PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पयाावरण, वन और जलवाय ुपररवतान मतं्रालय ऄजधसचूना नइ ददल्ली, 23 जनवरी, 2020 का.अ. 410(ऄ).—प्रारुप ऄजधसूचना भारत के राजपत्र, ऄसाधारण में भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 5644(ऄ) तारीख 30 ऄक्टूबर, 2018 द्वारा प्रकाजित की गइ थी जजसमें ईन सभी व्यजियों से, जजनको ईससे प्रभाजवत होने की संभावना थी, ईस तारीख से, जजसको ईि ऄजधसूचना को ऄंतर्ववष्ट करने वाले राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थी, साठ ददन की ऄवजध के भीतर, अक्षेप और सुझाव अमजंत्रत दकए गए थे; और, ईि प्रारुप ऄजधसूचना को ऄंतर्ववष्ट करन ेवाली राजपत्र की प्रजतयां जनता को 5 नवम्बर, 2018 को ईपलब्ध करा दी गइ थीं; और, प्रारुप ऄजधसूचना के ईत्तर में व्यजियों और पणधाररयों से कोइ भी अक्षेप और सुझाव प्राप्त नहीं हुए; और, 1967 में घोजित पवांआट केलीमर वन्यजीव ऄभयारण्य 17.29 वगा दकलोमीटर (1728.81 हके्टेयर) के्षत्र में फैला हुअ ह ैऔर 2013 में घोजित खंड-ख, 5.22 वगा दकलोमीटर (521.36 हके्टेयर) क्षते्र में फैला हुअ ह ैऔर तजमलनाडु राज्य में नागापट्टीनम जजला के वेदारान्यम तालुक में जस्ट्थत ह।ै यह नागापट्टीनम के दजक्षण में 60 दकलोमीटर और जहां पलक जलसंजध बंगाल की खाडी से जमलती ह ैमें जस्ट्थत ह।ै ऄभयारण्य का कुल क्षेत्रफल 22.51 वगा दकलोमीटर ह;ै स.ं 378] नइ ददल्ली, मगंलवार, जनवरी 28, 2020/माघ 8, 1941 No. 378] NEW DELHI, TUESDAY, JANUARY 28, 2020/MAGHA 8, 1941 सी.जी.-डी.एल.-अ.-05022020-215924 CG-DL-E-05022020-215924 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, ऄभयारण्य दजक्षणी भारत में काला जहरण ब्लैकबक की सबसे ऄजधक संख्या का पयाावास ह ैस्ट्थानीय रूप से वेजलमैन के रूप में जाना जाता ह,ै काला जहरण ब्लैकबक भारत में खुल ेभू-भाग के बहुत कम पिुओं में से एक ह।ै ऄभयारण्य के दजक्षणी भाग में जस्ट्थत घास भूजम ब्लैकबक के प्राकृजतक पयाावास का स्ट्थान ह;ै और, ऄभयारण्य पाररजस्ट्थजतकी-प्रणाली ईष्णकरटबंधीय िुष्क-सदाबहार वन, खुले घासभूजम और ज्वारीय जमट्टी फ्लैट का ऄजद्वतीय जमश्रण ह,ै जो देि में एकमात्र दकस्ट्म का ह।ै यह देि में ऄजद्वतीय िुष्क-सदाबहार वन का सबसे बडा फैलाव का एक वास ह;ै और, ऄभयारण्य और ईसके असपास की अर्द्ाभूजम ईत्तर से जलीय पजक्षयों के जलए महत्त्वपूणा िीतकालीन मैदान ह।ै ऄभयारण्य में ग्रेटर फ्लेममगो समेत प्रवासी जल पजक्षयों की लगभग 100 प्रजाजतयां जसतंबर के बाद से आसके असपास के क्षेत्रों में अन ेलगती हैं और ईत्तर में वापस जाने से पहल ेजनवरी तक यहां रहती हैं। ऄभयारण्य तट लुप्तप्राय ओजलवे ररडल ेकछुए का जनयजमत घोंसला स्ट्थल ह;ै और, पवांआट केलीमर वन्यजीव ऄभयारण्य खण्ड-ख में वनस्ट्पजतय और जीवजंतु की ऄच्छी जवजवधता ह।ै संरजक्षत के्षत्र में मुख्य वनस्ट्पजत सफेद बबूल (ऄकैजिया लेईकोफलोया), नीम (ऄजादीराचट आंजडका), बाघ बीन (देल्नीक्स इलाटा), पीपल री (दफकुस रेलीजगओसा), कुबन-लौरेल (दफकुस रेतुसा), आंजडयन बीच री (पोंगजमया जपन्नाटा), साल्ट बुस मैंग्रोव (ऄरथरोकनेमुम आंजडकुम), वाआल्ड बैरी (ऄल्लोफयलुस सेरााटुस), ब्लैक ओलुम (जसयजगईम कुजमनी), नैडल बुस (ऄजजमा टटेराकंथा), गलांदलुार जाटरोफा (जटरोफा गलांदजुलफेरा), कैट-थोरन (सकुटीऄ मयररटना), अदद पाए जाते हैं; और, ऄभयारण्य में पजक्षयों, जततजलयों, सरीसृपों, ईभयचरों, स्ट्तनधाररयों की जवजवधता ह।ै पजक्षयों में कट्टील आग्रेट (बुबुल्कुस आबस), बारटेल्ड गोदजवट (जलमोसा लपपोनीका) अदद हैं; और ऄभयारण्य में सरीसृपों की लगभग 18 प्रजाजतयां पहचान की गइ। ऄभयारण्य के समुर्द् तट में मुख्य सरीसृप आंजडयन स्ट्टारेड टॉरटोआस (गओेचेलोन आलेगंस), आंजडयन चमेलेओन (चमेलओे जयलाजनकुस), आंजडयन मॉनीटर जलजाडा (वनुास बेंगालेंजसस), कॉमन मस्ट्कक (मबुया करीनाटा), रेट स्नेक (पटयस मुकोसुस), सामान्य आंजडयन ब्रॉन्जबैक (डेंड्रोलादफस रीसरटस), लुप्तप्राय ओजलव ररदलेय टरटल (लेजपडोचेली सोजलवाकै), अदद ह;ै ईभयचरों की लगभग 9 प्रजाजतयां ऄजभजलजखत की गइ ह ैजजसमें जस्ट्कपपर फ्राग से (राना सायनोफल्यकरटस), कॉमन ग्रीन फ्राग (रानो हके्साडाक्टायला), री फ्राग (पोल्यपेदटेस मकुलाटेस) और कॉमन टोड (बुफो मेलानोस्ट्टीकटुस), िाजमल ह;ै और, पवांआट केलीमर वन्यजीव ऄभयारण्य खण्ड-ख वाजणज्य रूप से महत्त्वपूणा समुर्द्ी झींगा और मछजलयां जैसे पी. आनाआयमसदीकुस, पी. मोनोडोन, हील्सा आजलसा और चानोस चानोस के जलए जलांडक और पोिण भूजम का बडा वेदारान्यम दलदल ह।ै आनके ऄलावा ऄन्य समुर्द्ापगामी प्रजाजतयां ह,ै दलदल की मछली जीवजंतु मुख्यत: मुल्लेट प्रजाजतयों द्वारा प्रजतजनजधत्व करती ह।ै जलाियों और औद्योजगक नमक कायों के कम लवणता संघजनत में जवदेिी ओरओचरोजमस मोस्ट्साजम्बकुस (जतलाजपया मोस्ट्साजम्बका) की प्रचुर मात्रा ह ै और मानसून के दौरान ऄभयारण्य में जलमग्न के्षत्र ह।ै पवाआंट केलीमर का तट नवबंर से फरवरी तक मछजलयों और झींगों के जलए महत्त्वपूणा मछली ऄवतरण स्ट्थल ह;ै और, पवांआट केलीमर वन्यजीव ऄभयारण्य खण्ड-ख के चारों ओर के क्षेत्र को, जजसका जवस्ट्तार और सीमाएं आस ऄजधसूचना के परैा 1 में जवजनर्ददष्ट हैं, पयाावरण की दजृष्ट से पाररजस्ट्थजतकी संवेदी जोन के रूप में सुरजक्षत और संरजक्षत करना तथा ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योग या ईद्योगों की श्रेजणयों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजिद्ध करना अवश्यक ह;ै भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 3 ऄतः, ऄब, केन्र्द्ीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ परठत पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आसमे आसके पश्चात् पयाावरण ऄजधजनयम कहा गया ह)ै की धारा 3 की ईपधारा (1) तथा ईपधारा (2) के खंड (v) और खंड (xiv) और ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करत ेहुए, नागपरट्टनम जजले के तजमलनाडु राज्य में पवाआंट केलीमर वन्यजीव ऄभयारण्य खंड ख की सीमा के चारों ओर 0.14 दकलोमीटर से 4 दकलोमीटर तक के जवस्ट्ताररत क्षेत्र को पवाआंट केलीमर वन्यजीव ऄभयारण्य खंड ख पाररजस्ट्थजतकी संवेदी जोन (जजसे आसमें आसके पश् चात ्पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप में ऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार ह,ै ऄथाात ्:-
1. पाररजस्ट्थजतकी सवंदेी जोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार पवाआंट केलीमर वन्यजीव ऄभयारण्य खंड ख के चारों ओर 0.14 दकलोमीटर से 4.00 दकलोमीटर तक फैला हुअ ह ै और पाररजस्ट्थजतकी संवेदी जोन का क्षेत्रफल 88.93 वगा दकलोमीटर ह।ै
(2) पवाआंट केलीमर वन्यजीव ऄभयारण्य खंड ख और पाररजस्ट्थजतकी संवेदी जोन की सीमा का जववरण ईपाबधं I के रुप में संलग्न ह।ै
(3) सीमा जववरण और ऄक्षांि और दिेांतर के साथ पाररजस्ट्थजतकी संवेदी जोन के पवाआंट केलीमर वन्यजीव ऄभयारण्य खंड ख का मानजचत्र ईपाबधं-IIक, ईपाबधं-IIख, ईपाबधं-IIग, ईपाबधं-IIघ, और ईपाबधं-IIङ, के रूप में संलग्न हैं।
(4) पाररजस्ट्थजतकी संवेदी जोन और पवाआंट केलीमर वन्यजीव ऄभयारण्य खंड ख की सीमा के भू-जनदेिांकों की सूची ईपाबधं-III के सारणी क और सारणी ख में दी गइ ह ै।
(5) मुख्य मबदओुं के भू-जनदेिांकों के साथ पाररजस्ट्थजतकी संवेदी जोन के ऄतंगात अन ेवाल ेग्रामों की सूची ईपाबधं-IV के रूप में सलंग्न ह।ै
2. पाररजस्ट्थजतकी सवंदेी जोन के जलए अचंजलक महायोजना.– (1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोजन के जलए, राजपत्र में आस ऄजधसूचना के प्रकािन की तारीख से दो विा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और आस ऄजधसूचना में ददए गए ऄनुबंधों का पालन करत ेहुए, राज्य सरकार के सक्षम प्राजधकारी के ऄनुमोदनाथा एक अंचजलक महायोजना बनायेगी।
(2) राज् य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना में जवजनर्ददष् ट दकए गए हों के ऄनसुार तथा सुसंगत कें र्द्ीय और राज् य जवजधयों के ऄनुरूप तथा कें र्द्ीय सरकार द्वारा जारी मागाजनदेिों, यदद कोइ हों, द्वारा तैयार होगी ।
(3) अंचजलक महायोजना, ईि योजना में पाररजस्ट्थजतकी और पयाावरण संबंधी सरोकारों को समाकजलत करने के जलए राज् य सरकार के जनम्नजलजखत जवभागों के परामिा स ेतैयार होगी, ऄथाात:्-
(i) पयाावरण;
(ii) वन और वन्यजीव;
(iii) कृजि;
(iv) राजस्ट्व;
(v) िहरी जवकास;
(vi) पयाटन;
(vii) ग्रामीण जवकास;
(viii) मसचाइ और बाढ़ जनयंत्रण; 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ix) नगरपाजलका;
(x) पंचायती राज;
(xi) लोक जनमााण जवभाग;
(xii) राजमागा; और
(xiii) तजमलनाडु राज्य प्रदिूण जनयंत्रण बोडा ।
(4) अंचजलक महायोजना ऄनुमोददत जवद्यमान भू-ईपयोग, ऄवसंरचना और दियाकलापों पर कोइ जनबंधन ऄजधरोजपत नहीं करेगी जब तक आस ऄजधसूचना में जवजनर्ददष्ट न हो,तथा अचंजलक महायोजना में सभी ऄवसंरचनाओं और दियाकलापों में जो ऄजधक दक्षता और पाररजस्ट्थजतकी-ऄनकूुल हों का संवधान करेगी ।
(5) अंचजलक महायोजना में ऄनाच्छाददत क्षेत्रों की पुनः बहाली, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मृदा और नमी के संरक्षण, स्ट्थानीय समुदायों की अवश्यकताओं तथा पाररजस्ट्थजतकी और पयाावरण के ऐसे ऄन्य पहलुओं की व्यवस्ट्था की जाएगी जजन पर ध्यान ददया जाना अवश्यक ह।ै
(6) अंचजलक महायोजना में सभी जवद्यमान पूजा स्ट् थलों, ग्रामों और िहरी बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, उपजाउ भूजम, ईद्यानों और ईद्यानों की तरह के हररत क्षेत्रों, ईद्यान कृजि क्षेत्रों, बगीचों, झीलों और ऄन्य जल जनकायों का ऄभ्यंकन करेगी और आस में जवद्यमान और प्रस्ट्ताजवत भू- ईपयोग की जविेिताओं का ब्यौरा देने वाल े ऄनुसमर्वथत मानजचत्र भी ददए जाएंगे।
(7) अंचजलक महायोजना पाररजस्ट्थजतकी संवेदी जोन में जवकास को जवजनयजमत करेगी और सारणी में सूचीबद्ध पैरा- 4 में प्रजतजिद्ध और जवजनयजमत दियाकलापों का ऄनुपालन करेगी और स्ट्थानीय समुदायों की जीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी ऄनुकूल जवकास को सुजनजश्चत और ईसकी ऄजभवृजद्ध भी करेगी।
(8) अंचजलक महायोजना, प्रादेजिक जवकास योजना की सह-जवस्ट्तारी होगी ।
(9) आस प्रकार ऄनुमोददत अंचजलक महायोजना आस ऄजधसूचना के ईपबंधों के ऄनुसार मानीटरी के ऄपने कायों को करने के जलए एक संदभा दस्ट्तावेज तैयार करेगी ।
(10) ऄनुमोददत अंचजलक महायोजना मानीटरी सजमजत के जलए एक संदभा दस्ट्तावेज होगी तादक वह आस ऄजधसूचना के ईपबंधों के ऄनुसार मानीटरी के ऄपने कताव्यों का जनवाहन कर सके ।
3. राज्य सरकार द्वारा दकए जान ेवाल ेईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:-
(1) भ-ूईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन में वनों, ईद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के प्रयोजनों के जलए जचजन्हत दकए गए ईद्यानों और खुल ेस्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक दियाकलापों के जलए ईपयोग या संपररवतान नहीं दकया जाएगा: परन्त ुपाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क), में जवजनर्ददष्ट प्रयोजन से जभन्न प्रयोजन के जलए कृजि और ऄन्य भूजम का संपररवतान, मानीटरी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा ऄनुमोदन से क्षेत्रीय नगर योजना ऄजधजनयम तथा यथा लाग ूकेन्र्द्ीय सरकार और राज्य सरकार के ऄन्य जनयमों और जवजनयमों के ऄधीन तथा आस ऄजधसूचना के ईपबंधों के ऄनुसार स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को पूरा करन ेके जलए ऄनजु्ञात दकया जाएगा:-
(i) जवद्यमान सडकों को चौडा करना और ईन्हें सुदढृ़ करना और नइ सडकों का संजनमााण;
(ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 5
(iii) प्रदिूण ईत्पन्न न करन ेवाले लघु ईद्योग;
(iv) कुटीर ईद्योगों जजनके ऄंतगात ग्रामीण ईद्योग भी हैं; सुजवधाजनक भंडार और स्ट्थानीय सुजवधाएं सहायक पाररजस्ट्थजतकी पयाटन जजसके ऄंतगात ग्रहवास सजम्मजलत ह;ै और
(v) पैराग्राफ 4 के ऄधीन ददए गए संवर्वधत दियाकलाप: परंत ुयह और भी दक क्षेत्रीय नगर योजना ऄजधजनयम के ऄधीन सक्षम प्राजधकारी के पूवा ऄनमुोदन के जबना तथा राज्य सरकार के ऄन्य जनयमों और जवजनयमों और संजवधान के ऄनुच्छेद 244 के ईपबंधों तथा तत्समय प्रवृत्त जवजध, जजसके ऄंतगात ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता) ऄजधजनयम, 2006 (2007 का 2) भी अता ह,ै का ऄनुपालन दकए जबना वाजणजज्यक या औद्योजगक जवकास दियाकलापों के जलए जनजातीय भूजम का प्रयोग ऄनुज्ञात नहीं होगा: परंत ुयह और भी दक पाररजस्ट् थजतकी संवेदी जोन के भीतर अन ेवाली भूजम के ऄजभलेखों में हुइ दकसी गलती को, मानीटरी सजमजत के जवचार प्राप्त करने के पश्चात,् राज्य सरकार द्वारा प्रत्येक मामले में एक बार सुधारा जाएगा और ईि गलती को सुधारन ेकी सूचना कें र्द्ीय सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय को दी जाएगी: परंत ुयह और भी दक ईपयुाि गलती को सुधारन ेमें, आस ईप-पैरा में यथा ईपबंजधत के जसवाय, दकसी भी दिा में भू-ईपयोग का पररवतान सजम्मजलत नहीं होगा; (ख) ऄनपु्रयुक् त या ऄनुत् पादक कृजि क्षेत्रों में पुन: वनीकरण तथा पयाावासों और जैव- जवजवधता की बहाली के प्रयास दकए जाएंगे ।
(2) प्राकृजतक जल स्रोत.- अंचजलक महायोजना में सभी प्राकृजतक जल स्त्रोतों के अवाह क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण और नवीकरण के जलए योजना सजम्मजलत होगी और राज् य सरकार द्वारा ऐसे क्षेत्रों पर या ईनके जनकट जवकास दियाकलापों प्रजतजिद्ध करन ेके बारे में जो ऐसे क्षेत्रों के जलए ऄजहतकर हो ऐसी रीजत से मागादिाक जसद्धांत तैयार दकए जाएगंे।
(3) पयाटन या पाररजस्ट्थजतकी पयाटन.– (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन दियाकलाप या जवद्यमान पयाटन दियाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन के जलए होगा । (ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य सरकार के पयाावरण और वन जवभागों के परामिा से पयाटन जवभाग द्वारा बनायी जाएगी । (ग) पयाटन महायोजना अंचजलक महायोजना का घटक होगी । (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जायेगी। (ङ) पाररजस्ट्थजतकी पयाटन संबंधी दियाकलाप जनम् नानुसार जवजनयजमत दकए जाएंग:े-
(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी ऄजधक जनकट हो ,दकसी होटल या ररजॉटा का नया सजन्नमााण ऄनुज्ञात नहीं दकया जाएगा: परंत ुयह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की दरूी से परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक होटलों और ररजॉटा का स्ट्थापन केवल पूवा पररभाजित और नामजनर्ददष्ट क्षेत्रों में पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए ही ऄनुज्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेदी जोन के ऄन्दर सभी नए पयाटन दिया-कलापों या जवद्यमान पयाटन 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] दियाकलापों का जवस्ट्तार, केन्र्द्ीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय द्वारा जारी मागादिाक जसद्धांतो तथा पाररजस्ट्थजतकी पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल दनेे वाले राष्ट्रीय व्याघ्र संरक्षण प्राजधकरण द्वारा जारी पाररजस्ट्थजतकी पयाटन संबंधी मागादिाक जसद्धांतो (समय-समय पर यथा संिोजधत) के ऄनुसार होगा;
(iii) अंचजलक महायोजना का ऄनुमोदन होने तक, पयाटन के जलए जवकास और जवद्यमान पयाटन दियाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजनर्ददष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के अधार पर संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नए होटल, ररजाटा या वाजणजज्यक स्ट्थापन का संजन्नमााण ऄनजु्ञात नहीं होगा ।
(4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेदी जोन के ऄतंगात अन ेवाल ेबहुमूल्य प्राकृजतक जवरासत के सभी स्ट्थलों जैसे दक जीन कोि अरजक्षत के्षत्र, िैल जवरचनाएं, जल प्रपातो, झरन,े दरो, ईपवनों, गुफाए,ं स्ट्थलों, वनपथ, रोहण मागा, ईत्प्रपातो अदद की पहचान की जाएगी और ईनकी सुरक्षा और संरक्षण के जलए अंचजलक महायोजना के भाग के रूप में एक जवरासत संरक्षण योजना बनायी जाएगी।
(5) मानव जनर्वमत जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, कलाकृजत- क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्य संबधी, सौंदयाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण के जलए अंचजलक महायोजना के भाग के रूप में एक जवरासत संरक्षण योजना बनायी जाएगी।
(6) ध् वजन प्रदिूण.– पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदिूण (जवजनयमन और जनयंत्रण) जनयम, 2000 में जनयत ईपबंधों के ऄनुसार में पाररजस्ट्थजतकी-संवेदी जोन में ध्वजन प्रदिूण के जनयंत्रण और जनवारण का ऄनपुालन दकया जाएगा।
(7) वाय ुप्रदिूण.- पाररजस्ट्थजतकी संवेदी जोन में, वायु प्रदिूण की जनवारण और जनयंत्रण, वाय ु(प्रदिूण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों के ऄनुसार ऄनुपालन दकया जाएगा।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन में ईपचाररत बजहस्राव का जनस्ट्सारण, और पयाावरण ऄजधजनयम ऄधीन बनाए गए जनयमों के ऄन्तगात सजम्मजलत दकए गए पयाावरणीय प्रदिूण के जनस्ट्सारण संबंधी साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों ,आनमें जो भी ऄजधक कठोर हों ,के ऄनुसार दकया जाएगा।
(9) ठोस ऄपजिष्ट.- ठोस ऄपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन में ठोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357 (ऄ), तारीख 8 ऄप्रलै, 2016 के ऄधीन प्रकाजित ठोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों )इ एस एम( का प्रयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनरुूप ठोस ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रंबंधन ऄनुज्ञात दकया जा सकेगा।
(10) जवै जचदकत्सा ऄपजिष् ट का प्रबधंन.- जैव जचदकत्सा ऄपजिष् ट का प्रबंधन जनम्नानुसार दकया जाएगा:- भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 7 (क) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन. 343 (ऄ), तारीख 28 माचा, 2016 के ऄधीन प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (ख) पाररजस्ट्थजतकी संवदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करत े हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप जैव-जचदकत्सा ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रंबंधन ऄनुज्ञात दकया जा सकेगा।
(11) पलाजस्ट्टक ऄपजिष्ट का प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में पलाजस्ट्टक ऄपजिष्ट का प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना सं.सा.का.जन 340(ऄ), तारीख 18 माचा, 2016 के द्वारा प्रकाजित पलाजस्ट्टक ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधो के ऄनुसार दकया जाएगा।
(12) जनमााण और जवध्वसं ऄपजिष्ट का प्रबधंन.- पाररजस्ट्थजतकी संवेदी जोन में जनमााण और जवध्वंस ऄपजिष्ट का प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना सं.सा.का.जन 317(ऄ), तारीख 29 माचा, 2016 के द्वारा प्रकाजित संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट का प्रबंधन का जनपटान भारत सरकार पयाावरण, वन और जलवाय ु पररवतान मंत्रालय द्वारा प्रकाजित तथा समय- समय पर यथा संिोजधत इ–ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(14) यानीय-यातायात.- वाहन-यातायात का संचलन अवास-ऄनुकूल तरीके से जवजनयजमत दकया जाएगा और आस संबंध में अंचजलक महायोजना में जविेि ईपबंध सजम्मजलत दकए जाएंगे तथा अंचजलक महायोजना के तैयार होन े और राज्य सरकार के सक्षम प्राजधकारी द्वारा ऄनुमोददत दकए जाने तक, मानीटरी सजमजत सुसंगत ऄजधजनयमों और ईनके ऄधीन बनाए गए जनयमों और जवजनयमों के ऄनुसार वाहनों की अवाजाही के ऄनुपालन की मानीटरी करेगी।
(15) यानीय प्रदिूण.- यानीय प्रदिूण की रोकथाम और जनयंत्रण लागू जवजधयों के ऄनुसार दकया जाएगा और स्ट्वच्छतर ईंधन के प्रयोग के प्रयास दकए जाएंग े।
(16) औद्योजगक इकाइया.ं- (i) राजपत्र में आस ऄजधसूचना के प्रकािन पर या ईसके पश्चात पाररजस्ट्थजतकी संवेदी जोन में दकसी नए प्रदिूणकारी ईद्योग की स्ट्थापना की ऄनुमजत नहीं दी जाएगी।
(ii) जब तक आस ऄजधसूचना में जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन में कें र्द्ीय प्रदिूण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी मागादिाक जसद्धांतो में दकए गए ईद्योगों के वगीकरण के ऄनुसार केवल गरै- प्रदिूणकारी ईद्योगों की स्ट्थापना ऄनुज्ञात होगी। आसके ऄजतररि, गरै-प्रदिूणकारी कुटीर ईद्योगों को बढ़ावा ददया जाएगा।
(17) पहाडी ढलानों का सरंक्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार दकया जाएगा:- (क) अंचजलक महायोजना में पहाडी ढलानों के ईन क्षेत्रों को दिााया जाएगा जजनमें दकसी भी संजनमााण की ऄनजु्ञा नहीं होगी । (ख) जजन ढ़लानों या जवद्यमान खडी पहाडी ढलानों में ऄत्यजधक भू-क्षरण होता ह ैईनमें दकसी भी संजनमााण की ऄनुमजत नहीं दी जाएगी ।
4. पाररजस्ट्थजतकी सवंदेी जोन में प्रजतजिद्ध या जवजनयजमत दकए जान े वाल े दियाकलापों की सचूी.- पाररजस्ट्थजतकी संवेदी जोन में सभी दियाकलाप, पयाावरण (संरक्षण) ऄजधजनयम, और तटीय जवजनयमन जोन ऄजधसूचना, 2011 और पयाावरणीय समाघात जनधाारण ऄजधसूचना, 2006 सजहत ईसके ऄधीन बने जनयमों और वन (संरक्षण) 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्यजीव ) (संरक्षण) ऄजधजनयम , 1972 (1972 का 53), सजहत ऄन्य लाग ूजनयमों तथा ईनमें दकए गए संिोधनों के ऄनुसार िाजसत होंगे और नीचे दी गइ सारणी में जवजनर्ददष्ट रीजत से जवजनयजमत होंगे, ऄथाात:्- सारणी ि. स.ं

1. वाजणजज्यक खनन, पत्थर ईत्खनन और ऄपघिाण आकाइयां । (क) वास्ट्तजवक स्ट्थानीय जनवाजसयों की घरेल ू अवश्यकताओं जजसमें जनजी ईपयोग के जलए मकानों के संजनमााण या मरम्मत के जलए धरती को खोदना और मकान बनान े के जलए दिेी टाआल्स या ईंटों का जनमााण करना भी सजम्मजलत ह,ै के जसवाय सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनज), पत्थर की खानें और ईनको तोडने की आकाइयां तत्काल प्रभाव से प्रजतजिद्ध होंगी। (ख) खनन प्रचालन, माननीय ईच्चतम न्यायालय की ररट याजचका (जसजवल) सं. 1995 का 202 टी.एन. गौडाबमान जथरुमूलपाद बनाम भारत संघ के मामले में अदेि तारीख 4 ऄगस्ट्त, 2006 और ररट याजचका (सी) सं. 2012 का 435 गोवा फाईंडेिन बनाम भारत संघ के मामले में तारीख 21 ऄप्रलै, 2014 के अदेि के ऄनुसरण में प्रचालन होगा ।
2. प्रदिूण )जल , वाय,ु मृदा, ध्वजन अदद( ईत्पन्न करने वाल े ईद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेदी जोन में कोइ नया ईद्योग लगान े और वतामान प्रदिूणकारी ईद्योगों का जवस्ट्तार करने की ऄनुज्ञा नहीं होगी: जब तक, दक आस ऄजधसूचना में जवजनर्ददष्ट न हो ,पाररजस्ट्थजतकी ,संवेदी जोन में फरवरी 2016 में कें र्द्ीय प्रदिूण जनयंत्रण बोडा द्वारा जारी ददिाजनदेिों में दकए गए ईद्योगों के वगीकरण के ऄनुसार केवल गैर प्रदिूणकारी ईद्योगों की स्ट्थापना होगी। आसके ऄजतररि, गैर- प्रदिूणकारी कुटीर ईद्योगों को प्रोत्साहन ददया जाएगा।
3. वृहत जल जवद्युत पररयोजनाओं की स्ट्थापना । लाग ू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन्यथा ईपबंजधत के जसवाय) होंगे।
4. दकसी पररसंकटमय पदाथों का ईपयोग या ईत्पादन या प्रस्ट्संकरण । लाग ू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन्यथा ईपबंजधत के जसवाय) होंगे।
5. प्राकृजतक जल जनकायों या भूजम क्षेत्र में ऄनुपचाररत बजहस्रावों का जनस्ट्सारण । लाग ू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन्यथा ईपबंजधत के जसवाय) होंगे।
6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन में नइ या जवद्यमान अरा जमलों का जवस्ट्तार ऄनुज्ञात नहीं होगा ।
7. ईंट भट्टों की स्ट्थापना । लाग ू जवजधयों के ऄनुसार प्रजतजिद्ध (ऄन्यथा ईपबंजधत के जसवाय) होंगे। ख. जवजनयजमत दियाकलाप भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 9
8. होटलों और ररजॉटो का वाजणजज्यक स्ट्थापन । पाररजस्ट्थजतकी पयाटन दियाकलापों हते ु लघु ऄस्ट्थायी संरचनाओं के जनमााण के जसवाय, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन की जवस्ट्तार तक, आनमें जो भी जनकट हो, नए वाजणजज्यक होटलों और ररसोटो की स्ट्थापना ऄनुज्ञात नहीं होगी: परंत,ु संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर या पाररजस्ट्थजतकी संवेदी जोन की जवस्ट्तार तक, आनमें जो भी जनकट हो, सभी नए पयाटन दियाकलाप करन े या जवद्यमान दियाकलापों का जवस्ट्तार पयाटन महायोजना और यथालागू मागादिाक जसद्धांतों के ऄनुसार होगा।
9. संजनमााण दियाकलाप । संरजक्षत क्षेत्र की सीमा से)क( एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन की जवस्ट्तार तक, आनमें जो भी जनकट हो ,दकसी भी नये वाजणजज्यक संजनमााण की ऄनुज्ञा नहीं होगी: परंत ु स्ट्थानीय लोगों को ऄपनी अवास सम्बन्धी जनम्नजलजखत अवश्यकताओं को पूरा करन ेके जलए, पैराग्राफ 3 के ईप पैराग्राफ (1) में सूचीबद्ध दियाकलापों सजहत ऄपने ईपयोग के जलए, ऄपनी भूजम में भवन ईप-जवजधयों के ऄनुसार, संजनमााण करन ेकी ऄनुज्ञा होगी। परन्त ु यह और दक गैर–प्रदिूणकारी लघ ु ईद्योगों से संबंजधत संजनमााण दियाकलाप लाग ू जनयमों और जवजनयमों, यदद कोइ हों, के ऄनुसार सक्षम प्राजधकारी की पूवा ऄनुज्ञा से जवजनयजमत दकए जाएंगे और वे न्यूनतम होंग े। (ख) एक दकलोमीटर से अग े ये अंचजलक महायोजना के ऄनुसार जवजनयजमत होंगे ।
10. गैर प्रदिूणकारी लघ ुईद्योग। फरवरी, 2016 में केन्र्द्ीय प्रदिूण जनयंत्रण बोडा द्वारा जारी ईद्योगों के वगीकरण के ऄनुसार गैर-प्रदिूणकारी ईद्योगों तथा पाररजस्ट्थजतकी संवेदी जोन से देिी सामजग्रयों से ईत्पाद बनान ेवाले ऄपररसंकटमय लघु और सेवा ईद्योगों, कृजि, पुष्प कृजि, बागबानी या कृजि अधाररत ईद्योगों की स्ट्थापना सक्षम प्राजधकारी द्वारा ऄनुज्ञात होगी।
11. वृक्षों की कटाइ । (क) राज्य सरकार के सक्षम प्राजधकारी की पूवा ऄनुमजत के जबना वन या सरकारी या राजस्ट्व या जनजी भूजम पर वृक्षों की कटाइ की ऄनजु्ञा नहीं होगी । (ख) वृक्षों की कटाइ कें र्द्ीय या संबंजधत राज्य के ऄजधजनयमों और ईनके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार जवजनयजमत होगी ।
12. वन ईत्पादों या गैर काष्ठ वन ईत्पादों का संग्रह । लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
13. फमों, कारपोरेट, कंपजनयों द्वारा बडे पैमाने पर वाजणजज्यक पिधुन संपदा और कुक्कुट फामों की स्ट्थापना । स्ट्थानीय अवश्यकताओं को पूरा करन े के जलए लाग ू जवजधयों के ऄनुसार जवजनयजमत (ऄन्यथा प्रदान दकए गए) होंगे । 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
14. जवद्युत और संचार टॉवरो का पररजनमााण और तार-जबछाने तथा ऄन्य बुजनयादी ढांचे की व्यवस्ट्था । लागू जवजधयों के ऄनुसार जवजनयजमत होगा। भूजमगत केबल जबछाने को बढ़ावा ददया जाएगा ।
15. नागररक सुजवधाओं सजहत बुजनयादी ऄवसंरचनाएं। यह व्यवस्ट्था लागू जवजधयों, जनयमों, जवजनयमों और ईपलब्ध ददिाजनदेिों के ऄनुसार ईपिमन ईपायों के साथ की जाएगी।
16. जवद्यमान सडकों को चौडा करना, ईन्हें सुदढृ बनाना और नइ सडकों का जनमााण करना। यह व्यवस्ट्था लागू जवजधयों, जनयमों, जवजनयमों और ईपलब्ध मागादिाक जसद्धांतो के ऄनुसार ईपिमन ईपायों के साथ की जाएगी।
17. पयाटन से संबंजधत ऄन्य दियाकलाप जैसे दक पाररजस्ट्थजतकी संवेदी जोन क्षेत्र के उपर से गमा वायु के गुब्बारे, हलेीकापटर, ड्रोन, माआिोलाआट्स ईडाना अदद। लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
18. पवातीय ढ़लानों और नदी तटों का संरक्षण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
19. राजत्र में यानीय यातायात का संचलन । लाग ू जवजधयों के ऄनुसार वाजणजज्यक प्रयोजन के जलए जवजनयजमत होगा ।
20. स्ट्थानीय समुदायों द्वारा चल रही कृजि और बागवानी पद्धजतयों के साथ दगु्धिाला, दगु्ध ईत्पादन, जल कृजि और मत्स्ट्य पालन। स्ट्थानीय जनता के ईपयोग के जलए लाग ूजवजधयों के ऄनुसार ऄनुज्ञात होंगे।
21. प्राकृजतक जल जनकायों या भू के्षत्र में ईपचाररत ऄपजिष्ट जल या बजहस्रााव का जनस्ट्सारण । जल जनकायों में ईपचाररत ऄपजिष्ट जल/बजहस्रााव के जनस्ट्सारण से बचा जाएगा। ईपचाररत ऄपजिष्ट जल के पुनचािण और पुन:ईपयोग के प्रयास दकए जाएंगे ऄन्यथा ईपचाररत ऄपजिष्ट जल या बजहस्रााव का जनस्ट्सारण लाग ूजवजधयों के ऄनसुार जवजनयजमत होगा।
22. सतही और भूजल का वाजणजज्यक जनष्किाण । लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
23. कृजि या ऄन्य ईपयोग के जलए खुले कुएं, बोर कुएं अदद का जनमााण । समुजचत प्राजधकारी द्वारा जवजनयजमत दकया जाएगा और दियाकलाप की सख्त मानीटरी की जाएगी।
24. ठोस ऄपजिष् ट प्रबंधन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
25. जवदेिी प्रजाजतयों को लाना । लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
26. पाररजस्ट्थजतकी पयाटन। लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा ।
27. पॉजलथीन बैग का ईपयोग। पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात पॉजलथीन बैग का ईपयोग ऄनुज्ञात ह:ै जवजिष्ट अवश्यकता के अधार पर, यह लागू जवजधयों के ऄनुसार जवजनयजमत होगा ।
28. वाजणजज्यक संकेत बोडा और होर्डडग का ईपयोग। लाग ूजवजधयों के ऄनुसार जवजनयजमत होगा । ग. सवंर्वधत दियाकलाप
29. विाा जल संचय । सदिय रूप से बढ़ावा ददया जाएगा ।
30. जैजवक खेती। सदिय रूप से बढ़ावा ददया जाएगा ।

32. कुटीर ईद्योग जजसके ऄतंगात ग्रामीण काररगर भी ह।ै सदिय रूप से बढ़ावा ददया जाएगा ।
33. नवीकरणीय उजाा और ईंधन का ईपयोग । बायोगैस, सौर प्रकाि आत्यादद को सदिय रूप से बढ़ावा ददया जाएगा ।
34. कृजि वाजनकी । सदिय रूप से बढ़ावा ददया जाएगा ।
35. बागान लगाना और औिधीय पौधों का रोपण । सदिय रूप से बढ़ावा ददया जाएगा ।
36. पाररजस्ट्थजतकी ऄनुकूल यातायात का प्रयोग । सदिय रूप से बढ़ावा ददया जाएगा ।
37. कौिल जवकास । सदिय रूप से बढ़ावा ददया जाएगा ।
38. ऄविजमत भूजम या वनों या पयाावासों की बहाली । सदिय रूप से बढ़ावा ददया जाएगा ।
39. पयाावरण के प्रजत जागरुकता। सदिय रूप से बढ़ावा ददया जाएगा ।
5. पाररजस्ट्थजतकी सवंदेी जोन ऄजधसचूना की मानीटरी के जलए मानीटरी सजमजत.- कें र्द्ीय सरकार, पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 3 की ईपधारा (3) के ऄधीन आस ऄजधसूचना के ईपबंधो की प्रभावी मानीटरी के जलए मानीटरी सजमजत गरठत करती ह,ै जो जनम्नजलजखत से जमलकर बनेगी, ऄथाात:्- ि. स.ं मानीटरी सजमजत का गठन पद
(i) जजला कलेक्टर ऄध् यक्ष, पदेन;
(ii) राज्य सरकार द्वारा नामजनर्ददष्ट दकया जाने वाला वन्यजीव संरक्षण के के्षत्र में काम कर रह ेगरै सरकारी संगठनों का एक प्रजतजनजध सदस्ट्य;
(iii) राज्य सरकार द्वारा नामजनर्ददष्ट दकया जाने वाला जैव जवजवधता का जविेिज्ञ सदस्ट्य;
(iv) ईप-कलेक्टर, नागापट्टीनम सदस्ट्य;
(v) खंड जवकास ऄजधकारी, वेदारान्यम सदस्ट्य;
(vi) राज्य सरकार द्वारा नामजनर्ददष्ट दकया जाने वाला पाररजस्ट्थजतकी और पयाावरण का जविेिज्ञ सदस्ट्य;
(vii) राज्य लोक जनमााण जवभाग का एक प्रजतजनजध सदस्ट्य;
(viii) राज्य प्रदिूण जनयंत्रण बोडा का एक प्रजतजनजध सदस्ट्य;
(ix) तहसीलदार, वेदारान्यम तालुक सदस्ट्य;
(x) जजला वन ऄजधकारी और वन्यजीव वाडान सदस्ट्य– सजचव।
6. जनदिे जनबधंन:- (1) मानीटरी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन की मानीटरी करेगी।
(2) मानीटरी सजमजत का कायाकाल तीन विा तक या राज्य सरकार द्वारा नइ सजमजत का पुनगाठन दकए जाने तक होगा और आसके बाद मानीटरी सजमजत राज्य सरकार द्वारा गरठत की जाएगी। 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(3) ईन दियाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का. अ. 1533(ऄ), तारीख 14 जसतंबर, 2006 की ऄनुसूची में सजम्मजलत हैं, और जो पाररजस्ट्थजतकी संवेदी जोन में अते हैं, जसवाय आसके पैरा 4 के ऄधीन सारणी में यथाजवजनर्ददष्ट प्रजतजिद्ध दियाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईि ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरण ऄनापजत्त के जलए केन्र्द्ीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को जनर्ददष्ट दकया जाएगा।
(4) ईन दियाकलापों की, जो भारत के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ.1533(ऄ) 14 जसतंबर, 2006 की ऄनुसूची में सजम्मजलत नहीं ह,ै और जो पाररजस्ट्थजतकी संवेदी जोन में अत े हैं, जसवाय आसके परैा 4 के ऄधीन सारणी में यथाजवजनर्ददष्ट प्रजतजिद्ध दियाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईसे संबंद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया जाएगा।
(5) मानीटरी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायुक् त या संबंजधत ईपायुि ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का ईल्लंघन करता ह,ै पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 19 के ऄधीन पररवाद दायर करन ेके जलए सक्षम होगा।
(6) मानीटरी सजमजत मुद्दा दर मुद्दा के अधार पर ऄपेक्षाओं पर जनभार रहत ेहुए संबद्ध जवभागों के प्रजतजनजधयों या जविेिज्ञों, औद्योजगक संगमो या संबद्ध पणधाररयों के प्रजतजनजधयों को, ऄपन े जवचार-जवमिा में सहायता के जलए अमंजत्रत कर सकेगी ।
(7) मानीटरी सजमजत प्रत्येक विा की 31 माचा तक के ऄपन ेदियाकलापों की वार्विक कारावाइ ररपोटा राज्य के मुख्य वन्यजीव वाडान को, ईपाबधं V में संलग्न प्रपत्र के ऄनुसार, ईस विा की 30 जून तक प्रस्ट्तुत करेगी ।
(8) केन्र्द्ीय सरकार का पयाावरण, वन और जलवाय ुपररवतान मंत्रालय मानीटरी सजमजत को ईसके कृत्यों के प्रभावी जनवाहन के जलए ऐसे जनदेि दे सकेगा जो वह ईजचत समझे ।
7. आस ऄजधसूचना के ईपबंधों को प्रभावी बनान ेके जलए कें र्द्ीय सरकार और राज् य सरकार, ऄजतररक् त ईपाय, यदद कोइ हों, जवजनर्ददष् ट कर सकें गी ।

8. कोइ ऄन् य महत् वपूणा मामला । 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 23rd January, 2020 S.O. 410(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 5644(E) dated the 30 th October, 2018, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 5 th November, 2018; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification; AND WHEREAS, the Point Calimere Wildlife Sanctuary which was declared as Wildlife Sanctuary in 1967 is spread over an area of 17.29 square kilometres (1728.81 Ha) and Block B, declared in 2013 is spread over an area of 5.22 square kilometres (521.36 Ha) located in Vedaranyam Taluk of Nagapattinam District in the State of Tamil Nadu. It is situated about 60 kilometres in south of the Nagapattinam where Bay of Bengal meets the Palk Strait. The total area of Sanctuary is 22.51 square kilometres; AND WHEREAS, the Point Calimere Wildlife Sanctuary with Block B is home to the largest population of the Blackbuck in Southern India locally known as Velimaan which is one of the very few animals of the Country. The grasslands located in the southern part of the Sanctuary are the natural habitat of the blackbuck; AND WHEREAS, the Sanctuary eco-system is a unique mix of tropical dry-evergreen forests, open grasslands and tidal mudflats, the only of its kind in the country. It harbours the single largest stretch of the unique dry-evergreen forest in the country; AND WHEREAS, the Sanctuary and its surrounding wetlands are important wintering grounds for water birds from the North. Nearly 100 species of migratory water birds including the Greater Flamingo start arriving to the Sanctuary and its surroundings from September onwards and stay on till January before their return to the North. The Sanctuary coast has been a regular nesting site of the endangered olive ridley turtle; AND WHEREAS, the Point Calimere Wildlife Sanctuary with Block B has good diversity of flora and fauna. Major floras found of the protected area are white babul (Acacia leucophloea), neem (Azadirachta indica), tiger bean (Delnix elata), peepal tree (Ficus religiosa), cuban-laurel (Ficus retusa), Indian beech tree (Pongamia pinnata), salt bush mangrove (Arthrocnemum indicum), wild beery (Allophylus serratus), Black olum (Syzygium cumini), Needle bush (Azima tetracantha), glandular jatropha (Jatropha glandulifera), cat-thorn (Scutia myrtina), etc; AND WHEREAS, the Sanctuary has variety of birds, butterflies, reptiles, amphibians, mammals. Major bird species of the Sanctuary are cattle egret (Bubulcus ibs), bartailed godwit (Limosa lapponica) etc; and around 18 species of reptiles have been identified in the Sanctuary. The major reptiles are the Indian starred tortoise (Geochelone elegans), Indian chameleon(Chameleo zeylanicus), Indian monitor lizard (Varnus bengalensis), common skink (Mabuya carinataa), rat snake (Ptyas mucosus), common Indian bronzeback (Dendrolaphis tristis), the endangered olive ridley turtle (Lepidochely solivacea), etc nests in the shore of the Sanctuary. There are about 9 species of amphibians recorded which includes skipper frog (Rana cyanophlyctis), common green frog (Rana hexadactyla), tree frog (Polypedates maculates) and common toad (Bufo melanostictus), etc; AND WHEREAS, the Point Calimere Wildlife Sanctuary with Block B has great Vedaranyam swamp is the spawning and nursing ground for commercially important maritime prawns and fishes, such as P. enaeusindicus, P. monodon, Hilsa ilisha and Chanos chanos. Other than these anadromous species, the fish fauna of the swamp is mainly represented by mullet species. The marsh crab Scylla serratais a commercially important species from the swamp. The exotic Oreochromis mossambicus (Tilapia mossambica) is abundant in the reservoirs and low salinity condensers of industrial salt works, and in inundated areas of the Sanctuary during the monsoon. The coast of Point Calimere is an important fish landing site for fishes and prawns from November to February; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Point Calimere Wildlife Sanctuary with Block B which are specified in paragraph 1 as Eco-Sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 23 NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and

1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-Sensitive Zone shall be to an extent of 0.14 kilometre to 4.00 kilometres around the boundary of Point Calimere Wildlife Sanctuary with Block B and the area of the Eco-Sensitive Zone is 88.93 square kilometres.
(2) The extent and boundary description of Point Calimere Wildlife Sanctuary with Block B and its Eco- Sensitive Zone is appended in Annexure-I.
(3) The maps of the Point Calimere Wildlife Sanctuary with Block B demarcating Eco-Sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure- IIB, Annexure-IIC, Annexure-IID and Annexure-IIE.
(4) List of geo-coordinates of the boundary of Point Calimere Wildlife Sanctuary with Block B and Eco- Sensitive Zone are given in Table A and Table B of Annexure-III.
(5) The list of villages falling in the Eco-Sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-Sensitive Zone.- (1) The State Government shall, for the purposes of the Eco- Sensitive Zone, prepared a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent Authority of State.
(2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department;
(xii) Highways; and
(xiii) Tamil Nadu State Pollution Control Board.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
(10) The said Master Plan shall regulate development in Eco-Sensitive Zone so as to ensure eco-friendly development for local communities livelihood.
3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-Sensitive Zone shall not be used or converted into areas for major commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forest.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan. भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 25
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- Sensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) New construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-Sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-Sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-Sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-Sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-Sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone;
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:-
(a) The Bio-Medical Waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28 th March, 2016. 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(b) Safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- Sensitive Zone.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time.
(13) E-waste.- The E-waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-Sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-Sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.- The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-Sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 27 TABLE S. 1. Commercial mining, stone quarrying and crushing units.
(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities;
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21 st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). New industries and expansion of existing polluting industries in the Eco-Sensitive Zone shall not be permitted:
Provided that non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted.
3. Establishment of major hydro-electric project. Prohibited (except as otherwise provided) as per the applicable laws.
4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per the applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per the applicable laws.
6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-Sensitive Zone.
7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per the applicable laws. B. Regulated Activities
8. Commercial establishment of hotels and resorts. New commercial hotels and resorts shall not be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-Sensitive Zone, whichever is nearer, except for small temporary structures for ecotourism activities:
Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-Sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco- 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] S. No.

Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-Sensitive Zone shall be permitted by the competent Authority.
11. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
12. Collection of Forest produce or Non- Timber Forest produce. Regulated as per the applicable laws.
13. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies. Regulated (except otherwise provided) as per the applicable laws except for meeting local needs.
14. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated as per the applicable laws of underground cabling may be promoted.
15. Infrastructure including civic amenities. Taking measures of mitigation as per the applicable laws, rules and regulations available guidelines.
16. Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation as per the applicable laws, rules and regulation and available guidelines.
17. Undertaking other activities related to tourism like flying over the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated as per the applicable laws.
18. Protection of hill slopes and river banks. Regulated as per the applicable laws.

23. Open Well, Bore Well etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority.
24. Solid waste management. Regulated as per the applicable laws.
25. Introduction of exotic species. Regulated as per the applicable laws.
26. Eco-tourism. Regulated as per the applicable laws.
27. Use of polythene bags. Use of polythene bags are permitted within the Eco- Sensitive Zone: Provided based on specific requirement, it shall be regulated as per the applicable laws.
28. Commercial sign boards and hoardings. Regulated as per the applicable laws. C. Promoted Activities
29. Rain water harvesting. Shall be actively promoted.
30. Organic farming. Shall be actively promoted.
31. Adoption of green technology for all activities. Shall be actively promoted.
32. Cottage industries including village artisans, etc. Shall be actively promoted.
33. Use of renewable energy and fuels. Bio-gas, solar light etc. shall be actively promoted.
34. Agro-Forestry. Shall be actively promoted.
35. Plantation of Horticulture and Herbals. Shall be actively promoted.
36. Use of eco-friendly transport. Shall be actively promoted.
37. Skill Development. Shall be actively promoted.
38. Restoration of degraded land/ forests/ habitat. Shall be actively promoted.
39. Environmental awareness. Shall be actively promoted.
5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- 30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Sl. (ix) Tehsildar, Vedaranyam Taluk Member;
(x) District Forest Officer and Wildlife Warden Member-Secretary.
6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(1) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual sitespecific conditions and referred to the concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal. [F.
