और,और,और,और, �ा प अिधसूचना के उ@र म� /ि0य1 और पणधा$रय1 से कोई भी आ<ेप और सझुाव �ाA नह: Bए; और,और,और,और, यह तिमलनाडु िजले के रामानाथापुरम Cाम के कांिजरंकुलम का भाग ह।ै कांिजरंकुलम प<ी अभयारDय तिमलनाडु के रामानाथापुरम िजला म� अ<ांश 9°21’उ और दशेांतर 078°30’ पू के बीच िFथत ह ैऔर <े� 1.0421 वग �कलोमीटर (104.21 हIेटेयर) म� फैला Bआ ह।ै वष 1989, म� कांिजरंकुलम <े� को प<ी अभयारDय के ?प म� घोिषत �कया गया था, िजसका अनुमािनत <�े क&ला कंिजरंकुलम म� 66.66 हIेटेयर और मेला कंिजरंकुलम म� 37.55 हIेटेयर ह।ै इसे जल िनकाय1 म� रहने वाली पि<य1 के संर<ण के िलए तारीख 21.09.89 के सा. आ. एमएस संMया 684 पया वरण और वन िवभाग (एफ आर वी) के )ारा व6यजीव संर<ण अिधिनयम, 1972 क& धारा 18 (1) के अथ और प$रिध के अधीन एक अभयारDय के प म� अिधसूिचत �कया गया ह ैऔर जो तारीख 28.10.89 को राजप� भाग II म� पृY स.ं 774 पर द8ृ/ ह;ै औरऔरऔरऔर,,,, िविभZ �कार के �वासी प<ी भोजन के िलए कई दशे1 स ेआते ह[। 43 �जाितय1 से संबंिधत 4500 पि<य1 को /Fततम अविध के दौरान सूचीब\ �कया गया ह ैऔर मह]वपूण पि<य1 म� सफेद इिबस, 9लैक इिबस, ओपन-िब�ड Fटॉक , इCेट, मैना, टी�स, बतख, डाट र, बगुला, पेिलकन आ�द शािमल ह[। कंिजरंकुलम प<ी अभयारDय पु`प और जीवजंतु क& िविवधता के िलए सबसे बड़ा पया वास ह ैऔर संकटापZ �जाितय1 जैस ेपेिलकन, प�टेड Fटोक , यूरेिशयन Fपून िबल, aहाइट इिबस, डाट र, bलेcमंगो और पानी के पि<य1 जैस े�क सामा6य कुट, िपन टेल, गग नी, इCेट, कॉमdर�ट, 9लकै cवंगड िFट�ट, eकंग �फशर, सामा6य मैना, fाहिमनी काईट, Fपॉटेड ओवलेट आ�द ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] औरऔरऔरऔर,,,, अभयारDय �जनन और भोजन के िलए घ1सले बनाने और भोजन आचरण म� काफ& िविवधता के साथ शीतकालीन �वासी पि<य1 के िलए आदश पया वास �दान करता ह।ै यह दि<ण भारत म� हरेोनरी �जाितय1 और औपिनवेिशक पि<य1 �वासी के िलए घ1सले बनने का एक मुMय Fथल ह।ै अभयारDय म� पंख वाले प<ी अ0ूबर से फरवरी तक आते ह।ै आh भिूम गहराई म� अिनयिमत ह ैऔर य�द वषा सामा6य ह,ै तो 3 से 5 महीने तक जल ?का रहता ह।ै सफल �बंधन उपाय करने से िविवध �जनन �जाितय1 और शीतकालीन �जाितय1 को िविवधता म� वृि\ करने के िलए आक7ष त �कया जाएगा जो बदले म� अिधक पय टक1, प<ीिवद1 और छा�1 को आक7ष त करेगा। पि<य1 को दखेने के िलए अभयारDय का दौरा करने का सबसे अkछा समय नवंबर-जनवरी ह ैजब पि<य1 क& सMंया और �जाित क& िविवधता उlतम होती ह।ै अभयारDय मूल ?प से cसंचाई ट[क ह ैिजसका उपयोग अ0ूबर से जनवरी तक पूवd@र मानसून )ारा $रचाज �कए गए कृिष के िलए जल भंडारण के िलए �कया जाता ह।ै ट[क माच से अगFत तक पूरी तरह सूख जाता ह;ै औरऔरऔरऔर,,,, अभयारDय मलू ?प से cसंचाई ट[क ह,ै यहां अभयारDय के अंतग त कोई �ाकृितक वन नह: ह।ै वन िवभाग )ारा बबूल (अकैिशया िनलो�टका) बगान1 को Fथािपत �कया जाता ह।ै ट[क बांध और फोरशोरे म� अ6य �मुख वनFपित 6यू$रवी (आचाथेश ए�पेरा एल.), पानाई (बोरासस �लैबेिलफर एल.), इ Iकु (कैलो�ोिपस िगगांटे (एल.) आर.बीआर.), अवराम, अवाराई (से�ा ऑ�रकुलटाटा (एल.) रो�सब.), पुिलआ मरम (तामा�रंडस इंिडका एल.), नाई कदगुु, नाई वालाई (ि�लयोम िव�कोसा एल.), नटवादमुई, नाmटु बादाम (ट#म$निलए कट%पा एल.) आ�द ह।ै अभयारDय म� cसंचाई ट[क होने के कारण बBत ही कम जीवजंतु �जाितयां (प<ी-जीव को छोड़कर) ह[ िजसम� (एIसेnट अिवफना) भारतीय Cे नेवला (हरेपू�टेस इडवारद)े, भारतीय पाम िगलहरी (फना(बुलुस प)मा*म), िसयार (कैिनस ऑ�रयस), 9लैक-नैपेड हरे (लेपुस िनग�रकोि)लस) और ब[डीकूट रैट (बंदीकोटा ब,गाल,िसस) आ�द शािमल ह[; और,और,और,और, कािंजरंकुलम प<ी अभयारDय के चार1 ओर के <े� को, िजसका िवFतार और सीमाएं पा$रिFथितक& पया वरणीय से पा$रिFथितक& संवेदी जोन के ?प म� पैरा 1 म� िविनzद 8 ह[, जैव िविविधता क& दिृ8 सरुि<त और संरि<त करना और उ0 पा$रिFथितक& संवेदी जोन म� उ{ोग1 या उ{ोग1 के वग| के �चालन और �संFकरण करने को �ितिष\ करना आव}यक ह;ै अतःअतःअतःअतः,,,, अब, के6hीय सरकार, पया वरण (संर<ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प$ठत पया वरण (सरं<ण) अिधिनयम, 1986 (1986 का 29) (िजसे इस अिधिनयम म� इसके प�ात पया वरण अिधिनयम कहा गया ह)ै क& धारा 3 क& उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) )ारा �द@ शि0य1 का �योग करते Bए, तिमलनाडु रा�य म� कांिजरंकुलम प<ी अभयारDय क& सीमा के चार1 ओर 0.05 �कलोमीटर से 1.30 �कलोमीटर तक िवF ता$रत <े� कांिजरंकुलम प<ी अभयारDय को पा$रिFथितक& संवेदी जोन (िजसे इसम� इसके प} चात् पा$रिFथितक& संवेदी जोन कहा गया ह)ै, के ?प म� अिधसिूचत करती ह,ै िजसके िववरण िन�ानुसार ह,ै अथा त्:- ¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 3 1.1.1.1. पा रि�थितक�पा रि�थितक�पा रि�थितक�पा रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर उसक�उसक�उसक�उसक� सीमाएंसीमाएंसीमाएंसीमाएं....-(1) पा$रिFथितक& संवेदी जोन का िवFतार कांिजरंकुलम प<ी अभयारDय के चार1 ओर 0.05 �कलोमीटर स े1.30 �कलोमीटर तक िवFतृत ह।ै पा$रिFथितक& संवेदी जोन का <े� 3.90 वग �कलोमीटर ह।ै (2) पा$रिFथितक& संवेदी जोन क& सीमा का वण न उपाबंधउपाबंधउपाबंधउपाबंध----I I I I के ?प म� उपाब\ ह।ै (3) पा$रिFथितक& संवेदी जोन का सीमांकन करने वाले संरि<त <े� के मानिच� उपाबंधउपाबंधउपाबंधउपाबंध––––IIIIIIIIकककक----ङङङङ म� �दए गए ह।ै (4) पा$रिFथितक& संवेदी जोन और संरि<त <े� क& सीमा के भू िनदsशांक1 क& सूची उपाबंध उपाबंध उपाबंध उपाबंध IIIIIIIIIIII क& सारणीसारणीसारणीसारणी �मश�मश�मश�मश:::: (कककक) ) ) ) और और और और ((((खखखख)))) म� दी गई ह।ै (5) मुMय cबंद�ु के भू-िनदsशांक1 के साथ पा$रिFथितक& संवेदी जोन के अंतग त आने वाले Cाम1 क& सूची उपाबंधउपाबंधउपाबंधउपाबंध IVIVIVIVके ?प म� उपाब\ ह।ै 2222.... पा रि�थितक�पा रि�थितक�पा रि�थितक�पा रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आंचिलकआंचिलकआंचिलकआंचिलक महायोजनामहायोजनामहायोजनामहायोजना–––– (1) रा�य सरकार, पा$रिFथितक& संवेदी जोन के �योजन1 के िलए राजप� म� इस अिधसूचना के �काशन क& तारीख से दो वष क& अविध के भीतर, Fथानीय /ि0य1 के परामश स ेऔर रा�य के स<म �ािधकारी के अनुमोदन के िलए इस अिधसूचना म� �दए गए अनुबंध1 का पालन करते Bए आंचिलक महायोजना तैयार करेगी। (2) रा�य सरकार )ारा पा$रिFथितक& संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित से जो इस अिधसूचना म� िविनzद ̀ ट �कए गए ह[ के अनुसार तथा ससंुगत क� hीय और रा� य िविधय1 के अनु प और क� hीय सरकार )ारा जारी माग िनदsश1, य�द कोई ह1, )ारा तैयार होगी । (3) आंचिलक महायोजना, उ0 योजना म� पा$रिFथितक& और पया वरणीय बात1 को समाकिलत करने के िलए रा� य सरकार के िन�िलिखत िवभाग1 के परामश से तैयार होगी, अथा त्:- (1) पया वरण; (2) वन और व6यजीव; (3) कृिष; (4) राजF व; (5) नगर िवकास; (6) पय टन; (7) Cामीण िवकास; (8) cसंचाई और बाढ़ िनयं�ण; (9) नगरपािलका; (10) पंचायती राज; (11) लोक िन मा ण िव भाग; (12) राजमाग ; और (13) तिमलनाडु रा�य �दषूण िनयं�ण बोड । (4) आंचिलक महायोजना अनुमो�दत िव{मान भ-ूउपयोग, अवसंरचना और ��याकलाप1 पर कोई िनब�धन अिधरोिपत नह: करेगी जब तक �क इस अिधसूचना म� इस �कार िविनzद ̀ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ��याकलाप1 म�, जो अिधक द<ता और पा$रिFथितक& अनुकूल ह1, का संवध न करेगी । (5) आंचिलक महायोजना म� अनाkछा�दत <े�1 के जीणd\ार, िव{मान जल िनकाय1 के संर<ण, आवाह <े�1 के �बंधन, जल-संभर1 के �बंधन, भूतल जल के �बंधन, मदृा और नमी सरं<ण, Fथानीय समुदाय1 क& आव}यकता� तथा पा$रिFथितक& और पया वरण से संबंिधत ऐसे अ6य पहल�ु, िजन पर �यान दनेा आव}यक ह,ै के िलए उपबंध ह1गे । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (6) आंचिलक महायोजना िव{मान और �Fतािवत भिूम उपयोग िवशेषता� के 9यौर1 से अनुसम7थ त मानिच� के साथ सभी िव{मान पूजा F थल1, Cाम1 और नगरीय बिFतय1, वन1 के �कार और �कF म1, कृिष <े�1, ऊपजाऊ भिूम, ह$रत <े� जैसे उ{ान और उसी �कार के F थान, उ{ान कृिष <े�, फलोउ{ान, झील1 और अ6य जल िनकाय1 का अ�यकंन करेगी। योजना को मानिच�1 म� �दए गए िव{मान तथा �Fतािवत भूिम उपयोग सुिवधा� के िववरण )ारा सम7थ त �कया जाएगा। (7) आंचिलक महायोजना पा$रिFथितक& संवेदी जोन म� िवकास को िविनयिमत करेगी और सारणी म� �ितिष\ और िविनयिमत ��याकलाप1 का अनुपालन करेगी और F थानीय समदुाय1 क& जीिवका को सुरि<त करने के िलए पा$रिFथितक& अनुकूल िवकास को सुिनि�त और उसक& अिभवृि\ भी करेगी। (8) आंचिलक महायोजना �ादिेशक िवकास योजना क& सह-िवFतारी होगी । (9) इस �कार अनुमो�दत आंचिलक महायोजना इस अिधसूचना के उपबंध1 के अनुसार मानीटरी के अपने काय| को करने के िलए मानीटर सिमित के िलए एक संदभ दFतावेज तैयार करेगी । 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय....---- रा�य सरकार इस अिधसूचना के उपबंध1 को �भावी करने के िलए िन�िलिखत उपाय करेगी, अथा त्:- (1) भूभभूूभू----उपयोगउपयोगउपयोगउपयोग....–––– (क) पा$रिFथितक& संवेदी जोन म� वन1, उ{ान कृिष <े�1, कृिष <े�1, मनोरंजन के �योजन1 के िलए िचि6हत �कए गए पाक| और खुल ेFथान1 का वािणि�यक या आवासीय या औ{ोिगक संब\ िवकास ��याकलाप1 के िलए उपयोग या संप$रवत न नह: होगा; परंतु यह �क पा$रिFथितक& संवेदी जोन के भीतर भाग (क) म� िविनzद 8 �योजन1 से िभZ �योजन के िलए कृिष और अ6य भिूम का संप$रवत न मानीटरी सिमित क& िसफा$रश पर और यथा लागू और <े�ीय नगर योजना अिधिनयम और के6hीय सरकार या रा�य सरकार के अ6य िनयम1 तथा िविनयम1 के अधीन स<म �ािधकारी के पूव अनुमोदन से, और इस अिधसूचना के उपबंध1 )ारा Fथानीय िनवािसय1 क& िन�िलिखत आवासीय आव}यकता� को पूरा करने के िलए अनु�ात �कया जाएगा, जैस:े- (i) िव{मान सड़क1 को चौड़ा करना और उ6ह� सुदढ़ृ करना तथा नई सड़क1 का संिनमा ण; (ii) बुिनयादी ढांच1 और नाग$रक सुिवधा� का संिनमा ण और नवीकरण; (iii) �दषूण उ]पZ न करने वाले लघ ुउ{ोग; (iv) कुटीर उ{ोग1 िजनके अतंग त Cामीण उ{ोग भी ह[; सुिवधाजनक भDडार और Fथानीय सुिवधाएं सहायक पा$रिFथितक& पय टन िजसके अ6तग त Cह वास सि�मिलत ह;ै और (v) पैरा 4 के अधीन �दए गए संव7ध त ��याकलाप: परंतु यह और �क �ादिेशक नगर योजना अिधिनयम और रा�य सरकार के अ6य िनयम1 और िविनयम1 के अधीन स<म �ािधकारी के पूव अनुमोदन और सिंवधान के अनुkछेद 244 के उपबंध1 या त]समय �वृ@ िविध के उपबंध1 के अनुपालन के िबना, िजसके अ6तग त अनुसूिचत जनजाित और अ6य परंपरागत वन िनवासी (वन अिधकार1 क& मा6यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि�यक या औ{ोिगक िवकास ��याकलाप1 के िलए जनजातीय भिूम का उपयोग अनु�ात नह: होगा: परंतु यह और भी �क पा$रिFथितक& संवेदी जोन के भीतर भू-अिभलेख1 म� उपसंजात कोई गलती, मानीटरी सिमित के िवचार �ाA करने के प�ात् रा�य सरकार )ारा �]येक मामल ेम� एक बार ठीक होगी और उ0 गलती के सुधार क& सूचना क� hीय सरकार के पया वरण, वन और जलवायु प$रवत न मं�ालय को दी जाएगी: परंतु यह और भी �क गलती के संशोधन म� इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म� भू-उपयोग का प$रवत न सि�मिलत नह: होगा; (ख) वनीकरण तथा वास जीणd\ार ��याकलाप1 सिहत अन�युI त या अनु] पादक कृिष <े�1 म� पुन: वनीकरण करने के �यास �कए जाएंगे। (2) ाकृितक ाकृितक ाकृितक ाकृितक जल जल जल जल "ोत$"ोत$"ोत$"ोत$....- आचंिलक महायोजना म� सभी �ाकृितक जल �ोत1/न�दय1/ जलमाग| के आवाह <े�1 क& पहचान क& जाएगी और उनके संर<ण और नवीकरण के िलए योजना सि� मिलत होगी और रा� य सरकार )ारा ऐसे <े�1 पर या उनके ¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 5 िनकट िवकास ��याकलाप �ितिष\ करने के बारे म� जो ऐसे <े�1 के िलए अिहतकर हो ऐसी रीित से माग दश क िस\ातं तैयार �कए जाएंगे । (3) पय�टनपय�टनपय�टनपय�टन यायायाया पा रि�थितक�पा रि�थितक�पा रि�थितक�पा रि�थितक� पय�टनपय�टनपय�टनपय�टन....---- (क) पा$रिFथितक& सवेंदी जोन के भीतर सभी नए पा$रिFथितक& पय टन ��याकलाप या िव{मान पय टन ��याकलाप1 का िवFतार पय टन महायोजना के अनुसार पा$रिFथितक& संवेदी जोन के िलए होगा; (ख) पा$रिFथितक& पय टन महायोजना रा�य पय टन िवभाग )ारा रा�य पया वरण और वन िवभाग के परामश स ेतैयार होगी; (ग) पय टन महायोजना आंचिलक महायोजना के एक घटक के ?प म� होगी; (घ) पय टन महायोजना पा$रिFथितक& संवेदी जोन क& वहन <मता के आधार पर तैयार क& जाएगी; (ii) पा$रिFथितक& संवेदी जोन के भीतर नए पय टन ��याकलाप1 या िव{मान पय टन ��याकलाप1 का िवFतार क� hीय सरकार के पया वरण, वन और जलवायु प$रवत न मं�ालय के माग दश क िस\ांत1 के )ारा तथा रा` �ीय a या� संर<ण �ािधकरण, )ारा जारी पा$रिFथितक&–पय टन, पा$रिFथितक&-िश<ा और पा$रिFथितक&-िवकास पर बल दतेे Bए (समय-समय पर यथा संशोिधत) जारी माग दश क िस\ांत1 के अनुसार होगा; (iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक, पय टन के िलए िवकास और िव{मान पय टन ��याकलाप1 के िवFतार को वाFतिवक Fथल िविनzद 8 संवी<ा और मानीटरी सिमित क& िसफा$रश पर आधा$रत संबंिधत िविनयामक �ािधकरण1 )ारा अनु�ात �कया जाएगा और पा$रिFथितक& संवेदी जोन के भीतर �कसी नये होटल या $रसोट या वािणि�यक Fथापना का संिनमा ण अनु�ात नह: �कया जायेगा । (4) नैस'ग�नैस'ग�नैस'ग�नैस'ग�कककक िवरासतिवरासतिवरासतिवरासत....---- पा$रिFथितक& संवेदी जोन म� मह]वपूण नैस7ग क िवरासत के सभी Fथल1 जैसे जीन कोश आरि<त <े�, शैल िवरचनाएं, जल �पात1, झरन1, घाटी माग|, उपवन1, गुफाएं, Fथल1, �मण, अ�रोहण, �पात1 आ�द क& पहचान क& जाएगी और िवरासत संर<ण योजना आंचिलक महायोजना के भाग के प म� प$रर<ण और संर<ण के िलए तैयार क& जाएगी। (5) मानव िन'म�त िवरासत � थमानव िन'म�त िवरासत � थमानव िन'म�त िवरासत � थमानव िन'म�त िवरासत � थलललल....---- पा$रिFथितक& संवेदी जोन म� भवन1, संरचना�, िश�प-त�य, ऐितहािसक, Fथाप]य, स�दय पूरक और सांFकृितक मह]व के <े�1 क& और उप<े�1 क& पहचान और उनके संर<ण के िलए िवरासत योजना आंचिलक महायोजना के भाग के प म� तैयार क& जाएगी। (6) )विन)विन)विन)विन दषूण दषूण दषूण दषूण....– तिमलनाडु रा�य सरकार का पया वरण िवभाग या रा� य �दषूण िनयं�ण बोड , पया वरण (संर<ण) अिधिनयम, 1986 और उसके संशोधन1 के अधीन बन े�विन �दषूण (िविनयम और िनयं�ण) िनयम, 2000 के िनयत उपबंध1 के अनुसार पा$रिFथितक& संवेदी जोन म� �विन �दषूण के िनयं�ण के िलए िविनयम1 को लागू करेगा। (7) वायुवायुवायुवायु दषूण दषूण दषूण दषूण....- पा$रिFथितक& संवेदी जोन म�, वायु �दषूण के िनवारण और िनयं�ण का वायु (�दषूण िनवारण और िनयं�ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम1 के उपबंध1 के अनुसार अनुपालन �कया जाएगा। (8) बिह"ावबिह"ावबिह"ावबिह"ाव काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण....- पा$रिFथितक& संवेदी जोन म� उपचा$रत बिह�ाव का िनFसारण, साधारण मानक1 के उपबंध1 के अनुसार पया वरण (संर<ण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयम1 के अधीन आने वाले पया वरणीय �दषूण के िनFसारण के िलए साधारण मानक1 या रा�य सरकार )ारा िनयत मानक1, जो भी अिधक कठोर हो, के उपबंध1 के अनुसार होगा। (9) ठोसठोसठोसठोस अपिश0अपिश0अपिश0अपिश0....---- ठोस अपिश8 का िनपटान और �बंधन िन�ानुसार �कया जाएगा:- (क) पा$रिFथितक& संवेदी जोन म� ठोस अपिश8 का िनपटान और �बंधन भारत सरकार के पया वरण, वन और जलवायु प$रवत न मं�ालय क& अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अ�ैल, 2016 )ारा �कािशत ठोस अपिश8 �बंधन िनयम, 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 2016 के उपबंध1 के अनुसार �कया जाएगा। अकाब िनक पदाथd का िनपटान पा$रिFथितक& संवेदी जोन से बाहर िचि6हत �कए गए Fथान1 पर पया वरण-अनुकूल रीित से �कया जाएगा; WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 12th July 2018;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification;
AND WHEREAS, It is a part of Kanjirankulam Village of Ramanathapuram District of Tamil Nadu.
The Kanjirankulam Birds Sanctuary lies between Latitude 9°21’N and 078°30’E Longitude in the Ramanathapuram District of Tamil Nadu and extends over an area of 1.0421sq. km. (104.21 ha). The Kanjirankulam area was declared as a bird sanctuary in the year 1989, with an estimated area of 66.66 Ha in Keela Kanjirankulam and 37.55 Ha in Mela Kanjirankulam. It is notified as a sanctuary within the meaning and scope of Section 18 (1) of Wildlife Protection Act 1972, through the G.O Ms. No 684, Environment and Forest Department (FRV) dated 21.09.89 and appeared in the Gazette Part II on Page No. 774 on 28.10.89 for the conservation of avian fauna that inhabit the water body;
AND WHEREAS, many of the different varieties of migratory birds arrive from various parts of countries for feeding purpose. About 4500 birds belonging to 43 species have been listed during the peak season and the important birds include, white ibis, black ibis, open-billed stork, egrets, mynas, teals, ducks, darters, herons, pelicans etc. The Kanjirankulam Bird Sanctuary is biggest resident for variety of floral and faunal diversity and has species richness of nearly threatened species such as Pelican, Painted stork, Eurasian Spoon bill, White ibis, Darter, Flamingo and water birds such as common coot, Pin tail, Garganey, Egrets, Cormorants, Black winged stilt, King fisher, Common myna, Brahminy kite, Spotted Owlet etc.;
AND WHEREAS, the sanctuary offers ideal habitat for winter migratory birds with considerable diversity in nesting and feeding behaviour for breeding and feeding. It is one of the preferred nesting sites for heronry species and colonial birds migrating to South India. The feathered visitors flock the sanctuary from October to February. The wetland is irregular in depth and retains water for 3 to 5 months, if rain is normal.
Envisaging successful management measures will attract more breeding species and wintering species to enhance the diversity which in turn will attract more tourists, birdwatchers and students. The best time to visit the sanctuary for bird watching is November-January when bird population and species diversity is at the highest. The sanctuary is basically an irrigation tank that is used for storing water for agriculture recharged by the northeast monsoons from October till January. The tank remains completely dry from March to August;
AND WHEREAS, as the sanctuary is basically an irrigation tank, there is no natural forest within the sanctuary. Babul (Acacia nilotica) plantations were raised by the Forest Department. The other major flora in the tank bunds and foreshore are Nayurivi (Achyranthes aspera L.), Panai (Borassus flabellifer L.), Erukku (Calotropis gigantea (L.) R.Br.), Avaram, Avaarai (Senna auriculata (L.) Roxb.), Puliya maram (Tamarindus indica L.), Nai kadugu, Nai vaelai (Cleome viscosa L.), Natvadumai, Naattu badaam (Terminalia catappa L.)
etc. The sanctuary being an irrigation tank has very less faunal species (except Avifauna) such as Indian grey mongoose (Herpestes edwardsii), Indian palm squirrel (Funambulus palmarum), Jackal (Canis aureus), Black-naped Hare (Lepus nigricollis) and Bandicoot rat (Bandicota bengalensis) etc.;
AND WHEREAS, the sanctuary has variety of birds, butterflies, insects, reptiles and amphibians.
Example of birds are Little grebe (Tachybaptusruficollis), Spot-billed pelican (Pelecanusphilippensis), Little cormorant (Phalacrocoraxniger), Great cormorant (Phalacrocoraxcarbo), Darter (Anhinga melanogaster) etc;
some examples of reptiles are House gecko (Hemidactylus frenatus), Spotted indian gecko (Hemidactylus brookii), Garden lizard (Calotes versicolor), Monitor lizard (Varanus bengalensis), Common indian skink(Eutrophis carinata) etc. and Common indian toad (Duttaphrynus melanostictus), Ornate narrow mouthed frog (Microhyla ornate),Common skittering frog (Euphlyctis cyanophlyctis) etc.;

The rare species recorded in the sanctuary are Great cormorant (Phalacrocorax carbo), Purple heron (Ardea cinerea), Yellow bittern (Lxobrychus sinensis), Chestnut bittrem (Lxobrychus cinnamomeus), Black bittern (Dupetor flavicollis), Comb duck (Sarkidiornis melanotos), Northern shoveller (Anas clypeata),Common teal (Abas crecca)etc.;
AND WHEREAS, the landscape is mainly agrarian and the economy of the village is primarily dependent on agriculture. However, water stress and prolonged periods of drought has driven the villagers to pursue other sources of livelihood like working as porters (coolies). As a consequence, a high rate of migration has also been observed in the surrounding areas in tune with the profile of the district. Livestock rearing such as goats, sheep, cow and poultry also supports the economy of the village. Few villagers are also engaged in manufacturing charcoal to supplement their income during the lean season of agriculture.;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Kanjirankulam Bird Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from 0.05 kilometres to 1.30 kilometres around the boundary of Kanjirankulam Bird Sanctuary in the State of Tamil Nadu as the Kanjirankulam Bird Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:—
1. Extent and boundaries of Eco-sensitive Zone. - (1) The extent of Eco-sensitive Zone varies from
0.05 kilometers to 1.30 kilometers around the Kanjirankulam Bird Sanctuary. The area of the Eco-Sensitive Zone is 3.90 square kilometers.
(2) The boundary description of the Eco Sensitive Zone is appended at Annexure I.
(3) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure IIA-E.
(4)List of geo co-ordinates of the boundary of the Protected Area and the Eco-Sensitive Zone is at Annexure III Tables (A) and (B) respectively.
(5) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure IV.
2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of effective management of the Eco-Sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of Final Notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this Notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating environmental and ecological considerations into the said plan:
(1) Environment;
(2) Forest and Wildlife;
(3) Agriculture;
(4) Revenue ;
(5) Urban Development;
(6) Tourism;

(7) Rural Development;
(8) Irrigation and Flood Control;
(9) Municipal;
(10) Panchayati Raj;
(11) Public Works Department;
(12) Highways; and
(13) Tamil Nadu State Pollution Control Board.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:—
(1) Land use. –
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities;
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given in paragraph 4;

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph;
(b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.—The catchment areas of all natural springs/rivers/channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3)Tourism/Eco-tourism.—(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone;
(b) the Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests;
(c) the Tourism Master Plan shall form a component of the Zonal Master Plan;
(d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone;
(e) the activities of eco-tourism shall be regulated as under, namely:—
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the protected area or up to the extent of the ESZ whichever is nearer.
However, beyond the distance of 1 km from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, ecoeducation and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.
(4) Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution.—The Environment Department of the State Government or Tamil Nadu State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.
(7) Air pollution.—Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made there under and amendments thereto.
(8) Discharge of effluents.—Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made there under or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes.—Disposal and Management of solid wastes shall be as under:
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste.—Bio-medical waste management shall be as under:
(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification Number GSR 343 (E), dated the 28th March,2016 as amended from time to time.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.—The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made there under.
(15) Vehicular Pollution.—Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units.—(i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone;

(ii) only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes: The protection of hill slopes shall be as under:
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone:
All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927) the Wildlife(Protection) Act 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:— TABLE Sl. (a) All new and existing mining(minor and major minerals) stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumalpad vs.. UOI in W.P. (C) No. 202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation z. UOI in W.P. (C) No. 435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc).
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area .

No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or up to the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or up to the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities.
(a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or up to extent of the Eco-sensitive Zone whichever is nearer:
(b) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents.
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations if any.
(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
10. Small scale non polluting industries.
Non polluting industries as per classification of industries issued by the central Pollution Control Board in February 2016 and non-hazardous, small scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Ecosensitive Zone shall be permitted by the competent authority.
11. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.
12. Establishment of large scale commercial live stock and poultry farms by firms, corporate, companies.
Regulated under applicable laws.
13. Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
14. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws. Underground cabling may be promoted.

5. Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), comprising of the following consisting of not more than ten members namely:- S. 5. A representative from State Public Works Department Member;
6. A representative from State Pollution Control Board Member;
7. Wildlife Warden, Gulf of Mannar Marine National Park, Ramanathapuram Member- Secretary.
6. Terms of Reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and ¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 29 are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per Performa given in Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.

GARKOTI, Scientist ‘G’ ANNEXURE- I BOUNDARY DESCRIPTION OF ECO-SENSITIVE ZONE OF THE PROTECTED AREA North Starts from the interception point of Pulvaykulam Kanmoi feeder channel and Gundar Channel. Thence the boundary travels in eastern direction along the Gundar Channel.
North East The boundary along the Gundar Channel meets a point at distance of 600 mts eastward of the sanctuary on the northern margin of Gundar Channel at a point where Ettiseri – Kadamangulam village road intercepts on the channel.
East Thence travels southwards along the Ettiseri – Kadamangulam village approach road.
South East The boundary travels along the Ettiseri village approach road and ends at a point of interception of Ettiseri village approach road on the Mudukalathur – Kamuthi road.
South The boundary travels south of Kanjirankulam Kanmoi along the Mudukalathur – Kamuthi state high way in westward direction.
South West The boundary starts at a distance of 1.20 Km. from the southern western boundary of Mela Kanjirankulam Tank on a point of interception of Pulvaykulam village approach road on Mudukalathur – Kamuthi state highway.
West The boundary travels northwards along Pulvaykulam village approach road. Thence runs along the Pulvaykulam Kanmoi feeder channel running parallel to Pulvaykulam village main road on eastern periphery of Pulvaykulam village.
North West Thence the boundary meets the interception point of Pulvaykulam Kanmoi feeder channel and Gundar Channel.
