और,और,और,और, �ा प अिधसूचना के उ@र म- /ि0य1 और पणधा"रय1 से कोई भी आ<ेप और सझुाव �ाA नह: Bए; और,और,और,और, व�लानाडू 9लैकबक अभयारEय थोथुकुडी वन सभंाग के िनयं�णाधीन थोथुकुडी िजला म- एकमा� "रज़व� वन ह।ै अभयारEय का <े�फल 16.4121 वग� �कलोमीटर या 1641.21 हJेटेयर ह।ै यह ित नेलवेली-थोथुकुडी राKीय राजमाग� के िनकट िLथत ह।ै यह <े� जी.ओ. एमएस. सं. 1028 तारीख 28.9.1987 के अनुसार 9लैकबक अभयारEय घोिषत �कया गया था और तिमलनाडु सरकार के राजप� म- 21 अJटूबर 1987, और थोथुकुडी िजला के राजप� म- 8 अगLत 1996 म- �कािशत �कया गया; और,और,और,और, 9लैकबक एक संकटापP �जाित ह ैऔर भारतीय उपमहा(ीप के िलए Lथािनक ह।ै िवQ संर<ण संघ (आई यू सी एन) रेड डॉटा बुक के अनुसार, काला िहरण को वी यू (असुरि<त) िLथित म- िनधा�"रत �कया गया ह।ै व�लानाडू "रज़व� वन उपमहा(ीप म- दि<णीतम Lथान है जहां काला िहरण Lवाभािवक प से उपल9ध ह ैजो यह दशा�ता ह ै�क एक िनSTंत 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Lतर पर इसके संर<ण क% आवUयकता ह,ै Jय1�क िवकास के दबाव को बनाए रखने के िलए आनुवािंशक ?प से सVंया कम होगी। व�लानाडू "रज़व� वन (पहाड़ी) का िवशाल प"रवेश काला िहरण के िलए एक पारंप"रक <े� ह ैले�कन अब पहाड़ी क% ओर बढ़ता जा रहा हW। काला िहरण अिधकाशं समय म- "रज़व� वन के बजाए पूव� क% समीपवतX बंजर भिूम म- रहते हW; (i) पया�वरण;
(ii) वन और व6यजीव;
(iii) कृिष;
(iv) राजL व;
(v) नगर िवकास;
(vi) पय�टन;
(vii) eामीण िवकास;
(viii) Sसंचाई और बाढ़ िनयं�ण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िन मा�ण िव भाग;
(xii) राजमाग�; और
(xiii) तिमलनाडु राhय �दषूण िनयं�ण बोड�। (4) आंचिलक महायोजना अनुमो�दत िवgमान भ-ूउपयोग, अवसंरचना और �uयाकलाप1 पर कोई िनबvधन अिधरोिपत नह: करेगी जब तक �क इस अिधसूचना म- इस �कार िविनqद�r ट न हो और आचंिलक महायोजना सभी अवसंरचना और �uयाकलाप1 म- जो अिधक द<ता और पा"रिLथितक% अनुकूल ह1 का संवध�न करेगी । (5) आंचिलक महायोजना म- अनाwछा�दत <े�1 के जीणxmार, िवgमान जल िनकाय1 के संर<ण, आवाह <े�1 के �बंधन, जल-संभर1 के �बंधन, जल संभर �बंधन, मृदा और नमी संर<ण, Lथानीय समुदाय1 क% आवUयकता] तथा पा"रिLथितक% और पया�वरण से संबंिधत ऐस ेअ6य पहल]ु, िजन पर yयान दनेा आवUयक ह,ै के िलए उपबंध ह1गे । (6) आंचिलक महायोजना िवgमान और �Lतािवत भिूम उपयोग िवशेषता] के 9यौर1 स ेअनुसम7थ�त मानिच� के साथ सभी िवgमान पूजा L थल1, eाम1 और नगरीय बिLतय1, वन1 के �कार और �कL म1, कृिष <े�1, ऊपजाऊ भूिम, ह"रत <े� जैसे उgान और उसी �कार के L थान, उgान कृिष <े�, फलोउgान, झील1 और अ6य जल िनकाय1 का अ|यकंन करेगी। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) आंचिलक महायोजना पा"रिLथितक% सवंेदी जोन म- िवकास को िविनयिमत करेगी और सारणी म- सूचीबm पैरा म- �ितिषm और िविनयिमत �uयाकलाप1 का अनुपालन करेगी और L थानीय समदुाय1 क% जीिवका को सुरि<त करन ेके िलए पा"रिLथितक% अनुकूल िवकास को सुिनिTत और उसक% अिभवृिm भी करेगी। (8) आंचिलक महायोजना �ादिेशक िवकास योजना क% सह-िवLतारी होगी । (9) इस �कार अनुमो�दत आंचिलक महायोजना इस अिधसूचना के उपबंध1 के अनुसार मानीटरी के अपने काय} को करने के िलए मानीटर सिमित के िलए एक संदभ� दLतावेज तैयार करेगी । 3. रा$यरा$यरा$यरा$य सरकारसरकारसरकारसरकार %ारा%ारा%ारा%ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय....---- राhय सरकार इस अिधसूचना के उपबंध1 को �भावी करने के िलए िनjिलिखत उपाय करेगी, अथा�त्:- (1) भूभभूूभू----उपयोगउपयोगउपयोगउपयोग....–––– (क) पा"रिLथितक% संवेदी जोन म- वन1, उgान कृिष <े�1, कृिष <े�1, मनोरंजन के �योजन1 के िलए िचि6हत �कए गए पाक} और खुले Lथान1 का वािणिhयक या आवासीय या औgोिगक संबm िवकास �uयाकलाप1 के िलए उपयोग या संप"रवत�न नह: होगा: परंतु यह �क पा"रिLथितक% संवेदी जोन के भीतर भाग (क) म- िविनqद�8 �योजन1 स ेिभP �योजन के िलए कृिष और अ6य भिूम का संप"रवत�न मानीटरी सिमित क% िसफा"रश पर और यथा लागू और <े�ीय नगर योजना अिधिनयम और के6\ीय सरकार या राhय सरकार के अ6य िनयम1 तथा िविनयम1 के अधीन स<म �ािधकारी के पूव� अनुमोदन से, और इस अिधसूचना के उपबंध1 (ारा Lथानीय िनवािसय1 क% िनjिलिखत आवासीय आवUयकता] को पूरा करने के िलए अनु~ात �कया जाएगा, जैस:े- (i) िवgमान सड़क1 को चौड़ा करना और उ6ह- सुदढ़ृ करना तथा नई सड़क1 का संिनमा�ण; (ii) बुिनयादी ढांच1 और नाग"रक सुिवधा] का संिनमा�ण और नवीकरण; (iii) �दषूण उZपP न करने वाले लघ ुउgोग; (iv) कुटीर उgोग1 िजनके अंतग�त eामीण उgोग भी हW; सुिवधाजनक भEडार और Lथानीय सुिवधाएं सहायक पा"रिLथितक% पय�टन िजसके अ6तग�त गृह वास सि�मिलत ह;ै और (v) पैरा 4 के अधीन �दए गए संव7ध�त �uयाकलाप: परंतु यह और �क �ादिेशक नगर योजना अिधिनयम और राhय सरकार के अ6य िनयम1 और िविनयम1 के अधीन स<म �ािधकारी के पूव� अनुमोदन और संिवधान के अनुwछेद 244 के उपबंध1 या तZसमय �वृ@ िविध के उपबंध1 के अनुपालन के िबना, िजसके अ6तग�त अनुसूिचत जनजाित और अ6य परंपरागत वन िनवासी (वन अिधकार1 क% मा6यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिhयक या औgोिगक िवकास �uयाकलाप1 के िलए जनजातीय भूिम का उपयोग अनु~ात नह: होगा: परंतु यह और भी �क पा"रिLथितक% संवेदी जोन के भीतर भ-ूअिभलेख1 म- उपसंजात कोई गलती, मानीटरी सिमित के िवचार �ाA करने के पTात् राhय सरकार (ारा �Zयेक मामले म- एक बार ठीक होगी और उ0 गलती के सुधार क% सूचना क- \ीय सरकार के पया�वरण, वन और जलवायु प"रवत�न मं�ालय को दी जाएगी: परंतु यह और भी �क गलती के संशोधन म- इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म- भू-उपयोग का प"रवत�न सि�मिलत नह: होगा; (ख) वनीकरण तथा वास जीणxmार �uयाकलाप1 सिहत अन�युJ त या अनुZ पादक कृिष <े�1 म- पुन: वनीकरण करने के �यास �कए जाएंगे। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (2) 'ाकृितक'ाकृितक'ाकृितक'ाकृितक जल जल जल जल )ोत*)ोत*)ोत*)ोत*....- आचंिलक महायोजना म- सभी �ाकृितक जल �ोत1/न�दय1/जलमाग} के आवाह <े�1 क% पहचान क% जाएगी और उनके संर<ण और नवीकरण के िलए योजना सि� मिलत होगी और राh य सरकार (ारा ऐसे <े�1 पर या उनके िनकट िवकास �uयाकलाप �ितिषm करने के बारे म- जो ऐसे <े�1 के िलए अिहतकर हो ऐसी रीित से माग�दश�क िसmांत तैयार �कए जाएंगे । (3) पय�टनपय�टनपय�टनपय�टन यायायाया पा रि!थितक# पय�टनपा रि!थितक# पय�टनपा रि!थितक# पय�टनपा रि!थितक# पय�टन....---- (क) पा"रिLथितक% संवेदी जोन के भीतर सभी नए पा"रिLथितक% पय�टन �uयाकलाप या िवgमान पय�टन �uयाकलाप1 का िवLतार पय�टन महायोजना के अनुसार पा"रिLथितक% संवेदी जोन के िलए होगा; (ख) पय�टन महायोजना राhय पय�टन िवभाग (ारा राhय पया�वरण और वन िवभाग के परामश� स ेतैयार होगी; (ग) पय�टन महायोजना आंचिलक महायोजना के एक घटक के ?प म- होगी; (घ) पय�टन महायोजना पा"रिLथितक% संवेदी जोन क% वहन <मता के आधार पर तैयार क% जाएगी। (ङ) पा"रिLथितक% पय�टन संबंधी �uयाकलाप िनjानुसार िविनयिमत ह1गे:- (i) संरि<त <े� क% सीमा से एक �कलोमीटर के भीतर या पा"रिLथितक% संवेदी जोन के िवLतार तक, इनम- जो भी िनकट ह,ै नये वािणिhयक होटल और सैरगाह के सिPमा�ण अनु~ात नह: ह1गे: परंतु, यह �क सरंि<त <े� क% सीमा से एक �कलोमीटर क% दरूी से परे पा"रिLथितक% संवेदी जोन के िवLतार तक होटल1 और "रजॉट� का Lथापना केवल पूव� प"रभािषत और नामिनqद�8 <े�1 म- पय�टन महायोजना के अनुसार पा"रिLथितक% पय�टन सुिवधा] के िलए ही अनु~ात होगा; (ii) पा"रिLथितक% संवेदी जोन के भीतर नए पय�टन �uयाकलाप1 या िवgमान पय�टन �uयाकलाप1 का िवLतार क- \ीय सरकार के पया�वरण, वन और जलवायु प"रवत�न मं�ालय के माग�दश�क िसmातं1 के (ारा तथा राr �ीय a या� सरं<ण �ािधकरण, (ारा जारी पा"रिLथितक%–पय�टन, पा"रिLथितक%-िश<ा और पा"रिLथितक%-िवकास पर बल दतेे Bए (समय-समय पर यथा संशोिधत) जारी माग�दश�क िसmांत1 के अनुसार होगा; The Sanctuary area is 16.4121 sq km or 1641.21 Ha. It is situated near Tirunelveli- Thoothukudi National Highway. This area was declared as Blackbuck sanctuary as per G.O. Ms. No. 1028 dated 28.9.1987 and published in Tamil Nadu Government Gazette on October 21st 1987, and in Thoothukudi District Gazette on 8 th August 1996. AND WHEREAS, Black buck is an endangered species and is endemic to Indian subcontinent. According to the world conservation union (IUCN) red data book, the Blackbuck is assigned VU (vulnerable) status. Vallanadu Reserved forest is the Southernmost in the subcontinent place where Blackbuck is naturally available which speaks for itself the need for their conservation to a comfortable level, as population would be genetically deficient to sustain pressures of evolution. Vast surroundings of Vallanadu Reserved Forest (hillock) is a traditional area for Blackbuck but are now pushed to the hillock. Blackbuck spends most of the time in adjacent wastelands of eastern aspect than in RF. AND WHEREAS, Black buck which were earlier reported to be seen on western aspect have come down due to cattle pressure. Now they are seen only in eastern aspect of the Hillock and more in Northern (north-west to southeast direction) portion. RF is denser and hilly which reduces fodder availability. Surrounding wastelands are better ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27 place for their presence as they are more open and a mix of grassy patches and few xerophytes bushes. With abandoned stone quarries acting as waterholes, the area outside reserved forest provides fodder requirement, water requirement but not hiding ground for Blackbucks. Wastelands adjacent to eastern aspect are fast dwindling as they are private holdings, near to Highway. Agriculture being non-profitable there is fast getting converted as residential plots. AND WHEREAS, the sanctuary has variety of flora and fauna including birds, reptiles, mammals, amphibians. Some examples of flora are Velvel (Acacia leucocephala (Roxb.) Willd.),Kudaivel (Acacia planifrons Wight & Arn.), Usilai (Albizia amara (Roxb.) B.Boivin),Thaneervittan kizhangu (Asparagus racemosus Willd.), Kattu Kanagambaram (Barleria prionitis L.) etc; examples of some faunal species are Blackbuck(Indian Antilope)(Antilope cervicapra), Spotted deer(Axix-axis), Sambar(Cervus unicolor), Jackal(Canis aureus), India Fox(Vulpes bengalensis), Jungle cat(Felis chaus)etc; examples of birds include White breasted Kingfisher (Halcyon smyrnesis), Red-whiskered Bulbul (Pycnonotusjocosus), Peafowl (Pavo cristatus), Grater Coucal (Centropus sinensis), Indian Cuckoo (Cuculus micropterus), Red- vented Bulbul (Pycnonotuscafer) etc; example of reptiles include Kollegal Ground Gecko (Geckoellacollegalensi), Rock agama (Psammophilus dorsalis), Rate Snake (Elephae abslote), Cobra (Najanaja), Russels Viper (Daboia ruselli) etc. AND WHEREAS, most of these are wasteland, small part of settlement, small part of agricultural land and remaining part is Vallanadu RF within the Eco sensitive zone. Less than 10% of area of Eco-sensitive zone is agricultural land. Small area in Eco-sensitive zone is industries of Standard Fireworks factory. Remaining all areas is waste land beyond to Eco-sensitive zone the important economy of the area is primarily agriculture. NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule
(3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from zero (northern side, due to NH 7A)kilometre to 2.00 kilometre around the boundary of Vallanadu Blackbuck sanctuary in the State of Tamil Nadu as the Vallanadu Blackbuck sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-Sensitive Zone. - (1) The extent of Eco-sensitive Zone varies from zero (northern side, due to NH 7A) kilometer to 2.00 kilometer around the Vallanadu Blackbuck sanctuary. The area of the Eco- Sensitive Zone is 12.03 square kilometers.
(2) The boundary description of the Eco Sensitive Zone is appended at Annexure I.
(3) The map of the Protected Area demarcating the Eco-Sensitive Zone boundary is at Annexure IIA-E.
(4)List of geo co-ordinates of the boundary of the Protected Area and the Eco-Sensitive Zone is at Annexure III Tables (A) and (B) respectively.
(5) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure IV.
2. Zonal Master Plan for the Eco-sensitive Zone. - (1) The State Government shall, for the purpose of effective management of the Eco-Sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of Final Notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this Notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating environmental and ecological considerations into the said plan:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department;
(xii) Highways; and
(xiii) Tamil Nadu State Pollution Control Board. 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.–(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part
(a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and
(v) promoted activities and given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies. -The catchment areas of all natural springs/rivers/channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3)Tourism/ Eco-tourism.-(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone;
(b) the Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests;
(c) the Tourism Master Plan shall form a component of the Zonal Master Plan; ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 29
(d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone;
(e) the activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in predefined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and ecodevelopment;
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution. - The Environment Department of the State Government or Tamil Nadu State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made there under and amendments thereto.
(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made there under or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste. - Bio-medical waste management shall be as under:
(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification Number GSR 343 (E), dated the 28 th March,2016 as amended from time to time;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. 30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste. - The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made there under.
(15) Vehicular Pollution. - Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone;
(ii) only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes: The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone: All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927) the Wildlife(Protection) Act 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals) stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated
04.08.2006 in the matter of T.N. Godavarman Thirumalpad vz. UOI in W.P. (C) No. 202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation z. UOI in W.P. (C) No. 435 of
2012.
2. Setting of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.,). No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted. Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. 6. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated activities
8. Establishment of Commercial Hotels and Resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or up to the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or up to the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities.
(a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or up to extent of the Eco-sensitive Zone whichever is nearer:
(b) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents.
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations if any.
(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
10. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.
11. Discharge of treated waste water/effluents in natural water bodies or land area. The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.

25. Rain water harvesting. Shall be actively promoted.
26. Organic farming. Shall be actively promoted.
27. Use of renewable energy sources. Shall be actively promoted.
28. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
29. Adoption of green technology for all activities. Shall be actively promoted.
30. Plantation of Horticulture and Herbals Shall be actively promoted.
5. Monitoring Committee .-The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), comprising of the following namely:-
1. District Collector, Thoothukudi Chairman;
2. A representative of Non-government Organisation working in the field of wildlife conservation to be nominated by State Government Member;
3. An expert in Biodiversity nominated by the State Government Member;
4. An expert in Ecology and Environment to be nominated by the State Government Member;
5. A representative from State Public Works Department Member;
6. A representative from State Pollution Control Board Member;
7. District Officer, Thoothukudi Member Secretary.
6. Terms of Reference.–(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 33
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per Performa given in Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
