असाधारण, भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन, मंᮢ ालय कᳱ अिधसूचना सं. का.आ. 1019 (अ), तारीख 6 माचᭅ, 2020, ᳇ारा ᮧकािशत कᳱ गई थी िजसमᱶ ऐसे सभी ᳞िᲦयᲂ से, िजनकᳱ उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उᲦ अिधसूचना को अ᭠तᳶवᭅ᳥ करने वाले राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ध करा दी गई थᱭ, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत ᳰकए गए थ;े और, उᲦ ᮧाᱨप अिधसूचना को अ᭠तᳶवᭅ᳥ करने वाले राजपᮢ कᳱ ᮧितया ंजनता को तारीख 6 माचᭅ, 2020 को उपल᭣ध करा दी गई थी; और, ᮧाᱧप अिधसूचना के ᮧ᭜यᱫुर मᱶ ᳞िᲦयᲂ और पणधाᳯरयᲂ से कोई भी आᭃेप और सुझाव ᮧा᳙ नहᱭ ᱟए थ;े और, कालाटॉप-खिजयार व᭠यजीव अभयार᭛य 32031’35” उ से 32034’32” उ अᭃाशं और 76000’60” प ूसे 76003’76” प ूदेशांतर के बीच ि᭭थत ह।ै कालाटॉप-खिजयार व᭠यजीव अभयार᭛य च᭥बा िजला के च᭥बा उप-संभाग मᱶ ि᭭थत ह ै और च᭥बा व᭠यजीव संभाग के ᮧशासिनक िनयंᮢण के अंतगᭅत आता है। THE GAZETTE OF INDIA : EXTRAORDINARY [PARTII—SEC. 3(ii)] अिधिनयम,1972 कᳱ धारा 26 (क) के अधीन िहमाचल ᮧदेश सरकार कᳱ अिधसूचना सं.एफएफई-बी-एफ (6)- 11/2005-II, तारीख 7 जून, 2013 पुखरी ग᭨ला से देवीघाटू के अनुसार कालाटॉप- खिजयार व᭠यजीव अभयार᭛य कᳱ उᱫरी सीमा कᳱ सीमा का वणᭅन तक ᳰकया गया ह ैऔर इसके बाद डी पी एफ खजरोथ कᳱ सीमाᲐ के साथ काला टॉप आर-एफ-सी-11 तक जाती ह;ै जबᳰक पूवᱮ सीमा देवी घाटू स ेखिजयार डी पी एफ कᳱ सीमा के साथ कंजरेदी नाला तक जाती ह ैऔर इसके बाद भगोल मᱶ ᮧारंिभक ᭭थल ह ैभगोल से दिᭃणी भाग कᳱ सीमा आरंभ होती ह ैऔर झरुद ूᳯरज से होते ᱟए पोह᭨नी मᳰंदर तक जाती ह।ै जबᳰक पोह᭨नी मᳰंदर से पि᳟मी ᭃेᮢ काला टॉप ᳯरज़वᭅ वन कᳱ सीमा के साथ कालाटॉप ᳯरज़वᭅ वन, सी-11 तक ह।ै संरिᭃत ᭃेᮢ का कुल ᭃेᮢफल 17.17 वगᭅ ᳰकलोमीटर ह;ै और, कालाटॉप-खिजयार व᭠यजीव अभयार᭛य पि᳟मी िहमालय पवᭅत ᮰ेणी के धौलाधार ᮰णेी के पि᳟मी छोर पर ि᭭थत ह ैऔर उᲬतम ऊंचाई को दशाᭅता ह ैिजसके बाद धौलाधार रावी नदी कᳱ ओर नीचे होता जाता ह।ै इस अभयार᭛य का नाम ᮧिस ऐितहािसक “खᲯी नाग” मᳰंदर और काला टॉप के घने वनᲂ स े᳞ु᭜प᳖ ᱟआ ह।ै आरंभ से, यह अभयार᭛य 1958 मᱶ काला टॉप और खिजयार ᭃेᮢ कᳱ सीमा के 19.62 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ अिधसूिचत ᳰकया गया था। पिᭃयᲂ और पशᲐु के ऋतु ᮧवास के दिृ᳥कोण से ऋत ुके आधार पर उᲬतर ऊंचाई से िन᳜तर ऊंचाई तक और इसके िवपरीत इस अभयार᭛य कᳱ सीमा को उᱫर मᱶ रावी नदी कᳱ ओर आग ेबढ़ाने को आव᭫यक माना गया था। व᭠यजीवᲂ को बफर जोन ᮧदान करने और उसके अनुसार व᭠यजीवᲂ कᳱ ᮧभावी सुरᭃा सुिनि᳟त करन ेकᳱ भी पᳯरक᭨पना कᳱ गई थी। अिधसूचना को ᳰदनांक 26 िसतंबर, 1989 कᳱ अिधसूचना सं.6-2/73 एस एफ-IV, ᳇ारा पुनᳯरिᭃत ᳰकया गया था और इस अिधसूचना के अनुसार इस अभयार᭛य का कुल ᭃेᮢफल 69.47 वगᭅ ᳰकलोमीटर ह ै और 320 31’35” उ से 32034’32” उ अᭃांश और 76000’60” प ू से 76003’76” प ू देशांतर के बीच ि᭭थत ह।ै िहमाचल ᮧदेश सरकार कᳱ अिधसूचना सं.एफएफई-बी-एफ (6)-11/2005-II, तारीख 7 जून, 2013 को व᭠यजीव (संरᭃण) अिधिनयम, 1972 कᳱ धारा 26 (ए) के अनुसार कालाटॉप-खिजयार व᭠यजीव अभयार᭛य कᳱ सीमा को संशोिधत कर 17.17 वगᭅ ᳰकलोमीटर ᳰकया गया था। कालाटॉप-खिजयार व᭠यजीव अभयार᭛य च᭥बा िजला के च᭥बा एवं डलहौजी उप-संभागᲂ मᱶ ि᭭थत ह ैऔर च᭥बा व᭠यजीव संभाग के ᮧशासिनक िनयंᮢण के अंतगᭅत आता ह;ै और, कालाटॉप-खिजयार व᭠यजीव अभयार᭛य ᭃेᮢ को मौटे तौर पर तीन मुय ᮧकारᲂ घने वनᲂ, झील चरागाह और अ᭨पाइन चरागाह के छोटे िह᭭से मᱶ िवभािजत ᳰकया जाता ह।ै घन ेवनᲂ मᱶ कुछ ओक और रहोडोडᱶᮟोन के साथ पᳯरपᲤ िमि᮰त देवदार, ᭭ᮧूस और देवदार वन होते ह।ै वन मᱶ झाड़-झरंवाड़ काफᳱ ह,ᱹ कुछ ᭭थानᲂ मᱶ घन ेह ᱹ और घास से ढके ह।ᱹ काला टॉप-खिजयार व᭠यजीव अभयार᭛य कᳱ जलवाय ु िविवधता और िविवध पयाᭅवरणीय पाᳯरि᭭थितयां समान ᱨप से िविवध पयाᭅवासᲂ और पाᳯरि᭭थितकᳱ ᮧणािलयᲂ के साथ िविवध जीव ᱨपᲂ को आ᮰य ᮧदान करती है। यह ᭃेᮢ ᮧचुर और िविवध पौधᲂ के िलए जाना जाता है। इस ᭃेᮢ मᱶ पौधᲂ कᳱ ᮧजाितयᲂ कᳱ कुल संया 232 ह ैजो पौधᲂ के 76 पᳯरवारᲂ और 218 जेनेरा (वंश) से संबिंधत ह।ै अभयार᭛य कᳱ महᱬवपूणᭅ वन᭭पित देवदार (केरᱨस देवदार), कैल (िपनुस वा᭨लीिचअना), ᭭ᮧूस (िपकेया ि᭭मथअना सिमिथआना), िसलवर ᳰफर (अिबइस िप᭠डवो), तेजपᱫा (ᳰक᳖ामोनुम टमाला), ᳲशंगली ᳲमंगली (िडओ᭭कोᳯरया डलेटरोᳰदया), टोव (पाᳯरस फो᭨यफय᭨ला), बन काकरी (पोडोफाइलम हेसᱹᮟम), ᭪होलᱷड सोलोमन-सील (पोलीगोनातुम वरटीᳰकलातुम), ᮩाᳬी (तसुस वा᭨लीिचअना),तेजफल (ज़ांथोिसलम अरमतुम), आᳰद ह।ᱹ काला टॉप-खिजयार व᭠यजीव अभयार᭛य मᱶ 100 औषधीय पौधᲂ कᳱ ᮧजाितया ं अिभिलिखत कᳱ गई ह;ᱹ िजनमᱶ से संकटाप᳖ पौधᲂ कᳱ ᮰ेणी के अंतगᭅत 7 ᮧजाितया ंअथाᭅत ् िच᳖ामोनुम टमाला, डीओ᭭कोरेया डेलटोआिडया, पाᳯरस पॉलीिप᭨ला, पोडोफय᭨लुम हेसा᭠ᮤमु, पॉलीगोनैटम वेरटीᳰक᭨लातुम, टैसउस वा᭨लीिचअना, जा᭠थोसीलुम अरमातुम आती ह;ᱹ [भाग II—ख᭛ ड 3(ii)] भारत का राजपᮢ : असाधारण 3 और, यह कालाटॉप-खिजयार व᭠यजीव अभयार᭛य लु᳙ᮧाय क᭭तूरी मृग के िलए अ᭒छा ᮧाकृितक वास ह।ै यहा ंअ᭠य जीवजंतु ᮧजाितया ंतᱶदआु िब᭨ली (पᳯरओनाइलᱨुस बᱶगालᱶिसस), सामा᭠य तᱶदआु (प᭠ेथरेा ᮧᲽूस), काला भाल ु(उरसुस िथबेटानुस), च᭥बा सेᮓेड लंगरू (से᳜ोिपथेकस अजास), िहमालयन गोरल (नएमोरहडुेस गोरल), येलो ᮣोटेड मा᳷टᭅन (माटᱷस ᭢लैिवगलुा), कोकलास (पुकरािसया माᮓरोलाफा), कािलज (लोफुरा लेउकोमेलानुस), ᭭टै᭡प े ईगल(अयूइला िनपालᱶिसस), िहमालय गरी᭢फोन िग (गय᭡स िहमालयंिसस), आᳰद पाई जाती ह।ᱹ जीवजंतु िविवधता मᱶ, अभयार᭛य मᱶ ᭭तनधाᳯरयᲂ कᳱ 16 ᮧजाितया,ं पिᭃयᲂ कᳱ 110 ᮧजाितया ंपाई जाती ह;ै और, कालाटॉप-खिजयार व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाए ं पाᳯरि᭭थितकᳱ पयाᭅवरणीय से पाᳯरि᭭थितकᳱ संवेदी जोन के ᱨप मᱶ परैा 1 मᱶ िविन᳸दᭅ᳥ ह,ᱹ जैव िविविधता कᳱ दिृ᳥ सुरिᭃत और संरिᭃत करना और उᲦ पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ के ᮧचालन और ᮧसं᭭करण करन ेको ᮧितिष करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) (िजसे इस अिधसूचना मᱶ इसके प᳟ात पयाᭅवरण अिधिनयम कहा गया ह)ै कᳱ धारा 3 कᳱ उपधारा (1) और उपधारा (2) के खडं (v) और खंड (xiv) तथा उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, िहमाचल ᮧदेश रा᭔य के च᭥बा िजल ेके कालाटॉप-खिजयार व᭠यजीव अभयार᭛य कᳱ सीमा के चारᲂ ओर 500 मीटर तक िव᭭ताᳯरत ᭃेᮢ को कालाटॉप-खिजयार व᭠यजीव अभयारण्य पाᳯरि᭭थितकᳱ संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितकᳱ संवदेी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका ᭣यौरा िन᳜ानुसार ह,ै अथाᭅत ्:-
1. पाᳯरि᭭थित कᳱ संवेदी जोन का िव᭭तार और सीमाएं.-(1) पाᳯरि᭭थितकᳱ संवदेी जोन का िव᭭तार कालाटॉप- खिजयार व᭠यजीव अभयार᭛य कᳱ सीमा के चारᲂ ओर 500 मीटर तक िव᭭तृत होगा और पाᳯरि᭭थितकᳱ संवेदी जोन का ᭃेᮢफल 9.95 वगᭅ ᳰकलोमीटर ह।ै
(2) कालाटॉप-खिजयार व᭠यजीव अभयार᭛य और इसके पाᳯरि᭭थितकᳱ संवदेी जोन कᳱ सीमा का िववरण उपाबधं-I के ᱨप मᱶ संलᲨ ह।ै
(3) सीमा िववरण और अᭃांश और देशांतर के साथ पाᳯरि᭭थितकᳱ संवेदी जोन को सीमांᳰकत करत ेᱟए कालाटॉप-खिजयार व᭠यजीव अभयार᭛य के मानिचᮢ उपाबधं-IIक, उपाबंध-IIख और उपाबधं-IIग के ᱨप मᱶ संलᲨ ह।ै
(4) कालाटॉप-खिजयार व᭠यजीव अभयार᭛य कᳱ सीमा और पाᳯरि᭭थितकᳱ संवेदी जोन के भू-िनदᱷशांकᲂ कᳱ सूची उपाबधं-III कᳱ सारणी क और सारणी ख मᱶ दी गई ह।ै
(5) मुय ᳲबंदᲐु के भ-ूिनदᱷशांकᲂ के साथ पाᳯरि᭭थितकᳱ संवदेी जोन के अतंगᭅत आने वाल ेᮕामᲂ कᳱ सूची उपाबधं-IV के ᱨप मᱶ संलᲨ ह।ै
2. पाᳯरि᭭थितकᳱ संवेदी जोन के िलए आचंिलक महायोजना– (1) रा᭔य सरकार, पाᳯरि᭭थितकᳱ संवेदी जोन के ᮧयोजनᲂ के िलए राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और रा᭔य के सᭃम ᮧािधकारी के अनुमोदन के िलए इस अिधसूचना मᱶ ᳰदए गए अनुबंधᲂ का पालन करते ᱟए आंचिलक महायोजना तैयार करेगी। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PARTII—SEC. 3(ii)]
(2) रा᭔य सरकार ᳇ारा पाᳯरि᭭थितकᳱ संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित से जो इस अिधसूचना मᱶ िविन᳸दᭅ᭬ ट ᳰकए गए ह,ᱹ के अनुसार तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के अनुᱧप और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(3) आंचिलक महायोजना, उᲦ योजना मᱶ पाᳯरि᭭थितकᳱ और पयाᭅवरणीय बातᲂ को समाकिलत करने के िलए रा᭔ य सरकार के िन᳜िलिखत िवभागᲂ के परामशᭅ स ेतैयार होगी.-
(i) पयाᭅवरण;
(ii) वन और व᭠यजीव;
(iii) शहरी िवकास;
(iv) पयᭅटन;
(v) राज᭭ व;
(vi) नगरपािलका;
(vii) कृिष;
(viii) ᮕामीण िवकास;
(ix) ᳲसंचाई और बाढ़ िनयंᮢण;
(x) पंचायती राज;
(xi) लोक िन माᭅण िव भाग; और
(xii) िहमाचल ᮧदेश रा᭔य ᮧदषूण िनयंᮢण बोडᭅ।
(4) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸दᭅ᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ, जो अिधक दᭃता और पाᳯरि᭭थितकᳱ अनुकूल हᲂ, का संवधᭅन करेगी ।
(5) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितकᳱ और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलᲐु, िजन पर ᭟यान देना आव᭫यक ह,ै के िलए उपबधं हᲂग े।
(6) आंचिलक महायोजना िव᳒मान और ᮧ᭭तािवत भूिम उपयोग िवशेषताᲐ के ᭣यौरᲂ से अनुसमᳶथᭅत मानिचᮢ के साथ सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बि᭭तयᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी।
(7) आंचिलक महायोजना पाᳯरि᭭थितकᳱ संवदेी जोन मᱶ िवकास को िविनयिमत करेगी और सारणी मᱶ सूचीब पैरा-4 मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ का अनुपालन करेगी और ᭭ थानीय समुदायᲂ कᳱ जीिवका को सुरिᭃत करन े के िलए पाᳯरि᭭थितकᳱ अनुकूल िवकास को सुिनि᳟त और उसकᳱ अिभवृि भी करेगी।
(8) आंचिलक महायोजना ᮧादेिशक िवकास योजना कᳱ सह िव᭭तारी होगी ।
(9) इस ᮧकार अनुमोᳰदत आंचिलक महायोजना इस अिधसूचना के उपबंधᲂ के अनुसार मानीटरी के अपन े कायᲄ को करने के िलए मानीटरी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी । [भाग II—ख᭛ ड 3(ii)] भारत का राजपᮢ : असाधारण 5
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय.- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन ेके िलए िन᳜िलिखत उपाय करेगी, अथाᭅत्:-
(1) भ-ूउपयोग.– (क) पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ वनᲂ, उ᳒ान कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, मनोरंजन के ᮧयोजनᲂ के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुल े ᭭थानᲂ का वािणि᭔यक या आवासीय या औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा: परंत ुपाᳯरि᭭थितकᳱ संवदेी जोन के भीतर उपयुᭅᲦ खंड (क) मᱶ िविन᳸दᭅ᳥ ᮧयोजनᲂ से िभ᳖ ᮧयोजनᲂ के िलए कृिष और अ᭠य भूिम का संपᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और यथा लागू और ᮧादेिशक नगर योजना अिधिनयम और के᭠ᮤीय सरकार या रा᭔य सरकार के अ᭠य िनयमᲂ तथा िविनयमᲂ के अधीन सᭃम ᮧािधकारी के पूवᭅ अनुमोदन से, और इस अिधसूचना के उपबधंᲂ ᳇ारा ᭭थानीय िनवािसयᲂ कᳱ िन᳜िलिखत आवासीय आव᭫यकताᲐ को पूरा करन ेके िलए अनु᭄ात ᳰकया जाएगा, जैसे:-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढ़ृ करना तथा नई सड़कᲂ का संिनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) ᮧदषूण उ᭜प᳖ न करन ेवाले लघ ुउ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजनके अंतगᭅत ᮕामीण उ᳒ोग भी ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुिवधाए ं सहायक पाᳯरि᭭थितकᳱ पयᭅटन िजसके अ᭠तगᭅत गृह वास सि᭥मिलत ह;ै और
(v) पैरा 4 के अधीन ᳰदए गए संवᳶधᭅत ᳰᮓयाकलाप: परंत ुयह और ᳰक ᮧादेिशक नगर योजना अिधिनयम और रा᭔य सरकार के अ᭠य िनयमᲂ और िविनयमᲂ के अधीन सᭃम ᮧािधकारी के पूवᭅ अनुमोदन और संिवधान के अनु᭒छेद 244 के उपबंधᲂ या त᭜समय ᮧवᱫृ िविध के उपबंधᲂ के अनपुालन के िबना, िजसके अधीन अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या औ᳒ोिगक िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा: परंतु यह और भी ᳰक पाᳯरि᭭थितकᳱ संवदेी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई गलती, िनगरानी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामल ेमᱶ एक बार ठीक होगी और उᲦ गलती के सुधार कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय को दी जाएगी: परंतु यह और भी ᳰक गलती के सुधार मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा; (ख) वनीकरण तथा वास जीणᲃार ᳰᮓयाकलापᲂ सिहत अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे।
(2) ᮧाकृितक जल ᮲ोतᲂ.- आचंिलक महायोजना मᱶ सभी ᮧाकृितक झरनᲂ के आवाह ᭃेᮢᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और नवीकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के बारे मᱶ जो ऐस ेᭃेᮢᲂ के िलए अिहतकर हो ऐसी रीित से मागᭅदशᭅक िसांत तैयार ᳰकए जाएगें। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PARTII—SEC. 3(ii)]
(3) पयᭅटन या पाᳯरि᭭थितकᳱ पयᭅटन.- (क) पाᳯरि᭭थितकᳱ संवदेी जोन के भीतर सभी नए पाᳯरि᭭थितकᳱ पयᭅटन ᳰᮓयाकलाप या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितकᳱ संवदेी जोन के िलए होगा। (ख) पाᳯरि᭭थितकᳱ पयᭅटन महायोजना रा᭔य पयᭅटन िवभाग ᳇ारा रा᭔य पयाᭅवरण और वन िवभाग के परामशᭅ से तैयार होगी। (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ होगी। (घ) पयᭅटन महायोजना पाᳯरि᭭थितकᳱ संवदेी जोन कᳱ वहन ᭃमता के आधार पर तैयार कᳱ जाएगी। (ङ) पाᳯरि᭭थितकᳱ पयᭅटन संबंधी ᳰᮓयाकलाप िन᳜ानुसार िविनयिमत हᲂग,े अथाᭅत:्-
(i) संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितकᳱ संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट है, नय ेवािणि᭔यक होटल और ᳯरजॉटᭅ के सि᳖माᭅण अनु᭄ात नहᱭ हᲂग:े परंत,ु यह ᳰक संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर कᳱ दरूी से परे पाᳯरि᭭थितकᳱ संवदेी जोन के िव᭭तार तक होटलᲂ और ᳯरजॉटᭅ का ᭭थापना केवल पूवᭅ पᳯरभािषत और नामिन᳸दᭅ᳥ ᭃेᮢᲂ मᱶ पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितकᳱ पयᭅटन सुिवधाᲐ के िलए ही अनु᭄ात होगा;
(ii) पाᳯरि᭭थितकᳱ संवदेी जोन के भीतर नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितकᳱ–पयᭅटन, पाᳯरि᭭थितकᳱ-िशᭃा और पाᳯरि᭭थितकᳱ-िवकास पर बल देत े ᱟए (समय-समय पर यथा संशोिधत) जारी मागᭅदशᭅक िसांतᲂ के अनुसार होगा;
(iii) आंचिलक महायोजना का अनमुोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸दᭅ᳥ संवीᭃा और िनगरानी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया जाएगा और पाᳯरि᭭थितकᳱ संवेदी जोन के भीतर ᳰकसी नये होटल या ᳯरसोटᭅ या वािणि᭔यक ᭭थापना का संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जायेगा ।
(4) नसैᳶगᭅक िवरासत.- पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगᭅक िवरासत के सभी ᭭थलᲂ जैसे जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और िवरासत संरᭃण योजना आंचिलक महायोजना के भाग के ᱧप मᱶ पᳯररᭃण और संरᭃण के िलए तैयार कᳱ जाएगी ।
(5) मानव िनᳶमᭅत िवरासत ᭭ थल.- पाᳯरि᭭थितकᳱ संवदेी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, ᭭थाप᭜य, सᲅदयᭅपूरक और सां᭭ कृितक मह᭜व के ᭃेᮢᲂ कᳱ और उपᭃेᮢᲂ पहचान और उनके संरᭃण के िलए िवरासत योजना आंचिलक महायोजना के भाग के ᱧप मᱶ तैयार कᳱ जाएगी।
(6) ᭟ विन ᮧदषूण.- पयाᭅवरण अिधिनयम के अधीन ᭟विन ᮧदषूण (िविनयमन और िनयंᮢ ण) िनयम, 2000 मᱶ िनयत उपबंधᲂ के अनुसार मᱶ पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ ᭟विन ᮧदषूण के िनयंᮢ ण और िनवारण का अनुपालन ᳰकया जाएगा। [भाग II—ख᭛ ड 3(ii)] भारत का राजपᮢ : असाधारण 7
(7) वाय ुᮧदषूण.- पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ, वायु ᮧदषूण के िनवारण और िनयंᮢण का वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार अनुपालन ᳰकया जाएगा।
(8) बिह᮲ाव का िन᭭सारण.- पाᳯरि᭭थितकᳱ संवदेी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, साधारणᲂ मानकᲂ के उपबंधᲂ के अनुसार पयाᭅवरण अिधिनयम और उसके अधीन बनाए गए िनयमᲂ के अधीन आने वाल े पयाᭅवरणीय ᮧदषूण के िन᭭सारण के िलए साधारण मानकᲂ या रा᭔य सरकार ᳇ारा िनयत मानकᲂ, जो भी अिधक कठोर हो, के उपबंधᲂ के अनुसार होगा।
(9) ठोस अपिश᳥.- ठोस अपिश᳥ का िनपटान एवं ᮧबधंन िन᳜ानुसार ᳰकया जाएगा:- (क) पाᳯरि᭭थितकᳱ संवदेी जोन मᱶ ठोस अपिश᳥ का िनपटान और ᮧबंधन भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢ ालय कᳱ अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 के अधीन ᮧकािशत ठोस अपिश᳥ ᮧबंधन िनयम, 2016, के उपबंधᲂ के अनुसार ᳰकया जाएगा; अकाबᭅिनक पदाथᲃ का िनपटान पाᳯरि᭭थितकᳱ संवेदी जोन से बाहर िचि᭠हत ᳰकए गए ᭭थानᲂ पर पयाᭅवरण-अनुकूल रीित से ᳰकया जाएगा; (ख) पाᳯरि᭭थितकᳱ संवदेी जोन मᱶ मा᭠य ᮧौ᳒ोिगᳰकयᲂ का ᮧयोग करत े ᱟए िव᳒मान िनयमᲂ और िविनयमᲂ के अनुᱨप ठोस अपिश᳥ का सुरिᭃत और पयाᭅवरण-अनुकूल ᮧबंधन (ईएसएम) अनु᭄ात ᳰकया जा सकेगा।
(10) जैव िचᳰक᭜सा अपिश᭬ ट.- जैव िचᳰक᭜सा अपिश᭬ ट का ᮧबंधन िन᳜ानुसार ᳰकया जाएगा.- (क) पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ जैव िचᳰक᭜सा अपिश᳥ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं.सा.का.िन 343 (अ), तारीख 28 माचᭅ, 2016 के अधीन ᮧकािशत जैव िचᳰक᭜सा अपिश᳥ ᮧबंधन िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा। (ख) पाᳯरि᭭थितकᳱ संवदेी जोन मᱶ मा᭠य ᮧौ᳒ोिगᳰकयᲂ का उपयोग करते ᱟए िव᳒मान िनयमᲂ और िविनयमᲂ के अनुᱨप जैव-िचᳰक᭜सा अपिश᳥ का सुरिᭃत और पयाᭅवरण-अनुकूल ᮧबंधन अनु᭄ात ᳰकया जा सकेगा।
(11) ᭡लाि᭭टक अपिश᳥ ᮧबधंन.- पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंधन का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢ ालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.सा.का.िन 340(अ), तारीख 18 माचᭅ, 2016, ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंधन िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(12) िनमाᭅण और िव᭟वसं अपिश᳥ ᮧबधंन.- पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंधन का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢ ालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.सां.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबधंᲂ के अनुसार ᳰकया जाएगा ।
(13) ई–अपिश᳥.- पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंधन का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢ ालय कᳱ समय-समय पर यथासंशोिधत ᳇ारा ᮧकािशत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(14) यानीय यातायात.- यातायात कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध सि᭥मिलत ᳰकए जाएंग ेऔर आंचिलक महायोजना के तैयार होन ेऔर रा᭔य 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PARTII—SEC. 3(ii)] सरकार के सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होन े तक, िनगरानी सिमित सुसंगत अिधिनयमᲂ और उसके अधीन बनाए गए िनयमᲂ और िविनयमᲂ के अनुसार यानीय ᳰᮓयाकलापᲂ के अनुपालन को िनगरानी करेगी।
(15) यानीय ᮧदषूण.- लाग ूिविधयᲂ के अनुपालन मᱶ वाहन ᮧदषूण का िनवारण और िनयंᮢण ᳰकया जाएगा। ᭭व᭒छक धन के उपयोग के िलए ᮧयास ᳰकए जाएंगे।
(16) औ᳒ोिगक ईकाइया.ं- (i) राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन पर या उसके प᳟ात पाᳯरि᭭थितकᳱ संवेदी जोन के भीतर कोई नए ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अन᭄ुा नहᱭ दी जाएगी।
(ii) के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा फरवरी, 2016 मᱶ जारी मागᭅदशᭅक िसा᭠तᲂ मᱶ उ᳒ोगᲂ के वगᱮकरण के अनुसार, जब तक ᳰक अिधसूचना मᱶ इस ᮧकार िविन᳸दᭅ᳥ न हो; पाᳯरि᭭थितकᳱ संवेदी जोन के भीतर केवल गैर- ᮧदषूणकारी उ᳒ोगᲂ को अनु᭄ात ᳰकया जाएगा और इसके अितᳯरᲦ, गैर ᮧदषूणकारी उ᳒ोगᲂ को बढ़ावा ᳰदया जाएगा।
(17) पहाड़ी ढलानᲂ को सरंᭃण.- पहाड़ी ढलानᲂ का संरᭃण िन᳜ानुसार होगा:- (क) आंचिलक महायोजना पहाड़ी ढलानᲂ पर ᭃेᮢᲂ का संकेत होगा जहा ंᳰकसी भी संिनमाᭅण कᳱ अन᭄ुा नहᱭ दी जाएगी; (ख) कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर ᳰकसी भी संिनमाᭅण कᳱ अनु᭄ा नहᱭ दी जाएगी ।
4. पाᳯरि᭭थितकᳱ सवंदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰकए जान ेवाल ेᳰᮓयाकलापᲂ कᳱ सचूी.- पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण अिधिनयम के उपबधंᲂ और उसके अधीन बनाए गए िनयमᲂ िजसके अ᭠तगᭅत तटीय िविनयमन जोन, 2011 और पयाᭅवरणीय ᮧभाव आकलन अिधसूचना, 2006 और अ᭠य लाग ूिविधयां के िजसमᱶ वन (संरᭃण) अिधिनयम, 1980 (1980 का 69), भारतीय वन अिधिनयम, 1927 (1927 का 16), व᭠यजीव (संरᭃण) अिधिनयम, 1972 (1972 का 53), सि᭥मिलत ह ᱹऔर ᳰकय ेगय ेसंशोधनᲂ ᳇ारा शािसत हᲂग ेऔर नीचे दी गई सारणी मᱶ िविन᳸दᭅ᳥ रीित मᱶ िविनयिमत हᲂग,े अथाᭅत ्:- सारणी ᮓम स.ं

1. वािणि᭔यक खनन, प᭜थर उ᭜खनन और अपघषᭅण इकाइयां । (क) पाᳯरि᭭थितकᳱ संवेदी जोन के अंतगᭅत वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ िजसमᱶ मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना सि᭥मिलत ह,ै के िसवाय सभी ᮧकार के नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर उ᭜खनन और अपघषᭅण इकाइयां त᭜काल ᮧभाव से ᮧितिष हᲂगी; (ख) खनन ᮧचालन, 1995 कᳱ ᳯरट यािचका (िसिवल) स.ं 202 मᱶ टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत संघ के मामले मᱶ माननीय उᲬतम ᭠यायालय के आदशे 4 अग᭭त, 2006 और 2012 कᳱ ᳯरट यािचका (िसिवल) सं. 435 मᱶ गोवा फाउंडेशन बनाम भारत संघ के मामल े मᱶ तारीख 21 अᮧैल, 2014 के [भाग II—ख᭛ ड 3(ii)] भारत का राजपᮢ : असाधारण 9 आदशे के अनुसरण मᱶ होगा ।
2. ᮧदषूण (जल, वायु, मृदा, ᭟विन, आᳰद) उ᭜पन करने वाले उ᳒ोगᲂ कᳱ ᭭थापना । पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ कोई नया उ᳒ोग लगाने और वतᭅमान ᮧदषूणकारी उ᳒ोगᲂ का िव᭭तार करने कᳱ अनु᭄ा नहᱭ होगी: पर᭠तु यह ᳰक के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा फरवरी, 2016 मᱶ जारी मागᭅ दशᭅक िसा᭠तᲂ मᱶ उ᳒ोगᲂ के वगᱮकरण के अनुसार जब तक ᳰक अिधसूचना मᱶ ऐसा िविन᳸दᭅ᳥ न हᲂ, पाᳯरि᭭थितकᳱ संवेदी जोन के भीतर गैर-ᮧदषूणकारी उ᳒ोगᲂ को अनु᭄ात ᳰकया जाएगा और इसके अितᳯरᲦ गैर-ᮧदषूणकारी कुटीर उ᳒ागᲂ को बढ़ावा ᳰदया जाएगा।
3. बृहत जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापना । ᮧितिष।
4. ᳰकसी पᳯरसंकटमय पदाथᭅ का उपयोग या उ᭜पादन या ᮧसं᭭करण। ᮧितिष।
5. ᮧाकृितक जल िनकायᲂ या ᭃेᮢ भूिम मᱶ अनुपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । ᮧितिष।
6. नई आरा िमलᲂ कᳱ ᭭थापना। पाᳯरि᭭थितकᳱ संवदेी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
7. ट भᲵᲂ कᳱ ᭭थापना करना। ᮧितिष।
8. जलावन लकड़ी का वािणि᭔यक उपयोग । ᮧितिष।
9. पोिलथीन बैगᲂ का उपयोग । ᮧितिष। आ. िविनयिमत ᳰᮓयाकलाप
10. वािणि᭔यक होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितकᳱ पयᭅटन ᳰᮓयाकलापᲂ लघु अ᭭थायी संरचनाᲐ के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितकᳱ संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणि᭔यक होटल और ᳯरसोटᲄ को अनु᭄ात नहᱭ ᳰकया जाएगा: परंतु यह ᳰक संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के परे या पाᳯरि᭭थितकᳱ संवेदी जोन के िव᭭तार तक इनमᱶ से, जो भी िनकट हो सभी नए पयᭅटन ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना और यथा लाग ू मागᭅदशᱮ िसांतᲂ के अनुᱧप होगा।
11. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितकᳱ संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट हो, ᳰकसी भी ᮧकार नये वािणि᭔यक संिनमाᭅण कᳱ अनु᭄ा नहᱭ होगी: परंतु यह ᳰक ᭭थानीय लोगᲂ को अपनी आवास स᭥ब᭠धी िन᳜िलिखत आव᭫यकताᲐ को पूरा करने के िलए, पैरा 3 के उप पैरा
(1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत अपने उपयोग के िलए, अपनी भूिम मᱶ भवन उप-िविधयᲂ के अनुसार, संिनमाᭅण करने कᳱ अन᭄ुा होगी: परंतु यह ᳰक गैर–ᮧदषूणकारी लघु उ᳒ोगᲂ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PARTII—SEC. 3(ii)] सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से िविनयिमत ᳰकए जाएंगे और व े ᭠यूनतम हᲂग े। (ख) एक ᳰकलोमीटर ᭃेᮢ से परे ये आंचिलक महायोजना के अनुसार िविनयिमत हᲂगे ।
12. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । फरवरी, 2016 मᱶ के᭠ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी उ᳒ोगᲂ मᱶ वगᱮकरण के अनुसार गरै-ᮧदषूणकारी उ᳒ोग और अपᳯरसंकटमय मᱶ, लघु और सेवा उ᳒ोग, कृिष, पु᭬ प कृिष, उ᳒ान कृिष या पाᳯरि᭭थितकᳱ संवेदी जोन से दशेी सामᮕी से उ᭜पादᲂ को उ᭜प᳖ करने वाले कृिष आधाᳯरत उ᳒ोग सᭃम ᮧािधकारी ᳇ारा अनु᭄ात हᲂगे।
13. वᭃृᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनु᭄ा के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ वᭃृᲂ कᳱ कटाई नहᱭ होगी । (ख) वᭃृᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगे ।
14. वन उ᭜पादᲂ या गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
15. िव᳒ुत और संचार टावरᲂ का पᳯरिनमाᭅण और केबलᲂ के िबछाए जाने और अ᭠य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे (भूिमगत केबल के िबछाए जाने को बढ़ावा ᳰदया जा सकेगा)।
16. नागᳯरक सुख सुिवधाᲐ सिहत अवसंरचनाएं । ᭠यूनीकरण उपायᲂ को लागू िविधयᲂ, िनयमᲂ और िविनयमनᲂ और उपल᭣ध मागᭅदशᭅक िसांतᲂ के अनुसार ᳰकया जाना ।
17. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढ़ृ करना तथा नवीन सड़कᲂ का संिनमाᭅण । ᭠यूनीकरण उपायᲂ को लाग ू िविधयᲂ, िनयमᲂ और िविनयमनᲂ तथा उपल᭣ध मागᭅदशᭅक िसांतᲂ के अनुसार ᳰकया जाएगा ।
18. पयᭅटन से संबंिधत अ᭠य ᳰᮓयाकलाप जैसे गमᭅ वायु ग᭣ुबारᱶ, हलेीका᭡टर, ᮟोन, माइᮓोलाइटस आᳰद ᳇ारा पाᳯरि᭭थितकᳱ संवेदी जोन ᭃेᮢ के ऊपर से उड़ना जैस े ᳰᮓयाकलाप करना। लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
19. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
20. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे।
21. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ दुधशाला, दुघ उ᳒ोग, कृिष और मछली पालन । ᭭थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।
22. फमᲄ, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणि᭔यक पशᲐु और कुकुट फामᲄ कᳱ ᭭थापना । ᭭थानीय आव᭫यकताᲐ को पूरा करने के िलए लाग ूिविधयᲂ के अधीन िविनयिमत (अ᭠यथा उपबिंधत के िसवाय) हᲂग े।
23. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
24. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭तारण । जल िनकायᲂ मᱶ उपचाᳯरत अपिश᳥ जल या बिह᮲ाᭅव के िन᭭सारण स े बचा जाएगा और उपचाᳯरत अपिश᳥ जल के पुन:चᮓण और पुन:उपयोग के िलए ᮧयास ᳰकए जाएंग।े अ᭠यथा लागू िविधयᲂ के [भाग II—ख᭛ ड 3(ii)] भारत का राजपᮢ : असाधारण 11 अनुसार उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण या ᮧवाह के िनवᭅहन को िविनयिमत ᳰकया जाएगा।
25. सतही और भूजल का वािणि᭔यक ᮧयोग एवं िन᭬कषᭅण । लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
26. ठोस अपिश᳥ का ᮧब᭠धन। लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
27. पाᳯरि᭭थितकᳱ पयᭅटन। लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे ।
28. वािणि᭔ यक सूचनापᲵ और होᳺडᲈग। लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे । इ. सवंᳶधᭅत ᳰᮓयाकलाप
29. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा।

33. नवीकरणीय ऊजाᭅ और धन का उपयोग। बायोगैस, सौर ᮧकाश इ᭜ याᳰद को बढ़ावा ᳰदया जाएगा।
34. कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा।
35. बागान लगाना और जड़ी बᳯूटयᲂ का रोपण । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा।
36. पाᳯरि᭭थितकᳱ अनुकूल पᳯरवहन का उपयोग । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा।
37. कौशल िवकास । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा।
38. िन᳜ीकृत भूिम या वन या वास कᳱ बहाली। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा।
39. पयाᭅवरणीय जागᱧकता। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा।
5. पाᳯरि᭭थितकᳱ सवेंदी जोन कᳱ अिधसचूना कᳱ िनगरानी के िलए िनगरानी सिमित- कᱶ ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 3 कᳱ उपधारा (3) के अधीन इस अिधसूचना के उपबंधᲂ कᳱ ᮧभावी िनगरानी के िलए िनगरानी सिमित का गठन करती ह,ै जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत:्- ᮓ.स. िनगरानी सिमित का गठन पदािनधान

(iv) रा᭔य सरकार ᳇ारा नािमत ᳰकए जाने वाल े रा᭔य जैव िविवधता बोडᭅ से जैव िविवधता मᱶ एक िवशेष᭄ सद᭭य;
(v) रा᭔य के ᮧिति᳧त सं᭭थान या िव᳡िव᳒ालय से पाᳯरि᭭थितकᳱ मᱶ एक िवशेष᭄ सद᭭य;
(vi) िहमाचल ᮧदेश ᮧदषूण िनयंᮢण बोडᭅ के ᮧितिनिध सद᭭य;

6. िनदᱷश–िनबधंन.- (1) िनगरानी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को िनगरानी करेगी।
(2) िनगरानी सिमित का कायᭅकाल तीन वषᭅ तक या रा᭔य सरकार ᳇ारा नई सिमित के पनु: गठन तक के िलए होगा और त᭜प᳟ात िनगरानी सिमित रा᭔य सरकार ᳇ारा गᳯठत कᳱ जाएगी।
(3) उन ᳰᮓयाकलापᲂ कᳱ, जो भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢ ालय कᳱ अिधसूचना संयांक का.आ. 1533 (अ), तारीख 14 िसत᭥बर, 2006 कᳱ अनुसूची मᱶ सि᭥मिलत ह,ᱹ और जो पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ आत ेह,ᱹ िसवाय इसके जो पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸दᭅ᳥ ᮧितिष ᳰᮓयाकलापᲂ के, िनगरानी सिमित ᳇ारा वा᭭तिवक िविन᳸दᭅ᳥ ᭭थलीय दशाᲐ के आधार पर संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण अनापिᱫ के िलए केᮤᱭय सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय को िन᳸दᭅ᳥ ᳰकया जाएगा।
(4) इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸दᭅ᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢ ालय कᳱ अिधसूचना संयांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे अनुसूची मᱶ ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंतु पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸दᭅ᳥ ᭭थलीय दशाᲐ पर आधाᳯरत िनगरानी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उस े संब िविनयामक ᮧािधकरणᲂ को िन᳸दᭅ᳥ ᳰकया जाएगा ।
(5) िनगरानी सिमित का सद᭭य-सिचव या संब उपायᲦु ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लघंन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा।
(6) िनगरानी सिमित मुा दर मुा के आधार पर अपᭃेाᲐ पर िनभᭅर रहत े ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार- िवमशᭅ मᱶ सहायता के िलए आमिंᮢत कर सकेगी ।
(7) िनगरानी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक के अपने ᳰᮓयाकलापᲂ कᳱ वाᳶषᭅक कारᭅवाई ᳯरपोटᭅ रा᭔ य के मु य व᭠ यजीव वाडᭅन को उपाबंध V मᱶ संलᲨ ᮧोफामाᭅ मᱶ उ त वषᭅ के 30 जनू तक ᮧ᭭तुत करेगी ।
(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय िनगरानी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदᱷश द ेसकेगा, जो वह ठीक समझे ।

The Kalatop-Khajjiar Wildlife Sanctuary as per Government of Himachal Pradesh notification No. FFE-B-F(6)-11/2005-II, dated the 7thJune, 2013 under section 26(A) of the Wildlife (Protection) Act,1972 described the limits as North boundary has Pukhari Galla to Devi Ghatu and then along with the boundaries of DPF Khajroth up to Kalatop RF – C-11; while Eastern bordered from Devi Ghatu along with the boundary of Khajjiar DPF to Kanjredi Nalla and then up to its origin point at Bhagot. The boundary of Southern side begins from Bhagot through Jhurdu Ridge up to Pohlani Temple, while Western region with Pohlani Temple along the boundary of Kalatop Reserve Forest up to Kalatop Reserve Forest, C-11. The total area of the Protected Area is 17.17 square kilometers; AND WHEREAS,Kalatop-Khajjiar Wildlife Sanctuary in the Western Himalayan mountain ranges is located on the Western extremity of Dhauladhar Range and exhibits the highest elevation after which the Dhauladhar dips down towards Ravi River. This Sanctuary derives its name from the famous historical “Khajji Nag” temple and dense forests of Kalatop. Initially, this Sanctuary was notified in 1958 with an area of 19.62 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PARTII—SEC. 3(ii)] square kilometers limited to Kalatop and Khajjiar area. In view of the seasonal migration of birds and animals from higher elevation to lower elevation and vice-versa depending upon the season it was felt necessary to further extend the boundary of this sanctuary towards North upto Ravi River. This was also envisaged to provide a buffer zone to the Wildlife and ensure effective protection of wildlife accordingly. The notification was revised during 1989 vide No. 6-2/73 SF-IV, dated the 26th September, 1989 and as per this notification the total area of this Sanctuary was 69.47 square kilometers and situated between 320 31’35” N to 32034’32” N latitudes and 76000’60” E to 76003’76” E longitudes. The limit of the Kalatop-Khajjiar Wildlife Sanctuary was further revised to 17.17 square kilometers as per Government of Himachal Pradesh notification No.FFE-B-F(6)- 11/2005-II, dated the 7th June,2013 under Section 26(A) of the Wildlife(Protection) Act, 1972. The Kalatop- Khajjiar Wildlife Sanctuary is located in Chamba and Dalhousie sub-divisions of Chamba district and falls under the administrative control of Wildlife Division Chamba; AND WHEREAS, the Kalatop-Khajjiar Sanctuary area can broadly be divided into three main types viz, dense forests, lake meadow and small portion of alpine pasture. Dense forests consist of mature mixed fir, spruce and deodar forests with some oak and rhododendron. Undergrowth in the forest is well developed, dense in places and with a good cover of grass. The diverse climate and the varied environmental conditions prevailing in Kalatop-Khajjiar Wildlife Sanctuary support diverse habitat and ecosystems with equally diverse life forms. This area is known for its rich and diverse plant wealth. In this area total number of plant species is 232 belonging to 76 families and 218 genera. The important flora of the Sanctuary deodara (Cedrus deodara), kail (Pinus wallichiana), spruce (Picea smithiana),silver fir (Abies pindrow), tejpatta (Cinnamonum tamala), shingli mingli (Dioscorea deltoidea), tow (Paris polyphylla), ban kakri (Podophyllum hexandrum), whorled Solomon'sseal (Polygonatum verticillatum), brahmi (Taxus wallichiana), tejphal (Zanthoxylum armatum), etc. Out of 100 medicinal plant species recorded from the Kalatop Khajjiar Wildlife Sanctuary, 7 species viz; Cinnamonum tamala, Dioscorea deltoidea, Paris polyphylla, Podophyllum hexandrum, Polygonatum verticillatum, Taxus wallichiana, Zanthoxylum armatum fall in the category of threatened plants; AND WHEREAS, the Kalatop-Khajjiar Sanctuary is a good habitat for endangered musk deer. Other faunal species found here are leopard cat (Prionailurus bengalensis), common leopard (Panthera pardus), black bear (Ursus thibetanus), Chamba sacred langur (Semnopithecus ajax), Himalayan goral (Naemorhedus goral), yellow throated marten (Martes flavigula), koklash (Pucrasia macrolopha), kaleej (Lophura leucomelanos), steppe eagle (Aquila nipalensis), Himalayan griffon vulture (Gyps himalayensis), etc. In the faunal diversity, 16 species of mammals, 110 species of birds are found in the Sanctuary; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1, around the protected area of Kalatop-Khajjiar Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and
(xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act)read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of uniform 500 meters around the boundary of Kalatop-Khajjiar Wildlife Sanctuary, in Chamba district in the State of Himachal Pradesh as the Kalatop-Khajjiar Wildlife Sanctuary Eco-sensitive Zone (hereafterin this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: -
1. Extent and boundaries of Eco-sensitive Zone. – (1)The Eco-sensitive Zone shall be to an extent of uniform 500 meters around the boundary of Kalatop-Khajjiar Wildlife Sanctuaryand the area of the Ecosensitive Zone is 9.95 square kilometres.
(2) The boundary description of Kalatop-Khajjiar Wildlife Sanctuaryand its Eco-sensitive Zone is appended as Annexure-I.
(3) The maps of the Kalatop-Khajjiar Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC.
(4) List of geo-coordinates of the boundary of Kalatop-Khajjiar Wildlife Sanctuaryand Eco-sensitive Zone are given in Table A and Table B of Annexure-III.
(5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Ecosensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Urban Development;
(iv) Tourism;
(v) Revenue;
(vi) Municipal;
(vii) Agriculture;
(viii) Rural Development;
(ix) Irrigation and Flood Control;
(x) Panchayati Raj;
(xi) Public Works Department; and
(xii) Himachal Pradesh State Pollution Control Board.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified in clause (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as.-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution; 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PARTII—SEC. 3(ii)]
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or eco-tourism.-(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Ecosensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be permitted within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.-Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.-Prevention and control of air pollution in the Eco-sensitive Zone shall be carried outin accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.-Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes.-Disposal and management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.
(10) Bio-Medical Waste.–Bio-Medical Waste Management shall be as under:-
(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016;
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Ecosensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.-The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.-The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.-Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:- 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PARTII—SEC. 3(ii)]
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules madethereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco sensitive Zone;
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted.
3. Establishment of major hydro-electric project. Prohibited.
4. Use or production or processing of any hazardous substances. Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited.
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited.
8. Commercial use of firewood. Prohibited.
9. Use of polythene bags. Prohibited. B. Regulated Activities
10. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for ecotourism activities:
Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary [भाग II—ख᭛ ड 3(ii)] भारत का राजपᮢ : असाधारण 23 S. No.

(3) of the protected area or upto extent of the Ecosensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph
(1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
12. Small scale non polluting industries. Nonpolluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
13. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
14. Collection of Forest produce or Non- Timber Forest produce. Regulated as per the applicable laws.
15. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws (underground cabling may be promoted).
16. Infrastructure including civic amenities. Taking measures of mitigation as per the applicable laws, rules, regulations and available guidelines.
17. Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation as per the applicable laws, rules, regulation and available guidelines.
18. Undertaking other activities related to tourism like flying over the Ecosensitive Zone area by hot air balloon, helicopter, drones, microlites, etc. Regulated as per the applicable laws.
19. Protection of hill slopes and river banks. Regulated as per the applicable laws.
20. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
21. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.
22. Establishment of large-scale commercial livestock and poultry farms by firms, corporates and companies. Regulated (except otherwise provided) as per the applicable laws except for meeting local needs.
23. Introduction of exotic species. Regulated as per the applicable laws.
24. Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. 37. Skill Development. Shall be actively promoted.
38. Restoration of degraded land/ forests/ habitat. Shall be actively promoted.
39. Environmental awareness. Shall be actively promoted.
5. Monitoring Committee for Monitoring Eco-sensitive Zone Notification.-For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. (ii) Divisional Forest Officer (Territorial) Member;
(iii) A representative of Non-Governmental Organisation working in the field of wildlife conservation to be nominated by the State Government Member;
(iv) An expert in Biodiversity from State Biodiversity Board to be nominated by the State Government Member;
(v) One expert in Ecology from reputed institution or university of the State Member;
(vi) Representative of Himachal Pradesh Pollution Control Board Member;
(vii) Divisional Forest Officer (Wildlife) Member-Secretary.
6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Monitoring Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended as Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures.-The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc. Orders.-The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
