PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 3589] ubZ fnYyh] 'kqØokj] fnlEcj 29] 2017@ikS"k 8] 1939 No. 3589] NEW DELHI, FRIDAY, DECEMBER 29, 2017/PAUSHA 8, 1939 पया�वरणपया�वरणपया�वरणपया�वरण, , , , वनवनवनवन औरऔरऔरऔर जलवायुजलवायुजलवायुजलवायु प�रवत�नप�रवत�नप�रवत�नप�रवत�न म ंालयम ंालयम ंालयम ंालय अिधसचूनाअिधसचूनाअिधसचूनाअिधसचूना नई �द�ली, 28 �दस�बर, 2017 काकाकाका.आआआआ.... 4108410841084108((((अ)अ)अ)अ).— ा�प अिधसूचना भारत के राजप�, असाधारण म� सरकार के पया वरण, वन और जलवायु प$रवत न म�ंालय क& अिधसूचना सं. का.आ. 72 (अ), तारीख 10 जनवरी, 2017 0ारा कािशत क& गई थी िजसम� ऐसे सभी 6ि7य8 से, िजनक& उससे भािवत होने क& संभावना थी, उस तारीख से, िजसको उ7 अिधसूचना को अ<त=व > करने वाले राजप� क& ितयां जनता को उपल?ध करा दी गई थ@, साठ �दन क& अविध के भीतर आBेप और सुझाव आमंि�त �कए गए थे; और, राजप� क& ितयां जनता को तारीख 10 जनवरी, 2017, को उपल?ध करा दी गई थ@; और, ा�प अिधसूचना के EयुFर म� सभी 6ि7य8 और पणधा$रय8 से ाG आBेप8 और सुBाव8 पर के<Hीय सरकार 0ारा स�यक Iप से िवचार �कया गया; और, रामपारा व< यजीव अभयारण् य, 15.01 वग �कलोमीटर Bे� म� फैला ह ैऔर गुजरात राMय के वांकानरे मुNयालय के साथ मोरबी िजले म� अBांश 22 31’82’’ उFर और 22 34’ 88 ‘’ और 70 55’54’’ पूव और 70 58’ 59’’ पूव दशेांतर के बीच अविOथत ह।ै रामपारा व<यजीव अभयारPय, कुल 270 पौध8 क& जाितय8 के साथ सबसे चुर और सघन जैव-िविवधता भाग8 म� स े एक ह ै िजसम� 52 वृB8 क& जाितया,ं 39 झािड़य8 क& जाितयां, 41 पव तरोिहय8 क& जाितयां, 97 जड़ी-बू$टय8 क& जाितयां और 41 घास8 क& जाितया ंसि�मिलत ह ैऔर यह अYछे गुणवFा वाले सागौन वन 0ारा चार8 ओर से आYछा�दत ह।ै अभयारPय म� उभयचर8 जैसे म�ढ़क, टोढ़, ^लैप-शेल कछुआ और िसतारा कछुआ का वास ह ै और सन् 1998 म� गुजरात पा$रिOथितक& िशBा और अनुसंधान (जीईईआर) सOंथान 0ारा अaययन म� अभयारPय म� 10 प$रवार8, 16 जेनेरा और 21 मकिड़य8 क& जाितय8, 15 सरीसृप8 क& जाितय8, 93 पिBय8 क& जाितय8 और 16 Oतनधा$रय8 क& जाितय8 को 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अिभिलिखत �कया गया। रामपारा व<यजीव अभयारPय म� महEवपूण संकटापc जाित फोिन�स साइटवेि �स पाई जाती ह।ै आईयूसीएन लाल सूची dेणी म�, सैकुरम ब�गाल�स, अनोगेसस लै�टफ़ोिलया, कॉिमपोरा वोगेई और िवओला िसने�रया दलु भ जाितयां हe जब�क टरकुला यरैून और �लैको�ट�या इंिडका संकटापc जाित हe। और, रामपारा व<यजीव अभयारPय म� मुNय जीव-ज<तु जाितय8 जसैे भेिड़या, fचंकारा, लकड़बgघा, िसयार, बनिवलाव, लोमड़ी, साही, बनैला सूअर, ?लू बलु, खरगोश आ�द सि�मिलत हe, के साथ वनOपित क& कई दलु भ और संकटापc जाितयां हe; और, रामपारा व< यजीव अभयारP य के चार8 ओर के Bे� को, िजसका िवOतार और सीमाए ंइस अिधसूचना के पैरा 1 म� िविनiद > हe, पा$रिOथितक&य पया वरणीय और जैव िविवधता क& दिृ> से पा$रिOथितक& सवंेदी जोन के �प म� सुरिBत और संरिBत करना तथा उ7 पा$रिOथितक& सवंेदी जोन म� उjोग8 या उjोग8 के वगk के चालन तथा सOंकरण करन ेको ितिषm करना आवnयक ह;ै और, पूव म� यह Bे� मोरबी िजले के रामपारा व<यजीव अभयारPय pाम8 के समHु तट और दलदलीय राजOव अपिश> भूिम थी और लवणता को रोकन ेके िलए और तEकालीन सतं कबीर राMय को पुनः ाG करन ेके िलए और तEपrात गुजरात सरकार ने तट पर भूिम-उmार बांध का िनमा ण �कया, िजससे पा$रिOथित म� उ�लेखनीय प$रवत न sआ ह ैऔर अतीत क& िOथित म� सधुार sआ मीठे पानी के बड़े तालाब के Iप म� उभरा ह ैऔर यह िविभc ाकृितक जलीय वनOपितय8 का समथ न करता ह ैजो बदले म� इस Bे� म� कई वासी और िनवासी पिBय8 का समथ न करता ह ैऔर यह उनके बसेरे और घ8सले के िशकार के िलए भी उपयु7 ह;ै और, रामपारा व<यजीव अभयारPय क& आH भिूम पा$रिOथितक- णाली पालाकै$र�क$टक Bे� स े वासी जल वाह के िलए शीत भूिम ह ैऔर आH भूिम पिBय8 क& कई जाितय8 के िलए महEवपूण सदt और जनन भूिम के �प म� काय करता ह;ै और इस अभयारPय म� भारत म� एक असामा<य जनक, pेट uOटेड pबे,े (पोिडसेwस �uOटटस) के जनन क& $रपोट क& जाती ह;ै और, 1956 म� dेx राMय संत कबीर और महाराy सरकार 0ारा रामपारा व<यजीव अभयारPय भूिम-उmार बांध का िनमा ण �कया गया था और इस Mवलंत और कई वासी के साथ-साथ िनवासी पिBय8 के िलए Bे� के महEव को जाना, गुजरात सरकार ने इस Bे� को पBी अभयारPय के �प म� सरकारी अिधसूचना सं. एकेएच-81-ड?�यूएलपी-1081-102123/ पी -2 तारीख 27 मई, 1981 और एकेएच-209/82-ड?लूएलपी/1081/102123-वी-2 , तारीख 6 नव�बर, 1982 के अनुसार घोिषत �कया; और, उपरो7 संरिBत Bे� के वंशानुगत संसाधन8 को सधुारने तथा प$ररिBत करन ेके उzेnय से आवास बंध 0ारा पा$रिOथितक& तथा पया वरणीय दिृ> से पा$रिOथितक& संवेदी जोन के Iप म� रामपारा अभयारPय के चार8 ओर के Bे� को, िजसका िवOतार और सीमाए ं इस अिधसूचना के पैरा 1 म� िविनiद > हe, सुरिBत और संरिBत करना, तथा Oथानीय जाितय8 को पुनः लाना तथा उनका पुनवा स करना, पया वरणीय िशBा तथा पा$रिOथितक अनुसंधान का सवंध न करना तथा उ7 पा$रिOथितक& सवेंदी जोन म� उjोग8 या उjोग8 के वग{ के चालन तथा संOकरण करन ेको ितिषm करना आवnयक ह;ै अतः, अब, के<Hीय सरकार, पया वरण (संरBण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प$ठत पया वरण (संरBण) अिधिनयम, 1986 (1986 का 29) क& धारा 3 क& उपधारा (3) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (1) 0ारा दF शि7य8 का योग करत ेsए, गुजरात राMय म� रामपारा व< यजीव अभयारP य क& सीमा के लगभग 0.17 �कलोमीटर और 4.25 �कलोमीटर के िवOतार तक रामपारा व< यजीव अभयारP य पा$रिOथितक& संवेदी जोन (िजस ेइसम� इसके पn चात ्पा$रिOथितक& सवंेदी जोन कहा गया ह)ै के �प म� अिधसूिचत करती ह,ै िजसका िववरण िन|ानुसार ह,ै अथा त ्:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(1) (1) (1) (1) पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर उसक�उसक�उसक�उसक� सीमाएंसीमाएंसीमाएंसीमाएं--------(1) (1) (1) (1) रामपारा व< यजीव अभयारP य पा$रिOथितक& सवंेदी जोन का Bे� 31.08 वग �कलोमीटर तक होगा। पा$रिOथितक& सवंेदी जोन और सरंिBत Bे� के चार8 ओर पा$रिOथितक& सवंेदी जोन का <यूनतम और अिधकतम िवOतार uमशः लगभग 0.17 �कलोमीटर और 4.25 �कलोमीटर के मaय होगा। (2) पा$रिOथितक& सवंेदी जोन का मानिच�, सीमा के ?यौर8 और अBांश8 तथा दशेांतर8 सिहत उपाबंधउपाबंधउपाबंधउपाबंध IIII के �प म� उपाबm ह ै। (3) रामपारा व< यजीव अभयारP य और इसके पा$रिOथितक& सवंेदी जोन भ-ूिनद}शांक उपाबंधउपाबंधउपाबंधउपाबंध II II II II के �प म� उपाबm ह ै। (4) रामपारा पा$रिOथितक& संवेदी जोन म� आन ेवाले pाम8 क& सूची उपाबधंउपाबधंउपाबधंउपाबधं III III III III के �प म� उपाबm ह ै। 2222.... पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलकआचंिलकआचंिलकआचंिलक महायोजनामहायोजनामहायोजनामहायोजना....–––– (1) राMय सरकार, पा$रिOथितक& सवंेदी जोन के िलए राजप� म� इस अिधसूचना के काशन क& तारीख से दो वष क& अविध के भीतर, Oथानीय 6ि7य8 के परामश से और इस अिधसूचना म� सलंg न अनुबंध8 के सामंजO य स ेआंचिलक महायोजना तैयार करेगी । (2) आचंिलक महायोजना राM य सरकार म� सBम ािधकारी 0ारा अनुमो�दत क& जाएगी। (3) राMय सरकार 0ारा पा$रिOथितक& सवंेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म� िविनiद ~ ट �प तथा ससुंगत क� Hीय और राM य िविधय8 के सामंजO य और क� Hीय सरकार 0ारा जारी माग िनद}श8, य�द कोई ह8, 0ारा तैयार होगी । (4) आंचिलक महायोजना, पया वरणीय और पा$रिOथितक& िवचार8 को समाकिलत करने के िलए राM य सरकार के सभी संबm िवभाग8 के परामश से तैयार क& जाएगी, अथा त्:--
(i) पया वरण;
(ii) वन और व<यजीव;
(iii) कृिष;
(iv) राजOव;
(v) शहरी िवकास ;
(vi) पय टन;
(vii) pामीण िवकास;
(viii) fसंचाई और बाढ़ िनयं�ण;
(ix) नगरपािलका;
(x) पंचायती राज; और
(xi) लोक िनमा ण िवभाग । (5) आंचिलक महायोजना अनुमो�दत िवjमान भ-ूउपयोग, अवसंरचना और �uयाकलाप8 पर कोई िनब�धन अिधरोिपत नह@ करेगी, जब तक �क इस अिधसूचना म� िविनiद ~ ट न हो,और आचंिलक महायोजना सभी अवसंरचना और �uयाकलाप8 म� और अिधक दBता और पा$रिOथितक& अनकूुलता का संवध न करेगी । (6) आंचिलक महायोजना म� अनाYछा�दत Bे�8 के जीणkmार, िवjमान जल िनकाय8 के संरBण, आवाह Bे�8 के बंधन, जल-संभर8 के बंधन, भूतल जल के बंधन, मृदा और नमी संरBण, Oथानीय समुदाय8 क& आवnयकता� तथा पा$रिOथितक& और पया वरण स ेसबंंिधत ऐसे अ<य पहलु�, िजन पर aयान दनेा आवnयक ह,ै के िलए उपबंध ह8गे । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(7) आंचिलक महायोजना सभी िवjमान पूजा O थल8, pाम8 और नगरीय बंदोबOत8, वन8 के कार और �कO म8, कृिष Bे�8, ऊपजाऊ भूिम, ह$रत Bे� जैस ेउjान और उसी कार के O थान, उjान कृिष Bे�, जनजाित Bे� फलोउjान, झील8 और अ<य जल िनकाय8 का अ�यकंन करेगी । (8) आंचिलक महायोजना O थानीय समुदाय8 क& जीवकोपाज न को सुिनिn चत करने के िलए, पा$रिOथितक& सवंेदी जोन म� िवकास को पा$रिOथितक& अनुकूल िवकास के िलए िविनयिमत करेगी । (9) ऐसी अनुमो�दत आंचिलक महायोजना, मानीटरी सिमित के िलए इस अिधसूचना के उपबंध8 के अनुसार मानीटरी के काय करने के िलए एक संदभ दOतावेज होगी । 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय-------- राMय सरकार इस अंितम अिधसूचना के उपबंध8 को भावी करन ेके िलए िन|िलिखत उपाय करेगी, अथा त् :-- (1) भूभभूूभू----उपयोग.उपयोग.उपयोग.उपयोग.---- पा$रिOथितक& सवंेदी जोन म� वन8, उjान-कृिष Bे�8, कृिष Bे�8, आमोद- मोद के योजन के िलए िचि<हत �कए गए पाक{ और खुले Oथान8 का वृहद वािणिMयक या वृहद आवासीय का�पलै�स या औjोिगक �uयाकलाप8 के िलए उपयोग या संप$रवत न नह@ होगा: परंतु पा$रिOथितक& सवंेदी जोन के भीतर कृिष और अ<य भूिम का संप$रवत न मानीटरी सिमित क& िसफा$रश पर और यथा लागू Bे�ीय नगर योजना अिधिनयम राMय सरकार के अ<य िनयम8 तथा िविनयम8 के अधीन राMय सरकार8 के पूव अनुमोदन से, Oथानीय िनवािसय8 क& िन|िलिखत आवासीय ज�रत8 को पूरा करन े के िलए अनु�ात �कया जा सकेगा, जसै े:-
(i) िवjमान सड़क8 को चौड़ा करना और उ<ह� सुदढृ करना तथा नई सड़क8 का संिनमा ण;
(ii) बुिनयादी सुिवधा� और नाग$रक सुिवधा� का िनमा ण और नवीकरण;
(iii) दषूण का$रत न करने वाल ेलघु उjोग;
(iv) pामीण उjोग8 सिहत कुटीर उjोग; सुिवधा भPडार और Oथानीय सुिवधाए ंजो पा$रिOथितक& पय टन म� सहायक हe िजसके अंतग त गृह वास भी ह;ै
(v) सवं=ध त �uयाकलाप और पैरा-4 म� व=ण त �uयाकलाप : परंतु यह और �क जनजातीय भूिम का उपयोग राMय सरकार के पूव अनुमोदन और संिवधान के अनुY छेद 244 या तEसमय वृF िविध के उपबधं8 के अनुपालन के िबना, िजसके अंतग त अनुसूिचत जनजाित और अ<य परंपरागत वन िनवासी (वन अिधकार8 क& मा<यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिMयक या उjोग िवकास �uयाकलाप8 के िलए अनु�ात नह@ होगा : परंतु यह और भी �क पा$रिOथितक& सवंेदी जोन के भीतर भू-अिभलेख8 म� उपसंजात कोई �ु$ट, मानीटरी सिमित के िवचार ाG करन ेके पrात् राMय सरकार 0ारा Eयेक मामले म� एक बार संशोिधत होगी और उ7 �$ुट के संशोधन क& सूचना क� Hीय सरकार के पया वरण, वन और जलवायु प$रवत न मं�ालय को दनेी होगी। परंतु यह और भी �क उपयु 7 �ु$ट का संशोधन म� इस उप पैरा के अधीन यथा उपबंिधत के िसवाय �कसी भी दशा म� भू-उपयोग का प$रवत न सि�मिलत नह@ होगा । परंतु यह और भी �क ह$रत Bे� जैसे वन Bे�, कृिष Bे� आ�द म� कोई पा$रणािमक कटौती नह@ होगी और अ यु� त या अनुE पादक कृिष Bे�8 म� पुन: वनीकरण करन ेके यास �कए जाएंगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(2) �ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत - आचंिलक महायोजना म� सभी ाकृितक जल �ोत8 क& पहचान क& जाएगी और उनके संरBण और पुनI�भूतकरण के िलए योजना सि� मिलत होगी और राM य सरकार 0ारा ऐसे Bे�8 पर या उनके िनकट िवकास �uयाकलाप ितिषm करने के िलए ऐसी रीित से माग िनद}श तैयार �कए जाएंगे । (3) पय�टन पय�टन पय�टन पय�टन –––– ––––(क) पा$रिOथितक& सवंेदी जोन के भीतर सभी नए पा$रिOथितक& पय टन �uयाकलाप या िवjमान पय टन �uयाकलाप8 का िवOतार पा$रिOथितक& सवंेदी जोन सबंंधी पय टन महायोजना के अनसुार होगा । (ख) पा$रिOथितक& पय टन महायोजना पय टन िवभाग, 0ारा राMय सरकार के पया वरण और वन िवभाग के परामश से तैयार होगी । (ग) पय टन महायोजना आंचिलक महायोजना का एक घटक होगी । (घ) पा$रिOथितक& पय टन सबंंधी �uयाकलाप िन|ानुसार िविनयिमत ह8गे,:- (i) रामपारा व<यजीव अभयारPय क& सीमा स ेएक �कलोमीटर के भीतर या पा$रिOथितक& सवंेदी जोन क& सीमा तक, इसम� जो भी िनकट हो, �कसी होटल या $रसोट का नया संिcमा ण अनु�ात नह@ �कया जाएगा : पर<तु, व<यजीव अभयारPय क& सीमा से एक �कलोमीटर क& दरूी से परे पा$रिOथितक& सवंेदी जोन क& सीमा तक नए होटल8 और $रसोट{ क& Oथापना पय टन महायोजना के अनसुार पा$रिOथितक& पय टन सुिवधा� के िलए पूव सीमां�कत और पदािभिहत Bे�8 म� अनु�ात क& जाएगी। (ii) पा$रिOथितक& सवंेदी जोन के अ<दर सभी नए पय टन �uया-कलाप8 या िवjमान पय टन �uयाकलाप8 का िवOतार के<Hीय सरकार, पया वरण, वन और जलवायु प$रवत न मं�ालय 0ारा जारी माग दशt िसmांत8 तथा पा$रिOथितक& पय टन पर बल दतेे sए राyीय बाघ संरBण ािधकरण 0ारा जारी पा$रिOथितक& पय टन माग दशt िसmांत8 के अनुसार होगा । (iii) आंचिलक महायोजना का अनुमोदन �कए जान े तक, पय टन के िवकास तथा िवjमान पय टन �uयाकलाप8 के िवOतार को वाOतिवक Oथल िविनiद > संवीBा तथा मानीटरी सिमित क& िसफा$रश के आधार पर संबिंधत िविनयामक ािधकरण8 0ारा अनु�ात �कया जाएगा और पा$रिOथितक& सवंेदी जोन के भीतर �कसी नय ेहोटल $रसाट या वािणिMयक ितxान का संिcमा ण अनु�ात नह@ होगा । (4) नसै"ग�कनसै"ग�कनसै"ग�कनसै"ग�क िवरासतिवरासतिवरासतिवरासत -------- पा$रिOथितक& सवंेदी जोन म� महEवपूण नैस=ग क िवरासत के सभी Oथल8 जैसे सभी जीन कोश आरिBत Bे�, शैल िवरचनाए,ं जल पात8, झरन8, घाटी माग{, उपवन8, गुफाएं, Oथल8, �मण, अ�रोहण, पातो आ�द क& पहचान क& जाएगी और उ<ह� संरिBत �कया जाएगा तथा उनक& सरुBा और संरBा के िलए इस अिधसूचना के अंितम काशन क& तारीख स ेछह मास के भीतर, उपयु7 योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थमानव िन"म�त िवरासत � थल ल ल ल ---- पा$रिOथितक& सवंदेी जोन म� भवन8, संरचना�, िश�प-त�य, ऐितहािसक, कलाEमक और सांOकृितक महEव के Bे�8 क& पहचान क& जाएगी और इस अिधसूचना के काशन क& तारीख से छह माह के भीतर उनके संरBण क& योजनाए ंतैयार क& जाएगी तथा ऐसी योजना आंचिलक महायोजना का भाग होगी। (6) $ व$ व$ व$ विन �दषूणिन �दषूणिन �दषूणिन �दषूण – पा$रिOथितक& सवंेदी जोन म� a विन दषूण का िनवारण और िनय�ंण पया वरण (संरBण) अिधिनयम, 1986, 2000 के अधीन aविन दषूण (िविनयमन और िनय�ंण) िनयम8 के अनुसार काया ि<वत होगा । (7) वायुवायुवायुवायु �दषूण�दषूण�दषूण�दषूण - पा$रिOथितक& सवंेदी जोन म�, वाय ु दषूण का िनवारण और िनय�ंण वाय ु( दषूण िनवारण और िनयं�ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम8 के उपबंध8 के अनुसार काया ि<वत होगा । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

18. वािणिMयक जल संसाधन िजसके अंतग त भू-जल संचयन भी ह ै। (क) भूिम के अिधभोगी को केवल वाOतिवक कृिष उपयोग और घरेलू खपत के िलए सतही जल और भूिमगत जल िन~कष ण अनु�ात होगा; (ख) औjोिगक, वािणिMयक उपयोग के िलए सतही और भूिमगत जल का िन~कष ण के िलए सबंंिधत िविनयामक ािधकरण पूव िलिखत अनु�ा अपेिBत होगी िजसके अंतग त �कतने प$रणाम म� वह िन~कष ण करेगा, भी ह;ै (ग) सतही जल या भूजल का िवuय अनु�ात नह@ होगा; (घ) जल के संदषूण या दषूण, िजसके अंतग त कृिष भी ह,ै को रोकन ेके िलए सभी उपाय �कए जाएगंे ।

AND WHEREAS, copies of the Gazette containing the draft notification were made available to the public on the 10 th January, 2017; AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government; AND WHEREAS, the Rampara Wildlife Sanctuary spread over an area of 15.01 square kilometres is situated between latitude 22 31’ 82” N and 22 34’88’’ N and between 70 55’54’’ E and 70 58’59’’ E longitude in Morbi district with the headquarters at Wankaner in the State of Gujarat and is one of the richest and compact bio-diversity patches with a total 270 species of plants which include 52 species of trees, 39 species of shrubs, 41 species of climbers, 97 species of herbs and 41 grasses and it is covered on all sides by very good quality teak forest, and he said Sanctuary is a home to Amphibians such as Frogs, Toads, Flap-shell Turtle and Star tortoise and the study carried out by the Gujarat Ecological Education and Research (GEER) foundation in the year 1998 has recorded 10 families, 16 genera and 21 species of spiders in the Sanctuary, 15 species of reptiles, 93 species of birds and 16 species of mammals; Phoenix sytvestries is the important threatened species found in the said Sanctuary and in the International Union for Conservation of Nature (IUCN) redlist category, Saccharum bengalense, Anogeissus latifolia, Commiphora wightii and Viola cinerea are the rare species while Sterculia urens and Flacourtia indica are the threatened species; AND WHEREAS, the Rampara Wildlife Sanctuary includes Wolf, Chinkara, Hyana, Jackal, Jungle Cat, Fox, Porcupine, Wild boar, Blue bull, Hare, etc. as the major faunal species along with many rare and endangered species of flora; AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Rampara Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; AND WHEREAS, formerly this area was a sea-coast and marshy revenue waste land of villages Rampara Wildlife Sanctuary of Morbi district and to prevent salinity ingress and to reclaim the land, the erstwhile Sant Kabir State and subsequently the Government of Gujarat constructed a reclamation bund along the coast, which made a remarkable change and improvement in the situation that prevailed in the past as large pond of sweet water has emerged and this supports a variety of natural aquatic vegetation which in turn supports numerous migratory and resident birds in this area and it is also suitable for their roosting and nesting ; AND WHEREAS, the wetland eco-system of Rampara Wildlife Sanctuary is a wintering ground for migratory waterfowls from Palacarcitic region and serves as an important wintering and breeding ground for many species of wetland birds, and an uncommon breeder in India, Great crested grebe, (Podiceps cristatus), is reported breeding in this sanctuary ; AND WHEREAS, Rampara Wildlife Sanctuary reclamation bund was constructed by the Princely State of Sant Kabir and Government of Maharastra in 1956 and on realising the importance of the area for the vivid and numerous migratory as well as resident birds, the Government of Gujarat declared this area as Bird Sanctuary vide Government notifications No. AKH-81-WLP-1081-102123/P-2 dated the 27 th May, 1981 and AKH-209/82-WLP/1081/102123-V-2, dated the 6 th November, 1982; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Rampara Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view by habitat management aiming at improving and preserving the genetic resources of above protected area, reintroduction and rehabilitation of local species, promotion of environmental education and ecological research and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying between 0.17kilometer and 4.25 kilometers around the boundary of Rampara Wildlife Sanctuary in the State of Gujarat as the Rampara Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The area of the Eco-sensitive Zone is 31.08 square kilometers and the minimum and maximum extent of the Eco-sensitive Zone is 0.17 kilometer and 4.25 kilometers respectively surrounding the protected area of the Rampara Wildlife Sanctuary.
(2) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-I
(3) The Geo-coordinates of Rampara Wildlife Sanctuary and its Eco-sensitive Zone is given in Annexure-II.
(4) The list of villages falling within the Eco-sensitive Zone is appended as Annexure-III.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of the this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal ;
(x) Panchayati Raj ; and
(xi) Public Works Department.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development and livelihood security of local communities.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of the this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this final notification, namely:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities :
Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Governments to meet the residential needs of the local residents, and for activity such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and
(v) promoted activities and given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism - (a) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within one kilometer from the boundary of the Rampara Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometer from the boundary of the said Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within the Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation within six months from the date of publication of this notification in the Official Gazatte and such plan shall from part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] conservation shall be prepared within six months from the date of publication of this notification in the official Gazatte and such plan shall from part of the Zonal Master Plan.
(6) Noise pollution.- Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act,
1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the water (Prevention control of pollution ) Act, 1974 (6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016, as amended from time to time.
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Vehicular pollution.- -Prevention and control of vehicular pollution in the Eco-sensitive Zone shall be carried out in accordance with applicable laws and effort shall be made for use of cleaner fuel for example CNG, etc.
(13) Plastic waste management:- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(14) Construction and demolition waste management:- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(15) E-waste- The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(16) Industrial units.- (i) No new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in the this notification.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. Prohibited, Regulated and Promoted Activities.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 TABLE S.No. Activity Remarks

1. Commercial mining, stone quarrying and crushing units.
(a) New mining (minor and major minerals), stone quarrying and crushing units shall be prohibited except for the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal consumption.
(b) The mining operations shall strictly be in accordance with the orders of the Hon’ble Supreme Court dated the 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon’ble Supreme Court dated the 21 st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
4. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
5. Establishment of major thermal and hydro-electric projects. Prohibited (except as otherwise provided) as per applicable laws.
6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
7. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.
8. Use of polythene bags. Prohibited (except as otherwise provided) as per applicable laws.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws. Regulated activities
10. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the protected area or the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometre and upto the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Tourism Master Plan.
11. Construction activities.
(a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of protected area or of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] authority as per the applicable rules and regulations, if any.
(c) Beyond one kilometre upto the extent of Eco-sensitive Zone, construction for bone fide local needs shall be permitted and other construction activities shall be regulated as per the Zonal Master Plan.
12. Discharge of treated effluents and solid waste in natural water bodies or land area. Regulated under applicable laws.
13. Air and vehicular pollution. Regulated under applicable laws.
14. Introduction of exotic species. Regulated under applicable laws.
15. Extraction of ground water. Regulated under applicable laws.
16. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government;
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder;
(c) In case of Reserve Forests and Protected Forests, the Working Plan prescriptions shall be followed.
17. Erection of electric cables. Regulated under applicable laws.
18. Commercial water resources including ground water harvesting.
(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land.
(b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted shall require prior written permission from the concerned regulatory authority.
(c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
19. Undertaking activities related to tourism like over-flying the protected area by aircraft, hot-air balloons. Regulated under applicable laws.
20. Installation of electric lines. Regulated under applicable laws; (underground cabling shall be promoted). .
21. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
22. Fencing of existing premises of hotels and lodges. Regulated under applicable laws; (In order to allow free movement of wildlife, hotels or other commercial establishments within the Eco-sensitive Zone shall not fence their properties with barbed wire and no fence shall be higher than one meter and any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan).
23. Drastic change of agriculture systems. Regulated under applicable laws.
24. Movement of vehicular traffic at night. Regulated under applicable laws.
25. Sign boards and hoardings. Regulated under applicable laws.
26. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23
5. Monitoring Committee.- The Central Government within three months of this Notification, constitutes a Monitoring Committee, for effective monitoring of the provisions of the final notification, comprising of the following, namely:-
1. Collector, Morbi District Chairman
2. A representative of the Ministry of Environment, Forests and Climate Change , Government of India Member
3. One representative of Non-governmental Organisations working in the field of environment to be nominated by the Ministry of Enviornment, Forest and Climate Change Government of India Member
4. Regional Officer, Gujarat State Pollution Control Board, Morbi Member Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
27. Collection of non-timber forest products. Regulated under applicable laws.
28. Trekking and camping. Regulated under applicable laws.
29. Protection of hill slopes and river banks. No construction activity unless otherwise permitted under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 degree and also upto 100 meters from the banks of any river or natural nallah.
30. Solid waste management. Regulated under applicable laws.
31. Eco-tourism. Regulated under applicable laws. Promoted activities
32. Ongoing agriculture practices, plantation and other forestry activity. Shall be actively promoted.
33. Organic farming. Shall be actively promoted.
34. Adoption of green technology for all activities. Shall be actively promoted.
35. Cottage industries including village artisans. Shall be actively promoted.
36. Rain water harvesting. Shall be actively promoted.
37. Use of renewable energy sources. Shall be actively promoted.
38. Plantation and other forestry activity. Shall be actively promoted.
39. Agro forestry. Shall be actively promoted.
40. Restoration of degraded land/ forests/ habitat. Shall be actively promoted.
41. Skill development. Shall be actively promoted.

6. Terms of reference:
(1) The Monitoring Committee shall monitor the compliance of the provisions of the final Notification.
(2) The tenure of the Monitoring committee is for three (3) years or till the Constitution of the new Committee by the State Government.
(3) The first Monitoring Committee shall be constituted within three months from the date of publication of this Notification.
(4) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(5) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(6) The Member Secretary of the Monitoring Committee or the concerned Collector (s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of the this notification.
(7) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(8) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-IV.
(9) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc. Orders.- The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
