(i) पया�वरण;

(ii) वन और वEयजीव;

(iii) कृिष;

(iv) राजJ व;

(v) शहरी िवकास;

(vi) पय�टन;

(vii) Tामीण िवकास;

(viii) uसचाई और बाढ़ िनयं#ण;

(ix) नगरपािलका;

(x) पंचायती राज; और

(xi) लोक िन मा�ण िव भाग । (4) जब तक इस अिधसूचना म) िविनoदc न हो, आंचिलक महायोजना म) वत�मान म) अनुमो�दत भू-उपयोग, अवसंरचना और �wयाकलाप1 पर कोई ितबंध नह@ लगाया जाएगा तथा आचिंलक महायोजना म) सभी अवसंरचनाd और �wयाकलाप1 म) सुधार करके उEह) अिधक द8 और पा रिJथितक$-अनुकूल बनाने क$ /वJथा क$ जाएगी । (5) आंचिलक महायोजना म) वनरिहत और अवwिमत 8े#1 क$ बहाली, िवYमान जल िनकाय1 के संर8ण, आवाह 8े#1 के बंधन, जल-संभर1 के बंधन, भू-जल के बंधन, मृदा और नमी के संर8ण, Jथानीय समुदाय क$ आवGयकताd तथा पा रिJथितक$ एवं पया�वरण के ऐसे अEय पहलुd क$ /वJथा क$ जाएगी िजन पर xयान �दया जाना आवGयक है। (6) आंचिलक महायोजना म) सभी िवYमान पूजा J थल1, Tाम1 एवं शहरी बिJतय1, वन1 क$ ^िेणय1 एवं �कJ म1, कृिष 8े#1, ऊपजाऊ भूिम, उYान1 एवं उYान1 क$ तरह के ह रत 8े#1, बागवानी 8#े1, बगीच1, झील1 और अEय जल िनकाय1 क$ सीमा का िनधा�रण �कया जाएगा तथा सहायक मानिच# भी �दया जाएगा। इस महायोजना म) िवYमान और Jतािवत भ-ू उपयोग क$ िवशेषताd का 5यौरा देने वाले मानिच# भी �दए जाएंगे। (7) आंचिलक महायोजना म) पा रिJथितक$ संवेदी जोन म) होने वाले िवकास का िविनयमन �कया जाएगा और सारणी 4 म) यथासचूीबa ितिषa एवं िविनयिमत �wयाकलाप1 का पालन �कया जाएगा। इसमे J थानीय जनता क$ आजीिवका क$ सुर8ा के िलए पा रिJथितक$-अनुकूल िवकास का भी सिुनG चय एवं संवध�न �कया जाएगा। (8) आंचिलक महायोजना, 8े#ीय िवकास योजना क$ सह-कािलक होगी । (9) अनुमो�दत आंचिलक महायोजना, िनगरानी सिमित के िलए एक संदभ� दJतावेज होगी ता�क वह इस अिधसचूना के उपबंध1 के अनुसार िनगरानी के अपने कत�/1 का िनव�हन कर सके । 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय....---- राHय सरकार इस अिधसूचना के उपबंध1 को भावी बनाने के िलए िनsिलिखत उपाय करेगी, अथा�त्:- (1) भूभूभूभू----उपयोग.उपयोग.उपयोग.उपयोग.–––– (क) पा रिJथितक$ संवेदी जोन म) वन1, बागवानी 8े#1, कृिष 8े#1, आमोद मोद के िलए िचिEहत उYान1 और खुल ेJथान1 का वृहद वािणिHयक या आवासीय प रसर1 या औYोिगक �wयाकलाप1 के िलए योग या संप रवत�न अनु{ात नह@ �कया जाएगा: परंतु पा रिJथितक$ संवेदी जोन के भीतर भाग (क) म) िविनoदc योजन से िभ| योजन के िलए कृिष और अEय भूिम का संप रवत�न, िनगरानी सिमित क$ िसफा रश पर और स8म ािधकारी के पूव� अनुमोदन से, 8े#ीय नगर योजना अिधिनयम तथा यथा लागू केEqीय या राHय सरकार के अEय िनयम1 और िविनयम1 के अधीन तथा इस अिधसूचना के उपबंध1 के अनुसार Jथानीय िनवािसय1 क$ िनsिलिखत आवासीय ज�रत1 को पूरा करने के िलए अनु{ात �कया जाएगा:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5

(i) िवYमान सड़क1 को चौड़ा करना, उEह) सुदढ़ृ करना और नई सड़क1 का सिंनमा�ण; (ii) बुिनयादी ढांच1 और नाग रक सुिवधाd का संिनमा�ण और नवीकरण; (iii) दषूण उXप| न करने वाल ेलघ ुउYोग; (iv) कुटीर उYोग एवं Tाम उYोग तथा पा रिJथितक$ पय�टन म) सहायक सुिवधा भFडार, Jथानीय सखु-सुिवधाएं तथा गृह वास; और (v) बढ़ावा �दए गए और पैरा-4 म) उि�लिखत �wयाकलाप: परंतु यह भी �क 8े#ीय शहरी िनयोजन अिधिनयम के अधीन स8म ािधकारी के पूव� अनुमोदन के िबना तथा राHय सरकार के अEय िनयम1 एवं िविनयम1 एवं संिवधान के अनुLछेद 244 के उपबंध1 तथा तXसमय वृA िविध, िजसके अंतग�त अनुसूिचत जनजाित और अEय परंपरागत वन िनवासी (वन अिधकार1 क$ माEयता) अिधिनयम, 2006 (2007 का 2) भी आता ह,ै का अनुपालन �कए िबना वािणिHयक या औYोिगक िवकास �wयाकलाप1 के िलए जनजातीय भूिम का योग अनु{ात नह@ होगा: परंतु यह भी �क पा रिJ थितक$ संवेदी जोन के अंतग�त आने वाली भूिम के अिभलखे1 म) Cई �कसी #ु ट को, िनगरानी सिमित के िवचार ाB करने के पSात्, राHय सरकार (ारा Xयेक मामल ेम) एक बार सुधारा जाएगा और उ0 # ुट को सुधारने क$ सूचना क) qीय सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय को दी जाएगी: परंतु यह भी �क उपयु�0 # ुट को सुधारने म), इस उप-पैरा म) यथा उपबंिधत के िसवाय, �कसी भी दशा म) भ-ूउपयोग का प रवत�न शािमल नह@ होगा; (ख) अनु यु� त या अनुX पादक कृिष 8#े1 म) पुन: वनीकरण तथा पया�वास1 और जैव- िविवधता क$ बहाली के यास �कए जाएंगे । (2) �ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत....- आंचिलक महायोजना म) सभी ाकृितक जल ~ोत1 के आवाह 8े#1 क$ पहचान करके उनके संर8ण और बहाली क$ योजना सि& मिलत क$ जाएगी और राH य सरकार (ारा करके इस रीित से बनाए जा�गे �क उसम) इन 8े#1 या इनके आसपास के 8#े1 के िलए हािनकारक िवकास �wयाकलाप1 को ितिषa �कया गया हो। (3) पय�टन/पा�रि�थितक� पय�टन.पय�टन/पा�रि�थितक� पय�टन.पय�टन/पा�रि�थितक� पय�टन.पय�टन/पा�रि�थितक� पय�टन.–––– (क) पा रिJथितक$ संवेदी जोन के भीतर सभी नए पा रिJथितक$ पय�टन �wयाकलाप या िवYमान पय�टन �wयाकलाप1 का िवJतार पा रिJथितक$ संवेदी जोन स&बंधी पय�टन महायोजना के अनुसार अनु{ात होगा । (ख) पा रिJथितक$ पय�टन महायोजना राHय सरकार के पया�वरण और वन िवभाग1 के परामश� से पय�टन िवभाग (ारा बनायी जाएगी । (ग) पय�टन महायोजना आंचिलक महायोजना का घटक होगी । (घ) पय�टन महायोजना पा रिJथितक$ संवेदी जोन क$ वहन 8मता के आधार पर तैयार क$ जायेगी। (ङ) पा रिJथितक$ पय�टन संबंधी �wयाकलाप िन& नानुसार िविनयिमत �कए जाएंगे:- (i) संरि8त 8े# क$ सीमा से एक �कलोमीटर के भीतर या पा रिJथितक$ संवेदी जोन क$ सीमा तक, इनम) जो भी अिधक िनकट हो, �कसी होटल या रसोट� का नया सि|मा�ण अनु{ात नह@ �कया जाएगा: परंतु, पा रिJथितक$ पय�टन सुिवधाd के िलए संरि8त 8े# क$ सीमा से एक �कलोमीटर क$ दरूी से परे पा रिJथितक$ संवेदी जोन क$ सीमा तक पूव� प रभािषत और अभीिहत 8े#1 म) पय�टन महायोजना के अनुसार, नए होटल1 और रसोट� क$ Jथापना अनु{ात होगी;

(ii) पा रिJथितक$ संवेदी जोन के अEदर सभी नए पय�टन �wया-कलाप1 या िवYमान पय�टन �wयाकलाप1 का िवJतार, केEqीय सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय (ारा जारी �दशािनदtश1 तथा पा रिJथितक$ पय�टन, पा रिJथितक$-िश8ा और पा रिJथितक$-िवकास पर बल देने वाले रा�ीय /ा� संर8ण ािधकरण (ारा जारी पा रिJथितक$ पय�टन संबंधी �दशािनदtश1 (समय-समय पर यथा संशोिधत) के अनुसार होगा; (iii) आंचिलक महायोजना का अनुमोदन होने तक, पय�टन के िवकास और िवYमान पय�टन �wयाकलाप1 के िवJतार को वाJतिवक Jथल-िविशc संवी8ा तथा िनगरानी सिमित क$ िसफा रश के आधार पर संबंिधत िविनयामक ािधकरण1 (ारा अनु{ात �कया जाएगा और पा रिJथितक$ संवेदी जोन म) �कसी नए होटल, रजाट� या वािणिHयक ित�ान का संि|मा�ण अनु{ात नह@ होगा । (4) �ाकृितक िवरासत�ाकृितक िवरासत�ाकृितक िवरासत�ाकृितक िवरासत....–––– पा रिJथितक$ संवेदी जोन के अंतग�त आने वाले बCमू�य ाकृितक िवरासत के सभी Jथल1 जैसे �क जीन पूल रजव� 8े#, शैल संरचना, जल पात, झरने, दरt, उपवन, गुफाए,ं Jथल, वनपथ, रोहण माग�, उX पात आ�द क$ पहचान क$ जाएगी और उनक$ सुर8ा एवं संर8ण के िलए आंचिलक महायोजना के भाग के �प म) एक िवरासत संर8ण योजना बनायी जाएगी। (5) मानव िन#मत िवरासत � थमानव िन#मत िवरासत � थमानव िन#मत िवरासत � थमानव िन#मत िवरासत � थल.ल.ल.ल.---- पा रिJथितक$ संवेदी जोन म) भवन1, संरचनाd, कलाकृित- 8े#1 तथा ऐितहािसक, JथापXय संबधी, स�दया�Xमक और साJंकृितक महXव के 8े#1 क$ पहचान क$ जाएगी और उनके संर8ण के िलए आंचिलक महायोजना के भाग के �प म) एक िवरासत संर8ण योजना बनायी जाएगी। (6) $ व$ व$ व$ विन �दषूण.िन �दषूण.िन �दषूण.िन �दषूण.– xविन दषूण (िविनयमन और िनयं#ण) िनयम, 2000 म) िनयत उपबंध1 के अनुसरण म) पा रिJथितक$ संवेदी जोन म) xविन दषूण के िनयं#ण के िलए िविनयम1 और उसके अधीन बनाए गए संशोिधत िनयम1 को काया�िEवत करेगा। (7) वायुवायुवायुवायु �दषूण�दषूण�दषूण�दषूण....- पा रिJथितक$ संवेदी जोन म), वायु दषूण क$ रोकथाम और िनयं#ण, वायु ( दषूण िनवारण और िनयं#ण) अिधिनयम, 1981 (1981 का 14) के उपबंध1 और उसके अधीन बनाए गए िनयम1 और उनम) �कए गए संशोधन1 के अनुसार �कया जाएगा। (8) बिह�ावबिह�ावबिह�ावबिह�ाव काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण....- पा रिJथितक$ संवेदी जोन म) उपचा रत बिह~ाव का िनJसारण, और उसके अधीन बनाए गए िनयम1 के अEतग�त शािमल �कए गए पया�वरणीय दषूण के िनJसारण सबंंधी साधारण मानक1 या राHय सरकार (ारा िनयत मानक1, इनम) जो भी अिधक कठोर ह1, के अनुसार �कया जाएगा। (9) ठोसठोसठोसठोस अपिश,अपिश,अपिश,अपिश,....---- ठोस अपिशc का िनपटान एवं बEधन िनsानुसार �कया जाएगा:- (क) पा रिJथितक$ संवेदी जोन म) ठोस अपिशc का िनपटान और बंधन भारत सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय क$ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अ ैल, 2016 के (ारा कािशत ठोस अपिशc बंधन िनयम, 2016 के उपबंध1 के अनुसार �कया जाएगा; अकाब�िनक पदाथ� का िनपटान पा रिJथितक$ संवेदी जोन से बाहर िचिEहत �कए गए Jथान1 पर पया�वरण-अनुकूल रीित से �कया जाएगा; (ख) पा रिJथितक$ संवेदी जोन म) माEय ौYोिग�कय1 (ई एस एम) का योग करते Cए िवYमान िनयम1 और िविनयम1 के अनु�प ठोस अपिशc का सुरि8त और पया�वरण-अनुकूल ंबंधन अनु{ात �कया जाएगा। (10) जैव िच�क/सा अपिश0 टजैव िच�क/सा अपिश0 टजैव िच�क/सा अपिश0 टजैव िच�क/सा अपिश0 ट का �बंधन का �बंधन का �बंधन का �बंधन....- जैव िच�कXसा अपिश] ट का बंधन िनsानुसार �कया जाएगा:- (क) पा रिJथितक$ संवेदी जोन म) जैव िच�कXसा अपिशc का िनपटान भारत सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय क$ समय–समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 343(अ), तारीख 28 माच�, 2016 के (ारा कािशत जैव िच�कXसा अपिशc बंधन िनयम, 2016 के उपबंध1 के अनुसार �कया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 (ख) पा रिJथितक$ संवदी जोन म) माEय ौYोिग�कय1 का योग करते Cए िवYमान िनयम1 और िविनयम1 के अनु�प जैव-िच�कXसा अपिशc का सुरि8त और पया�वरण-अनुकूल ंबंधन अनु{ात �कया जाएगा। (11) 2लाि�टक अपिश, का �बंधन2लाि�टक अपिश, का �बंधन2लाि�टक अपिश, का �बंधन2लाि�टक अपिश, का �बंधन....---- पा रिJथितक$ संवेदी जोन म) �लािJटक अपिशc का बंधन, भारत सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय क$ समय-समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 340(अ), तारीख 18 माच�, 2016 के (ारा कािशत �लािJटक अपिशc बंधन िनयम, 2016 के उपबंधो के अनुसार �कया जाएगा। (12) िनमा�ण और िव$वंस अपिश, का �बंधनिनमा�ण और िव$वंस अपिश, का �बंधनिनमा�ण और िव$वंस अपिश, का �बंधनिनमा�ण और िव$वंस अपिश, का �बंधन....---- पा रिJथितक$ संवेदी जोन म) िनमा�ण और िवxवंस अपिशc का बंधन, भारत सरकार के पया�वरण, वन और जलवायु प रवत�न मं#ालय क$ समय-समय पर यथा संशोिधत अिधसूचना स.ंसा.का.िन 317(अ), तारीख 29 माच�, 2016 के (ारा कािशत सिंनमा�ण और िवxवंस अपिशc बंधन िनयम, 2016 के उपबंध1 के अनुसार �कया जाएगा। (13) ईईईई––––अपिश,.अपिश,.अपिश,.अपिश,.---- पा रिJथितक$ संवेदी जोन म) ई–अपिशc का बंधन, भारत सरकार पया�वरण, वन और जलवायु प रवत�न मं#ालय (ारा कािशत तथा समय- समय पर यथा संशोिधत ई–अपिशc बंधन िनयम, 2016 के उपबंध1 के अनुसार �कया जाएगा। (14) यानीययानीययानीययानीय----यातायात.यातायात.यातायात.यातायात.---- यानीय-यातायात का संचलन आवास-अनुकूल तरीके से िविनयिमत �कया जाएगा और इस सबंंध म) आंचिलक महायोजना म) िवशेष उपबंध सि&मिलत �कए जाएंगे तथा आंचिलक महायोजना के तैयार होने और राHय सरकार के स8म ािधकारी (ारा अनुमो�दत �कए जाने तक, िनगरीनी सिमित ासंिगक अिधिनयम1 और उनके तहत बनाए गए िनयम1 एवं िविनयम1 के अनुसार वाहन1 क$ आवाजाही के अनुपालन क$ मानीटरी करेगी। (15) यानीययानीययानीययानीय जिनतजिनतजिनतजिनत �दषूण.�दषूण.�दषूण.�दषूण.---- यानीय जिनत दषूण क$ रोकथाम और िनयं#ण लागू िविधय1 के अनुसार �कया जाएगा और JवLछतर �धन के उपयोग के यास �कए जाएंगे। (16) औ4ोिगक ईकाइयां.औ4ोिगक ईकाइयां.औ4ोिगक ईकाइयां.औ4ोिगक ईकाइयां.---- (i) राजप# म) इस अिधसचूना के काशन क$ तारीख को या उसके बाद पा रिJथितक$ संवेदी जोन म) �कसी नए दषूणकारी उYोग क$ Jथापना अनु{ात नह@ होगी। (ii) जब तक इस अिधसचूना म) िविनoदc न हो, पा रिJथितक$ संवेदी जोन म) क) qीय दषूण िनयं#ण बोड� (ारा फरवरी, 2016 म) जारी �दशािनदtश1 म) �कए गए उYोग1 के वग[करण के अनुसार केवल गैर- दषूणकारी उYोग1 क$ Jथापना अनु{ात होगी। इसके अित र0, गैर- दषूणकारी कुटीर उYोग1 को बढ़ावा �दया जाएगा। (17) पहाड़ीपहाड़ीपहाड़ीपहाड़ी ढलान9ढलान9ढलान9ढलान9 काकाकाका संर:ण.संर:ण.संर:ण.संर:ण.---- पहाड़ी ढलान1 का संर8ण िनsानुसार �कया जाएगा:- (i) आंचिलक महायोजना म) पहाड़ी ढलान1 के उन 8े#1 को दशा�या जाएगा िजनम) �कसी भी संिनमा�ण क$ अनु{ा नह@ होगी । (ii) िजन ढ़लान1 या िवYमान खड़ी पहाड़ी ढलान1 म) अXयिधक भ-ू8रण होता ह ैउनम) �कसी भी संिनमा�ण क$ अनु{ा नह@ होगी । 4444.... पापापापा�रि�थितक��रि�थितक��रि�थितक��रि�थितक� सवेंदीसवेंदीसवेंदीसवेंदी जोनजोनजोनजोन म;म;म;म; दषूण (जल, वायु, मृदा, xविन आ�द) उXप| करने वाले उYोग1 क$ Jथापना । पा रिJथितक$ संवेदी जोन म) कोई नया उYोग लगाने और वत�मान दषूणकारी उYोग1 का िवJतार करने क$ अनु{ा नह@ होगी: जब तक �क इस अिधसचूना म) िविनoदc न हो, पा रिJथितक$ संवेदी जोन म) फरवरी, 2016 म) क) qीय दषूण िनयं#ण बोड� (ारा जारी �दशािनदtश1 म) �कए गए उYोग1 के वग[करण के अनुसार केवल गैर- दषूणकारी उYोग1 क$ Jथापना होगी। इसके अित र0, गैर- दषूणकारी कुटीर उYोग1 को ोXसाहन �दया जाएगा।

3. बड़ी जल िवYुत प रयोजनाd क$ Jथापना । लागू िविधय1 के अनुसार ितिषa (अEयथा उपबंिधत के िसवाय) ह1गे।

4. �कसी प रसंकटमय पदाथ� का योग या उXपादन या Jसंकरण । लागू िविधय1 के अनुसार ितिषa (अEयथा उपबंिधत के िसवाय) ह1गे।

ाकृितक जल िनकाय1 या भूिम 8#े म) अनुपचा रत बिह~ाव1 का िनJसारण । लागू िविधय1 के अनुसार ितिषa (अEयथा उपबंिधत के िसवाय) ह1गे।

6. नई आरा िमल1 क$ Jथापना। पा रिJथितक$ संवेदी जोन म) नई अथवा िवYमान आरा िमल1 का िवJतार अनु{ात नह@ होगा ।

7. �ट भk1 क$ Jथापना । लागू िविधय1 के अनुसार ितिषa (अEयथा उपबंिधत के िसवाय) ह1गे।

10. संिनमा�ण �wयाकलाप । (5)(5)(5)(5) संरि8त 8े# क$ सीमा से एक �कलोमीटर के भीतर या पा रिJथितक$ संवेदी जोन क$ सीमा तक, इनम) जो भी अिधक िनकट हो, �कसी भी नये वािणिHयक संिनमा�ण क$ अनु{ा नह@ होगी: परंतु Jथानीय लोग1 को अपनी आवास स&बEधी िनsिलिखत आवGयकताd को पूरा करने के िलए, पैरा 3 के उप पैरा (1) म) सचूीबa �wयाकलाप1 सिहत अपने योग के िलए, अपनी भूिम म) भवन उप-िविधय1 के अनुसार, संिनमा�ण करने क$ अनु{ा होगी: परEतु यह और �क गैर– दषूणकारी लघ ुउYोग1 से संबंिधत संिनमा�ण �wयाकलाप लागू िनयम1 और िविनयम1, य�द कोई ह1, के अनुसार स8म ािधकारी क$ पूव� अनुमित से िविनयिमत �कए जाएंगे और वे Eयूनतम ह1गे । (ख) एक �कलोमीटर से आगे ये आंचिलक महायोजना के अनुसार िविनयिमत ह1गे ।

11. गैर दषूणकारी लघु उYोग। फरवरी, 2016 म) केEqीय दषूण िनयं#ण बोड� (ारा जारी उYोग1 के वग[करण के अनुसार गैर- दषूणकारी उYोग1 तथा पा रिJथितक$ संवेदी जोन से दशेी सामिTय1 से उXपाद बनाने वाले अप रसकंटमय लघ ुऔर सेवा उYोग1, कृिष, पु]प कृिष, बागबानी या कृिष आधा रत उYोग1 क$ Jथापना स8म ािधकारी (ारा अनु{ात होगी।

12. वायु और यानीय दषूण। लागू िविधय1 के अधीन िविनयिमत होगा ।

13. वृ81 क$ कटाई । (क) राHय सरकार के स8म ािधकारी क$ पूव� अनुमित के िबना वन या सरकारी या राजJव या िनजी भूिम पर वृ81 क$ कटाई क$ अनु{ा नह@ होगी । (ख) वृ81 क$ कटाई क) qीय या संबंिधत राHय के अिधिनयम1 और उनके अधीन बनाए गए िनयम1 के उपबंध1 के अनुसार िविनयिमत होगी ।

15. िवYुत और सचंार टॉवर लगाने, तार-िबछाने तथा अEय बुिनयादी ढांचे क$ /वJथा । लागू िविधय1 के अधीन िविनयिमत होगा (भूिमगत केबल िबछाने को बढ़ावा �दया जाएगा)।

16. नाग रक सिुवधाd सिहत बुिनयादी अवसंरचना। यह /वJथा लागू िविधय1, िनयम1, िविनयम1 और उपल5ध �दशािनदtश1 के अनुसार उपशमन उपाय1 के साथ क$ जाएगी।

17. िवYमान सड़क1 को चौड़ा करना, उEह) सुदढृ बनाना और नई सड़क1 का िनमा�ण करना। यह /वJथा लागू िविधय1, िनयम1, िविनयम1 और उपल5ध �दशािनदtश1 के अनुसार उपशमन उपाय1 के साथ क$ जाएगी।

18. पय�टन से संबंिधत अEय �wयाकलाप जैस े �क पा रिJथितक$ संवेदी जोन 8े# के ऊपर से गम� वायु के गु5बारे, हलेीका�टर, iोन, माइwोलाइ�स उडाना आ�द। लागू िविधय1 के अधीन िविनयिमत होगा ।

19. पहाड़ी ढाल1 और नदी के �कनार1 का संर8ण । लागू िविधय1 के अधीन िविनयिमत होगा ।

20. राि# म) सड़क यातायात का संचलन । लागू िविधय1 के अधीन वािणिHयक योजन के िलए िविनयिमत होगा ।

21. Jथानीय समुदाय1 (ारा अपनायी जा रही वत�मान कृिष और बागवानी पaितय1 के साथ डेय रयां, द�ुध उXपादन, जल कृिष और मXJय पालन। Jथानीय जनता के योग के िलए लागू िविधय1 के अधीन अनु{ात ह1गे।

22. फम�, कारपोरेट, कंपिनय1 (ारा बड़े पैमाने पर वािणिHयक पशुधन संपदा और कु�कुट फाम� क$ Jथापना । Jथानीय आवGयकताd को पूरा करने के िलए लागू िविधय1 (अE यथा उपबंिधत के िसवाय) के अधीन अनु{ात होगा।

ाकृितक जल िनकाय1 या भ ू 8े# म) उपचा रत अपिशc जल या बिह~ा�व का िनJसारण । जल िनकाय1 म) उपचा रत अपिशc जल/बिह~ा�व के िनJसारण से बचा जाएगा। उपचा रत अपिशc जल के पुनच�wण और पुन:उपयोग के यास �कए जाएंगे अEयथा उपचा रत अपिशc जल या बिह~ा�व का िनJसारण लागू िविधय1 के अनुसार िविनयिमत �कया जाएगा।

24. सतही और भूजल का वािणिHयक िन]कष�ण । लागू िविधय1 के अधीन िविनयिमत होगा ।

25. ठोस अपिश] ट बंधन। लागू िविधय1 के अधीन िविनयिमत होगा ।

26. िवदशेी जाितय1 को लाना । लागू िविधय1 के अधीन िविनयिमत होगा ।

27. पा रिJथितक$ पय�टन। लागू िविधय1 के अधीन िविनयिमत होगा ।

29. होटल1 और लॉज1 के िवYमान प रसर1 म) बाड़ लगाना । लागू िविधय1 के अधीन िविनयिमत होगा । वE यजीव के मु� त सचंलन को अनु{ात करने के िलए पा रिJथितक संवेदी जोन के भीतर होटल1 या अE य वािणिH यक J थापन अपनी प रसंपिX तय1 म) कांटेदार स ेबाड़ नह@ लगाएंगे और कोई भी बाड़ एक मीटर से ऊंची नह@ होगी।कोई िवYमान बाड़, जो इस उपदश� का अनुपालन नह@ करती ह,ै को आंचिलक महायोजना म) व�णत समय-सीमा के अनुसार उपांत रत �कया जाएगा ।

30. कृिष णािलय1 म) आमूल प रवत�न । लागू िविधय1 के अधीन िविनयिमत होगा ।

(5) मानीटरी सिमित का सदJय-सिचव या संबa उपायु� त या संबंिधत उपायु0 ऐसे /ि0 के िव�a, जो इस अिधसचूना के �कसी उपबंध का उ�लंघन करता ह,ै पया�वरण अिधिनयम, क$ धारा 19 के अधीन प रवाद दायर करने के िलए स8म होगा। (6) मानीटरी सिमित संबंिधत िवभाग1 के ितिनिधय1 या िवशेष{1, औYोिगक संघ1 के ितिनिधय1 या संबंिधत प81 को, Xयेक मामले मे आवGयकता के अनुसार, अपने िवचार-िवमश� म) सहायता के िलए आमंि#त कर सकेगी । (7) मानीटरी AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 6 th November, 2017;

AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification;

AND WHEREAS, Jasrota Wildlife Sanctuary is located about 75 kilometres from Jammu City towards the northern side of Kathua district in the State of Jammu and Kashmir covering an area of 10.04 square kilometres. The protected area was notified as Sanctuary by the Jammu and Kashmir Government, Forest Department vide S.R.O.

No. 151 dated, the19 th March, 1987 and falls between 32° 27' to 32° 31' North latitude and 75° 22' to 75° 26' East longitude. The Sanctuary is located between river Ujh in the east and Lodmoli wali Khad in the west. The northern boundaries of the Jasrota Wildlife Sanctuary has the villages Gurah Surja, Mala, Taloti, Tibba, Furlain, Mun, Gurnam Wala; while the southern part has the villages Jasrota, Mala, Shani and Khanpur and canal Ujh. In the western side ruins of Lodmoli khad is located;

AND WHEREAS, the flora and fauna represent rich biological significance of Jasrota Wildlife Sanctuary. The vegetation of the Sanctuary comes under the major group "Sub-tropical Northern Mixed Dry Deciduous Forests". A wide variety of sub-tropical broad leaved tree and shrubs are found in the area. Large area of the Sanctuary is covered with shrubs and weeds where as some pure patches of bamboo are also found at places. The broad-leaved forest consists of deciduous species;

AND WHEREAS, the area hosts a wide variety of fauna and avifauna typical to the area of sub-tropical climate. Important floras reported from the Jasrota Wildlife Sanctuary are khair (Acacia catechu), siris (Albizia lebbeck), phalai (Acacia modesta), brankut or bhainkar (Adhatoda vasica), garna (Carissa opaca), bel (Aegle marmelos), booti (Asparagus racemosus), karal (Bauhinia purpurea), charmord (Ehretia laevis), balungar (Bauhinia vahlii), semal or simbal (Bombax ceiba), kurangal or amaltash (Cassia fistula), lohki hendma Cassia tora), tillu or shishum (Dalbergia sissoo), amla (Emblica officinalis), bor (Ficus benghalensis), gular or rumbal (Ficus racemosa), rathain (Flueggea virosa), paanjphooli (Lantana camara), kamela (Mallotus philippensis), aam (Mangifera indica), kaam (Mitragyna parvifolia), karipatta or drankul (Murraya koenigii), khajur (Phoenix dactylifera), randa (Catunaregum spinosa), jamun (Syzygium cumini), reed (Terminalia chebula), arjun (Terminalia arjuna), bera (Terminalia belerica), ber (Ziziphus jujuba), ber (Ziziphus oenoplia), dai or tai (Woodfordia fruticosa), kambal (Lannea coromandelica), sanan (Oujenia oojeninensis), khajur (Phoenix dactylifera), randa (Catunaregum spinosa), jamun (Syzygium cumini), reed (Terminalia chebula), arjun (Terminalia arjuna), etc. Euphorbia royleana is also found on rocky areas. Chir pine (Pius roxburghii) forest in found on outer dry foothills of Shiwalik Range;

AND WHEREAS, important fauna or avifauna reported from the Jasrota Wildlife Sanctaury are nilgai (Boselaphus tragocamelus), spotted deer (Axis axis), barking deer (Muntiacus muntejak), rhesus monkey (Macacamulatta), jackal (Canis aureus), hare (Lepus nigricollis), porcupine (Hystrix Indica), wild boar (Sus scrofa), mongoose (Herpestes edxardis), pea fowl (Pavo cristatus), red Jungle fowl (Gallus gallus), bush quail (Prediculata asiatica), green pigeon (Treron phoenix coptera), blue rock pigeon (Columba livia), red turtle dove (Streptopelia tranquebarica), blue Jay (Coracias benghalinus), black partirdes (Francolinus francolinus), spotted owlet (Athene brama), parakeets (Psittacula cyanocephala), hoope (Upupae pops), bulbul (Pycnonotus species), pariah kite (Milvus migranis), koel (Eudynamus scolopacea), wood pecker (Picoidesnamus), bablers (Turdoides caudatus) etc. Important water fowls reported from the Jasrota Wildlife Sanctuary are mallard (Anas Platyrhnchos), pin tail (Anas acuta), gadwal (Anas Stepera), common teal (Anas crecca), wigeon (Anas Penelope), and common pochard (Aythya ferina), etc;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Jasrota Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 60 metres to 2.022 kilometres around the boundary of Jasrota Wildlife Sanctuary, in Kathua district in the State of Jammu and Kashmir as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: -

1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 60 metres to

2.022 kilometres around the boundary of Jasrota Wildlife Sanctuary. The extents of the Eco-sensitive Zone from the boundary of Jasrota Wildlife Sanctuary is varies from 437 meter to 1260 meter in the North-east, 1106 meter to 2022 meter in the North, 207 meter to 686 meter in the South, 122 meter to 597 meter in the South-west, 1302 meter to 1673 meter in the West, 517 meter to 1436 meter in the Northwest, 65 meter to 194 meter in the East, 60 meter to 981 meter in the Southeast.

The total area of the Eco-sensitive Zone is 12.56 square kilometres which includes 5.5173 square kilometres forest land, 2.4321 square kilometres private land and 2.0246 square kilometres State land which includes six villages Danoh, Ladoli, Gurha Surja, Dhewal, Chanpura and Moni. The Eco-sensitive Zone also includes 2.584 square kilometres private, State and miscellaneous lands of villages Moni, Jasrota, Dhaloti, Mala and Dhamyal.

(2) The boundary description of Jasrota Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I.

(3) The maps of the Jasrota Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, and Annexure-IIC.

(4) List of geo-coordinates of the boundary of Jasrota Wildlife Sanctuary and Eco-sensitive Zone are appended as Table A and Table B of Annexure-III.

(5) List of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.

2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipal;

(x) Panchayati Raj; and

(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities, such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and

(v) promoted activities given under paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.

(e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and ecodevelopment;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-

(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016;

the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.

(10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:-

(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28 th March,

2016.

(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic Waste Management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.

(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.

(13) E-Waste.- The e-Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.

(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S. 1. Commercial mining, stone quarrying and crushing units.

(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for personal consumption;

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).

New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:

Provided that non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition the non-polluting cottage industries shall be promoted.

3. Establishment of major hydro-electric project.

Prohibited (except as otherwise provided) as per the applicable laws.

4. Use or production or processing of any hazardous substances.

Prohibited (except as otherwise provided) as per the applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited (except as otherwise provided) as per the applicable laws.

6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per the applicable laws.

8. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.

B. Regulated Activities

9. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:

Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

10. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents;

Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

11. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the Competent Authority.

12. Air and vehicular pollution. Regulated under applicable laws.

13. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

14. Collection of Forest produce or Non- Timber Forest produce.

Regulated as per the applicable laws.

15. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated under applicable laws (underground cabling may be promoted).

16. Infrastructure including civic amenities. Taking measures of mitigation as per the applicable laws, rules and regulations available guidelines.

17. Widening and strengthening of existing roads and construction of new roads.

Taking measures of mitigation as per the applicable laws, rules and regulation and available guidelines.

18. Undertaking other activities related to tourism like flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

19. Protection of hill slopes and river banks. Regulated as per the applicable laws.

30. Fencing of existing premises of hotels and lodges.

In order to allow free movement of wildlife, hotels or other commercial establishments within the Eco-sensitive Zone shall not fence their properties with barbed wire and no fence shall be higher than one meter. Any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan.

31. Community Reserve Nature Regulated as per the applicable laws.

32. Trekking and camping. Regulated as per the applicable laws.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. (viii) Territorial Divisional Forest Officer, Forest Division Kathua Member;

(ix) Representative of Housing and Urban Planning Department/Rural Development Department Member;

(x) Representative of Agriculture Production Department Member;

(xi) Concerned Wildlife Warden (I/C of the Jasrota Wildlife Sanctuary) Member-Secy.

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.

In the western and North-western side, Eco-sensitive Zone boundary passes through to south of village Dewal crosses the Ladoli wali Khad and passes through the Forest Co.7/JSR, Co. 8/JSR in the west, through compt 81/JSR in the northwest, 82/JSR and 83/JSR in the Northern side which are part of Sunanal forests, Tarota Pera forest, Kori Bagan forest and Barot Forests of Jasrota Range of Forest Division Kathua. The Eco-sensitive Zone transverse through the Jagir Khad in the North, meets with the River Ujh in the Norteast direction through ogri Khad. The Eco-sensitive Zone boundary passing Eastern of village Chandwan Beliari in west.

In the North and Northeast Directions, Eco-sensitive Zone boundary passes through the Jagir Khad along the northern and eastern side of Village Moni.

In the Eastern and South-eastern side, the Eco-sensitive Zone boundary passes along with the river Ujh, crosses the Ujh Barrage, moves along with the Ujh Canal and then crosses Rajbagh Jakhole road, runs to North of temple and then crosses to Northern side of village Mala. From Village Mala, the line crosses the Gura Surjan Khad and moves towards North of Village Dhaloti.
