग�क िवरासत के सभी Bथल. जैसे सभी जीन कोश आरि6त 6े", शैल िवरचनाएं, जल �पात., झरन., घाटी मागz, उपवन., गुफाN, Bथल., �मण, अ�रोहण, �पात., आ�द क# पहचान क# जाएगी और उ>ह& संरि6त �कया जाएगा तथा उनक# सुर6ा और संर6ा के िलए इस अिधसूचना के �काशन क# तारीख से छह मास के भीतर, उपयु- योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िन&म�त िवरासत � थमानव िन&म�त िवरासत � थमानव िन&म�त िवरासत � थमानव िन&म�त िवरासत � थल ल ल ल ---- पा�रिB थितक संवेदी जोन म& भवन., संरचनाN, िश�प-त�य, ऐितहािसक, कला`मक और सांBकृितक मह`व के 6े". क# पहचान करनी होगी और इस अिधसूचना के �काशन क# तारीख से छह माह के भीतर उनके संर6ण क# योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म& सि\मिलत क# जाएगी । (6) ' व' व' व' विन �दषूणिन �दषूणिन �दषूणिन �दषूण - पा�रिBथितक संवेदी जोन म& @ विन �दषूण के िनयं"ण के िलए राA य सरकार का पया�वरण िवभाग या म@य �दशे राA य �दषूण िनयं"ण बोड�, वायु (�दषूण िनवारण और िनय>"ण)1981 (1981 का 14) और उसके अधीन बनाये गए िनयम. के उपयोग के अनुसार माग�दश�क िसqात और िविनयम तैयार करेगा। (7) वायुवायुवायुवायु �दषूण�दषूण�दषूण�दषूण -- पा�रिBथितक संवेदी जोन म&, वायु �दषूण के िनयं"ण के िलए राAय सरकार का पया�वरण िवभाग या म@य �दशे राA य �दषूण िनयं"ण बोड� वायु (�दषूण िनवारण और िनयं"ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम. के उपबंध. के अनुसार माग�दश�क िसqांत और िविनयम तैयार करेगा । (8) बिह"ावबिह"ावबिह"ावबिह"ाव काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण -- पा�रिBथितक संवेदी जोन म& उपचा�रत बिहPाव का िनBसारण, जल �दषुण िनवारण और िनय>"ण अिधिनयम 1974(1974 का 6) और उसके अधीन बनाए गए िनयम. के उपबंध. के अनुसार होगा । (9) ठोसठोसठोसठोस अपिश. अपिश. अपिश. अपिश. ---- ठोस अपिश{. का िनपटान िनlिलिखत jप म& होगा - (क) पा�रिBथितक संवेदी जोन म& ठोस अपिश{. का िनपटान भारत सरकार के पया�वरण, वन और जलवायु प�रवत�न मं"ालय क# अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अ�ैल, 2016 ठोस अपिश{ �बंध िनयम, 2016 के अनुसार �कया जाएगा; और अकाब�िनक सामdी का िनपटान पा�रिBथितक संवेदी जोन के बाहर पहचान �कए गए B थल पर �कसी पया�वरणीय Bवीकृत रीित म& होगा; (ख) पा�रिBथितक# संवेदी जोन के भीतर जैव-िच�क`सा अपिश{. के सुरि6त और पया�वरणीय @विन �बंधन (ई एस एम) क# पहचान क# गई तकनीक. के उपयोग क# िवuमान िनयम. और िविनयम. के अनु�प दी जाएगी। (10) जैव िच�क0 सीजैव िच�क0 सीजैव िच�क0 सीजैव िच�क0 सीय अपिश2 टय अपिश2 टय अपिश2 टय अपिश2 ट- जैव िच�क` सीय अपिश_ ट �बंधन स.ंका.िन 343 (अ) तारीख 28 माच� 2016 %ारा �कािशत जैव िच�क`सीय अपिश{ �बंध िनयम, 2016 के उपबंध. के अनुसार �कया जाएगा । (ख) पा�रिBथितक संवेदी जोन के भीतर जैव-िच�क`सा अपिश{. के सुरि6त और पया�वरणीय @विन �बंधन (ईएसएम) क# पहचान क# गई तकिनक. के उपयोग क# िवuमान िनयम. और िविनयम. के अनुjप अनुमित दी जाएगी। (11) यानीययानीययानीययानीय प�रवहनप�रवहनप�रवहनप�रवहन - प�रवहन क# यानीय गितिविधयां आवास के अनुकूल िविनयिमत ह.गी और इस संबंध म& आंचिलक महायोजना म& िवशेष उपबंध अिधकिथत �कए जाएंगे और आंचिलक महायोजना के तैयार होने और राA य सरकार के स6म �ािधकारी के %ारा अनुमो�दत होने तक, मानीटरी सिमित �वृ9 िनयम. और िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 27th July, 2018 S.O. 3689(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.1308 (E), dated the 26th April, 2017, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, no objections and suggestions received from all persons and stakeholders in response to the said draft notification; WHEREAS, Narsinghgarh Wildlife Sanctuary situated in Rajgarh district in the State of Madhya Pradesh and spread over an area of 57.19 square kilometers has number of lakes and wetland areas with an artificial perennial lake and this lake is a major source of water to wild animals throughout the year and also the key attraction for the tourists; AND WHEREAS, the said Sanctuary is rich in floral and faunal diversity with Trees, Shrubs and Climbers 180 species (approx), Grasses 18 species (approx), Aquatic flora, 19 species (approx) and in faunal Tiger (Panthera tigris), Wildcat Felis chaus (Felidae),Percupine Hystisx indica (Hystricydae), Pangoline Menis crassicaudata (Manidae), andthe flora species are Haldu (Adina cordifolia), Kari Milusa tomentosa (Annonaceae), Bija (Pterocarpus marsupium), Maida (Litsea glutinosa), Harra (Terminalia chebula); AND WHEREAS, as per Champion and Seth’s revised classification the aforesaid Sanctuary is dry deciduous scrub forest and comprises mainly of Khair, Moyan Kardhai, Dhaura, Saja, Lendia, Tendu, Sitaphal, Karonda, Lantana and few patches of chandan and average density varies from 0 to 0.7, and most of the species are hardy to drought, fire and are good coppicers; AND WHEREAS, the important feature of this Sanctuary is presence of Paradise flycatcher in abundance and among other birds like Bulbul, Owl, Woodpecker, etc. are the commonly found species of the birds, which can be seen any time in the area; Paradise flycatcher, which is the State bird of Madhya Pradesh, is mostly found in dense forest especially in the summer period migratory birds which visit the Sanctuary include Spot billed duck, Bramhini duck, Sarus crane, Stilt, Jacana, Wagtail, Common Indian hornbill, White necked stork; and the carnivores’ family which is headed by Panther in the Sanctuary has no problem of their food, because Chinkara, Chital and Hare are found in abundance. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13 NOW, THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 100 meters on urban/residential settlement side to 2 kilometer in the rest of the area around the boundary of Narsinghgarh Wildlife Sanctuary in the State of Madhya Pradesh as the Narsinghgarh Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1)The Eco-sensitive Zone is spread over an area of
140.71 square kilometers with extent ranging from 100 meters on urban/residential settlements side to 2 kilometers on the rest of area from the boundary of the Narsinghgarh Wildlife Sanctuary and the boundary details in the form of Global Positioning System (GPS) coordinates of points along the boundary of Narsinghgarh Wildlife Sanctuary and its Eco-sensitive Zone are given in Annexure-I.
(2) The list of 48 villages falling in the Eco-sensitive Zone is appended as Annexure-II.
(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in that notification.
(2) The said plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation withall concerned State Departments, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department. for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the said Zonal Master Plan shall be supported by maps giving details of existing and proposed land use features.
(8) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone to ensure eco-friendly development for livelihood security of local communities.
(9) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions of monitoring under the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.-
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or industrial activities and such areas shall be clearly defined in the Zonal Master Plan along with maps:
Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant laws of the Central/State Government as applicable, to meet the residential needs of the local residents such as.-
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and
(v) Promoted activities and given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the of the competent authority under the relevant laws of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such areas.
(3) Tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-Tourism Master Plan shall be prepared by the Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of the eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within one kilometer from the boundary of the Narsinghgarh Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer. However, beyond the distance of one kilometer from the boundary of the Wildlife Sanctuary till the extent ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per the Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc., shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or the Madhya Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government or the Madhya Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Ecosensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time and the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive Zone.
(10) Bio-medical waste. - Bio-medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28 th March,2016 as amended from time to time.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive Zone.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Ecosensitive Zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:- TABLE S No Activity Description

1. Commercial Mining
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of new industries causing pollution (Water, Air, Soil, Noise, etc.). No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted. Industries categorised as Green or White in the Central Pollution Control Board Classification including agro-based small scale industries, will be regulated as per regulations.
3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. B. Regulated Activities
7. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of the Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
8. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies. Regulated under applicable laws.
9. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per building bye laws.
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
10. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the competent Authority
11. Setting up of brick kilns. Regulated (except as otherwise provided) as per applicable laws
12. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder.
13. Collection of Forest produce or Non-Timber Forest Produce (NTFP). Regulated under applicable laws.
14. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable law. Underground cabling may be promoted.
15. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
16. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
17. Undertaking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated under applicable law
18. Protection of hill slopes and river banks. Regulated under applicable laws 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
5. Monitoring Committee.-The Central Government hereby constitutes the Monitoring Committee, for effective monitoring of the Eco-sensitive Zoneof the following, namely:-
(i) Divisional Commissioner, Bhopal -Chairman;
(ii) One representative of Non-Governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Madhya Pradesh -Member;
(iii) An expert in the area of ecology and environment to be nominated by the Government of Madhya Pradesh -Member;
(iv) Representative of Madhya Pradesh Pollution Control Board -Member;
(v) Chief Conservator of Forests, Bhopal -Member;
19. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals.
21. Discharge of treated effluents in natural water bodies or land area. The discharge of treated effluent shall be regulated as per applicable laws.
22. Commercial extraction of surface and ground water. Regulated under applicable law.
23. Open well, bore well etc. for agriculture or other usage Regulated and the activity should be strictly monitored by the appropriate authority.
24. Solid Waste Management. Regulated under applicable laws.
25. Introduction of Exotic species. Regulated under applicable laws.
26. Eco-tourism. Regulated under applicable laws.
27. Use of polythene bags. Regulated under applicable laws.
28. Commercial Sign boards and hoardings. Regulated under applicable laws. C. Promoted Activities
29. Rain water harvesting. Shall be actively promoted.
30. Organic farming. Shall be actively promoted.
31. Adoption of green technology for all activities. Shall be actively promoted.
32. Cottage industries including village artisans, etc. Shall be actively promoted.
33. Use of renewable energy. Bio gas, solar light etc. to be actively promoted.
34. Agro-Forestry. Shall be actively promoted.
35. Skill Development. Shall be actively promoted.
36. Restoration of Degraded Land/ Forests/ Habitat. Shall be actively promoted.

(x) District Officer of Town and Country planning Department - Member;
(xi) Expert in Biodiversity nominated by State Government - Member;
(xii) Wildlife Warden of Narsinghgarh Wildlife Sanctuary, Bhopal - Member Secretary.
6. Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be for a period of three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30 th June of that year to the Chief Wildlife Warden of the State as per proforma appended at Annexure-IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
