PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2907] ubZ fnYyh] 'kqØokj] fnlEcj 9] 2016@vxzgk;.k 18] 1938 No. 2907] NEW DELHI, FRIDAY DECEMBER 9, 2016/AGRAHAYANA 18, 1938 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय अिधसचूना नई ᳰद᭨ली, 9 ᳰदस᭥बर, 2016 का.आ. 3996(अ).—भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. 1558(अ) तारीख 12 जून, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसूचना अतंᳶव᳥ ह,ै उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत करत ेᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी; और उᲦ राजपᮢ, िजसमᱶ उ त अिधसूचना अंतᳶव᭬ ट ह,ै कᳱ ᮧितयां जनता को 12 जून, 2015 को उपल᭣ध करा दी गई थᱭ ; और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर कᱶ ᮤीय सरकार ᳇ारा स᭥यक् ᱧप से िवचार ᳰकया गया; और, गौटाला अᮢम व᭠ यजीव अभयार᭛ य 200 14' 00'' से 200 27' 29.787'' उ᭜ तर अᭃांश और 740 53'
30.782'' से 750 16' 40'' पवूᭅ देशांतर के बीच महारा᭬ ᮝ के औरंगाबाद और जलगᱼव िजलᲂ मᱶ ि᭭ थत ह ैऔर 260.61 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ ह;ै और, गौटाला अᮢम व᭠ यजीव अभयार᭛ य महारा᳦ रा᭔ य के औरंगाबाद और नािसक ᭃेᮢ मᱶ एक मह᭜ वपूणᭅ संरᭃण एकक ह ैऔर 30 से अिधक ᭭ तनपायी ᮧजाितयᲂ िजसके अंतगᭅत अनुसूची एक ᮧजाितयाँ जैसे भेिडया (कैिनस लुपुस पैि᭨लपेस), तᱶदआु (पᱶथेरा पाडᭅस), रीछ (मेलरुसस अरिसनस), काला िहरण (एि᭠टलोप करिवकापरा), चौᳲसगा मृग (टेटरासेरस Ფोडᳯरकॉरिनस), ᮧवासी ᮧाि᭭ थित कᳱ 20 ᮧजाितयᲂ सिहत पिᭃयᲂ कᳱ 210 से अिधक ᮧजाितयां और िविभ᭠ न ᮧकार के सᳯर सृपᲂ, उभयचरᲂ, मछिलयᲂ आᳰद का आ᮰य ᭭ थान ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, गौटाला अᮢम व᭠ यजीव अभयार᭛ य के चारᲂ ओर के ᭃेᮢ को पᳯर रᭃण और संरᭃण करना आव᭫ यक ह ैतथा िज सकᳱ सीमाᲐ को इस अिध सूचना के पैरा 1 मᱶ पाᳯरि᭭थितक संवेदी जोन के ᱧप मᱶ िव िन ᳸द ᭬ ट ᳰक या गया ह ैऔर पयाᭅवरण कᳱ दिृ᭬ ट से उ᳒ोगᲂ या उ᳒ोगᲂ के वगᭅ को तथा उनकᳱ संᳰᮓ याᲐ और ᮧᳰᮓ याᲐ को उ त पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष करना आव᭫ यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) के साथ पᳯठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत े ᱟए, महारा᭬ ᮝ रा᭔ य मᱶ गौटाला अᮢम घाट व᭠ यजीव अभयार᭛ य कᳱ सीमा से एक ᳰक लोमीटर तक के िव᭭ ताᳯरत ᭃेᮢ को गौटाला अᮢम घाट व᭠ यजीव अभयार᭛ य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:--
1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाएं.—(1) पाᳯरि᭭थितक संवेदी जोन 483.45 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ गौटाला अᮢम व᭠ यजीव अभयार᭛ य कᳱ सीमा से एक ᳰक लोमीटर तक के ᭃेᮢ मᱶ फैला ᱟआ ह ैऔर ऐसे जोन कᳱ सीमा का वणᭅन उपाबधं–I मᱶ ᳰद या गया ह ै।
(2) पाᳯरि᭭थितक संवेदी जोन महारा᭬ ᮝ मᱶ औरंगाबाद और जलगᱼव िजलो के 70 ᮕामᲂ मᱶ फैला ᱟआ ह ै।
(3) पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत आने वाल ेᮕामᲂ कᳱ सूची उपाबधं-II के ᱧप मᱶ उपाब ह ै।
(4) पाᳯरि᭭थितक संवेदी जोन का मानिच ᮢ अᭃांश और देशा᭠तर के साथ उपाबधं-III के ᱧप मᱶ उपाब ह ै।
2. पाᳯरि᭭थितक सवंदेी जोन के िलए आचंिलक महायोजना.—(1) रा᭔य सरकार, पाᳯरि᭭ थितकᳱय संवेदी जोन के ᮧभावी ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, आंचिलक महायोजना ऐसी रीित मᱶ तैयार कᳱ जाए जो इस अिधसूचना मᱶ िविन᳸द᭬ ट ह ैऔर के᭠ ᮤ ीय सरकार और रा᭔ य सरकार कᳱ िविधयᲂ तथा के᭠ ᮤ ीय सरकार ᳇ारा जारी मागᭅदशᱮ िसांत के भी अनᱨुप ह ᱹ।
(2) आंचिलक महायोजना अिधसूचना मᱶ िविन᳸द᳥ तैयार शतᭅ के अनᱨुप होगा िजसमᱶ पयाᭅवरणीय ᮧभाव शािमल ह।ै
(3) पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित मᱶ रा᭔ य सरकार तथा सुसंगत के᭠ ᮤ ीय और रा᭔ य िविधयᲂ के अनुᱨप भी तथा के᭠ ᮤ ीय सरकार ᳇ारा जारी मागᭅिनदᱷश का िसांत, यᳰद कोई हᲂ, ᳇ारा तैयार कᳱ जाएगी ।
(4) आचंिलक महायोजना सभी संबंिध त रा᭔ य िव भागᲂ के साथ परामशᭅ से पयाᭅवरणीय और पाᳯरि᭭ थितक िवचारणᲂ को उनमᱶ एकᳱकृत करने के िलए तैयार कᳱ जाएगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन और व᭠यजीव ;
(iii) कृिष;
(iv) राज᭭ व;
(v) नगर िवकास;
(vi) पयᭅटन;
(vii) ᮕामीण िवकास;
(viii) ᳲसचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका;
(x) पंचायती राज;

(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हᲂ और आचंिलक महायोजना मᱶ सभी अवसंरचना ᳰᮓयाकलापᲂ मᱶ दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जलाशयᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभर ᮧबंधन, भूजल ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक ह,ै के िलए उपबंध हᲂग े।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे पाकᲃ और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलो᳒ानᲂ, झीलᲂ और अ᭠य जलाशयᲂ का अ᭤यकंन करेगी; आंचिलक महायोजना के मानिचᮢ ᳇ारा िव᳒मान और ᮧ᭭तािवत भूिम के उपयोग का िववरण ᳰकया जाएगा ।
(8) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीिवका सुरिᭃत करने के िलए पाᳯरि᭭ थितक अनुकूल िवकास को सुिनि᭫ चत करेगी ।
(9) आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए ᮧावधानᲂ के संबंध मᱶ अपने कायᲄ के बाहर ले जाने के िलए मानीटरी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय.—रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भू-उपयोग.—पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुल े ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा : परंत ु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन ेके िलए और पैरा 4 कᳱ सारणी के ᭭तंभ
(2) के अधीन ᮓं. सं. 9, सं. 11, सं. 20, सं. 33 और सं. 36 के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत ्:-
(i) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद ;
(ii) ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग;
(iii) िव ᳒ मान सड़कᲂ को चौड़ा करना और सुदढ़ृ करना;
(iv) वषाᭅ जल संचय; और
(v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण कारीगर भी ह,ᱹ : परंत ुयह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और भारत के संिव धान के अन᭒ु छेद 244 तथा त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा : परंत ु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट मानीटरी सिमित के िवचार ᮧा᳙ करन ेके प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ केवल एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंत ुयह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू- उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंत ुयह और भी ᳰक हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत.—आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पनुᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तयैार ᳰकए जाएंग े।
(3) पाᳯरि᭭थितक पयᭅटन.—(क) पाᳯरि᭭थितक संवेदी जोन के भीतर पाᳯरि᭭थितक पयᭅटन महायोजना के अनुसार पयᭅटन संबंधी ᳰᮓयाकलाप, जो आंचिलक महायोजना का भाग ᱨप मᱶ िन᳜िलिखत ᱨप मᱶ हᲂगे । (ख) पाᳯरि᭭थितक पयᭅटन महायोजना पयᭅटन िवभाग, महारा᭬ ᮝ सरकार ᳇ारा राज᭭ व और वन िवभाग, महारा᭬ ᮝ सरकार के परामशᭅ से तैयार होगी । (ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂग,े अथाᭅत ्:-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के संबंिधत पयᭅटकᲂ के अ᭭ थायी िनवास के िलए आवासन के िसवाय पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और ᳯरसाटᭅ के नए संिनमाᭅण गौटाला अᮢम व᭠ यजीव अभयार᭛ य कᳱ सीमा के 1 ᳰकलोमीटर के भीतर अन᭄ुात नहᱭ हᲂगे ;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया जाएगा ।
(4) नैसᳶगक िवरासत.—पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ पᳯररिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थल.—पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण.—पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या महारा᭬ ᮝ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ के अनुसार पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, 2000 अंतगᭅत तैयार करेगा ।
(7) वाय ुᮧदषूण.—पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या महारा᭬ ᮝ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(8) बिह᮲ाव का िन᭭सारण.—पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥.—ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶग े;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट.—पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना जी.एस. आर 343(अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) ᭡लाि᭭टक अपिश᳥ ᮧबधंन.—पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना जी.एस.आर. 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(12) िनमाᭅण और िव᭟वसं अपिश᳥ ᮧबधंन.—पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना जी.एस.आर. 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(13) यानीय पᳯरवहन.—पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंग ेऔर आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(14) औ᳒ोिग क ईकाईया.ं— (क) पाᳯरि᭭थितक संवेदी जोन के भीतर नए का᳧ आधाᳯरत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा िविध के अनुसार ᭭थािपत िव᳒मान का᳧ आधाᳯरत उ᳒ोगᲂ के िसवाए नहᱭ दी जाएगी । (ख) ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वायु या मृदा ᮧदषूण काᳯरत करने वाले ᳰकसी नए उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अन᭄ुा नहᱭ दी जाएगी ।
4. पाᳯरि᭭थितक सवंदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सचूी.—पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂग ेऔर नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत ्:— 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप :
1. वािणि᭔यक खनन । (क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न ेकᳱ इकाइयां ᮧितिष हᲂगी । तथािप, वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेल ूआव᭫यकताᲐ के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइ᭨स या टᲂ का िनमाᭅण करना िव᳒मान िविनयमᲂ के अनसुार अनु᭄ात हᲂगे । (ख) खनन संᳰᮓयाए,ं माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमलूपाद बनाम भारत सरकार के मामल े मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामल ेमᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के अनसुरण मᱶ सवᭅथा हᲂगे ।
2. नए उ᳒ोगᲂ के कारण ᮧदषूण (जल, वाय,ु िमᲵी, ᭟विन, आᳰद) कᳱ ᭭थापना। कोई नई या पाᳯरि᭭थितकᳱ सवेंदनशील ᭃेᮢ मᱶ ᮧदषूण फैलाने वाल े उ᳒ोगᲂ के िव᭭तार कᳱ अनमुित दी जाएगी। हᳯरत या ᳡ते कृिष आधाᳯरत लघु उ᳒ोगᲂ सिहत के᭠ᮤीय ᮧदषूण िनयंᮢ ण बोडᭅ वगᱮकरण के ᱨप मᱶ वगᱮकृत उ᳒ोगᲂ को िनयमᲂ के अनसुार िविनयिमत ᳰकया जाएगा।
3. नए बृहत जल िव᳒ुत पᳯरयोजनᲂ कᳱ ᭭थापना । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
4. ᳰकसी पᳯरसकंटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
5. ᮧाकृितक जलाशयᲂ या सतही ᭃेᮢ मᱶ अनपुचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
6. कंपिनयᲂ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़ े पैमाने पर वािणि᭔यक पशुᲐ और पो᭨ᮝी फामᲄ कᳱ ᭭थापना । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
7. आरा मीलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई या िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
8. जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनसुार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । िविनयिमत ᳰᮓयाकलाप
9. होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितक अनकूुल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे : पर᭠तु व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक सवेंदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱧप होगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
10. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ रा᳦ीय पाकᭅ कᳱ सीमा से 1 ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार के नए वािणि᭔यक संिनमाᭅण को अनु᭄ात नहᱭ ᳰकया जाएगा: परंतु ᭭ थानीय ᭪ यि तयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण िजसके अतंगᭅत पैरा 3 मᱶ सूचीब ᳰᮓयाकलाप भी ह,ᱹ को करने के िलए अनु᭄ात ᳰकया जाएगा : पर᭠तु यह और ᳰक ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोगᲂ से संबंिधत संिनमाᭅण ᳰᮓयाकलापᲂ को लागू िनयमᲂ और िविनयमᲂ के अनसुार, यᳰद कोई हᲂ सᭃम ᮧिधकारी कᳱ पवूᭅ अनु᭄ा स े िविनयिमत ᳰकया जाएगा और ᭠ यनूतम पर रखा जाएगा । (ख) एक ᳰकलोमीटर से परे आंचिलक महायोजना के अनुसार िविनयिमत ᳰकया जाएगा।
11. ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन से गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग कृिष, पु᭬ प कृिष, उ᳒ान कृिष, या कृिष आधाᳯरत उ᳒ोग दशेीय माल स े औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालत ेह ᱹअनु᭄ात हᲂगे ।
12. वायु ᮧदषूण । पाᳯरि᭭थितक संवेदी जोन मᱶ, वाय ु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग ᮧदषूण िनयंᮢण बोडᭅ वाय ु(ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
13. ᭟विन ᮧदषूण । पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या महारा᭬ ᮝ रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ᭟विन ᮧदषूण (िविनयमन और िनयंᮢ ण) िनयमᲂ के अनुसार पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, 2000 अतंगᭅत तयैार करेगा ।
14. बिह᮲ाव का िन᭭सारण । पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनसुार होगा ।
15. ईट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार िविनयिमत (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
16. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनमुित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत केᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनसुार िविनयिमत होगी ।
17. वन उ᭜पादᲂ और गैर-का᳧ वन उ᭜पादᲂ (एन टी एफ पी) का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
18. िव᳒ुत और दरूसंचार टावरᲂ और िबछाई गई केबलᲂ और अ᭠य बुिनयादी ढाँचᲂ का पᳯरिनमाᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे और भूिमगत केबलᲂ को ᮧो᭜सािहत ᳰकया जा सकेगा ।
19. नागᳯरक सुिवधाᲐ सिहत बुिनयादी ढांचे । लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
20. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण । लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
21. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ, हलेीका᭡टर, ᮟोन, आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना जसैे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
22. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
23. रािᮢ मᱶ यािनक यातायात का सचंलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
24. ᭭थानीय समदुायᲂ ᳇ारा लाई जा रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । ᭭थानीय लोगᲂ के उपयोग के लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । लागू िविधयᲂ के अनसुार अनपुचाᳯरत बिह᮲ाᭅव का िन᭭सारण िविनयिमत हᲂगे ।
26. वािणि᭔यक सतह और भूिमगत जल कᳱ िनकासी । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. खुले कुआ, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ सती स े मानीटरी कᳱ जाएगी।
28. ठोस अपिश᭬ ट ᮧबंधन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
29. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
30. पाᳯरि᭭थितक पयᭅटन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
31. पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
32. वािणि᭔ यक साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । सवंᳶधत ᳰᮓयाकलाप
33. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
34. जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
35. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
36. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह।ᱹ सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
37. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । जैव गैस, सौर ᮧकाश आᳰद को बढावा दनेा होगा ।
38. कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
39. कौशल िवकास । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
40. िन᳜ीकृत भूिम या वन आवास कᳱ बहाली । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।

5. मानीटरी सिमित.—(1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत ्:-
(i) िजला कले टर, औरंगाबाद —अ᭟ यᭃ;
(ii) िजला कले टर का ᮧितिनिध, जलगांव —सद᭭ य;
(iii) िजला पᳯरषद का ᮧितिनिध, औरंगाबाद —सद᭭य;
(iv)
(v)
(vi) िजला पᳯरषद का ᮧितिनिध, जलगांव राज᭭ व िवभाग का ᮧितिनिध, महारा᭬ ᮝ सरकार पयाᭅवरण (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ का महारा᭬ ᮝ रा᭔य सरकार ᳇ारा ᮧ᭜ येक मामले मᱶ तीन वषᭅ कᳱ अविध के िल ए नामिन᳸द᳥ एक ᮧितिनिध - —सद᭭य; —सद᭭ य; —सद᭭ य;
(vii) पाᳯर ि᭭ थ ित क और पयाᭅवरण के ᭃेᮢ मᱶ महारा᭬ ᮝ रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक िवशेष᭄ —सद᭭य;
(viii) महारा᳦ रा᭔य जैव िविवधता बोडᭅ के सद᭭य सिचव / सद᭭य —सद᭭य;
(ix) ᭃेᮢीय अिधकारी, महारा᳦ रा᭔य ᮧदषूण िनयंᮢण बोडᭅ —सद᭭य;
(x) ᭔ ये᭬ ठ नगर योजना अिध कारी —सद᭭य;
(xi) उप वन संरᭃक, व᭠ यजीव औरंगाबाद ᮧभाग —सद᭭य;
(xii) उप वन संरᭃक, जलगांव ᮧभाग —सद᭭य;
(xiii) उप वन संरᭃक, औरंगाबाद ᮧभाग —सद᭭य सिचव । िनदᱷश िनबधंन :
(1) मािन टरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी और मानीटरी सिमित कᳱ अविध तीन वषᭅ कᳱ होगी ।
(2) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸द᭬ ट ᮧितिष गितिविधयᲂ के िसवाय आन ेवाले ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(3) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै और जो पाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।

(5) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहत े ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपन ेिवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(6) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠य जीव वाडᭅन को उपाबधं IV मᱶ उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।
(7) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपन े कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए ऐसे िनदेश दे सकेगा, जो वह ठीक समझे ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 9th December, 2016 S.O. 3996(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 1558(E), dated the 12th June 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said notification were made available to the public on the 12th June 2015; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification; AND WHEREAS, the Gautala Autramghat Wildlife Sanctuary is situated in Aurangabad and Jalgaon Districts of Maharashtra between 20o 14’ 00” to 20o 27’ 29.787” North Latitude and 74o 53’ 30.782” to 75o 16’ 40” East Longitude and extends over an area of 260.61 square kilometres; AND WHEREAS, the Gautala Autramghat Wildlife Sanctuary is an important conservation unit in Aurangabad and Nashik region of Maharashtra State and harbours more than 30 species of mammal including schedule I species like Wolf (Canis lupus pallipes), Leopard (Panthera pardus), Sloth Bear (Melursus ursinus), Black Buck (Antilope cervicapra), Four Horned Antelope (Tetracerus quadricornis), more than 210 species of birds including 20 species of migratory status and a variety of reptiles, amphibians, fishes etc; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Gautala Autramghat Wildlife Sanctuary as Ecosensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and process in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986), read with sub- rule
(3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of up to one kilometer from the boundary of Gautala Autramghat Wildlife Sanctuary in the State of Maharashtra as the 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Gautala Autramghat Wildlife Sanctuary Eco- sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.—(1) The Eco-Sensitive Zone is spread over an area of 483.45 square kilometres with an extent of up to one kilometre from the boundary of Gautala Autramghat Wildlife Sanctuary and the boundary description of the said Zone is given in Annexure I.
(2) The Eco-sensitive Zone is spread across 70 villages in Aurangabad and Jalgaon Districts in Maharashtra.
(3) The list of the villages falling within Eco-sensitive Zone is appended as Annexure II.
(4) The map of the Eco-sensitive Zone along with latitudes and longitudes is appended as Annexure III.
2. Zonal Master Plan for Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for consideration and approval of the State Government.
(2) The Zonal Master Plan so prepared shall be commensurate with the stipulation specified in this notification and include the environmental implications.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj ;
(xi) Public Works Department.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with supporting maps; the Zonal Master Plan shall be supported by Maps giving details of existing and proposed land use features.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development for livelihood security of local communities.
(9) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification.
3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:— ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19
(1) Land use.—Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 9,11, 20, 33 and 36 in column (2) of the Table in paragraph 4, namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities;
(ii) small scale industries not causing pollution;
(iii) widening and strengthening of existing roads;
(iv) rainwater harvesting; and
(v) cottage industries including village artisans:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or restrict development activities within the catchment areas.
(3) Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Maharashtra in consultation with Department of Revenue and Forests, Government of Maharashtra.
(c) The activities of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Ecosensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometre from the boundary of the Gautala Autramghat Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to ecofriendly tourism activities.
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefact areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(6) Noise pollution.—The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
(7) Air pollution.— The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.
(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder.
(9) Solid waste.—Disposal of solid waste shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016, as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid waste into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical wastes.—The Bio-Medical waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343(E), dated the 28th March, 2016, as amended from time to time.
(11) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) Vehicular traffic .—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Act and the rules and regulations made thereunder.
(14) Industrial units.—
(a) No establishment of new wood based industries within the Eco-sensitive zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil or noise pollution within the proposed Ecosensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- TABLE Sl. Commercial mining (a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No. 202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No. 435 of 2012.
2. Setting of new industries causing pollution (water, air, soil, noise, etc.). No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted. Industries categorised as Green or White in the Central Pollution Control Board Classification including agro-based small scale industries, shall be regulated as per regulations.
3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws
6. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies. Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
7. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
8. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. Regulated Activities
9. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the protected area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
10. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the protected area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph
(1) of paragraph 3 as per building byelaws:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre, it shall be regulated as per the Zonal Master Plan.
11. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority. 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
12. Air pollution. Regulations for the control of air pollution in the Eco-sensitive Zone shall be in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
13. Noise pollution. The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
14. Discharge of effluents. The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made thereunder.
15. Setting up of brick kilns. Regulated (except as otherwise provided) as per applicable laws
16. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
17. Collection of forest produce or Non- Timber Forest Produce (NTFP). Regulated under applicable laws.
18. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable law and underground cabling may be promoted.
19. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
20. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
21. Under taking other activities related to tourism like over flying the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated under applicable law.
22. Protection of hill slopes and river banks Regulated under applicable laws.
23. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
24. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals.
25. Discharge of treated effluents in natural water bodies or land area. The discharge of treated effluent shall be regulated as per applicable laws.
26. Commercial extraction of surface and ground water. Regulated under applicable law.
27. Open well, bore well etc. for agriculture or other usage. Regulated and the activity shall be strictly monitored by the appropriate authority.
28. Solid waste management. Regulated under applicable laws.
29. Introduction of exotic species. Regulated under applicable laws.

5. Monitoring Committee.—The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification comprising of the following, namely:-
(i) District Collector, Aurangabad —Chairman;
(ii) representative of District Collector, Jalgaon —Member;
(iii) representative of Zilla Parishad, Aurangabad —Member;
(iv) representative of Zilla Parishad, Jalgaon —Member;
(v) representative of Department of Revenue, Government of Maharashtra —Member
(vi) a representative of Non-governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Maharashtra for a period of three years —Member;
(vii) one expert in the area of ecology and environment to be nominated by the Government of Maharashtra —Member;
(viiii) Member- Secretary or Member of the Maharashtra State Biodiversity Board —Member;
(ix) Regional Officer, Maharashtra State Pollution Control Board, —Member;
(x) Senior Town Planning Officer —Member;
(xi) Deputy Conservator of Forests, Wildlife Aurangabad Division —Member;
(xii) Deputy Conservator of Forests, Jalgaon Division —Member;
(xiii) Deputy Conservator of Forests, Aurangabad Division —Member-Secretary. Terms of reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification and the tenure of the Committee shall be for a period of three years.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4
31. Use of polythene bags. Regulated under applicable laws.
32. Commercial sign boards and hoardings. Regulated under applicable laws. Promoted Activities
33. Rain water harvesting. Shall be actively promoted.
34. Organic farming. Shall be actively promoted.
35. Adoption of green technology for all activities. Shall be actively promoted.
36. Cottage industries including village artisans, etc. Shall be actively promoted.
37. Use of renewable energy. Bio gas, solar light, etc. to be actively promoted
38. Agro-forestry. Shall be actively promoted.
39. Skill development. Shall be actively promoted.
40. Restoration of degraded land/ forests/ or habitat. Shall be actively promoted.
41. Environmental awareness. Shall be actively promoted.
42. Community Nature Reserves. Shall be actively promoted. 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
