और, उि प्रारूप अजधसूचना को अन्तर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को तारीख 12 माचा, 2021 को उपलब्ध करा िी गई थी;
और, उि प्रारुप अजधसूचना के प्रत्र्ुतर में व्यजिर्ों और पणधाररर्ों से प्राप्त आक्षेपों और सुझावों पर कें द्रीर् सरकार द्वारा जवचार दकर्ा गर्ा था;
और, टंुडा वन्र्िीव अभर्ारण्र् चौंसठ वगा दकलोमीटर के क्षेत्रफल में फैला हुआ ह ैऔर र्ह चम्बा जिल ेके भारमौर उप-संभाग में जस्ट्थत ह ैऔर जहमाचल प्रिेि में वन्र्िीव संभाग, चम्बा के प्रिासजनक जनर्ंत्रण के अतंगात आता ह।ै टंुडा स.ं 394] नई दिल्ली, मगंलवार, फरवरी 1, 2022/माघ 12, 1943 No. 394] NEW DELHI, TUESDAY, FEBRUARY 1, 2022/MAGHA 12, 1943 सी.जी.-डी.एल.-अ.-03022022-233095 CG-DL-E-03022022-233095 सी.जी.-डी.एल.-अ.-03022022-233095 CG-DL-E-03022022-233095 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] वन्र्िीव अभर्ारण्र् 76º 24′ पू से 76º 38′ पू िेिांतर और 32º 40′ उ से 32º 76′ उ अक्षांि के बीच और चम्बा- भारमौर मुख्र् सड़क पर धाकोग से सात दकलोमीटर की िरूी पर जस्ट्थत ह।ै और, टंुडा वन्र्िीव अभर्ारण्र् को अजधसूचना सं. एफटी. 43-51/50-IV तारीख 19 जसतम्बर, 1962, तिन्तर र्था संिोजधत सं.6-25/73-एसएफ तारीख 17 जसतम्बर, 1975 के द्वारा वन्र्िीव अभर्ारण्र् का ििाा दिर्ा गर्ा था और अंजतम अजधसूचना वन्र्िीव (संरक्षण) अजधजनर्म, 1972 की धारा 26क के अधीन, अजधसूचना सं. एफएफई-बी-एफ (6)- 11/2005-II तारीख 7 िून, 2013 के द्वारा िारी की गई जिसके अंतगात अभर्ारण्र् की सीमा का समीकरण तर् दकर्ा गर्ा। और, वन्र्िीव अभर्ारण्र् प्रिाजतर्ों िैसे िेविार (केिरूस िेओिारा), जसलवर दफर (अजबइस जपड्रोव), स्ट्प्रूस (जपकेर्ा जस्ट्मथअना), कैल (जपनस वाल्लीजचअना), बान (क्रू्इरकस सेमेकारजपफोजलर्ा), आदि के साथ वनस्ट्पजत जवजवधता में समृद्ध ह ैऔर र्हां वृक्षावृत क्षेत्र और चरागाहों की बड़ी संख्र्ा का अच्छा इंटरफेस ह ैिो पिुओं के साथ-साथ पजक्षर्ों के जलए अच्छा पर्ाावास बनाता ह।ै और, अभर्ारण्र् में मखु्र् िीविंतु प्रिाजतर्ां तेंिआु (पेन्थरेा प्रड्यूस), काला भाल ू (सेलनेारक्टोसस जथबेटानस), भूरा भाल ू(उरसूस अरक्टोस), गोरल (नैमोरहडेस गोरल), जहमालर्न थार (हजेमतरागस िेमलाजचकस), जहमालर्न इबेक्स (कापरा इबेक्स), जहमालर्न मोनलl (लोफोफोरूस इम्पेिानस), स्नोव कोक्क (टेटराओगाल्लुस जहमालर्ेंजसस), जचर तीतर (कटरेउस वाल्लीजच), कोक्लास (पुकराजसर्ा माकरोलोफो), चकोर (अलेक्टोररस चुकार) आदि पाई िाती हैं। और, टंुडा वन्र्िीव अभर्ारण्र् के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाएं इस अजधसूचना के पैरा 1 में जवजनर्िाष्ट हैं, पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव-जवजवधता की िजृष्ट से पाररजस्ट्थजतकी संवेिी िोन के रूप में सुरजक्षत और संरजक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों की श्रेजणर्ों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजिद्ध करना आवश्र्क ह;ै अतः, अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना में इसके पश्चात् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की उपधारा (1) तथा धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) एवं उपधारा (3) के द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, जहमाचल प्रिेि राज्र् के मंडी जिला में टंुडा वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर िून्र् से एक दकलोमीटर तक के जवस्ट्ताररत क्षेत्र को टंुडा वन्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात् :-
1. पाररजस्ट्थजतकी सवंिेी िोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार टंुडा वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर िून्र् से एक दकलोमीटर के साथ 46.74 वगा दकलोमीटर में जवस्ट्ताररत ह ैऔर जहमनिी और अगम्र् क्षेत्रों के साथ प्रिर्िात बफा सीमा पहाजड़र्ां लाहौल और स्ट्पीजत की जिला सीमा की उपजस्ट्थजत के कारण उत्तरी और उत्तर पूवा भाग की ओर पाररजस्ट्थजतकी संवेिी िोन का िून्र् जवस्ट्तार ह।ै
(2) टंुडा वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उपाबधं-I के रूप में उपाबद्ध ह।ै
(3) सीमा जववरण और अक्षांि और िेिांतर के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए टंुडा वन्र्िीव अभर्ारण्र् के मानजचत्र उपाबधं–IIक, उपाबधं–IIख और उपाबधं–IIग के रूप में उपाबद्ध हैं।
(4) टंुडा वन्र्िीव अभर्ारण्र् और पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू- जनिेिांकों की सूची उपाबधं- III की सारणी क और सारणी ख में िी गई ह।ै [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3
(5) मुख्र् बबंिओुं के भू-जनिेिांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाल ेग्रामों की सूची उपाबधं–IV के रूप में उपाबद्ध ह।ै
2. पाररजस्ट्थजतकी सवंिेी िोन के जलए आचंजलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी और राज्र् में सक्षम प्राजधकारी द्वारा सम्र्क रुप से अनुमोदित दकर्ा िाएगा।
(2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए हैं, के अनुसार तथा सुसंगत कें द्रीर् और राज् र् जवजधर्ों के अनुरुप और कें द्रीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी ।
(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा स ेतैर्ार होगी-
(i) पर्ाावरण;
(ii) वन और वन्र्िीव;
(iii) कृजि;
(iv) रािस्ट् व;
(v) िहरी जवकास;
(vi) पर्ाटन;
(vii) नगरपाजलका;
(viii) जहमाचल प्रिेि राज्र् प्रििूण जनर्ंत्रण बोडा।
(4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दिर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दिर्ाकलापों में, िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणद्धद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलुओं, जिन पर ध्र्ान िेना आवश्र्क ह,ै के जलए उपबंध होंगे ।
(6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेिताओं के ब्र्ौरों से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजि क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभर्ांकन करेगी।
(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करन ेके जलए प्रदकर्ा प्रिान की िाएगी और सारणी में सूचीबद्ध पैरा-4 में प्रजतजिद्ध और जवजनर्जमत दिर्ाकलापों का अनपुालन करेगी और स्ट् थानीर् समुिार्ों की िीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत और उसकी अजभवृजद्ध भी करेगी।
(8) आंचजलक महार्ोिना प्रािेजिक जवकास र्ोिना की सह जवस्ट्तारी होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(9) राज्र् सरकार द्वारा अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कताव्यों का जनवाहन कर सके।
3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करन े के जलए जनम्नजलजखत उपार् करेगी, अथाात्:-
(1) भ-ूउपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुले स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दिर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा:
परंत ुपाररजस्ट्थजतकी संवेिी िोन के भीतर इसमें जवजनर्िाष्ट प्रर्ोिनों से जभन्न प्रर्ोिनों के जलए कृजि और अन्र् भूजम का संपररवतान जनगरानी सजमजत की जसफाररि पर और र्था लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्द्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करन ेके जलए अनुज्ञात दकर्ा िाएगा, िैसे-
(i) जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिकृर करना तथा नई सड़कों का संजनमााण;
(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रििूण उत्पन्न न करने वाल ेलघु उद्योग;
(iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी हैं; सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन जिसके अन्तगात गृह वास सजम्मजलत है; और
(v) पैरा 4 में दिए गए संवर्धात दिर्ाकलाप:
परंत ुर्ह और दक प्रािेजिक नगर र्ोिना अजधजनर्म और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन और संजवधान के अनचु्छेि 244 के उपबंधों र्ा तत्समर् प्रवृत्त जवजध के उपबंधों के अनुपालन के जबना, जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी ह,ै वाजणजज्र्क र्ा औद्योजगक जवकास दिर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा:
परंत ु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई गलती, जनगरानी सजमजत के जवचार प्राप्त करन ेके पश्चात ्राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार ठीक होगी और उि गलती के सुधार की सूचना कें द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:
परंत ुर्ह और भी दक गलती के सुधार में इस उप परैा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू- उपर्ोग का पररवतान सजम्मजलत नहीं होगा;
(ख) वनीकरण तथा वास िीणद्धद्धार दिर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजि क्षते्रों में पनु: वनीकरण करने के प्रर्ास दकए िाएंगे।
(2) प्राकृजतक िल स्रोत.- आचंजलक महार्ोिना में सभी प्राकृजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दिर्ाकलाप प्रजतजिद्ध करने के बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएंगे। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5
(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दिर्ाकलाप र्ा जवद्यमान पर्ाटन दिर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा;
(ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी;
(ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप में होगी;
(घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी;
(ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दिर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे, अथाात:्-
(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नर्े वाजणजज्र्क होटल और ररिॉटा के सजन्नमााण अनुज्ञात नहीं होंगे:
परंत,ु र्ह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की िरूी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररिॉटा की स्ट्थापना केवल पूवा पररभाजित और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनजु्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दिर्ाकलापों र्ा जवद्यमान पर्ाटन दिर्ाकलापों का जवस्ट्तार कें द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष् रीर् ा र्ाघ्र स संरक्षण प्राजधकरण, द्वारा िारी पाररजस्ट्थजतकी– पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेत े हुए (समर्-समर् पर र्था संिोजधत) िारी मागाििाक जसद्धांतों के अनुसार होगा;
(iii) आंचजलक महार्ोिना का अनमुोिन दकए िान े तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दिर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िाष्ट संवीक्षा और जनगरानी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए होटल र्ा ररसोटा र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनजु्ञात नहीं दकर्ा िार्ेगा ।
(4) नसैर्गाक जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपणूा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत के्षत्र, िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाए,ं स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप में परररक्षण और संरक्षण के जलए तैर्ार की िाएगी ।
(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तरै्ार की िाएगी।
(6) ध् वजन प्रििूण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििूण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििूण के जनर्ंत्रण और जनवारण का अनुपालन दकर्ा िाएगा।
(7) वार् ुप्रििूण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रििूण के जनवारण और जनर्ंत्रण का वार्ु (प्रििूण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सरण, साधारण मानकों के उपबंधों के अनुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाल ेपर्ाावरणीर् प्रििूण के जनस्ट्सरण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा।
(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रलै, 2016 के द्वारा प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथद्ध का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनकूुल रीजत से दकर्ा िाएगा;
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरुूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(10) िैव जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016, के द्वारा प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा;
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरुूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(11) प्लाजस्ट्टक अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(12) जनमााण और जवध्वसं अपजिष्ट प्रबधंन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा ।
(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(14) र्ानीर् र्ातार्ात.- र्ातार्ात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होगी और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सजम्मजलत दकए िाएंग ेऔर आंचजलक महार्ोिना के तैर्ार होन ेऔर राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, जनगरानी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् दिर्ाकलापों के अनुपालन को जनगरानी करेगी।
(15) र्ानीर् प्रििूण.- लाग ूजवजधर्ों के अनपुालन में वाहन प्रििूण का जनवारण और जनर्ंत्रण दकर्ा िाएगा और स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे।
(16) औद्योजगक ईकाइर्ा.ं- (क) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात ्पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिजूित उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी;
[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (ख) केन्द्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रििूणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रििूणकारी उद्योगों को बकरावा दिर्ा िाएगा।
(17) पहाड़ी ढलानों को सरंक्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार होगा- (क) आंचजलक महार्ोिना पहाड़ी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी;
(ख) कटाव के एक उच्च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी।
4. पाररजस्ट्थजतकी सवंिेी िोन में प्रजतजिद्ध और जवजनर्जमत दकए िान ेवाल ेदिर्ाकलापों की सचूी.- पाररजस्ट्थजतकी संवेिी िोन में सभी दिर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीन बनाए गए जनर्मों जिसके अन्तगात तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 और अन्र् लागू जवजधर्ों के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) सजम्मजलत हैं और दकर् ेगर्े संिोधनों द्वारा िाजसत होंगे और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में जवजनर्जमत होंगे, अथाात ्:- सारणी िम स.ं

(ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्र्ार्ालर् के आिेि 4 अगस्ट्त, 2006 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामल ेमें तारीख 21 अप्रलै, 2014 के आिेि के अनुसरण में होगा ।
2. प्रििूण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन करन ेवाल ेउद्योगों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रििूणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी:

6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई आरा जमलों की स्ट्थापना और जवद्यमान आरा जमलों का जवस्ट् तार अनुज्ञात नहीं होगा।
7. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध।
8. पोजलथीन बैगों का उपर्ोग। प्रजतजिद्ध।
9. िलावन लकड़ी का वाजणजज्र्क उपर्ोग। प्रजतजिद्ध।
10. जवििेि प्रिाजतर्ों को लाना। प्रजतजिद्ध। आ. जवजनर्जमत दिर्ाकलाप
11. वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना। पाररजस्ट्थजतकी पर्ाटन दिर्ाकलापों लघु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट ह,ै नए वाजणजज्र्क होटल और ररसोटों को अनजु्ञात नहीं दकर्ा िाएगा:
परंत,ु र्ह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के परे र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक इनमें से, िो भी जनकट हो सभी नए पर्ाटन दिर्ाकलाप र्ा जवद्यमान दिर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागाििी जसद्धांतों के अनुरुप होगा।
12. संजनमााण दिर्ाकलाप। (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर् ेवाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी:
परंतु र्ह दक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आवश्र्कताओं को पूरा करन ेके जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध दिर्ाकलापों सजहत अपन ेउपर्ोग के जलए, [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 िम स.ं

(3) अपनी भूजम में भवन उप-जवजधर्ों के अनुसार, संजनमााण करन ेकी अनुज्ञा होगी:
परंतु र्ह दक गरै–प्रििूणकारी लघ ु उद्योगों से संबंजधत संजनमााण दिर्ाकलाप लाग ू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंगे। (ख) एक दकलोमीटर क्षेत्र से परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे।
13. प्रििूण उत्पन्न न करन े वाले लघु उद्योग। फरवरी, 2016 में केन्द्रीर् प्रििूण जनर्ंत्रण बोडा द्वारा िारी उद्योगों में वगीकरण के अनुसार समर्-समर् पर र्था संिोजधत गैर-प्रििूणकारी उद्योग और अपररसंकटमर् में, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करने वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे।
14. वृक्षों की कटाई। (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत कें द्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होगे ।
15. वन उत्पािों र्ा गैर काष् ठ वन उत्पािों का संग्रहण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
16. जवदु्यत और संचार टावरों का पररजनमााण और केबलों के जबछाए िाने और अन्र् बुजनर्ािी ढांचे। लागू जवजधर्ों के अधीन जवजनर्जमत भूजमगत केबल जबछाने को बकरावा दिर्ा िाएगा।
17. नागररक सुख सुजवधाओं सजहत अवसंरचनाएं । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाएगा ।
18. जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिकृर करना तथा नवीन सड़कों का संजनमााण । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों तथा उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाएगा ।
19. पर्ाटन से संबंजधत अन्र् दिर्ाकलाप िैसे गमा वार्ु गुब्बारें, हलेीकॉप्टर, ड्रोन, माइिोलाइटस, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उड़ना िैसे दिर्ाकलाप करना। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

21. राजत्र में र्ाजनक र्ातार्ात का संचलन । लागू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंगे ।
22. स्ट्थानीर् समुिार्ों द्वारा चल रही कृजि और बागवानी प्रथाओं के साथ िगु्धिाला, िगु्घ उद्योग, कृजि और मछली पालन । स्ट्थानीर् लोगों के उपर्ोग के जलए लागू जवजधर्ों के अधीन अनुज्ञात होंग े।
23. प्राकृजतक िल जनकार्ों र्ा सतही क्षेत्र में उपचाररत बजहस्रााव का जनस्ट्तारण । िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुन:चिण और पनु:उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्र्था लाग ू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचािण र्ा प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा।
24. सतही और भूिल का वाजणजज्र्क जनष्किाण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
25. फमों, जनगम और कंपजनर्ों द्वारा बडे़ पैमाने पर वाजणजज्र्क पिओुं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आवश्र्कताओं को पूरा करने के जलए लागू जवजधर्ों के अधीन जवजनर्जमत होंगे ।
26. खुले कंुआ, बोर कंुआ, आदि कृजि और अन्र् उपर्ोग के जलए । जवजनर्जमत और सम्बद्ध प्राजधकारी द्वारा दिर्ाकलापों की सख्ती से जनगरानी की िाएगी।
27. ठोस अपजिष्ट का प्रबन्धन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
28. पाररजस्ट्थजतकी पर्ाटन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
29. वाजणजज् र्क सूचनापट्ट और होडडंग। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे । इ. सवंर्धात दिर्ाकलाप
30. विाा िल संचर्न। सदि र् रूप से बकरावा दिर्ा िाएगा।
31. िैजवक खेती। सदि र् रूप से बकरावा दिर्ा िाएगा।
32. सभी गजतजवजधर्ों के जलए हररत प्रौद्योजगकी को अंगीकृत करना । सदि र् रूप से बकरावा दिर्ा िाएगा।
33. कुटीर उद्योग जिसके अतंगात ग्रामीण कारीगर भी हैं। सदि र् रूप से बकरावा दिर्ा िाएगा।
34. नवीकरणीर् ऊिाा और ईंधन का उपर्ोग । बार्ोगैस, सौर प्रकाि, इत् र्ादि को बकरावा दिर्ा िाएगा।
35. कृजि वाजनकी । सदि र् रूप से बकरावा दिर्ा िाएगा।
36. बागान लगाना और िड़ी बूरटर्ों का रोपण । सदि र् रूप से बकरावा दिर्ा िाएगा।

5. पाररजस्ट्थजतकी सवंिेी िोन अजधसचूना की जनगरानी के जलए जनगरानी सजमजत- इस अजधसूचना के उपबंधों की प्रभावी जनगरानी के जलए, कें द्रीर् सरकार, पर्ाावरण अजधजनर्म की धारा 3 की उपधारा (3) के अधीन जनगरानी सजमजत का गठन करती ह,ै िो जनम्नजलजखत से जमलकर बनेगी, अथाात:्- ि.स.ं जनगरानी सजमजत का गठन पि
1. मुख्र् वन संरक्षक, चंबा वन वृत्त, चंबा अध् र्क्ष;
2. राज्र् सरकार द्वारा पर्ाावरण के क्षेत्र (जवरासत संरक्षण सजहत) में काम करने वाल ेगैर- सरकारी संगठन का प्रजतजनजध सिस्ट्र्;
3. पाररजस्ट्थजतकी और पर्ाावरण में एक जविेिज्ञ राज्र् सरकार द्वारा नाजमत दकर्ा िाएगा सिस्ट्र्;
4. राज्र् प्रििूण जनर्ंत्रण बोडा के क्षेत्रीर् कार्ाकारी अजभर्ंता सिस्ट्र्;
5. राज्र् िैव जवजवधता बोडा का एक प्रजतजनजध सिस्ट्र्;
6. संभागीर् वन अजधकारी, भरमौर सिस्ट्र्;
7. उप-संभागीर् मजिस्ट्रेट भरमौर र्ा उनके प्रजतजनजध सिस्ट्र्;
8. संभागीर् वन अजधकारी (वन्र्िीव), चंबा सिस्ट्र्-सजचव;
6. जनिेि जनबधंन.- (1) जनगरानी सजमजत इस अजधसूचना के उपबंधों के अनुपालन को जनगरानी करेगी।
(2) जनगरानी सजमजत का कार्ाकाल अगल े आििे होन े तक दकर्ा िाएगा, परंत ु र्ह दक सजमजत के गैर- सरकारी सिस्ट्र्ों को समर्-समर् पर राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा।
(3) उन दिर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में सजम्मजलत हैं, और िो पाररजस्ट्थजतकी संवेिी िोन में आत े हैं, जसवार् इसके िो पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजिद्ध दिर्ाकलापों के, जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केद्रींर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िाष्ट दकर्ा िाएगा।

8. कोई अन् र् महत् वपूणा जविर् । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 1st February, 2022 S.O. 409 (E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary on the 12 th March, 2021, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 1195(E), dated the 12 th March, 2021, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 12 th March, 2021;
18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the aforesaid draft notification were considered by the Central Government;
AND WHEREAS, the Tundah Wildlife Sanctuary is spread over an area of sixty four square kilometres and is located in the Bharmour sub-division of Chamba district and falls under the administrative control of Wildlife Division, Chamba in Himachal Pradesh. The Tundah Wildlife Sanctuary is located between 76º 24′ E to 76º 38′ E longitude and 32º 40′ N to 32º 76′ N latitude and is at a distance of seven kilometres from Dhakog on Chamba- Bharmour main road.
AND WHEREAS, the Tundah Wildlife Sanctuary was given the status of Wildlife Sanctuary vide Notification No. Ft. 43-51/50-IV dated 19 th September 1962, further revised vide No. 6-25/73-SF dated 17 th September 1975 and the final Notification issued vide notification no. FFE-B-F(6)-11/2005-II dated 7 th June, 2013 under Section 26 A of the Wildlife (Protection) Act,1972, rationalized the boundary of the sanctuary.
AND WHEREAS, the Wildlife Sanctuary is rich in floral diversity with species such as deodar (Cedrus deodara), silver fir (Abies pindrow), spruce (Picea smithiana), kail (Pinus wallichiana), ban (Quercus semecarpifolia) etc and there is good interface of wooded area and vast expenses of pastures that forms an ideal habitat for animals as well as birds.
AND WHEREAS, the major faunal species found in the sanctuary are common leopard (Panthera pardus), black bear (Selenarctos thibetanus), brown bear (Ursus arctos), goral (Naemorhedus goral), Himalayan thar (Hemitragus jemlachicus), Himalayan ibex (Capra ibex), Himalayan monal (Lophophorus impejanus), snow cock (Tetraogallus himalayensis), chir pheasent (Catreus wallichii), koklas (Pucrasia macrolopha), chakor (Alectoris chukar) etc.
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Tundah Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from zero to one kilometres around the boundary of Tundah Wildlife Sanctuary, in Chamba District in the State of Himachal Pradesh as the Tundah Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of zero to one kilometres around the boundary of Tundah Wildlife Sanctuary and the area of the Eco-sensitive zone is 46.74 square kilometres and the zero extent of Eco-sensitive Zone towards Northern and North Eastern side is due to presence of district boundary of Lahul and Spiti exhibiting snow bound mountains with glaciers and inaccessible terrains.
(2) The boundary description of the Tundah Wildlife Sanctuary and its Eco-sensitive Zone is appended as Annexure-I.
(3) The maps of the Tundah Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-II A, Annexure-II B and Annexure-II C.
(4) Lists of geo-coordinates of the boundary of the Tundah Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure-III.
(5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Ecosensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification and get it duly approved by the competent authority in the State.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan -
(i) Environment;
(ii) Forest and Wildlife;

(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Municipal;
(viii) Himachal State Pollution Control Board.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved by the State Government shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified herein above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural area with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Department of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, ecoeducation and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 made under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluents in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by the State Government, whichever is more stringent.
(9) Solid wastes.-Disposal and Management of solid wastes shall be as under -
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed of in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under -
(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28 th March, 2016;
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.
(13) E-waste.- The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts, rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be in compliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under -
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco- sensitive Zone;

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that, non-polluting industries shall be allowed within Eco- Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited.
4. Use or production or processing of any hazardous substance.
Prohibited.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited.
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
7. Setting up of brick kilns. Prohibited.
8. Use of polythene bags. Prohibited.
9. Commercial use of firewood. Prohibited.
10. Introduction of exotic species. Prohibited.
B. Regulated Activities
11. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of the Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of the Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
12. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents:

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
13. Small scale non polluting industries.
Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
14. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.
15. Collection of Forest Produce or Non-Timber Forest Produce.
Regulated under applicable laws.
16. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws of underground cabling may be promoted.
17. Infrastructure including civic amenities.
Taking measures of mitigation, as per applicable laws, rules and regulation and available guidelines.
18. Widening and strengthening of existing roads and construction of new roads.
Taking measures of mitigation, as per applicable laws, rules and regulations and available guidelines.
19. Undertaking other activities related to tourism like over flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

21. Movement of vehicular traffic at night.
Regulated for commercial purpose under applicable laws.
22. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted as per the applicable laws for use of locals.
23. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per the applicable laws.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment Act, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S.No. Constituent of the Monitoring Committee Designation

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner shall be competent to file complaint under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional Measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Order of Court or Tribunal .-The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
